This dissertation is a study of a social movement based on the organizations that define that movement, with specific attention to Christian conservative legal organizations (CCLOs) and their advocacy for the Christian Right in American politics. I ask, how do these organizations differ from one another in their advocacy efforts? How is this movement industry structured with respect to organizational networks? And how do the differences and variation among these organizations affect the dynamics among these groups? That is, how do organizations interact in the confines of a shared movement? This study addresses the literatures on law and society, religion and politics, and social movements, acting as a bridge between these distinct areas of inquiry. Using social network analysis, qualitative content analysis, and original interviews with movement attorneys, I find that CCLOs differ in their behaviors in their industry of activism and in their interaction with other CCLOs. I further argue that these behaviors are best understood in terms of unique organizational characteristics like structure, expertise, and relations with other groups. I conclude that organizations bearing surface similarities to one another can actually differ in meaningful ways, ways that facilitate and drive interaction among these groups in their shared movement and movement industry.

The purpose of this study was to examine the advocacy techniques employed by three state-level child advocacy groups in a mid-western state and to determine the effectiveness of such techniques in influencing policy and legislation.The groups studied were a government-funded bureau, a professional association, and a varied member organization. Each was selected because it met the qualifications set forth for that particular group type. Data collection took place during June and July, 1981.The records examined during data collection included minutes of meetings, publications, fiscal reports, legislative reports and bills, by-laws, and newspaper articles. The data discerned from the records described the groups' founding, objectives, structure, membership, finances, and advocacy strategies, particularly public information campaigns, training, and lobbying efforts. Interviews were conducted with persons knowledgeable of the groups' activities, as necessary.Data were organized into the categories of background information, objectives, membership, structure, funding, and advocacy efforts. Issues considered by any of the three groups were classified either as legislation or as a child-oriented issue. Advocacy techniques utilized to advance a group's position on a piece of legislation were paired with the bill. The effectiveness of the techniques was determined via a scale which examined a bill's progression through the legislative process. Patterns of effective advocacy were listed. Similarly, advocacy techniques employed to advance a group's position on child-oriented issues were paired with the issues. Patterns of advocacy were discerned from that information.As a result of the data analysis, the following conclusions were made; (a) a variety of techniques were used by the groups and contributed to effective advocacy; (b) the techniques of writing to and meeting with legislators or their staffs on behalf of a group were utilized most commonly in successful efforts related to legislation; (c) collaboration and multiple efforts were related to effective advocacy; (d) the professional association was most successful in its legislative advocacy efforts; and (e) the three groups took more positions and utilized more advocacy techniques on child-oriented issues than on legislation.

This project explores domestic violence advocacy in California by tracing historical, social, and cultural influences; examining the limit of the law and bias of those who uphold it; and analyzing a local domestic violence agency that provides services to survivors. Through the frameworks of anti-essentialization, and intersectionality I analyze gender roles and stereotypes ingrained in our culture. The essentialization of what it is to be a women renders women’s differences invisible, making it difficult for law and policy to address. By looking at domestic violence through an intersectional lens, the multi-layered nature women’s experiences can be revealed. However, not all laws and policies reflect this intersectional viewpoint which limits their effectiveness. The law can also be limited by those who enforce and interpret it. Those within law enforcement and the justice system are not immune to the stereotypes, and assumptions of the culture we live in. I use several women’s stories as well as advocate interviews to demonstrate the bias or attitude of indifference that can be held by law enforcement and the court system. The advocates who work closely with survivors of domestic violence use a client-centered approach to advocacy. This affirms the client’s ability and right to make her own decisions. The advocates partner the use of boundaries and self-care with this client-centered approach in order to best serve their clients.

This study examines the effectiveness of a legal advocacy program of the Gwinnett County Domestic Violence program. The legal advocacy program assists the victims to resolve their legal issues. This evaluation focuses on Temporary Protective Orders in the form of Child Custody, Restraining Orders and Possession of Property. The program setting is Gwinnett County, a residential facility that houses 32 women and their children. The sample consists of women who entered the shelter between July 2000 and July 2001. A secondary data analysis was used to collect data, as well as interviews with the legal advocate and the shelter director. Data was collected in the winter and spring of 2002 at the agency where it is maintained manually in the form of written files and records. Descriptive statistics were used to analyze the data, along with graphs and a Program Logic Model for a fine interpretation of results. The findings of this study revealed that most cases were resolved eventually. However, some cases were not resolved indicating the existence of barriers between systems.

