La polygamie pose à la fois et tacitement, par son existence et ses actions symboliques, et explicitement, par le discours et les théories qu’elle produits ou auxquelles elle donne lieu, à un certain nombre de questions qui sont parmi les plus importantes de mon étude des sciences sociales, et, pour certaines, tout à fait nouvelles. Cette institution de révolte contre une forme particulière de violence symbolique, outre qu’elle fait exister des objets d’analyse nouveaux , met en question très profondément l’ordre symbolique en vigueur et pose de manière tout à fait radicale la question des fondements de cet ordre et des conditions d’une mobilisation réussie en vue de le subvenir, comme le conçoit Pierre Bourdieu. La forme particulière de domination symbolique dont sont victimes les femmes en couples polygames chez les Punu, frappées d’un stigmate qui, à la différence de la couleur de la peau ou de leur féminité, peut être cachée ou (affichée), s’impose à travers des actes collectifs de catégorisation qui font exister des différences significatives , négativement marquées, et par là, des groupes, des catégories sociales stigmatisées. Comme dans certaines espèces de racisme, elle prend en ce cas la forme d’un déni d’existence publique, visible. L’oppression comme « invisibilisation » se traduit par un refus de l’existence légitime, publique, c’est-à-dire connue et reconnue, notamment par le droit, et par une stigmatisation qui n’apparait jamais aussi clairement que lorsque le mouvement revendique la visibilité. La nature de l’institution ou du contrat de mariage a vécu un changement fondamental pendant les dernières années en France et au Canada. Dans une première étape, la thèse analyse pourquoi au Canada et en France les législateurs ne permettent pas la polygamie après avoir libéralisé presque tous les autres aspects du mariage. Deuxièmement, la recherche démontre que la prohibition de la polygamie cause plusieurs effets sur les droits personnels et sur les droits fondamentaux qui sont parfois corrigés par la législation en acceptant la relation polygamique pour ces fins spécifiques.Finalement, la thèse examine la prohibition de la polygamie en France et au Canada à travers une approche critique pour ensuite suggérer les perspectives d’évolution proposées à cette prohibition générale<br>The nature of the marriage institution, or contract, experienced fundamental changes during the last few years in France and in Canada. In a first step, the thesis analyses why Canadian and French legislators do not allow polygamy after having liberalized almost all other aspects of marriage. Secondly, the research shows that the prohibition of polygamy results in several effects on personal and fundamental rights, which are sometimes corrected through legislation by accepting the polygamous relationship for specific purposes. Finally, the thesis examines the prohibition of polygamy in France and inCanada through a critical approach in order to then suggest an outlook for modifications to this general prohibition

Qu'est-ce que la polygamie ? Par qui, pourquoi et comment est-elle pratiquée ? Dans une étude comparative de deux terrains à forte population musulmane, tels que la Turquie et l'Algérie, nous essayerons de répondre à ces questions à la fois d'ordre macrosociologique et microsociologique. En Turquie, entre une interdiction officielle et une tradition permissive, la gestion de la polygamie dans l'espace public s'effectue à travers des stratégies de contournement des lois institutionnelles pour effectuer une organisation de la polygamie sur le plan administratif et juridique. Quant à l'Algérie, pour la gestion de cette organisation, des lois existent pour limiter la polygamie mais sans vraiment l'interdire. Elle devient alors un jeu perpétuel de contournement de lois dans un rapport formel- informel. Ainsi, dans les sociétés musulmanes d'aujourd'hui et étudiées dans ce travail de recherche, les raisons de la pratique de la polygamie ne sont pas seulement d'ordre religieux, elles sont aussi d’ordre culturel, économique et social. Que cela soit en Turquie ou en Algérie, la polygamie n'est peut-être pas pratiquée de la même façon et pour les mêmes raisons (puisque ces dernières sont multiples) mais finalement la nature des raisons est la même : Satisfaire une expression du soi dans un environnement social holiste. Elle serait donc un moyen d'être dans la norme sociale tout en étant une volonté individuelle. En effet, la nature conflictuelle de la pratique de la polygamie présente un côté stimulateur de rapport de force et de pouvoir. Ce phénomène se traduit par un processus de territorialisation et d'appropriation de l'espace polygame qui transforme la polygamie en destructeur social où son impact sur les enfants n'est pas moindre<br>What is the polygamy? By whom, why and how is it practiced? In a comparative study of two grounds to strong Moslem population, such as Turkey and Algeria, we would try to answer these questions at the same time of macrosociological and microsociological order. In Turkey, between an official ban and a tolerant tradition, the management of the polygamy in the space public is made through strategies of bypassing of the institutional laws to make an organization of the polygamy on the administrative and legal plan. When in Algeria, louse the management of this organization, laws exist to limit the polygamy but without forbidding it really. But it becomes then a perpetual game of bypassing of laws in a formal / informal relationship. So, in societies current and studied in this research work, the reasons of the practice of the polygamy are not only of religious order. He appears there also. He represents so many cultural, economic and social reasons there. That it is in Turkey or in Algeria, The polygamy is cannot be practised in the same way and for them even reasons (because these last ones are multiple) but finally the nature of the reasons is even. Le nouveau testament (nt) ne mentionne pas d'activite missionnaire en afrique, comme il le fait pour l'asie mineure et l'europe. Mais, plusieurs textes prouvent que des relations s'etablissent entre l'evangile et l'afrique (mat. 2. 13-15 : fuite de la sainte famille en egypte ; actes (. 26-40 : conversion d'un haut personnage africain). Bref, cette demonstration a pour objet la verification litteraire et historique des difficultes de l'oeuvre missionnaire catholique, ou protestante contre la polygamie au monde noir de l'afrique occidentale. Historiographiquement, la polygamie, en afrique occidentale, s'est instauree a cause de la superiorite numerique des femmes due, en partie, a une forte mortalite infantile, en partie, a l'importance de la guerre dans les societes traditionnelles. La majorite des hommes, etaient des guerriers, et pris en esclavage par les vainqueurs. On devient polygame pour des motivations de nature de caractere tres differentes, poussant l'homme, qui choisit une nouvelle epouse. Car la sterilite de sa premiere femme est la raison la plus imperative, a savoir dans la societe de l'afrique noire, la finalite du mariage est la procreation, lorsqu'un couple ne donne naissance a aucun enfant, le mari a le droit et, meme, le devoir de choisir une nouvelle epouse. En cas de sterilite du couple, la tradition demande que seule la femme soit tenue responsable. La femme est consciente que la sterilite du couple est suffisante pour qu'elle soit conduite a une situation de co-epouse, bien que son mariage soit contracte sous regime monogame.

