Abstract:
This research study deals mainly with the educator professionalisation in the post democratic South Africa, paying attention to the role of a professional council in promoting educator professionalism. The status and image of teaching in this country seem to have been viewed From the racial and cultural differences of communities previously. The democratic dispensation brought an end to this unfair racial and cultural discrimination in the education system through the establishment of a non-racial professional council for educators (i.e. SACE). The research aims are to determine: - The characteristics of a professions and those needed for educator professionalism; and - the role of the a professional council in promoting educator professionalisation. In order to attain the above-mentioned research aims, a literature review and an empirical investigation were undertaken. The literature study was used to clarify concepts such as occupation, semi-profession, profession, professionalisation and professional status. Secondly, characteristics or common features associated with traditional models of professions (ie. accounting, law and medicine) were discussed from a theoretical point of view. Lastly, the literature study highlighted the establishment of professional councils for educators in other parts of the world, including South Africa. The different forms of legislation and policy documents applicable in education were discussed. In order to determine the extent to which teaching adheres to or fulfils the characteristics associated with a profession, teaching was tested against these characteristics. The history of the establishment of SACE was briefly discussed and the objectives or role of this organisation in educator professionalisation concluded this chapter. The empirical research was conducted by using the questionnaire as a measuring instrument. The advantages and disadvantages of the questionnaire as measuring instrument were highlighted. The target population comprises of 239 educators from a total population of 2070 educators in Lejweleputswa and Northern Free State Education Districts -Free State Province. The data collected in the investigation was processed through the SAS computer package to establish frequencies and percentages of responses mean scores ranking, t-test procedures and the effect sizes. The results were then presented tables, analysed and interpreted in accordance with the literature study. The literature study revealed that like all other occupations, teaching aspires to attain recognition and status as a profession. It was also revealed that teaching partially satisfy characteristics associated with professions. The empirical study revealed that the employment of un- or under qualified educators is still prevalent in South African schools. In the last chapter, Chapter 5, conclusions from the literature review and empirical investigation were drawn. The recommendations with regard to the role of SACE in educator professionalisation were provided. Finally based on the research, future research studies in SACE and educator professionalism were recommended.

Abstract:
The thesis investigates the nature and regulation of the international practices of large commercial law firms. The overseas work of City solicitors, German commercial lawyers and US corporate lawyers is examined; almost seventy interviews were undertaken with lawyers and regulators based within the jurisdictions of England and Wales and Germany. A wide variety of literature, ranging from the fields of globalisation and regulation to the sociology of the professions, contextualises the empirical research. It is argued that the processes of globalisation have intensified within the last quarter of this century. The heightened internationalisation of business has impacted upon the worlds of many professionals, including those of lawyers in large law firms. Many of the largest law firms are moving to more commercialised forms of practice, where entrepreneurship is highly valued. Indeed, one of the reasons why foreign offices are opened is to take advantage of "green-field" sites abroad. However, law firms' strategies do vary; the thesis aims to tease out some of the differences in the international practices of the law firms investigated. In so doing, it cautions against over-generalising when discussing the overseas strategies and experience of "mega-law firms". Nevertheless, international developments do test the limits of current regulation. Large law firms often operate beyond the regulatory concerns of professional associations yet several features of their practice are worrying. For instance, the tendency of commercial lawyers not to consider anything other than their clients' immediate interests (to act as "hired guns") calls into question the legitimacy of regulatory systems. The thesis proposes a programme of reform to address such concerns.

Abstract:
This dissertation examines lawyers and lawyering in post-Soviet Georgia. It suggests that the collapse of the Soviet Union triggered a rapid de-professionalization of lawyers. The monopoly of the Soviet-era Bar was broken, the number of law graduates multiplied, many of the objective conditions for lawyering (such as functioning courts) were simply absent and most jurists employed by state enterprises lost their jobs. In other words, lawyers were left with little control over their markets or work. But there has also been a growing movement towards the professionalization of lawyers since 1991. Intriguingly, the key to understanding the new professionalism lies not with the reconstruction of state-mandated monopolies (indeed for several years there was simply no law regulating the Bar), but rather with lawyers' attempts to control a market through means firmly lodged in culture and the politics of the post-Soviet transition. These means include a traditional reliance on reputation and networks. Comparisons are also made here to the legal professions in Armenia and Azerbaijan, revealing similar findings and rounding out this thesis as a regional study. The empirical findings, which are based on fieldwork carried out in Transcaucasia between 1998 and 2001, have implications for studies of the legal profession and the rule of law in transition societies.

Abstract:
The objective of this research is to evaluate the effectiveness of the development of professional judgement during the two year work-based pre-admission training period (PEAT 2) required of Scottish solicitors so as to identify a model that allows them to respond to the changes the UK legal services sector is experiencing. The methodology adopted throughout reflects an emphasis on researching knowledge in the context of its application (Flyvbjerg 2001). Professional judgement is described as the ‘heart of professional practice’ (Fish and Coles 1998) and is therefore selected to provide a holistic method of evaluation. The UK legal profession is fragmenting in its response to market pressures, including the introduction of external regulation and ‘alternative business structures’ under the Legal Services Act 2007 and increased globalisation, specialisation and commoditisation. It is therefore important to identify the traditional method used by Scottish solicitors to develop their judgement as there is a risk that what was previously implicit and assumed in this ‘community of practice’ (Wenger 1998) becomes dissipated. As a result, the relevance and application of judgement is considered in the context of professional practice and solicitors in particular. The effect of external influences are interpreted, including in relation to the job of a solicitor, the future development of judgement and implications for legal education. The research method adopted enables confidential data to be obtained about the development of professional judgement and the PEAT 2 processes through completion of semi-structured interviews with a number of Scottish law firms, the Law Society of Scotland and related regulatory organisations, supplemented with Scottish trainee focus groups and comparative data from illustrative law firms and regulators in England and Wales. This allows 10 detailed case studies of law firms to be developed and analysed using Eraut’s (2007) model of early career learning and Fuller and Unwin’s (2003) model of expansive and restrictive apprenticeships as well as providing commentary from experienced solicitors and regulatory sources on the development of professional judgement. This data enables an analysis of the effectiveness of the current Scottish pre-admission training processes and the identification of methods used to develop the judgement of novices. Findings indicate that elements of the formal requirements of PEAT 2 are limiting the experiential and reflective learning of trainees and, in the wider context of work-based learning, that professional judgement is developed through exposure to reflective practice in a ‘community’ that provides an expansive apprenticeship and establishes parameters of acceptable choices. Recommendations include adjustments to pre-admission legal training and the introduction of a specialist qualification, accredited by the Law Society of Scotland.

