Si la mal-aimee franciade suscite depuis une vingtaine d'annees un regain d'interet, elle n'a pas encore fait l'objet d'une etude d'ensemble, qui prenne en compte, davantage que la theorie de l'epopee enoncee dans les arts poetiques, sa pratique effective. Nos outils critiques sont empruntes a la lexicologie (index d'a. E. Creore) et a l'intertextualite. Distincte de celle projetee pour henri ii, "la franciade de charles ix" s'ouvre sur une importante "epistre au lecteur", qui en laisse percevoir les enjeux. L'action proprement dite commence a buthrote, cette troie contrefaite ou vit un prince cache, engourdi, que des dieux vont venir reveiller. La tempete precipite francus "dans les erreurs de crete", l'ile des grands mythes antiques, espace clos ou s'affrontent les forces antagonistes de l'ordre et du desordre, bientot incarnees par le prince troyen et le tyran phovere. Une seconde epreuve attend le heros, aime de deux princesses a la fois dont il doit rejeter l'une et courtiser l'autre. Le dernier livre, "des plus beaux" au jugement d'amadis jamyn, fait succeder la magie a l'amour, la lecon d'histoire a l'eschatologie. Cet ample catalogue royal est riche de significations, aussi bien politiques qu'esthetiques. Tout au long des quatre chants, resonnent aux oreilles du lecteur les voix entrecroisees mais assourdies d'homere, d'apollonios, de virgile, d'ovide; et aussi celle de ronsard lui-meme, qui reprend bien des themes et motifs anterieurement traites pour en offrir ici une nouvelle sinon ultime variation. Sa pratique du poeme heroique, affranchie des normes edictees par le theoricien, privilegie l'invention et la varietas, jusqu'a faire de la franciade une maniere de "roman". Meme inachevee, l'ambitieuse tentative du vendomois ne devait pas rester sans echo : nous en suivons la reception contemporaine jusqu'en 1578, en meme temps que le long poeme cherche sa place dans le monument des oeuvresAlthough the long-disregarded franciade has prompted renewed interest over the past twenty years, it still hasn't formed the object of any overall study which would take into account the actual practice of the epic rather than its theory as stated in the artes poeticae. Our critical tools are borrowed from lexicology (a. E. Creore's word-index) and intertextuality. Unlike the epic designed for henri ii, "la franciade de charles ix" opens with a noteworthy "epistre au lecteur", enlightening us on what is at stake. The action itself starts in buthrote, that counterfeit, troy, home of a hidden and drowsy prince that some gods will soon awaken. The storm pushes francus headlong "dans les erreurs de crete", the isle of the antiquity's great myths, an enclosed space where the antagonistic forces of order and disorder, soon embodied by the trojan prince and phovere the tyrant, oppose each other. The hero is put to a second test when, loved by two princesses, he has to reject one and woo the other. In the last book, "des plus beaux" according to amadis jamyn, magic takes over after love, the history lesson after eschatology. This extensive royal catalogue is rife with political and aesthetic meanings. Throughout the four cantos, the voices of homer, apollonios, virgil and ovid, though subdued, meet and ring into the reader's ears. We can also hear ronsard himself as he takes up many previously treated themes and motifs to offer here a new if not last variation. His practice of the heroic poem, free from theoretical rules, favours invention and varietas, thus making of la franciade a kind of "roman". Even uncompleted, the vendomois's bold undertaking was not to be left unnoticed : we keep track of its contemporary reception till 1578, as well as of its painstaking integration into the edifice of the oeuvres

