Abstract:
Consolidated imperial rule tends to alter the relationships among indigenous elites. Some elite groups may adjust to the new regime by joining it or otherwise becoming collaborators in rule. Others may see a marked deterioration in their former ruling status and honor. Groups which cooperated politically during the pre-colonial period may experience new tensions and enter into relationships of a more adversary nature. It is sometimes difficult for observers of social and political change to see clearly the nature of the new conflicts among elites and the directions of cleavage. For this reason a lack of consensus pervades scholarly assessments of the meaning of the development of tensions between high-status non-Brahmans and Brahmans in south India early in the twentieth century. It is not clear why anti-Brahmanism emerged in the ideology of the Justice Party, a party of landholding interests.Was this development another example of the exacerbation of social distinctions under imperial rule, analogous to the Hindu-Muslim communalism which emerged in north India? Or, as one opinion has it, was the ideological change an opportunistic maneuver on the part of a group of politicians, encouraged by British officials anxious to foil the nationalist movement? This paper takes an approach more in line with the first alternative and sees the propagation of an ideology of ethnic antagonism as a result of processes of the reformation of group and personal identities. I link the reformation of group identity to the confusion in rules regarding group behavior which resulted from the imposition and operation of the imperial system of dispute management, the Anglo-Indian legal system.

AbstractThe Madras High Court located in Chennai, India, was established in 1862 when India was under colonial rule. It continues to exist in post-independence India after merging into the Indian legal system. In this study, I argue that the architecture and judicial iconography of the Madras High Court building reflects a recurring historical tension between Indian and British concepts of justice. This is continually reflected in the semiotics of the legal space of this high court which in turn influences the legal consciousness of the court personnel who utilize this space. This architecture and iconography of the Madras High Court constitutes, preserves, and reinforces the ambivalent legal consciousness of those who created, occupy, and visit this space. The contemporary legal consciousness of the court personnel is thus seen to have deep historical roots.

Third-party funding in International Commercial Arbitration is one of the most contemporaneous and controversial issue in the normative framework in India. The last several years have witnessed increasing involvement of Third Party Funders in International Commercial Arbitration proceedings. Third-party funding has been considered as one of the means of access to justice for those who have a credible claim but no financial means to pursue it. Dispute resolution in India tends to be a cost-heavy proposition for the parties involved. The present discussion highlights critical appraisal regarding TPF (Third Party Funding) from the delivery of procedural and substantive justice as well as suggesting legal and jurisprudential grounds in third party funding governance all across the world.

AbstractThe East India Company troops fighting the Burmese aggression on the frontier of Bengal in Eastern India “freed” upper and lower Assam territories in 1825. David Scott of the Bengal Service was appointed to oversee the establishment of civil and revenue administration in these frontier territories. He established a hierarchical multiple structure of “native courts”—called panchayats—as the chief medium of civil and criminal justice. This was ostensibly continuing a traditional Assamese form of dispute resolution—the mel; however, the British criminal jury as well as the expert assessor model animated the system. After his death in 1831, the system was brought in line with the rest of the Bengal administration based on the British court system. His experiment, paralleled in many other newly conquered and ceded districts from the Madras territories to Central India, suggests the use of this mode in post-conquest situations by British administrators in South Asia.

AbstractPresident Erdogan and the Justice and Development Party (AKP) fundamentally transformed the Turkish political realm: The AKP was elected in 2002 on promises of economic liberalisation and accession to the European Union (EU). Over sixteen years it steered Turkey from being perceived as a “model” western-style democracy to autocracy. Instrumental for this transformation was Erdogan’s use of a new form of right-wing, religiously legitimated populism that systematically undermined the institutions of democracy by polarising society, capturing the public discourse and disregarding constitutional principles. This article examines the emergence of the AKP’s right-wing, religiously legitimated populism through three analytical lenses: First, the historical development of democracy in Turkey and its shortcomings; second, the antidemocratic effect of Erdogan’s post-coup attempt policies; third, a comparison between the AKP’s brand of populism with political strategies employed by the Bharatiya Janata Party (BJP) in India, the Law and Justice Party (PiS) in Poland and Putin’s Russia.

