This document is a professional project and academic companion piece
completed to partially fulfill requirements for the attainment of a Masters in City
and Regional Planning at California Polytechnic State University, San Luis
Obispo. The project is the City of King West Broadway Master Plan (Plan). The
Plan was completed over the course of a year for a real-world client (The City of
King) and provides new form-based code recommendations in the Plan Area.
The Plan is included as Appendix A. The companion piece is intended to provide
additional background research that was conducted during the planning process,
but omitted from the final project. In the companion piece, I first explain why I
selected the WBMP for my professional project. Next, I elaborate on the sources
and inspiration for the goals of the project that are listed in the plan including
grant requirements, input from the public, and current planning practices. Finally,
I provide background research and justifications for two parts of the plan that
have little reasoning in the text: mobilehome relocation law and the suggested
development standards.

François-Denis Tronchet, jurisconsulte, participa, aux premières places, à l'application du droit, mais aussi à son écriture, à un moment de l'histoire de France où les juristes refusèrent d'être les interprètes du passé pour devenir les agents du devenir historique. Il prit part à tous les grands événements de la Révolution : les Etats généraux, le Serment du Jeu de Paume, la nuit du 4-août, l'élaboration de la Constitution de 1791, la fuite du roi arrêtée à Varennes, le procès du roi ; il siégea, sous le Directoire, au Conseil des Anciens ; enfin, il fut le premier président du Tribunal de cassation sous le Consulat, avant de présider la commission chargée de l'élaboration du Code civil. La pensée de cet avocat au Parlement de Paris fut décisive dans le passage de l'ancien droit au nouveau. Elle s'y exprime dans ses consultations, qui constituent la principale source de cette étude. Conservées aujourd'hui à la bibliothèque de la Cour de cassation, elles constituent une source exceptionnelle, rarement exploitée. Pourtant, des documents furent une source d'inspiration méconnue du Code civil. Il s'agit donc d'une configuration tout-à-fait remarquable, où l'historien dispose tout à la fois d'un travail juridique, les consultations, et du résultat qu'elles ont contribué à inspirer, le Code civil, qui régit toujours notre présent. En outre, on trouve, entre la source (les consultations) et sa résultante (le Code), des témoignages précis de l'action politique de Tronchet, notamment dans les archives parlementaires. Comment un juriste aussi érudit, aussi imprégné de tradition que François-Denis Tronchet a-t-il pu participer de façon aussi décisive à la Révolution, devenant, au moment de la rédaction du Code civil, l'artisan d'un droit absolument nouveau ? L'art de la consultation, par la liberté que donne l'interprétation, lui avait donné la capacité d'envelopper son avis personnel, parfois très créatif, des formes apparemment objectives de l'autorité de l'avocat consultant. Il s'était ainsi préparé à la grande réorganisation des normes de 1789. En outre, la participation à des réseaux d'opposition proches du jansénisme ; l'influence, dans les milieux parlementaires, du culte de la république romaine et d'une philosophie stoïcienne, transmise par l'intermédiaire de Cicéron, qui soulignait la centralité politique de la justice et de la loi naturelle ; tous ces facteurs expliquent ses prises de position favorables à la Révolution, mais aussi le rôle qu'il joua dans la défense du roi. Pour conclure, il voyait la Révolution comme une régénération, une transformation du présent par un retour authentique aux principes passés. During this period of French history, some jurists refused to be only interpreters of the Past, and began to be true actors of History. François-Denis Tronchet took part in nearly all important events of the French Revolution : the Estates-General, the Tennis Court Oath, the Fourth of August and the abolition of feudal privileges, the writing of the Constitution of 1791, the flight of Louis XVI stopped at Varennes, the King's trial. He was a Member of Parliament (of the Conseil des Anciens) during the Directoire ; lastly, he was the president of the Tribunal de cassation during the Consulate and he presided the commission in charge of the redaction of the civil code. His thought was decisive in the transformation of French Law during the French Revolution. It is conveyed in its consultations, which are the main historical source of this dissertation. Today stored at the library of the Cour de cassation, they constitute an extraordinarysource, rarely used. However, these documents inspired the French civil code. Here, historians have a hand, at the same time, a lawyer's work, the consultations, and the result they partly inspired, the civil Code, that still inspires our present. Besides, between the source (the consultations) and its result (the Code) we have some documents about the political life of Tronchet (mainly parliamentary records). How is it so, that such a learned jurist, so influenced by ancient juridical traditions, played such a crucial role in the French revolution, becoming, during the redaction process of the Civil code, the architect of an absolutely new Law ? During the Ancien regime, the art of consultation gave him, by way of the intellectual freedom of interpretation, the ability of giving his own opinion, sometimes very creative, under the guise of apparently objective, and authoritative, form of the consultation. Therefore, he was intellectually prepared to the reorganization of Law brought about by the French Revolution. Besides, other factors explain his participation in the French Revolution. His belonging to opposition networks, close to Jansenism, during the Ancien Regime accounts for his itinerary. The influence, in parliamentary circles, of the celebration of the Roman Republic as well as the influence of stoic philosophy, conveyed through Cicero's writingd, which underlined the major importance of justice and natural Law, also partly account for his adhesion to the Revolution. These intellectual influences also explain his defence of Louis XVI during his trial. To conclude, he viewed the Revolution as a process of regeneration, a transformation of time present by a resurrection of the true principles of ancient Law

