Abstract:
This Master's thesis entitled Author rights protection organizations in the Czech Republic - their activities and presentation focuses on the area of copyright protection, especially in the field of musical work. The aim of the thesis is to provide a comprehensive overview of the current situation of collective societies operating in the Czech Republic and to compare them in selected areas of activity. The aim of the work is also to evaluate the practical functioning of the collective societies and explain some myths that are routed by the general public about the collective administration. The theoretical part of the thesis contains the definition of basic concepts, as the basis for other chapters dealing with specific collective societies, namely OSA, INTERGRAM and DILIA. This part of the thesis is based on annual reports analysis of these organizations, as well as personal interviews and written communication with these institutions' representatives. This master thesis is particularly helpful as a summary and evaluation of collective organizations' activities that are part of the culture and therefore have a significant impact on the level of Czech and other cultures.

The thesis entitled "Legal aspects of organizing music events" deals with musical performances from the perspective of organizers, performers, but also the wider public. The aim is to identify the legal issues that must be seen to by the organizer of musical performances and to evaluate the operation and use of the services of collective rights management societies and to evaluate the impact of copyright infringement and attitude of the society to its violation. The introductory chapter provides an overview of the legislation and discusses copyright and certain organizations that work in this field. The second chapter describes the activities of collective rights management companies. Equally important is the third chapter, which deals with license agreements and the different types of licenses. The final chapter applies the theoretical knowledge gained from previous chapters into practice.

The authors' rights nowadays concern every individual. They significantly influence the performing artists, who use authors' works to make their living. This thesis analyses the specific impact of the Czech legal regulations on the professional musicians, describes the competences of the collecting societies, refers to the difficulties due to differences in the legal regulations on the international scale and defines musical theme as a new term in the legal context. The thesis proves the advantage of potential use of this term in both Czech and international courts practise.

The aim of this work is to describe the quality of social dialogue in local government in the area of Czech Republic, to find out if there is, in the presence of trade union in the local government institutions, a positive influence on civil servants working for local authorities and if the impacts on austerity measures realized are reduced. For this purpose, it is important to give a detailed description of a position and function that the local government in the public sector in the Czech Republic has and to clarify a position of civil servants working for local authorities. In this work, there is also described the system of social dialog and there are analyzed the social dialog institutions with the aim of the local government. In order to find out the trade union influence over the public servants working for local authorities satisfaction, it is carried out a survey at all levels of local government. It is found a little influence on the satisfaction that the trade unions have, resulting from a relatively poor labor union organized character. This situation is, in connection with austerity measures, one cause of the social dialog in the public sector ineffectiveness.

The purpose of my thesis is to analyse the recent development of collective administration of rights (CRM). I have chosen this topic because of its actual impact and current changes on the field of CRM. The growing importance of the Internet and of digitisation technologies is opening up new possibilities for distributing creative content online. This is not in harmony with territorial principles of administration of right in Europe. So, there are challenges which can change the way how CRM cooperate and compete. First chapter briefly describes collective administration of rights in Czech Republic. Second chapter is focused on public licences concretely Creative commons. Their impact on CRM is unexceptionable and the national legislature has to react on this new phenomenon of licensing of copyright works. The aim of the present thesis is to examine an impact of reproductive and recording technique and of the global network of the Internet on the institute of collective management of copyright and related rights which forms traditional part of the system of copyright law. Firstly, the thesis embeds an issue of the institute of collective management into the appropriate legal framework and historical context. The delimitation of collective management's purpose follows; an emphasis is placed on the position of the collective manager of copyright as an intermediary between the competing interests of the right holders and interests of users. It is explained that the change of manners of communication of the work to the public from "point-to-mass" to "point-to-point" tends to weaken such position. The real and legal monopoly of collective management is scrutinized and conclusions of academics drawn from the coexistence of copyright management companies on the market in the United States are contrasted in the following part of the thesis. Collective management and use of copyright on the Internet Abstract This thesis is dealing with two main areas. The first on is a concept of collective management, particularly the collective management of rights in musical works. At the beginning it is described as a general concept. More detailed aspects such as the inner organization of a collective society, its relations with another persons and entities and the exercise of collective management through setting tariffs, licensing and distribution of remuneration are explained thoroughly on the example of OSA. The difficulties for OSA in the field of extended collective licensing in connection with the royalty-free music are pointed out while describing the regimes of collective management. The second area is the use of musical works on the Internet with regards to collective management. At first, the terms Internet and Internet Service Providers (ISPs) are described. Closely analysed is a liability of these providers for the content online and limitation of this liability with so-called safe harbours. It is argued that these harbours need to be revised as it is shown on the example of YouTube. The purpose of the thesis is to analyse the collective administration of copyright and neighbouring and relating rights, as the very title suggests. Based on the yearlong Erasmus stay in Paris, I decided to compare the Czech legislation with the legal system of France. Following after the opening, the second chapter is meant to be informative and should provide an explanation of basic concepts which the reader encounters at work. Third chapter, by a relatively brief section, describes the legal anchoring of collective administration in both jurisdictions. The fourth chapter, which is structured thematically rather than chronologically, introduces readers to the historical development of the Institute of collective management. The concept of collective administrator and analysis of its origin and status of the legal system are to be found in the fifth chapter. Chapters six and seven have an identical theme - control. The master's thesis focuses on the influence of interest groups during the creation of the 2012 Proposal for a Directive on collective rights management. In particular, the thesis deals with the pre-legislative phase of the legislative process, which began in April 2004. The theoretical framework includes conceptualization of interest groups, lobbying and influence. The mechanisms of influence are analysed using two theories - rational choice theory and rational choice institutionalism. The thesis utilizes process tracing - theory testing as a main methodological approach. Empirical evidence is investigated by analysing primary sources. The main subjects of the analysis are the most relevant documents from the European Commission concerning the pre-legislative phase. Four semi-structured interviews with selected relevant actors were also conducted. The thesis concludes by confirming/ disproving of the main hypothesis: Specific interest groups succeeded in influencing the text of the proposal for a directive on the collective management of copyright.

