Abstract:

The research goal is to figure out the role of the Al-Mawaddah Islamic Girl Boarding School or Kiswah against economic empowerment employee of boarding school. The research method used is descriptive qualitative approach with case studies. Data collected by interviews and observations directly to the informant that is in charge of the cooperative and the community surrounding the village of Coper Jetis Ponorogo and secondary data collection is derived from the journal, text books and other literature.Results from this study is a Kiswah role in the economic empowerment of the employees but still less perfect or less than optimal. The employees economic empowerment conducted by the Cooperative Al-Mawaddah Islamic Girl Boarding School or Kiswah by making Kiswah as employment and to increase their income. Going forward, Kiswah will change the shape of this cooperative that previously was business cooperatives into credit unions or other forms of cooperatives.

Abstract:

Aturan tentang nafkah pasca perceraian telah diatur dalam Pasal 80 KHI Ayat (4) huruf (a) disebutkan bahwa “sesuai dengan penghasilannya suami menanggung: a. nafkah, kiswah dan tempat kediaman bagi istri”. Dalam hal biaya pengasuhan anak (hadhanah) pasca perceraian menjadi tanggungan suami berdasarkan kemampuannya sebagaimana yang telah diatur dalam KHI Pasal 156 huruf (d) yakni “Semua biaya hadhanah dan nafkah anak menjadi tanggungan ayah menurut kemampuannya, sekurang-kurangnya sampai anak tersebut dewasa dan dapat mengurus diri sendiri (21 tahun)”. Dalam praktiknya hakim di Mahkamah Syar’iyah Aceh memutuskan terhadap nafkah iddah, mut’ah, kiswah dan serta biaya hadhanah terhadap anak yang belum mumayyiz di luar batas kemampuan suami. Oleh karena itu, penulis ingin mengetahui dasar pertimbangan hakim terhadap nafkah pasca perceraian dan bagaimana tinjauan hukum Islam terhadap nafkah pasca perceraian. Dalam penelitian ini, metode penelitian yang digunakan adalah deskriptif analisis yang bersifat kualitatif. Berdasarkan hasil penelitian, Adapun dasar pertimbangan majelis hakim terhadap putusan nafkah pasca perceraian pada kasus perkara cerai talak putusan Nomor 01/Pdt.G/2019/MS-Aceh, diantaranya dalam menentukan hak nafkah terhadap istri dan anak setelah terjadinya perceraian dapat dilihat dari kepatutan atau kemampuan suami yaitu diukur dengan melihat penghasilan suami setiap bulan, melihat usia perkawinan yang telah dijalankan oleh kedua belah pihak, melihat apakah istrinya nusyuz dan apakah suaminya pernah melakukan kezaliman terhadap istrinya, selain itu hakim juga melihat dan menyesuaikan kebutuhan dan kemampuan suami sesuai dengan kondisi suatu daerah. Ditinjau melalui hukum Islam, dalam menetapkan jumlah nafkah pasca perceraian untuk istri dan anak-anaknya hakim telah melakukan pertimbangan yakni demi kemaslahatan kedua belah pihak yang berperkara dan anak-anaknya yang dikenal dengan al-maslahah al-mursalah yaitu memelihara dari kemadaratan dan menjaga kemanfaatan.

Abstract:

This study aims to analyze the legal aspects of Mut ah Rights and Eid al-Fitr towards the wife who has been divorced by Talaq in her position as Qobla Dukhul. This research is Normative Empirical, namely research by looking at the existing conditions in the field by linking the legal sources of regulations in force in the Republic of Indonesia. The benefits that will be received from the results of this research are to find out and analyze the legal basis of Mut ah Rights and Iddah livelihoods against a wife who has been divorced by her husband in her position that the wife has not been interfered with at all (Qobla Dukhul) and to know and analyze legal considerations in the decision. Rantauprapat Religious Court No. 1173 / Pdt.G / 2020 / PA.RAP for Divorce talaq in the position of wife of Qobla Dukhul. The results of this study state that if a marriage breaks up due to divorce, according to the provisions of Article 149 and Article 158 of the Compilation of Islamic Law, the ex-husband is obliged to give a proper mutʻah to his ex-wife, either in the form of money or objects, unless the former wife is qobla al dukhul and provides a living , maskan and kiswah to the ex-wife during iddah, unless the ex-wife has been through divorce ba1in or Nusyuz and is not pregnant. In the consideration of the Panel of Judges in Case No. 1173 / Pdt.G / 2020 / PA.RAP stated that because the marriage broke up due to divorce in the Qabla ad-Dukhul State, the Respondent did not have a period of iddah at all and the applicant was released from all legal consequences of divorce such as providing support, maskan and kiswah to ex-wife during iddah.Keywords: Mut'ah, Nafkah Iddah, Qobla Dukhul