Network, organizational, and policy learning literatures indicate that when interest groups face failure they will seek out alternative ideas and strategies that will enhance their potential for future success. Research with regard to interest groups and legal change has found that interest groups, using arguments that were once accepted as the legal standard for Supreme Court decisions, were unwilling or unable to alter their arguments when the Court reversed its position on these legal standards. This research project examined the conflicting findings of these literatures. Using the Advocacy Coalition Framework as a guide, this project studied the separationist advocacy coalition in cases regarding state aid to elementary and secondary sectarian schools from 1971 to 2002. The legal briefs filed by members of the separationist advocacy coalition with the Court were examined using content analysis to track changes in their legal arguments. Elite interviews were then conducted to gain an understanding of the rationale for results found in the content analysis. The research expectation was that the separationist advocacy coalition would seek out and incorporate into their briefs new and innovative legal arguments to promote their policy goals.
The research results demonstrated that prior to legal change interest groups did seek out and incorporate new legal arguments borrowed from other fora and sought to expand or reinterpret established legal arguments to better aid their policy goals. The changes that seemed to have the potential for adoption by the Court were quickly incorporated into the briefs of the other members of the coalition. Following legal change interest groups continued to analyze the decisions of the Court in order to seek out the best possible legal arguments to use in their briefs; however, the main focus of legal arguments examined and used by the coalition narrowed to those cited by the swing justice in the funding cases. Two innovative arguments were developed, but were either ignored or considered unsuitable, and were not used by the other members of the coalition. Counter to this project's research expectations new and innovative legal arguments were not adopted by the coalition. As the Court discontinued the use of various legal arguments the coalition quickly responded to these changes and dropped those obsolete legal arguments. Therefore, contrary to prior research, the interest groups and the coalition altered their arguments following legal change. Only those interest groups who no longer participated in coalition discussions reverted back to using pre-legal change arguments. Learning continued to occur in the coalition following legal change; however, the focus of analysis and the pool of arguments deemed worthy of use narrowed considerably.<br>Ph. D.

In this project, I look at the work of the International Gay and Lesbian Human Rights Commission (IGLHRC) and the role that brokers at the organization play in constructing, promoting, and institutionalizing a body of LGBT human rights. While a great deal is being written about the diffusion of LGBT politics and human rights discourses from the Global North, there are few ethnographic analyses of who is doing the exporting, how, and toward what ends. Based on a year of fieldwork in IGLHRC’s New York and Cape Town offices, I look at the history of IGLHRC, the interactions among brokers and how these shape their daily work, how brokers understand their mandate and the hybridity that it so often requires, and how partnership with groups in the Global South, the production, verification, and circulation of information, and the possibilities and constraints of the formal human rights arena all shape the work that brokers do. Ultimately, I conclude that human rights advocacy must be understood holistically if it is to be understood at all. Such advocacy always necessarily involves a degree of theoretical elaboration, promotion, and codification by human rights defenders and NGOs, and focusing exclusively on one or another of these aspects paints a skewed portrait of what it means to work within a human rights framework. Drawing from the anthropology of sexuality, queer theory, literature on brokerage, and interdisciplinary studies of transnational advocacy networks, this project aims to deepen understandings of how LGBT NGOs and the brokers that animate them regularly engage in the construction, promotion, and institutionalization of particular understandings of sexuality and the claims that can be made by sexual subjects globally.

The impetus for the recognition of the need for legal partners in healthcare came from Boston City Hospital in 1993. The hospital provided care to the largest uninsured and underinsured population in the New England states. The pediatric patients were noted by Dr. Barry Zuckerman to have difficulty in recovering from medical illnesses. He linked their inability to improve their health to poor housing, food insecurity, and basic social determinants of health. His hiring of a part-time lawyer led to a national movement for the development of medical-legal partnerships. The American Bar Association, the National Center for Medical-Legal Partnerships at George Washington University in Washington, DC and the American Academy of Pediatrics formed the first national medical-legal partnership in 2007. Joint resolutions were passed for members to become partners with the other professional colleagues to “address the legal and social issues affecting patient health and well-being.” The American Bar Association resolution led to the creation of the Medical-Legal Partnership Pro Bono Project. In 2015, the East Tennessee State University College of Nursing nurse-led community health center was awarded a small grant from the National Nurse Centers Consortium to participate in the development of a medical-legal partnership. The health center is staffed by Nurse Practitioners who provide health care for the underserved in northeast Tennessee. The patients are diverse and include homeless, migrants, residents of public housing, uninsured, and underinsured. Partnering with the Tennessee Justice Center in Nashville, Tennessee, the nurse-led medical legal partnership improved lives of pediatric patients, adults, pregnant women across the state, and advocacy rights for those who cannot speak for themselves.

