Trinh Thanh Phong is one of the typical writers of prose in Tuyen Quang. At the age of sixty five, he has not only contributed much good writing such as novels, poems and stories, for Tuyen Quang literature in particular and Vietnamese literature in general, but also has won awards abroad. “Land at Plains of Jars” is a novel which got Dong Duong Award in the Mekong River Literature Prizes. These were the friendship prizes among Vietnam, Laos and Cambodia awarded in Phnom Penh city in 2008. Purpose – This article is a “Q&A interview” conducted by Joanne Pransky of Industrial Robot Journal as a method to impart the combined technological, business and personal experience of a prominent, robotic industry engineer-turned entrepreneur regarding the evolution, commercialization and challenges of bringing a technological invention to market. Design/methodology/approach – The interviewee is Dr Yoky Matsuoka, the Vice President of Nest Labs. Matsuoka describes her career journey that led her from a semi-professional tennis player who wanted to build a robot tennis buddy, to a pioneer of neurobotics who then applied her multidisciplinary research in academia to the development of a mass-produced intelligent home automation device. Findings – Dr Matsuoka received a BS degree from the University of California, Berkeley and an MS and PhD in electrical engineering and computer science from the Massachusetts Institute of Technology (MIT). She was also a Postdoctoral Fellow in the Brain and Cognitive Sciences at MIT and in Mechanical Engineering at Harvard University. Dr Matsuoka was formerly the Torode Family Endowed Career Development Professor of Computer Science and Engineering at the University of Washington (UW), Director of the National Science Foundation Engineering Research Center for Sensorimotor Neural Engineering and Ana Loomis McCandless Professor of Robotics and Mechanical Engineering at Carnegie Mellon University. In 2010, she joined Google X as one of its three founding members. She then joined Nest as VP of Technology. Originality/value – Dr Matsuoka built advanced robotic prosthetic devices and designed complementary rehabilitation strategies that enhanced the mobility of people with manipulation disabilities. Her novel work has made significant scientific and engineering contributions in the combined fields of mechanical engineering, neuroscience, bioengineering, robotics and computer science. Dr Matsuoka was awarded a MacArthur Fellowship in which she used the Genius Award money to establish a nonprofit corporation, YokyWorks, to continue developing engineering solutions for humans with physical disabilities. Other awards include the Emerging Inventor of the Year, UW Medicine; IEEE Robotics and Automation Society Early Academic Career Award; Presidential Early Career Award for Scientists and Engineers; and numerous others. She leads the development of the learning and control technology for the Nest smoke detector and Thermostat, which has saved the USA hundreds of billions of dollars in energy expenses. Nest was sold to Google in 2013 for a record $3.2 billion dollars in cash.