La réception de la polygamie et de la répudiation par l’ordre juridique international français a connu une évolution fluctuant entre la tolérance et le rejet. Nous plaçant dans le cadre particulier des relations franco-marocaines, nous avons cherché à vérifier dans quelle mesure la réforme de ces deux institutions, introduite au Maroc par le nouveau Code de la famille, pouvait leur assurer un meilleur accueil. Mais au préalable, nous avons jugé utile de passer en revue leur histoire et leur évolution dans le cadre du droit marocain. Ensuite, nous avons examiné le parcours difficile de leur " immigration " en France, les différents bouleversements jurisprudentiels qu’elles ont subis et l’intervention de plus en plus sévère de l’ordre public prenant désormais appui sur le respect des droits fondamentaux tel que dicté par la CEDH. Loin de résorber tous les différends en la matière, la Convention franco-marocaine du 10 août 1981 a révélé ses insuffisances et ses limites. L’ambition de ce travail fut alors de proposer quelques solutions inspirées pour certaines d’entre elles de la doctrine, telles que l’adoption de nouvelles règles matérielles ou encore la théorie des accommodements réciproques<br>The reception of polygamy and repudiation by the French international legal order has evolved, fluctuating between tolerance and rejection. Placing us in the specific context of French-Moroccan relations, we have sought to verify to what extent the reform of these two institutions, introduced by the new Code of family in Morocco, could provide them a better reception. But before, we thought it useful to review their history and their evolution under Moroccan law. Then we reviewed the difficult course of their " immigration " in France, the different jurisprudential dislocations that they underwent, and the more severe intervention of the public order now based on respect for such fundamental rights as dictated by the ECHR.Far from resolving all disputes in this area, the French - Moroccan agreement of 10 August 1981 revealed its shortcomings and limitations. Leurs attitudes se modulent en fonction de différents paramètres statuaires tels le statut-professionnel, l'âge, le statut familial, et ce, en liaison avec certains mécanismes psychologiques définis tels la recherche de différenciation sociale et le besoin d'affirmation de l'identité masculine<br>In the study of plural marriage and the relationship between polygyny and the social environment, the different methodological approaches (anthropological, sociological, demographic and psychosociological) furnish their specific contributions. In the case of Togo, we have established that from a psychological point of view, the attitudes that students and civil servants develop with respect to plural marriage are divergent. Le droit français et le droit libyen reposent sur des principes foncièrement différents. Le premier, fondé sur la laïcité, prône l'égalité homme-femme. Le second, de tradition religieuse n'est pas favorable à ce principe, la prédominance masculine en est le trait caractéristique. Cette distinction se voit tout au long de notre étude. Dans une première partie nous traitons les différentes formes de couples que connaissent les deux systèmes ainsi que les effets de nature aussi bien personnelle que patrimoniale qui en résultent. Cela comprend notamment l'exercice de l'autorité parentale et la contribution aux frais de ménage. Dans la seconde partie, il est question de la dissolution du couple et des conséquences qu'elle produit, personnelles comme patrimoniales. Malgré les différences entre les deux systèmes, on observe des difficultés de part et d'autre relatives à l'existence et à la dissolution du couple. Le système français est très attaché aux principes de liberté, égalité ; le système libyen est d'avantage protectionniste. Dans cette thèse on examine la famille et le mariage chez les turkmènes yomut. Cette thèse est constituée de trois parties suivantes: 1- generalise, 2- famille, 3- mariage. La première partie est constituée des éléments nécessaires à connaitre la société des turkmène. On y présente d'abord dans les deux premiers chapitres les aspects géographique et démographique de la région du turkmène. Ensuite dans le troisième chapitre on parle des évènements historiques qui ont transformé depuis le XIXe siècle la société iranienne et la société des turkmènes jusque 1962. Dans le quatrième chapitre on présente leur organisation tribale, la division tribale, la généalogie, la fonction socio-politique de la hiérarchie tribale et l'organisation économique. Ainsi à travers ces divers éléments on essaie d'éclairer la situation générale des turkmènes. La deuxième partie est consacrée exclusivement à l'étude de la famille chez les turkmènes yomut. Dans le premier chapitre de cette partie après la présentation des différents types de famille on essaie de dégager la définition générale de la famille chez les turkmènes yomut. On examine ensuite les différents types de famille et leur constitution dans la réalité. Dans le deuxième chapitre on présente des caractéristiques de la famille comme: la succession du bien ou le droit d'héritage et la division du travail. La troisième partie est constituée de huit chapitre ou on étudié tous les problèmes qui concernent le mariage:-les règles islamiques et les coutumes qui jouent le rôle déterminant dans le choix de conjoints; - les divers types de mariage et leurs rapports avec le problème de parenté ;- les relations entre les conjoints au niveaux endogamie et exogamie;- les raisons particulières de certains types de mariage; - l’âge du mariage;- le rôle de l'argent dans le mariage;- les différentes cérémonies du mariage;- la dissolution du mariage; -et finalement la question de polygamie.

En opposant a plusieurs reprises l'ordre public francais a certains effets d'un mariage polygamique, bien que ceux-ci fussent, en fait, soumis a la loi francaise, les juges francais, dans ces especes, ont en realite voulu corriger les consequences dictees par la regle de conflit qui n'assure aucune protection a la premiere femme francaise d'un homme polygame. Il apparaissait ainsi que la regle de conflit francaise, regisant la validite au fond des mariages, n'etait pas adaptee aux difficultes posees par le mariage polygamique. Elle ignore en particulier le fait que la polygamie est un statut matrimonial qui existe des la premiere union. Il convient en consequence de definir la regle de conflit de facon a determiner ce statut pour pouvoir se prononcer sur la validite des mariages subsequents. Cette lex matrimonii devra regir aussi la validite en la forme du mariage polygamique et les effets personnels entre epoux. Elle pourra, en outre, se substituer ponctuellement a la loi normalement applicable aux regimes matrimoniaux et aux successions pour resoudre certaines difficultes liees a la polygamie. En revanche, elle n'interviendra pas pour regir les rapports des epoux avec les tiers : se posera alors un probleme d'articulation entre le systeme juridique competent qui ignore l'institution et la nature polygamique du mariage dont il s'agit de faire produire certains effets.

Nombreux sont les domaines ou, aujourd'hui encore, l'egalite entre l'homme et la femme souleve plus de problemes juridiques qu'elle n'evoque une realite. Dans toutes les spheres du droit, des constats d'inegalite s'imposent, en effet, en fait ou en droit. Mais pour s'en tenir au droit international prive, on a vu en france, a priori paradoxalement, se creuser des inegalites, dans des matieres et a une periode ou le droit francais interne amorcait son evolution pour l'egalite. En effet, depuis les annees 60, les occasions se sont multipliees devant nos tribunaux d'accueillir des institutions etrangeres au droit francais : etrangeres dans l'espace, mais aussi fondamentalement dans la conception qu'elles soustendent des rapports personnels. Ainsi notamment de la repudiation et de la polygamie du droit musulman auxquelles nous nous attacherons au cours de notre etude. Si la question ne s'est presentee pour beaucoup qu'au moment de la procedure d'exequatur, soit a une phase ou sa gestion est plus delicate, c'est aussi, semble-t-il, a cause d'une mauvaise apprehension du phenomene. Il s'agit en effet de verifier la validite d'un droit acquis a l'etranger, mais ne devrait-on pas considerer qu'il s'agit, en realite, de la creation de ce droit en france ? c'est d'abord poser la question de la methode de reglement de conflit de lois a employer. A cet egard, l'analyse montrera que la situation litigieuse est souvent mal localisee et que cette localisation releve d'une inadequation des criteres de rattachement actuel au statut personnel dans les conflits de lois. En effet, si les droits litigieux sont traites comme des droits acquis a l'etranger, c'est parce que la regle de conflit francaise permet aux interesses de les creer a l'etranger, moyennant un voyage rapide hors du territoire francais, et alors meme qu'ils y sont installes. Nous evoquons ici le rattachement du statut personnel a la nationalite, qui, ainsi, constitue une inegalite en lui-meme et dans ses consequences. Ainsi, l'on s'apercoit que le champ laisse au positionnement du probleme au stade de la reconnaissance des droits etrangers devrait etre residuel, et qu'une meilleure formulation de la regle de conflit devrait permettre d'aboutir a ce resultat. L'objet de cette etude est de faire une etude comparee des effets de l'analphabetisme et de la polygamie dans quelques oeuvres de Sembѐne Ousmane et Ferdinand Oyono. En effet, l'analphabetisme et la polygamie sont deux des problѐmes qui ne laissent pas les Africains progresser dans le monde comme il faut. Comme ecrivains negro-africains engages, Sembѐne Ousmane et Ferdinand Oyono vont eveiller la conscience des Africains envers ces problѐmes, à travers leurs romans. Ainsi, les Africains peuvent reflechir encore sur ces problѐmes et saisir la balle au bon en trouvant des solutions avant qu'il ne soit trop tard.
L'etude est presentee en quatre chapitres et une conclusion. Le premier chapitre sert d'introduction. Elle analyse un peu sur l'etat de sous-developpement en Afrique noire.
Le deuxieme chapitre discute la vie de Sembene Ousmane, le milieu socio-culturel ou il a grandi et qui l'a influence dans ses oeuvres. Le troisieme chapitre, pourtant, est consacre a Ferdinand Oyono et ses contributions dans la litterature negro-africaine. Nous verrons que bien qu'il n'ait ecrit que trois romans jusqu'ici, il a fait des pas indelebiles dans les sables de l'histoire en Afrique noire.
Le quatrieme chapitre analyse quelques livres des deux auteurs tels que Le Mandat, Voltaῐque d'Ousmane et Une vie de boy, Le vieux negre et la medailie et Chemin d'Europe d' Oyono pour faire sortir les problemes de la polygamie et de l'analphabetisme.
La conclusion essaie de voir si nos deux ecrivains ont bien pose les problemes. Elle suggere aussi une solution qui est l'education des masses et de la femme--education adaptee aux besoins du peuple.

