Abstract:

The current paper is concerned with linguocultural (ethnolinguistic) analysis of australianisms as culture specific words which are either not found in British English (the mother tongue) or are different from their British counterparts to some extent. The main research question was to identify the key lexemes of this type and establish correlation between them and Australian values (the national identity) as well as ethnostereotypes in modern Australian society. The novelty of the approach to studying these lexical units is in looking at them in terms of their functioning in speech and pragmatics based on the most sensitive to social change and dynamic type of discourse – the media (The material was drawn for the national papers “The Daily Telegraph, Australia” and “The Australian” over the past decade). By means of the random selection method, definitional and contextual analyses six key concepts have been identified (fair go, fair dinkum, larrikin, battler, bludger, (hard) yakka – the last word being aboriginal) and their place in the national identity structure defined. Also, we found some differences in how the same australianisms were presented and ranked in either paper manifesting certain values (for example, battler) or anti-values (for example, bludger) depending on the editorial board’s opinion and/or the content. For instance, “The Daily Telegraph” clearly highlighted the idea of justice (e.g. fair go, fair dinkum), while “The Autralian” put more focus on praising the stubbornness of Australians in the struggle against various obstacles (e.g. battler). References to the boisterous (larrikin) nature of Australians were somewhat more frequent “The Daily Telegraph”, although this concept was quite important for both newspapers. One of the most interesting results we got was a shift in connotations of several australianisms. Thus, it was shown that some words (for example, larrikin), originally having a negative meaning, with time may become positively connoted, characterising a certain previously disapproved type of person / behavior as normal. The study can be continued to include more words of this type, especially aboriginal ones which are already used in media and call for ethnolinguistic (linguocultural) interpretation by researchers.

In the 21st century, ‘playing’ football at the elite level is a profession in a multi-billion dollar business. However, the way it is imagined in media discourse and the popular imagination positions football and its athletes as transcending mere ‘work’, portraying them as ‘larrikin’ national heroes, pseudo-religious figures and role models. Taking the case of Andrew Lovett as a case study, a footballer ultimately fired after being charged with sexual assault, this article demonstrates the persistence of ‘non-work’ discourses in media reporting using mixed-methods discourse analysis. It shows how ‘transcendent’ discourses provide a logical framework that makes treating footballers differently from those in other public professions seem reasonable, enabling clubs and leagues to act in their own best interests.

This article discusses the likely Australian copyright implications of an increasingly popular form of digital music expression: the music mash-up, a majority of which are created from pre-existing audio/sound recordings and video without permission of the copyright owner. In examining this issue, the analysis of the courts in the recent Larrikin music copyright infringement cases are examined. Consideration of the implications of music mash-up creation to moral rights is also considered. In the hypothetical scenario that a music mash-up artist is accused of copyright infringement, consideration is given as to the likely outcome of the application of the fair dealing exceptions under the Copyright Act 1968 (Cth). Finally, a suggestion is made as to the direction of future law reform in this area.

The 1970s newspaper Australasian Weed remains a remarkable chronicle of a very different time when a flourishing counter-culture created the space for a regular pro-drug publication at the edge of legality. Content analysis of the Weed and associated publications reveals an expected preoccupation with legalisation campaigns, instructional material and zany antics but a more surprising interest in detailed investigations of the legal process, the history and literature of drugs and health and safety issues. While influenced by the US underground press and drug writers like Hunter S. Thompson, the Weed was nevertheless in the Australian tradition of larrikin, alternative press with a crusading agenda and a confrontational approach to authority. The Weed's stormy career and eventual demise point clearly to the limits of a free press in Australia and raise questions about the efficacy of government drug education programs.

Abstract:

The intersection between social media activity and employment is an emerging global issue. This article examines the cultural, economic and technical milieu that has generated contested social media misconduct dismissals in Australia and South Africa. Through an analysis of 42 Australian and 97 South African decisions, it is argued that the ubiquitous, enduring and open nature of social media affects employment quite differently depending on country specific factors. In Australia, the absence of entrenched political rights has meant that employee social media use is not subject to reasonable expectations of privacy. However, there is also tolerance for a certain level of larrikin behaviour. In South Africa, the existence of enshrined rights manifests differently in the context of social media dismissal. Within a culturally diverse population with deeply fractured race relations, the decisions reveal a White minority still perpetuating dominance over a historically disadvantaged Black workforce.