OBJECTIVES/GOALS: Improve infrastructure, resources, partnerships, and metrics to enhance the research environment for Hispanic researchers as a Minority Serving Institution. To support the research infrastructure in our Campus to encourage a research culture of sustainability and productivity. METHODS/STUDY POPULATION: Development of four research capacity-building models to enhance the pathway of junior researchers as independent researchers:1. MSc Phase I-Scholar Award 2 years in a Post Doctoral Master in CTR ; 2. Advanced CTR Award 1 year to support research infrastructure development in submitting a grant to NIH with the mentoring of a Visiting Endowed Chair; 3. Mini Infrastructure Research Award 1 year provides funds to increase research productivity; 4. Award on Excellence in CTR recognizes a faculty member with a distinguished research portfolio that support HiREC Career Coach and Mentoring approach. HiREC targets junior faculty, early and mid-career researchers from our two partners Schools. RESULTS/ANTICIPATED RESULTS: HiREC has been recognize as support for research infrastructure development. Since 2011, 10 MSc Phase I-Scholar Awards have been granted increasing the pool of trained Hispanics researchers in P. R., the Advanced CTR Award of $50,000 each, from March, 2019, was granted to 2 women researchers from the SoM and 2 Visiting Endowed Chair were accepted as candidates. The Mini Infrastructure Research Award, since 2017, supported the development of 2 Science labs, data analysis, 3 peer review publications and other research capacity building. Two researchers from the SoM were honored with the HiREC 2018 Award on Excellence in CTR heighten the institutional recognition of top researchers’ endeavors. DISCUSSION/SIGNIFICANCE OF IMPACT: It’s imperative to pursue specific strategies that lead to successful research capacity-building models. By acknowledging institutional research infrastructure needs, trendy scientific and technological knowledges and researchers’ needs, HiREC have been able to successfully accomplish its mission. Design/methodology/approach – The interviewee is Dr Esben H. Ostergaard, inventor, co-founder and chief technology officer of Universal Robots. From building his first robot to solve a local industrial problem at the age of four, to building the world’s first collaborative robot company, Dr Ostergaard shares his lifelong ventures as a robot scientist, inventor and entrepreneur. Findings – Dr Ostergaard received degrees in computer science, physics and multimedia at Aarhus University in Denmark, and a PhD in robotics from the University of Southern Denmark. While at Aarhus, Dr Ostergaard pursued his hobby of robot football, and in 1998, his team STATIC became the world champion of the Federation of International Robot-soccer Association (FIRA). Dr Ostergaard held research positions at the University of Southern California (USC) Robotics Labs and at the Advanced Industrial Science and Technology (AIST) in Tsukuba/Tokyo. During the years 2001-2005 as a researcher and assistant professor in robotics and user interfaces at University of Southern Denmark, he created the foundation for a reinvention of the industrial robot. This led him to found Universal Robots in 2005 with two of his research colleagues. Originality/value – From a young child who played with LEGOs until he got a Commodore 64, Dr Ostergaard has always been interested in robotics. His unique multidisciplinary education and multicultural research experiences helped him to pioneer a new multi-axis, lightweight industrial robot and launch the successful company, Universal Robots, which has grown from its three co-founders to nearly 150 employees, with more than 4,000 collaborative robot applications installed in over 50 countries worldwide. Dr Ostergaard has over 30 patents and has received many awards, including the 2012 IEEE-IFR Invention and Entrepreneurship Award (IERA), the 2013 Japanese Institute Good Design Award, the 2013 Robotics Business Review Game Changer Award and the Ernst & Young Entrepreneur of the Year 2012 in Region Funen.

Abstract Laos is no stranger to international investment arbitration. Despite its status as one of Southeast Asia’s least developed countries, it has had an Investment Law for more than two decades and is also a party to several bilateral and Association of South East Asian Nations (ASEAN)-related investment agreements. More recently, two investment treaty claims have been made against it, one of which has given rise to an award challenge that went all the way to Singapore’s highest court. This article will examine the history, evolution and current iteration of Laos’ relationship with international investment law and focus on the two investment treaty claims instituted against Laos. The article concludes with an appraisal of Laos’ need to maintain its investment treaty programme, despite the difficulties that may have arisen as a result of it being a respondent in investment treaty arbitrations.

This article surveys the enforcement of arbitration awards in five Southeast Asian nations: Vietnam, Laos, Cambodia, Thailand, and Myanmar. Each has large and urgent needs for foreign investment but each presents a legal system with a less than spotless record for effective and transparent investment protection. The article reviews current laws and the extent to which practice follows the law. In light of the conclusion that law and practice are often not aligned across the region, it concludes with a short discussion of the implications and possible alternatives for those affected.

Abstract:
This study is concerned with the recognition and enforcement of foreign arbitral awards under the relevant regimes in the GCC states, both local law and international conventions. The easy enforceability of arbitral awards is considered one of the main factors in the success of international commercial arbitration. Thus this thesis not only attempts a comprehensive analysis of the requirements of and procedures for recognition and enforcement of foreign awards in the GCC States, but also evaluates whether the GCC’s laws and practices comply with best international practice standards, especially as embodied in the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. The thesis comprises of seven chapters. The first chapter examines the legal framework of the GCC States, and provides a brief history of the rules governing arbitration and the recognition and enforcement of foreign arbitral awards. Chapter two looks at general principles regarding recognition and enforcement of foreign arbitral awards. Chapter three covers jurisdictional elements in the recognition and enforcement of arbitral awards in the GCC States. Chapter four examines the procedural steps demanded by each state for the enforcement of an award, looking particularly at the impact of relevant international conventions on these issues. Chapter five deals with the evidence which must be tendered and the conditions that must be satisfied in order to obtain the recognition and enforcement of foreign arbitral awards in the GCC States. Chapter six examines the grounds on which a respondent may apply to dismiss an application for recognition and enforcement of a foreign arbitral award. Chapter seven then deals with the grounds on which a foreign arbitral award must be refused enforcement. The concluding chapter summarises the problems thrown up by the study, and suggests a common way forward for the legal systems of the states of the Arabian Gulf in dealing with these issues.