This study examines the issue of gender bias and other gendering processes within the profession of law in Kansas. Although women have made great strides toward equality within the law profession, there are still glaring disparities between men’s and women’s occupational attainment. Women enter law school at similar rates as men do; however, they are not similarly represented in the legal profession upon graduation, or throughout their careers. Utilizing a theory of gendered organizations, this study seeks to investigate what impact, if any, certain sociodemographic factors, sector of law, mentorship, and perceptions of discrimination, have on women’s levels of job satisfaction. To accomplish this goal, this study makes connections between previous research conducted by the Kansas Bar Association, and more recent survey data modeled after the original KBA research. Underlying structures and ingrained interactions are examined quantitatively, to gain a better understanding of the gendered processes that women experience within the profession of law in Kansas.

Abstract:
Over the past 30 years, the solicitors’ profession has become increasingly diverse. However, the existing literature demonstrates the persistence of structural inequalities as the profession continues to be stratified on a gendered, classed and raced basis. This thesis will explore the position of Muslim women within the solicitors’ profession, and their battle for inclusion within historically closed legal spaces. Drawing upon the feminist frameworks of embodied intersectionality and Critical Race Theory, I aim to develop a greater understanding of the fluid and contingent nature of marginalised identity. Contextualised within an increasingly volatile and hostile society, I focus on how Muslim women’s professional experiences are contoured through complex interactions of gender performance and expectation, religious obligations, community and socio-economic location. Whilst this group have gained a degree of attention within the literature, I contribute new understandings to the experiences of this under-represented, and under-researched group. Thus, the heterogeneous diversity of Muslim women provides the much needed complexity to previous literature concerning women and BAME groups. Through a constructivist grounded theory approach, this thesis analyses with the narratives of 12 Muslim women across legal sectors. Through their voices, I seek to identify the pervasive structural barriers facing this group within the profession, and the reflexive strategies used to progress. I engage with these women’s experiences of negotiation to understand the interactions between their professional and personal obligations, and the resultant impacts on their career trajectories, family relationships and personal wellbeing. Departing from the discourses of passive victimhood, I seek to (re)construct Muslim women as powerful agents in procuring structural change, through their influence as role models, and cultural and institutional entrepreneurs. Their stories have also revealed new, novel contributions to the professional literature: including focus on the Islamic constructions of motherhood, and the provision of prayer within legal spaces.

Abstract:
This study used a questionnaire to assess counselors' awareness of and opinions on issues related to the legislated regulation of their profession. The subjects (N = 159) were members of the Arizona Counselors Association. Statistical procedures used included numerical frequencies, percentages, chi-square and Pearson's product-moment correlation coefficient. The results indicated that the subjects were moderately informed about the consequences of legislated regulation. There was a tendency of subjects to be aware of, agree with and value those positions which represent professionally and personally beneficial consequences of regulation, and to be unaware of, disagree with and consider less important positions representing the negative consequences of regulation. Subjects supported legislated regulation, and supported traditional forms of regulation. The majority thought there was a need for more information and dialogue about the consequences of legislated regulation.

Abstract:
In Australian parenting disputes pursuant to the Family Law Act 1975 (Cth), an Independent Children’s Lawyer (ICL) may be appointed to represent the interests of the child the subject of the dispute. The role of the ICL has been formalised through legislative direction and the creation of national guidelines. Yet there are significant State and regional variations in how ICL work is conducted and differing understandings on the part of lawyers as to what the role requires. Concerns have been expressed about the efficacy of ICLs and the quality of legal services they provide. These concerns are heightened by the relatively powerless position of children vis-à-vis the lawyer; continuing ambiguity about the status of children in family law disputes; the increased role ICLs are expected to play in gathering evidence and assisting the court; and an apparent increase in the proportion of matters in which an ICL is appointed, with associated implications for funding. Against this backdrop, the thesis examines the professional identity of ICLs, via analysis of interviews with 40 lawyers working in this capacity. Using this interview material, I assemble a model of how ICLs conceive of their role and what they consider to be effective practice. I find that there is a disconnect between academic discourse, and the reality of ICL work and the place of the ICL in the family law system. Though born from, and sustained by, a set of essentially protective concerns, ICLs are now often described as a “voice” for children in the family law process and a means of enabling children’s rights to participation. This focus, however, disregards the “best interests” nature of the ICL role, the multitude of other tasks that ICLs perform, and the role they play in smoothing the operation of the family law system. Understanding the goals of the system, and the structural constraints affecting ICLs, is essential to any consideration of ‘effectiveness’.

Recent events have given attention to the public perception of criminal justice field in the United States. Although there has been much political debate about problems in the criminal justice field, attention should be turned to the prospective employees who will soon be seeking out these debates: college students seeking to enter the criminal justice field. The current study did that through survey data obtained from 112 students enrolled in criminal justice courses at East Tennessee State University during the Fall 2020 semester. Analysis revealed much about student interest in various criminal justice occupations, their perceived ability to perform the duties associated with them and the factors that motivated their decision-making. It also indicated that certain characteristics may influence desire to enter the policing and legal fields. Each of these findings is discussed.

During the information sessions that the Scripps Mock Trial Team hosts at the beginning of the school year for those interested in mock trial, it's customary for all the returning team members to talk about why we decided to join mock trial in college. We had no team at my high school, but at the end of my senior year, my AP American Government teacher decided that having a mock trial in class would give us valuable insight into the American legal system. I was chosen to give the closing statement for the defense, and I found my calling. My competitive spirit had found an outlet where it was not hampered by the unathletic body that housed it: competitive arguing. I have not been able to find any scholarly text that examines the ways in which mock trial teams themselves adhere to gender-normative patterns. I believe that this thesiswill be invaluable to an understanding of how gender roles are performed in the legal profession

The combating of money laundering has become crucial since it has escalated from a domestic to an international problem and vice versa. South Africa, in an attempt to combat money laundering has enacted anti-money laundering (AML) and anti-terrorism legislation. The legislation consists of the Prevention of Organised Crime Act 121 of 1998 (POCA); the Financial Intelligence Centre Act 38 of 2001 (FICA); and the Protection of Constitutional Democracy against Terrorist and Related Activities Act 33 of 2004 (POCDATARA). In essence POCA and POCDATARA criminalise money laundering and terrorist financing. FICA requires certain professions, such as the legal profession to maintain specific controls. Such controls include AML measures, combating the financing of terrorism (CFT) and also require the keeping of confidential client records, the filing of suspicious transaction reports (STR's) and certain cash transaction reports (CTR's).

