El texto que tiene en sus manos se constituye en el tercer volumen de la colección denominada: Pensar en escuelas de pensamiento, una producción editorial derivada de las reflexiones y acciones encadenadas y desencadenadas desde los colectivos interdisciplinares que configuran una apuesta del pensar, en la Universidad de La Salle, que lleva el mismo nombre de la colección. Esta edición incluye una serie de escritos en el contexto de los procesos de formación, las perspectivas y los retos de cada equipo y del proyecto mismo como globalidad que intenta contribuir con la materialización de la esencia de la universidad. En cuanto a la formación, este volumen deja ver el trancurrir de cada colectivo, y demás participantes del proyecto, respecto a su crecimiento como nodos de pensamiento colaborativo que buscan trascender las restricciones disciplinares, sin negar la importancia de las disciplinas en la gestión del conocimiento y el desarrollo de la humanidad. Tal ejercicio de formación continua se inscribe en la doble perspectiva que caracteriza estas escuelas del pensar, es decir, son escuelas en cuanto las interacciones que generan con otros sujetos y comunidades representan un escenario que brinda múltiples posibilidades de aprendizaje; principalmente en lo que respecta a pensar mejor, de manera colaborativa e interdisciplinaria. Una segunda perspectiva desde la que se asume esta noción de escuela se asienta en que, al pensar más y mejor, los nodos interdisciplinares del pensar van produciendo mejores resultados en su pensar y las acciones derivadas de este, así, se espera que en el mediano-largo plazo llegue un momento en que los colectivos interdisciplinares y su pensar cualificado, pudieran convertirse en una oportunidad de referencia para otros pensadores y comunidades del pensar y el actuar, tanto en la academia como en otros escenarios

This chapter considers applications for sale of land held on trust, which are brought by third parties; typically creditors and trustees in bankruptcy of a beneficiary. The chapter explores the different legislation and rules that applies depending on whether the application is made by a creditor or a trustee in bankruptcy. In determining applications for the sale of a home, the court must have regard to the rights of those influenced by the sale under Art 8 European Convention on Human Rights (ECHR). Where the sale is discretionary, the courts have the opportunity to undertake a proportionality balance required to ensure compatibility of the sale with the ECHR. Where there is no discretion, however, questions of compatibility with the ECHR arise.

Abstract:
This book is the result of the inter-institutional research project carried out by the Catholic University of Colombia and the University of La Salle. It presents an inter-institutional proposal for the improvement of tutorials as an academic support strategy for the tutoring programs in the areas of Mathematics and Chemistry of both universities. For achieving this, during a period of five years, a mixed research methodology was used. It began with the characterization of the programs based on the review of different documents, as well as the institutional results, and the articulation of these with the theory that founded them. It was found that the two departments of Basic Sciences have understood the tutoring sessions as a space for academic accompaniment in which they seek to improve the academic performance of students, and this as an indicator of learning. This support has been categorized, in both cases, by promoting actions related to the creation of a culture of autonomous work in students and one of participation from teachers. Subsequently, a comparative analysis was carried out between the implemented strategies. And, finally, the incidence of the academic accompaniment strategies was evaluated from the perspective analysis of the academic community.

All books in this flagship series contain carefully selected substantial extracts from key cases, legislation, and academic debate, providing able students with a stand-alone resource. This chapter describes the formality requirements that must be complied with for the creation or transfer of legal estates and interests in land. The three stages of creating and transferring legal rights are contract, creation or transfer, and registration. The Law of Property (Miscellaneous Provisions) Act 1989 had increased the formality requirements for contracts and made more severe the consequences of non-compliance. Under s 2 of the 1989 Act, a contract may take the form of a single document signed by both parties or an exchange of documents, each of which has been signed by one of the parties. Non-compliance results in a document being void as a contract for sale of land, but a valid contract may be obtained through use of collateral contracts or rectification. The Law Commission had envisaged the use of estoppel in appropriate cases in which formality requirements for a contract for sale were not complied with. The fundamental objective of the Land Registration Act 2002 is directly associated to the introduction of e-conveyancing. The goal of attaining e-conveyancing has not been deserted, but its introduction appears almost as far away now as it did when the LRA 2002 passed into law.

This chapter concentrates on the rights and powers conferred upon the lender to enforce its security over land. A lender's rights and remedies arise from the nature of its security, the powers implied by the Law of Property Act 1925, and any express powers. The lender's right to take possession originated at common law but is now conferred by s87(1) of the 1925 Act. The lender's power of sale and to appoint a receiver are implied by s 101(1)(i) and s101(1)(iii) of the 1925 Act respectively and can only be exercised if the borrower has defaulted. The duties that a lender and receiver owes when selling the mortgaged property are explained as well as the position of a purchaser from a lender or receiver where there has been a breach of duty.

This chapter discusses the internal regulation of co-ownership. It is concerned with the content question: the rights enjoyed by co-owners, including their rights and duties in relation to each other, and whether one co-owner can insist on a sale of the land against the wishes of another. The joint tenancy and the tenancy in common are two forms of co-ownership. The chapter explores the operation of survivorship in respect of a joint tenancy and the process through which a joint tenant may become a tenant in common through severance. Co-ownership is terminated once there is a sole legal and equitable owner. The process of partition can also terminate co-ownership. In both forms of co-ownership, the rights and duties of the co-owners are governed through the imposition of a trust of land, regulated by the Trusts of Land and Appointment of Trustees Act 1996 (TOLATA 1996). TOLATA 1996 contains a procedure enabling disputes relating to land held on trust to be determined by an application to court. The chapter considers how the courts have resolved disputes between the beneficiaries as to whether land should be sold. The chapter also considers the relationship between TOLATA 1996 and ‘home rights’ (of occupation) conferred by the Family Law Act 1996.
