Abstract:
A limited and simplified discovery system should broaden access to courts, resolve disputes quickly, and expedite relief to injured parties. It should not incentivize procedural gamesmanship or increase the system’s complexity. Regrettably, Illinois’s “limited and simplified” discovery system does both. The initiation procedure for the simplified system, Rule 222(b), creates procedural traps and perverse incentives for both plaintiffs and defendants, and conflicting appellate interpretations of the Rule intensify the problem. This Note examines the flaws underlying the current simplified discovery scheme and argues for reform. It examines simplified discovery schemes in other states to recommend a new system for initiating and exiting limited and simplified discovery in Illinois. It also identifies lessons that other states can take from Illinois to improve their own discovery procedures. The proposed reforms would improve cost savings by broadening the Illinois scheme’s applicability and increase transparency and fairness for all litigants.

Abstract:
Endowment insurance provides protection benefit and saving benefits. In the endowment insurance the insured party (insurance participant) must be paid the premiums. In addition to premiums, there is also policy value, which is sum of money that must be collected by the company in preparation for claim payment. The purpose of this study was to determine calculation of policy value in endowment insurance using Illinois method based on Weibull Mortality Law. In this study used secondary data from United States Life Table in the form of mortality probability data. Calculation value using Weibull mortality law, then the policy value calculated by Illinois method. The result of this study is policy value using Illinois Method based on Weibull Mortality Law is bigger than policy value using Illinois method without Weibull mortality law in the first year until year 20th. After year 20th, the policy value using Illinois method based on Weibull mortality law is smaller than policy value using Illinois method without Weibull mortality law, while at the end of the insurance year which is year 30th, the policy value with or without Weibull mortality law generates the same value.

Two months after a mob in Alton, Illinois, killed abolitionist editor Elijah Lovejoy and destroyed his fourth press, a jury acquitted several assailants accused of rioting. By the time that the trials commenced in January 1838, the defenses had all been publicly aired; indeed, they had been rehearsed in print and at well-attended meetings long before the attack occurred. The mob's leaders had taken special care over several months to lay a legal foundation for their action; most notably, the Illinois attorney general led the pre-attack rhetorical justification and the post-attack courtroom defense. In the end, the jury found that resorting to forcible measures in such circumstances did not clearly fall outside the law.

ObjectiveAs part of the Smoke-Free Illinois Act, smoking on the gambling floors of all commercial casinos in Illinois became prohibited. This study examined the effects of the Smoke-Free Illinois Act on casino admissions per-capita and real per-capita adjusted gross receipts using 18 years of data (10 years before and 8 years after the Illinois law went into effect).MethodsWe employed a difference-in-difference regression technique using monthly data for the states of Illinois, Indiana, Iowa and Missouri and control for numerous determinants expected to affect casino admissions and revenue.ResultsThe Smoke-free Illinois Act was found not to be a statistically significant determinant of per-capita casino admissions and of real per-capita gross adjusted receipts in all the models we estimated.ConclusionsThe estimates from this study clearly indicated that the Illinois law that banned smoking in casinos has had no significant negative economic consequences for casinos in terms of per-capita admissions or revenues.

The question that this paper answer is whether the Illinois Reporter’s Privilege should protect an online blogger. The definitions of the terms “reporter,” “news medium,” and “source” quoted from 735 ILCS 5/8-902, followed by several examples. Second, a brief history of journalism is presented, where it is demonstrated that for hundreds of years, journalists and publishers alike engaged in their profession with little formal training, but rather with a sincere desire to convey the facts and the truth to their peers. Second, the essay outlines how Illinois and federal courts have employed the privilege in case law. In answering the question, the work examines whether WikiLeaks qualifies under the Illinois Reporter’s Privilege. The position taken is that the answer is yes. The idea is that if WikiLeaks qualifies under the privilege, then other online blogs also qualify. The opinion of the author is that the law is sufficient as it stands. There is no need to change its wording. Finally, some loose ends are discussed before reiterating the conclusion that the Illinois Reporters’ should not be changed.

Purpose Discusses the significance of the Illinois Supreme Court ruling in Van Dyke v. White, which clarified that annuities are not securities in the state of Illinois, with a particular focus on the ramifications to insurance, brokerage and investment advisory standards of care as well as causes of action for breaches thereof. Design/methodology/approach Describes the Court’s ruling as it relates to the industry going forward. Does not discuss the specifics of the plaintiff’s case or history. Findings The statutory language of Illinois’ securities laws specifically excludes annuities from the definition of securities. For this reason, the Illinois Department of Insurance has sole authority over regulating annuities, giving the Illinois Department of Securities no authority, except to the extent there is an investment advisor breach pursuant to §12(J) of the Illinois Securities Law of 1953. The industry has yet to react or adjust to the Court’s ruling, so there may be a future wave of reactions. Originality/value Assists the reader in understanding the unique regulatory environment of annuities in Illinois, the relevant standards of care related to annuity advice and transactions, and remedies for grievances after the Illinois Supreme Court ruling in Van Dyke v. White.

