Full textThe contemporary right set up the right to the enforcement of the judgments. Affirmed with force by the European Convention of the humans right, this right forms now part of the right to a fair trial stated by article 6 of European Convention. Often, it was marked that the right was related to faculty to force, it seems indeed that the enforcement of the judgment is the most important phase of the procedure since it is supposed to concretize it. Consequently, it is necessary to know if the right, so much at the national level than European, offers a concrete capacity to us to carry out the judgments. In the absence of right to enforce the judgment, the interest of the litigants in the engagement of a procedure would be seen reduced, moreover the enforcement's lack of the decisions would be incompatible with the principle of the rule of the law which the States began to respect by ratifying European Convention

Full textTraditionally, the post-adjudicative phase has been considered from the perspective of the creditor State in order to determine how to get the other State party to the dispute to comply with the international judgment. The purpose of this research is a complementary analyse in relation to those already carried out on the enforcement of international judgments. It takes the State party obliged to implement a decision of an international tribunal as the starting point of the analysis. What are the legal principles that govern this post-judgment stage. What means are implemented by States in the domestic or the international orders to comply with this decision of an international tribunal? This study demonstrates that this obligation is technically realized, as the case may be, by the cooperation between the States parties to the dispute adopting bilateral agreements or establishing, for example, joint committees of demarcation, and by the unilateral initiative of the State implementing national measures requested by the international obligation. The proliferation of international and regional courts and tribunals with compulsory jurisdiction results in the multiplication of litigations and, accordingly, in an increase of cases where a State is obliged to implement an international judgment. The States concerned seem to adapt more and more their domestic legal orders to this assumption in order to facilitate the implementation of the legal obligation to implement the decisions and awards of international tribunals

Full textThe payment of claims of creditors of bankruptcy admitted in case-law since the 19th century on the grounds of civil law rules is today the result of a process of reinstatement and appropriation into bankruptcy of generally accepted civil law rules. Section 40 of the 25/1/1985 act created a general preferential claim securing the claims regularly incurred after the adjudication order. It has thus legitimated and justified these creditors of bankruptcy claims preferential payment, on the grounds of a preferential right. This preferential right secures the claims as defined in section 40 as 1) valid -2) subsequent to the adjudication order -3) including a continuance of activity, in conformity with the general principles of secured debt law. This preferential payment can be executed either when falling due or as a hierarchy payment, but case-law shows that payments at due date of claims under section 40 tend to prevail. The payment is conditioned by the implicit availability of sufficient funds -a pivot condition for this mode of payment and a limit between the fields of payment at due date and hierarchy payment. This condition implies a statement of 'failure to pay at due date' left to the discretion of the court. By reference to case-law against assignees for pecuniary harm sustained through non-payment of claims incurred in day-to-day business transactions and non-performance of contracts preexisting to but to be carried out after the date of the adjudication order, as described in section 37, this condition would be fulfilled with firms near insolvency. Lastly, the enforcement of this set of rules of payment to creditors of bankruptcy raises questions about the 'free to levy a distress rule' as allowed by the french "cour de cassation" since the 19th century

Full textThe objective of our research is to account for the way in which we judge the acts of someone accused of crimes against humanity, of murder or of negligence in contexts which respectively call upon the history of a country, the stereotyped perception of a criminal and the anger which can cause a failing justice. We wonder if, in such contexts, we reason like a lawyer while following the legal concepts of responsability and guilt (Hart et Honoré, 1985) resulting from the models of attribution (Fincham et Jaspars, 1980) or if our judgement is related to our group of membership, to the defendant's one (Tajfel, 1972; Turner, 1979) and to our emotions (Frijda and Mesquita, 1994; Goldberg et al. , 1999).
