Peranan hukum internasional dalam usahanya melarang penggunaan peperangan sebagai alat untuk menyelesaikan sengketa antar negara dapat terlihat pada Briand-Kellogg Pact 1928 antara Amerika Serikat dan Perancis yang kemudian diikuti oleh negara-negara lain. Mengingat substansi yang diaturnya persetujuan ini menciptakan hukum internasional universal. Oleh sebab itu negara-negara yang tidak menjadi peserta terikat juga olehnya. Penggunaan kekerasan pada suatu sengketa internasional mengakibatkan timbulnya peperangan. Dalam perkembangan teknologi persenjataan seperti sekarang ini akibat yang ditimbulkannya jauh lebih mengerikan dari pada zaman perang primitif. Senjata pemusnah massal misalnya bom nuklir itulah yang paling ditakutkan oleh manusia mengingat akibat yang ditimbulkannya dapat menghancurkan peradaban. Fihak penduduk sipil yang tidak berdosa menjadi korban keganasan perang senjata teknologi ultra modern. Diharapkan dicari suatu pemecahan untuk menjauhkan peperangan. Mengajak para fihak yang berselisih untuk lebih memperhatikan masalah kemiskinan itu lebih baik. Penggunaan istilah peperangan sudah mulai dilupakan oleh masyarakat hukum internasional dan diganti dengan sengketa senjata. Sedangkan Hukum Perang dicoret oleh sistimatika hukum internasional dan digantikan oleh Hukum Humaniter.

Abstract:
This article demonstrates the pre-eminent place the issue of interstate relations occupies in Carl Schmitt’s political thinking between the early 1920s and early 1940s. First, I discuss how Schmitt’s understanding of interstate relations develops from 1923 until the Nazi’s taking power. By focusing on his critique of imperialism and universalism in international law during this period, I reveal that his engagement with the Monroe Doctrine, the Covenant of the League of Nations and the Kellogg–Briand Pact results in a change in his views in Roman Catholicism and Political Form in which he talks about the possibility of a world state in the form of a League of Nations with supra-state and supra-sovereignty powers. Second, I show to what extent the novel international circumstances created by the emergence of the Nazi rule leads him to elaborate the concepts of the Reich and the Groβraum in addition to his continuing engagement with the concepts of imperialism and universalism. By accentuating the development of his interest in the concepts of imperialism, universalism, the Reich and the Groβraum, I argue that the question of interstate relations is the sine qua non of Schmitt’s political thinking. I conclude by asserting that studying Schmitt’s political thinking in its connection with his interest in interstate relations provides a promising path for leftist political theorists to understand, explain and reimagine the contemporary global order.

The legal prohibition on aggression was first posited in the 1928 Kellogg-Briand pact (‘The Pact of Paris’), which outlawed ‘war as an instrument of national policy’. This Chapter looks at justifications for war that were given to right wrongs and recover debts, restore honour, dignity or equilibrium, or simply as part of a right of self-preservation. It details how Germany and Great Britain, joined by Italy, decided to take coercive measures against Venezuela for unpaid debts in 1902. The chapter covers the attempt to outlaw the use of force through a multilateral treaty: the Kellogg-Briand Pact or Pact of Paris 1928. There is also a detailed look at the discussions at the League of Nations over whether the military action by Italy and Japan were Wars or something else. The emergence of the rule that territory cannot be seized by force is examined and related to the parallel rule that prohibits recognition of any such claimed acquisition of territory.

Abstract:
In this note Wight describes pendulum swings in opinion about the requirements of justice in war in Western civilization since the Middle Ages. Medieval Catholicism emphasized the righteousness of the ruler’s cause and asserted orthodoxy against infidels or heretics. Prominent writers on international law in the seventeenth and eighteenth centuries (Gentili, Grotius, and Vattel) marked a shift toward secularization and rationalism (with both sides usually able to claim justice) and restraint in the laws of war governing the methods of combat. Moser’s study of international law, published in 1777–1780, was representative of an ‘age of positivism’ (1763–1918) in which all sovereign states had a right to resort to war or to remain neutral, while codifying obligations concerning the conduct of war. The Covenant of the League of Nations, signed in 1919, initiated a return to restrictions on the right to resort to war, reinforced by the 1928 Kellogg–Briand Pact, also known as the General Treaty for the Renunciation of War as an Instrument of National Policy, which was upheld by the Nuremberg Tribunals. The Covenant ruled out aggression as unjust, while action in defence of the Covenant would be just by enforcing collective security. The Soviet Union reintroduced Holy War with its view of the Great Patriotic War (World War II) and the Cold War as just causes that advanced Communist revolutionary objectives. Counter-force strategies of nuclear deterrence may be regarded as strengthening restraint in the methods of war, compared to counter-value or ‘anti-city’ approaches.