In addition to legislative reform, Illinois oil and gas law has been further defined by two cases decided in the past year: Tri-Power Resources, Inc. v. City of Carlyle, which allows "non-home-rule unit" municipalities to prevent oil and gas drilling through zoning ordinances, and Nye v. Leavell, which confirms Illinois' position on what constitutes "production" under a lease. The Tri-Power Resources decision leaves the industry in a rather precarious position moving forward.

Abstract:
The Will County community supports community policing efforts and wants their law enforcement agencies to be transparent, service-orientated, and committed to their diverse neighborhoods. The purpose of this phenomenological study was to explore current policing methods and tactics to improve community relationships within Will County, Illinois. Six different focus group studies were completed where 33 participants completed questionnaires and follow-up, in-depth interviews were conducted to gather data on personal police experiences and perceptions. The questionnaire responses were separated into three categories including Likert-scale response questions, dichotomous (yes and no answers), and ranking police tactics by levels of importance. Nine statistically data driven tables were generated into percentage totals that created comparisons of police methods, police tactics, and issues. The main policing tactics that Will County residents expected from their policing agencies were rapid response for service and police professionalism (appearance, conduct, communication skills). The participants expected that police agencies solve major crimes (high-profile murders, assaults, robberies). The lowest ranked police tactics discovered in all 4 subcategories surveyed were aggressive enforcement efforts (even for minor offenses) and traffic enforcement. The participants demonstrated support for community policing efforts that requires law enforcement agencies to work with their neighborhoods. The results of this study can be used to create a policing culture that incorporates traditional policing efforts and combines these efforts with the newer community policing methods that are positively impacting the Will County communities.

Four municipalities in DuPage County, Illinois were selected for study to determine the effects of zoning on housing that is affordable to low and moderate-income groups, and to suggest possible recommendations to achieve some inclusiveness by providing a wide range of housing options.Though Woodridge, Naperville and Villa Park appear to have made progress in terms of providing housing choices for low and moderate income groups, there exist some limited opportunities to increase affordable housing in these communities. Oak Brook is most exclusionary. It provides no opportunities for low and moderate-income groups that work in that community, even though it is a major employment center. This creates difficulties for entry job seekers and other low groups that want to live in these communities.The recommendations are specifically tailored to each community in terms of what the community could realistically do, in view of the limited land available for development. This study is intended to renew interest in zoning and affordable housing, and lead to zoning reforms in communities in DuPage County, Illinois.

Abstract:
This chapter argues that disability was central to the production of racialized medical knowledge in the antebellum years. As white southern physicians professionalized, they constructed racial discourses that dovetailed with disabling legal fictions of blackness. The criminal, property, and manumission laws of slavery analogized blackness and disability by overemphasizing the state of enslaved people’s bodies, while slave codes metaphorically “handicapped” blacks in society through pass laws, literacy laws, and the denial of citizenship rights. Samuel Cartwright, Josiah Nott, and others borrowed from this legal lexicon and invented new conditions and theories of black abnormality. Enslaved women, sexuality, reproductive health, and the imagined link between hereditary defects and racial inferiority played a major role in these conversations and positioned physicians as “experts” of black bodies.

This chapter tracks Todd Solondz's canny cinematic homeopathy with the nation's overarching economic decline under several rubrics. The first is the built environment of his films, interested as they are in the aesthetically valueless architecture of “junkspace.” Next, the chapter examines his stylistic posture of “left classicism,” which borrows key aesthetic principles from the dominant industry, only to drain them of their usual affirmative functions. His several ontological gestures of “eternal recurrence,” offered with the twist of a general decline in standards, are then explored. Afterward, the chapter discusses his determined interest in the dynamic opposition between playful sequences of fantasy and escape and unendurable long takes of truly intolerable material. Finally, his thematic preoccupation with the excremental function of the “gift of shit,” which he analyzes in an exhaustive fashion, is studied.

This chapter examines and analyzes the five-year journey of Zobrest v. Catalina Foothills School District (1993) from the federal district court in Tucson to the U.S. Court of Appeals for the Ninth Circuit to the U.S. Supreme Court. William Bentley Ball, the Zobrests’ attorney, and John Richardson, the school district’s attorney, clashed over whether the Establishment Clause permitted any government aid to a Catholic school. Many religious and civil libertarian groups—but just one national deaf association—filed arguments to sway the court. Chief Justice William Rehnquist, who wrote the majority decision favoring the Zobrests, misunderstood the complicated function of a sign language interpreter to permit what he regarded as incidental parochial school aid. Rehnquist maintained the aid was permissible because the plaintiffs and their deaf son were its main beneficiaries.

