Abstract:
Abstrak Penelitian ini bertujuan untuk mengetahui bagaimana pembagian harta waris terhadap perkawinan beda agama menurut Kitab Undang–Undang Hukum Perdata (KUH Perdata) dan bagaimana pembagian harta waris terhadap perkawinan beda agama menurut Kompilasi Hukum Islam (KHI). Metode penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis normatif. Dalam Kitab Undang-Undang Hukum Perdata (KUH Perdata) terkait status hak waris beda agama terletak pada Pasal 838 Kitab Undang-Undang Hukum Perdata (KUH Perdata) dimana dalam pasal tersebut menyatakan bahwa yang tidak patut menjadi ahli waris adalah mereka yang dipersalahkan telah membunuh, memfitnah pewaris telah melakukan suatu kejahatan dengan hukuman lima tahun penjara, melakuan kekerasan, dan juga telah menggelapkan, merusak atau memalsukan surat wasiat. Karena, menurut Pasal 832 Kitab Undang-Undang Hukum Perdata (KUH Perdata) yang berhak menjadi ahli waris ialah, para keluarga sedarah, baik sah maupun luar kawin dan si suami atau istri yang hidup terlama. Sehingga dapat disimpulkan bahwa dalam Kitab Undang Undang Hukum Perdata (Burgerlijk Wetboek) tidak ada mengenal perbedaan agama sebagai penghalang mewarisi, dengan kata lain sah sah saja orang yang berbeda agama menjadi pewaris atau mewarisi. Sedangkan dalam Kompilasi Hukum Islam perbedaan agama adalah menjadi penghalang seseorang untuk mendapatkan warisan dari si pewaris. Konsep Kompilasi Hukum Islam ( KHI ) mengenai status hak waris beda agama terletak dalam Pasal 171 Huruf C Kompilasi Hukum Islam (KHI) yang berbunyi, ahli waris adalah orang yang pada saat meninggal dunia mempunyai hubungan darah atau hubungan perkawinan dengan pewaris, beragama Islam, dan tidak terhalang karena hukum untuk menjadi ahli waris. Serta diperkuat dengan Hadits Rasulullah, yang artinya “Orang muslim tidak mewarisi orang kafir (begitu juga sebaliknya) orang kafir tidak mewarisi orang muslim. Abstract:
Tulisan ini merupakan pengusulan metode terhadap pengkajian pembaruan hukum keluarga Islam. Metode tersebut adalah tematik-interdisipliner. Metode tematik berfungsi sebagai sarana memahami Alquran tema per tema dari ayat-ayat yang memiliki semangat yang sama dalam struktur makna yang lebih universal tanpa adanya dilema parsial dan ekslusif dalam memahami ketetapan hukum yang terkandung di dalamnya. Adapun metode interdisipliner, menggabungkan dan melibatkan beberapa disiplin keilmuan untuk menyelesaikan masalah yang dihadapi (problem solving). Tujuan perpaduan metode tersebut dalam pembaruan hukum keluarga Islam adalah menciptkan pengkajian hukum Islam yang lebih terbuka dan universal, sehingga hasil penetapan hukumnya dapat berlaku proporsional, berkeadilan dan adaptif-konteks. Seperti penetapan hukum jumlah bagian harta waris bagi laki-laki dan perempuan, dua banding satu (2:1). Proses pembagian harta waris didasarkan pada semangat keadilan dan kesejahteraan ekonomi di antara keduanya, yaitu memperhatikan kondisi ekonomi, potensi dan karir si ahli waris untuk menetukan jumlah yang didapat ahli waris tersebut. Tujuan dari perpaduan metode tematik-interdisipliner terhadap pembagian waris laki-laki dan perempuan adalah; (1) proses pembagian waris berlaku secara bijakasana, karena dilakukan melalui musyawarah keluarga, (2) terciptanya keadilan dan kesejahteraan ekonomi di antara keduanya, karena pembagian harta waris didasarkan pada kondisi, potensi dan karir ahli waris, (3) meminimalisir pertikaian diantara keduanya mengenai jumlah bagian harta waris.

