Can archaeology be considered a factor of socio-economic development for civil society? This, in short, is the question underlying the first national workshop devoted to Public Archaeology (Archeologia Pubblica in Toscana: un progetto e una proposta, Aula Magna, 12 July 2010), organised by the Chair of Mediaeval Archaeology of the University of Florence with the collaboration of the Universities of Pisa and Siena. The meeting also provided the opportunity to communicate the socio-economic results of a case study of projects that the Tuscan universities have recently successfully developed in this sector, involving local authorities, museums, public and private enterprises in forms of active partnership. Public archaeology is seen as the updating of the original vocation of the discipline to address the contemporary, in terms of economics, governance, communication, identity of the archaeological assets and the respective social communities.

Issues related to collective decision making and to Condorcet jury theorems have been studied and publicly discussed for over two hundred years. Recently, there is a burgeoning interest in the topic by academicians as well as practitioners in the fields of Law, Economics, Political Science, and Psychology. Typical questions are: What is the optimal size of a panel of decision makers such as a jury, a political committee, or a board of directors? Which decision rule to utilize? Who should be the members of the team, representatives or professionals? What is the effect of strategic behaviour, group dynamics, conflict of interests, free riding, social interactions, and personal interdependencies on the final collective decision? This article presents current thinking in the field, offers suggestions for further research, and alludes to possible future developments regarding public choice and collective decision making.

This chapter analyzes how researchers and courts can cope with modern challenges for 21st-century criminal jury trials and discusses what should be expected from criminal juries and future jury research. The chapter asks how a receptive legal system interested in making changes to maximize the fairness of criminal jury trials might respond. It reviews the important themes and massive empirical literature that this remarkable collection presents in vivid and thoughtful detail, highlighting the persistent issues of race and ethnicity, as well as new challenges and opportunities that have accompanied the dramatic advances in technology. The chapter raises questions about the application of empirical findings on jury behavior in the context of the legal system and considers the omissions and incomplete understandings that future research needs to address in order to provide a full picture of this important human institution.

This essays explores several epistemological related elements in the early modern English jury trial environment. Witnessing, credibility, testimony, doubt, suspicion, equivocation, conscience, fact, and oaths are frequent topics in law and literature studies. In one way or another, all of them raise questions of truth-telling, fact-finding, and epistemology. This environment included oath taking, the credibility of oath and non oath takers, the rhetorical origins of credibility criteria, casuistry, and the legal language of ‘satisfied conscience’, and the interplay between ‘truth’ and ‘mercy.’ It also discusses the consistency, tension, and/ or conflict between conceptual elements and the practices of grand jurors, jurors, and judges.

Without assuming prior legal knowledge, books in the Directions series introduce and guide readers through key points of law and legal debate. Questions, diagrams, and exercises help readers to engage fully with each subject and check their understanding as they progress. This chapter discusses the mens rea elements of a criminal offence. There are two types of intention: direct and oblique. A person directly intends a consequence that he desires. Where he instead merely appreciates that it is virtually certain to occur, a jury may find he intended the consequence. This is oblique intent. Subjective recklessness requires two questions to be asked: (a) did D foresee the possibility of the consequence occurring; and (b) was it unreasonable to take the risk? The actus reus and mens rea must coincide in time for the defendant to be guilty. The continuing act or ‘single transaction’ theories might be employed to establish coincidence.

Abstract:
This chapter provides a brief overview of the history of the modern U.S. intelligence community, with specific reference to the causes and consequences of major reform efforts. Pearl Harbor generated intense pressure to build an intelligence system capable of providing warning of future attacks, culminating in the creation of the modern intelligence community in 1947. Sixty years later, the September 11 attacks led to another round of organizational changes. This chapter describes and evaluates those changes, noting that the jury is still out on basic questions about the relationship between organizational design and intelligence performance. It then turns to contemporary debates over analysis, intelligence-policy relations, and politicization. The conclusion suggests avenues of future research on these issues.
