Abstract:
ABSTRACTIt is undeniable that most of our modern universities are portraying themselves as factory-like institutions which manufacture useful knowledge. The term “useful knowledge” refers to a type of knowledge which directly has immediate payoff and practically commodifiable. Most modern universities are no longer spotlighted as the generator of new knowledge, the influential bodies in civic life and nation-state, the greatest critics of public policies, but reduced to and figuring as a major agent of economic growth. Posting economic growth as the model for universities is a form of corporatism in higher education level. Art disciplines, as a part of humanities, are inevitably framed by such a model. In which, art is understood as a mere aesthetic commodity and the artist is seen as a mechanical subject to be manipulated by profit motifs. This view has been well prevailing, but it is not incontestable. This paper is written as an attempt to critically respond towards such prevailing corporatist view. To do that, the author borrows some philosophical perspectives from an American philosopher, Martha C. Nussbaum (1947–now). Her philosophical accounts on art, imagination, and compassion as a form of distinctive moral emotion are considerably an adversary to the current perspective of art education which has been colonized by corporatism. From her perspective, more than just a mere commodity, art has a significant role in upholding democracy. Art has the power to nurture compassion, in which respect and concern for others are inherent. Respect and concern are the vital-ethical ingredients for democracy. One particular art form which, according to Nussbaum, can nurture compassion, intensively, is a tragedy. Through which, we shall see other people as human beings, not as objects of manipulation. Such philosophical views of hers may re-attune our current perspective on art education. ABSTRAK Sulit dipungkiri bahwa kebanyakan dari universitas modern/masa kini kerap menampilkan wajahnya sebagai institusi yang serupa dengan pabrik manufaktur pengetahuan yang berguna. Istilah “pengetahuan yang berguna” merujuk kepada pengetahuan yang berdampak langsung dan secara praktis dapat dikomodifikasi. Kebanyakan dari universitas masa kini tidak lagi disorot sebagai sebuah generator bagi kebaruan pengetahuan, lembaga yang berpengaruh bagi kehidupan civic dan negara bangsa, kritikus terbesar bagi kebijakan-kebijakan publik, akan tetapi terreduksi sebagai agen utama dari pertumbuhan ekonomi. Penempatan pertumbuhan ekonomi sebagai model yang diacu oleh universitas sesungguhnya adalah sebuah wujud korporatisme pada aras perguruan tinggi. Disiplin keilimuan seni, sebagai sebuah bagian dari humaniora, turut terbingkai oleh model tersebut. Dari perspektif korporatisme, seni dipahami sekadar komoditas estetis dan sang seniman dipandang sebagai subjek mekanistik yang dapat dimanipulasi oleh motif-motif profit. Pandangan ini masih bertahan dan populer sampai saat ini, akan tetapi tidak berarti tidak dapat dikontestasikan. Makalah ini ditulis sebagai sebuah upaya untuk menanggapi secara kritis pandangan korporatistik tersebut. Dalam rangka mencapai tujuan tersebut, penulis merujuk kepada beberapa pandangan filosofis dari salah satu filosof asal Amerika, yakni Martha Nussbaum (1947-sekarang). Pandangan filosofisnya tentang seni, imajinasi, dan bela rasa sebagai sebuah bentuk emosi moral distingtif adalah lawan dari perspektif tentang pendidikan seni yang telah dikolonisasi oleh korporatisme. Seni, melalui perspektifnya, memiliki peran yang signifikan dalam menegakkan demokrasi; keberadaannya lebih dari sekadar komoditas. Baginya seni berdaya untuk memelihara bela rasa, yang di dalamnya rasa hormat dan kepedulian terhadap yang lain inheren. Rasa hormat dan kepedulian, dalam hal ini, adalah unsur etis yang vital bagi demokrasi. Salah satu bentuk partikular dari seni yang menurut Nussbaum mampu secara intensif memelihara bela rasa, adalah tragedi. Melalui tragedi, kita akan memandang orang lain sebagai manusia, bukan sebagai objek untuk dimanipulasi. Pandangan-pandangan filosofis darinya merupakan ajakan bagi kita untuk menala kembali perspektif yang bertahan hingga kini tentang pendidikan seni.