Syftet med denna studie är att undersöka vårdnadsdomar och vårdnadsutredningar från tingsrätt och familjerätt där beslut och förslag till beslut inte är lika. Studien ämnar undersöka på vilket sätt domaren/domarna (juristen) anser sig ha ett bättre beslut i vårdnadsmålen jämfört med familjerättssekreterarens (socionomens) och hur detta kan avläsas i de domar där de två professionerna inte tycker lika. Är det rena juridiska felbedömningar som familjerättssekreteraren har gjort eller är det andra rekvisit och tolkningar som förekommer? Har en domare bättre kunskap att bedöma barns bästa än familjerättssekreteraren? Hur utmärker sig de två professionerna i det skrivna språket kring sitt egna handlingsutrymme? Studien har analyserat domar och vårdnadsutredningar med diskursanalys som metod för att belysa den professionsproblematik som studien syftar till att undersöka. Tre olika vårdnadsfall med tingsrättsdomar och vårdnadsutredningar har granskats. I ett fall finns även en hovrättsdom. De slutsatser som kommer fram i jämförelserna av empirin är att det råder en starkare självsäkerhet hos juristen i handlingsutrymmet kring att utföra sin profession, jämfört med socionomen. The aim of this study is to analyse the child custody enquiry with the custody judgements form the family law department and the court when the proposition for resolution and the decision is not concistent. The study aim to examine in what way the judge (lawyer) consider themselves to have a better decision in the family cases than the family law caseworker (the social worker) when the two professions do not agree. Is it the judicial intepretation done by the family law caseworker that is wrong, or is it the necessary prerequisite and other legal opinions which occours in the texts? Does the judge have better knowledge to assess the best interests of children than the family law caseworker? How do the two professions in the written language distinguish themselves about their own space of action? The study has analyzed judgments and custody enquires with discourse analysis as a method of highlighting the professional problem that the study aims to investigate. Three different custody enquires with district court cases have been examined. In one case there is also a judgement from the court of appeal. The conclusions that emerge in the comparisons of the material are that there is greater self-assurance of the lawyer in the action room in pursuit of his or her profession, in comparison with the social worker. The written language is treated in different ways and with different degrees of self-esteem and security in claims, depending on the profession.

To endow the profession of bailiff of quantitative and qualitative arguments to bring to a successful conclusion the various actions and anticipate the evolutions relative to the profession, we suggest in this project of thesis analyzing the demography of bailiff's services, their localization, structure them, the sensibility of the activity of these professionals in the situation. This project also makes a commitment to estimate the balance in the economy of services, with regard to complex rules of pricing and finally to analyze the legal regulation of the services market

Eu égard à la particularité et à la délicatesse de ses missions, les Etats proclament son indépendance dans leur constitution.Au Mali, de l’indépendance jusqu’en 1991, la magistrature est restée inféodée à l’Exécutif. C’est sous la IIIème République qu’elle a acquis les garanties formelles d’indépendance. Cependant, c’est sous cette République que les critiques les plus acerbes sont formulées à son encontre : lenteur des procédures, corruption des magistrats, collusions frauduleuses entre magistrats et avocats, etc.L’étude de la magistrature porte sur le cadre normatif dans son évolution historique (accès, organisation, fonctionnement, responsabilité etc.) et l’apport des luttes syndicales dans le sens du renforcement de l’indépendance des juges. The judiciary has a special place witthin the state administration. It is responsible for settling legal disputes between individuals (civil courts, commercial, etc.), punishing infringement of the criminal laws (criminal courts) and controlling the rulers acting within the law (administrative courts). Given the uniqueness and delicacy of its missions, states proclaimed its independence in their constitution.In Mali, from independence to 1991, the judiciary remained subservient to the executive. It was under the Third Republic that it has acquired the formal guarantees of independence. However, it is in this republic that most trenchant criticisms are made against it: slow procedures, judicial corruption, fraudulent collusion between judges and lawyers, etc.The study of the judicial is the normative framework in its historical development (access, organization, operation, liability, etc.) and the contribution of labor struggles in the direction of strengthening the independence of judges. The study focused too on analysis of the difficulties faced by judges in their interaction with institutional and social environment (their relations with government, social relationships, etc.). This approach allows us to better appreciate the constraints of the construction of their independence to cope with their role of building the rule of law.The study finally, analyses the perceptions of litigants and the judges commented portrait of two of them that we considered “honest“ in accordance with the rules of professional conduct and ethics

Tennessee does not have a formal state-wide required mentoring program for Tennessee lawyers. Mentoring programs are available to Tennessee lawyers but no uniform standards exist. It has been suggested that providers of mentoring programs should develop strategies for improving and expanding mentoring experiences for new lawyers. The purpose of this study was to evaluate attitudes towards mentoring by Tennessee lawyers who are within their first 5 years of practice. The researcher sought to identify the perceptions of new lawyers regarding mentoring to better understand mentoring’s role within the legal profession. The methodology for this study was nonexperimental quantitative survey research. The survey instrument was an electronic questionnaire. The survey consisted of demographic questions and 17 items that were divided into 3 dimensions: Value of Mentoring, Access to Mentoring, and Structure of Mentoring. Demographic data consisted of gender, type of practice (private solo practice, small firms of 2-10 lawyers, large firms of 11 or more lawyers, government practice, or other) and years of experience (less than 1 year, 1 year, 2 years, 3 years, 4 years, and 5 years of experience). Of the 1,433 possible participants, 287 (20.02%) responded to the survey. Nine research questions were addressed using ANOVA and independent-samples t tests. The significant finding in this study indicated female attorneys have a stronger preference for mentoring experiences and programs with greater structure (Structure of Mentoring dimension). The Value of Mentoring and Access to Mentoring dimension scores were not statistically significantly different in the demographics consisting of gender, type of practice (private solo practice, small firms of 2-10 lawyers, large firms of 11 or more lawyers, government practice, or other) or years of experience (less than 1 year, 1 year, 2 years, 3 years, 4 years, and 5 years of experience).

The worldwide increase of corporate failures on the scale of Enron and WorldCom has sparked a renewed international trend of corporate governance review. With the external company auditor blamed at least in part for many corporate failures, corporate governance reform also necessitates a review of the statutory regulation of the company auditor. In particular, the lack of auditor independence when auditing clients has been under the legislator’s spotlight. The problems associated with unregulated or poorly regulated auditors are well illustrated by the activities of auditing giant Arthur Andersen. In the US, the Sarbanes-Oxley Act has been promulgated in reaction to corporate failures, imposing many new legislative restrictions on the auditor. The UK has a more tempered, selfregulatory approach. South Africa, following international trends with its recently promulgated Auditing Profession Act and Corporate Laws Amendment Act, has also greatly increased the regulation of auditor independence. The question is now whether these new restrictions in the wake of corporate failures have been the right approach with which to prevent future failures and to provide adequate protection to shareholders. Although the general legislative increase in auditor awareness is welcomed, the efficacy of several provisions in South African legislation can be questioned. Widespread reform has taken place in the appointment and remuneration of the auditor, which now has to be independently determined by the audit committee. In particular, South Africa’s new regulation of non-audit services, and the lack of refined regulation on compulsory auditor rotation as well as the cross-employment of auditors by clients, needs a critical discussion. It is submitted that the discretion of a well-regulated audit committee, combined with increased disclosure and transparency, should be enough to regulate most of the key aspects of auditor independence. Care should be taken to not overlegislate in haste to reform. South Africa needs a flexible and customised approach in this regard.