During the past century, lawyers in New Orleans created a number of organizations to provide legal services for the poor, as lawyers did throughout the country. Most of those organizations provided routine service directly to individual clients and received quiet acceptance within the city and the state. However, more aggressive lawyers in other legal services offices engaged in law reform or challenged politically powerful interests. These offices found themselves embroiled in controversy and facing impediments that were placed in the way of their work. This dissertation introduces nonprofit legal services in New Orleans, but focuses on and investigates the experiences of four organizations – the New Orleans Legal Assistance Corporation, the Tulane Environmental Law Clinic, the Louisiana Capital Assistance Center, and the Advocacy Center – that were involved in controversies. This investigation differs from most prior studies of legal assistance in several ways. First, it discusses a variety of local legal service organizations rather than concentrating on the legal aid movement of the first half of the twentieth century, or the later Legal Services Program and its successor Legal Services Corporation. Secondly, it provides detailed discussion of several New Orleans legal services, which had previously been limited to scrutiny of the Tulane Environmental Law Clinic. Most importantly, it goes beyond description to provide causal explanation for the controversies by reference to social structure, and the social mechanisms and social processes at work. The dissertation presents access to law by the poor as being a form of "largesse" or charity or gift, which is granted when it is convenient for the powerful, but withheld when it is inconvenient for the powerful. From this perspective, the controversies resulted from the opposing interests of the two major social classes in modern capitalist society, with the politically powerful objecting to certain legal victories or gains achieved by the poor. In addition to the New Orleans cases, the dissertation refers to other legal services offices throughout the country that experienced similar problems. This demonstrates that the underlying issues are not limited to the city of New Orleans or the state of Louisiana, but are national in scope.

This thesis addresses the issues faced by the urban poor in their efforts to gain housing in
developing countries. It argues that participation in housing is a matter of governance, in
which the Public, Private and Popular sectors interact, and Intermediary Agents (IA) are
necessary to act as catalysts in this interaction.
In Indonesia there are two major problems related to housing the urban poor. The first
problem concerns the quantity of housing. The second problem concerns the quality of
housing, infrastructure and the environment. The government usually addresses these
problems through a project-based, sectoral approach that lacks community engagement and
accountability. Intermediary Agents have assisted many of these housing projects. However,
little research has been undertaken on their role in these housing projects, as well as in the
informal housing process.
This thesis examines the role of IAs in the housing process of four different
communities: one community in a government-sponsored project and three communities in
informal settlements. The findings showed that the IAs, in engaging with the four different
communities, played different roles and have different values.
The involvement of IAs in the housing process elucidates a fundamental issue. On one
hand, the IAs offer a mechanism to assist communities in providing and improving access to
housing, infrastructure and services. However, there are limitations to their role: they have not
the capacity to improve security of land tenure for the residents, which is essential for
sustainable housing development. Where there has been some recognition of residents' rights
to occupy the land, there have been substantial gains in community engagement in investing
and improving their living environment.
The thesis demonstrates the importance of community participation and acknowledges
stakeholder engagement and community empowerment are crucial, roles that are often
dependent on the involvement of IAs. It also extended the research on movement and
development IAs demonstrating that both functions are complementary and important in
housing delivery and that there are five roles that these IAs could play depending on the
housing situation.
The thesis offers new approaches to housing delivery and policy in Indonesia by
involving urban poor communities, as the beneficiaries of housing for the poor programs. The
qualitative method of the research has not been able to provide a generalised conclusion, but
the lessons learned are important not only for providing housing for the urban poor in
Indonesia but also possibly to addressing housing problems in other Asian countries. This
thesis addresses four areas of intervention in transposing skills for a more democratic
approach in housing the poor. Within these areas the research proposes new models of
engagement for relevant stakeholders in public, popular and private sectors involving
Intermediary Agents. These models are underpinned by a set of basic principles to guide IA
engagement. Lastly the thesis proposes three models for IAs involvements in the housing
process.