Arbitration is the preferred method of dispute resolution in international trade. Naturally, a set of rules is necessary to govern the conflict&rsquo<br>s resolution. For cultural, political, economical or other reasons the parties&rsquo<br>national laws may not serve the individual interests and needs of that particular contract well. If one wants to avoid the application of both parties&rsquo<br>national laws, one can choose that the contract be governed by an a-national legal standard, e.g. general principles of International Trade Law or the general usages of a particular trade. These internationally accepted principles of law governing contractual relations are called lex mercatoria (law merchant).<br /> <br /> Lex mercatoria already existed in the Middle Ages and can even be dated back to antiquity. Later it disappeared through the nationalization of International Trade Law and was rediscovered in the 1950s, when international traders were again creating their own law and disputes were increasingly resolved outside of the national jurisdictions and applying a-national law. Lex mercatoria is being applied more and more by arbitrators and is therefore becoming increasingly important for dispute resolution in International Trade. Numerous different concepts and theories of lex mercatoria have been developed. Its being an autonomous legal system is questioned by some authors and the doctrine in favour of it called unfounded. The critics also argue that the authority to apply lex mercatoria may be a recipe for amateurism and the substitution of the arbitrator&rsquo<br>s private preferences for the parties&rsquo<br>intentions, for itis easy to proclaim common principles on the basis of limited knowledge. The lex mercatoria is said only to exist because scholars talk about it. However, these and other allegations can be refuted by critically analyzing the arguments that are supposed to underline those assumptions. Applying lex mercatoria to solve international trade disputes has many advantages. By choosing lex mercatoria the parties avoid rules which are unfit for international contracts, e.g. peculiar formalities, brief cut-off periods and special difficulties created by domestic laws. In addition to that, neither of the parties has the advantage of having the dispute governed by his own law. Since one of the central rules is the principle of good faith and fair dealing, lex mercatoria neither leads to arbitrary results nor does it favour the rich. Is it possible for the arbitrators to apply lex mercatoria if no law has been chosen by the parties? The failure of the parties to indicate a choice could well mean that they did not wish to have their contract governed by any of their national laws. In some awards arbitrators applied lex mercatoria as they considered the community of international merchants to be autonomous and to exist beyond national legislation. However, it cannot be deduced from the absence of such a choice that the parties have impliedly chosen lex mercatoria to be the law governing the conflict. Lex mercatoria is applicable only as a subsidiary law in cases where no national law has been chosen and seems apt.

Abstract:
<p> A deficit orientation of English Language Leamer (ELL) Latino students permeates the climate at many schools across the state of California. School efforts to address the academic needs of ELL students emphasize disadvantages, and focus primarily on language remediation approaches. In turn, ELL students are submerged into a substandard curriculum that fails to capitalize on, and denies students access to, their cultural and linguistic strengths. In the Los Angeles schools, only 27% of EL students who began the ninth grade were eligible to graduate four years later. Latino ELL students are significantly academically challenged and struggle to meet high school graduation requirements; these students, by default, are not prepared for college. Reversing the desolate academic trajectories of Latino ELL students by validating and promoting their strengths as a foundation for learning was the impetus for this study. </p><p> This study documents student and staff perceptions of the implementation of the Los Angeles Unified School District (LAUSD) Seal ofBiliteracy Awards Program at one high school with a predominantly Latino student population. Guided by a conceptual framework utilizing the concepts of empowerment of minority students, community cultural wealth, funds of knowledge, and subtractive schooling, this qualitative case study examined the narratives of Latino ELL students and staff participants to gain an understanding oftheir perceptions about college access, the process of implementing the LAUSD Seal ofBiliteracy Awards program, and the purpose, value, and impact of the program on student achievement. The study included focus group interviews with 26 high school student participants, primarily female and mostly in the 12th grade, and individual interviews with six staff participants in various capacities with an educational experience ranging from five to 15 years. </p><p> The findings indicate that the LAUSD Seal ofBiliteracy Awards Program is active at the research site and is producing positive student social and academic impacts. School level impacts include an improved academic school climate and increased parent presence at school functions. In order to shift practice towards an "assets" schooling orientation, recommendations of this study call for a change in policy, converting a voluntary program into a mandatory program. Recommendations of this study urge educators to change current practices to ethically address the issue of evaluation of "transcripts" from foreign countries and to work with teachers to build capacity for additive schooling approaches. Furthermore, recommendations for practice suggest schools must provide all students equitable access to college information by establishing a college and career readiness pathways course that is also a graduation requirement. </p>

