Abstract:
Changes to the regulation of consumer leases for people on welfare who use Centrepay deductions to make lease payments for household goods, are part of the federal government’s response to a 2016 review of small amount credit contract laws. The review and response do not propose expanding availability of no-interest loans as an alternative to small amount credit contract finance. In 2015, a Bill proposing to exclude consumer leases from Centrepay failed to pass, with opponents objecting to the Bill as paternalistic. Restrictions on consumer spending imposed since 2007 by income management legislation, however, have been supported as necessary paternalism. These conflicting approaches to the protection of people receiving social security benefits from self-harming consumer choices constitute selective paternalism, while failing to deliver financial autonomy and inclusion.

Abstract:
The purpose of this paper is to determine to what extent should a lease of movable property fall within the ambits of the National Credit Act. The paper analyses the courts decisions regarding leases of movable properties, and further adds value to the existing scholarship. Courts are not ready to entertain extrinsic evidence in the cases where it contradicts the terms of an agreement. Parties should make sure that their contractual provisions are clear and unambiguous. Such provisions depict the notion that a lease of a movable property should fall within the ambits of the National Credit Act, hereinafter called NCA. And in such circumstances that qualifies it in terms of the Act ought to be met. In terms of section 8(4) of the NCA, a lease of movable property should by no means exclude the provision that ownership will pass to the lessee upon payment of the final rental instalment. Alternatively upon meeting certain conditions as determined by parties. One should therefore be able to differentiate leases in terms of the NCA and leases as defined by common law. Thus, one cannot try to qualify common law leases within the context of section 8(4) of the NCA where the original intention was an ordinary common law lease agreement. The Court in the case of ABSA Technology v Michael`s Bid House concluded that the NCA was not applicable to leases of movable property in certain circumstances. It is the findings of this paper that courts, recognize lease of movable property.

Abstract:
Purpose – This paper aims to report on research that investigates the use of green clauses in leases of office and retail premises in England and Wales. Design/methodology/approach – The authors examined 26 recent leases of green build properties registered at HM Land Registry. The green clauses discovered were classified and compared with the model form green clauses promoted by the London-based Better Building Partnership's Green Lease Toolkit. Findings – Of the 26 leases analysed, 18 contained some form of green provision. Research limitations/implications – As the sample selected was not representative, a larger study is needed to detect trends in green leasing. This research method does not show the impact of green clauses on property management. Practical implications – This research illustrates the types of clauses that have been used in leases but also shows that green leasing principles are not yet the industry standard. Many new, long leases still make no reference to environmental practices. Originality/value – This is the first research to be done examining the green content of agreed leases and develops a methodology that can be used for future research.

The freehold oil and gas lease in Canada has had a perilous and uncertain existence. In the early cases, the courts applied a literal interpretation of the leases, resulting in numerous unexpectedly terminated leases. In recent years, there has been a resurgence of cases involving terminated leases. Modern case law recognizes that the failure of a lease can create liabilities in both tort and restitution, but courts have faced difficulties in dealing with the overlapping compensatory and restitutionary remedies. The modern case law has been heavily criticized, but the authors argue that there is a smaller difference between the overlapping remedies than is commonly supposed when the underlying purpose of restitutionary remedies is examined, and they propose a resolution to the problem of overlapping remedies.

This article seeks to show why, historically, the lease/tenancy were viewed as being peripheral to the scheme of land law, not perceived as part of ‘real property It suggests that the continued classification today of leases/tenancies as personalty reflects an uncritical perpetuation of this perception, a failure to reappraise their legal status and function in the context of today law and social relations concerned with land. More generally, it touches on a possible need to reappraise many of the underlying, historically derived schemata and structures of today's property law. Finally, as the offer of a small step in the reappraisal of the place of lease/tenancies, it argues that today, in law, they can and should properly be classified (together with freeholds) as part of real property.

As is well known among both my students and colleagues, my professional life as a lawyer (and later as a law professor) took a monumental turn in 1999 when I reviewed and drafted my first wind lease in Nolan County, Texas. That lease, as well as all of the other wind leases at the time, contained contractional “clean up and restoration” clauses similar to many oil and gas leases then in use. Simply put, the leases provided that upon expiration or termination of the lease (which for a wind lease, unlike an oil and gas lease, might be fifty or more years in the future), the lessee would remove its equipment and restore the surface “to as near as reasonably possible to its original condition” prior to the lease.