Artikel ini membahas mengenai kontribusi dari konsep takwil para Ushuliyyun dalam kewarisan beda agama. Para Ushuliyyun mewariskan metode takwil dalam Istibath Ahkam sebagai salah satu metodologi hukum Islam. Takwil merupakan pengalihan dari makna dhahir pada makna yang tersembunyi berdasarkan dalil yang dapat dijangkau. Penelitian ini menggunakan kajian kepustakaan (library research) sebagai pendekatan dengan melakukan kajian pada berbagai bahan hukum mengenai konsep takwil dan interpretasinya dalam kewarisan beda agama. Kajian ini menghasilkan konsep takwil secara menyeluruh mengenai ketentuan dan syarat yang harus diketahui agar takwil yang dilakukan menjadi takwil yang maqbul. Adapun takwil yang tidak memiliki dalil dan hanya karena nafsu maka takwil ini tidak bisa diterima. Relevansi konsep takwil dengan penyelesaian permasalahan dalam masyarakat mengenai hukum Islam dapat diketahui salah satunya pada pengaplikasian takwil terhadap konsep pewarisan beda agama yang ditakwilkan sehingga menghasilkan makna bahwa larangan kewarisan beda agama itu hanya diperuntukkan bagi kafir harby. Serta seorang muslim juga tetap bisa menjadi ahli waris dari orang kafir.

Dalam hal ini penulis melakukan analisa mengenai bagaimana tinjauan hukum islam terhadap terhalangnya hak kewarisan. artikel penelitian ini kami menganlisanya dengan menggunakan jenis pendekatan yuridis normatif dengan kajian literatur, kepustakaan sebagai bahan hukum dan perundang-undangan. Kompilasi hukum islam menginginkan adanya persyaratan terhadap ahli waris agar tidak melakukan ketentuan seperti yang diatur dalam ketentuan pasal 173 KHI (kompilasi Hukum Islam) yang menyebabkan terhalangnya mewarisi. Adapun hal - hal yang menyebabkan seseorang ahli waris dinyatakan terhalang menerima warisan dari harta yang ditinggalkan pewaris. Dalam fiqh klasik ulama sunni ditentukan bahwa ada empat faktor yang menyebabkan seseorang terhalang menerima warisan dari pewaris, yaitu (a) perbudakan, (b) pembunhan, (c) berbeda agama/kafir , (d) mati misterius

Tulisan ini mengungkap kritik Islam revivalis atas pandangan Tim Penulis Paramadina melalui buku Fiqh Lintas Agama Membangun Masyarakat Inklusif-Pluralis yang membolehkan perkawinan beda agama tanpa membedakan apakah ahlul Kitab, musyrik dan kafir. Demikian juga kebolehan atas waris beda agama. Pendapat ini didasarkan atas paradigma fikih inklusif, yang akomodatif terhadap hak-hak minoritas. Akomodasi fikih ini didasarkan atas argumen teologis-normatif dengan merujuk kepada surat al-Mâidah ayat 5. Sedangkan secara historis adanya bukti praktik sahabat yang mengawini wanita non muslim. Karena itu, pelarangan atas pernikahan beda agama dalam fikih klasik lebih bersifat ijtihadi. Sementara kebolehan waris beda agama tidak ditegaskan secara eksplisit oleh teks, sebaliknya adanya teks (riwayat) Mu‟azd dan Mu‟awiyah yang membolehkan. Pendapat Tim Penulis Paramadina ini menuai kritik dari Islam revivalis dengan merujuk kepada pendapat ulama fikih klasik yang menyepakati keharaman perkawinan dan waris beda agama. Dalam hal yang disebut terakhir, Islam revivalis berargumen bahwa riwayat Mu‟azd dan Mu‟awiyah tidak disepakati kevalidannya dibandingkan dengan riwayat yang melarang seorang muslim mewarisi orang kafir. Sedangkan mendahulukan dalil yang disepakti kevalidannya adalah lebih utama diperpegangi daripada dalil yang tidak disepakti kevalidannya. Demikian juga memilih pendapat mayoritas atas pendapat minoritas jauh lebih dikedepankan. Hal mana mayoritas ulama melarang nikah beda agama adalah haram karena pernyataan tekstual ayat, kecuali nikah dengan ahlul Kitab. Itu pun kebolehan tersebut bersifat darurat. Bahkan dampak buruk perkawinan beda agama harus didahulukan daripada mengambil manfaat. Pandangan mayoritas ulama fikih klasik diikuti oleh MUI, NU dan Muhammadiyah, serta tokoh dan pemikir Islam Indonesia lainnya. Meskipun ruang dan jalan alternatif tersedia dalam opini hukum minoritas, tetapi tidak dapat dipraktikan di Indonesia. Karena undang-undang perkawinan no. 1 tahun 1974 dan Kompilasi Hukum Islam tidak mengakomodir sehingga kehilangan keabsahannya secara legal.

