Abstract:
The manual discusses the role of judicial practice in the implementation of the mechanism of legal monitoring on the Federal, regional and local levels. It justifies significance of judicial practice as an integral part of the legal monitoring, since it is the judiciary, which is constant- Janno being at the turn of sometimes conflicting interests to have the most complete information about the quality of legislation. Describes the theoretical and normative foundations of legal monitoring, its organization and influence on the development of procedural law and the legal system. Special attention given the anti-corruption monitoring. The work is aimed at resolving issues of implementation of legal monitoring in the activities of public authorities, business-structures, public organizations and other civil society institutions in order to make informed proposals on optimization of the Russian legislation. For deputies, employees of state and municipal authorities, representatives of civil society institutions, scientific workers, teachers, postgraduates and students of law universities and faculties.

The manual is devoted to making individual complaints to the European Court of human rights: peculiarities of realization of the right to appeal, conditions of admissibility and the judicial procedure of the European Court of Human Rights. The author analyses some “autonomous concepts” used in the court's case law and touches upon the possibility of limiting the right to judicial protection. The article deals with the formation and development of the individual's rights to international judicial protection, as well as the protection of human rights in universal quasi-judicial international bodies and regional judicial institutions of the European Union and the Organization of American States. Abstract:
This chapter discusses the evolution of the New Judicial Federalism, reflecting the realization that state constitutional rights provisions can provide, or be interpreted to provide, more rights than the federal Constitution's national minimum standards. It describes the wide variety of state constitutional rights provisions, together with the various stages of the New Judicial Federalism beginning in the 1970s. These developments consisted of state high court decisions, law review literature, including influential articles written by state judges as well as Justice William Brennan, Jr., and conferences. Also, the chapter describes the backlash against the New Judicial Federalism and the awareness that expansive judicial interpretations of state constitutions could be overturned by amendments to the texts of state constitutions. The chapter concludes with the suggestion that a true dialogue between state and federal courts concerning constitutional rights might be possible.

This concluding chapter looks back, reviewing key insights from the case studies, and outward, reflecting on what the horizontal dimension of rights suggests about constitutionalism more broadly. The conclusion introduces short shadow case studies (Poland, China, the European Court of Justice, and the United Kingdom) that shed more light on the dynamics of horizontal rights and underscore how their impact is sensitive to institutional and political differences. The chapter considers linkages between horizontal effect and two other prominent developments in constitutionalism, proportionality review and weak-form judicial review. It concludes by suggesting that horizontal rights can serve as engines of political integration, prompting multibranch engagement in the business of giving concrete form to a nation’s most fundamental commitments.

Abstract:
Women’s activism in the judicial arena has a long history. This chapter reviews the scholarly literature to provide core insights into women’s struggles and their legal successes in the courts. It begins with a broad definition of women’s legal activism and describes barriers that historically prevented women from fully participating in the courts. Women’s legal activism has played a significant role in removing these barriers. The chapter also discusses key events in feminist law, including the Roe v. Wade decision, congressional passage of the 1963 Equal Pay and 1964 Civil Rights Acts, and the 1971 Reed v. Reed decision. These legal developments erected important legal platforms for pursuing further rights and equality for women, for instance, in the areas of sexual harassment and pregnancy discrimination. In recent years, women have continued their legal efforts to expand the reach of the Fourteenth Amendment and Title VII and to protect reproductive rights.