In the past decade, journalism scholars have started to pay more attention to what we could call the precarization of journalism: the large-scale job loss and downsizing in the news industry (at least in some countries) combined with a shift towards per-item payment and production rather than permanent, full-time contracts. In this essay, I sketch a history of precarious work in journalism and argue that unionization and other forms of collective action in journalism has been made difficult due to an occupational culture rooted in this history of journalism as precarious work. In the late nineteenth century, journalists in many countries opted to create a culture rather than to create unions, and this culture has both mythologized and naturalized precarity. In Australia, however, journalists unionized early. Besides the obvious structural factors behind this early unionization, the existence of the cultural figure of the larrikin and its role in journalistic culture likely also encouraged taking on a worker identity rather than seeking to emulate an upper-class writerly culture.

This paper explores the genealogies of bio-power that cut across punitive state interventions aimed at regulating or normalising several distinctive ‘problem’ or ‘suspect’ deviant populations, such as state wards, non-lawful citizens and Indigenous youth. It begins by making some general comments about the theoretical approach to bio-power taken in this paper. It then outlines the distinctive features of bio-power in Australia and how these intersected with the emergence of penal welfarism to govern the unruly, unchaste, unlawful, and the primitive. The paper draws on three examples to illustrate the argument – the gargantuan criminalisation rates of Aboriginal youth, the history of incarcerating state wards in state institutions, and the mandatory detention of unlawful non-citizens and their children. The construction of Indigenous people as a dangerous presence, alongside the construction of the unruly neglected children of the colony — the larrikin descendants of convicts as necessitating special regimes of internal controls and institutions, found a counterpart in the racial and other exclusionary criteria operating through immigration controls for much of the twentieth century. In each case the problem child or population was expelled from the social body through forms of bio-power, rationalised as strengthening, protecting or purifying the Australian population.

The Kookaburra case was a tragic and controversial copyright dispute, highlighting the need for copyright law reform by the Australian Parliament. In this case, a copyright action was brought by Larrikin Records against Men at Work, alleging copyright infringement by Down Under of the Kookaburra song composed by Marion Sinclair. The dispute raised a host of doctrinal matters. There was disquiet over the length of the copyright term. There were fierce contests as to the copyright ownership of the Kookaburra song. The litigation raised questions about copyright infringement and substantiality — particularly in relation to musical works. The case highlighted frailties in Australia’s regime of copyright exceptions. The litigation should spur the Australian Law Reform Commission to make recommendations for law reform in its inquiry, Copyright and the Digital Economy. This paper provides a critical evaluation of the options of a defence for transformative use; a defence for fair use; and statutory licensing. The paper also examines the question of appropriate remedies in respect of copyright infringement. The conclusion considers the implications of the Kookaburra case for other forms of musical works — including digital sampling, mash-ups, and creative remixes. It finishes with an elegy for Greg Ham — paying tribute to the multi-instrumentalist for Men at Work.

Abstract:

This paper looks at the demotic tongue of mateship in Australian Great War Literature as a theme of cognition and understanding in the literary texts and texts of culture. The language, like the Australian, was filled with character and a sense of the larrikin. It seemed irreverent at times, even rude in some circles, but it was much more than its immediate sound or inference; it was the natural verbal essence of the Australian mind – honest, loyal, dutiful and humorous. These characteristics are cornerstones of Australian mateship, a type of friendship that would be there beyond the bitter end, rival the love of a woman and even the protection of one’s own life. For some Australians, poetry was merely an extension of this language, as language was merely an extension of friendship. The aim of this paper is to demonstrate the Australian use of humour and language in the setting of Great War poetry. It looks at the demotic tongue of mateship, specifically what is known as the Great Australian Adjective (bloody), along with several other examples of vernacular language, in Australian Great War Literature, and considers this by referring to the common language of the Australian poet from the time. It will consider the notion that Australian writers of the Great War era may have been misunderstood as a result of their language, leading to critical mistakes about a poem’s literary worth, a poet’s seriousness as a poet and a nation’s literary value.

