My thesis offers an internal critique of Sen’s and Nussbaum’s versions of the capabilities approach (CA hereafter) as an approach to social justice. First, I examine the justifications that Sen and Nussbaum provide for their approaches to justice. I argue that neither Sen nor Nussbaum succeeds in providing a successful justification. Within the employer-employee relationship, the principles of natural justice demand a fair procedure to be followed before imposing punishments on employees. ILO Convention 158 and other selected foreign jurisdictions support the view that the existence of a valid reason such as a capacity problem or a conduct problem of the employee alone is not sufficient for a termination of service or another punishment to be justified and it is necessary to have applied a fair procedure by the employer in arriving at the said decision. The study aims to introduce a methodology for a spatial redistribution of supplementary incomes generated by new or renovated local public goods (LPGs) and shows how its application promotes spatial justice in the cities. Two models were developed for establishing land and real estate prices (LEnP) variation and estimating the supplementary income associated to new LPGs. These models were applied to stations of BRT-TM Transmilenio system in Bogotá and to 108,888 estate appraisals (2004-2018) distributed throughout the city.