La Franciade, Les Lusiades et La Jérusalem Délivrée présentent des éléments qui relèvent de l'intertexte médiéval, si nous analysons les ‘motifs' des chansons de geste, les personnages et leurs discours et les excursus. Les motifs communs sont les assemblées, le combat, le déguisement, les rêves, l'île, la forêt et le locus amoenus. Dans les épisodes secondaires, il y a, entre autres, les motifs de l'enlèvement/emprisonnement, de la libération des prisonniers, de la fuite des héros persécutés, de la poursuite et de la victime innocente. Les excursus, les prières et les discours emploient quelques topoï du Moyen-Age latin : la modestie affectée, la noblesse d'âme, le monde renversé et l'éloge du souverain. Les discours amoureux révèlent l'influence de la fin'amor et de la rhétorique amoureuse ovidienne ; nous trouvons encore des vestiges du plahn et de la reverdie. Armide est l'orientale séductrice des gestes tardives ; Herminie, la sarrasine amoureuse d'un chrétien ; Argant, le Cornumaran tassien. Les "hypotextes" médiévaux sont La Conquête de Jérusalem et la chronique de Guillaume de Tyr (le Tasse), le Cligès et le roman d'Eneas (Ronsard) et le récit chevaleresque bourguignon, dans les "Douze d'Angleterre" (Camões)The Franciade, the Lusíadas and the Jerusalem Delivered contain medieval intertextual elements. This influence becomes evident if we conduct a comparative analysis of the narrative and descriptive "motifs" from the chansons de geste, to the characters, their speeches, and the excursus. The common "motifs" are the assemblies, the combat, cross-dressing, the dreams, the island, the forest, and the locus amoenus. The secondary episodes feature kidnapping/prison, liberation of the prisoners, flight of the persecuted heroes, the pursuit and the innocent victim. The excursus, the prayers, and the speeches employ several traditional topoi of the Latin Middle Ages: false modesty, nobility of soul, an upside down world and praise for the sovereign. The love speeches reveal the influence of the fin'amor and of Ovidian love rhetoric, and vestiges of plahn and reverdie are still found. Armida is again the oriental seductress of late chansons de geste, as Herminia is the Saracen in love with a Christian, and Argante the Tassian Cornumaran. Some of the most important medieval "hypertexts" are La Conquête de Jérusalem, the chronicle of William of Tyre (Tasso), the Cligès and the romance of Eneas (Ronsard), and the chivalrous narrative of Bourgogne, in The Twelve of England (Camões)

Research of intercultural communication and management phenomena has been rising since 1950s. At that time the researchers acknowledged the importance of the role of culture in international relations. Purpose of this diploma thesis is to unhide culturally influenced perception and behavior of French in application to business. Basic characteristics of French culture were identified based on study of researches of recognized researchers in this field i.e. Geert Hofstede and Fons Trompenaars. Further characteristics of the culture were examined in the sample of 12 interviewees using quantitative research methods. They were willing to dedicate their time and share personal working experience in relation with French whether in France or in direct working relation in Czechia. Barriers of communication between both cultures were confirmed by the research as existing and therefor the study of cultural differences was justified. The results of the research are presented in form of recommendations for Czechs and sum up the established phenomena.

This thesis is focused on French innovation system and its outputs. The aim is to analyze innovation performance of France, as well as its innovation policy and to find out the meaning of the innovation system for French economy and its competitiveness. The thesis also includes a case study of a shareholder and presents his perspective. The first chapter explains basic definitions and innovation related terms and reviews innovation associated theories. The second chapter examines the French innovation system evolution and its performance based on statistical data. Moreover, the French innovation business conditions and an innovation policy will be discussed. Following the analysis of the French innovation system, the last chapter evaluates whether the target of reinforcing innovation capacity is met. At the same time, the third section presents a player of the system, Raise company, and its position within this innovation system.

The purpose of my thesis is to explain the issue of the welfare state's crisis. To describe its current situation and impacts in modern world of capitalism. I have chosen France as a case study. Social disorders are common and becoming stronger and the sustainability of the social state causes considerable difficulties. In the first part of my thesis I describe the development of the modern welfare state, its basic principals and individual theoretical approaches criticizing the concept. In the second part I illustrate characteristic features of French welfare state: interests groups, primary values of the society and its specifics, situation on labor market, entrepreneurial environment and political progress. The thesis shows that France makes efforts to reform its welfare state. However, suggested solutions are only partial and even deepen social problems in France.

The diploma thesis focuses on the reform of the bank sector of France passed by the legislators in 2013. The thesis is divided into three parts. The first part focuses on the overall characteristics of the French economy and on the macroeconomic development of the country since 2008. The second part describes the bank system of France and contains stress tests performed at selected bank institutions. The final part focuses on the actual reform of the bank system and portrays some concrete measures taken. The thesis also contains a brief comparison of the bank reform made in 2009 in Spain and the reform that is currently taking place in France.