In recent decades, experiences resulted from Modern wars have shown that aggressive armies have targeted vital and sensitive resources of the other countries in order to decrease their expenses in one hand and increase damages in other hand, defending countries transmit their critical and sensitive facilities to safe underground spaces in order to reduce damages, and experience has shown that underground spaces receive the least damage. This study tries to examine and prioritize Tehran tunnels as undergroundsafe spaces at crisis times regarding their structural parameters and also civil defense arrangements. It could accelerate the selection and creation of underground-safe spaces at crisis and it also can decrease construction and maintenance costs. This study has used AHP method to evaluate Tehran tunnels. In this regard five indices have been chosen by asking experts in the related fields and to evaluate and select a proper way to choose the best one as an urban-safe space. Finally, the investigated tunnels are prioritized as Tohid weighted as 0.349, Niyayesh weighted as 0.279, Resalat weighted as 0.197 and finally Amir Kabir weighted as 0.164 respectively that showed Tohid tunnel is the best urban-safe space and, Niyayesh, Resalat and Amir Kabir tunnels take the next places in the ranking, respectively.

Abstract:
Achievement of optimal performance can be done if nurses have career development and competence, besides that nurse satisfaction is also a determining factor in Nurse performance. The purpose of this study was to determine the effect of career development and competence on job satisfaction and performance. The population in this study was the Staff Nurses. The sampling technique is Saturated Sampling (Sensus). The sample in this study were all staff nurses who worked in the inpatient ward of the AWS Samarinda regional general hospital, totaling 201 staff nurses. This research was analyzed using the SmartPLS program. The results of this study indicate that career development has a positive and significant effect on job satisfaction, competence has a positive and not significant effect on job satisfaction, career development has a positive and not significant effect on nurse performance, competence has a positive and significant effect on performance, job satisfaction has a positive and significant effect on Nurses performance, job satisfaction has mediates between career development and performance on Nurses AWS Samarinda regional general hospital. SMK Yamatu Tualang merupakan sekolah yang termasuk dalam kelompok sekolah bisnis dan manajemen serta teknologi dan rekayasa. Dalam menjalankan proses sebagai organisasi yang bergerak dibidang pendidikan SMK Yamatu Tualang memiliki beberapa permasalahan baik dari kondisi internal maupun kondisi eksternal diantaranya 80% sekolah tidak meyediakan sarana untuk penerapan TI dan komunikasi serta sekolah mengalami ketertinggalan dari beberapa sekolah pesaing dalam penerapan SI/TI. Penelitian ini bertujuan untuk membuat portofolio aplikasi perencanaan strategi sistem dan TI sebagai perencanaan kedepan pada SMK Yamatu Tualang. Perencanaan strategi sistem dan TI ini menggunakan metode Ward and Peppard dan tools yang akan digunakan untuk analisa antara lain menggunakan analisis SWOT, CSF, Porter Five Forces dan Mc Farlan Strategic Grid. Dari hasil analisis dapat dirumuskan portofolio aplikasi perencanaan strategi sistem dan TI yang dibutuhkan SMK Yamatu Tualang yaitu website resmi sekolah, SI akademik, SI kepegawaian, aplikasi E-kurikulum, SI PPDB online, SI alumni dan karir serta SI perpustakaan.