Abstract:
Communism arrived in the south Indian state of Kerala in the early twentieth century at a time when the matrilineal systems that governed caste-Hindu relations were crumbling quickly. For a large part of the twentieth century, the Communist Party – specifically the Communist Party of India (Marxist) – played a major role in navigating Kerala society through a developmental path based on equality, justice and solidarity. Following Lefebvre’s conceptualisation of (social) space, this paper explores how informal social spaces played an important role in communicating ideas of communism and socialism to the masses. Early communists used rural libraries and reading rooms, tea-shops, public grounds and wall-art to engage with and communicate communism to the masses. What can the efforts of the early communists in Kerala tell us about the potential for communicative socialism? How can we adapt these experiences in the twenty-first century? Using autobiographies, memoirs, and personal interviews, this paper addresses these questions.

This article focuses on the struggles and shifting political strategies of two major political players in northern India: the Yadavs (a low-to-middle ranking pastoral agricultural caste) and the dalits (former untouchables, which in the region mainly come from the Chamar caste) and their political parties, the Samaj wadi Party and the Bahujan Samaj Party, respectively. Both communities (and political parties) have strongly benefited from affirmative action policies over the last three decades. We argue that that these affirmative action policies, and the political rhetoric that has tended to accompany them, have been “vernacularized“ in local sociocultural structures, which in turn has helped to produce folk theories of democracy and social justice that are directly and indirectly legitimizing conflict, and producing new forms of caste-based strategic voting, based on the principle that the enemy of my enemy is my friend.

Abstract:
Purpose of the study: This paper compares the gender education conducted by two Islamic political parties in Indonesia and India represented by PKS (Prosperous and Justice Party) and the Muslim League. This comparative is essential since both countries face inequality in gender issues, and both parties claim as Islamic representation. Methodology: This research is a comparative study model by the interviews and survey-based collecting data methodology. The object of this research is the leader of PKS and Muslim Leagues. The data were analysed and discussed with various literature reviews to perform the similarities and differences in gender education playing by both parties. Main Findings: Both PKS and the Muslim League have a concern about women’s education and participation in the public sphere and have done some programs and establishing some infrastructure to gain their goals. However, since Indonesia and India have different cultural and political backgrounds, gender education in Indonesia has fewer constraints than the India case. Applications of this study: This study is helpful for the particular political parties to evaluate their programs in gender education. Moreover, it also will inspire the other to optimize the participation of women in public areas. Novelty/Originality of this study: No research has been conducted on the comparative study of gender education between PKS in Indonesia and Muslim league in India.

Abstract The Supreme Court of India (SC) pronounced a momentous judgment in Vishaka v. State of Rajasthan in 1997, categorically recognizing the menace of sexual harassment (SH) at workplace and constitutionally rendering it as being in violation of fundamental rights guaranteed by Articles 15, 19, and 21 of the Constitution of India 1950. The Court also provided a mechanism for redressal against SH, which was ultimately reinforced by Parliament with the enactment of Sexual Harassment at Workplace (Prevention, Prohibition and Redressal) Act 2013 (POSH Act). However, when it comes to allegations of SH against judges in the SC and High Courts by its employees, interns, or lower court judges, the response of the SC has been abysmal to say the least. There is a systematic pattern to suggest foul play and conspiracy in each such allegation, and judges, including even the Chief Justice of India (CJI), have not hesitated to openly indulge in victim-shaming and-blaming. In other words, the court has not been able to uphold its own jurisprudence on sexual harassment, which it expects to be scrupulously adhered to by other organs of the state. It is submitted that in not supporting the cause of victims alleging SH against judges, the other organs of the state are also party to this constitutional decay and serious infraction of fundamental rights. It leads us to ask the question, how can we guard against the guardians?

In Bangalore, late in the summer of 2014, I listened to many animated conversations. There were political debates: the right-wing Hindu nationalist party had, earlier that summer, won national as well as state elections, evoking disparate reactions across society, sowing dissension even among the technological elite. There were technological arguments: should Bangalore continue to be an outsourcing haven for software services, or did India need a new model of development? Technology itself no longer seemed to unite people and offer exciting futures, as it had a decade ago. In Basavanagudi, a neighborhood named after twelfth-century social reformer Basavanna, part of the South Bangalore constituency where Tom Friedman's friend Nandan Nilekani had just lost the local election to the Hindu nationalist BJP candidate, I noticed a growing buzz around a social media campaign for a new documentary on climate change. Facebook, Twitter, and chats excitedly shared news of the upcoming global release of a film seeking to unite the globe in a social movement to stop climate change. Software engineers and social justice activists might, it seemed, be able to come together on this topic, if not any other.

