Abstract:
William Ewart Gladstone, four times prime minister (1868–74, 1880–5, 1886, and 1892–94), the “greatest colossus of the Victorian Age,” the most influential prime minister of the nineteenth century, and the Grand Old Man (G.O.M.) of British politics and statesmanship, seems an unlikely advocate for the theatre. Deeply religious, conservative, and serious, Gladstone is not easily imagined as an avid theatregoer. It is difficult to imagine him supporting the ephemeral, often subversive, and suggestive character of the theatre. And indeed, in his early years Gladstone despised the theatre and called it an “encouragement of sin.” As prime minister, he was almost obsessed by a religious zeal; Richard Foulkes has noted that “Few, if any, prime ministers have carried out their role in making senior Church appointments as assiduously as Gladstone did.” For members of Victorian Britain's Christian majority, the theatre was anathema and regarded as morally suspect. They were intensely suspicious and saw playgoing as a distraction from religion and as a promoter of frivolity, vanity, and female forwardness. They linked theatres to “prostitution, juvenile delinquency, idleness, drunkenness and frivolity.” In fact, theatres were the “antithesis of the Victorian world view which prized respectability, gentility, decency, education and uplift.” Until at least the later decades of the nineteenth century, theatre “was widely regarded as the lowliest of the arts, if one at all.”

Abstract:
Adolescents as the next generation have an important role in the development of the nation. On the other hand, they frequently face social problems. The socialization they make sometimes deviates from the values, the norms prevailing in the society. The problems of this study are what factors causing the behavioral deviation of the urban adolescent, what several of the behavioral deviation of the urban adolescent, and what efforts should be taken to overcome the behavioral deviation of the urban adolescent. This study aims to determine the factors causing the behavioral deviation of the urban adolescent, to know the several of the behavioral deviations of the urban adolescent, and to find out the efforts to overcome the behavioral deviation of the urban adolescent. The theoretical basis used in examining the problems is the theory of social control and labeling theory. This study used a qualitative method. The data source was obtained from library research. The data were analyzed with the qualitative descriptive presentation technique. The result of this study showed that the deviation of adolescent behavior in urban areas is increasing highly. Several of the behavioral deviation of the urban adolescent such as juvenile delinquency, drug abuse, brawl, drunkenness, and smoking. The motives are such as the failure of socialization, weak of social control (no controller), and labeling to someone who tends to identify himself as the one who does deviation by society.

Abstract:
Le discernement est une notion située à la frontière du droit, de la psychologie, et de la la philosophie, l’analyse juridique de cette notion nécessite donc une lecture psychologique et philosophique de ce terme. En tant que notion complexe, le discernement, qui est défini comme la capacité à distinguer entre le bien et le mal, peut être confondu avec d’autres notions avec lesquelles il existe des points communs. Tel est le cas de l’élément moral de l’infraction.Il nous paraît indispensable de déterminer quelle est la place du discernement au sein de la théorie pénale. Les questions qui relèvent de notre recherche sont dés lors les suivantes : Faut-il attacher le discernement à la théorie de l’infraction ou bien à la théorie de l’imputabilité ? Quelles conséquences entraîne le défaut de discernement sur la responsabilité pénale de l’agent ? Ces conséquences sont-elles identiques en droit français et en droit syrien ? Enfin, quelles réponses alternatives sont adoptées dans les deux systèmes pénaux à défaut de responsabilité?
Discernment is a concept that marks the boundaries between law, psychology and philosophy. Therefore, the legal analysis of this notion must be understood within a psychological and philosophical framework. Discernment is a particularly complex notion. It is defined as the ability to distinguish between right and wrong. It may be confused with other notions with which it overlaps, such as criminal intent.It is therefore, indispensable to situate discernment in criminal legal theory. Thus, the following issues will be addressed in this thesis: Should discernment be linked to the legal understanding of what constitutes an offence, of to the theory of accountability? What are the consequences of the lack of discernment on the criminal liability of the offence perpetrator? Are these consequences similar in French law and in Syrian law? And lastly, when there is no criminal liability, what are the alternatives responses thesis shall look for alternatives responses provided for in both criminal law systems?