Abstract:
Seen in the context of the analogy UNESCO draws between cultural and biological diversity, this chapter reflects on the leading contemporary Indian poet Arvind Krishna Mehrotra’s choice of English as a literary medium and on his practice as a poet-translator. Like a number of other major poets of the post-independence era, including Arun Kolatkar, A. K. Ramanujan, and Adil Jussawalla, and following in a path Joyce pioneered, Mehrotra refused naturalism in two ways: first, he declined to write in his ‘mother tongue’ (Hindi); second, he chose not to indigenize English as an Indian language. Instead, he chose a number of foreignizing and, for him, denaturalizing strategies, including Americanization. The chapter, which also considers the significance of these strategies given the terms of the Indian constitution, ranges widely across Mehrotra’s oeuvre, focusing on The Absent Traveller (1991) and Songs of Kabir (2001).

Every work on Jewish thought and law since the twelfth century bears the imprint of Maimonides. A. N. Whitehead's famous dictum that the entire European philosophical tradition ‘consists of a series of footnotes to Plato’ could equally characterize Maimonides' place in the Jewish tradition. The critical studies in this volume explore how Orthodox rabbis of different orientations — Shlomo Aviner, Naftali Zvi Yehudah Berlin (Netziv), Kalonymus Kalman Shapira, Joseph Kafih, Abraham Isaac Kook, Aaron Kotler, Joseph Soloveitchik, and Elhanan Wasserman — have read and provided footnotes to Maimonides in the long twentieth century. How well did they really understand Maimonides? And where do their arguments fit in the mainstream debates about him and his works? Each of the seven core chapters examines a particular approach. Some rabbis have tried to liberate themselves from the influence of his ideas. Others have sought to build on those ideas or expand them in ways which Maimonides himself did not pursue, and which he may well not have agreed with. Still others advance patently non-Maimonidean positions, while attributing them to none other than Maimonides. Above all, the chapters published here demonstrate that his legacy remains vibrantly alive today.

Although many Americans think of Jackie Robinson when they consider the story of race and racism in baseball, a long history of tragedies and triumphs precede Robinson’s momentous debut with the Brooklyn Dodgers on April 15, 1947. From the pioneering Cuban Giants (1885-1915) to the Negro Leagues (1920-1960), black baseball was a long-standing, if underdocumented, staple of African American communities. This book examines creative portraits of this history by William Brashler, Jerome Charyn, August Wilson, Gloria Naylor, Harmony Holiday, Kadir Nelson, and Denzel Washington, among others. Divided into three literary waves, the book is especially attentive to the archival contributions (and at times drawbacks) of imaginative representations of black baseball. Specifically, the book argues that African American and Euro-American novelists, playwrights, poets, and filmmakers fill in gaps and silences in recorded baseball history; democratize access to archives by sharing their research with readers; and advance countermythologies to whitewashed baseball lore. Reading representations across the literary color line also opens up a propitious space for exploring black cultural pride and residual frustrations with racial hypocrisies on the one hand and the benefits and limitations of white empathy on the other. Thus, while this book’s particular focus is black baseball, the comparative, archival mode of analysis utilized herein provides a model for analyzing literary interventions in other marginalized cultural histories as well.

India and Civilizational Futures is the second volume to emerge from the deliberations of the Backwaters Collective on Metaphysics and Politics, a group comprised largely of Indian scholars, writers, and intellectuals that was formed in late 2010 with the intent of considering how the intellectual and cultural resources of Indic civilization, and more broadly the Global South, might be deployed to introduce incommensurability and greater plurality into the world of modern knowledge systems. The members and friends of the Collective are animated by various passions: though some are interested in the decolonization of the university and in exploring other sites of learning, and others wish to put into serious question the most familiar categories that have informed humanistic inquiry and social science research, they are united both in their quest to engender an ecological plurality of knowledges and reinitiate metaphysics into the discourses of politics. The contributors to this volume offer perspectives on India’s past and intellectual traditions that suggest how we might liberate ourselves from the straightjackets of history, development, normal politics, the nation-state, and what globally passes for ‘common sense’ in various spheres of life and thought. While some papers engage with a few figures who have been critical in shaping India’s intellectual life, such as Kabir, Narayana Guru, Ambedkar, Tagore, and Gandhi, others bring into the limelight equally compelling if somewhat neglected figures such as Rahul Sankrityayan, M.G. Ranade, and T.R.V. Murti. Conceptual chapters on intercommunality, South Asian ideas of hospitality, and mnemocultural modes of learning complete the volume.