The paper analyses Syed Amanuddin’s “Don’t Call Me Indo-Anglian” from the perspective of a cultural materialist. In an effort to understand Amanuddin’s contempt for the term, the matrix of identity, language and cultural ideology has been explored. The politics of the representation of the self and the other that creates a chasm among human beings has also been discussed. The impact of the British colonialism on the language and psyche of people has been taken into account. This is best visible in the seemingly innocent introduction of English in India as medium of instruction which has subsequently brought in a new kind of sensibility and culture unknown hitherto in India. Indians experienced them in the form of snobbery, racism, highbrow and religious bigotry. P C Ray and M K Gandhi resisted the introduction of English as the medium of instruction. However, a new class of Indo-Anglians has emerged after independence which is not different from the Anglo-Indians in their attitude towards India. AbstractReligious movements have long been challenging the modernist and secularist ideas around the world. Within the last decade or so, pro-religious parties made significant electoral advances in various countries, including India, Sudan, Algeria, and the Palestinian territories. In this article, we focus on the rise of the pro-religious Justice and Development Party (Adalet ve Kalkınma Partisi- AKP) to power in the 2002 elections in Turkey. Using the Turkish experience with political Islam, we evaluate the explanatory value of Mark Juergensmeyer's rise of religious nationalism theory, with a special emphasis on the “failed secularism” argument. Our analysis indicates that the theoretical approach formulated by Juergensmeyer has a great deal of explanatory power; however, it does not provide a complete explanation for the success of the AKP. The rise of religion in Turkish politics is the result of a complex process over long years of encounter and confrontation between two frameworks of order, starting with the sudden imposition of secularism from above, when the republic was established. Hence, to understand the rise of religion in contemporary Turkish politics, an in-depth understanding of history, politics, and the sources of tension between secularists and Islamists is essential. The findings of this article have important implications for other countries, especially those that are experiencing a resurgence of religion in politics, and are struggling to integrate religious parties into a democratic system.

Sustainability reporting enables the creation of long-term value for organizations. It is forward-looking and includes quantitative and qualitative reporting measures. It is a key platform for communicating the organization’s economic, social, environmental and governance performance, reflecting positive and negative impacts. It can be undertaken by all types, sizes and sectors of organizations. Through the Global Reporting Initiative (GRI) Sustainability Reporting Framework, the GRI works to increase the transparency and exchange of sustainability-related information. The present study conceptually reviews sustainability reporting and its benefits for the entities. Here, an attempt has been made to examine the development in the Indian regulatory environment for sustainability reporting along with finding out trend, application level and status of the sustainability reporting practice of Indian entities as per the GRI reporting framework. The findings reveal that the development of the corporate governance standard is maturing in India. Amendments in laws and changes in the regulatory mechanism are creating pressure on entities to respond to and communicate for their sustainability concerns. With globalization, Indian companies are increasingly realizing that they have much to lose by not following sustainability reporting. In fact, many respected companies already get their sustainability reports audited by a third party to ensure its credibility. Sustainability reporting is therefore a vital step of managing change towards a sustainable global economy—one that combines long-term profitability with environmental care and social justice.

It is not a Code of law, yet it determines the range of the moral authority of laws in practice. In many ways, a Code is the core of an industrial relations system. The objects of a Code are: to maintain discipline and industrial pace, to achieve greater industrial harmony, to develop and promote a compatible system of labour relations to ensure justice and fairness, and change in" work attitudes and productivity. The Indian Code of Discipline is such that the government is not a party to the agreements between management and union_ However, the government does keep the administrative machinery in good order. By structuring the agreements in three parts, responsibility is distributed in three spheres. For instance, industrial disputes, strikes, and lockouts have been placed in the joint sphere. Workload composition, employers' labour practices, and administrative responsiveness have been placed in the sphere of management, while the sphere of the union includes union activities. Thus, the Indian Code is prepared in such a way that violation of a single Code leads to total violation in both the joint and individual spheres. This dependence is both the substance and the moral authority ofthe Code.