On the other hand, the society is increasingly seeking for a more efficient, non-bureaucratical and speedier access to justice. However, this access is not being possible through traditional means of conflict resolution, what means lawsuits. Actually, the Judiciary seems inadequate in order to attend a constantly growing number of procedures and law professionals do not have awareness that we must privilege the pacification culture over the litigation culture. Therefore, due to so many crisis, either in Judiciary, in State, in the university legal education, it is necessary to find ways to provide practical and real effectiveness to make the access to justice as a citizen fundamental right, consequently, contributing to promote social, human and economic development in the democratic rule-of-law State. To achieve this objective, it must exist a join effort of society, legislators, legal scholars and students, in order to change the paradigm of a dogmatic and archaic legal education, which has its foundations in the history of a centralized and absolute Law, guided by utilization and application of what the laws dictate. This overpassed educational method, nowadays countered by several jurists, always withdrew the critical and interpretational power of the people, as it is evident in studies of the jurist theoretical common sense. Considering those aspects, this work aims to disseminate the phenomenon of extrajudicial conflict resolution as a new paradigm to be adopted for a legal education dedicated to alternative dispute resolution founded in negotiation techniques and game theory.<br>A experiência prática de disciplinas oferecidas nos cursos de direito das universidades federais brasileiras mostra que o ensino jurídico não está acompanhando as transformações sociais contemporâneas. Por sua vez, a sociedade vem buscando cada vez mais um acesso à justiça que seja célere, eficiente e desburocratizado. Todavia, esse acesso não tem sido possível através do meio tradicional de solução de conflitos, que é a prestação da tutela jurisdicional pelo Estado-juiz. Na verdade, o que se verifica é a insuficiência do Poder Judiciário para atender um número sempre crescente de demandas processuais e a falta de consciência dos operadores do direito de que é preciso privilegiar a cultura da pacificação, em detrimento da cultura da litigância. Assim, diante de tantas crises, seja do Poder Judiciário, seja do Estado, seja da educação jurídica universitária, faz-se necessário encontrar caminhos para que se dê efetividade prática e real de acesso à justiça como direito fundamental do cidadão, contribuindo, assim, para promover o desenvolvimento econômico, social e humano no Estado democrático de direito. Para que isso ocorra, é necessário um esforço conjunto da sociedade, dos legisladores, dos estudiosos do direito, dos docentes e discentes, no sentido de mudar um paradigma de educação jurídica dogmática e arcaica que tem suas origens na história de um direito centralizado e absoluto, disciplinado pela utilização e aplicação do que ditam as leis. Essa forma superada de educação, combatida atualmente por vários juristas, sempre tirou das pessoas o poder de interpretação e de crítica, consoante se evidencia nos estudos sobre o senso comum teórico do jurista. Levando em consideração esses aspectos, o presente trabalho tem por objetivo difundir o fenômeno da desjudicialização dos conflitos como um novo paradigma a ser adotado para uma educação jurídica que se volte para a prática da atividade advocatícia negocial, fundamentada por técnicas de negociação e pela teoria dos jogos.

O presente trabalho tem como premissa principal que o advogado é o mediador mais adequado para fazer a divulgação, através da publicidade, dos direitos coletivos e difusos dos cidadãos, no Brasil e na Argentina. Diante disso, propôs-se analisar o efeito que as sociedades modernas e a evolução das tecnologias da comunicação exerceram sobre a comunicação, e sobre os processos de conquista da democracia nos dois países. Procurou-se identificar que o advogado é agente transformador da Justiça quando leva ao judiciário as mais variadas demandas oriundas das transformações da sociedade. Através dos Estudos Culturais, em diálogo com os hibridismos culturais, procurou-se provar que o medo de uma comunicação de massa hipnotizante, é infundado. Por fim, foram buscados argumentos que procuram colocar a comunicação do advogado com a sociedade brasileira e argentina como peça fundamental para a consolidação da democracia nos dois países.<br>This paper has as main premiss that the lawyer is the most adequate mediator to spread, thru publicity, of the collective and diffuse rights of the citizens in Brazil and Argentina. In view of this, we propose to analyze the effects that the modern societies and the evolution of communication technologies exercise upon the communication and the processes of conquest of democracy in both countries. We tried to identify that the lawyer is a transforming agent of Justice when he brings to the judiciary the most various demands produced by the transformation of the society. Thru Cultural Studies, in dialogue with cultural hybridity, we tried to proof that the fear of the hypnotizing mass communication is unfounded. At last, we searched arguments that try to place the communication of the lawyer with the Brazilian and Argentinean society as a master piece for the democracy consolidation in both countries.