Popular culture has been inundated with stories and images of True Crime for a long time, which is testament to people’s enduring fascination with criminals and their deviant actions. In such stories, which present actual cases of notorious crimes in a style that often resembles fiction, criminals are either reviled as monsters or lauded as cultural icons. More recently, popular autobiographical accounts by criminals themselves have begun to emerge within this True Crime genre. Typically self-celebratory in nature, such representations construct a rather glamorized public image of the author. This article undertakes a multimodal analysis of what has been classed as one typical example of this True Crime sub-genre, Australian Mark Brandon Read’s autobiographical account Chopper: From the Inside. It thereby seeks to demonstrate that the book, while glamorizing and mythologizing its protagonist, simultaneously offers scope for a qualitative understanding of Read’s life of crime and the sensual dynamics of his violent offending. To this end, the analysis focuses on some of the linguistic and pictorial strategies Read employs in constructing a public image of himself that alternates between the dangerous ‘hardman’ and the ‘larrikin’ criminal hero. However, it is also shown that Read’s account reveals a degree of critical self-reflection. In addition to the multimodal analysis, the article also endeavours to explore the link between celebrity and crime, thereby engaging with the nature of popular culture’s fascination with celebrated criminals.

Abstract:

In September 2006, Australia’s most iconic feminist, Germaine Greer, wrote a controversial article in response to the death of celebrity wildlife presenter Steve Irwin. In the Guardian piece, entitled ‘That sort of self-delusion is what it takes to be a real Aussie larrikin’, Greer concluded, ‘The animal world has finally taken its revenge on Irwin’. For hundreds of Australian readers, Greer’s public response to the untimely demise of a purported national ‘hero’ represented a symbolic assault not just on the ’Crocodile Hunter’s’ grieving family but on the nation itself. Following the article’s appearance, Greer’s agents – Gillon Aitken Associates, based in the United Kingdom – received copious amounts of hate mail directed towards the controversial celebrity feminist; these emails are contained in the recently acquired Greer archive at the University of Melbourne and provide important insights into affective responses to this polarising figure. Tightly policing the boundaries of what constitutes ‘Australian-ness’ as well as mobilising problematic assumptions about the correct way of publicly doing femininity, these emails call into question Greer’s authority to speak publicly not just about this matter but about any issue at all. In so doing, these emails – which include threats of violence – work to contest the ‘newness’ of the vitriolic, misogynistic hate speech commonly directed towards vocal women in the contemporary mediasphere (especially via platforms such as Twitter). Against the representation of Irwin as model Australian, Greer is dismissed not just as a ‘bad’ woman but as a ‘bad’ citizen. Accordingly, this article considers both the kind of ‘Greer’ and the kind of ‘Irwin’ being discursively constructed in these emails, and how the mutually constitutive discourses of misogyny and nationalism were deployed in these attempts to marginalise and silence Greer and to mourn and celebrate Irwin.

Abstract:

Gender is constructed from social and cultural meanings that dynamically shift and vary. Previous work has assumed that the constructions of masculinity in Australia are like those in other Western societies, and typically focus on qualities such as physical strength, courage and sometimes military engagement. This study explores whether these assumptions hold, by conducting telephone interviews among 617 Queensland men, aged 18 years and above, across all geographical parts of Queensland. This survey was administered in 2013, as part of the Queensland Social Survey series. The study explores the diverse meanings associated with being a ‘real man’ given by the survey participants. Three main dimensions emerged from the thematic analysis: physicality; personality and character; social roles and relationships. The study confirmed that masculinities are dynamic and complex. Responses revealed a surprising emphasis on character and morality 44.5% (n = 684) as defining manhood, as against physical qualities 13.7% (n = 153).

The concept of social inclusion generally is discussed as an ideal to which there is no opposition, and to which policy and practices in society necessarily must be directed. This article discusses how current notions of social inclusion in policy, academic and media discourses are related to historical representations of social disadvantage. It also discusses how social inclusion policies and ideas in Australia accord with cultural values and ideals of egalitarianism, but conflict with the values of non-conformity and anti-authoritarianism celebrated in the national identity. It examines how the media framing of social inclusion is influenced by the received understanding and historic representation of social inclusion, as well as how media representations of non-conformity in Australia are framed by a mythology of Australian journalists and journalism as larrikins and non-conformist. It argues that while media framing of social inclusion frequently reflects and promotes the dominant perspective as constructed by government and academic discourses, Australian media reporting is able at times to provide a positive alternative to the homogenising and bureaucratic view of social inclusion by championing and celebrating non-conformity and anti-authoritarianism.