ENGLISH ABSTRACT: The unique and intimate relationship that exists between a medical practitioner and his/her client is possibly one of the most important relationships that can come into being between any two people. This relationship is characterised and influenced by the qualities and attributes specific to the nature and historical development of medical care, as well as medical science in general. The doctor-patient relationship is also influenced by the social dynamics of a particular community, environmental factors, technological advances and the general social and commercial evolution of the human race. With regard to medical care and health service delivery, the doctor-patient relationship is furthermore vital to the quality of the care provided, as well as to the outcomes and relative success of the specific medical intervention or treatment. One of the distinct characteristics of the doctor-patient relationship is the power imbalance inherent in this relationship. The medical practitioner has expert knowledge and skill, while the patient finds himself or herself in an unusually dependent and vulnerable position. It is because of this important role that the doctor-patient relationship still plays in health service delivery today; the susceptibility of the relationship to a variety of influences, and the characteristic power imbalances inherent in this relationship, that a study of the doctor-patient relationship in South African medical- and health law is necessary. The characteristic power imbalances will be considered from a legal perspective in this dissertation. This study provides a comprehensive source of the doctor-patient relationship from a legal perspective. Where relevant, references are made to theories and principles from other disciplines, including sociology, economy and medical ethnomethodology. The prevalence and consequences of power imbalances in the doctor-patient relationship are identified and discussed with the aim of bringing these to the attention of both the legal fraternity, and medical practitioners. Specific problem areas are identified and solutions are offered, including the following: • The adverse consequences of power imbalances inherent in the doctor-patient relationship on the medical decision-making process are considered from various perspectives. With regard to these adverse consequences, the doctrine of informed consent is analysed and evaluated in great detail. • The influence of paternalistic notions in health service delivery; the business model of health service delivery and the effects of managed care and consumer-directed health care on the doctor-patient relationship and health service delivery in general are also analysed from a legal perspective, and specifically with regard to the power imbalances inherent in this relationship. • The role of autonomy, self-determination and dignity, as well as the principles of beneficence in medical practice, are reconsidered in an attempt to provide a solution for redressing the power imbalances inherent in the doctor-patient relationship. • The fiduciary nature of the doctor-patient relationship and the special role of trust in the relationship are emphasised throughout the dissertation as the focal point of departure in the doctor-patient relationship and the main constituent in any legal endeavor to redress the power imbalances inherent in it.
AFRIKAANS OPSOMMING: Die unieke en intieme verhouding wat bestaan tussen ‘n mediese praktisyn en ‘n pasiënt is wêreldwyd waarskynlik een van die belangrikste verhoudings wat tussen twee persone tot stand kan kom. Hierdie verhouding word gekenmerk en beïnvloed deur kwaliteite en eienskappe eie aan die besonderse aard en historiese ontwikkeling van gesondheidsorg, sowel as die mediese wetenskap in die algemeen. Die dokter-pasiënt verhouding word verder beïnvloed deur die sosiale dinamika van ‘n bepaalde gemeenskap, omgewingsfaktore, tegnologiese vooruitgang en die algemene sosiale en kommersiële ontwikkeling van die mensdom. Op die terrein van gesondheidsorg en mediese dienslewering is die dokter-pasiënt verhouding voorts ook sentraal tot die kwaliteit van die mediese sorg wat verskaf word, sowel as die uitkomste en relatiewe sukses van die spesifieke mediese behandeling. Een van die kenmerkende eienskappe van die dokter-pasiënt verhouding is die magswanbalans wat daar tussen dokter en pasiënt bestaan. Much has been written in the literature of higher education on the history and current role of presidents, provosts, and deans. However, higher education scholars have, for the most part ignored the role of institutional in-house attorneys on college and university campuses. Those who have written on the subject of institutional counsel have proffered the idea that in-house general counsel offices were established as a result of the increased regulation of higher education by state and federal governments, and litigation resulting from the faculty and student rights movements of the 1960s and 1970s. This project seeks to provide a detailed justification for the rationale for the proliferation of counsel offices, and to provide a base-line qualitative, interview-based approach to the current role of college and university attorneys. Using a historical, document based approach this dissertation provides a comprehensive exploration of the argument that the establishment and growth of offices of the general counsel on college and university campuses was rooted in litigation. This dissertation further builds on the notion that as colleges and universities became larger and more complex, federal and state governments increased regulatory and reporting demands and accountability on institutions. A second issue that this dissertation covers is the way in which modern day institutional counsel view their roles within a college or university. Using Oral History Methodology, three attorneys were interviewed about their perceptions of their roles. Based on those interviews, this dissertation proffers the idea that an institutional counsel’s view of his or her role is linked to the nature of the individual campus and its leadership, and the structure of the office in which the attorney works. This dissertation also puts the role of the institutional counsel into the context of institutional actors by comparing it with the role of the academic dean. In addition to showing that the role of the institutional counsel is institution dependent, the results of this project indicate that the role of the institutional general counsel is an area ripe for additional study.