This Epilogue narrates an incident in which the Islamic Alexander became a rallying cry for the anti-kafir (infidel) movement in Sumatra. It considers how Ahmad Shah bin Iskandar, a claimant to Sumatra’s Minangkabau throne in Palembang, professed the status of a saint to wage holy war against the Dutch, and turned to the legend of Alexander the Great to inspire his resistance. As a leader of the anti-kafir movement, Ahmad Shah garnered support from various chiefs in the region and sought to build an archipelagic alliance. An analysis of Ahmad Shah’s uses of the Alexander legend reveals how the Alexander Romance was turned to religiously motived politics in European encounters with Southeast Asia. Ahmad Shah’s exegesis of Iskandar Zulkarnain’s name emphasizes the latter’s dual role as king and prophet, and in laying claim to an Alexandrian descent of Palembang provenance, Ahmad Shah pretended to sacral kingship.

This chapter begins with the introduction of Robert Kafin and his law partner, Ed Needleman who had been talking to Ted Hullar from the Sierra Club, David Newhouse from the Adirondack Mountain Club (ADK), and Courtney Jones, a philanthropist from the Lake Champlain town of Westport at Harold Hochschild's Great Camp in October 1971. The chapter describes Kafin's career shift and how he learned what was going on in the Adirondacks. Kafin saw that the National Environmental Policy Act (NEPA) and other new federal laws were broadly written and not widely understood, especially by law firms north of Albany. The chapter reviews how the Adirondack Pack Agency Act added a big new state law to that pile. These laws could be used to shape or stop development. The chapter then shifts to describe how the Adirondack Project established Kafin & Needleman as the people to talk to if you wanted to block development in the Adirondacks. It also reviews the implications of Horizon and Ton-Da-Lay development for the Adirondack Park Agency (APA). Ultimately, the chapter examines the power and influence of some lawyers in relation to the APA.

This chapter focuses on the author's childhood in 1956. On July 26, 1956, Gamal Abdel Nasser declared that he was nationalizing the Suez Canal and would use the income from the canal's operations to finance the construction of the new dam at Aswan. The broadcast of the speech was the signal for the takeover of the canal office by an Egyptian military commando unit. This episode has gone into the history books as the Suez Crisis, a highly euphemistic term, for the “crisis” was a proper war, with many dead, wounded, prisoners of war, and massive destruction. The author also describes her experiences adapting to a new environment as they move from Kafr al-Arab and Fariskur to Cairo, Egypt's capital and the cultural and political center of the Arab world at the time.

Jaroslav Strnad recognizes that the existing body of Kabir’s poetry was produced by the interplay of both oral and written traditions. He analyses the internal structure of individual poems as well as the organizational structure of manuscripts to show how we might trace the growth of this poetry along thematic and stylistic lines, and through the efforts of multiple performers and composers. He consequently argues that the study of poets in the early modern period—many of whose ‘original’ oeuvres are as elusive as that of Kabir—might be more fruitfully pursued as the mapping of such ‘streams’ of poetic development, rather than as a hunt for ur-texts.

This chapter examines the ways that white appropriation gave Zulu its power and value relative to other African signifiers. It first provides an overview of the legacy of John William Colenso, who, as Church of England Bishop of Natal from 1855 until his death in 1883, made it his business to refine, correct, and amplify existing grammars and dictionaries in Zulu. It then considers the distinction between Zulu and Kitchen Kafr—or Fanagalo, as it was called later. It also reflects on what stands in the way of learning Zulu and how Fanagalo becomes a substitute not only for Zulu, but also for other African languages. The author concludes by charting his history of attempts at learning Zulu in South Africa by citing Sibusiso Nyembezi's 1970 language manual, Learn More Zulu.

Whether it has been the case of Kabir Kala Manch (KKM) in Maharashtra or Jana Naṭya Manḍali (JNM) in Andhra Pradesh, the labouring bodies of subaltern communities have made their presence felt by reconfiguring the language and aesthetics of political theatre performance in India. Expounding on the choreopolitics of labouring bodies, the chapter while discussing the shortcomings of the middle class led left cultural movements, also offers a critique to the ongoing criticisms coming from an essentialist and ahistorical reading of art and politics. The chapter takes up cultural labour and its transformative potential in the context of Gaddar and JNM. It shows the ways in which the ‘folk performance’ can be radically constituted for a transformative politics. Gaddar and JNM reconstitute the cultural labour by reclaiming the radical language and revolutionary subjectivities of labouring body.