Sur la base des travaux de Simone de Beauvoir Deuxième sexe I et Deuxième sexe II, et d’autres articles importants, une analyse sur la condition et la conception des femmes dans Les Soleils des indépendances a été effectuée dans le but d’étudier l’image de la femme postcoloniale africaine en général, et ivoirienne en particulier comparativement à celle d’avant l’indépendance. En examinant les conditions de la femme dans Les Soleils des indépendances d’Ahmadou Kourouma nous nous sommes retrouvés confrontés à certaines idées telles que la soumission, la société patriarcale, la femme traditionnelle, la femme moderne, la liberté, la femme comme mère mais aussi comme objet et victime des atrocités liées aux coutumes et traditions. Malgré l’accession de la Côte d’Ivoire à l’indépendance cette condition n’a pas été améliorée, et c’est ce que l’auteur dénonce indirectement et peut-être inconsciemment.<br>Based on Simone de Beauvoir’s work The Second Sex, and other important articles, an analysis of the condition and conception of women was carried out in order to study the image of the postcolonial African women in general, and Ivorian in particular, in comparison with the women before the independence. Through the analyse of the condition of women in Ahmadou Kourouma’s The Suns of Independence, we came across ideas such as submission, patriarchal society, traditional woman, modern woman, freedom, women as mothers but also women as sexual objects and victims of customs and traditions related atrocities. Despite the accession of Ivory Coast to independence this condition has not improved, and this is what Kourouma is indirectly or maybe unconsciously denouncing.

Le XXIe siècle se veut un siècle de la promotion et la protection des personnes vulnérables et de la lutte contre la discrimination. La communauté internationale s’intéresse davantage à la condition problématique de la femme et de l’enfant en tant que facteur révélateur de l’état global d’avancée sociale de la société. Or, l’Afrique demeure le continent ou le nombre de personnes vulnérables est le plus important de la planète. L’Organisation de l’Unité Africaine en son temps et l’Union Africaine ont déjà fait montre de leur engagement à s’attaquer aux problèmes concernant les femmes et les enfants à travers des mécanismes de protection des droits de l’homme bien définis. En effet, tout un arsenal juridique a été mis en place pour protéger les droits des femmes et des enfants. Au premier rang desquelles s’inscrivent les deux pactes de 1966 directement issus de la déclaration universelle des droits de l’homme, l’un sur les droits civils et politiques, l’autre sur les droits sociaux, économiques et culturels ; la convention relative aux droits de l’enfant ; la charte africaine des droits de l’homme et des peuples, la charte africaine des droits de l’enfant ; le protocole relatif aux droits des femmes, la déclaration des droits de l’enfants de 1989.La mise en œuvre de ces instruments juridiques est encore fragmentaire. Comme dans tous les accords internationaux, le plus grand défi est de passer de l’état de ratification à l’intégration de ces accords dans les législations nationales et leur mise en application afin que tous puissent jouir de leurs droits. Le droit international relatif aux droits de l’homme, dans sa forme actuelle, prohibe la discrimination et la violence contre les femmes et les enfants. Il représente le cadre juridique dans lequel les obligations des Etats en matière de promotion et de protection des droits fondamentaux des femmes et des enfants sont déterminées et évaluées. La pierre angulaire de cet édifice juridique est la convention sur l’élimination de toutes formes de discrimination à l’égard des femmes et la convention sur les droits de l’enfant. La crise économique mondiale, les conflits en cours ont entraîné des violences systématiques commises à l’encontre des femmes et des enfants. Ces violences se sont traduites au Sénégal par une dislocation de la famille et par l’effritement des solidarités traditionnelles. La vulnérabilité des femmes et des enfants au sein de la cellule familiale a entraîné le développement de pratiques telles que la mendicité, la délinquance, la prostitution, les enfants abandonnés, le mariage forcé, … L’analyse de la condition actuelle de la femme et de l’enfant au Sénégal nous amène à nous poser des questions suivantes : Il s’agit d’évaluer le degré d’intégration par le Sénégal des normes internationales dans son droit interne. Les entraves culturelles, religieuses et politiques ne constituent-elles pas un obstacle à l’effectivité des normes internationales ? Comment amener les praticiens à tenir compte des normes internationales dans le règlement des différends dans les rapports de familles ?<br>The twenty-first century is a century of promoting and protecting vulnerable people and fighting discrimination. The international community is more interested in the problematic condition of women and children as a factor in revealing the overall state of social advancement of society. However, Africa remains the continent where the number of vulnerable people is the largest on the planet. The Organization of African Unity in its time and the African Union have already demonstrated their commitment to tackling issues concerning women and children through well-defined human rights protection mechanisms. Indeed, a whole legal arsenal has been put in place in order to protect the rights of women and children. Foremost, among them there are the two pacts of 1966 stemming directly from the Universal Declaration of Human Rights, one on civil and political rights, the other on social, economic and cultural rights; the Convention on the Rights of the Child; the African Charter on Human and Peoples' Rights, the African Charter on the Rights of the Child; the Women's Rights Protocol, the 1989 Declaration of the Rights of the Child.The implementation of these legal instruments is still fragmentary. As in all international agreements, the biggest challenge is to move from the ratification state to the integration of these agreements in national legislation and their implementation so that all can enjoy their rights. International human rights law, in its current form, prohibits discrimination and violence against women and children. It represents the legal framework in which States' obligations to promote and protect the human rights of women and children are determined and evaluated. The cornerstone of this legal edifice is the Convention on the Elimination of All Forms of Discrimination against Women and the Convention on the Rights of the Child. The global economic crisis, ongoing conflicts have resulted in systematic violence against women and children. In Senegal, this violence resulted in a dislocation of the family and the erosion of traditional solidarities. The vulnerability of women and children in the family unit has led to the development of practices such as begging, delinquency, prostitution, abandoned children, forced marriage, etc. Analysis of the current status of women and of the child in Senegal leads us to ask ourselves the following questions: It is a question of assessing the degree of integration by Senegal of international norms into its internal law? Are cultural, religious and political obstacles not an obstacle to the effectiveness of international standards ? How to get practitioners to consider international standards in resolving disputes in family relationships ?