Cases that occur in the decision No. 341/Pdt.G/2016/MS.Sgi and decision No. 44/Pdt.G/2017/MS-Aceh judge has granted the applicant's request and dropped one raj'idivorce against the defendant. However, in both decisions the judge disagreed inconsidering the livelihood of the claimant/comparator's claim. In the decision No. 341/Pdt.G/2016/MS. The Panel of Judges only granted the reconciliation claim for livelihoodand without granting the livelihood of the Madhiyah reconciliation claim. Whereas in thedecision No. 44/Pdt.G/2017/MS-Aceh the Panel of Judges granted a claim forreconciliation of the iddah income along with the issue, kiswah, mut'ah and also grantedthe claim of reconciliation for the livelihood of madhiyah.

AbstrakPutusnya perkawinan karena putusan pengadilan mengakibatkan beberapa akibat hukum lainnya, diantaranya berupa pembebanan kewajiban membayar nafkah ‘iddah, mut‘ah, maskan, kiswah, hadhanah, dan nafkah anak yang dibebankan kepada suami. Tulisan ini bertujuan untuk mengetahui bagaimana ketika putusan pengadilan tidak dijalankan secara sukarela dan mencari solusi agar putusan tersebut bukan hanya sebagai keadilan semu tetapi dapat menjamin keadilan dan kemanfaatan dari putusan tersebut secara real. Berdasarkan analisis penulis, maka dapat disimpulkan bahwa dalam hal putusan tentang kewajiban mantan suami tidak dijalankan secara sukarela maka dapat diajukan upaya permohonan eksekusi putusan ke Pengadilan Agama yang memeriksa perkara tersebut. Permohonan tersebut dapat didasarkan pada hukum acara peradilan umum yaitu pasal 197 HIR atau 207-208 RBg. Upaya tersebut dapat dilakukan pihak mantan isteri meskipun hasilnya berdasarkan penilaian majlis hakim yang memeriksa perkara tersebut.

ABSTRAK Perceraian merupakan perkara halal yang dibenci Allah SWT. Jika terjadi perceraian maka akan ada masa tunggu/iddah. Imam madzahib sepakat bahwa perempuan yang diceraikan dengan talak raj’i berhak mendapatkan nafkah dan tempat tinggal selama masa iddah. Sedangkan untuk talak ba’in, mereka berbeda pendapat, Imam Abu Hanifah berpendapat istri itu tetap berhak atas nafkah dan tempat tinggal, Imam Malik dan Imam Syafi’i berpendapat bahwa istri hanya berhak atas tempat tinggal saja, sedangkan Imam Ahmad ibn Hanbal berpendapat bahwa istri tidak mendapatkan hak nafkah dan tempat tinggal. Pendapat Imam Ahmad ini, memiliki persamaan dengan peraturan perkawinan di Indonesia, tepatnya pasal 149 b Kompilasi Hukum Islam, yang menyatakan bahwa, suami wajib memberikan nafkah, maskan dan kiswah kepada istri yang ditalak raj’i dan tidak untuk istri yang ditalak ba’in. Penelitian ini adalah penelitian pustaka (library research), dan berdasarkan studi ini perlu dipertimbangkan lagi hak istri pada dua jenis talak tersebut, Sehingga istri tetap bisa mendapatkan nafkah dan tempat tinggal selama masa iddah apapun jenis talak yang dijatuhkan. Abstract:

This study aims to describe and analyze the Judge Progressiveness in the case of a �divorce �related �to domestic violence. The principle of law governing civil judges is passive, in reality this principle creates difficulties for women (wives) victims of domestic violence to achieve justice. The research method used is �non-doctrinal tradition with a socio-legal approach, and qualitative descriptive analysis. The results of the study illustrate. Religious Courts Judges as one of the law enforcers are very potential to seek justice for victims of domestic violence, the majority of whom are women, because many cases of domestic violence ended in divorce cases in the Religious Courts. But the consideration of the religious Court Judge in deciding the case of a divorce petition �is not yet progressive, the Judge still adheres to the principle of law, that the Civil Judge is passive. So that when the Plaintiff (Wife) does not demand income and compensation from her husband. The Plaintiff (Wife) as a victim of domestic violence will not get a living idah, mut'ah, maskan, kiswah and any compensation from the Defendant (Husband). Religious Court Judges have not yet explored other relevant legislation, including progressive religious texts that favor women as victims of domestic violence to strengthen the building of their arguments. Whereas in the case of divorce by talak, the Judge views the law in book in his legal considerations �by giving protection to the wife, namely by giving the wife the right to earn a living Idah, Mutah (a living for one year to entertain the wife divorced by her husband), maskan and kiswah, according with what is stipulated in the Marriage Law and the Compilation of Islamic Law. The paradigm of the operation of the Judge in a country with a pluralistic culture such as Indonesia, it's time to change to a more progressive direction, Judge is no longer limited to the existence of a mouth that sounds the sentence of the law ( le judge est uniquenment la bouche qui pronance le most de lois) Judge also not tools designed to be logical and work mechanically, but whole people who have sensitivity to humanitarian and social concerns. Progressive judges learn and are good at making interpretations that are not literal (connotative), and have a high sense of empathy to be able to catch social norms that contextually support each prescription of the Act. The holistic understanding of the judges has the potential to provide justice for women victims of domestic violence.

Penelitian ini bertujuan mengungkap respons Nahdlatul Ulama Pono- rogo terhadap dakwah dan ajaran dari gerakan Islam Fun Gerakan Islam Fundamentalis dicirikan sebagai gerakan-gerakan Islam yang hendak kembali kepada pondasi dasar ajaran Islam dan tradisi kenabian dengan pemahaman terhadap teks yang cenderung harfiah, menonjolkan klaim kebenaran, mempertentangkan Islam dan NKRI, serta menyerang praktik-praktik keagamaan ka tradisionalis. Gerakan Islam fundamentalis tersebut seka mulai mengembangkan dakwah dan ajarannya di kantong-kantong Nahdlatul Ulama seperti di Ponorogo dan sekitarnya. Untuk menggali data, penulis melakukan wawancara dengan beberapa tokoh sentral NU Ponorogo dan mengkaji beberapa dokumen serta literarur terkait. Penelitian ini mendapati bahwa untuk merespons gerakan Islam fundamentalis, para kiai NU di bawah koordinasi Pengurus Cabang Nahdlatul Ulama (PCNU) Kabupaten Ponorogo, mendirikan Aswaja NU Center. Lembaga ini kemudian mengkoordinasi beberapa menyelenggarakan program dan kegiatan dalam rangka meng-counter gerakan Islam fundamentalis. Program tersebut adalah: 1) Daurah Ahl al-Sunnah wa al-Jama’ah (Dakwah), 2) Kajian Islam Ahl al- Sunnah wa al-Jama’ah (Kiswah), 3) Usaha sosialisasi Islam Ahl al- Sunnah wa al-Jama’ah (Uswah), 4) Maktabah Ahl al-Sunnah wa al-Jama’ah (Makwah); dan 5) Bimbingan Islam Ahl al-Sunnah wa al-Jama’ah (Biswah).