Abstract The subject of unification is as vibrant as national movement even after 58 years of a fractured verdict. More than to achieve a physical conjugation it was an attempt for cultural fusion. The aspiration for linguistic unification was a part of the national discourse. The movement, which began with mystic originations, later on turned out to become communal. Political changes during 1799 A.D. and 1857 A.D. changed the fortunes of Mysore state and ultimately led to its disintegration and became the reason for this movement. The concept of unification is akin to the spirit of nationalism, against the background of colonial regime assigning parts of land to different administrative units without taking into consideration the historical or cultural aspects of that place. Kannadigas marooned in multi lingual states experient an orphaned situation got aroused with the turn of nineteenth century. The problem precipitated by the company was diluted by British when they introduced English education. Though the positive aspect like emergence of middle class is pragmatic, rise of communalism on the other hand is not idealistic. This research paper is designed to examine the polarization of castes during unification movement of Mysore State (Presently called as State of Karnataka, since 1973, which was termed Mysore when integrated) which came into being in 1956 A.D. Most of the previous studies concentrate on two aspects viz ideological discourse and organizational strategies adopted to gain Unification. The course of the unifi cation movement and role of Congress party dominates such studies while some of them concentrate on the leaders of the movement. Other studies are ethnographical in nature. ‘Community Dominance and Political Modernisation: The Lingayats’ written by Shankaragouda Hanamantagouda Patil is a classic example. Mention may be made here of an recent attempt by Harish Ramaswamy in his ‘Karnataka Government and Politics’ which has covered almost all aspects of emergence of Karnataka as a state but communal politics during unification movement has found no place. ‘Rethinking State Politics in India: Regions within Regions’ is an edited book by Ashutosh Kumar which has articles on ‘Castes and Politics of Marginality’ where a reference is made to caste associations and identity politics of Lingayats, but the area of study is neighboring Maharashtra and not Karnataka. Though it contains two articles on Karnataka its subject matter doesn’t pertain to this topic. One more important effort is by ‘Imagining Unimaginable Communities: Political and Social Discourse in Modern Karnataka’ where the author Raghavendra Rao thinks Karnataka and India as two unimaginable communities and discuss primarily the founding moments of negotiation between the discourses of Indian nationalism and Kannada linguistic nationalism. It is more an intellectual history and throws light on nationalism in a colonial context. Mostly studies concentrate on either the course or the leaders of the movement. Invariably congress as an organization finds place in all studies. But the blemish of such studies is a lesser concentration on activities of major socio cultural groups. The role of socio cultural groups assumes importance because of the milieu at the beginning of 20th century which annunciated a wave of social changes in the state. It is a known fact that the movement for linguistic state was successful in bringing a political integration of five separate sub regions but failed to unite people culturally. This concept of unification which is akin to the spirit of nationalism got expressed at the regional level in the sense of respect for once own culture, language and people. In case of Karnataka this expression had political overtones too which is expressed by some who fought for it (Srinivas & Narayan, 1946 ). Most of the early leaders of unification movement (and for that matter even movement for independence too can be cited here) belonged to one particular caste, and with passing of time has led to the notion of domination of that caste over the movement. This paper tries to give justice in a limited way by giving legitimate and adequate recognition for those castes which deserves it and do away with misconceptions. Two concepts political modernization and social mobility are used. The later derives its existence from the former in this case. The data used here is primarily gained from news papers and secondary sources like books and interviews given by participants. No hypothesis is tested nor any theory is developed in this attempt but historical materials are examined in the light of modernity. The key problem discussed here is emergence of communal politics and the role of social groups in unification. Biases of regionalism, caste and class have been overcome by rational thinking.