A partir de 1980, le phénomène de Ernai (l’homme marié entretient une deuxième femme souvent en cohabitant avec elle sans être su par l’épouse de l’homme) a fait l’apparition dans les villes côtières du sud de la Chine ou l’économie sont relativement développée. Il s’agit d’un échange de l’assistance financière accordée par un homme marié contre le service sexuel fourni par une femme souvent célibataire. Dans les relations entre ces hommes et femmes, il se peut que le couple soient amoureux l’un et l’autre, il arrive également que le couple s’intéresse plutôt a la transaction commerciale. Beaucoup de Ernai étaient issues du milieu modeste rurale. Dans les travaux de recherche antérieurs, les Ernai sont classées dans la prostitution. Or elles possèdent aussi des caractéristiques des concubines antiques des Qie. L’action des Ernai est considérée comme passive, étant donné que les hommes qui entretiennent jouent un rôle actif dans le processus. Il existe peu d’études systématiques en la matière. Le présent travail essaie d’explorer leurs parcours de vie conjugale afin de démontrer la nature réelle de ce group féminin en faisant un détour dans le passe pour mieux expliciter le présent<br>Since 1980, the phenomenon of Ernai (a maried man takes in charge of a second wife by living together with her without being seen by the spouse of the man) has been come out firstly in the coastal towns of southern China where the economy is relatively developed. It is an exchange of financial and material assistance given by a married man against the sexual service provided by a woman often single. In these relations between men and women, it is possible that the couple is in love each other, it also happens that the couple's interest is rather a commercial transaction. Many Ernai are from the poor regions. In the previous research, the Ernai are classified mostly in the framework of prostitution. But they have also some characteristics like the ancient concubinage of Qie. The action of Ernai is considered passif, given that men maintain active role throughout the process. There are few systematic studies on the subject. This paper tries to explore the belonging of these Ernai with doing a tour in the past in order to better explain this phenomenon

PONTIFÍCIA UNIVERSIDADE CATÓLICA DO RIO DE JANEIRO<br>CONSELHO NACIONAL DE DESENVOLVIMENTO CIENTÍFICO E TECNOLÓGICO<br>La dissertation a cherché a énoncer l exclusion sexiste et raciste persistante à Mozambique et au Brésil, à travers de l approche en relation a l égard des auteurs, la mozambicaine Paulina Chiziane et la brésilienne Conceição Evaristo, focalisant d’un côté les personnages des romans Niketche et Ponciá Vicêncio et de l autre côte le positionnement politique des mêmes auteurs comme activistes, formulé dans des entrevues et textes divers. La méthodologie utilisée a eté l analyse critique des romans, l incursion dans les entrevues et les conférences desquelles ont participé les auteurs et l étude des textes critiques et théoriques appropriés. De tout cela, il a eté possible de conclure que les questions raciales sont fortement présentes dans le roman brésilien, du début à la fin, mais ne sont que des coups de pinceau dans le mozambicain. La problématique des relations de genre en contrepartie est nucléaire pour la tournure des deux narrations. Dans les entrevues analysées des auteurs, il a eté possible voir que la question de genre est crucial pour Chiziane tandis que la raciale semble d être environnante dans son discours. Mais pour Evaristo les deux questions semblent d être plus serrées. L étude des écritures procédant du point de vue des femmes nègres, de leurs art, stratégie et vision politique, contribuent pour confirmer l expérience féminine nègre sous une perspective divergente de soumission de la cristallisation du stéréotype, reconnaissant une tension nécessaire entre l égalité et la différence, entre droits individuels et identités de groupes, quand on cherche résultats plus démocratiques moyennât l insubordination et la résistance identitaire.<br>A dissertação buscou investigar as formas de exclusão sexista e racista que persistem em Moçambique e no Brasil, através da abordagem relacional entre o olhar de duas escritoras, a moçambicana Paulina Chiziane e a brasileira Conceição Evaristo, focalizando, por um lado, as personagens dos romances Niketche, uma história de poligamia e Ponciá Vicêncio e, por outro, a postura política das próprias autoras como ativistas, expressa em entrevistas e textos diversos. A metodologia utilizada foi a análise crítica dos dois romances, a incursão em entrevistas e conferências das quais participaram as duas escritoras e o estudo de textos críticos e teóricos pertinentes. A partir disso, foi possível concluir que as questões raciais estão fortemente presentes no romance brasileiro, permeando-o do começo ao fim, mas são apenas pinceladas no moçambicano. A problemática das relações de gênero, em contrapartida, é nuclear na estruturação das duas narrativas. Também nas entrevistas analisadas das autoras, foi possível observar que a questão de gênero é crucial para Paulina Chiziane, enquanto que a racial parece ser circundante no seu discurso. Já para Conceição Evaristo, as duas questões aparecem mais estreitamente ligadas. O estudo das escritas oriundas do ponto de vista das mulheres negras, de sua arte, estratégia e visão política, contribui para afirmar a experiência feminina negra sob uma perspectiva diversa da submissão ou da cristalização do estereótipo, reconhecendo uma tensão necessária entre igualdade e diferença, entre direitos individuais e identidades grupais, quando se buscam resultados mais democráticos através da insubordinação e da resistência identitária.

Cette thèse vise à contribuer à une meilleure compréhension des facteurs qui agissent sur la décision de migrer des individus. Dans le chapitre 1, nous montrons qu’au Portugal, les immigrés occupent souvent des postes pour lesquels ils sont surqualifiés, et que cette non-adéquation entre profils et emplois occupés influence la sélection dans la migration. Les phénomènes de surqualification, plus marqués chez les individus les plus qualifiés, entrainent une sélection négative des migrants, tandis qu’une bonne adéquation entre profils et emplois conduit à une sélection positive.Dans le chapitre 2, nous tirons profit d’une expérimentation sur le terrain pour comprendre comment les décisions de migrer illégalement vers l’Europe des jeunes gambiens sont influencées par l’information qu’ils ont sur les risques associés à cette mobilité. Nous montrons d’abord que les participants au jeu surestiment à la fois le risque de périr en route et la probabilité d’obtenir un statut légal en Europe. Nos résultats suggèrent par ailleurs que la décision de migrer illégalement est influencée par l’une et l’autre probabilité. Informer les candidats au départ sur les risques réels encourus pourrait ainsi les aider à prendre des décisions en connaissance de cause et contribuerait peut-être à sauver des vies. Dans le chapitre 3, nous examinons les liens entre structure familiale et migration, en étudiant l’influence du type d’union des mères sur le comportement migratoire de leurs enfants. Nous trouvons que les enfants nés de mères en union polygame sont plus enclins à migrer vers l’étranger. Nous expliquons ce résultat par la rivalité fraternelle qui en découle<br>The purpose of this thesis is to contribute to a better understanding of the drivers of international migration. In Chapter 1, we document that immigrants in Portugal face a high incidence of occupational-skill mismatch, and show how it affects the selection into migration. We find that the incidence of over-education leads to negative selection while correct occupational-skill matches lead to positive selection. In Chapter 2, we rely on a lab-in-the-field experiment to understand the willingness to migrate illegally of young males aged 15 to 25 in The Gambia. We first show that potential migrants overestimate both the risk of dying en route to Europe, and the probability of obtaining legal residency status. The experimental results suggestthat the willingness to migrate illegally is affected by information on the chances of dying en route and of obtaining a legal residence permit. Providing providing potential migrants with official numbers on both probabilities thus affect their likelihood of migrating. This has the potential to help migrants make informed decisions and perhaps save lives. In Chapter 3, we investigate the impact of family structure on international migration decisions. We find that children of mothers in polygynous unions are more likely to migrate internationally. We provide further evidence suggesting that this result is due to sibling rivalry: having full- or half-siblings in migration increases the likelihood of migrating. Our evidence suggests that co-wives’ rivalry as documented elsewhere trickles down to children’s rivalry in migration, suggesting that while neglected in the literature, family structure is crucial to understanding migration

Le fait marquant de ces dernières années a été incontestablement l'attribution d'une place nouvelle à la femme africaine. Cette attribution s'est faite en rupture plus ou moins profonde avec les droits traditionnels. Elle s'est traduite dans les droits africains post-coloniaux par la prise d'une série de mesures de protection au profit de la femme. Cette protection multiforme et pluridisciplinaire s'étend à tous les domaines : pénal, social, politique et surtout familial (le mariage). Dans ce dernier domaine, la protection ne pouvait se faire sans retoucher voire interdire certaines institutions des droits coutumiers tels que la polygamie, la dot, la répudiation unilatérale de la femme, le levirat entre autres. Dans les pays de colonisation française, cette protection s'est inspirée de celle organisée par le législateur français sans jamais l'égaler. Faut-il voir la une attitude conscience ou inconsciente des nouveaux législateurs ? Nous ne saurions y répondre pour le moment. Même en restant à la traîne du droit français en matière de protection de la femme, les mesures prises par les droits africains contemporains au profit de la femme n'en sont pas moins révolutionnaires<br>On of the most important event of those last years has been the attribution of the new place to the african woman. This analysis is done in light of the work of several African women writers. Fatou Diome evokes and denounces the position of the women on the island of Niodior through many topics such as submission, forced marriage, infertility, polygamy, patriarchal society, traditional versus modern woman, freedom, women as objects as victims of customs and traditions.