In the scientific study of the emotions the goal is to find natural kinds. That is, to find categories about which interesting scientific generalizations and predictions can be formed. Core affect is dimensional approach to the emotions which claims that emotions emerge from the more basic psychological processes of valence (pleasant/unpleasant) and arousal (activation/deactivation). Lisa Feldman Barrett (2006b) has recently argued that the discrete emotion approach has failed to find natural kinds and thus should be dismissed as a failed paradigm. She offers core affect as an alternative theory that will better capture natural kinds in emotionally salient phenomena. In this thesis I evaluate Barrett’s claim on the basis of a philosophically robust understanding of natural kinds and a careful assessment of the empirical evidence. I argue that while core affect is not a natural kind, subsets of core affect space may be natural kinds.

Thesis (MBA)--University of Stellenbosch, 2011.This study investigates the independence of non-executive directors serving on the boards of the Top 40 companies listed on the JSE based on information collected from the companies‘ annual reports. It examines the definition of an independent non-executive director and analyses whether the directors of the Top 40 companies comply with the definition of the independent non-executive directors as set out in the King III Report. The third King Report on Governance for South Africa also known as King III Report was developed in response to the Companies Act of 2008 and the global financial crisis where the boards of directors were accused of not providing the required oversight in companies. Governments and regulatory bodies around the world were calling for the reform of laws and corporate governance codes to prevent occurrences such as the financial crisis and other corporate governance scandals. The new Companies Act mainly focuses on the duties and responsibilities of directors and their performance obligation. The King III report incorporated the amendments to the new Companies Act to ensure that companies are in line with best practice in corporate governance and that they comply with the law in terms of the Companies Act. The King code focuses on the role of non-executive directors with emphasis on the independence of directors because the role of directors is seen to be pivotal to good corporate governance. The findings of the study show that the majority of the companies analysed comply with the definition of an independent director as outlined in the King III Report. However, there is evidence that some companies are not yet compliant in terms of the disclosure of information concerning the tenure of directors as well as the number of directorships. The non-disclosure of information pertaining to the tenure and number of directorships held by some directors makes it difficult to assess whether the directors are fully compliant or not. There is also evidence that suggests that the majority of the boards do not assess directors‘ independence for those directors who have served on the board for more than nine years. Therefore, the majority of companies do not include a review of the independence of directors. Best practice stipulates that there be an assessment of the directors‘ independence when extending the directors‘ tenure beyond the given nine-year period. The study recommends that the King Report should be decisive on issues such as the number of directorships and that it should provide guidelines for the number of directorships that directors can hold. The study shows that some of the directors in the Top 40 companies listed on the JSE currently hold too many directorships and that there is a need for more clarity in this regard. 62 Pages. .