Nationalism in India was born out of the bondage of a country subjected to foreign rule and the internal loss of self-confidence that went with such a rule. The freedom struggle that followed was understood to be Indian nationalism, not Hindu or Muslim or any kind of religious or other nationalism primarily aimed to ensure the welfare of all citizens and their entitlement to justice and human rights. The present paper examines this evolution of nationalism in India as a freedom struggle against the British and then as a democratic process to give every Indian a voice in decision-making in free India. But what has been noticed over the years is a steady regression in secularism where individual rights were compromised, then as a struggle for power in party circles and finally in the name of religion. To the extent that today’s nationalism in India is perceived more as an imposed ‘feeling’- a feeling that has equally impacted the country’s image outside home; despite promising strides to transform India from a ‘balancing’ to a ‘leading’ power internationally. Being normative in nature the paper borrows citation mostly from secondary sources of information, including books, journals and e-sources for current affairs. It tries to incorporate two formal discussions on Nationalism and International status of India which is part of the curriculum at UG-level in college/universities. Public interest litigation (PIL) has a vital role in the civil justice system in that it could achieve those objectives which could hardly be achieved through conventional private litigation.PIL, for instance, offers a ladder to justice to disadvantaged sections of society, provides an avenue to enforce diffused or collective rights, and enables civil society to not only spread awareness about human rights but also allows them to participate in government decision making. PIL could also contribute to good governance by keeping the government accountable. This article will show, with reference to the Indian experience, that PIL could achieve these important objectives. However, the Indian PIL experience also shows us that it is critical to ensure that PIL does not become a facade to fulfil private interests, settle political scores or gain easy publicity. Judiciary in a democracy should also not use PIL as a device to run the country on a day-today basis or enter the legitimate domain of the executive and legislature. The challenge for states, therefore, is to strike a balance in allowing legitimate PIL cases and discouraging frivolous ones. One way to achieve this balance could be to build in economic (dis)incentives in PIL and also confine it primarily to those cases where access to justice is undermined by some kind of disability. Judiciary, being the sentinel of constitutional statutory rights of citizens has a special role to play in the constitutional scheme. It can review legislation and administrative actions or decisions on the anvil of constitutional law. For the enforcement of fundamental rights one has to move the Supreme Court or the High Court’s directly by invoking Writ Jurisdiction of these courts. But the high cost and complicated procedure involved in litigation, however, makes equal access to jurisdiction in mere slogan in respect of millions of destitute and underprivileged masses stricken by poverty, illiteracy and ignorance. The Supreme Court of India pioneered the Public Interest Litigation (PIL) thereby throwing upon the portals of courts to the common man. Till 1960s and seventies, the concept of litigation in India was still in its rudimentary form and was seen as a private pursuit for the vindication of private vested interests. Litigation in those days consisted mainly of some action initiated and continued by certain individuals, usually, addressing their own grievances/problems. Thus, the initiation and continuance of litigation was the prerogative of the injured person or the aggrieved party. However, these entire scenario changed during Eighties with the Supreme Court of India led the concept of public interest litigation (PIL). The Supreme Court of India gave all individuals in the country and the newly formed consumer groups or social action groups, an easier access to the law and introduced in their work a broad public interest perspective.