La loi gabonaise semble impartiale dans la distribution des rôles et le partage du pouvoir au sein du couple. Afin de vérifier cette hypothèse et de chercher à comprendre quelles sont les motivations d'une telle définition du mariage et des rapports de genre, nous avons cherché à savoir comment cet acte était défini dans le droit coutumier tout en mettant en lumière les modifications et les changements qu'il a subi au fil du temps. Ces modifications sont la résultante de la cohabitation entre peuples divers (le Gabon est une mosaïque ethnique) et de la colonisation française. Ceci nous a mené vers une comparaison entre les coutumes, la loi coloniale française et la loi gabonaise actuelle. A l'issu de cet exercice, nous sommes parvenus à deux résultats : d'une part, la loi gabonaise actuelle est issue des différents droits que nous venons d'énoncer (coutumes locales et droit colonial français), ce qui lui confère un caractère hybride. D'autre part, on peut noter dans ces droits un trait commun, qui est la soumission de l'épouse à l'époux. Cette dernière réalité est concrétisée par la pratique de la polygamie et le sens que la société gabonaise donne à la dot<br>The Gabonese law seems impartial in the distribution of the roles and the division of the power within the couple. In order to check this assumption and to understand the motivations of this kind of marriage and the relations of gender, we sought to know how this act was defined in the common law while clarifying the modifications and the changes which it underwent in the course of time. These modifications are the resultant of the cohabitation between various people (Gabon is an ethnic mosaic) and French colonization. This carried out us towards a comparison between the habits, the French colonial law and the current Gabonese law. At resulting from this exercise, we arrived to two results: on the one hand, the current Gabonese law is resulting from the various rights which we have just started (local habits and French right colonial), which gives a hybrid character to him. On the other hand, we can note in these rights a resemblance, which is the submission of the wife to the husband. This last reality is concretized by the practice of polygamy and the direction which the Gabonese society gives to the dowry. Past by insisting on the period 1892-1973 during which the forestry development occupied a dominating place in the economic and social life of this country

Ce travail a pour objet d’étudier la confrontation entre deux systèmes juridiques distincts en matière de mariage et de ses effets. Il s’agit de la réception du droit marocain de la famille qui est d’essence religieux par l’ordre juridique français à travers son droit international privé, un ordre juridique laïque. La première partie de cet ouvrage est consacrée à la compréhension du mariage marocain et de ses effets qui est indispensable pour la réception d’institutions étrangères par l’ordre juridique français. Pour y parvenir, il faut saisir l’évolution de l’institution matrimoniale depuis la création du premier Code de la famille marocain, jusqu'à la réforme de ce dernier en 2004. Elle met en évidence l’assimilation par le législateur marocain du mariage et de ses effets dans un Code de la famille moderne tout en gardant son essence religieuse. Cette approche indispensable conduit à comprendre la portée de la réforme du mariage marocain de 2004 et la difficulté que connait son application. Comprendre ses limites permet de saisir la conception de la notion de famille dans le Maroc d’aujourd’hui. La deuxième partie est consacrée à la réception de cette notion à travers le mariage marocain et ses effets par le droit international privé français. L’étude de l’application des règles de droit international privé montre la difficulté qu’a la loi marocaine à s’appliquer sur le territoire français malgré l’existence de la convention franco-marocaine du 10 aout 1981. Le droit marocain se trouve, malgré sa compétence, soit devant une qualification difficile de ses institutions inconnues de l’ordre juridique français et dans ce cas, il est dénaturé. Soit il est face à l’intervention du mécanisme de l’exception de l’ordre public puisque ses institutions et ses règles sont considérés comme choquant les principes fondamentaux du for et par conséquent, il est écarté. En analysant la méthodologie du droit international privé français, un certain relativisme découle dans l’application de ses modalités ce qui envoie à s’interroger sur les limites du respect des valeurs fondamentales du for. Un relativisme qui se débat entre poursuivre le but du droit international privé d’harmoniser deux systèmes<br>This work is to study the confrontation between two distinct legal systems relating to marriage and its effects. It is the receipt of the Moroccan family law which is of religious essence by the legal order french through its international law private, a legal secular. The first part of this book is devoted to understanding Moroccan marriage and its effects which is indispensable for the reception of foreign institutions by the french legal order. Achieve this, to understand the evolution of the marital institution since the creation of the first Code of the Moroccan family, until the reform of the latter in 2004. Ithighlights the assimilation by the Moroccan legislator of the marriage and its effects in a modern family Code while keeping its religious essence. This indispensable approach leads to understand the scope of the reform of the Moroccan wedding of 2004 and the difficulty that knows its application.Understanding its limits allows to capture the design of the concept of family in the Morocco of today.The second part is devoted to this concept through the Moroccan wedding reception and its effects byfrench private international law. The study of the application of the rules of private international law shows the difficulty that Moroccan law applicable on french territory despite the existence of the Franco-Moroccan agreement of 10 August 1981. Moroccan law is, despite its jurisdiction, either before a difficult qualification of its unknown institutions of the french legal system and in this case, it is denatured. L'étude de l'évolution des comportements matrimoniaux s'inscrit dans la recherche des signes précurseurs de la transition de la fécondité dans les pays en Afrique de l'Ouest et plus particulièrement dans les villes de Cotonou, d'accra et de Lomé capitales respectives du Benin, du Ghana et du Togo. Les données utilisées pour cette analyse sont les recensements effectués dans ces trois pays depuis 1960, l'enquête mondiale fécondité du Benin en 1982 et les enquêtes démographiques et de sante du Ghana et du Togo en 1988. Les résultats obtenus peuvent se résumer comme : - on note un rajeunissement de l'âge dans la vie sexuelle à travers les générations et un recul récent de l'âge d'entrée en première union dans les jeunes générations dans les trois villes. - les premières unions sont plus stables à Cotonou qu’à Lomé. - il y a plus d'hommes en union polygame à Cotonou que dans les deux autres villes, mais on recense plus de femmes en union polygame à Lomé qu’à Cotonou. Mais quel que soit le pays, on remarque une tendance à la diminution de la polygamie<br>The study of the evolution of matrimonial behaviours is in kipping with the research of forwarnings of fertility transition in West African countries and specially in Cotonou, Accra and Lome. The data for the study are mainly the census taken in three countries since 1960, the world fertility survey made in Benin in 1982 and the demographic and healt surveys made in Ghana and Togo in 1988. The results obtained can be summarised as follows : - in the towns we notice in age at first in age at first sexual experience through generation and a recent increase in age at first marriage among young genetation. - first marriages are more stable in Cotonou than in Lome. - in Cotonou there are more men in polygamous marriage than in the two other towns, but women in polygamous marriage are more numerous in Lome than in Cotonou. Nevertheless, in all these countries there is a tendancy of regression of polygamy