tempos. Como crime público que é, espera-se que seja notificado em maior número,
contribuindo para que hajam menos casos de omissão. Este tipo de comportamento
expressa-se de diversas formas, desde a violência psicológica e emocional, à física e à
sexual, englobando ainda a negligência. Pode atingir qualquer classe social e económica,
assim como qualquer idade, género ou afinidade populacional. Como resultado, pode
apresentar diversas manifestações, quer físicas quer psicológicas, contribuindo na
alteração do comportamento futuro da vítima podendo torná-la mais vulnerável e
potencial agressora. Assim, é de extrema importância a intervenção dos profissionais de
saúde, força policial e de justiça, em casos como estes, sendo essencial seguir-se uma
conduta específica e eficaz, nomeadamente no papel do Médico Dentista no que toca ao
diagnóstico das ocorrências, notificação e possível tratamento das lesões se necessário e
indicado. Over the time domestic violence has gradually gain shape and importance. Being a public
crime, it is expected an increased number of reports, thus avoiding omission of cases.
This kind of crime may be expressed in several forms, such as, psychological and
emotional to physical and sexual violence, or even negligence. Moreover it can come
across any type of social and economic class, age, gender or ethnical background.
Therefore, domestic violence presents different manifestations, for instance physical and
psychological, which influence the victim behaviour on the future, and might result not
only in increased vulnerability but serve as a contributor for the creation of potential
aggressors. Consequently, the intervention of health professionals and legal forces is
essential and should follow a specific and effective conduct, including the medical dentist,
whose role comprises on the, report of occurrences, establishment of diagnosis and
suitable treatment.

Alinhando essas duas abordagens, a Administração Legal e o BPM, o objetivo deste trabalho é identificar os principais processos de negócio que compõem a estrutura de um escritório de advocacia. Uma pesquisa de natureza qualitativo-exploratória e quantitativo-descritiva foi realizada, sendo as estratégias metodológicas desenvolvidas em três fases. A primeira fase de coleta de dados envolve a identificação dos critérios e fundamentos terminológicos do contexto analisado, por meio da aplicação de três entrevistas individuais semi-estruturadas. Após a identificação do mapa das dimensões terminológicas, parte-se para a segunda fase da coleta de dados, a aplicação de um questionário estruturado, o qual foi aplicado nos escritórios certificados com a norma ISO 9001 no Brasil. Por meio da estatística descritiva foram identificados os principais processos de negócio que compõem a estrutura dos escritórios de advocacia, bem como seus processos de apoio. Based on the application of both approaches together, i.e. Legal Administration and BPM, the aim of this research is to identify main business processes that make up the structure of a law firm. A qualitative-exploratory and quantitative-descriptive nature research was realized based on three main phases. The first phase involves identifying criteria and terminological basis within the context analyzed based on the application of three individual semi-structured interviews. After the identification of the terminology dimensions map, the second phase was the application of a structured questionnaire, which was applied on nine Law Firms, certified on ISO 9001, in Brazil. Based on descriptive statistics the main business processes that define the organizational structure of law firms, as well as their supporting processes were identified. The main business process were grouped in four categories and the support business processes were grouped in six categories.

