Full textPolygamy, both tacitly because of its existence and its symbolical action, and explicitly, through the speeches and the views it expresses or it gives rise to, raises a certain number of queries which are among the most important ones of my social sciences survey and, as far as some of them are concerned, completely new. This institution of revolt against a particular form of symbolic violence, besides the fact that it gives rise to new analysis subjects, thoroughly questions the current symbolic order and completely raises the query of the foundations of this order and of conditions of a successful mobilization in order to support it. The particular form of symbolic domination whose victims are the women in polygamous couples, struck by a mark which, unlike the colour of the skin or femininity, can be hidden or displayed , is obvious through group actions of categorization which give rise to significant differences, negatively marked , and consequently to marked groups and social categories. Full textThe nature of the marriage institution, or contract, experienced fundamental changes during the last few years in France and in Canada. In a first step, the thesis analyses why Canadian and French legislators do not allow polygamy after having liberalized almost all other aspects of marriage. Secondly, the research shows that the prohibition of polygamy results in several effects on personal and fundamental rights, which are sometimes corrected through legislation by accepting the polygamous relationship for specific purposes. Finally, the thesis examines the prohibition of polygamy in France and inCanada through a critical approach in order to then suggest an outlook for modifications to this general prohibition

Full textWhat is the polygamy? By whom, why and how is it practiced? In a comparative study of two grounds to strong Moslem population, such as Turkey and Algeria, we would try to answer these questions at the same time of macrosociological and microsociological order. In Turkey, between an official ban and a tolerant tradition, the management of the polygamy in the space public is made through strategies of bypassing of the institutional laws to make an organization of the polygamy on the administrative and legal plan. When in Algeria, louse the management of this organization, laws exist to limit the polygamy but without forbidding it really. But it becomes then a perpetual game of bypassing of laws in a formal / informal relationship. So, in societies current and studied in this research work, the reasons of the practice of the polygamy are not only of religious order. He appears there also. He represents so many cultural, economic and social reasons there. That it is in Turkey or in Algeria, The polygamy is cannot be practised in the same way and for them even reasons (because these last ones are multiple) but finally the nature of the reasons is even. Full textThe reception of polygamy and repudiation by the French international legal order has evolved, fluctuating between tolerance and rejection. Placing us in the specific context of French-Moroccan relations, we have sought to verify to what extent the reform of these two institutions, introduced by the new Code of family in Morocco, could provide them a better reception. But before, we thought it useful to review their history and their evolution under Moroccan law. Then we reviewed the difficult course of their " immigration " in France, the different jurisprudential dislocations that they underwent, and the more severe intervention of the public order now based on respect for such fundamental rights as dictated by the ECHR.Far from resolving all disputes in this area, the French - Moroccan agreement of 10 August 1981 revealed its shortcomings and limitations. The ambition of this work was then to offer some solutions inspired for some of them by the doctrine, such as the adoption of new substantive rules or the theory of reciprocal accommodations

Full textIn the study of plural marriage and the relationship between polygyny and the social environment, the different methodological approaches (anthropological, sociological, demographic and psychosociological) furnish their specific contributions. In the case of Togo, we have established that from a psychological point of view, the attitudes that students and civil servants develop with respect to plural marriage are divergent. Their attitudes vary on the basis of different statutory factors such as the socioprofessional status of the respondents, the age, the social situation of the family etc. The above factors work in conjonction with certain definite psychological mechanisms such as the search for social differenciation and the need to affirm a masculin identy in determining the personal attitude toward polygyny

Full textBased on Simone de Beauvoir’s work The Second Sex, and other important articles, an analysis of the condition and conception of women was carried out in order to study the image of the postcolonial African women in general, and Ivorian in particular, in comparison with the women before the independence. Through the analyse of the condition of women in Ahmadou Kourouma’s The Suns of Independence, we came across ideas such as submission, patriarchal society, traditional woman, modern woman, freedom, women as mothers but also women as sexual objects and victims of customs and traditions related atrocities. Despite the accession of Ivory Coast to independence this condition has not improved, and this is what Kourouma is indirectly or maybe unconsciously denouncing.