Even in the days of an ever closer European union, Europe contains no less than four different legal cultures with respect to real estate conveyances: the Latin-German notary system, the deregulated Dutch notary system, the lawyer/solicitor system, and the Scandinavian licensed real estate broker system. The latter is of particular interest in that Scandinavian brokers play a far larger role in real estate transactions than their European counterparts.This paper examines and compares the Swedish real estate broker and the Latin notary. The Swedish broker is required by law to act as an impartial intermediary, to provide counseling to both parties, and to assist in drawing up all contracts and other documents necessary for the transaction at hand. To that end, the broker must be active and observant of the particular needs of the parties to the present transaction, always striving to enable them to reach equitable and practical agreements so as to prevent future disputes. In other words, the broker is required to tailor the transaction to fit the needs of the buyer and seller.The Latin notary profession prevails in large parts of the world, particularly the Latin-German parts of continental Europe, and Latin America. While there are divergences in the notarial laws of all countries, the similarities are greater still, and it is correct to speak of a single profession throughout all these countries. The notary carries out several important functions, the nexus of which is the authentication of legal documents. In the preparation of these documents, the notary is required to provide impartial counseling in order to tailor the transaction at hand to fit the will and needs of the parties. To uphold the integra fama of the profession, and to safeguard the proper performance of the notarial functions, lawgivers in all countries emphasize the importance of impartiality and integrity. There are national divergences as to the specific rules of conduct related to impartiality, particularly those concerning what activities are considered incompatible with the notariat, but they rest on common principles. Most importantly, not only must the publica fides be honored, it must be seen in the eyes of the public to be honored. The organization and regulation of the notary profession raises important economic issues, particularly with regard to competition/monopoly and market failures. The discussion of the regulation or deregulation of the notariat is by no means settled. Comparing the two professions, it is striking to see the enormous similarities in the legal frameworks and their respective rationales. Two common features are of particular interest. Firstly, both the Swedish broker and the Latin notary are required to assist the contracting parties in the contract phase, drawing up any necessary documents and counseling the parties as to the implications of the transaction. In that respect, both professions function as tailors to the transaction. Secondly, both the broker and the notary are required to act impartially and independently – impartially visavi the contracting parties, and independently in order to preserve the public faith in the independence and integrity of the professions.The similarities can be summarized as a function on the real estate market: impartial counseling and contract-engineering. This function exists alongside other functions, such as the brokers’ traditional matchmaking, or the registration of property rights. This functional approach may prove very useful in all kinds of analyses of the real estate market, whether of political, legal, or economic nature. For instance, with respect to the merits and/or necessity of the Swedish impartiality rule, those wishing to amend the law and introduce a system of overtly partial brokers acting solely on behalf of their principal have to face the question of what is to become of counseling for the principal’s counterpart. Should the counterpart be forced to choose between hiring their own legal counsel or make do without? Further, those wishing to contest the mandatory notarial intervention in real estate transactions have to face the same question: what is to happen to impartial counseling, given not only to the client but also to the client’s counterpart? Both instances illustrate the common feature shared by the two examined professions: impartial contract-engineering and counseling. To complete the picture and cover the whole arena of real estate transactions, the next logical step is therefore to compare and analyze different systems for registration of property rights. Doing so will hopefully achieve a tool for examining the real estate market that will prove useful indeed, particularly in future discussions concerning European harmonization.

Abstract:

Law schools are criticized for graduating students who lack the skills necessary to practice law. Legal research is a foundational ability necessary to support lawyering competency. The American Bar Association (ABA) establishes standards for legal education that include a requirement that each law student receive substantial instruction in legal skills, including legal research. Despite the recognized importance of legal research in legal education, there is no consensus of what to teach as part of a legal research course or even how to teach such a course.

Legal educators struggle to address these issues. The practicing bar and judiciary have expressed concerns about law school graduates ability to conduct legal research. Studies have been conducted detailing the poor research ability of law students and their lack of skills. Although deficiencies in law student research skills have been identified, there is no agreement as to how to remediate these deficiencies. This dissertation suggests the legal research resources that should be taught in law schools by identifying the research resources used by practicing attorneys and comparing them to those resources currently included in legal research instruction at the 202 ABA-accredited law schools.

Multiple data sources were used in this study. Practitioner resource information was based on data provided by practicing attorneys responding to the 2013 ABA Legal Technology Survey. Resources taught in ABA-accredited law schools were identified through three sources: a 2014 law school legal research survey sent to the 202 ABA-accredited law schools, a review of law school syllabi from ABA-accredited law school legal research and legal research and writing courses, and the Association of Legal Writing Directors 2013 annual survey of legal research and writing faculty. The combined data from these three sources were compared to the resources used by practicing lawyers identified in the annual national 2013 ABA Legal Technology Survey. This comparison of what is taught with what is used in practice identifies a deficiency in law school instruction in the research resources used by practicing attorneys. These survey results detail distinct areas of inadequate instruction in legal research resources and provide legal educators with detailed information necessary to develop a curriculum that will result in graduating students with practice-ready competencies.

Abstract:
The dissertation examines the central judicial institution of the Grand Duchy of Lithuania: the Supreme Tribunal and its functioning in the latter half of the 18th century. The choice of the investigated period was determined by the most significant judicial reforms carried out from 1764 to 1792 and in 1793. The present work, with reference to the concept of “efficient practice” and data of the research on modern legal theory and practice, adopts a comprehensive approach towards the administration of justice in the society of modern times. It analyses the most important factors determening the court’s activity: court’s competence, composition, judicial process and practical organization of its work. The compositional aspect of the court is analysed through the lenses of the formation of legal profession, therefore the aim was not only to evaluate all the normative acts defining responsibilities and functions of judges, chancellery clerks, advocates, procurators, court prosecutors but also to compile a comprehensive list of them. The dynamics of the court’s work was determined by calculating the number of lawsuits filed, number of cases that were solved and the ones left unsolved as well as the average time it took to settle lawsuits that were recorded in each register. Disertacijoje yra nagrinėjama centrinės LDK teismo institucijos – Vyriausiojo Tribunolo ir jo funkcionavimo XVIII a. II pusėje istorija. Tiriamą laikotarpį įrėmina svarbiausios teismo reformos, vykusios 1764 ir 1792 bei 1793 m. Darbe, remiantis ,,efektyvios teismų veiklos“ konceptu, šuolaikinės teisės teorijos ir praktikos tyrimų rezultatais, realizuojama kompleksiška prieiga prie teisingumo vykdymo naujųjų laikų visuomenėje tyrimo problematikos. Analizuojami svarbiausiais teismo veiklos determinantais laikomi faktoriai: teismo kompetencija, sudėtis, teismo procesas ir praktinis darbo organizavimas. Teismo sudėties aspektas analizuotas per teisininko profesijos formavimosi problemą, todėl siekta ne tik įvertinti teisėjų, kancelarijos darbuotojų, advokatų, agentų ir instigatorių pareigas bei funkcijas apibrėžusių normatyvinių aktų visumą, bet ir sudaryti šių asmenų sąrašus. Abstract:
This thesis takes as its starting point the proposition that the restricted development of law centres in the United Kingdom has been a result of the exercise of power by the legal profession. This was based on the evidence of the legal profession's influence on the initial development of public legal services policy and the profession's active opposition to the emergence of the first law centres in the United Kingdom. However, law centres remained on the margins of public legal services policy, despite the retreat of the profession from its original position. Thus, it was suggested that the key issue was not simply the power of the profession, but also the power of the dominant paradigms of legal practice, legal needs and legal services. This is reflected in the private practice and casework orientation of the legal aid system. Law centres challenge the dominant paradigms in many ways. They offer a multi-faceted approach to the resolution of the legal and socio-economic problems of the poor and do so in a not-for-profit, community-controlled and often collectivist context. Through quantitative and qualitative techniques employed in a multiple case study setting, this study sought to test the 'power hypothesis' empirically. Focusing on all of the law centres operating at any time between 1974 and 1997 in Strathclyde and the West Midlands, detailed accounts of significant events and periods in each centre's birth, life and, where appropriate, death were constructed. The thesis provides for the first time a social historical narrative of the development of law centres in these two locations. These accounts reveal that the profession and the dominant paradigms have had an impact on law centres in many significant ways. However, several of the greatest difficulties faced by law centres cannot be explained by reference to this conceptual framework. Accordingly, the thesis concludes that a wider theoretical framework is required to explain the development of law centres. This wider framework must draw on several existing traditions. It should recognise the importance of community, local and ethnic politics; social exclusion and ethnicity; and organisational and change management. However, it must also recognise the power of the legal profession and the dominant paradigms, as the additional challenges this brings distinguish the experience of law centres from that of other radical, community organisations.