Dentre os diversos motivos para esta transformação, apresentam-se a mudança em sua gestão e posicionamento estratégico decorrentes de fatores mercadológicos, tais como tecnologia, sócio econômico, financeiro e os efeitos próprios da globalização. Observa-se, no entanto, que se as organizações empresariais evoluíram e se aperfeiçoaram administrativa e estrategicamente, o mesmo não se podendo dizer da advocacia empresarial, quer por muitos anos permaneceu inerte em sua estratégia, gestão e organização administrativa. Ocorre que a partir de determinado momento, as empresas que, por necessidade, interesse em crescimento ou competitividade vieram a se profissionalizar, passaram a exigir o mesmo de seus fornecedores, dentre eles os escritórios de advocacia empresarial Por tais razões e pelo crescente número de advogados e sociedades de advogados empresariais, se faz presente à advocacia empresarial uma estratégia clara e oportuna e voltada às características da sua indústria, qual seja, a prestação de serviços tendo o conhecimento como elemento precípuo de sua atuação. A Visão Baseada em Recursos (‘VBR’) vem ao encontro desta necessidade estratégica da advocacia empresarial, ao focar a sua estratégia nos recursos internos de uma organização empresarial como elemento norteador estratégico de sua teoria, indo ao encontro dos anseios e necessidades da advocacia empresarial. O presente estudo analisa a estratégia da advocacia empresarial a partir dos norteadores advindos da literatura de campo, Pessoas, Tecnologia, Organização, Preço e Geografia que, alinhados aos conceitos e recursos estratégicos da VBR como referência central para delinear a direção estratégica de um escritório de advocacia empresarial.<br>Business transformations experienced by businesses in recent years reached the legal world. And several authors in articles and publications refer to the legal market in transformation, particularly in relation to the field of Business and Corporate Law. Among the many reasons for this transformation on Business and Corporate Law, it can be presented the changes in management and strategic positioning due to market factors, such as technology, economic, financial partner and the effects of globalization itself. It is observed, however, that even though business organizations have evolved and improved administrative and strategically, the same can not be said of business and corporate law, taking in account that for many years it remained inert in its strategy, management and administrative organization. It happens that after a certain time, the companies that, by necessity, interest in growth or competitiveness came to professionalize themselves, and began to demand the same of its suppliers, including the Corporate Law Firms. For all this and the growing numbers of lawyers and corporate business lawyers, it is necessary to business law professionals a clear and timely strategy, geared and focused to the characteristics of their industry, namely, the provision of services taking knowledge as essential element of its performance. The Resource Based View ('VBR') meets this strategic need of business law, to force its strategy on internal resources of a business organization as an element and guidance strategy of its theory, meeting the wishes and needs of law business. A Espanya, malgrat que els professionals de l'advocacia dediquen gran part de la seva activitat a negociar, els coneixements per desenvolupar aquesta funció professional tenen una presència poc rellevant en el currículum acadèmic, a més, el tractament doctrinal i deontològic es escàs. Per contra, als EUA la situació és diferent, la negociació ha anat cobrant rellevància al currículum acadèmic i formatiu de l'advocat, hi ha un patrimoni doctrinal d'important calat i la norma ètica integra preceptes relatius a la negociació. Prenent com a base aquesta anàlisi, es realitza una revisió doctrinal que serveix de fil conductor per a la presentació dels diferents enfocaments/estils de negociació.
Un cop establert l'estat de la qüestió, la segona part d'aquest treball compara la negociació legal amb el litigi. Es refereix tant l'auge dels mecanismes de alternatius de resolució de conflictes, entre ells la negociació, com la influença d´ aquest fenomen en la forma de exercir l´advocacia. Es realitza una reflexió sobre les suposades bondats de les modalitats alternatives de resolució de conflictes i sobre les aportacions del sistema d'administració de justícia tradicional. Alhora, es posa de manifest la preocupació per les garanties i la qualitat de les solucions als conflictes mitjançant mecanismes distints al litigi judicial.
L'activitat negociadora de l'advocat està, en general, escassament tractada per les normes deontològiques. Analitzant les diferències entre els marcs comparats EUA i Espanya, s'observa un tractament més extens i profund en el primer d'ells enfront d'una regulació escassa en el segon. Abordarem la problemàtica ètica dels processos de negociació legal, i en especial, la protecció a la part contrària atorgada per aquesta norma en aquests processos.
Finalment, s'indica la conveniència que el col·lectiu professional adopti una actitud proactiva, proposant les seves pròpies alternatives de resolució de conflictes. Aquest treball finalitza amb dues propostes: la d'una norma deontològica i la d'un mecanisme de negociació supervisada.<br>In Spain, although the legal profession devotes much energy to negotiation, the academic
curriculums do not, for the most part, feature training in the skills necessary to carry out this
legal function. Furthermore, there has been little research in the area and the question of ethics
has not been addressed. In contrast, the situation in the United States is different: negotiation
has become increasingly important in academic curriculums and in training for lawyers. There is
a wealth of important research and their codes of ethics incorporate provisions relating to
negotiation. Based on this analysis, a doctrinal review has been carried out, serving as a
guideline for the presentation of different approaches, different styles of negotiation, their
respective benefits and consideration of the factors to be taken into account.
Once established the State of the art, the second part of this paper compares legal negotiation
with litigation the growth of legal negotiation and other alternative conflict resolution mechanisms
and its influenced on the way the legal profession operates has been evaluated. An analysis of
the supposed benefits of these new procedures is carried out and the contribution of the
traditional justice system is examined. At the same time, this work highlights concerns about the
fairness and quality of solutions to conflicts arising from mechanisms other than litigation.
Legal negotiation is, in general, undertreated by ethical standards. Having analyzed ethical
issues in the United States and Spain, a longer and more thorough treatment is observed in the
first of them and less regulation in the second. Ethical issues on legal negotiation have been
particularly addressed.
Finally, the desirability of the legal profession adopting a proactive approach by proposing its
own alternative dispute resolutions is examined. This work concludes with two proposals: a rule
of professional conduct and a supervised negotiation mechanism.

