Collaborative family law recently emerged as a method of dispute resolution where the parties and their lawyers agree to finalize all matters through negotiations only, without going to court. This thesis includes a history and literature review of collaborative family law, drawing comparisons to mediation or litigation. It raises questions about the capacity of collaborative family law to deal with disputes involving power imbalance or spousal abuse. This study explores gender discrimination among attorneys using Young Lawyers survey data from 2007. The survey included five questions about discrimination which are used as outcome measures. The survey asks respondents about receiving demeaning comments, missing out on desirable assignments, client requests for someone else to do work, colleague requests for someone else to work with, and the partner discounted hours. Results show gender gaps in two of the discrimination measures: experience in receiving demeaning comments and missed out desirable comments. Gaps persist even after controlli

In the last decade or more there has been increasing interest in the mental health and wellbeing of practising lawyers, both in Australia and internationally. Research reports surveying lawyers’ perceptions of their work life have found an alarming rate of mental health problems such as depression and substance abuse (Kelk, et.al., 2010). One of the potential areas of concern for legal practice and the mental health of lawyers is exposure to potentially traumatic material. The empirical research to date has found that lawyers who report high levels of depression and psychological distress are

This thesis examines the notion of professional responsibility amongst international has lawyers. There are challenges to conceptualising the notion in 'international' terms, particularly when citing diversity in nationality, specialisms, ideology, language and culture as evidence. Indeed, social circumstances and allegiances have an influence on one's identity and sense of responsibility. However, as much as it might be beneficial and necessary to understand situational variations, and, the differences amongst them, it seems unsatisfactory to base the conceptualisation of international lawyer
