Abstract:
This paper discusses of the strengths and weaknesses of the long-term Finnish crime policy and the reform ideology of the 1970s. These ideas were crystallized in slogans such as "crime policy is an inseparable part of general social development policy" and "good social development policy is the best crime policy". The goals of this policy were defined by a two-fold formula: (I) the minimization of the economic and social costs of crime and crime control (the aim of minimization), and (2) the fair distribution of these costs among the offender, society, and the victim (the aim of fair distribution). During the last 25 years, Finnish crime policy has been guided by these basic ideas. This paper examines the success of this policy. One major indicator of its success has been the decrease in Finlands rate of incarceration. At the beginning of the 1950s, the incarceration rate in Finland was four times higher than in the other Nordic countries and among the highest in Europe. However, the steady decrease that started soon after the Second World War has continued, and by the early 1990s Finland declined to the Nordic level. The paper also examines the relation between incarceration rates and reported crime. A comparison of the Nordic countries reveals that the major crime trends have been essentially identical despite striking differences in the use of imprisonment. It is concluded that the decrease in the prison population has been one of the major victories of the Finnish crime policy. The paper also discusses important reforms to the present crime policy, the role of the criminal law as distinguished from other crime policy mechanisms, the aims and functions of the penal system, and foreseeable problems ("risk factors'') that may threaten the basic tenets of humane and rational crime policy.

Evidenzbasierte Kriminalpolitik orientiert sich an systematisch gewonnenem empirischen Wissen über Kriminalität und Strafe. Sie muss das zu lösende Problem kennen und wissen, welche Maßnahmen bei wem wie wirken. Die Kriminal- und Strafrechtspflegestatistiken sollten idealiter Basisdaten hinsichtlich der Problemlage und der Umsetzung der Maßnahmen liefern. Insofern sind sie eine notwendige, wenngleich keine hinreichende Bedingung für evidenzbasierte Kriminalpolitik. Die deutschen Kriminalstatistiken erfüllen diese Aufgabe aber unvollständig. Ihre Defizite werden aufgezeigt und Vorschläge zur Weiterentwicklung gemacht.

Abstract:
The purpose of this study is to analyze what criminological theory explanations the Sweden Democrats use in their criminal politics. The three main questions from which we assume are: How do the Sweden Democrats approach crime? On which criminological theory is the Sweden Democrat’s policy of crime based upon? And which measures and preventive methods do the Sweden Democrats find appropriate to fight criminality? Our hypothesis is that the Sweden Democrat’s reuse/reproduce the Labeling Theory and that the party with its standpoints in this area and the rhetoric used, create a risk for individuals and/or groups of people to be labeled. The labeling can then contribute to increasing crime, in the form of the self-fulfilling prophecy. Our study is a qualitative study, based on literature studies. The analyze method that used for the collected material, is the content analysis. The five analyzed documents are written and publicized by the party. The results in this study suggest support for the tested hypothesis.

Abstract:
Den här studien är en kvalitativ innehållsanalys över vad intagna på svenska anstalter har diskuterat utifrån fångtidningen Hallbladet. Det empiriska material jag har utgått från har varit Hallbladet. Totalt har 139 artiklar analyserats. Jag har tittat på den svenska kriminalpolitikens utveckling och jämfört den med diskussionerna i Hallbladet. Jag har varit ute efter att fånga de intagnas verklighet så som de uppfattar det. Om denna överensstämmer med verkliga förhållanden är inte relevant då det är deras åsikter som ska analyseras. 1960-1971 var en period då det hände mycket inom kriminalvården. 1965 infördes den nya brottsbalken, 1966 startades riksförbundet för kriminalvårdens humanisering (KRUM) och 1969 anordnades den första strejken på Hallanstalten. Kriminalpolitiken diskuterades i Hallbladet men den diskuterades inte i någon större omfattning. Jag har haft stämplingsteorin som teoretisk utgångspunkt för studien. Stämplingsteorin valde jag då jag haft en hypotes att intagna stämplas av samhället som onda och att denna stämpling blir självförverkligande. Att de intagna uppfattar sig som stämplade av samhället och kriminalvården framkommer i deras diskussioner. Jag har också valt att utgå från Nils Christies teori rörande den goda fienden. För att en fiende ska uppfattas som god måste vissa kriterier vara uppfyllda, bland annat att fienden måste uppfattas som farlig och att de som bekämpar fienden måste ha stöd från samhällets håll. Den goda fienden har också visat sig vara en fungerande teori då bland annat media, enligt de intagna, under vissa perioder punktmarkerat alla intagna som farliga för att uppnå ett samhällsstöd i att bekämpa dem.

Abstract:
This thesis analyses the punishment for murder. During the 16th and 17th centuries Swedish punishment was brutal and death penalty was a normal sentence. In modern days sentencing in Sweden has become more moderate with fines and imprisonment as the severest forms of penalties. The sentence for murder has been reformed several times during the last couple of years and it seems as though the sentence never can be strict enough. The will of the legislator has been to make life imprisonment the main sentence for murder. However, the Supreme Court of Sweden and the legislator doesn’t seem to be in agreement about what the right sentence for murder should be. When the legislator aggravates the sentence, the Supreme Court mitigates it. Since there has been numerus reforms of the sentence for murder the purpose of this thesis is to look at the motives behind the bills and The Supreme Court’s grounds for decision to review whether or not they are legitimate. In former times sentences has been motivated by different ideologies such as general or individual deterrence, humanitarian grounds and the principal of proportionality. Therefore, the main purpose is to evaluate if the motives behind the bills of the murder sentence was motivated by those ideologies or if other factors dominated. Some professionals are namely under the opinion that criminal politics has become more offensive and because of that the motives behind different bills are others than accepted ideologies. This thesis analyses whether a more offensive criminal politics can be noted when reviewing the bills changing the sentence for murder. With a changed criminal politics some critics propose that the Supreme Court also has become more offensive. The conclusions are the following. In the motives behind the four bills changing the murder sentence one could say that there are signs of a more offensive legislator. The main argument is often that the society has changed their view of the crime which motivates a stricter sentence. Some ideologies such as the principal of proportionality are used in the motives but often in comparison with the societies changed view and not in comparison with other crimes. As for the Supreme Court of Sweden the results show that the court not have become more active, at least not in regard to the murder sentence. In those cases, were the court has ruled against the will of the legislator the court has had legitimate reasons for doing so.