L'approche adoptée pour répondre à cette question associe des théories économiques, des méthodes micro-économétriques et des connaissances établies par d'autres disciplines (sociologie, anthropologie, démographie et médecine). Le travail empirique est mené sur des données originales provenant d'une enquête ménage sénégalaise et sur les Enquêtes Démographiques et de Santé menées dans les pays africains. Chacun des chapitres étudie un déterminant potentiel des choix de fécondité : la préférence pour les garçons, les besoins des femmes en termes d'assurance-veuvage, et les rivalités reproductives entre co-épouses dans les ménages polygames. Tous convergent vers le même résultat : une femme intensifie sa fécondité lorsque son avenir économique est menacé, parce que son accès aux ressources contrôlées par les hommes passe principalement par ses enfants. Ainsi, la promotion de l'autonomie des femmes pourrait favoriser le contrôle des naissances et éviter aux femmes et aux enfants de subir les risques sanitaires liés aux grossesses rapprochées<br>This dissertation investigates if fertility behaviors in Africa can partly be explained by women's strategies to improve their economic security. The approach combines economic theory, micro-econometric methods and insights from other disciplines (sociology, anthropology, demography and medicine). The empirical work is carried out on original data from a Senegalese household survey, and on the Demographic and Health Surveys in African countries. Each chapter explores one potential driver of fertility: son preference, women's needs for widowhood insurance and co-wife reproductive rivalry in polygamous households. All point to the same idea: a woman intensifies her fertility when her economic future is jeopardized, because children remain women's best claim to the resources controlled by men. In terms of policy implications, the main insight is that the sustained high level of fertility in Africa does not merely reflect women's lack of control over births, as is often argued. It also reflects their incentives to have many children. Promoting women's autonomy would thus help birth control efforts and spare mothers and children the heavy health cost of frequent pregnancies

The title of this paper is "Two generations of African writers: Women who conform to norms, and women who make noise. Mariama Bâ and Calixthe Beyala”. In this study we analyze two novels, Une si longue lettre by Mariama Bâ (1979) and Assèze l’Africaine by Calixthe Beyala (1994). We examine the similarities and differences in expression, style and themes. Our objective is to determine whether Bâ and Beyala are representing two different groups of African female writers. We have combined a postcolonial approach with a comparative method. Our hypothesis is that the two novels stand in contrast to each other through differences in themes and styles. In order to test this hypothesis we use previous research. Our analysis shows that the work of Bâ has a sober and refined style of writing. Bâ is raising awareness of the situation of women, without deviating from social norms, choosing themes such as polygamy, sisterhood and the value of education. In the work of Beyala we see a more pronounced political criticism, in a bolder and more agitating style of writing. Our conclusion is that the two novels are strongly differentiated through themes and styles. Bâ and Beyala belong to two different generations of female French-speaking African authors.

Written in Swedish with an English abstract. Polygamy has recently received more and more attention in Sweden due to, among other things, the streams of refugees and globalization. The Swedish norm of marriage is monogamy thus family constellations that go against this sometimes have difficulties to adapt to the Swedish family law. Polygamy is a collective name for marriages where a person is married to several people at the same time. The sex basically does not play a role in the concept of polygamy, but the most common marriage constellation, and the constellation that this essay has delimited itself to, is the one where one man is married to several women. Today, polygamy is mainly practiced in the Muslim countries of Asia and Africa where the Qur'an is an important part of the construction of the countries' legal systems. In order for polygamy to be allowed in Sweden, it is required that the marriage can be recognized according to the law on certain international legal relationships concerning marriage and guardianship (lag om vissa internationella rättsförhållanden rörande äktenskap och förmynderskap). According to the Swedish Tax Agency's (Skatteverket) investigation, there are currently 679 persons registered with one or more spouses in the population register in Sweden; on the other hand, the figure is not considered to reflect reality. When a person dies, there are many things to be organized. Most of these issues in Sweden are regulated in the Inheritance Code (ärvdabalken). But since most of the family law in Sweden is based on the Swedish norm of marriage of monogamy, there are several application problems when the Inheritance Code is to be applied to polygamous marriages. But although the law is mainly designed for monogamy, it is possible to apply the law to polygamous family constellations. Even though it is not designed for this purpose, the law should be considered flexible enough that it can be applied. However, the application of the law creates problems among other things when it comes to the women in the relationship. It is clear that women in polygamous marriages have more uncertainties than women in monogamous marriages when it comes to the right to inherit and survivor`s protection. It is also difficult to presume that the proposal for legislative amendment that are on the table will contribute to strengthening the protection of the women. However, there are many indications that it in general looks good for the children in the marriages. There is really not much that suggests that children whose parents are in polygamous relationships are treated a lot differently when it comes to the right to inherit then children with parents in monogamous marriages.<br>Polygami har på senare tid uppmärksammats mer och mer i Sverige med anledning av bland annat flyktingströmmar och globalisering. Den svenska äktenskapsnormen är tvåsamhet, monogami vilket således har lett till att familjekonstellationer som går emot denna norm ibland har svårt att anpassas till den svenska familjerätten. Polygami är ett samlingsnamn för äktenskap där en person är gift med flera personer samtidigt. I grunden spelar könet inte någon betydelse för begreppet polygami men den vanligaste äktenskapskonstellationen, och den konstellation som uppsatsen har avgränsat sig till, är den där en man är gift med flera kvinnor. Idag är polygami främst praktiserat i de muslimska länderna i Asien och Afrika där Koranen är en viktig del av uppbyggnaden av ländernas rättsordningar. För att polygami ska bli tillåtet i Sverige krävs det att äktenskapen kan erkännas enligt lagen om vissa internationella rättsförhållanden rörande äktenskap och förmynderskap. Enligt Skatteverkets utredning finns det idag 679 personer registrerade med en eller flera makar i folkbokföringsdatabasen i Sverige, däremot anses siffran inte spegla verkligheten. Att de förslag till lagändring som ligger på bordet kommer bidra till en stärkelse av kvinnornas skydd är även det svårt att förmoda. Mycket tyder dock på att det överlag ser bra ut för barnen i äktenskapen. Det finns egentligen inte mycket som tyder på att barnen i hög utsträckning blir särbehandlade jämte barn i monogama äktenskap.

This thesis is about the boundaries of domestic immigration law and international human rights regarding polygamy. It considers how polygamous wives are treated, and why. Polygamy has traditionally been viewed in the West as ‘harmful’, both to women and society. Western legal systems do not allow domestic plural marriage, and international human rights institutions recommend the prohibition of polygamy. Despite that, valid foreign polygamous marriages are recognised in the United Kingdom, particularly where it would be more harmful to do otherwise—except in immigration. The Immigration Act 1988 and Immigration Rules exclude additional polygamous wives from reuniting with their families. No exception is made and any harm that women are likely to suffer as a result is irrelevant. This thesis argues that the treatment of additional polygamous wives, particularly in the refugee context where women are more likely to be exposed to insecurity and harm, presents a ‘polygamy paradox’. While formal objections to polygamy are apparently based on harm, they are likely to cause more harm than good. This work interrogates the stance on polygamy to consider not only its paradoxical effect, but what informs this outcome. Applying a critical legal understanding, this thesis exposes not only the unintended consequences of the law. It also highlights what has shaped legal boundaries, historically and more recently, revealing a hidden bias that undermines the legitimacy and efficacy of laws and rights. This work concludes by offering a renewed feminist framework for the consideration of polygamy; one which takes account of gender, history and power. Ordinary epistemological foundations for the treatment of polygamy are disturbed, so the voices of women who have occupied a neglected space at the centre of laws, rights and reality as a relentlessly excluded ‘other’ are heard, and the content of laws and rights may be improved.