Nous présentons ainsi une revuebibliographique exhaustive des différentes théories et expressions de la mobilité, à partir delaquelle nous proposons une nouvelle expression pour les dislocations vis. Cette loi, utilisablepour la première fois dans le régime de transition ductile-fragile, permet de reproduire lesprincipales observations expérimentales disponibles à ce niveau. Finalement, nous montronsles améliorations apportées au code de DD Tridis BCC 2.0, qui intègrent la nouvelle loi demobilité avec une nouvelle gestion des segments de dislocation permettant de stabiliser etaccélérer des simulations complexes avec prise en compte du glissement déviéThe present work is part of a larger multi-scale effort aiming to increase knowledge of thephysical phenomena underneath reactor pressure vessel irradiation embrittlement. Withinthis framework, we focused on the description of dislocation mobility in BCC iron, which is oneof the key inputs to dislocation dynamics (DD) simulation codes. Les listes de rois, rédigées dans le haut Moyen Âge occidental, sont des documents chronologiques qui dressent les noms des souverains ayant régné sur un même peuple. Les chercheurs ont principalement étudié ces sources pour déterminer les durées des règnes des souverains mentionnés. Nous nous proposons d’étudier ces textes selon une double perspective philologique et historique. Notre réflexion est élaborée à partir de trois axes de recherche : la rédaction des listes, leurs diffusions et leurs usages. Ils permettent de déterminer les spécificités de cette forme d’écriture. Dans un premier temps, nous étudions trois cas de listes qui accompagnent des codes de lois du haut Moyen Âge : la liste des rois des Lombards et l’Édit de Rothari, la liste des rois des Wisigoths et le Liber Iudiciorum, la liste des rois des Francs et la Loi salique. Nous restituons les logiques qui président à la rédaction et à la diffusion de ces documents et, ainsi, montrons que la copie de ces textes, qui exposent un discours sur le passé royal d’un peuple, répond majoritairement à des enjeux politiques et idéologiques. Dans un second temps, nous proposons une synthèse à propos des listes de rois. Nous tentons de déterminer en quoi ces textes relèvent d’une part d’héritage de la culture écrite romaine. L’identification des auteurs des listes permette de souligner les rôles octroyés à ce document au moment de sa création et les méthodes employées lors de la mise en liste. Il apparaît que l’élaboration et la circulation de ces textes répondent autant à des usages pratiques qu’à des enjeux mémoriels et politiquesThe king-lists, written in the Early Western Middle Ages, are chronological documents that mention the name of the rulers that ruled over the same people. The researchers mainly studied these sources to determine the duration of those rulers’ reigns. We propose to study these texts from both a philological and historical perspective. Our thinking is based on three areas of research : the drafting of lists, their distribution and their use. It makes possible to determine the features of this form of writing. First of all, we study three cases of lists that go with civil codes laws from the Early Middle Ages: the list of Lombard kings and the Edict of Rothari, the list of Visigoth kings and the Liber Iudiciorum, the list of Frankish kings and the Lex salica. We explain why and how theses documents are written and disseminated and, from that, we show that the copying of these texts, which express an intention about the royal past of a people, meets both political and ideological issues. In a second step, we propose a synthesis about the king-lists. We try to determine why these texts are part of the Roman written cultural heritage. The identification of their authors makes it possible to highlight the roles assigned to this document at the time of its creation and the methods used during the listing. It appears that the elaboration and circulation of theses are for practical uses as well as memory and political issues

