Abstract:

Przedmiotem rozważania są konkordaty zawarte przez Stolicę Apostolską w okresie pontyfikatu Jana Pawła II. We wstępie Autor określa pozycje konkordatu w hierarchii źródeł prawa kanonicznego i prawa państwowego. Część pierwsza zawiera analizę pojęcie konkordatu jako dwustronnej umowy międzynarodowej zawartej przez Stolicę Apostolska z danym państwem w celu normalizacji sytuacji Kościoła katolickiego na jego terytorium, mającej skutki prawne dla obu stron w przedmiocie poszanowania i ochrony wolności religii w wymiarze indywidualnym i instytucjonalnym. Część druga zawiera klasyfikacje konkordatów Jana Pawła II ze względu na przynależność państwa, będącego stroną konkordatu, do określonego regionu geograficznego, kulturowego bądź politycznego. Z tych racji zostały wyróżnione trzy grupy konkordatów: 1) konkordaty z państwami Europy, 2) konkordaty z państwami Ameryki Łacińskiej, 3) konkordaty z państwami Afryki i Azji.

Abstract:

Konkordat polski uwzględnia zasady konstytucyjne państwa polskiego i jego ustawy oraz wskazania Vaticanum II i normy prawa kanonicznego. Jego przewodnie idee to: autonomia i suwerenność Kościoła katolickiego i państwa polskiego oraz ich wzajemna współpraca. Z tej racji istnieje zbieżność niektórych postanowień Konkordatu z zasadami Konstytucji RP, dzięki czemu może on budować zgodę narodową i pokój społeczny w Polsce.

Abstract:

Wpływ konkordatu między Stolicą Apostolską a Rzecząpospolitą Polską z 1925 r. na Eparchię Stanisławowską Po upadku państw centralnych władze ukraińska i polska próbowały przywrócić własne państwo. Próby te były zasadniczo komplikowane przez sytuację etniczno-polityczną w Galicji, zwłaszcza po decyzji Ententy z 15 marca 1923 r. o połączeniu Galicji Wschodniej z Polską. Dla ukraińskiego Kościoła greckokatolickiego (UKGK) rozpoczęła się kolejna szansa i wyzwanie – współpraca z nowym rządem i rzeczywistością. Taka zmiana geopolityczna spowodowała pewnego rodzaju nihilizm prawny w stosunku do relacji państwa i kościoła, które okazało się selektywną sprawiedliwością. Te stosunki prawne powinien był rozstrzygać konkordat między Stolicą Apostolską a państwem polskim. Głównymi warunkami wstępnymi przygotowania konkordatu ze strony ukraińskiego Kościoła greckokatolickiego były niepewność prawna, napięte trudności finansowe i gospodarcze oraz kwestie społeczno-polityczne w społeczeństwie. Kościół obrządku bizantyjskiego w tym procesie przygotowawczym był prowadzony przez metropolitę Szeptyckiego, który przemawiał w imieniu swoich biskupów ze Stanisławowa i Przemyśla oraz ich wiernych. Ważne dla UKGK było wyjaśnienie kwestii własności kościelnej, wyborów biskupów, świadectwa chrztu, edukacji i struktur kościelnych. Umowa, podpisana 10 lutego 1925 r., zobowiązała do złożenia przysięgi wierności wszystkich biskupów UKGK, w tym biskupa Grzegorza Chomyszyna (1867-1945), prezydentowi polskiemu i zobowiązała do lojalności wobec państwa.

Abstract:

The concordat defnes the scope of cooperation between the state and the Catholic Church for the good of the human person and the good of society at international level. The signing of the Concordat in 1993 was preceded by long negotiations conducted by two independent legal entities – the Holy See and the Polish State. Concordat norms detail the basic human rights already guaranteed in multilateral international agreements, e.g. in the Convention for the Protection of Human Rights and Fundamental Freedoms, ratifed by Poland on December 15, 1992 (Articles 9 and 14). In general, the subject ofthe concordat agreement is all matters of church life in its institutional and individual dimension. The purpose of the article is therefore to approximate the scope of the concordat agreement in force in Poland since 1998, as well as to place it in the Polish legal system

Abstract:

Magistro baigiamajame darbe lyginamuoju aspektu kalbama apie bažnyčios (konfesijų) nustatyta tvarka sudarytų santuokų teisinę prigimtį bei teisines pasekmes. Lyginimui su Lietuvos Respublika yra pasirinktas Lenkijos Respublikos bažnytinių santuokų teisinis reguliavimas. Ši valstybė yra pasirinkta dėl to, kad joje, kaip ir Lietuvoje, religija visuomenėje vaidina svarbų vaidmenį, istorinis katalikybės vaidmuo Lietuvoje ir Lenkijoje yra labai panašus, abu kraštai yra vadinami katalikiškais. Darbe yra nurodomas santuokos sudarymo formos. Aptariama bažnytinės santuokos samprata, jos santykis su civiline santuoka. Yra apžvelgiamas bažnytinių santuokos statusas skirtingais Lietuvos ir Lenkijos istorijos laikotarpiais. Daug dėmesio yra skiriama bažnytinių santuokų pripažinimo sąlygoms, nurodoma, kokių materialinių santuokos sudarymo sąlygų reikia laikytis sudarant bažnytinę santuoką tam, kad ji sukeltų tokias pačias teisines pasekmes kaip ir civilinė santuoka. Taip pat aptariami procedūriniai reikalavimai, keliami bažnytinėms santuokoms. Yra apžvelgiami minėtų valstybių teisės aktai, reglamentuojantys bažnytinių santuokų kelią į pripažinimą. Darbe bandoma nustatyti, kokių problemų Lietuvoje ir Lenkijoje kyla pripažįstant bažnytines santuokas. Yra analizuojamos jų teisinės pasekmės, atsiradimo laikas. Aptariama bažnyčios nustatyta tvarka sudarytų santuokų pabaiga bei joms taikoma jurisdikcija. Magistro baigiamojo darbo pabaigoje pateikiamos apibendrintos išvados bei pasiūlymai dėl... In der Magisterarbeit werden im vergleichenden Aspekt das rechtliche Wesen und die rechtlichen Folgen der Ehen, die in der von der Kirche (Konfession) festgelegten Ordnung abgeschlossen wurden, behandelt. Zum Vergleich mit der Republik Litauen wurde die rechtliche Regelung der kirchlichen Ehen in der Republik Polen herangezogen. Dieser Staat wurde deswegen gewählt, weil dort, wie auch in Litauen, die Religion eine wichtige Rolle in der Gesellschaft spielt, die historische Rolle des Katholizismus in Litauen und Polen sehr ähnlich ist und beide Länder als katholische Länder genannt werden. In der Arbeit werden die Formen des Eheabschlusses angeführt. Der Begriff der kirchlichen Ehe und ihr Verhältnis zur Zivilehe werden behandelt. Ein Übersicht des Status der kirchlichen Ehen in verschiedenen Zeiträumen der Geschichte von Litauen und Polen wird angeführt. Eine große Aufmerksamkeit wird den Bedingungen der Anerkennung der kirchlichen Ehen geschenkt, es wird angegeben, welche materielle Bedingungen zum Abschluss einer kirchlichen Ehe eingehalten werden müssen, damit sie dieselben rechtlichen Folgen wie eine Zivilehe hat. Ausserdem werden Vorschriften für Prozeduren des Abschlusses einer kirchlichen Ehen behandelt. Eine Übersicht von Rechtsakten der genannten Staaten, welche die Anerkennung der kirchlichen Ehen regeln, wird gemacht.