Full textThe twenty-first century is a century of promoting and protecting vulnerable people and fighting discrimination. The international community is more interested in the problematic condition of women and children as a factor in revealing the overall state of social advancement of society. However, Africa remains the continent where the number of vulnerable people is the largest on the planet. The Organization of African Unity in its time and the African Union have already demonstrated their commitment to tackling issues concerning women and children through well-defined human rights protection mechanisms. Indeed, a whole legal arsenal has been put in place in order to protect the rights of women and children. Foremost, among them there are the two pacts of 1966 stemming directly from the Universal Declaration of Human Rights, one on civil and political rights, the other on social, economic and cultural rights; the Convention on the Rights of the Child; the African Charter on Human and Peoples' Rights, the African Charter on the Rights of the Child; the Women's Rights Protocol, the 1989 Declaration of the Rights of the Child.The implementation of these legal instruments is still fragmentary. As in all international agreements, the biggest challenge is to move from the ratification state to the integration of these agreements in national legislation and their implementation so that all can enjoy their rights. International human rights law, in its current form, prohibits discrimination and violence against women and children. It represents the legal framework in which States' obligations to promote and protect the human rights of women and children are determined and evaluated. The cornerstone of this legal edifice is the Convention on the Elimination of All Forms of Discrimination against Women and the Convention on the Rights of the Child. The global economic crisis, ongoing conflicts have resulted in systematic violence against women and children. In Senegal, this violence resulted in a dislocation of the family and the erosion of traditional solidarities. The vulnerability of women and children in the family unit has led to the development of practices such as begging, delinquency, prostitution, abandoned children, forced marriage, etc. Analysis of the current status of women and of the child in Senegal leads us to ask ourselves the following questions: It is a question of assessing the degree of integration by Senegal of international norms into its internal law? Are cultural, religious and political obstacles not an obstacle to the effectiveness of international standards ? How to get practitioners to consider international standards in resolving disputes in family relationships ?

It is an exchange of financial and material assistance given by a married man against the sexual service provided by a woman often single. In these relations between men and women, it is possible that the couple is in love each other, it also happens that the couple's interest is rather a commercial transaction. Many Ernai are from the poor regions. In the previous research, the Ernai are classified mostly in the framework of prostitution. But they have also some characteristics like the ancient concubinage of Qie. The action of Ernai is considered passif, given that men maintain active role throughout the process. There are few systematic studies on the subject. This paper tries to explore the belonging of these Ernai with doing a tour in the past in order to better explain this phenomenon

La dissertation a cherché a énoncer l exclusion sexiste et raciste persistante à Mozambique et au Brésil, à travers de l approche en relation a l égard des auteurs, la mozambicaine Paulina Chiziane et la brésilienne Conceição Evaristo, focalisant d’un côté les personnages des romans Niketche et Ponciá Vicêncio et de l autre côte le positionnement politique des mêmes auteurs comme activistes, formulé dans des entrevues et textes divers. La méthodologie utilisée a eté l analyse critique des romans, l incursion dans les entrevues et les conférences desquelles ont participé les auteurs et l étude des textes critiques et théoriques appropriés. De tout cela, il a eté possible de conclure que les questions raciales sont fortement présentes dans le roman brésilien, du début à la fin, mais ne sont que des coups de pinceau dans le mozambicain. La problématique des relations de genre en contrepartie est nucléaire pour la tournure des deux narrations. Dans les entrevues analysées des auteurs, il a eté possible voir que la question de genre est crucial pour Chiziane tandis que la raciale semble d être environnante dans son discours. Mais pour Evaristo les deux questions semblent d être plus serrées. L étude des écritures procédant du point de vue des femmes nègres, de leurs art, stratégie et vision politique, contribuent pour confirmer l expérience féminine nègre sous une perspective divergente de soumission de la cristallisation du stéréotype, reconnaissant une tension nécessaire entre l égalité et la différence, entre droits individuels et identités de groupes, quand on cherche résultats plus démocratiques moyennât l insubordination et la résistance identitaire.
A dissertação buscou investigar as formas de exclusão sexista e racista que persistem em Moçambique e no Brasil, através da abordagem relacional entre o olhar de duas escritoras, a moçambicana Paulina Chiziane e a brasileira Conceição Evaristo, focalizando, por um lado, as personagens dos romances Niketche, uma história de poligamia e Ponciá Vicêncio e, por outro, a postura política das próprias autoras como ativistas, expressa em entrevistas e textos diversos. A metodologia utilizada foi a análise crítica dos dois romances, a incursão em entrevistas e conferências das quais participaram as duas escritoras e o estudo de textos críticos e teóricos pertinentes. A partir disso, foi possível concluir que as questões raciais estão fortemente presentes no romance brasileiro, permeando-o do começo ao fim, mas são apenas pinceladas no moçambicano. A problemática das relações de gênero, em contrapartida, é nuclear na estruturação das duas narrativas. Também nas entrevistas analisadas das autoras, foi possível observar que a questão de gênero é crucial para Paulina Chiziane, enquanto que a racial parece ser circundante no seu discurso. Já para Conceição Evaristo, as duas questões aparecem mais estreitamente ligadas. O estudo das escritas oriundas do ponto de vista das mulheres negras, de sua arte, estratégia e visão política, contribui para afirmar a experiência feminina negra sob uma perspectiva diversa da submissão ou da cristalização do estereótipo, reconhecendo uma tensão necessária entre igualdade e diferença, entre direitos individuais e identidades grupais, quando se buscam resultados mais democráticos através da insubordinação e da resistência identitária.