Coordenação de Aperfeiçoamento de Pessoal de Nível SuperiorThe present study addresses the Abolitionist Approach to Animal Rights proposed by the American legal scholar Gary L. Francione. This research aims to discuss three h v w h h : h moral relationship between humans and nonhumans; (B) the property status of nonhuman animals; (C) the philosophical grounding for a moral theory in defense of nonhuman animals based solely on sentience. For doing so, this study not only x h k g q y h h h perspectives of other authors. In view of this, the present dissertation is divided in three chapters. In the first chapter, it will be investigated the issue of the moral relations held between human beings and nonhumans animals. Major emphasis will be placed on the analysis of the d moral schizophrenia the last one was coined by Francione. In the second chapter, it will be detailed the moral and legal status of nonhuman animals as economic resources and its numerous theoretical and practical implications. Other key issues approached in this h h y K h hy defense of animal rights, and a reconstruction of the debate among Francione and Robert Garner on the relation between equal consideration of interests and property. In the third chapter, four major themes will be subject of problematization: (a) the attempts to exclude nonhuman animals from the moral community; (b) the similar-minds theory of the human/nonhuman relationship; (c) the lifeboat dilemma, the harm of death on sentient beings and their interest in continued existence; and (d) the creation of an animal rights moral theory based solely on sentience and the extension of the moral personhood to all sentient nonhuman animals. As a general conclusion, it will be sustained that the extension of moral personhood as well as moral rights to nonhuman animals will lead to the abolition of institutionalized animal exploitation.
O presente estudo versa sobre a Abordagem Abolicionista dos Direitos Animais proposta pelo scholar de Direito norte-americano Gary L. Francione. Esta pesquisa almeja discutir três tópicos centrais da perspectiva ética de Francione em defesa dos animais não-humanos: (A) a relação moral entre humanos e não-humanos; (B) o estatuto de propriedade dos animais não-humanos; (C) a fundamentação filosófica de uma teoria moral em defesa dos animais não-humanos baseada somente na senciência. Para fazê-lo, esse estudo não apenas explora o pensamento moral de Francione, mas igualmente contrapõe suas ideias às perspectivas éticas de outros autores. Com isso em vista, a presente dissertação divide-se em três capítulos. No primeiro capítulo, investigar-se-á a questão das relações morais mantidas entre seres humanos e animais não-humanos. Dar-se-á maior ênfase à análise das õ q z esta última, cunhada por Francione. No segundo capítulo, será detalhado o estatuto moral e legal dos animais não-humanos como recursos econômicos e suas diversas implicações teóricas e práticas. Outros assuntos-chave abordados nesse capítulo incluem uma discussão sobre o problema da crueldade na filosofia moral kantiana, uma defesa dos direitos dos animais e uma reconstrução do debate entre Francione e Robert Garner sobre a relação entre igual consideração de interesses semelhantes e propriedade. No terceiro capítulo, quatro grandes temáticas serão alvo de problematização: (a) as tentativas de exclusão dos animais não-humanos da comunidade moral; (b) a teoria das mentes similares da relação entre humanos/não-humanos; (c) o dilema do bote salva-vidas, o dano da morte em seres sencientes e o seu interesse na existência continuada; e (d) a criação de uma teoria moral dos direitos animais baseada apenas na senciência e a extensão da pessoalidade moral a todos os animais não-humanos sencientes. Como conclusão geral, será sustentado que a extensão da pessoalidade moral, assim como de direitos morais aos animais não-humanos, acarretará na abolição da exploração animal institucionalizada.

Práce popisuje vývoj francouzsko-alžírských vztahů od počátku francouzské nadvlády (1830). Ve stručnosti se dotýká i občanské války v Alžírsku, která trvala osm let a byla ukončena vyhlášením nezávislosti alžírského státu v roce 1962. Vztahy v dalších letech byly významně poznamenány předchozím obdobím a zejména krutými okolnostmi, které provázely boj za osvobození Alžírska. K jejich zhoršení přispěl i problém terorismu v Alžírsku. Teprve v posledních několika letech se styky obou zemí začínají vylepšovat, rozvíjí se vzájemná spolupráce v mnoha oblastech hospodářství a je zřejmá snaha Francie, jako vyspělé země, pomáhat Alžírsku v naplňování započatých reforem a v jeho přechodu k principům tržní ekonomiky.

The aim of my master thesis was to specify the business and diplomatic protocol in France and answer several questions that I defined. Are there any differences between the facts that we read in books and guides about French business and diplomatic protocol, and the reality? Can we generalize French business protocol and say that it is valid for all sectors and generations of managers? Can we claim that French diplomatic protocol is valid all the time and every single president sticks to it? The first chapter explains all the key terms - protocol, business protocol, diplomatic protocol, business negotiation, etiquette. The second chapter focuses on French business protocol, especially organization and course of business negotiation, dress code and gift-giving etiquette, and finally characterizes a typical French company. The third chapter focuses on French diplomatic protocol, especially on all aspects conserning ambassadors in France. The fourth chapter represents the practical part and gives several practical examples of French business and diplomatic protocol. This part is based on four qualitative conversations with four experts on this domain.