Abstract:
This thesis explores the arguments and evidence for reform of commercial property leases through legislative intervention. It identifies and explains the causes of landlord and tenant disputes arising mainly from poorly drafted commercial leases. It investigates the relevant codes for leasing business premises, the Law Society business lease, the regulatory reform of part II of the 1954 Act, the British Property Federation lease, and various other attempts at reform of commercial property leases. This research also investigates the potential need for ethnic minorities in commercial property to have the key legal terms of commercial property leases made available in both English and other languages. There is little previous academic research on reform of commercial property leases through legislative intervention (other than Crosby Reading reports). This research aims to contributute towards filling the gap that exists in the literature by investigating reform through legislation. This research involved semi-structured interviews with participants from five groups: lawyers, surveyors/agents, landlords, tenants and business owners. Most interviewed supported reform of commercial property leases through legislative intervention, and better guidance explaining the meaning of key legal terms of commercial property leases, especially from ethnic minority businesses.

Chapter 11 of the Property Agents and Motor Dealers Act 2000 (Qld) and the Retail Shop Leases Act 1994 (Qld) both introduce procedural requirements to the process for creation of land contracts and were both introduced to address a perceived lack of conscience in each of the industries affected. These represent a recent broadening of the ambit of consumer protection legislation in Queensland which deviates from more traditional methods of statutory intervention into land contracts. This paper focuses on the extent to which the Acts effectively introducing a conscience element into certain land contracts, and the extent to which this alters classical contract law. The effectiveness of the approach is then tested against the critiques of two alternative theories of law - law and economics and feminist contract theory - to see whether the legislative approach answers the deficiencies in contract identified within the terms of each theory.

This thesis is about the right of superficies, with regard to France, Italy and, in broad outlines, Belgium and the Common Law system. Paying special attention to the law in action, a comparative, functionalistic approach is adopted. The argumentative route of the thesis follows several main paths, closely linked:- The historical dimension of the right of superficies, as a key to understanding the similarities and the differences between the legal orders taken into account.- The comparative dimension of the right of superficies, highlighting the fact that it is quite an unitary legal institution in Italy, while in France (in the absence of a precise legal regulation) this institution, developing directly very close to the practice of the stakeholders, is fragmented in several legal tools conceived to meet specific needs.- The socio-economic dimension of the right of superficies, as an analysis of the concrete needs of the stakeholders.- The theoretical and conceptual dimension of the right of superficies, highlighting its characteristic of a dynamical, flexible and problematic element of the Civil Law system of property. - The dimension of the right of superficies as a possible connection between the traditions of Civil Law and Common Law, due to its capacity to call into question the closed attitude of continental property models, bringing out their latent structures coming from the past, before the age of codifications. - The socio-political dimension of the right of superficies, as a tool that may propagate an approach based on social solidarity in the field of property law, as enshrined in the Italian Constitution

Följande rapport kommer redogöra för den hyresrättsliga aspekten på det nya fenomenet co-working.Undersökningen genomförs genom att granska ett antal avtal som används av aktörer på marknaden i Stockholm.Co-working tar sin början i San Fransisco 2005 och har sedan dess vuxit explosionsartat. Konceptet går ut på attupplåta flexibla arbetsplatser i olika former och detta väcker frågeställningen huruvida hyresavtal föreligger. Det ansesföreligga i de fall samtliga rekvisit i 12 kap 1 § JB är uppfyllda. Särskilt intressant är rekvisiten ”hus eller del av hus”och ”upplåts till nyttjande”. Detta p.g.a. att objektet för upplåtelse inte är byggnadstekniskt avskilt och att utrymmet ivissa fall delas med flera andra. Inom ramen för rapporten har fyra olika medlemskapstyper definierats ochundersökningen visar att några av dessa kan anses utgöra hyresavtal, detta innebär att hyreslagens regler ska tillämpaspå medlemskapen. Hyreslagens syfte är att verka som skyddslagstiftning och av vikt blir därför hyresgästernas skydd.Undersökningen har haft särskilt fokus på reglerna om uppsägningstider och indirekt besittningsskydd då dessasannolikt har störst ekonomisk påverkan för inblandade parter. Undersökningen har visat att avtalen som skrivs innehåller flera brister både vad gäller uppsägningstider och indirektbesittningsskydd. Dagens lagstiftning har visat sig flexibel nog att tillämpa på dessa flexibla arbetsplatser. För attaktörerna ska kunna åstadkomma den avsedda flexibiliteten behöver avtalen skrivas om. Ett förslag är att aktörernaskriver avtalen på bestämd tid vilket ger dem möjlighet att tillämpa kortare uppsägningstider. Vidare kan aktörernaavtala bort det indirekta besittningsskyddet genom att inhämta godkännande från hyresnämnden. På detta sätt kanaktörerna fortsätta bedriva verksamheten i enlighet med gällande lagstiftning samtidigt som användarna får tillgångtill lättillgängliga och flexibla hyresavtal för kontorsplatser.
The following thesis will describe the legal aspects of the new phenomena co-working. The study will beimplemented by reviewing a selected number of contracts that are used by actors on the market for co-working inStockholm. Co-working took its form 2005 in San Francisco and has grown rapidly since. The concept is aboutletting flexible workspaces in different shapes and this raises the question if the contracts are to be seen as leaseagreements. This considers be to hand when all four requisites in 12 chapter 1 § JB is fulfilled. Requisites that areespecially interesting is “house or part of house” and “exclusive right to use”. This due to that the object for leasingis not technically separated and that it is sometimes shared by others. In this thesis four different types ofmembership are identified, and the study shows that some of these are to be considered as lease agreements. Thismeans that the memberships have to follow the rental laws (12 chapter JB). The purpose of the rental law is toprotect the tenant that is to be seen as the weaker part. The study has focused on the rules about notification periodsand indirect protection of possession because this could have a large economic impact for the parties involved.The study has shown that the contracts that are used contains several flaws both regarding notification periods andindirect protection of possession. Current legalization has shown to be flexible enough to be applied on these flexibleworkspaces. For the actors to be able to reach the intended flexibility the contracts need to be rewritten. Onesuggestion is that the actors writes the contracts for a designated time that will allow them to use shorter notificationperiods. The actors are also able to create contracts that doesn’t contain indirect protection of possession byobtaining approval from Hyresnämnden. By doing this, the actors are able to operate in accordance with currentlegalization as well as the users are able to have accessible and flexible workspaces.