Full textThe purpose of this thesis is to contribute to a better understanding of the drivers of international migration. In Chapter 1, we document that immigrants in Portugal face a high incidence of occupational-skill mismatch, and show how it affects the selection into migration. We find that the incidence of over-education leads to negative selection while correct occupational-skill matches lead to positive selection. In Chapter 2, we rely on a lab-in-the-field experiment to understand the willingness to migrate illegally of young males aged 15 to 25 in The Gambia. We first show that potential migrants overestimate both the risk of dying en route to Europe, and the probability of obtaining legal residency status. The experimental results suggestthat the willingness to migrate illegally is affected by information on the chances of dying en route and of obtaining a legal residence permit. Providing providing potential migrants with official numbers on both probabilities thus affect their likelihood of migrating. This has the potential to help migrants make informed decisions and perhaps save lives. In Chapter 3, we investigate the impact of family structure on international migration decisions. We find that children of mothers in polygynous unions are more likely to migrate internationally. We provide further evidence suggesting that this result is due to sibling rivalry: having full- or half-siblings in migration increases the likelihood of migrating. Our evidence suggests that co-wives’ rivalry as documented elsewhere trickles down to children’s rivalry in migration, suggesting that while neglected in the literature, family structure is crucial to understanding migration

Full textThe Gabonese law seems impartial in the distribution of the roles and the division of the power within the couple. In order to check this assumption and to understand the motivations of this kind of marriage and the relations of gender, we sought to know how this act was defined in the common law while clarifying the modifications and the changes which it underwent in the course of time. These modifications are the resultant of the cohabitation between various people (Gabon is an ethnic mosaic) and French colonization. This carried out us towards a comparison between the habits, the French colonial law and the current Gabonese law. At resulting from this exercise, we arrived to two results: on the one hand, the current Gabonese law is resulting from the various rights which we have just started (local habits and French right colonial), which gives a hybrid character to him. On the other hand, we can note in these rights a resemblance, which is the submission of the wife to the husband. This last reality is concretized by the practice of polygamy and the direction which the Gabonese society gives to the dowry. Past by insisting on the period 1892-1973 during which the forestry development occupied a dominating place in the economic and social life of this country

It is the receipt of the Moroccan family law which is of religious essence by the legal order french through its international law private, a legal secular. The first part of this book is devoted to understanding Moroccan marriage and its effects which is indispensable for the reception of foreign institutions by the french legal order. Achieve this, to understand the evolution of the marital institution since the creation of the first Code of the Moroccan family, until the reform of the latter in 2004. Ithighlights the assimilation by the Moroccan legislator of the marriage and its effects in a modern family Code while keeping its religious essence. This indispensable approach leads to understand the scope of the reform of the Moroccan wedding of 2004 and the difficulty that knows its application.Understanding its limits allows to capture the design of the concept of family in the Morocco of today.The second part is devoted to this concept through the Moroccan wedding reception and its effects byfrench private international law. The study of the application of the rules of private international law shows the difficulty that Moroccan law applicable on french territory despite the existence of the Franco-Moroccan agreement of 10 August 1981. Moroccan law is, despite its jurisdiction, either before a difficult qualification of its unknown institutions of the french legal system and in this case, it is denatured. It is against the intervention of the mechanism of the public order exception as its institutions and its rules are considered offensive the fundamental principles of the Forum and consequently, he was waived. Full textThe study of the evolution of matrimonial behaviours is in kipping with the research of forwarnings of fertility transition in West African countries and specially in Cotonou, Accra and Lome. The data for the study are mainly the census taken in three countries since 1960, the world fertility survey made in Benin in 1982 and the demographic and healt surveys made in Ghana and Togo in 1988. The results obtained can be summarised as follows : - in the towns we notice in age at first in age at first sexual experience through generation and a recent increase in age at first marriage among young genetation. - first marriages are more stable in Cotonou than in Lome. - in Cotonou there are more men in polygamous marriage than in the two other towns, but women in polygamous marriage are more numerous in Lome than in Cotonou. Nevertheless, in all these countries there is a tendancy of regression of polygamy