Motivation
Processed complementary food labels should protect and promote optimal breastfeeding and complementary feeding practices, important determinants of child survival, growth and development, and provide information regarding safe and appropriate use. However, there is a lack of formal guidelines from international normative bodies on the appropriate marketing of complementary foods. In recognition of the need for interim guidance, the Maternal, Infant and Young Child Working Group developed the Draft Guide for Marketing Complementary Foods, which provides practical guidance on how the marketing (including labelling) of processed complementary foods and supplements can be informed by the principles of the International Code of Marketing of Breast-milk Substitutes (the Code) and subsequent relevant World Health Assembly (WHA) resolutions in a way that supports optimal infant and young child feeding.
Aim
The aim of this study was to describe the extent to which the labelling practices (as a sub-set of marketing practices) of processed complementary food sold in South Africa comply with international guidance on the marketing of complementary foods that is fully aligned with the principles of the Code and subsequent relevant WHA resolutions (the Draft Guide for Marketing Complementary Foods).
Methods
Employing a cross-sectional study design, products were purchased from a sample of 17 retail grocery stores, three wholesale grocery stores, three retail pharmacies and three baby chain stores in the Gauteng, Western Cape and KwaZulu-Natal provinces from June to August 2011. Purchased products were then compared with a master list of complementary food products compiled through desk research, and missing products were identified and purchased. Label information was captured, then blinded and the order of products randomised. The Draft Guide for Marketing Complementary Foods was used to create a checklist with pre-set answers and accompanying criteria against which the captured labelling practices were then analysed.
Results
One hundred and sixty product labels of 35 manufacturers were analysed, none of which complied with all checklist criteria. Fifty-six (35%) labels did not provide an appropriate age of introduction, while 32 (20%) labels used phrases implying that the product was suitable for use before six months of age. Thirty-seven (23%) labels used images of infants appearing to be younger than six months. Only 20 (13%) labels carried a message regarding the importance of exclusive breastfeeding for the first six months of life, and none provided a message on the importance of the addition of complementary foods from six months together with continued breastfeeding to two years or beyond. Eight (5%) labels recommended feeding the product in a bottle and two labels (1%) used an image of a feeding bottle. Nineteen (12%) labels suggested a daily ration too large for a breastfed child, and 32 (20%) potentially promote the manufacturer’s infant formula. All labels provided label information in an appropriate language, but 102 (64%) labels relegated required label information to small text and were thus not easy to read. Only six (4%) labels failed to provide instructions for safe and appropriate use, while 44 (28%) did not include safety messages in their preparation and use instructions. Ten (6%) labels did not provide storage instructions, and 27 (17%) labels did not provide necessary warnings. Nutrient content claims, nutrient comparative claims, nutrient function/other function claims and reduction of disease risk claims were found on 126 (79%), eight (5%), 117 (73%) and 10 (6%) labels, respectively.
Conclusion
The labelling practices of processed complementary food labels in South Africa do not fully comply with international guidance on the marketing of complementary foods (the Draft Guide for Marketing Complementary Foods) and so do not sufficiently protect and promote optimal infant and young child feeding practices, revealing much room for improvement. Such guidance must be refined and formalised by international normative bodies and adopted into national legislation to assist manufacturers in ensuring that their complementary food labels meet an accepted standard and contribute towards the safe and appropriate use of processed complementary foods.Thesis (MSc (Nutrition))--North-West University, Potchefstroom Campus, 2013.

At the World's Industrial and Cotton Centennial Exposition, the Woman's Department offered women of all regions of the country an opportunity to exhibit what they considered "woman's work." As women came together and attempted sectional reconciliation, controversy persisted, especially over the selection of northern suffragist Julia Ward Howe, author of the "Battle Hymn of the Republic," as the Department's president. However, during the course of the event, which lasted from December 16, 1884 to May 31, 1885, New Orleanians and other southern women learned skills and strategies from participants and famous women visitors, and these southerners insinuated their voices into the national debate on late-nineteenth-century women's issues.

This study was conducted in order to understand stressful situations and stress coping strategies among employees who were working from home during the covid-19 pandemic. In attempt to bridge this knowledge gap, a critical incident approach was employed. Twelve (12) participants who were working from home were obtained purposively to participate in this study. Semi-structured interviews were conducted through zoom to collect data. Critical Incident Technique was used during interviews and thematic analysis were used to analyse data. The study revealed stressors which are lack of enough resources, extra work, lack of autonomy, work future uncertainty, stress due to covid-19, lack of help when needed, difficulties to reach colleagues, job inefficient and presence of telework unsuitable jobs. Coping strategies revealed were positive mindset, seeking social support, physical exercises, self-efforts to find solution of telework challenges, working extra hours and not answering calls or emails on purpose. It was recommended that organizations should determine suitable jobs for telework, providing required resources, granting employees working autonomy, as well as establishing a channel which can be used as a means of communication among employees as well as to be used as an inspiration and encouragement channel through proving motivational adds to help employees to relive their stressful situations.