Abstract:
The Indonesian government has radically altered the structure of the national sugar industry by issuing Presidential Instruction no 9/1975 on the People’s Sugarcane Intensification Program (TRI) in order to increase sugar productivity. The dependence on the production process to sugar factories was replaced with the production process of the farmers from planting to harvesting. This research intends to document the socio-economic effects of the TRI program on farmers within the Mojo Sugar Factory work area in Sragen, Central Java, between 1975 until 1998. The result of the research has shown that farmers south of the Bengawan Solo river were resistant to the TRI program in favor of more lucrative rice farming. These farmers conducted social protests such as sugarcane field burnings. Farmers that lived north of the river supported the TRI program because planting sugarcane on non-irrigated fields was more profitable than planting other crops. This research shows that the TRI program has positively benefited to some farmers, a conclusion that is not shared by previous researches that point to only negative effect of the program.

Abstract:
The paper presents and analyses contemporary corporate brand models, brand personality constructs as well as model C2ITE. Equilibrium of the corporate brand is constituted by an integrated model of different theoretical approaches to brand phenomena. The primary model is acquired as hexagonal brand identity, as it is also a starting construct that unites the derived models. The corporate brand is causal and depends on joint communication with all C2ITE features. The corporate brand origin is the corporate identity displayed and interpreted by the ACID test model. Corporate identity is essential for several reasons: it enables further creation of the corporate brand, image and other constructs, but also because of the strategic dimension of brand positioning in consumer consciousness. The design of the brand personality is confirmed by the CBBE model dimensions. The corporate brand equilibrium is suggested by the diversification of identity, image and personality. The corporate brand must have the ability to react quickly to market changes, as well as developed collaborative approach to all participants.

Ungeachtet der fortdauernden Liberalisierungs- und Desorganisierungsprozesse in allen kapitalistischen Ökonomien weist der österreichische Korporatismus eine erstaunliche Resilienz über verschiedene institutionelle Felder auf. Der Aufsatz fokussiert auf die Rolle von sozialen Akteuren in der (Re-)Produktion oder dem Wandel von institutionellen Strukturen und Praktiken des österreichischen Korporatismus. In den vier untersuchten Feldern, d.h. der Wirtschafts- und Sozialpolitik, kollektiver Lohnverhandlungen, der Arbeitsbeziehungen auf Betriebsebene und der beruflichen Aus- und Weiterbildung, haben kollektive Akteure nicht zu institutioneller Erosion, sondern zu einer institutionellen Konversion von korporatistischen Institutionen in Richtung neuer Ziele in einem internationalen Kontext beigetragen. Während der Regierungskoalition der konservativen Volkspartei und der rechtsstehenden, populistischen Freiheitlichen Partei (2000-2006) wurde allerdings deutlich, dass das normative Bekenntnis zur Sozialpartnerschaft dann an seine Grenzen stößt, wenn sich das Machtgleichgewicht zugunsten einer stärker neoliberalen Position verschiebt. Nicht-marktbestimmte Institutionen stellen daher eher eine ‚geliehene Stabilität“ zur Verfügung, als eine robuste Basis für eine Resilienz des Austro-Korporatismus. Gewerkschaften sind im Besonderen gefordert ihre Aufmerksamkeit auf ihre Mitglieder zu richten und neue Wege zu finden, wie sie ihre Rolle als Sozialpartnerschaftsorganisationen und soziale Bewegungen kombinieren können, um die nichtmarktbestimmten Institutionen zu bewahren.