Today, the temporary agency work is a well-established industry in the Swedish labour market. The industry has grown every year since the start 1992 and seemingly, the legislation has not kept up with its’ pace. The reason behind the growth of temporary agency work is their clients impulsion for flexibility as well as making their organisation more efficient. Employers organizations argue that the ability to be flexible is a tool to increase economic growth in the society while the unions argue that the temporary agency workers are paying the price with insecure employment-contracts. The line between cancelation of employment due to redundancy and dismissal due to personal reasons is unclear, with disadvantages to the employment protection, through this triangular relationship between the temporary agency work, user company and the employee. The question is if the goal justifies the means. The purpose of this thesis is to investigate how the temporary agency work-industry is affecting the temporary agency workers employment protection, in addition, the thesis will investigate which legal impacts the legislation is creating in a diversity perspective. In order to answer the research questions properly, a traditional legal dogmatic method has been used as well as legal sociological perspective.

Notre étude est une approche pluridisciplinaire de la polyginie, par l'étude du cas des Dagombas du Nord du Ghana, qui sont en très grande majorité musulmans et moins scolarisés. Nous avons organisé notre thèse en trois parties. Dans la première partie, nous procédons à une analyse réflexive sur le terrain du Nord ghanéen, selon une approche anthropologique. Nous décrivons la logique polygynique africaine et son évolution dans le contexte des transformations de la société contemporaine. Dans nos hypothèses nous mettons en corrélation la pratique de la polygynie avec l’analphabétisme, la richesse, les mœurs, et les valeurs à l’origine des mariages forcés. Dans la seconde partie, nous décrivons successivement : les évolutions du mariage, des liaisons matrimoniales, etc. Les ressorts de la polygynie, son évolution et le rôle particulier du système éducatif sont mis en relief. Par le croisement des niveaux d’instruction des femmes vivant en situation de polygynie ou encore celle des situations socio- professionnelles permet de tester les ressorts des pratiques émergentes face à ce régime matrimonial. Dans la troisième partie, nous décrivons les mutations socioculturelles et économiques actuelles et leurs conséquences sur les pratiques polygyniques au Ghana. Nous analysons, à cet égard, les perceptions et représentations de la polygynie par les citadins à l’une de variable allant de la tranche d’âge au degré d’attachement à la religion et à la tradition. The introduction presents our epistemological position and our methodological options. We have classified our thesis in three parts. In the first part, we explore an anthropological approach based on the field research. The hypothesis correlated the practice of polygyny with illiteracy, wealth, morals, and values as factors related to forceful marriages. Finally, we evaluated the evolution of polygyny social changes in a contemporary society. In the second part, we successively elaborated: the changes in marriage, and matrimonial status, etc The outcome of polygyny and the role of the educational system are highlighted. Accessing the educational level of women, living in polygyny or the Socio- Professional conditions determines the institutional stakes emerging from this matrimonial practice. In the third part, we found out the socio-cultural and economic changes and their consequences on polygyniques practices in Ghana. We analyze, our samples given the perceptions and representations of polygyny by urban dwellers the variable ranging from the age group determined their commitment to religion and tradition. Cette thèse porte sur l'analyse des normes de redistribution au sein de la famille élargie en Afrique Sub-Saharienne et de leurs impacts sur les choix d'allocation des ressources entre individus. Dans un contexte où les marchés financiers sont peu développés et où les revenus sont très volatiles, les individus sont vulnérables face aux risques économiques et de la vie. Pour pallier ces risques, ils se reposent alors principalement sur deux stratégies : la redistribution intrafamiliale et l'épargne. Dans cette thèse, j'étudie comment les mécanismes de redistribution intrafamiliale affectent les décisions d'épargne. A partir d'une enquête qualitative originale conduite au Sénégal en 2012, le premier chapitre propose une analyse fine de la relation entre les migrants, principaux contributeurs aux dépenses du ménage d'origine, et les destinataires de leurs transferts afin de mieux comprendre la dynamique du partage de ressources et les normes sociales qui y sont jointes. Dans le second chapitre, j'étudie les décisions de transferts au sein de la fratrie et comment elles permettent d'expliquer les choix d'épargne. J'utilise les données représentatives à l'échelle nationale de l'enquête "Pauvreté et Structure Familiale' au Sénégal. Je montre l'importance de transferts notamment destinés à des cérémonies, qui sont associés pour les hommes par un niveau d'épargne plus faible. Dans le troisième chapitre, je mets en évidence l'existence de stratégies coûteuses visant à réduire la pression à redistribuer, à partir d'une expérimentation originale au Sénégal. Une forte disposition marginale à payer pour cacher ses revenus est observée. De plus, les personnes ayant reçues leurs gains en privé transfèrent moins à leur entourage et compensent par d'avantage de dépenses personnelles. Enfin, dans le chapitre 4, il s'agit de comprendre comment les changements anticipés dans la situation matrimoniale du ménage peuvent influencer les comportements d'épargne et d'investissement. En particulier, je montre que les femmes en union monogame, face au risque de l'entrée d'une seconde femme dans leur union, investissent dans des stratégies visant à se protéger économiquement, en accumulant davantage d'épargne et concentrant leurs dépenses sur leurs besoins personnels et l'éducation de leurs enfants<br>This PhD dissertation aims at analyzing the effect of informal redistribution, taking mostly place within the extended family, on individuals' resource allocation choices in Sub-Saharan Africa. Indeed, in this region, due to limited access to markets for insurance, credit and savings, and to formal redistribution, individuals are vulnerable to life risks and economic shocks. To protect themselves against these risks, individuals rely mainly on two strategies: informal redistribution and informal savings. I analyze in this thesis how informal redistribution within the extended family affects individual savings decisions. The first chapter is based on an original qualitative survey conducted in Senegal in 2012 and propose a detailed analysis of the relationship between the transfer senders and the recipients within several family networks to understand the dynamics of resource sharing in the extended family and the social norms attached to these transfers. In the second Chapter, I investigate transfer patterns within a sibship and analyze how these patterns are related to saving decisions, using the nationally-representative ' Pauvrete et Structure Familiale' (PSF) suvey in Senegal. I find some evidence of high redistributive obligations that come generally at the cost of lower savings achieved for the main transfer senders. Based on an original lab experiment, in the third chapter, I highlight the widespread use of costly strategies aimed at circumventing these redistributive norms, namely income hiding. I identify the distortionary effects of such strategies on resource allocation decisions. In particular, I elicit a high willingness-to-pay to hide income from peers in the lab and show that hidden income induce a lower share of the gains devoted to transfers out of the lab, compensated by an increase in personal expenses. Finally, in my last chapter, using the panel of individuals of the PSF survey, I show that monogamous wives, when facing a higher risk of becoming polygamous, invest in self-protective strategies by saving more and spending more on personal expenses and on the education of their children

<p>Poly, to live in several loving and intimate relationships at the same time, is one alternative to the mono norm. In Sweden polygamy is illegal yet in recent years poly has slowly started to enter the hetero normative political agenda and raise debate in the media. But what does poly mean, and how do those who identify with this type of relationship describe it in contrast to mono? The theoretical framework is based on a structural viewpoint of the changes in the organisation of the family and the growing de-traditionalism of society. Amongst other I use a Foucauldian perspective to explain the structural shift (yet not replacement) between an Alliance pattern and a Sexuality pattern. Other theories in use are that of the emerging ideal of The Pure Relationship and Queer Tendencies. The essay draws its empirical results from seven e-mail and/or face interviews with individuals who identify with poly. The results show that if poly and mono are both understood as expression of the pure relationship they are potentially not so different. Yet the stigma and the lack of role models show that there is much needed public debate about it to unleash it from old discourses that still seem to uphold the equation that love equals two partners. Drawing attention to queer mechanism and the initiated process of the decentralisation of the heterosexual norm, I speculate that in the future polygamy must not be a foreign concept in Swedish society.</p>