different dimension considering the number of lawyers in order to get how the
revenue and payroll cycle are presented and what are the impacts on the measure of
professional productivity and the fiscal aspects adopted.
After getting the information about the main activities connected to the cycles
studied, it was done a comparison with theoretical basis extracted from books,
articles, sites and specialized magazines, mainly in the national ambit and some
sources from North America.
By using of case study tool, that was the use of a questionnaire with seven
questions directed to the administrators of the fifties law offices more admired in
Brazil in 2009, it has got some data related to more relevant aspects of revenue and
payroll cycle, besides the questions of the fiscal aspects adopted and the
professional productivity.
The intention was to compare the law offices studied with the answers collected
from the other offices selected from the list of the most admired of the country in
2009 of Anuário - Análise Advocacia 500 and to cross the data obtained by the case
study with the theoretical sources developing the analysis of the results obtained<br>A proposta deste trabalho é a realização de um estudo de caso em dois
escritórios de advocacia, de diferentes portes em relação ao número de advogados,
a fim de levantar como os ciclos de receitas e gastos com pessoal são apresentados
e quais seus impactos na medição da produtividade dos profissionais e no regime
tributário adotado.
A partir do levantamento do funcionamento das principais atividades ligadas
aos ciclos estudados, foi realizada uma comparação com a base teórica extraída de
livros, artigos, sites e revistas especializadas, principalmente no âmbito nacional,
bem como algumas fontes do mercado norte-americano.
Por meio da ferramenta de estudo de caso, que foi a utilização de um
questionário com sete perguntas direcionadas aos administradores dos cinqüenta
escritórios de advocacia mais admirados do Brasil em 2009, foram levantados dados
com relação aos aspectos mais relevantes dos ciclos de receitas e gastos com
pessoal, além das questões do regime de tributação adotado e a forma de
remuneração dos profissionais em relação à medição da respectiva produtividade.
O intuito foi o de fazer uma comparação entre os escritórios estudados e a
pesquisa com outros escritórios, que foram selecionados da lista dos mais
admirados do país em 2009 do Anuário - Análise Advocacia 500, e realizar o
cruzamento dos dados obtidos pelo estudo de caso com as fontes teóricas,

intends to analyze the practice of the legal profession under the influence of
globalization and the legal market . It is based on the assumption that the
globalization and consolidation of economic blocks in detriment of the national
borders are a 21st century reality. The free movement of people and the needs that
result from it require the adaptation of the States and of societies, especially when
speaking of the movement of goods and services. The legal service provision follows
this world trend, resulting, within the Brazilian legal profession, in the incorporation of
the term legal market . Nevertheless, the consolidation of this historic moment
depends on the solidification of projects that allow greater flexibility for the practice of
Law, through two main hypotheses: the transnationalization of the legal profession in
the scope of MERCOSUR, allowing cross-border practice among State parties; and
the association between Brazilian and foreign law firms, allowing foreigners to
indirectly practice the legal profession in Brazil.<br>Este trabalho vincula-se ao Programa de Pós-Graduação strictu sensu em Direito,
Relações Internacionais e Desenvolvimento da Pontifícia Universidade Católica de
Goiás e analisa o exercício profissional da advocacia sob os efeitos da globalização
e do mercado jurídico. Parte-se de pressuposto de que a globalização e a
consolidação dos blocos econômicos em detrimento das fronteiras nacionais são
realidade no Século XXI. A livre circulação de pessoas e as necessidades daí
advindas requerem a adaptação dos Estados e das sociedades, notadamente
quanto à circulação de bens e serviços. A prestação de serviços advocatícios tem
acompanhado essa tendência mundial, o que culminou com a incorporação, pela
advocacia brasileira, do termo mercado jurídico. A consolidação desse novo
momento histórico depende, entretanto, da concretização de projetos que permitam
maior flexibilidade ao exercício da profissão no Brasil, merecendo destaque duas
hipóteses: a transnacionalidade da advocacia no âmbito do MERCOSUL, de modo a
permitir que profissionais dos países componentes do bloco atuem nos Estadosparte;
e a associação entre sociedades de advogados nacionais e escritórios
estrangeiros, viabilizando uma atuação indireta dos estrangeiros em território
nacional.