Korporativna komunikacija u svojoj suštini predstavlja pojam sveobuhvatne komunikacije poslovne organizacije s interesno-utjecajnim skupinama. S obzirom na njezin značaj u provedbi suvremenih poslovnih trendova i procesa, postala je neodvojivi element u svim poslovnim organizacijama te jedna od ključnih funkcija menadžmenta u korporativnim poslovnim sustavima. Cilj ovog rada bio je steći pregled nad najrelevantnijim znanstvenim teorijama korporativne komunikacije i njezinih temeljnih sastavnica. Unatoč znanstvenicima koji su je definirali brojnim teorijama, zbog njezine sveobuhvatnosti do danas nije postignuto suglasje znanstvene zajednice oko temeljne znanstvene definicije. Dodana vrijednost ovog rada je uvid u teorije najeminentnijih znanstvenih autoriteta u svrhu pregleda sveobuhvatnosti područja i promišljanja daljnjih znanstvenih istraživanja. Stavljajući dostupne teorije u kontekst brzine poslovnih i tehnoloških promjena kojima se poslovne organizacije moraju prilagođavati, može se zaključiti kako će korporativna komunikacija pratiti procese prilagodbe što će zasigurno rezultirati novim znanstvenim tumačenjima a samim time i otežati postizanje suglasnosti znanstvene zajednice oko temeljne znanstvene teorije.

Zusammenfassung Ausgehend von der Pluralisierung und Liberalisierung der gesundheitspolitischen Interessenlandschaft beschäftigt sich der Aufsatz mit der Frage, auf welche Weise sich die Struktur und Funktion des Meso-Korporatismus im deutschen Gesundheitssystem verändert und welche Entwicklungsperspektiven unter den Bedingungen von Vermarktlichung und Verstaatlichung bestehen. Hierzu werden die korporatismustheoretischen Grundlagen geklärt und am Beispiel der Konzertierte Aktion im Gesundheitswesen (1977), des Gemeinsamen Bundesausschusses (2004) und der Konzertierten Aktion Pflege (2018) wichtige Entwicklungen nachgezeichnet. Die Autoren argumentieren, dass die meso-korporatistischen Foren erodiert sind, aber keineswegs ausgedient haben. Vielmehr ist die Beteiligung der Interessenverbände an den für die Politikformulierung maßgebenden Netzwerken und Prozessen in zunehmendem Maße selektiv und situativ geworden. Abstract: Corportarism in German Health System: Requirements, Conditions and Development Based on the pluralisation and liberalisation of health policy interests, this paper deals with the question, how the structure and function of mesocorporatism in the German health system is changing and what development perspectives exist under the conditions of Vermarktlichung and Verstaatlichung. For this purpose, the theoretical principles of corporatism will be clarified and important developments traced using the examples of the Concerted Action in Health Care (Konzertierte Aktion im Gesundheitswesen 1977), Federal Joint Committee (Gemeinsamer Bundesauschuss 2004) and the Concerted Action in Nursing (Konzertierte Aktion in der Pflege 2018). The authors argue that the mesocorporatist forums are eroded, but not disused. Rather, the participation/involvement of interest groups, in the networks and processes that are decisive for policy formulation, has become increasingly selective and situational.

Dieser unter ähnlichen Zwängen und unter teilweise unterschiedlichen Modalitäten in anderen Ländern (Argentinien 1966-73 u. 1976-heute, Peru 1968-80, Uruguay Juni 1973-heute, Chile September 1973-heute) wiederholte Versuch, die Reste des Populismus zu beseitigen und neue Strukturen der sozialen Kontrolle, der wirtschaftlichen Entwicklung und der Herstellung eines politischen Konsensus zu schaffen, hat einen Typ von Staat entstehen lassen, der im lateinamerikanischen Kontext deutlich neue Züge aufweist.