Chapter 6 examines the ways in which Carole Boston Weatherford’s A Negro League Scrapbook (2005), James Sturm and Rich Tommaso’s Satchel Paige: Striking Out Jim Crow (2007), and Kadir Nelson’s We Are the Ship: The Story of Negro League Baseball (2008) invite young readers to excavate the black baseball archive, engaging a millennial audience statistically disinterested in the national pastime. The visual components of these children’s books are especially crucial, as they animate the images of black players and communities from a bygone era for young readers, who will ultimately be responsible for keeping the memory of black baseball alive. Further, while all of the contemporary authors in this third wave of black baseball literature are deeply committed to accuracy, they make it clear that theirs is a, not the, historical representation, suggesting congruence with Jacques Derrida’s critique of the instability of archival truths.

This chapter analyse the status of eunuchs in Islam, compared to other civilizations. One monitor the different types of eunuchs and their evolution from serving in the harem section under early Abbasids to become intrusted with intelligence, insignia among other vital posts. The significant period of caliph al-Amin d. 813, where one see his love affairs with eunuchs and public perception to such behaviour. One do examine how third gendered eunuchs became army commanders, dominating the political affairs of the empire in early 10th cntury. That is in full collaboration with royal mothers, concubines, among other courtiers. How legendary Mu’nis al-Khadim reinstated a caliph, and toppled another for his own interests, although he has no biological future. Such domination by eunuchs, made them occupy almost all top positions in the state. The result, was the declaration of the first sole eunuch as a governor of a Muslim state in 966; Kafur of Egypt. That took place with some resentment from some intellectuals, but chroniclers did not report much dismay to the phenomena.

Abstract:
Abstract Drilling challenges in offshore Nile Delta have been largely documented in the literature. Operators are often confronted with drilling problems related to shale swelling, cavings, tight holes in combination with increased risks of lost circulation in some of the highly depleted formations. The Kafr El Sheikh shale in particular, has been linked to many instances of wellbore instability, due to its mineralogical composition (estimated to be mostly smectite, &gt;70%). From offset well drilling experience, it could also be noticed that insufficient mud weight was often used to drill through the Kafr El Sheikh Shale, causing wellbore failure in shear due to lack of support of the wellbore wall. In the past, multiple mud weight designs have been implemented relying solely on pore pressure as lower bound of the mud window. With the increased use of geomechanics, it has been demonstrated that the lower bound should be taken as the maximum of the pore pressure and borehole collapse pressure, thus accounting for the effects of formation pressure, horizontal and vertical stresses, rock properties as well as wellbore trajectory. It has been proven that slight overpressure is often encountered halfway through the Kafr El Sheikh formation, which would typically result in slightly higher borehole collapse pressures. In the study fields, the operator expressed interest in drilling highly deviated wells (&gt; 60-70 degrees). This raised concerns for increased drilling challenges, especially in the Kafr El Sheikh. A comprehensive and systematic risk assessment, design of a fit-for-purpose solution and its implementation during drilling took place in the fields of interest. Offset well data analytics from the subject fields supported a holistic evaluation of drilling risks associated with the Kafr El Sheikh, providing good understanding of stress sensitivity on deviation, azimuth and lithology. Upon building a robust geomechanical model, calibrated against offset well drilling experience, pre-drill mud weight and drilling practices recommendations were provided to optimize the drilling program. Near real-time geomechanical monitoring was implemented which helped to manage the model uncertainties. The implementation of a holistic risk assessment, including geomechanical recommendations and near real-time geomechanical monitoring, was effective to lead the drilling campaign successfully. As a result, three high angle wells (&gt; 60-70 degrees) were drilled through the challenging Kafr El Sheikh formation without any hole instability. An integrated risk assessment of hole instability, managed in stages (pre-drill and during drilling), has helped to understand and simulate the behaviors of the formation. Proactive decisions have established a controlled drilling environment for successful operations.