Abstract:

This qualitative research study (Merriam & Tisdell, 2016) informed by an a priori theoretical framework gathered perspectives of female law enforcement leaders on their experiences leading in hegemonic masculine police cultures (Archbold & Schulz, 2012; Morash & Haarr, 2012; Rabe-Hemp, 2009) to better understand how female law enforcement leaders described the construction of their social identities (Morash & Haarr, 2012; Rabe-Hemp, 2009; Tajfel & Turner, 1979) and the influences on their self-efficacy (Bandura, 1977, 1986, 1997). The two areas of focus for the study within the law enforcement leaders’ experiences included understanding how the women thought of themselves and others as a group and what experiences influenced their confidence to lead. The study was guided by two research questions: How do female law enforcement leaders describe their social identities? and What experiences shape the formation and evolution of self-efficacy of female law enforcement leaders? There were two subquestions: How, if at all, is gender a factor in the female law enforcement leaders’ social identity constructions? and How do the reported experiences described by the female law enforcement leaders inform the four information sources for self-efficacy theorized by Bandura (1977)?

This study provided in-depth descriptive data about the social identity constructions and self-efficacy evolution of 16 female law enforcement leaders. General findings from the study indicated women’s social identities (Tajfel & Turner, 1979) are constructed within and outside of the law enforcement community with a strong identification with groups outside of law enforcement and influenced by gender. Further findings from the study indicated that a myriad of experiences and interactions influence leader self-efficacy (Archbold & Schulz, 2012; Bandura, 1977, 1986, 1997; Rabe-Hemp, 2009; West & Zimmerman, 1987) that are generally aligned with Bandura’s (1977, 1986, 1997) self-efficacy theory, with one noteworthy exception and one emergent influence.

The diploma thesis discusses the issues of help mainly by the United States under the Lend- Lease Act during the Second World War. The theoretical part deals with the historical context and the economic s and political framework of the rise of the programme with an emphasis on the USA. The following part is focused on the quantification of the whole extent. A great part of the thesis is devoted to the issues of help by the Soviet Union. The emphasis is placed not only on the content, but mainly on the logistic issues. Following the historical context there are also four major transportation corridors discussed and their occupancy at the time, material flow and mode of transport are analysed.