In the modern world, security is exposed to numerous transnational and asymmetric threats. Such circumstances necessitate the collaboration and joint efforts of the security capacities of national states, as well as their firmer integration into the collective system of international security. Within that framework, corporations, as the most developed business systems that transcend national boundaries, establish a system of corporate security that, in addition to its basic function as the protection of the security of a business, exerts further influence on national security. In the era of global interdependence, national security and economic development are intricately connected. While security risks jeopardize the transfer of people and capital, stable economic development and successful provision of public services stimulate legitimacy and strengthen the social cohesion within a state, thus reducing the threat of societal fragmentation. On the other hand, economic crisis and recession can fuel security threats, from unemployment, poverty, and political instability, to intra- and international conflicts. The state of corporate security in the countries of the Western Balkans and its position in national security systems is influenced primarily by the following factors, the ongoing economic and financial crisis; the unfinished process of transition; political instability; new forms of security risks and threats; the coupling of organized crime and corruption; insufficient legal and normative organization of the non-state security sector. V sodobnem svetu je varnost izpostavljena številnim nadnacionalnim in asimetričnim grožnjam. Take okoliščine zahtevajo sodelovanje in skupna prizadevanja varnostnih zmogljivosti nacionalnih držav, pa tudi njihovo trdnejše povezovanje v kolektivni sistem mednarodne varnosti. V tem okviru korporacije kot najbolj razviti poslovni sistemi, ki presegajo nacionalne meje, vzpostavljajo sistem korporativne varnosti, ki poleg svoje temeljne funkcije, torej zaščite varnosti podjetja, dodatno vpliva na na- cionalno varnost. V času globalne soodvisnosti sta nacionalna varnost in gospodarski razvoj neločljivo povezana. Medtem ko varnostna tveganja ogrožajo pretok ljudi in kapitala, stabilni gospodarski razvoj in uspešno izvajanje javnih služb spodbujata legitimnost in krepitev socialne kohezije v državi, s čimer se zmanjša nevarnost družbene frag- mentacije. Po drugi strani pa lahko gospodarska kriza in recesija sprožita varnostne grožnje, od brezposelnosti, revščine in politične nestabilnosti do znotrajdržavnih in mednarodnih konfliktov. Na stanje korporativne varnosti v državah Zahodnega Balkana in njeno vlogo v sistemu nacionalne varnosti vplivajo predvsem trenutna gospodarska in finančna kriza, nedokončan proces tranzicije, politična nestabilnost, nove oblike varnostnih tveganj in groženj, porast organiziranega kriminala in korupcije ter slaba pravna in normativna ureditev nedržavnega varnostnega sektorja.

Over the years, the irresponsible behavior of individuals and companies through the years created growing social and environmental problems around the world. Globalization, market growth, and industrialization lead to increasingly negative impacts on the natural environment. Socially responsible business is a concept of which the company pays attention to achieving growth and development, and also to cooperate with employees, locals, consumers, business associates, and society as a whole. This paper presents the results of a pilot study conducted on the territory of the Republic of Serbia, Autonomous Province Vojvodina. 53 companies, with over 250 employees, participated in the research. In the paper, the authors presented and evaluated various dimensions of socially responsible business and environmental performance, and based on the obtained results it was determined that there is a statistically positive correlation between these variables.

Die unterschiedlichen religionsrechtlichen Traditionen der Einzelstaaten werden geachtet. Über die Vertretungen bei den europäischen Institutionen haben die Kirchen die Möglichkeit, ihre Anliegen und Interessen wirksam zu vertreten, so dass die gelegentlich zu beobachtende Ignoranz gegenüber der Religion auf europäischer Ebene einer freundlichen Offenheit und Kooperationsbereitschaft gewichen ist.