Abstract:
Employing decolonized, Indigenous research methods, the author considers Métis Beadwork Practice through the analytical lens of Therapeutic Jurisprudence and establishes the practice as a holistic Indigenous Legal Pedagogy for knowledge creation and mobilization in legal education. The author agrees with Drs. Friedland and Napoleon who suggest that a significant challenge in and to Indigenous legal research is that such research occupies a space of “deep absence,” with the starting line moved back as a consequence of colonialism. Building on the work of Dr. Shawn Wilson, the author espouses an Indigenous Research Paradigm which requires a prioritization of the relationship to the ideas and making space for non-linear logic systems and Indigenous ways of knowing in scholarly research. In her work, the author prioritizes synthesis over deconstruction on the belief that deconstructing relationships to ideas for the purpose of analyzing them would have the effect of damaging the cognitive and emotional relationships developed through the research ceremony. While the work embodies the four essential elements of autoethnography, the author argues that the work of Indigenous scholars speaking in their own voices is sui generis in nature. She argues that Indigenous scholars who employ storytelling and other culturally-relevant knowledge mobilization practices are engaging a distinct Indigenous Research Method. This work ultimately progresses in a non-linear fashion and incorporates extra-intellectual knowledge including poetry, music, and photography. The use of multiple fonts and other formatting devices including right justification are used to underline shifts in voice and perspective throughout the work. These pedagogical choices valourize the ways of knowing of Indigenous women and honour the author’s Métis worldview, including her understanding that all things are interrelated. The author examines, and ultimately eschews, notions of neutral objectivity in research as colonial constructs that undermine Indigenous Knowledge Systems and contribute to the ongoing colonization of Indigenous peoples in post-secondary education. Following an introduction to the legal and social history of Forced Assimilative Education of Indigenous Peoples in Canada, the author reviews recent research into ongoing colonialism, racism, and ethno-stress experienced by Indigenous Learners in post-secondary education. The ii author subsequently explores the specific concern of the subjugation and erasure of Indigenous women’s knowledge in academia. She conducts a review of existing literature in the sphere of Feminist Legal Theory, examining and ultimately rejecting intersectionality and conceptualizations of sisterhood as possible remedies to discrimination faced by Indigenous women legal scholars. She argues that the lived experience of Indigenous women is situated not at an intersection, but rather in the centre of a colonialism collision. As a consequence, the author argues that existing Feminist Legal Theory does not create adequate space for Indigenous difference, experiences, or worldviews. Offering insight into legal education, legal ethics, and professionalization processes, the author also explores questions of lived experience of Indigenous lawyers beyond the legal academy. She argues that learning the language of law is but the first element in a complex professionalization process that engages structures of patriarchal hierarchy in addition to the other forces, including colonialism and racism, that shape the legal profession. She further argues that, for Indigenous peoples, learning to speak the linear, official language of legal education represents a collision of even more complex systems of dominance, with the regulated approach to learning and problem-solving standing in direct opposition to Indigenous ways of knowing. Consequently, Indigenous law Learners frequently experience an intellectual rupture when engaging in the professional assimilation process. The author offers an overview of Calls to Action 27, 28, 42, and 50 of the Truth and Reconciliation Commission of Canada and an introductory environmental scan of ongoing efforts to decolonize and indigenize law schools including land-based learning and the development of Indigenous Course Requirements (ICRs). The author subsequently considers the process of decolonizing the legal academy through the analytical lenses of Therapeutic Jurisprudence and Therapeutic Jurisprudence+. She ultimately positions the act of decolonizing legal education as an act grounded in decolonial love with the potential for healing individuals and communities struggling with ongoing colonialism and racism in the academy. Building on the work of the late Professor Patricia Monture-Angus and contemporary Indigenous legal scholars including Drs. Tracey Lindberg, Darcy Lindberg, Val Napoleon, and John Burrows, the author considers possibilities for reimaging legal education through the development and use of Indigenous Legal Pedagogies. The author argues that Beadwork Practice holds a distinctive language of possibility as an Indigenous Legal Pedagogical practice as a result of deeply entrenched links between beads and law. The author explores the social and legal history of beads as a tool for legal knowledge production and mobilization in the context of wampum belts and beyond, including the use of Métis beadwork as a mnemonic device to facilitate intergenerational knowledge transfer of stories and songs that carry law. Further, she examines colonial law and policy that served to undermine the legal value of beads, and canvases emerging trends in the revitalization of community beadwork practice. Finally, the author positions Beadwork Practice as a holistic Indigenous Legal Pedagogy to support not only the revitalization of Indigenous Legal Orders and the development of cross-cultural competency as required under Calls to Action 27 and 28, but also therapeutic objectives of individual and community healing.