Abstract:

Isra'iliyyat is all stories entering into interpretation (tafsir) based on the stories of C hristians, Jewish or others. Those stories are intentionally included into the interpretation by the enemies of Islam to corrupt Muslims' faith.The existence of Isra’iliyyat in the interpretation began from that a number of the Jews who converted into Islam couldn't totally leave all of their previous tenets and beliefs. As a result, their religious understanding and practices are .frequently mixed between Islam and their previous faith. These Isra'iliyyat stories entered and amended in the interpretation in the period of tabi'in and obtained a peak time in the period of tabi'it tabi'in without any coercive selection so that those stories are hardly ever refused.Tamim Ad-Dari, Abdullah bin Salam, Ka'ab al-ahbar, Wahab bin Munabbih,. Muhammad bin Sa'ib al-Ka/bi, Abdul Malik bin Abdul Aziz bin Juray: Muqotil bin Sulaiman, and Muhammad bin Manvan as-Suddi, the Jews priests who converted into Islam, are the main sources of the Isra’iliyyat stories. Isra’iliyyat can destruct the Muslims faith because it shows as if Islam were human creation, and could be inserted by the deviate imagination and thoughts. Moreover, it can also eliminate the Muslims trust toward the Salaf Ulama of the group of the companions and tabii·n. Besides, it can turn the Muslims notice to conduct a research and to reveal the great secrets oftheQur'an.

Teknikpengumpulan data yaitu teknik dokumentasi, yang digunakan untukmengumpulkan serta meneliti bahan pustaka, yang merupakan data sekunder darijudul dan permasalahan dalam penelitian ini, sedangkan teknik analisis dalampenelitian ini adalah deskriptif analisis yaitu menganalisis serta membandingkanpersamaan dan perbedaan pendapat Imam mazhab dan peraturan perundangundangan perkawinan di Indonesia. Dalam penelitian ini, metode pendekatan yangdigunakan adalah yuridis normatif, yaitu dengan cara menganalisa data yangdiperoleh dengan ketentuan hukum.Berdasarkan studi perbandingan hukum Islam (pendapat empat Imammazhab) dan peraturan perundang-undangan perkawinan di Indonesia,kedepannya untuk lebih mempertimbangkan hak istri, dengan dua jenis talaktersebut, dalam hal nafkah khususnya setelah ketika masa iddah sedangberlangsung. Sehingga istri tersebut tetap berhak mendapatkan nafkah dan tempattinggal ketika dia sedang menjalani masa iddah, tidak perduli dari jenis talak yangdijatuhkan oleh suaminya.

Abstract:

Syftet med detta projekt är att bygga ett lokalt nätverk åt företaget Summit i stadsdelen Kista utanför Stockholm. Det lokala nätverket ska ha möjlighet att nyttjas av minst 400 kunder och det ska samtidigt vara stabilt och säkert. Projektarbetet startades med en förstudie där jag tog fram viktig information kring olika metoder som kan användas för att bygga nätverk. Under projektets gång har jag valt ut lämplig hårdvara efter min kravspecifikation, konfigurerat hårdvaran och dokumenterat nätverket efter hur det är uppbyggt. När jag var klar med konfigurationen och dokumentationen av nätet installerade jag allt på plats i byggnaden. Resultatet av projektet var en stor succé med ett fullt fungerande nätverk och med alla dess krav uppfyllda. Kraven handlar om allt från hastighet på nätverket till hur nätet är uppdelat för bästa säkerhet kring känslig data.
The purpose of this project is to build a local area network for Summit, a company in Kista outside the city of Stockholm, which is also for the use of their customers. The aim was that the local area network should be usable by at least 400 customers simultaneously and that the LAN should be both reliable and secure. I began the project with a pilot study where I researched different methods I could use to help me build the network. Over the course of the project I chose hardware that was suitable for the network’s needs; I configured it; and I documented the whole network. When I was finished with the configuration and documentation I installed the whole network in the building. The result of this project is a huge success as a fully working local area network. I also managed to implement all the network’s needs described in the specification: everything from the network’s speed to how the network is segmented for the most secure way of handling sensitive data.