Dies setzt voraus, dass sie innenpolitisch diese Anpassungsprozesse realisieren können. Eine wichtige Voraussetzung hierfür ist die Sozialpartnerschaft. Damit ist ein System der innenpolitischen Kompensation für die potentiellen Verlierer der Weltmarktöffnung verbunden. Dies ist der Kern der These, die Peter Katzenstein in seinem bahnbrechenden Werk über ‚Kleine Staaten in Weltmärkten’ für sieben Länder und den Zeitraum bis Anfang der 1980er jähre entwickelt hat. In diesem Beitrag zeige ich, dass diese These auch auf die Gegenwart und auf einen größeren Kreis demokratischer Kleinstaaten zutrifft. Freilich müssen drei Ergänzungen gemacht werden: Erstens entwickelt nur ein Teil der kleinen Länder eine wirtschaftlich wirksame Sozialpartnerschaft. Zum zweiten variieren nicht nur die Typen der kleinstaatlichen Korporatismen, sondern auch die Kompensationen viel stärker, als dies Katzensteins Werk nahe legt. Und zum dritten sind heute große wie kleine Staaten außenwirtschaftlich sehr verwundbar; aber die Voraussetzungen für die Einführung oder Beibehaltung einer wirksamen Sozialpartnerschaft sind bedroht.

U ovom tekstu izložit će se pitanje jednog novog oblika konstitucionalizma: zelenog ili ekološkog konstitucionalizma, koji je postao svojevrsno „pitanje dana“ suvremene ustavne politike, kao i osnovne konture njegove problematike s kojom se susreće moderni ustavotvorac i ona demokratska politika koji su voljni realizirati mjere „ekološki protektivne politike“. Posebna pozornost će se, dakle, pokloniti izvorima, oblicima i svrsi afirmacije recentnog zelenog konstitucionalizma. Temeljno je polazište da konstitucionalizaciju zaštite okoliša ne treba promatrati kao panaceu koju bi trebalo izbjegavati ili uklanjati iz amplituda ordinarnog političkog odlučivanja. Naprotiv, inzistiranjem na njegovoj konstruktivnoj ulozi moguće je zagovarati i ostvarivati demokratsku političku kontrolu nad „raspojasanim“ snagama tržišta koje preko okoliša i drugih pitanja koja se tiču javnog dobra već dugo žele do kraja ostvariti politiku deregulacije i korporativne vladavine.

Abstract:
The different models for the criminal liability of juristic persons reveal a tension between individualist and realistic approaches. For individualists a corporation is the product of a union of individuals. This means that a juristic person can only be held criminally responsible if the conduct and fault of an individual involved in the entity are attributed to the juristic person. For realists a corporate entity has an existence independent of its individual members. The juristic person is blameworthy because its corporate identity or corporate ethos encouraged the criminal conduct. A study of organisational theory reveals that corporate crime may not necessarily be traced to the fault of specific individuals. Corporate criminality often is the result of complex decisions on different levels of the corporate hierarchy and furthermore is encouraged by the manner in which the organisation is structured. Prominent scholars such as the American philosopher Peter A French and the Australian Brent Fisse rejected an individualist approach and attempted to develop models of corporate fault based on the corporate identity idea. The failure of a corporation to take preventative or corrective measures in reaction to corporate criminal conduct is regarded as the basis for corporate fault by these authors. French calls this the "principle of responsive adjustment" whilst Fisse names it the concept of "reactive fault." A more sophisticated model (the "corporate ethos" model), which is also more reconcilable with the basic notions of criminal law, was developed by the American legal scholar Pamela Bucy. * A corporation will be held criminally responsible if its corporate ethos has encouraged the criminal conduct. This approach is often regarded as the most sophisticated and comprehensive model for corporate criminal liability. The Corporate Manslaughter and Corporate Homicide Act of the United Kingdom of 2007 provides that a jury may take into consideration the extent to which the evidence shows that there were attitudes, policies, systems or accepted practices within an organisation that were likely to have encouraged failure to comply with health and safety legislation. The corporate culture or corporate identity model is not the exclusive model of attribution in these jurisdictions. It does, however, go a long way towards recognising true corporate or organisational fault. Corporate acts are not merely reduced to the fault of individuals but are rather based on the manner in which the corporation is structured.