The aim of this master thesis is to evaluate entrepreneurial environment in the Czech Republic and France, define its strengths and weaknesses and suggest possible improvements. The thesis offers a comprehensive look at the key entrepreneurial aspects from the perspective of small and medium entrepreneurs. The thesis describes and analyses tax issues, social security scheme, entrepreneurial support, legal forms of business entities and administrative burden of entrepreneurs. The thesis also comprises SWOT analysis of entrepreneurial environment of both compared countries. The thesis includes a practical part (apart from the theoretical part) which concerns an evaluation of a survey by questionnaire conducted among Czech small and medium entrepreneurs. The final part of thesis does not lack author's point of view on the described issues.

Diploma thesis deals with tourism and its competitiveness in selected regions of France. The main aim of the thesis is to identify the main aspects of regional tourism competitiveness. The selected regions are Basse-Normandie, Bretagne, Chamagne-Ardenne, Pays de la Loire, Provence-Alpes-Côte d'Azur and Rhône-Alpes. The theoretical part is devoted to the importance of the position of tourism in terms of economics, society and regional development. Thesis also explains the concept of tourism competitiveness and its associated attributes such as comparative and competitive advantage. In detail various indicators of competitiveness of the WEF methodology are described. In the practical part there is defined set of indicators which can be used to measure the competitiveness of the tourism sector in regions. Indicators are based on publicly available data of selected regions. With using these indicators it is calculated tourism competitiveness index for each region. Final comparison shows that the most competitive tourism has region Provence-Alpes-Côte d'Azur. On the contrary, the least competitive tourism is in region Champagne-Ardenne. Five fundamental aspects of tourism development are defined, based on the results obtained. In conclusion, diploma thesis confirms direct relationship between the level of the index and incoming tourism in selected French regions. With respect to the defined set of indicators of tourism competitiveness the possibility of its use also within regions in other European countries it is offered.

À travers l’étude d’un large choix des témoignages et documents on souhaite montrer une différence significative entre l’Italie et la France, et se questionner sur les causes qui la déterminent. Une certaine mythologie (Barthes) se dégage de cette première analyse qui demande à être identifiée, questionnée, mise en perspective dans une étude transtextuelle qui sera le centre de la deuxième partie de la thèseIn this thesis, I’ll provide a brief overview on the major turning points of the critical response to Fellini’s films in the 20th century French press (especially in Cahiers du cinéma and Positif). To this end, starting from I Vitelloni – the first Fellini’s film to be released in French theatres – up to The Voice of the Moon – Fellini’s last movie –, I’ll follow the critical debate on Fellini’s films, with particular reference to issues concerning dramatic structure and neo-realism. Within this context, I’ll highlight how Cahiers changed its critical response to Fellini’s work throughout the years, from his exclusion from the “auteurs’ elite group” to his final inclusion. Podstatnou část práce tvoří popis systému politiky podpory vývozu v obou ekonomikách. Esta reforma al Derecho Civil Francés se vio concretada a través de la Ordenanza 2016-133 de 10 de febrero de 2016. A través del presente trabajo se traducirá importante literatura analítica relacionada al nuevo derecho de los contratos en Francia y, posteriormente, se realizará unas breves conclusiones en torno a los puntos más importantes de ésta en relación al Derecho Civil Chileno, en especial, los aspectos de remedios contractuales en general, la excepción de contrato no cumplido, el concepto contractual de fuerza mayor, nuevos remedios contractuales establecidos en el derecho francés y la aplicación de la ley en el tiempo.