A dissertation submitted to the Faculty of Arts in partial fulfilment of the requirements for the degree of Master of Arts in the Department of English at the University of Zululand, South Africa, 2013.<br>Polygamy is widely practised in African communities. The African social-realist
novel, especially when it is woman-authored, shows female characters as having to
play docile, subservient roles and accept demeaning positions in polygamous
marriages. Although it has been claimed that traditional African marriage creates a
satisfactory situation for women, mainly by means of the security it offers and the
bonds that it forges between co-wives, the narrators of African realist novels almost
always expose only evils associated with polygamy. In most of the texts, co-wives
experience conflict with one another, not bonds. Men are portrayed as egocentric
beings that greedily satisfy their sexual impulses at the expense of women.
Encouraged by their families, they inflict irreparable emotional damage not only on
their accumulated wives but often also on their offspring. While blinded by their
desires, these men engender many unplanned children for whom they usually take
little fatherly responsibility. Consequently, children too are objects of pity in many of
the books. This dissertation, by means of close analysis of select African narratives,
reveals that, despite all the struggles for liberation and democracy, values highly
regarded in modern societies, polygamy is a prevailing sign of male dominance in
African communities today. The dissertation shows that even such male-authored
novels as Chinua Achebe’s Things Fall Apart and Onuora Nzekwu’s High Life For
Lizards fail to recommend a polygamous life to women, while Mariama Bâ ’s So
Long a Letter and Scarlet Song, Buchi Emecheta’s The Joys of Motherhood and
Kehinde, Es’kia Mphahlele’s Chirundu, Lazarus Miti’s The Prodigal Husband, Ama
Ata Aidoo’s Changes, Sue Nyathi’s The Polygamist,SembeneOusmane’s Xala, Lola
Shoneyin’s The Secret Lives of Baba Segi’s Wives, Rebecca HourwichReyher’s Zulu
Woman, Miriam KWere’s The Eighth Wife, T.M. Aluko’s One Man One Wife and
Aminata Sow Fall’s The Beggars’Strike all use polygamy to highlight the
incongruence between the ideals of democracy and the facts of life as experienced by
African women. These texts reflect real social problems. They cast light on the
inequalities that prevail in polygamous relationships and imply that the principle of
equality cannot be achieved as long as polygamy exists.

This thesis illustrates how love, legality, money, sex(uality) and sin direct Malays’ marital strategies in the face of various social, moral, religious and structural pressures. Passionate love (cinta) is cherished and celebrated by Malays – that is, if it is indulged within marriage. Marriage serves as a license to engage in (otherwise illicit) sexual desires by rendering them “halal” or lawful in the eyes of Islam and Malay adat (traditions). A vigilant State-led Islamic Bureaucracy, which polices and punishes pre- or extramarital sexual liaisons between unmarried couples through strict moral surveillance, further ensures that access to physical intimacy remains a conjugal privilege. However, hindered by complex bureaucratic procedures for marriage and pressured by escalating passions, many of my Malay informants are compelled to seek cheaper, quicker, and discreet alternatives in neighboring Southern Thailand to “halal-ize” pre- or extramarital romances, resulting in secret – and legally contentious – monogamous or polygamous cross-border marriages. Cross-border marriages – specifically polygamous ones – are subsequently explored here as a careful (and often failed) negotiation between discretion and disclosure: their stability decreases with increased exposure, rendering them highly precarious. Contrary to the dominant male-centric scholarship on polygamy, this study privileges the perspectives and experiences of polygamous wives by considering how their position within the marriage informs their capacity to engage in – or conversely, disengage from – this multi-marital arrangement. Polygamy is embraced by some women as a female choice that secures access to marriage and motherhood – both crucial towards achieving Malay womanhood. For others, polygamy is hardly a “choice” at all, and they must cope with the discomforting reality in which the husband’s money, time, and attention are now “halved” between his wives. Love in polygamy is experienced in visible and measurable terms, and the husband’s unequal distribution of his emotional and economic resources create discontent among wives that may culminate in divorce, or covertly confronted through sorcery. In Malay polygamy, more therefore means less.

Le couple au sens du droit musulman est conçu par le lien matrimonial, ce qui exclut toutes autres formes d’unions. Les profondes mutations en la matière de certains pays musulmans font que l'institution familiale est traversée par des courants contradictoires faisant d’elle un champ de lutte propice entre l'ancienne et la nouvelle, entre la tradition et la moderne.Les réformes apparues, il y a une dizaine d’années, dans certains pays musulmans témoignent la volonté des législateurs musulmans de répondre au souci de l’égalité homme-femme, en particulier le rééquilibrage des droits entre les époux. Ainsi, de nombreuses institutions ont connu des mutations soit par leur prohibition, soit par leurs restrictions les rendant difficilement applicables.Ce travail a le mérite de dresser le bilan de l’accueil de ces institutions réformées dans l’ordre juridique français et, ainsi démontrer les tergiversations jurisprudentielles en la matière.L’européanisation du droit international privé et l’influence libérale de la famille en droit français ont accru la diversité des règles et des méthodes applicables aux couples.En analysant la méthodologie du droit international privé français, un certain relativisme découle dans l’application de ses modalités ce qui envoie à s’interroger sur les limites du respect des valeurs fondamentales du for. Un relativisme qui se débat entre poursuivre le but du droit international privé d’harmoniser deux systèmes et respecter les valeurs essentielles du pays d’accueil.Néanmoins, apprécier les réformes du droit étranger dans leur globalité et leur profondeur permettra de renforcer la coordination entre les différents systèmes en jeu<br>The couple under Muslim law is designed by the marriage bond, which excludes all other forms of union. However. The profound changes are making Family crossed by contradictory speeches that makes it a field of struggle between the old family and the new one, between tradition and modernity.The recent reforms that have appeared in many Muslim countries, over a decade for the majority, show the concern of the Muslim legislator for the question of equity between men and women, especially the husband and wife. Thus, many institutions have experienced mutations either by their prohibition or by their reluctance involving their difficulties of application.The position of the French judge is marked by the concern to exclude the application of foreign rules only to situations that have close ties with French territory. This "proximist" conception of public order is going against a relativistic approach to divergences between legal systems., and above all the emergence of a new rule of conflicts with the phenomenon of “Europeanisation” in French domestic law

I den här uppsatsen tittar jag på debatten kring månggifte i Svenska tidningsartiklar. Debatten har fått nytt liv på senare år i och med förslag som kommit från både Feministisk initiativ och Centerpartiet om att öppna upp för en samlevandlag istället för en äktenskapslag. Uppsatsen är en kritisk diskursanalys enligt en modell av Norman Fairclough, jag har också valt att koppla det starkt till Queerteori och en queerteoretisk syn på heteronormativitet. I min analys hittades det ett par tydliga diskurser kring kön, ojämlikhet, äktenskap, heteronomativitet och valfrihet. Att gå igenom detta material visade på flera starka ståndpunkter ofta i direkt konflikt. Argument fördes från så väl gamla normer som näst intill karikatyriska föreställningar kring vad det skulle innebära att vara leva fler samt. Argumenten för visade istället på en vilja att normalisera snarare än acceptera. Önskan att måla upp livsstilen som varken mer eller mindre annorlunda än den monogama normen. Uppsatsen blir därför viktig då den är ett sätt att belysa dessa strukturer samt att i viss mån ifrågasätta de normer som finns.

This study consists of six chapters. Chapter One is the introductory chapter. It identifies the problem, highlights its aims and objectives. It defines concepts and concludes with a literature review and the scope of the study. Chapter Two gives an overview of the theoretical framework paying special attention to psychoanalytic theory which forms the cornerstone of the study. It provides a literary explanation with regard to the nature of polygamy as well as the challenges inherent in polygamous marriages. Chapter Three serves as a prelude to critique how Lesokolla‟s behavioural patterns affected him as a polygamist. Chapter Four focuses on the problems experienced by the society of King Phefomoloha as a result of Lesokolla‟s polygamy. Chapter Five pursues the critique further, this time discussing the impact that Lesokolla‟s polygamy had on the child Tshitso and her mother Botle.
Chapter Six is the final chapter of the study. It embodies a general conclusion that is
informed by the findings of the study undertaken.