This diploma thesis is focused on the comparison of active and passive portfolio management of mutual funds. In the theoretical part, collective investment schemes and basic types of mutual funds are described. Included is the description of both investment strategies and an overview of empirical studies, that handle the same topic. In the empirical part are compared actively and passively managed funds from 4 U.S. economic sectors. The comparison is based on different criteria and is made for different time periods. The theoretical part focuses on the issue of portfolio management, active and passive investment management and alternative investment strategies. 1 RESUMÉ This dissertation focuses on selected aspects of copyright and rights related to copyright in connection with radio broadcasting. It specializes in use of authors' works, artistic performances of performers and phonograms of phonogram producers in the way of radio broadcasting and on internet connected to radio broadcasting according to the current legislation in Czech Republic. In the first part it concentrates on items of copyright protection, their use in radio broadcasting, on broadcasters as users in the view of copyright law, on licence agreement, term of protection and radio broadcasting itself. As far as the broadcasting is concerned the dissertation approaches it in the view of administrative law focusing on its content. In the second part it deals exclusively with collective rights management as with the key institute for broadcasters to get appropriate copyright licences to use the protected items. It concerns the compulsory and voluntary collective rights management, the cumulative agreements and royalties, and collecting societies operating in Czech Republic. With regard to the present trends this dissertation, in its third part, aims at broadcasters' activities on internet and further platforms. Abstract:
This Master's thesis deals with collective bodies in non-governmental non-profit organizations in the Czech Republic. The theoretical part acquaints the reader with basic concepts such as non-profit organization and its possible legal forms in the Czech Republic, mission, fundraising, public relations, strategic planning and briefly introduces the collective bodies of foreign organizations. The practical part is then based on good practices of six organizations, whose representatives of collective bodies were willing to share their experiences. The organizations were selected on the basis of successful participation in the competition Non-Profit Organization of the Year, in which they were placed among the top three in their category (some of them even for several years). Among these organizations we can find one registered institute, two public benefit societies and three registered associations. Since these organizations aren't with the same legal form, their collective bodies are also different. During the description of good practices, it was found, however, that the degree of motivation with which the members of the collective bodies of the surveyed organizations commit themselves to their work and their active involvement in the operations of the organization does not differ. This Diploma thesis is focused on performance comparison between mutual funds and classic ETF. In the theoretic part, essence and the principle of functioning of mutual funds and ETF are described. In conclusion of the theoretical part is included an overview of empirical studies that are focused on the same topic. In the empirical part is performed comparison between mutual funds and ETF which are selected from 4 economic sectors and oriented on the American market exclusively. Funds performance comparison is performed from the perspective of chosen investment time horizon and in the context of declining, growing and stagnating of the American stock market. Investment recommendation is made according to results obtained from the empirical part.

In this work, the copyright protection in the music industry is discussed. I am focusing in particular on the description of copyright, rights related to copyright, collective management and protection of these rights. In the beginning, I mention the national, international and European sources of copyright and I am explaining the concepts of copyright, copyright work (including musical and processed work of art), and authoring. Furthermore, I explore the copyright law in terms of its origin, content and restrictions. Copyright is based on the quasidual concept, which simply means that we distinguish the moral rights from the property rights. In this work, I explain the content of all of these individual rights. I also address the licensing contract, by which the author authorizes another person to administer the rights to use his piece. I am focusing on cases of the so-called non-contractual use of production, which means that the user may use the work without the consent of the author and free of charge. Furthermore, I define the idea and the content of performer's rights to his artistic output, the manufacturer of the sound and image recording rights to his sound recordings and radio and television broadcaster's rights to his broadcast. Copyright law is a special category of civil law which, with the upswing of the Internet, has become important for different types of stakeholders in the global information society. The 'participative web' operates with content generated by users. This user-generated content has often disputable origins in terms of copyright clearance. The Internet has opened the possibility for developing new forms of communication between anonymous or individual users who are not easily identifiable. Especially peer-to-peer file sharing and recently the information services offered and operated by the so-called 'cyberlockers' are the reason of questioning the role of copyright protection online which needs a beneficial solution.
