Abstract:
The Constitution of the Republic of Kosovo in its basic provisions has constituted the principle of separation and control of the balance between state powers as a fundamental principle of democracy, by designating representative bodies belonging to state powers such as Parliament, Government, and Judiciary. In addition, the Constitution sanctions other state bodies that have a constitutional character and together create the form of governance in the Republic of Kosovo. Among them also the President functions as a constitutional body exercising the executive duty and having ceremonial competencies. The President in Kosovo is a neutral authority because he/she is a representative of the people’s unity. The authorities in Kosovo create a "check and balance" among themselves for the normal functioning of the state. Kosovo is considered a parliamentary Republic, not sanctioned by the constitution but implied based on the decision of the Parliament of the Republic of Kosovo.In addition to electing the Government, the Parliament also elects the President of the Republic, so in this study, we will address the function of the President, the exercise of his duties, his competencies, and his relationship with other state bodies. We will also analyze the system of governance and the principle of separation and balance of powers, with special emphasis on the constitutional position of the President in the Republic of Kosovo. Among other things, we will address in particular the complexity of the procedures for the election of the President of the Republic of Kosovo. Considering the ongoing problems that have accompanied the presidential elections in the Republic of Kosovo and that continue to be so, it is necessary to clarify whether “the constitutional reform initiative for the President of the Republic of Kosovo to be voted by the people is considered the most current and best way of overcoming the present parliamentary stalemate in the election of the candidate for the President of the Republic, as well as whether the implementation of this reform is conditioned by the will of the political parties and the people”. In general, from the stated scientific elaboration of the topic, we can conclude that the intention of this paper consists in determining the constitutional regulation of the institution of the President of the Republic of Kosovo applied in the parliamentary system, empirical elaboration of problems that accompanied the election of presidents in the Republic of Kosovo as well as the immediate need to change the manner of electing the President of the Republic of Kosovo.

Abstract:
The paper "The guarantees of the human rights of the defendant in the law system in Kosovo" aims to treat the access of the Republic of Kosovo in the delivery of constitutional guarantees and legal guarantees to protect the defendant in the criminal procedure. Within these guarantees, special emphasis is placed on the judicious acts in force that provide these guarantees in the Republic of Kosovo. A special analysis with regard to this paper is dedicated to the Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR), the practice of European Court of Human Rights (ECtHR), the Constitution of the Republic of Kosovo and the Criminal Procedure Code of Kosovo (CPCK). The analysis of those acts clarifies that the guarantees of the Legal System in Kosovo coincide with the rights of the defendant. Another dimension that finds space within the paper is the practical implementation of the guarantees provided by the aforementioned acts in terms of the rights of the defendant. The role of the Constitutional Court in the Republic of Kosovo in the past and now has been mainly analyzed in the formation of the constitutional and international guarantees, applicable in Kosovo concerning the rights of the defendant in the criminal procedure.

The Constitution of the Republic of Kosovo in its basic provisions has defined the form of government and separation of state powers, as a fundamental principle of democracy, where the President of the Republic of Kosovo is not part of any of the state powers, but the constitutional powers he exercises affect that he has connections with all state powers. This paper addresses the relation of the President of the Republic of Kosovo with the legislative power, including the exercise of some of his constitutional powers, namely the convening of the constitutive session of the Assembly, the dissolution of the Assembly and the annual speech of the President in the Assembly of the Republic of Kosovo. The above-mentioned competencies, in addition to the theoretical aspect, are also analyzed in the practical aspect when these constitutional competencies of the President were materialized by President Jahjaga during the mandate 2011-2016. Also, the political stalemate and the actions taken by the President, Mrs. Atifete Jahjaga for his overcoming, criticisms and recommendations of the European Commission in the Progress Reports regarding the political stalemate in the country. since the declaration of Kosovo as an independent state in 2008, it has managed to complete a full constitutional mandate, five years, unlike its predecessors and successors until 2019. Therefore, this paper aims to elaborate the exercise of some constitutional powers and the practice of one of the most important constitutional institutions in the Republic of Kosovo, that of the President of the Republic of Kosovo.

The article is dedicated to a review of the laws on criminal liability of legal entities of a partially recognized state, the Republic of Kosovo. Its main acts are the Criminal Code of the Republic of Kosovo, the special Law on the Liability of Legal Entities for Criminal Offenses and the Criminal Procedure Code of the Republic of Kosovo, which came into force on January 1, 2013. The publication reviews statutory resolutions allowing considering a legal entity a criminal liability subject; pays attention to the fact that legal entities in the Republic of Kosovo may be brought to criminal liability for any actions acknowledged as crimes by the national criminal laws with no exceptions; specifies articles of the General Part of the Criminal Code of the Republic of Kosovo, provisions of which are applied to bringing legal entities to criminal liability; reviews such criminal sanction types applicable to legal entities as a fi ne, liquidation of a legal entity, property forfeiture; analyzes circumstances considered at punishment imposition and the conditions for release from punishment. The author notes the criminal procedure peculiarities of bringing legal entities to liability.