The chronology of the Late Bronze and Early Iron Age Near East is currently a topic of intense scholarly debate. The conventional/orthodox chronology for this period has been assembled over the past one-two centuries using information from King-lists, royal annals and administrative documents, primarily those from the Great Kingdoms of Egypt, Assyria and Babylonia. This major enterprise has resulted in what can best be described as an extremely complex but little understood jigsaw puzzle composed of a multiplicity of loosely connected data. I argue in my thesis that this conventional chronology is fundamentally wrong, and that Egyptian New Kingdom (Memphite) dates should be lowered by 200 years to match historical actuality. This chronological adjustment is achieved in two stages: first, the removal of precisely 85 years of absolute Assyrian chronology from between the reigns of Shalmaneser II and Ashur-dan II; and second, the downward displacement of Egyptian Memphite dates relative to LBA Assyrian chronology by a further 115 years. Moreover, I rely upon Kuhnian epistemology to structure this alternate chronology so as to make it methodologically superior to the conventional chronology in terms of historical accuracy, precision, consistency and testability.

Nesta tese, a capacidade erro-zero de canais discretos sem memória é generalizada para canais quânticos. Uma nova capacidade para a transmissão de informação clássica através de canais quânticos é proposta. A capacidade erro-zero de canais quânticos (CEZQ) é definida como sendo a máxima quantidade de informação por uso do canal que pode ser enviada através de um canal quântico ruidoso, considerando uma probabilidade de erro igual a zero. O protocolo de comunicação restringe palavras-código a produtos tensoriais de estados quânticos de entrada, enquanto que medições coletivas entre várias saídas do canal são permitidas. Portanto, o protocolo empregado é similar ao protocolo de Holevo-Schumacher-Westmoreland. O problema de encontrar a CEZQ é reformulado usando elementos da teoria de grafos. Esta definição equivalente é usada para demonstrar propriedades de famílias de estados quânticos e medições que atingem a CEZQ. É mostrado que a capacidade de um canal quântico num espaço de Hilbert de dimensão d pode sempre ser alcançada usando famílias compostas de, no máximo,d estados puros. Com relação às medições, demonstra-se que medições coletivas de von Neumann são necessárias e suficientes para alcançar a capacidade. É discutido se a CEZQ é uma generalização não trivial da capacidade erro-zero clássica. O termo não trivial refere-se a existência de canais quânticos para os quais a CEZQ só pode ser alcançada através de famílias de estados quânticos não-ortogonais e usando códigos de comprimento maior ou igual a dois. É investigada a CEZQ de alguns canais quânticos. É mostrado que o problema de calcular a CEZQ de canais clássicos-quânticos é puramente clássico. Em particular, é exibido um canal quântico para o qual conjectura-se que a CEZQ só pode ser alcançada usando uma família de estados quânticos não-ortogonais. Se a conjectura é verdadeira, é possível calcular o valor exato da capacidade e construir um código de bloco quântico que alcança a capacidade. The decision by some public primary schools situated in the King Cetshwayo District, in KwaZulu Natal, South Africa, to use English as language of learning and teaching (LoLT) in teaching isiZulu-speaking learners in Grade 1 classrooms, is a matter of concern. English is not the learners’ home language and the practice is also against the policy of the Department of Basic Education. In considering the recommendation by the South African Constitution, Acts and language policies of the country, it is expected to see all Foundation Phase (Grade R-3) learners being taught in their home language.
The aim of this study was to explore the use of English as LoLT in teaching Grade 1 isiZulu-speaking learners. The interpretivist/constructivist paradigm underpinned the study as did the Language Acquisition Theory proposed by Skinner and Teacher Efficacy Theory by Bandura. This study adopted a qualitative multiple-case study as it aimed to explore the use of English as the LoLT in teaching Grade 1 isiZulu-speaking learners. One-on-one, semi-structured interviews, observations and document analysis were used as data collection instruments. A purposive sampling of six Grade 1 teachers from three public primary schools was employed. Thematic data analysis method was used to analyse collected data. Data collected were analysed, categorised into codes and themes were identified.
Overall, it was found that the communities regard the schools, offering English as the LoLT in teaching Grade 1 IsiZulu-speaking learners, as the best performing schools, though the language policy was not taken into consideration and the teachers are challenged in using the target language in their teaching. It was found that five Grade 1 teachers used English in conjunction with isiZulu and only one teacher used a minimal amount of isiZulu to clarify concepts for learners to understand. It was concluded that some teachers found themselves frustrated in using English as the LoLT due to lack of proper mentoring and support from the School Management Teams (SMTs). It is recommended that the provincial Department of Education, under the leadership of the Member of the Executive Council (MEC), should review the language policy and give some clarity to ensure that schools receive guidance on how to choose the most appropriate LoLT. Among beverage brands in Taiwan, King Car is the only multi-brand enterprise possessing carbonic acid drinks of “King Car,” supplementary drinks of “Oligo,” and coffee of “Mr. Brown” Ranking top brands of their categories, these brands take advantages of individual targeted markets and orientation. The success of King Car provokes the examination on its expertise in building multi-brands. In terms of brand asset management, the research intends to compare and contrast multi-brand management and single-brand to perceive key strategy to brand success. Resources and capacity within an organization constitutes its predominance, while brand is a part of intangible asset of organization generating benefits. After all, the attributions of multi-brand manufacturers are as the followings: 1.Research and develop, 2. human resources, 3. resource integration, 4 financial resources, 5. production capacity, 6. prestige, 7. market information management, collection, and analysis, 8.self-support marketing route, 9. business experience of related field, and 10. market entrance timing.Key success factors of non-alcoholic drinks are listed below:1. Commercial effects and enterprise image, 2. Entrance timing and 3. Route control. Understanding and manipulation of factors to management success vary drastically with departments. In other words, the enforcement of factors fails to reach the standard of prescribed cognition, whereas there’s still room for improvement. Eventually, the development of new product requires multi-dimensional consideration involving brand, firm value, core capacity, and consumer’s acceptability. Enterprise shall avoid flocking to the marketing strategy favoring by the majority of product development departments.