La substitution de la notion de « professionnel de mer » à celle floue de « gens de mer », employée dans l’historiographie, permet d’observer plus précisément ces hommes, en discernant pour chacun, de manière synchronique et diachronique grâce à la reconstitution de trajectoires individuelles, compétences et activités navales, fonctions à bord, et statut social à terre, dans un contexte médiéval où les statuts juridiques, des aristocrates aux esclaves, occupaient une place centrale dans l’identification des individus et la hiérarchisation de la société majorquine. This thesis is a socio-historical essay about the plural profession of mariner in the kingdom of Majorca over the long term, from the conquest of the island by James I of Aragon in 1229 to Majorcan support for the conquest of the kingdom of Naples by Alfonso V the Magnanimous in the 1440s. The substitution of the notion of "professional of the sea" for that of "seaman", used in historiography, allows for a more precise observation of these men, discerning for each of them, synchronously and diachronically thanks to the reconstitution of individual trajectories, naval skills and activities, functions on board, and social status on land, in a medieval context where legal status, from aristocrats to slaves, occupied a central place in the identification of individuals and in the hierarchisation of Majorcan society. In three main successive parts, the articulated and interdependent study of the practical, institutional and social dimensions of this professionalisation thus offers multiple lived realities, individually and collectively, both at sea and on land, which go beyond the simple normative framework presented in the different sea customs, professional collectives and maritime jurisdictions in force in the Kingdom of Majorca

Public sector lawyers constitute a subset of the profession. However, there is no requirement that public sector lawyers engage in continuing legal education nor are they subject to the regulation of the professional legal bodies in Queensland. There is an absence of analysis and critical reflection about the duties of public sector lawyers and the means to ensure they engage in ethical conduct. This is an issue of importance which warrants investigation due to the dual obligations public sector lawyers owe by virtue of their roles as public servant and lawyer. There is a gap in the knowledge about the way one section of the legal profession is regulated and performs their duties. This paper will review and adapt existing theoretical knowledge about the particular professional obligations of both lawyers and administrators to construct a framework to be utilised by Queensland public sector lawyers to guide decision making to ensure it is ethical. Further, it purports to contribute to the areas of professional conduct and training of lawyers working specifically for state government agencies in Queensland by extending the knowledge about the duties of lawyers and public servants, to formulate the duties which specifically apply to public sector lawyers working for the Queensland public sector. Existing knowledge about ethics education and training and adult education theories are combined to produce the most effective ethics education and training schemes for public sector lawyers in the Queensland public service. The focus of the paper is on lawyers employed in the Queensland state public service. It concerns the dual roles of lawyer and public servant and the duties which flow from the duality of professional roles. The duties are determined by the important function performed by the public sector lawyer. It incorporates the duty to act in the public interest and to see, to the greatest extent possible that justice is done. The author proposes that the best way to enhance professional conduct of public sector lawyers is to simultaneously improve existing regulatory mechanisms by developing an enforceable code of conduct and establishing an ethics education and training program for public sector lawyers, to foster a more accountable government legal service.

У дисертації на основі аналізу нормативно-правових актів, вітчизняної та зарубіжної наукової літератури досліджено основні чинники та тенденції розвитку сучасної зарубіжної юридичної освіти, розкрито особливості їх реалізації в США, Великобританії та ФРН. З-поміж чинників виокремлено зростання соціального престижу юридичної професії і розширення доступу до юридичної освіти; з-поміж тенденцій – реформування моделей юридичної освіти, оптимізацію національних мереж правничих шкіл, прагматизацію зарубіжної юридичної освіти і підвищення ефективності підсумкової атестації юристів. Зроблено висновок, що сучасна юридична професія змогла реалізувати в собі два взаємодоповнюючі принципи: єдності і диференціації. Розвиток інтеграційних процесів у сучасному суспільстві детермінував необхідність існування загальних філософських та інституційних основ юридичної професії. Водночас, кожна правова система під впливом національних традицій зберегла власну специфіку у структурі і розумінні юридичної професії. В диссертации на основе анализа нормативно-правовых актов, отечественной и зарубежной научной литературы исследованы основные факторы и тенденции развития современного зарубежного юридического образования, раскрыты особенности их реализации в США, Великобритании и ФРГ. В качестве факторов определено рост социального престижа юридической профессии и расширение доступа к юридическому образованию; как тенденции - реформирование моделей юридического образования, оптимизация национальных сетей юридических школ, прагматизация зарубежного юридического образования и повышение эффективности итоговой аттестации юристов. Сделан вывод, что современная юридическая профессия смогла реализовать в себе два взаимодополняющих принципа: единства и дифференциации. Развитие интеграционных процессов в современном обществе детерминировал необходимость существования общих философских и институциональных основ юридической профессии. В то же время, каждая правовая система под влиянием национальных традиций сохранила свою специфику в структуре и смысле юридической профессии. In the dissertation on the basis of the analysis of normative legal acts, domestic and foreign scientific literature the basic factors and tendencies of development of modern foreign legal education are investigated, the peculiarities of their realization in the USA, Great Britain and Germany are revealed. The factors that determine the growth of the social prestige of the legal profession and the increased access to legal education; as tendencies – reform of models of legal education, optimization of national networks of law schools, pragmatization of foreign legal education and increase of efficiency of final certification of lawyers. It is concluded that the modern legal profession has been able to implement two complementary principles: unity and differentiation. The development of integration processes in modern society has determined the need for the existence of common philosophical and institutional foundations of the legal profession. At the same time, each legal system under the influence of national traditions has retained its own specifics in the structure and understanding of the legal profession. The growing role of lawyers is justified by the complication of social infrastructure, the development of the legal status of a person, the expansion of rights and freedoms, the jurisprudence of modern society, which reflects a common tendency for all developed countries to expand the subject of legal regulation, increase the political influence of holders of law degree. The criteria for access to legal education are classified into educational and social. Admission to US law schools requires any undergraduate education. In the UK and Germany, the enrollment of students is carried out on the basis of schooling. The only social barrier to access to legal education is tuition fees. Reforming the content of legal education in its most general form concerns models of legal education. In the US, lawyers are trained in 220 law schools, in the UK – 97, in Germany – 44 universities. The structure of legal education, which includes the duration of studies, its division into cycles, courses, semesters and trimesters, is investigated. Pragmatization of legal education is manifested in the practical orientation of the educational process, its orientation on the individual interests of students, the development of their practical skills. Such a new form of practical training of lawyers as law clinics has been investigated. The final form of practical training of lawyers in the UK and Germany – internships is analyzed. The solicitor's internship lasts two years, the barrister's internship – 1 year, the referendariat – two years. In the US, there is no postgraduate education. In Germany, there is a single standard for all law school graduates, which includes two state exams. In the United States, admission to law is through bar examination. In the UK, separate qualification tests are conducted for solicitors and barristers. Their purpose is not to test knowledge, but to test readiness for independent legal practice.