AbstractThe doctrine of state immunity occupies a fundamental place in international law. The application of the doctrine, largely left to the national laws of states, is not consistent. One particular area of inconsistency is the treatment of the plea of state immunity from execution of arbitral awards resulting from investor-state disputes. The issue of state immunity from execution has come to the fore in light of a number of recent attempts by award-creditors to attach their awards against the assets of a foreign state located in jurisdictions considered to be “pro-enforcement”, such as France and Belgium. This chapter considers the plea of state immunity and the execution of investment arbitration awards from the perspective of the forum state. In particular, it addresses the introduction of procedural and substantive amendments to French and Belgian laws on state immunity following these attempts by award-creditors to seize foreign state assets located in their respective jurisdictions. The chapter posits a way forward for investors seeking to navigate the landscape governing state immunity from execution.

Compared to those in international commercial and investment arbitration, arbitrator-challenge practi-ces in inter-state cases are abnormally rare. The reasons behind the asymmetric practices include the ideology towards the role of arbitrators (authority vs. expertise), the effectiveness of enforcement (whether the award can be executed in domestic courts or whether there exist preconditions), and the unique structure and function of the specific tribunals. By virtue of illustrating the rules and practi-ces of the ad hoc tribunal established under Annex VII of the United States Convention on the Law of the Sea, the Iran-United States Claims Tribunal, and the International Court of Justice, the current standard, “justifiable doubts to the impartiality and independence of arbitrators”, is not interpreted uniformly and somehow unreasonable. To overcome the phenomenon of fragmentation and other problems, the arbitrator-challenge rules in inter-state disputes should not be treated differently and should be harmonized with rules and case laws developed in international commercial and investment arbitration.

Abstract:
How did the Fulbright program evolve in relation to the challenge of racial diversity? For the first several decades of the Fulbright program Australia had a mass immigration program and a White Australia policy of racial exclusion. This influenced the fields of research in which Fulbright awards were made. Aboriginal Australians were the objects of research by visiting American scholars but did not themselves begin to win awards until the 1970s. In the mid-1960s many of those who were leading the call for change in immigration laws were Fulbright scholars. Australians travelling to the US on educational exchange observed racial segregation and some became politically active and influenced movements on behalf of Aboriginal people. The first recipient of the Distinguished Visitor Award under the Fulbright program was African-American historian John Hope Franklin. A special category of award for Aboriginal Australians was initiated in 1992.