Introduite dans le paysage lexicographique québécois il y a une vingtaine d'années comme élément de caractérisation diatopique des usages, la notion de francisme a notamment fait l'objet de critiques sévères à la suite de son application dans le Dictionnaire du français Plus (DFP, 1988) et le Dictionnaire québécois d'aujourd'hui (DQA, 1992 et 1993). En dépit de ces critiques, cette notion a de nouveau été exploitée dans le dictionnaire électronique du français en usage au Québec mis en ligne en 2009 (Dictionnaire de la langue française. Le français vu du Québec; FVQ). Notre mémoire vient s'inscrire en continuité des études qui ont abordé la notion de francisme dans une perspective méthodologique; ses deux objectifs tiennent compte des deux principales critiques formulées quant à l'exploitation lexicographique de cette notion. Nous nous sommes donné comme premier objectif de préciser dans quelle mesure le traitement des emplois étroitement associés à la France dans le FVQ se rapproche ou diffère du traitement précédemment proposé par le DQA; notre comparaison porte sur les emplois répertoriés à la lettre C. Notre étude montre entre autres que, contrairement au DQA, le FVQ s'est efforcé d'adopter un type de présentation distinct pour les particularismes référentiels, de façon à ne pas les confondre avec les particularismes de type géolinguistique. Comme deuxième objectif, nous avons voulu, à la lumière de l'expérience du FVQ, revenir sur l'utilisation de la notion de francisme comme élément de caractérisation diatopique des usages. À partir de cas précis relevés à la suite de notre étude comparative et notamment à partir de cas de traitements divergents, nous avons essayé de déterminer dans quelle mesure l'observation des grands corpus textuels exploités par le FVQ venait ou non confirmer la pertinence de son exploitation lexicographique et encadrer son application de façon relativement objective. Notre étude montre qu'à quelques exceptions près, le marquage géolinguistique du FVQ est confirmé par l'observation des usages québécois et français enregistrés dans la banque médiatique Eureka. Par ailleurs, nos analyses ont montré que si l'exploitation lexicographique de la notion de francisme doit faire intervenir des considérations quantitatives, elle peut aussi, dans une certaine mesure, tirer profit de considérations qualitatives. Si la plus faible fréquence d'un emploi dans le sous-corpus québécois peut être un indicateur important de son statut de francisme, ce statut peut être confirmé ou infirmé par la prise en compte de l'existence ou non d'autre(s) ressource(s) lexicale(s) concurrente(s).

La presente memoria traduce una parte de este trabajo, el cual versa sobre nuevos aportes en el derecho de los contratos y de las obligaciones. Este se construye en torno al aporte de varios y connotados profesores franceses, quienes dividieron las materias del código y las volvieron a coordinar, para resultar en un proyecto ofrecido por la cancillería del mismo país a su parlamento. El anteproyecto de reforma del derecho de las obligaciones y del derecho de la prescripción, objeto concreto de la presente traducción, se denomina también de manera más informal como “Anteproyecto Catala”. Dicho nombre, naturalmente, honra al profesor Pierre Catala, acaso quién dirigiera de manera más general esta parte del proyecto de reforma, quien a su vez menciona como sus antecesores en el espìritu modernizador a Portalis y Carbonnier.

Nuestro procedimiento civil presenta desde sus inicios una serie de deficiencias que no han sido resueltas por ninguna de las reformas parciales que ha sufrido. Si bien su falencia más palpable es su lentitud, percibida cotidianamente y con resignación por la gente, tiene muchísimos otros problemas estructurales. Ejemplos de aquello son la falta de inmediación del juez, la escrituración, la gran cantidad de recursos existentes, la prueba legal tasada, entre otros.1 Lo anterior provoca que las personas vayan perdiendo la confianza en la capacidad del sistema para resolver sus conflictos, lo que abre las puertas a la autotutela, que se encuentra al margen del derecho. Es preciso recordar también el viejo adagio: justicia retrasada es justicia denegada. Por todo lo anterior, se perfila como absolutamente necesaria e indispensable una reforma integral al procedimiento civil actual, para dar por fin un salto a la modernidad y dejar de lado las formas arcaicas que todavía imperan en nuestros procesos