Allt högre krav ställs på en vetenskapligt grundad praktik inom det sociala arbetet, en så kallad evidensbaserad praktik. Studiens syfte är att undersöka evidensbasering i det sociala arbetets praktik. Detta uppnås genom en undersökning av arbetsmetoder och synen på evidensbaserat arbete hos fältassistenter verksamma i Rinkeby-Kista stadsdelsförvaltning. Studien genomförs med hjälp av intervjuer vilka analyseras tillsammans med olika dokument och ställs mot det teoretiska ramverket. Dokumenten utgörs av en populärvetenskaplig artikel och två arbetsplatsannonser samt skriftlig information från fältassistenterna. Författarna utgår därmed ifrån en kombination av olika sätt att inhämta kunskap. Det teoretiska ramverket utgörs av Socialstyrelsens modell för evidensbaserat arbete och tillämpad teoretisk litteratur gällande evidensbasering, socialt arbete och fältarbete. Studiens resultat visar enligt författarna att det råder en osäkerhet kring evidensbegreppet bland de fältassistenter som ingår i undersökningen. Detta leder till att den evidensbaserade praktiken till stor del utförs utan en professionell medvetenhet.
Increasingly high demands, in western welfare states, are placed on a scientifically based social work practice; a so-called evidence based practice. The aim for the study is to investigate evidence based social work practice. This is achieved through a study of the work methods of detached youth workers from Rinkeyby-Kista district administration in Stockholm and their view on evidence based social work. The study is conducted using interviews which together with various documents are analyzed and set against a theoretical framework. The documents consist of a popular science article, two job advertisements and data from detached youth workers. The authors thus use different methods of collecting data. The theoretical framework consists of the National Board model for evidence based work and applied theoretical literature regarding evidence based practice, social work and outreach work. The results demonstrate that there is uncertainty about the concept of evidence based practice among detached youth workers included in the survey. This furthermore leads to an evidence based practice which is largely carried out without a professional awareness.

Tiivistelmä. Laadullisessa tutkielmassani tutkin suomalaisia kissaan liitettyjä käsityksiä yhteiskunnalliselta tasolta tarkasteltuna. Tutkimusaineiston olen kerännyt haastattelemalla sellaisten yhteiskunnallisten tahojen edustajia, joiden näkemysten huomioiminen tuo kissan asemaan liittyviä näkökulmia monipuolisesti esille. Nämä tahot ovat eläinsuojelutaho, viranomaistaho ja luonnonsuojelutaho. Eläinsuojelutahon edustajat koostuvat löytökissojen parissa toimivista henkilöistä, viranomaistahon edustajat ovat eläinlääkäreitä ja luonnonsuojelutahon edustajat ovat luonnonsuojelujärjestöissä toimivia henkilöitä. Hyödyntämällä kehysanalyysiä teoreettismetodologisena apuvälineenäni olen tulkinnut aineistosta kolme selitystapaa, eli kehystä, joiden avulla kissan asemaa voidaan ymmärtää ja selittää. Nämä kehykset olen nimennyt historialliseksi kehykseksi, taloudellisen arvon kehykseksi ja luonnonsuojelun kehykseksi. Lisäksi olen etsinyt tutkielmassani keinoja, miten kissan asemaa voitaisiin parantaa. Käytin analyysissäni ihmistieteellisen eläintutkimuksen, kriittisen eläintutkimuksen ja kapitalismin kritiikkiin liittyviä teorioita. Tutkielmassani analysoin, että kissan heikkoa asemaa selitetään historiallisilla selitystavoilla hyödyn näkökulmasta tai kissan lajityypillisten piirteiden avulla. Käsitys kissasta helppona lemmikkinä liittyy sen pieneen taloudelliseen arvoon. Kissan asema ei näyttäydy selkeänä lakisääteisesti ja tämä korostuu puhuttaessa kissan negatiivisista vaikutuksista luontoon. Kissan asemaa parantavat keinot ovat linkitettävissä kehyksiin. Ne käsittävät valistuksen ja tiedon lisäämisen, ihmisten asenteiden muutoksen sekä lain merkityksen ja yhteiskunnallisen vaikuttamisen korostamisen. Tutkielmani havainnollistaa, että kissaan liitetyt käsitykset ovat tapauskohtaisia ja tulkinnanvaraisia. Kissojen aseman parantamiseen on kuitenkin monia keinoja. Tärkeintä on ottaa kissan pohtiminen vakavasti yhteiskunnallisen keskustelun ja toiminnan avulla.Abstract. In this qualitative thesis, I have studied what kind of views there are about cat from social perspective. I have collected the research material by interviewing representatives from social organizations whose opinions about the role of cat in society can bring up diverse views. These organizations are animal welfare organization, authority and environmental protection organization. The animal welfare organization includes people who volunteer with rescue cats, authority means veterinarians and the environmental protection organization representatives are people who volunteer in environmental protection organization. I used frame analysis as a theoretical and methodological tool to analyze three frames how one can understand and explain the position of cat. I call these frames historical frame, frame of economic value and frame of environmental protection. Besides this I also wanted to find out how the status of cat could be improved. In my analysis I used the theories from human-animal studies, critical animal studies and critique of capitalism. I analyze that historical explanations, which are linked to the benefit perspective and the species-specific perspective, explain the low status of cat. Understanding of a cat as an easy pet is related to the economic value. The status of cat is not clear in law and this is highlighted while discussion about the negative effects on environment. The solutions for improving the status of cat are linked to the frames. The solutions include education and increasing knowledge, changing people’s attitudes and the importance of law and the increasing of public influencing. My thesis shows that the views about cat are case-specific and ambiguous. There are still many ways to improve the status of cats. The most important thing is to include the thinking of cat seriously with public discussion and action.