Section 388 of the Energy Policy Act of 2005 (EPAct) amended the Outer Continental Shelf Lands Act (OCSLA) to grant the U.S. Department of the Interior (USDOI) discretionary authority to issue leases, easements, or rights-of-way for activities on the Outer Continental Shelf (OCS) that produce or support production, transportation, or transmission of energy from sources other than oil and gas, except for where activities are already otherwise authorized in other applicable law (e.g., the Deepwater Port Act of 1974 (33 U.S.C. 1501 et seq.), the Ocean Thermal Energy Conversion Act of 1980 (42 U.S.C. 9101 et seq.)) [1]. This authority was delegated to the Minerals Management Service (MMS), which was charged with developing regulations intended to encourage orderly, safe, and environmentally responsible development of alternative energy resources and alternate use of facilities on the OCS. MMS published its Alternative Energy/Alternate Use proposed rule in the Federal Register in July 2008 for public comment and held a series of public workshops to discuss the proposed regulations. The final regulations were submitted to the U.S. Office of Management and Budget (USOMB) on November 3, 2008 for clearance. In advance of final regulations, MMS announced an interim policy in November 2007 to authorize offshore data collection and technology testing activities in Federal waters. This measure was designed to allow developers to jumpstart data collection activities in support of potential future alternative energy development once regulations are in place. MMS has worked very closely with its State and Federal counterparts in implementing the interim policy, which has progressed most expeditiously on the Atlantic Coast. The interim policy is in effect until the MMS promulgates final rules. Beyond the MMS leasing process, several other Federal entities are involved in the permitting and licensing of alternative energy in the offshore environment, including the U.S. Army Corps of Engineers (USACE), the U.S. Coast Guard (USCG), and the Federal Aviation Administration (USFAA), among others. This paper will discuss the history of MMS’ program and policy development for offshore alternative energy activities; the steps taken to arrive at final regulations; as well as note the other regulatory bodies involved in the authorization of these activities in U.S. Federal waters.

Abstract Repeated weld joints leaks were observed in newly commissioned non insulated low temperature carbon steel anhydrous ammonia pipes after few months of operations. A detailed investigation was carried out to identify the root cause which found to be usage of high strength filler wire which leads to stress corrosion cracking (SCC) and weld joints failure. Also, An Online advance inspection via Phased Array Ultrasonic Test (PAUT) was conducted to assess the condition of weld joints in anhydrous ammonia pipe loops. Moreover, three different samples of leaked weld joints were submitted for metallurgical failure analysis laboratory. The paper explains the root cause of the damage, Online PAUT inspection and the challenges faced during development of the rectification procedure and implementation.

We explored some of the questions posed by digitalisation in an accompanying working paper focused on constitutional theory: Digitalisation, the ‘Fourth Industrial Revolution’ and the Constitutional Law of Privacy in South Africa. In that paper, we asked what legal resources are available in the South African legal system to respond to the risk and benefits posed by digitalisation. We argued that this question would be best answered by developing what we have termed a 'South African public law perspective'. In our view, while any particular legal system may often lag behind, the law constitutes an adaptive resource that can and should respond to disruptive technological change by re-examining existing concepts and creating new, more adequate conceptions. Our public law perspective reframes privacy law as both a private and a public good essential to the functioning of a constitutional democracy in the era of digitalisation. In this working paper, we take the analysis one practical step further: we use our public law perspective on digitalisation in the South African health sector. We do so because this sector is significant in its own right – public health is necessary for a healthy society – and also to further explore how and to what extent the South African constitutional framework provides resources at least roughly adequate for the challenges posed by the current 'digitalisation plus' era. The theoretical perspective we have developed is certainly relevant to digitalisation’s impact in the health sector. The social, economic and political progress that took place in the 20th century was strongly correlated with technological change of the first three industrial revolutions. The technological innovations associated with what many are terming ‘the fourth industrial revolution’ are also of undoubted utility in the form of new possibilities for enhanced productivity, business formation and wealth creation, as well as the enhanced efficacy of public action to address basic needs such as education and public health.

When an inmate leaves prison following a sentence for terrorism offenses, their reintegration will depend on whether they can function as a relatively social member of their community. Obstacles such as stigmatization exist for all former convicts, but among steadfast extremists these barriers will be mutual, if they continue to perceive the ingroup-outgroup dichotomy that fed their extremism in the first place. A simple but effective means for determining the likelihood that returning prisoners will act prosocially towards the ‘other’ could be the use of so-called lab-in-field games, which provide small incentives to learn how individuals behave in a given situation, rather than just eliciting their sentiment. This chapter outlines the potential for such an approach. It draws on field research conducted in Indonesia in 2018, which involved interviews with 28 former convicted terrorists, regarding their practical experiences with reintegration and interactions in the community.

This policy brief reports findings from a survey of parent leaders in 2007 that sought to understand what parents of English Learners and Standard English Learners think about the education of their children and about parent education and involvement in the Los Angeles Unified School District (LAUSD). Surveys with 513 LAUSD parent leaders revealed low ratings for LAUSD’s parent education efforts as well as for student academic programs. Open-ended responses point both to educational as well as policy recommendations in the following areas: 1) home/school collaboration; 2) professional development, curriculum and Instruction, and tutors/support; and 3) accountability. This policy brief concludes that improvement in the educational experiences and outcomes for Standard English Learners and English Learners can happen by capitalizing on existing parent leadership.