Full textThis dissertation investigates if fertility behaviors in Africa can partly be explained by women's strategies to improve their economic security. The approach combines economic theory, micro-econometric methods and insights from other disciplines (sociology, anthropology, demography and medicine). The empirical work is carried out on original data from a Senegalese household survey, and on the Demographic and Health Surveys in African countries. Each chapter explores one potential driver of fertility: son preference, women's needs for widowhood insurance and co-wife reproductive rivalry in polygamous households. All point to the same idea: a woman intensifies her fertility when her economic future is jeopardized, because children remain women's best claim to the resources controlled by men. In terms of policy implications, the main insight is that the sustained high level of fertility in Africa does not merely reflect women's lack of control over births, as is often argued. It also reflects their incentives to have many children. Promoting women's autonomy would thus help birth control efforts and spare mothers and children the heavy health cost of frequent pregnancies

Full textPolygami har på senare tid uppmärksammats mer och mer i Sverige med anledning av bland annat flyktingströmmar och globalisering. Den svenska äktenskapsnormen är tvåsamhet, monogami vilket således har lett till att familjekonstellationer som går emot denna norm ibland har svårt att anpassas till den svenska familjerätten. Polygami är ett samlingsnamn för äktenskap där en person är gift med flera personer samtidigt. I grunden spelar könet inte någon betydelse för begreppet polygami men den vanligaste äktenskapskonstellationen, och den konstellation som uppsatsen har avgränsat sig till, är den där en man är gift med flera kvinnor. Idag är polygami främst praktiserat i de muslimska länderna i Asien och Afrika där Koranen är en viktig del av uppbyggnaden av ländernas rättsordningar. För att polygami ska bli tillåtet i Sverige krävs det att äktenskapen kan erkännas enligt lagen om vissa internationella rättsförhållanden rörande äktenskap och förmynderskap. Enligt Skatteverkets utredning finns det idag 679 personer registrerade med en eller flera makar i folkbokföringsdatabasen i Sverige, däremot anses siffran inte spegla verkligheten. När en människa dör är det mycket saker som ska anordnas. De flesta av dessa angelägenheterna i Sverige regleras i ärvdabalken. Men eftersom den till största delen av familjerätten i Sverige utgår från den svenska äktenskapsnormen om tvåsamhet, föreligger det ett flertal tillämpningsproblem när ärvdabalken ska tillämpas på polygama äktenskap. Men trots att lagen i huvudsak är utformad för monogami finns det möjlighet att tillämpa lagen vid polygama familjekonstellationer. Trots att lagen i sig inte är konstruerad för polygama familjer torde den dock vara så flexibel att den går att tillämpa. Tillämpningen av lagen är dock behäftade med problem för bland annat kvinnorna i relationen. Det är tydligt att kvinnor i polygama äktenskap har det mer osäkert än kvinnor i monogama äktenskap när det kommer till arv och efterlevnadsskydd. Att de förslag till lagändring som ligger på bordet kommer bidra till en stärkelse av kvinnornas skydd är även det svårt att förmoda. Mycket tyder dock på att det överlag ser bra ut för barnen i äktenskapen. Det finns egentligen inte mycket som tyder på att barnen i hög utsträckning blir särbehandlade jämte barn i monogama äktenskap.

Full textOur study is a multidisciplinary approach to polygyny, by the case study of the Dagombas, of the Northern part of Ghana, in which majority of them are Muslims and uneducated. The introduction presents our epistemological position and our methodological options. We have classified our thesis in three parts. In the first part, we explore an anthropological approach based on the field research. The hypothesis correlated the practice of polygyny with illiteracy, wealth, morals, and values as factors related to forceful marriages. Finally, we evaluated the evolution of polygyny social changes in a contemporary society. In the second part, we successively elaborated: the changes in marriage, and matrimonial status, etc The outcome of polygyny and the role of the educational system are highlighted. Accessing the educational level of women, living in polygyny or the Socio- Professional conditions determines the institutional stakes emerging from this matrimonial practice. In the third part, we found out the socio-cultural and economic changes and their consequences on polygyniques practices in Ghana. We analyze, our samples given the perceptions and representations of polygyny by urban dwellers the variable ranging from the age group determined their commitment to religion and tradition. Deducing from this observation, we are investigating on the perspectives of this matrimonial status in the society, their emancipation and socio-economic development of women and the impact of woman in time and space