Politics and literature are two central aspects in the work of Egon Erwin Kisch. His experiences during his brief but intense visit to Australia - from November 1934 to March 1935 ?? as an antifascist and pacifist activist/ writer in exile, led to a renewed reflection on the function of literature generally, and of the specific genre of Reportage in particular. The concept of reportage presented by Kisch in his speech at the Paris Congress ?? For the Defence of Culture?? (1935) was formulated as a direct consequence of his Australian Tour. The aim of the thesis is to analyse Kisch??s Australian Landfall in two different discourses: a historical and a literary one. The objective of the historical discourse is to examine the political relevance of the ??Kisch Case?? with regard to its impact on Australian society: the Commonwealth government??s refusal to allow Kisch to enter Australia as a speaker at the Melbourne ?? Congress against War and Fascism??, and its subsequent prosecution of Kisch as an illegal immigrant following his celebrated ??landfall?? ( a jump overboard in the port of Melbourne) became the focus of political, legal and media controversy that produced a vigorous, if short- lived culture of protest. The Kisch visit polarized Australian society and made apparent a number of internal political and socio-cultural contradictions. The focus of the literary discourse is on Kisch??s concept of Reportage which underwent significant changes due to his experiences in Australia and as a result of the difficulties in writing about events that he witnessed not only as an interested, but passionate observer and researcher, but also as a central character and actor in a very personal political drama. The analysis acknowledges the dominant writing strategies, notably the hybrid generic form of reportage, travel writing and autobiographical narrative. Kisch??s collection of reportages is remarkable also because of its innovative contribution to Australian historiography, an achievement that has been overlooked in existing Kisch scholarship. The thesis breaks new ground by reevaluating ??Landung in Australien?? as a significant contribution to the work of one of the Weimar Republic??s most important authors.

Abstract:

This study explains the process of how Kista bibliotek, a library in Stockholm, evolves from being an idea to a running activity. The library is created in a time of change, both political and economical and is supposed to meet many different goals set from many different actors. The library is placed in one of Stockholm’s biggest shopping centres, Kista galleria and close to Kista science city which is an important midpoint for international businesses and science. Kista is also an area of segregation and socioeconomic problems and the library want to connect the different ‘worlds’ and together; the local people, businesses and the community create an environment which to be proud of. With new institutionalism as theoretical frameworks and with the use of qualitative interviews and unobtrusive observations, this paper shows how the original idea transforms throughout different levels of the organization. How the library evolves to be both traditional and progressive, how it meets the needs of the locals and work with the commercial environment to fulfil their mission to be a public place in the middle a commercial shopping centre. This study portrays a picture of a library which is moves between different organizational fields, between the private and public sector to achieve the goal of being a modern library in a modern world.

AbstractWe present a certified SMT QF_BV solver CoqQFBV built from a verified bit blasting algorithm, Kissat, and the verified SAT certificate checker GratChk in this paper. Our verified bit blasting algorithm supports the full QF_BV logic of SMT-LIB; it is specified and formally verified in the proof assistant Coq . We compare CoqQFBV with CVC4, Bitwuzla, and Boolector on benchmarks from the QF_BV division of the single query track in the 2020 SMT Competition, and real-world cryptographic program verification problems. CoqQFBV surprisingly solves more program verification problems with certification than the 2020 SMT QF_BV division winner Bitwuzla without certification.