Il progetto di ricerca, dal titolo La Nuova destra dalla Francia all'Italia, prende come oggetto di studio specifico quel fenomeno politico, emerso in Italia verso la metà degli anni Settanta, che si originò in seno agli ambienti politici della destra radicale, noto con la definizione di Nuova Destra (ND), sul modello dell’omologa e più matura corrente francese il cui nucleo principale ruotava attorno all’associazione culturale GRECE (Groupement de recherche et d’études sur la civilisation européenne). Dal livello avanzato della ricerca sviluppata in questi anni, si è potuto notare che questo soggetto culturale ed ideologico è stato scarsamente studiato nel panorama scientifico italiano dove la maggior parte delle indagini ad esso dedicate sono state svolte da politologi, o comunque risultano riconducibili agli ambienti accademici delle Facoltà di Scienze Politiche, mentre pochissimi sono i lavori che si sono accostati alla ND con le armi specifiche della ricerca storica. Al contrario in Francia il fenomeno è stato oggetto di numerose ricerche da parte di autorevoli studiosi e ha dato avvio ad un florido dibattito ideologico. L’obiettivo principale a cui questa ricerca di dottorato tenta di rispondere è, quindi, quello di ricostruire le vicende storiche della ND italiana, sia attraverso i suoi rapporti con il Movimento sociale italiano (MSI), dalle cui sezioni giovanili essa nacque e si sviluppò per poi distaccarsene, sia tramite l’analisi delle sue evoluzioni politiche e concettuali, sia, infine, cercando di porre in evidenza i lasciti, le influenze e gli stretti legami, che intercorsero fra l’Italia e la più matura esperienza della Nouvelle Droite francese, ed in particolare con il pensiero politico e filosofico di Alain de Benoist, il suo maggiore esponente.

C’est donc la signification de fiscalité environnementale qu’il s’agit d’individualiser, son essence et les caractéristiques de son mode opératoire. La fiscalité et l’environnement sont liés par une relation qui a évolué au fil du temps. This diploma thesis deals with the topic of the French and EU asylum policies and their reciprocal influence. The main goal of this thesis consists in demonstrating (if applicable) France's success in enforcing its legislation at the European level, or if it is rather the opposite phenomenon that prevails: the necessity of the implementation of asylum rules (that have been approved in the EU) to the French regulations. The whole thesis is grounded on the concept of Europeanization which determines a theoretical framework that serves as a basis for the empirical part, consisting of an analysis of the development of French and common European asylum legislation first. The crucial part of this thesis is the fourth chapter where the interconnection between the theoretical and empirical part takes place as well as the discovery of the link between the French and European asylum legislation and drawing of consequences that respond to initial propositions.

Although Libya differs in many aspects from the other Maghreb countries, it cannot be isolated in the region. Thus this thesis, with the emphasis to the differences, takes Libya also in account. This thesis also aims to define the current foreign policy of France towards the Maghreb countries and outlines the strengths and weaknesses of current and future mutual cooperation.

La thèse se propose d'évaluer l'impact des influences françaises dans le domaine des corps techniques de terre (artillerie, génie et ingénieurs-géographes) en Italie (notamment Républiques Cisalpines, République Italienne et Royaume d'Italie) entre 1796 et 1814. On peut relever des contributions importantes, malgré de fortes résistances structurelles et conjoncturelles. La première partie analyse la construction de l'officier des armes savantes en France de la moitié du XVIIIe siècle jusqu'à l'époque impériale à travers une histoire culturelle de l'institution militaire. Dans la deuxième partie, on étudie la réception du modèle français en Italie, notamment par les transferts culturels et les institutions. Les transferts révèlent une forte asymétrie entre la France et l'Italie. La quantité, la qualité et la nature des publications et des sources manuscrites suggèrent une forte hégémonie culturelle française, donc une tendance à un échange plutôt unidirectionnel, à un processus d'acculturation. Les institutions italiennes ont été modelées sur celles françaises avec des adaptations. L'étude prosopographique conduite sur les officiers en service italien permet de conclure qu'il y a eu une montée d'une culture méritocratique dans ces branches de l'armée, cependant très entravée par le faible nombre d'emplois.

Memoria (licenciado en ciencias jurídicas y sociales)La crisis del derecho civil tradicional, empujada por la imposibilidad para responder a los problemas legales propios del tráfico jurídico moderno, han resultado en la mayor reforma del derecho francés de contratos y obligaciones desde la promulgación del Code Civil en 1804, inspiración determinante para la redacción del Código Civil chileno de 1855. La ordenanza nº 2016-131 ha tenido por objeto la modernización de la legislación civil francesa. Por este medio, se han codificado soluciones jurisprudenciales y doctrinarias, adaptado conceptos, y eliminado determinadas nociones que han probado ser insuficientes para responder a complicaciones jurídicas actuales. El presente trabajo tiene por objeto analizar los cambios presentados, contrastándolos con la antigua legislación, el derecho comparado y prestando especial atención a la legislación chilena. Por medio de ello, los autores buscarán proponer una modernización al Código Civil chileno, analizando el estado actual de las figuras normativas del país, tomando como base las soluciones planteadas por el nuevo Code Civil.