Full textThis PhD dissertation aims at analyzing the effect of informal redistribution, taking mostly place within the extended family, on individuals' resource allocation choices in Sub-Saharan Africa. Indeed, in this region, due to limited access to markets for insurance, credit and savings, and to formal redistribution, individuals are vulnerable to life risks and economic shocks. To protect themselves against these risks, individuals rely mainly on two strategies: informal redistribution and informal savings. I analyze in this thesis how informal redistribution within the extended family affects individual savings decisions. The first chapter is based on an original qualitative survey conducted in Senegal in 2012 and propose a detailed analysis of the relationship between the transfer senders and the recipients within several family networks to understand the dynamics of resource sharing in the extended family and the social norms attached to these transfers. In the second Chapter, I investigate transfer patterns within a sibship and analyze how these patterns are related to saving decisions, using the nationally-representative ' Pauvrete et Structure Familiale' (PSF) suvey in Senegal. I find some evidence of high redistributive obligations that come generally at the cost of lower savings achieved for the main transfer senders. Based on an original lab experiment, in the third chapter, I highlight the widespread use of costly strategies aimed at circumventing these redistributive norms, namely income hiding. I identify the distortionary effects of such strategies on resource allocation decisions. In particular, I elicit a high willingness-to-pay to hide income from peers in the lab and show that hidden income induce a lower share of the gains devoted to transfers out of the lab, compensated by an increase in personal expenses. Finally, in my last chapter, using the panel of individuals of the PSF survey, I show that monogamous wives, when facing a higher risk of becoming polygamous, invest in self-protective strategies by saving more and spending more on personal expenses and on the education of their children

Full textPoly, to live in several loving and intimate relationships at the same time, is one alternative to the mono norm. In Sweden polygamy is illegal yet in recent years poly has slowly started to enter the hetero normative political agenda and raise debate in the media. But what does poly mean, and how do those who identify with this type of relationship describe it in contrast to mono? The theoretical framework is based on a structural viewpoint of the changes in the organisation of the family and the growing de-traditionalism of society. Amongst other I use a Foucauldian perspective to explain the structural shift (yet not replacement) between an Alliance pattern and a Sexuality pattern. Other theories in use are that of the emerging ideal of The Pure Relationship and Queer Tendencies. The essay draws its empirical results from seven e-mail and/or face interviews with individuals who identify with poly. The results show that if poly and mono are both understood as expression of the pure relationship they are potentially not so different. Yet the stigma and the lack of role models show that there is much needed public debate about it to unleash it from old discourses that still seem to uphold the equation that love equals two partners. Drawing attention to queer mechanism and the initiated process of the decentralisation of the heterosexual norm, I speculate that in the future polygamy must not be a foreign concept in Swedish society.

Full textPolygamy is widely practised in African communities. The African social-realist novel, especially when it is woman-authored, shows female characters as having to play docile, subservient roles and accept demeaning positions in polygamous marriages. Although it has been claimed that traditional African marriage creates a satisfactory situation for women, mainly by means of the security it offers and the bonds that it forges between co-wives, the narrators of African realist novels almost always expose only evils associated with polygamy. In most of the texts, co-wives experience conflict with one another, not bonds. Men are portrayed as egocentric beings that greedily satisfy their sexual impulses at the expense of women. Encouraged by their families, they inflict irreparable emotional damage not only on their accumulated wives but often also on their offspring. While blinded by their desires, these men engender many unplanned children for whom they usually take little fatherly responsibility. Consequently, children too are objects of pity in many of the books. This dissertation, by means of close analysis of select African narratives, reveals that, despite all the struggles for liberation and democracy, values highly regarded in modern societies, polygamy is a prevailing sign of male dominance in African communities today. The dissertation shows that even such male-authored novels as Chinua Achebe’s Things Fall Apart and Onuora Nzekwu’s High Life For Lizards fail to recommend a polygamous life to women, while Mariama Bâ ’s So Long a Letter and Scarlet Song, Buchi Emecheta’s The Joys of Motherhood and Kehinde, Es’kia Mphahlele’s Chirundu, Lazarus Miti’s The Prodigal Husband, Ama Ata Aidoo’s Changes, Sue Nyathi’s The Polygamist,SembeneOusmane’s Xala, Lola Shoneyin’s The Secret Lives of Baba Segi’s Wives, Rebecca HourwichReyher’s Zulu Woman, Miriam KWere’s The Eighth Wife, T.M. Aluko’s One Man One Wife and Aminata Sow Fall’s The Beggars’Strike all use polygamy to highlight the incongruence between the ideals of democracy and the facts of life as experienced by African women. These texts reflect real social problems. They cast light on the inequalities that prevail in polygamous relationships and imply that the principle of equality cannot be achieved as long as polygamy exists.