Photo by Finding Dan | Dan Grinwis on Unsplash We who grew up texting, instant messaging, and emailing are blessed with native fluency in internet slang that varies according to country and language. Growing up in Sub-Saharan Africa, my schoolmates and I particularly loved to say TIA or, “This Is Africa.”[1] Largely popularized through the 2006 film, “Blood Diamond”,[2] TIA was the answer to all of the idiosyncrasies that accompanied living in the middle of the second-largest continent. Pulled over by local traffic police who demand a “cold drink”? TIA. Helped push the school bus out of a massive pothole during monsoon season? TIA. Reached for your Nokia brick only to pull a similarly sized cockroach from your purse? TIA. Largely isolated from the rest of the world, disease hysteria triggered by bird flu, SARS, and MERS passed by Sub-Saharan Africa as a far- off echo – my community was preoccupied with more imminent threats like malaria and cholera. The 2013 Ebola epidemic was the first time I was exposed to the narrow focus and broad indifference with which the wider world regards Africa. Mass hysteria over an “African disease” that threatened US shores exhibited narrow focus[3] while broad indifference manifested as radio silence following the resolution of cases in the US and Europe. The outbreak lasted until 2016 but coverage waned after 2015, when the only Ebola patients outside of Africa were expats shipped home for recovery.[4] As a freshman in college, my new British friends asked whether my family was at risk (they were not) and whether it was safe for me to go home for the holidays (it was). The 2013 outbreak primarily affected West Africa, on the opposite side of the continent. But to my college friends, Africa was a disease-ridden monolith. TIA, that is Africa. To the indifferent journalist, Africa is a convenient narrative device. By refusing to think of parts of Africa as anything other than the whole, we reduce a continent of 54 nations to a single entity – smaller and more manageable. The same occurred at the height of COVID-19 anxieties. As the healthcare systems of “more developed” countries threatened imminent collapse, a cry rattled across the globe: what will the Africans do?[5] Military-enforced lockdowns?[6] Will we have to take care of their citizens again?[7] While catching up with some friends in July 2020, I resisted an eyeroll as an acquaintance, grinning smugly, announced a new Ebola outbreak plaguing Congo.[8] (He probably meant DRC but he did not specify, and I am not sure he knew the difference.) A quick Google search confirmed the news, reported with glee in all major news media.[9] The Zoom call erupted in a flurry of sighs as my friends contemplated the new threat to US soil. Ever the party pooper, I emphasized that the outbreak was nothing new. The Ebola virus takes its name from its eponymous river in the DRC and the Congolese government had only just announced the end to a two-year struggle with Ebola in April.[10] Soon afterwards, the world lost interest; Al-Jazeera posted its last Ebola article on July 25.[11] Concurrently, coverage on ‘Africa’s COVID-19 crisis’ dwindled, eclipsed by worldwide #BLM protests, unrest in Belarus, and the US elections. As the attention on other world events settled, the “developed” world checked in with “poor, underdeveloped” Africa.[12] Despite concerns about cramped South African townships and the veracity of disease reports in Nigeria,[13] the number of COVID-19 cases and death rates in the continent have stayed low.[14] Citing a young population, existing contact-tracing infrastructure, and cross-immunity from other coronaviruses, several published articles analyze Africa’s mortality statistics.[15] Some, as pointed out by Ghanaian journalist, Karen Attiah, strive to paint the successes of African COVID-19 responses with stereotypical images of poverty and instability. After all, TIA. But while the world was not looking, African healthcare systems rallied. Wild poliovirus was completely eradicated from the continent in August.[16] Uganda began developing its own COVID-19 testing kits in May.[17] COVID-19 cases were limited to ten of Africa’s 54 countries while the DRC’s leading Ebola expert[18] reported that the new outbreak was under control.[19]Though there are still economic concerns due to reduced import-export activity between countries, Africa stands strong as second waves in Europe threaten to overrun hospitals.[20] A year from the beginning of the COVID-19 pandemic, the WHO shared concerns of a lack of justice and equality in global vaccine distribution.[21] Higher income countries have had enough stock to vaccinate one fourth of their population, on average, while low income countries are limited to around 1 in 500.[22] However, a headline in CBS News implies that the low vaccination rate in South Africa is due to a domestic class struggle between the rich and poor citizens,[23] rather than an issue of vaccine nationalism. There are some reporters in Western news media, like Peter Mwai who reports for the BBC, who portray African healthcare systems in a balanced way. Seeking out unbiased writers’ articles is the best way to ensure exposure to balanced news. However, this is an exercise that many readers overlook because they depend on headlines for information. The bias is systematic, and the reliability of a few reporters is outweighed by countless examples of careless copy editing. As evidenced by the CBS News clip, quick turnaround time for publishing live television broadcast clips online leads to sloppy research, injecting prejudices in news media. Perhaps it is too early to celebrate. But as Western media spotlights claims that Africa was spared due to herd immunity from previous coronaviruses blazing through poverty-stricken neighborhoods, it does not seem so bad to rebuff the stereotype.[24] The US currently leads in total COVID-19 cases, followed by India, Brazil, and France. South Africa does not even break the top ten. Morocco, next in line, resides comfortably at 32.[25] For the moment, we can be proud. Decades of experience building infrastructure around highly contagious diseases paid off. Many public health officials in African governments acknowledged and addressed COVID-19’s potential early.