Abstract:

The digger wasp genus Kohliella Brauns, 1910, a member of the tribe Larrini, subfamily Crabroninae of the family Crabronidae, is a rarely occurring genus comprising only three known species worldwide (Pulawski 1991; 2020). The genus has been recorded from the Ethiopian (South Africa and Zimbabwe; two species) and Oriental (Sri Lanka; one species) regions. Brauns (1910) erected the genus based on the type species Kohliella alaris from South Africa. The genus is characterized by a V-shaped swelling on the frons, an oblong tubercle on the mandible and a petiolate third submarginal cell of the forewing (Bohart & Menke 1976; Pulawski 1991). The nesting habits are known only for Kohliella alaris. Gess and Gess (1980) studied the life history of this species. It preys on nymphal tree cricket Oecanthus filiger Walker, and nests in the ground in flat, sandy areas with sparse vegetation; nests are constructed prior to hunting. In this paper, Kohliella anula Pulawski, 1991, previously known from Sri Lanka only, is recorded for the first time from India.

Abstract:

The effects of devaluations on economies have caused a great deal of concern in recent years. Conventional economists such as Robinson (1947) and Meade (1951) hold the view that due to high unemployment and the absence of any supplyside effects of the exchange rates, devaluation will increase employment if it increases the demand for home goods. A number of papers have been written which serioUsly challenge this result on a number of grounds. For example, Turnovsky (1981) has derived the result that if agents under-predict changes in the exchange rate then output will increase with devaluation. On the other hand, if agents over predict changes in the exchange rate then output will reduce with devaluation. However, economists such as Calvo (1983) and Larrian and Sachs (1986) have supported the standard result by arguing that the stability of the system is sufficient to rule out perverse outcomes of devaluation. Buffie (1986), on the other hand, has derived the result that for stable economies, devaluation mayor may not increase output. However, Buffie shows that if the production function is separable between primary factors and the imported input then devaluation will increase employment. Lai and Chang (1989) have derived the result that currency devaluation has a negative impact on output if workers are free from money illusion. Gylfason and Schmid (1983), report a similar result: if the real wage is assumed to be constant then devaluation contracts the real income.