In 2014, reports suggested that a surge of foreign jihadists were participating in armed conflicts in Syria, Iraq, and elsewhere. The United Nations Security Council responded by imposing in Resolution 2178 (2014) an array of obligations on member states to counter the threat posed by “foreign terrorist fighters” (FTFs). In the intervening year, those states have taken a range of actions — though at various speeds and with varying levels of commitment — to implement the FTF obligations imposed by the Council. Meanwhile, many states continue to fund and otherwise throw their support behind life-saving humanitarian relief for civilians in armed conflicts around the world — including conflicts involving terrorists. Yet, in recent years, members of the humanitarian community have been increasingly aware of the real, perceived, and potential impacts of counterterrorism laws on humanitarian action. Part of their interest stems from the fact that certain counterterrorism laws may, intentionally or unintentionally, adversely affect principled humanitarian action, especially in regions where terrorist groups control territory (and thus access to civilians, too). The effects of these laws may be widespread — ranging from heightened due diligence requirements on humanitarian organizations to restrictions on travel, from greater government scrutiny of national and regional staff of humanitarian organizations to decreased access to financial services and funding. Against that backdrop, this briefing report has two aims: first, to provide a primer on the most salient issues at the intersection of counterterrorism measures and humanitarian aid and assistance, with a focus on the ascendant FTF framing. And second, to put forward, for critical feedback and assessment, a provisional methodology for evaluating the following question: is it feasible to subject two key contemporary wartime concerns — the fight against FTFs and supporting humanitarian aid and assistance for civilians in terrorist-controlled territories — to meaningful empirical analysis?

Abstract:
Objectives: The Israeli work plan regarding HBTM included: (a) producing a better diagnostic method; (b) following infestations during the season and evaluating damage to resistant bees and, (c) controlling HBTM by conventional means under local conditions. For varroa our plans to try novel control (e.g. oil novel control (e.g. oil patties &amp; essential oils) were initially delayed by very low pest populations, then disrupted by the emergence of fluvalinate resistance. We monitored the spread of resistance to understand it better, and analyzed an underlying biochemical resistance mechanism in varroa. The US work plan focused on novel management methods for both mites with an emphasis on reducing use of traditional insecticides due to resistance and contamination issues. Objectives were: (a) evaluating plant essential oils for varroa control; (b) exploring the vulnerability of varroa to desiccation for their management; and (c) looking for biological variation in HBTM that could explain virulence variability between colonies. Although the initial PI at the USDA Beltsville Bee Lab, W.A. Bruce, retired during the project we made significant strides especially on varroa water balance. Subcontracts were performed by Yoder (Illinois College) on varroa water balance and DeGrandi-Hoffman (USDA) who evaluated plant essential oils for their potential to control varroa. We devised an IPM strategy for mite control i the U.S. Background: Mites that parasitize honey bees are a global problem. They are threatening the survival of managed and feral bees, the well-being of commercial/hobby beekeeping, and due to pollination, the future of some agricultural commodities is threatened. Specific economic consequences of these mites are that: (a) apiculture/breeder business are failing; (b) fewer colonies exist; (c) demand and cost for hive leasing are growing; (d) incidences of bee pathogens are increasing; and, (e) there are ore problems with commercial-reared bees. As a reflection of the continued significance f bee mites, a mite book is now in press (Webster &amp; delaplane, 2000); and the 2nd International Conference on Africanized Honey Bees and Bee Mites is scheduled (April, 2000, Arizona). The first such conference was at OSU (1987, GRN was co-organizer). The major challenge is controlling two very different mites within a colony while not adversely impacting the hive. Colony management practices vary, as do the laws dictating acaricide use. Our basic postulates were that: (a) both mites are of economic importance with moderate to high infestations but not at low rates and, (b) once established they will not be eradicated. A novel strategy was devised that deals with the pests concomitantly by maintaining populations at low levels, without unnecessary recourse to synthetic acaricides. Major Conclusions, Solutions, Achievements: A major recent revelation is that there are several species of "Varroa jacobsoni" (Anderson &amp; Trueman 1999). Work on control, resistance, population dynamics, and virulence awaits knowing whether this is a problem. In the U.S. there was no difference between varroa from three locales in terms of water balance parameters (AZ, MN &amp; PA), which bodes well for our work to date. Winter varroa (U.S.) were more prone to desiccation than during other seasons. Varroa sensitivity to desiccation has important implications for improving IPM. Several botanicals showed some promise for varroa control (thymol &amp; origanum). Unfortunately there is varroa resistance to Apistan in Israel but a resistance mechanism was detected for the first time. The Israel team also has a new method for HBTM diagnosis. Annual tracheal mite population trends in Israel were characterized, which will help in targeting treatment. Effects of HBTM on honey yields were shown. HBTM control by Amitraz was demonstrated for at least 6 months. Showing partial resistance by Buckfast bees to HBTM will be an important IPM tactic in Israel and U.S.