The present master paper investigates the challenges which are met while trying to implement the provisions of the directives on professional qualifications into national law. Despite the fact that the directives regulating the recognition of professional qualifications have already been implemented into the national law of the Republic of Lithuania after the new European Parliament and Council directive 2005/36/EC codifying all the existed directives on the recognition of professional qualifications, has been adopted, the competent authorities face new challenges trying to implement the provisions of new directives. Due to this fact, several stages of the implementation of the directives of European Union are distinguished.: the obligations Lithuania had to fulfil before the accession to EU and after the new Directive 2005/36/EC was adopted. The main objective of this paper is to analyse problematical issues regarding the transposition of directives on recognition of regulated professional qualifications into national law. The attempt was made to disclose the main features of the systems regarding recognition of regulated professional qualifications. A great deal of attention is alloted to the analysis of the process of recognition, the presumptions and the development of General system of recognition and Sectoral directives. Cette thèse porte sur l’étude d’un groupe socio-professionnel, les avocats, et leurs pratiques professionnelles de la communication et leurs usages des médias en France de 1945 à nos jours. Longtemps situé hors de la sphère marchande, on assiste au développement d’un marché du droit mondialisé, complexe et concurrentiel qui bouleverse l'exercice de la profession d'avocat. Ce changement du biotope a rendu la communication indispensable. La profession a pris acte de cette nécessité et a assoupli progressivement ses règles déontologiques en ce sens. La pratique ordinaire de communication des avocats reste déficitaire. Nous privilégierons d’abord, une approche générale, la communication de l’instance représentative de la profession, le Conseil national des barreaux, agissant comme source mandatée dans l’arène médiatique. Nous analyserons les stratégies mobilisées dans le cadre de cette communication institutionnelle pour promouvoir, influencer la représentation médiatique de la profession et élargir son périmètre d’action. Néanmoins, à côté de cette pratique ordinaire de communication déficitaire, deux typologies d’acteurs que constitue cette profession réglementée font exception. This thesis focuses on a socio-professional entity (lawyers) and their professional practice of communication and use of the media in France from 1945 until the present. The law stayed during a long period outside the market sphere. But recently a new market (of the law) has emerged: this market is worldwide, complex and very competitive. The legal profession has been impacted deeply by this recent development, which has rendered communications necessary. The legal profession is aware of this change and has progressively softened the ethical rules in this regard. To start, we will focus on the representative authority of the profession, the National Council of Bar, which acts as a mandatory source in the media. We will notably analyse the strategies used within the framework of this institution’s communications in order to promote, to influence the representation of the profession in the media and to enhance the perimeter of action of this institution. While lawyers’ ordinary use of communications remains minimal, there are two exceptions in the legal profession: corporate law firms and high-profile lawyers involved in criminal cases. We will study these two categories of actors: their manner of using communications and their use of the media, and we will describe the processes, the strategies, and behaviours toward the media, as well as the objectives targeted

Many patent law dilemmas arise from a failure to understand technologies as embedded in broader social, economic and political realities and to contextually analyze these legal phenomena. This narrowness leads to poor legal development, of which the modern medical exception from patentability is one example. Judges have difficulty interpreting it, patentees do not understand its purpose and it does not protect the important medical technologies to which the public would like access. This thesis applies a legal pluralist analysis to examine the emergence of the medical methods exception in order to understand why it was created and legislated. It starts by examining the origins of the exception in the caselaw, and the informal, concurrent norm established by the emerging medical profession in the early 20th century. It then proceeds to examine why the medical profession might have sought and enforced a norm prohibiting its members from patenting, and concludes that this arose from the need of the medical profession to distance itself from the patent law. As a result, professionalizing physicians established an internal normative order that mimicked and in many cases replaced the effect of the formal law. The thesis then proceeds to examine how the form of the informal norm evolved in the period between WWI and WWII, finding that the profession’s norm transformed and broke down concurrently with its efforts to achieve external legitimacy through legislation. That breakdown arose from factors which included growing labour mobility, greater understanding of the benefits of patents, and a growing role of science and industry in medicine that threatened the profession’s access to valuable medical innovation. The thesis concludes with a study of a current case (Myriad Genetics) that applies the thesis’ theoretical framework to a present dispute over the role the law should play in regulating genetic diagnostic tests.

Abstract:
Este estudio investiga el modelo de las competencias profesionales del catedrático a través de sus cuatro dimensiones (aptitud, empatía, sapiencia y seguridad) adaptado al contexto peruano, específicamente a la ciudad de Lima, haciendo uso del análisis factorial confirmatorio de segundo orden, como un caso particular de un modelo de estructuras de covarianza (SEM). El modelo fue usado para probar la hipótesis de investigación de este estudio que se realizó en una universidad pública de Lima, en la Facultad de Ciencias Administrativas, con una muestra de 195 participantes seleccionados en forma aleatoria. Los resultados apoyan la idea de que las competencias profesionales del catedrático tienen una relación directa con su aptitud, empatía, sapiencia y seguridad con coeficientes de 0,86; 0,86; 0,84 y 0,78 respectivamente; con una significación del 1%. Además, el modelo propuesto en la presente investigación cumple con las propiedades psicométricas, es decir posee consistencia interna de 0,79 y cumple con la evidencia de la validez de constructo con un índice GFI de 0,93 y RMSEA de 0,054; que son los índices adecuados. Por tanto, este estudio proporciona un modelo para los catedráticos que buscan mejorar día a día en su desenvolvimiento como tales.

Abstract:
Online distance learning is an essential element in the continuing education of law enforcement officers across the nation. However, little research has been conducted into the use of learning management systems by law enforcement agencies as a tool for professional development. This study attempts to assess the attitudes, preferences, and influences that impact distance learning for professional development work for state law enforcement officers and their agencies. Law enforcement agencies and law enforcement training centers have failed to utilize or embrace distance-learning technologies, or they have adopted distance-learning technology without knowing the effectiveness of the training or learning. For adult learning to be active, the learner must embrace the subject and the training delivery method. The law enforcement profession has historically used traditional classroom lectures for education and hands-on demonstration for training. This study focuses on the attitudes, preferences and other factors that influence the use of distance learning for professional development by state law enforcement officers. This study incorporated an online survey of 496 Florida state law enforcement personnel employed by the Florida Highway Patrol and the Florida Fish and Wildlife Commission, Division of Law Enforcement. The survey consisted of 64 questions that were analyzed and results into categories of descriptive demographics, work-related, reading and writing skills, technology use, software use, self-belief, self-management, ease of use, and learning preference for a review of factors that influence the attitudes and perceptions of state law law enforcement personnel on the use of learning management systems for profession development learning. This quantitative study revealed wireless connectivity variations between metropolitan and rural counties does not influence the perception or attitude of state law enforcement personnel on the use of a learning management system. The research also revealed the learning management system does not influence their perception of online, classroom or blended learning for professional development. This research also revealed little correlation to age, race or national origin, sex, and years of experience to the preference for a learning management system for distance learning. The research suggests that level of education does not influence the attitude or perception of users on the use of a learning management system but personnel who are certified instructors do have a stronger preference towards the use of a learning management system for professional development learning. The duty assignment of patrol, investigations, supervisory and administrative, or other duties does not influence the attitude or perception of users of a learning management system.