The Tricostularia Nees ex Lehm. group of genera is reviewed and formally recognised as Cyperaceae tribe Schoeneae subtribe Tricostulariinae R.L.Barrett, K.L.Wilson & J.J.Bruhl. Molecular data from plastid rbcL and trnL–F and nuclear ITS and ETS regions are combined with a novel assessment of morphological characters to support our new classification. Six genera are included: a new genus, Ammothryon R.L.Barrett, K.L.Wilson & J.J.Bruhl, and the named genera Chaetospora R.Br., Morelotia Gaudich., Tetraria P.Beauv., Tricostularia, and Xyroschoenus Larridon. Ammothryon, Chaetospora and Tricostularia are all endemic to southern Australia. Morelotia has one species each in Hawaii, French Polynesia and New Zealand, and three species in southwest Western Australia. Tetraria has a disjunct distribution in Southern Africa, Borneo, New Guinea and New Caledonia. Xyroschoenus is endemic to the Seychelles. Tetrariopsis C.B.Clarke (based on Tetrariopsis octandra (Nees) C.B.Clarke) is included under an expanded concept of Morelotia, which also includes Tetraria australiensis C.B.Clarke and Tetraria microcarpa S.T.Blake from south-west Western Australia. Tricostularia bennettiana R.L.Barrett & K.L.Wilson, Tricostularia davisii R.L.Barrett & K.L.Wilson, Tricostularia lepschii R.L.Barrett & K.L.Wilson, Tricostularia newbeyi R.L.Barrett & K.L.Wilson, and Tricostularia sandifordiana R.L.Barrett & K.L.Wilson are described as new species from south-west Western Australia. The following new combinations are made: Ammothryon grandiflorum (Nees ex Lehm.) R.L.Barrett, K.L.Wilson & J.J.Bruhl, Morelotia australiensis (C.B.Clarke) R.L.Barrett & K.L.Wilson, Morelotia microcarpa (S.T.Blake) R.L.Barrett & K.L.Wilson, Morelotia octandra (Nees) R.L.Barrett & J.J.Bruhl and Tricostularia drummondii (Steud.) R.L.Barrett & K.L.Wilson. Tricostularia drummondii is reinstated from synonymy (formerly Discopodium drummondii Steud.), having previously been confused with T. exsul (C.B.Clarke) K.L.Wilson & R.L.Barrett. Hala ere, ebaluazioa ez da esparru egokia, ez arriskuak aztertzeko, ezta ondorioak eta kontrol-neurriak aztertzeko ere. Erakunde-disfuntzio horiek lanean testuinguru faktiko gisa soilik hartzen den kasu batekin lotuta ageri dira: Kanarietako esplorazio-zundaketak, petroliorik dagoen zehazteko. Gure zuzenbidean 2013/30 zuzentaraua sartzeak disfuntzio horiek gainditzeko aukera emango du. RESUMEN: En este trabajo se analizan las dificultades de encaje del analisis de riesgos de accidentes graves en la evaluacion de impacto ambiental. Esta debe considerar los denominados ≪efectos de aparicion irregular≫, como podrian ser los derivados de un accidente asociado al proyecto correspondiente. Sin embargo, la evaluacion no es el ambito institucional adecuado ni para analizar los riesgos, ni las consecuencias, ni las medidas para su control. Estas disfunciones institucionales se ponen de manifiesto en relacion con un caso, que aqui solo se toma como contexto factico, como es el de los sondeos exploratorios en Canarias para determina la existencia de petroleo. La incorporacion a nuestro Derecho de la Directiva 2013/30 permitira salvar estas disfunciones. ABSTRACT: This work analyzes the difficulties of fitting the risk analysis of serious accidents in the enviromental impact assessment. This has to consider the so called ≪effects of irregular appearance≫, as it could be those derived from an accident related to the corresponding project. Nevertheless, the assessment is not the adequate institutional field nor to analyzing risk nor the consequences, or the measures for its control. These institutional malfunctions are evidenced in a case which is here taken as a factual context as it is the explorations to see if there is petron in the Canary Islands. The transposition in our legal system of Directive 2013/30 will allow to solve those malfunctions.

Hala, estatu soziala, egungo oso gai garrantzitsua, eta haren krisialdia aztertuko ditugu, jabeen, batez ere higiezinen jabeen, kontserbazio-betebeharra bezalako gai zehatz baten bidez. Horretarako, betebehar horren definizio ezberdinek eta erregulazio zehatzak izan dezaketen eragina aztertuko dugu, gure Estatuaren gizarte-eskubide bat lortzeko, etxebizitza duina edukitzeko, aurrerapausoak edo atzerapausoak izan baitaitezke. RESUMEN: Si siempre ha sido fundamental para el Derecho Administrativo el estudio del papel del Estado en la Sociedad, hoy en día nos encontramos ante una etapa de cambio y, fundamentalmente, ante la importantísima crisis del Estado Social en que se hace imprescindible reformular las relaciones entre ambos. Así, a través de un tema tan concreto como es el deber de conservación de los propietarios, especialmente de inmuebles, se tratará una cuestión tan primordial de nuestro tiempo como es el Estado Social y la situación de crisis que el mismo afronta en estos momentos. A tales efectos, se analiza cómo una definición u otra de este deber, así como su regulación concreta, puede incidir en dar un paso hacia delante o hacia atrás en la consecución de la vivienda digna como derecho social integrante de nuestro Estado. ABSTRACT: If the study of State’s role within society has always been fundamental as far as Administrative Law is concerned, nowadays we find ourselves in a changing period and principally, before the so important crisis of the Welfare State, where the relationships between both of them need to be reformulated. Hence, by means of such a specific subject as the duty of preservation by the owners, specially of properties, we deal with a key issue of our times as it is Social State and the crisis situation it faces nowadays. To that end, it is analyzed how one or another definition for this duty together with its specific regulation will have an impact to move forward or backward so as to achieve a dignified housing as a social right which is to be part of our State.