Abstract:
This thesis examines grassroots peace building in Kosovo during the period 2001 - 2008 and seeks to understand how international actors have best supported, or otherwise, a process of deepening peace at this level. The research centres on analysis of thirty-three in-depth interviews with the main actors from this field. Through analysing interpretations of peace and peace building in Kosovo, I identify a contradiction between on the one hand, the dominant approach of building peace through relationships (favoured by international actors); and on the other, the need for peace to address personal needs. This means helping individuals come to terms with the past, and affecting a broader normalization of people’s everyday lives. I assert that a ‘deepening’ of peace in Kosovo will ultimately come about through offering young people more opportunities to ‘open up their hearts and minds’ - to broaden their horizons in ways that they feel empowered to view themselves and the world around them through a critical lens. This research identifies negative attitudes and behaviours amongst external actors in Kosovo, and illustrates how our personal qualities and conduct are of primary importance when it comes to peace building. In doing so, I identify a need for a higher level of self-awareness, commitment and empathy amongst external actors. Whilst reports have emerged which seek to evaluate the impact of peace building in Kosovo, this research examines the experiences of those engaged in such endeavours and encompasses a strong story-telling element. It also seeks to ground the issues at stake within a broader understanding of Kosovo’s social and historical landscape.

Agriculture is one of the most important branches of economical development in the Municipality of Klina. The Municipality’s geographical position, climate and earth conditions, as well as the manpower in the territory of enables cultivation of much agricultural cultivation and the growth of high efficiency in the area. Considering all the existing factors and the new factors (to be initiated) of the development which will be based on long term socio-economic development of the municipality of Klina, most important is the agriculture. Making use of and harmonizing the available natural factors, agriculture will secure to the municipality of Klina sufficient food, produce an important overflow of market, and a general growth of the overall income and employment of the inhabitants. Convenient fertile lands, the change of planting structure, adequate appliance of agro technique and watering will create propitious possibilities for increasing agriculture production, notably the development of farming. Agriculture will for a long time be bearer of general socio-economic development in the Municipality of Klina, all it is needed is to set and realize basic purpose, role and direction of agriculture development. This make possible orientation in development and creation of conditions for the alteration of the structure of the fabrication, utilization of the existing possibilities, and finding new ways of development, recommendation of the existing systems and building new watering systems, arranging terrene, increasing land fertility, reorganization of the manufacture and reinforcement of the private sector and execution of the more dynamic increase of trade products, intense urbanization of rural places, fair governing, equipping lands with more qualitative roads for agrarian needs. All this will contribute to more quality and quantity innovation of the existing state. In a direct connection with this is the increase of plan efficiency and the increase of productivity, the plant fabrication with organizing conditions for using more water for watering, larger mechanisms for ii productivity, the expansion of guanos and fertilizers and the application of contemporary agro technical measures. Except the efficiency increase and the assortment of agricultural production, it must be reckoned that the farming should rapidly be developed through the specialization of private sectorfarms, individual mini farms for cultivation of cattle and poultry, milk and dairy products and egg production. Buying stations and depot are necessary as well as the stations that sell cattle food, guanos, agriculture tools and mechanisms, the service for mending these tools, agrarian stations, farming pharmacy, and veterinary stations.

AbstractUsing Regional Security Complex Theory, this paper examines the role of the OSCE in securitizing and de-securitizing actors in developing Kosovo-Serbia relations. The research is based on an analysis of official documents collected at the archives of the OSCE Documentation Center in Prague. In this regard, the contribution provides an in-depth analysis of developments in Kosovo within the OSCE context starting from 1995, when the OSCE was established, until 2001, when the Federal Republic of Yugoslavia was welcomed once again as an OSCE participating State. This period is contrasted against that of more recent positive developments in Kosovo starting from 2015, when Serbia was the first Western Balkan country to Chair the OSCE, until 2020, and the Albanian OSCE Chairmanship. This research investigates the role that the regional actors, namely the USA, the EU and the Russian Federation, played in enhancing or not Kosovo’s domestic developments. This study intends to bring to light the progress made on Kosovo’s path to democratization by highlighting the controversy in relation to its ongoing struggle to have a seat at the table of the OSCE and a voice on important issues concerning its domestic security.

AbstractThe Organization for Security and Cooperation in Europe (OSCE) comprises 57 participating states, including almost all the countries of the Western Balkans. The only country which is not a participating state of the OSCE in this region is the Republic of Kosovo. Kosovo announced its independence from Serbia on 17 February 2008, and a number of OSCE participating states soon after recognized its statehood. However, some participating states, including Serbia, Russia, Spain, Slovakia, Romania, Cyprus, and Greece, did not. International organizations, such as the United Nations (UN), the European Union (EU), and the OSCE, have been engaged in post-conflict reconstruction of Kosovo since 1999. The aim of this article is to show the role of international community engagement in rebuilding the social security system in Kosovo since the end of the war of 1999. This analysis will enable the reader to understand not only the evolution of the social security system in Kosovo, but also the direct and indirect impact of international community on the social security of the states with limited recognition.