Video games and the Internet world has once again become the object of all criticism. According to the scholars research there have been a lot of proof that "Music for Youth Development brings harm", as well as violent video games too. On the other side, many psychiatrists also pointed out that if young people addicted to the Internet world excessive to form "social barriers ",which cause hard to reading and understanding people because they have been to be disciplined by the virtual world. But not all games will have a negative impact on children, for example the United States has begun to implement table games, table games had been emphasized social education to improve and learn skills. South Africa has institutionalised the application of combined assurance’s Three Lines of Defence Model (TLDM) through the 3rd and 4th editions of the King Code. Albeit, failure of the TLDM has been documented in recent corporate governance scandals in South Africa. These failures point to the inadequacy of the model in its theoretical underpinnings that place more emphasis on compliance than moral development (acts vs virtue ethics). In this research study, the adequacy of the TLDM was assessed, as well as its effectiveness in dealing with Agency. It was further sought to establish whether competitive advantage could be created through TLDM implementation in South African organisations and to quantify in relative terms, the scope for competitive advantage creation through TLDM application. A mixed research methodology (convergent design) was used to gather quantitative and qualitative insights from governance practitioners in South Africa (concurrently over a cross-sectional time frame). 204 survey respondents and 11 interviewees participated in the study. A statistically valid model for creation of competitive advantage was developed from the quantitative findings while a framework for competitive advantage was developed from the qualitative findings. The findings of the study confirm the inadequacy of the TLDM that it lies in poor implementation by South African organisations than in the model’s theoretical underpinnings. It was concluded that competitive advantage can be created though TLDM implementation in South African organisations, and the scope for creation of competitive advantage is relatively significant. The implementation of TLDM with compliance fixation mediates the creation for competitive advantage through TLDM, while moral development focus in TLDM implementation moderates the relationship between TLDM Adequacy in ethics underpinnings and competitive advantage creation. While the inadequacy of the TLDM was established through this study, the support for the TLDM was still overwhelming, although support for additional levels as contemplated in the Five Levels of Assurance Model (FLAM) was considerable.Graduate School of Business Leadership