Through a close examination of British Caribbean slave laws, this chapter argues that British Caribbean slave law always recognized the humanity of the slave, and the law’s power derived from its ability to see Africans’ humanity and effectively disable it. Slave law suspended Africans and their descendants between the human and the animal through disability-inducing laws. The principle of maternal inheritance was a legal notion that positioned enslaved women as legally equivalent to animals. The slave codes of Barbados and Jamaica disabled enslaved Africans by limiting their mobility, freedom, and autonomy, and by divesting them of political status. The codes encouraged the physical impairment and disfigurement of captives by sanctioning punishments that disabled and disfigured as well as by establishing a culture in which whites could punish captives with impunity in whatever way they desired.

highlights the tensions between the demands of modern law and white supremacy by studying the rights of convicted criminals in court. Many southern states, for racial and partisan ends, used criminal convictions to strip convicts of their right to testify on their own behalf in court. While states in the rest of the country had revoked such limitations on courtroom testimony by the late nineteenth century, southern states maintained them. They served as an extension of Jim Crow laws, used to deny African Americans full citizenship, much as felon disenfranchisement laws did.

The book’s final chapter accounts for a 2006 Indian law banning child marriage as well as contemporary feminist dilemmas about lowering the age of sexual consent. This chapter tracks the efforts to reform the law on child marriage to make it easier to enforce. The context of legal changes following the 2012 gang rape of Jyoti Pandey is also explained. The chapter shows how feminists are calling for lowering, rather than raising, the age of consent, out of a recognition that the higher age of consent facilitates social control. The chapter uses the history offered in previous chapters to dissect the complexities of recent laws prohibiting child marriage and altering the age of consent. Ultimately, chapter 7 exposes how presumptions about the vulnerability of the adolescent girl can backfire when too much power is vested in parental hands.

En 1933, un gobierno totalitario cerraba las puertas de una de las comunidades artísticas más significativas para la Historia del Arte del siglo XX y del actual, tanto desde el punto de vista de la creación, como de la pedagogía de las artes: la Bauhaus. Aquella clausura no supuso, sin embargo, su fin. En 1937 tomaría su testigo la New Bauhaus, abierta en Chicago por László Moholy-Nagy, uno de los profesores más influyentes en la plantilla de aquella institución creada por Walter Gropius en 1919. Su nombre ha variado desde entonces, «Chicago School of Design» (1939), «Institute of Design» (1944), hasta llegar a integrarse en el «Illinois Institute of Technology», existente en la actualidad. El paréntesis entre dos guerras mundiales había sido ocasión para el encuentro de artistas, especialistas en diversos ámbitos de la creación y de diferentes orígenes culturales, con un objetivo común, formar a otros creadores para «desear, proyectar y crear todos juntos la nueva estructura del futuro», como decía Gropius en el manifiesto original. Su pretendido final, impuesto por un régimen político, encontró su punto y aparte en un estado democrático al otro lado del Atlántico, dando pie no solo a una iniciativa mantenida a nivel académico en el Instituto de Illinois, sino inspirando a otra, fuera de las estructuras estatales, que puede servir a su vez como ejemplo de aplicación creativa del presente disenso en las culturas democráticas. Precisamente en Chicago surgiría, en 1990, un proyecto de la mano de la Fundación MacArthur, para potenciar la diversidad artística y cultural y orientarla hacia una meta, reconocer y promover procesos creativos y nuevas ideas como cauces esenciales en la mejora de la vida. Se dotaría económicamente a una serie de instituciones artísticas, colonias, comunidades o residencias de artistas, para celebrar un encuentro llamado «Special Initiative on Artists». De aquella reunión que tuvo lugar en 1991, surgió la creación de un consorcio internacional de comunidades artísticas, hoy conocida como «Alliance of Artists Communities», donde la formación y la puesta en común de trabajos y nuevos proyectos son los ejes fundamentales. Quizá pueda ser este un ejemplo de salto creativo por encima de las barreras de las políticas del consenso, si fracasan, o del desacuerdo, si tienen lugar.