Don Juan Manuel’s laudatory portrayal of Saladin, the Muslim Sultan of Babylon, in Exempla 25 and 50 of El Conde Lucanor presents an interesting paradox, particularly when considering that the fourteenth-century text was intended as moral instruction for a Christian audience. This report addresses this paradox by determining Saladin’s placement within Juan Manuel’s moral and spiritual philosophy through textual and comparative character analyses. The first section applies Victor Turner’s social drama theory in a textual analysis of Exempla 25 and 50 to establish Juan Manuel’s representation of Saladin as a triumphant figure, capable of meeting and overcoming challenges to his honor and virtue. The second section applies M. M. Bakhtin’s concept of dialogism to engage in a closer examination of Saladin’s “voice” in relation to other characters of Juan Manuel’s exempla for the purpose of revealing the ambiguities and finer intricacies of Saladin’s character. These analyses serve to raise and address paradoxical questions relating to Juan Manuel’s presentation of Saladin as both a Muslim adversary and friend of Christendom.text

The beginning of the new millennium is characterized by radical technological progress, paradigm shifts in natural and human sciences, increasing uncertainty about the real nature of the human being and how one person can assist another in an accountable way with solving problems in order to restore human dignity through educational psychological assistance. Research is carried out to determine what an accountable educational psychological practice, with special reference to pedotherapy, should entail. A literature study regarding basic requirements of an accountable educational psychological practice in historical and contemporary perspective is included. A further literature study is executed concerning an accountable pedotherapeutic practice. A theoretical grounding of pedotherapy is included in the literature study and specific attention is given to an analysis of the concepts and ideas of pedotherapy. pedotherapeutic relationships, the diagnostic approach and forms of pedotherapy. The nature and role of a view of human kind in educational psychological practice is also discussed. Categories describing an accountable science of Psychology of Education and its practice are presented. Subsequent criteria for the evaluation of pedotherapeutic endeavour are formulated. Origins for and the value of a universal code of ethics for pedotherapists are discussed against the background of a view of human kind. By means of an empirical investigation it is determined what the current status of Psychology of Education in theory and practice is. This investigation is conducted by means of idiographic interviews and afterwards idiogrammes are compiled to determine to what extent practitioners are conversant with theoretical foundations and an ontological view of human kind, the value of evaluation criteria and the possibilities presented by the insights of Psychology of Education and how practitioners approach their practice in ethical stance. Also the views of practitioners on current prescriptions and their suggestions for improving educational psychological practice are obtained. A number of recommendations is presented in the light of findings from the entire study. A trial run for the formulation of an ethical code for educational psychologists is presented.

American jurisprudence currently applies two incompatible validity standards to determine which laws are enforceable. The natural law tradition evaluates validity by an uncertain standard of divine law, and its methodology relies on contradictory views of human reason. Legal positivism, on the other hand, relies on a methodology that commits the analytic fallacy, separates law from its application, and produces an incomplete model of law.
These incompatible standards have created a schism in American jurisprudence that impairs the delivery of justice. This dissertation therefore formulates a new standard for legal validity. This new standard rejects the uncertainties and inconsistencies inherent in natural law theory. It also rejects the narrow linguistic methodology of legal positivism.
In their stead, this dissertation adopts a pragmatic methodology that develops a standard for legal validity based on actual legal experience. This approach focuses on the operations of law and its effects upon ongoing human activities, and it evaluates legal principles by applying the experimental method to the social consequences they produce. Because legal history provides a long record of past experimentation with legal principles, legal history is an essential feature of this method.
This new validity standard contains three principles. The principle of reason requires legal systems to respect every subject as a rational creature with a free will. The principle of reason also requires procedural due process to protect against the punishment of the innocent and the tyranny of the majority. Legal systems that respect their subjects' status as rational creatures with free wills permit their subjects to orient their own behavior. The principle of reason therefore requires substantive due process to ensure that laws provide dependable guideposts to individuals in orienting their behavior.
The principle of consent recognizes that the legitimacy of law derives from the consent of those subject to its power. Common law custom, the doctrine of stare decisis, and legislation sanctioned by the subjects' legitimate representatives all evidence consent.
The principle of autonomy establishes the authority of law. Laws must wield supremacy over political rulers, and political rulers must be subject to the same laws as other citizens. Political rulers may not arbitrarily alter the law to accord to their will.
Legal history demonstrates that, in the absence of a validity standard based on these principles, legal systems will not treat their subjects as ends in themselves. They will inevitably treat their subjects as mere means to other ends. Once laws do this, men have no rest from evil.