Abstract:
We study the allocation of dynamic electric vehicle charging investments from the policymaker’s perspective, which aims to meet statewide emission-reduction targets for the Illinois passenger vehicle sector. We determine statewide charging deployment trajectories over a 30-year planning horizon and estimate their emission reduction. Electric vehicle demand functions model the electrified vehicle market growth and capture network externalities and spatial heterogeneity. Our analysis indicates that most chargers need to be deployed in the first 10 to 15 years of the transition to allow benefits to accrue for electric vehicle drivers, availability of home charging influences consumers’ choice and drivers’ electrified travel distance, charging stations should be prioritized for frequent long-distance drivers, and spatial effects are crucial in accurately capturing the demand for electric vehicles in Illinois. We also develop a multi-criteria suitability map to site charging stations for electric vehicles based on economic, societal, and environmental justice indicators. We identify census tracts that should be prioritized during Illinois’ statewide deployment of charging infrastructure along with interstates and major highways that traverse them. Major interstates and highways I-90, I-80, I-55, and I-57 are identified as having high siting suitability scores for charging stations. Last, a novel location model was developed for equitable electric vehicle charging infrastructure placement in the Illinois interstate and major highway network. Two objectives were set to reduce detours and improve the ability to complete long-distance trips for low-income electric vehicle travelers and multi-unit dwelling residents. Our analysis indicates that if the system’s efficiency is the only consideration, low-income/multi-unit housing resident travelers are most likely to fail to complete their trips, while an equitable charging siting could mitigate this issue.

Soils containing inorganic compounds are frequently encountered by transportation agencies during construction within the right-of-way, and they pose a threat to human health and the environment. As a result, construction activities may experience project delays and increased costs associated with management of inorganic compounds containing soils required to meet environmental regulations. Recalcitrance of metal-contaminated soils toward conventional treatment technologies is exacerbated in clay or organic content-rich fine-grained soils with low permeability and high sorption capacity because of increased treatment complexity, cost, and duration. The objective of this study was to develop an accelerated in situ electrochemical treatment approach to extract inorganic compounds from fine-grained soils, with the treatment time comparable to excavation and off-site disposal. Three reactor experiments were conducted on samples collected from two borehole locations from a field site in Illinois that contained arsenic (As)(~7.4 mg/kg) and manganese (Mn)(~700 mg/kg). A combination of hydrogen peroxide (H2O2) and/or citrate buffer solution was used to treat the soils. A low-intensity electrical field was applied to soil samples using a bench-scale reactor that resembles field-scale in situ electrochemical systems. For the treatment using 10% H2O2 and citrate buffer solution, average removal of 23% and 8% were achieved for Mn and As, respectively. With 4% H2O2 and citrate buffer, 39% and 24% removal were achieved for Mn and As; while using only citrate buffer as the electrolyte, 49% and 9% removal were achieved for Mn and As, respectively. All chemical regimes adopted in this study reduced the inorganic compound concentrations to below the maximum allowable concentration for Illinois as specified by the Illinois Environmental Protection Agency. The results from this work indicate that electrochemical systems that leverage low concentrations of hydrogen peroxide and citrate buffer can be effective for remediating soils containing manganese and arsenic.

This report presents findings on the evaluation of foundation layers under concrete pavements in the state of Illinois. It also provides recommendations and scenarios where unbound granular layers can be safely used under concrete pavements as economical and well-performing subbase layers. The current practice and mechanistic design methods for constructing concrete pavements in Illinois was first evaluated, including historical studies that led to the current design procedures and policies. The performance of concrete pavements with unbound granular layers in Illinois were then evaluated, and several case studies of well-performing concrete pavements with granular subbases, high traffic levels, and low distress levels and severity were realized. Next, the practices of surrounding states were evaluated, and several Midwest states, i.e., Wisconsin, Minnesota, Iowa, and Michigan, were found to regularly use unbound granular layers under concrete pavements with no issues. A literature review on the most recent requirements and recommendations for designing granular subbases under concrete pavements was then presented. It is concluded that subbase layers under concrete pavements are mainly used to provide uniform support and prevent pumping. Based on the case study evaluations and literature, a stable, drainable, and durable daylighted granular subbase design is recommended for traffic factors up to 10.0. Stability is ensured by limiting the ratio of gravel-to-sand fractions in the aggregate mix between 1.3 and 1.9. Drainability requirements can be met by limiting the percentage of fines passing the No. 200 sieve (0.075 mm) to 4% and by checking the quality of drainage is at least fair based on the time required to drain 50% of the water. Lastly, a geotextile fabric is recommended for use below the granular subbase for separation to ensure drainability throughout design life.

Recent developments in transformative technologies hold the promise to provide holistic solutions for affordable transportation services to rural areas and thus greatly alleviate existing social inequality through efficient planning and management of complex transportation systems and systemwide interactions among multiple modes. To realize the promise, many challenging research questions need to be addressed, which often leads to computationally intractable, large-scale, dynamic/stochastic, discrete optimization models. This project proposes to address some of the challenges by building a series of holistic and tractable models on the design of mobility services, capacity planning, dynamic matching, and routing, as well as pricing. The proposed project is expected to create a new series of planning and management models that can support strategical and operational decisions for large-scale autonomous and shared mobility systems in rural areas. The planned case study and simulation for the Village of Rantoul, Illinois, will lay the foundation for future field implementation.