Para os advogados, em especial, a informação, tanto jurídica quanto de outras áreas do conhecimento, é um recurso imprescindível. Diante do exposto, objetivou-se em âmbito mais geral: identificar as características do comportamento informacional de advogados relacionadas ao desenvolvimento de suas atividades de trabalho. Em um contexto mais específico, objetivouse: a) verificar as fontes de informação utilizadas pelos advogados para identificar e obter informação; b) identificar as fontes de informação utilizadas pelos advogados; c) determinar os fatores positivos e negativos que influenciam o comportamento de busca de informação dos advogados. Para tanto, foi analisada uma amostra composta por 10 advogados que atuam na cidade de Marília e região, os quais totalizam, aproximadamente, 1000 profissionais. A coleta de dados foi realizada por meio de entrevista semi-estruturada e os dados coletados foram analisados qualitativamente. Os resultados demonstraram que as fontes de informação mais utilizadas para identificar informação são os livros; a fonte de informação mais utilizada para obter informação é o contato com colegas de profissão (conversa informal para troca de informações) e com profissionais de outras áreas; dentre as fontes de informação disponíveis em seus escritórios, a Internet é a mais utilizada e considerada a mais importante; as fontes formais de informação (Internet e livros) são as mais utilizadas para localizar informação; a maioria sente dificuldade para localizar e ter acesso à informação, principalmente quando se depara com algum assunto inovador ou desafiador; pedir auxílio nas... Especially for lawyers, information, both legal and from other areas of knowledge is an essential resource. In this sense, it is intended in a general scope: to identify the informational behavior characteristics of lawyers related to their daily work. In a more specific context, the goals were: a) verify the sources of information used by lawyers to identify and obtain information; b) identify the sources of information used by lawyers; c) determine the positive and negative aspects that influence the informational behavior of lawyers. For such, a sample made of 10 lawyers who work in Marília and the nearby area was analyzed, representing a total of approximately 1,000 professionals. The data collection was carried out by a semi-structured interview and the collected data were qualitatively analyzed. Results show that the most common mechanism to obtain information is the coworker contact (informal chat for information exchange), and with professionals from other areas; among the sources of information available in their offices, the Internet is the most popular and considered the most important; the formal sources of information (the Internet and books) are the most used; most of the professionals have difficulty to find and access information, mainly when they come across some innovative or challenging subject; ask for help in the activities of information seeking is a very common practice to most of them; several aspects may influence informational behavior, but the one that is positive with the greatest influence is related to people (family and office coworkers). As mudanças globais, as novas tecnologias e o aumento das expectativas dos clientes geram uma necessidade, cada vez maior, de um planejamento estruturado e coerente com a realidade. A conduta e a abordagem tradicionais na gestão dos escritórios de advocacia não mais garantem o sucesso e sobrevivência, sendo fundamental a adoção de uma forte orientação ao cliente e o conhecimento da concorrência para o sucesso nos dias atuais. O volume de informações jurídicas produzidas é muito grande, tornando a recuperação da informação desejada mais difícil. As constantes atualizações da legislação dificultam o trabalho dos advogados, pois tornou-se uma árdua tarefa para o profissional do direito encontrar a melhor informação dentre as várias disponíveis. Diante disso, este estudo de caso propôs a criação de um planejamento de gestão da informação para os escritórios de advocacia. A partir das informações coletadas nos questionários com os sócios, no levantamento de documentos e na observação direta foi realizada uma análise dos dados, a fim de determinar as forças e fraquezas do negócio. Essas serviram de base para determinar os objetivos estratégicos, tendo como destaque, aumentar o número de clientes, atender as demandas num tempo relativamente menor, melhorar a qualidade técnica na prestação dos serviços advocatícios e criar um banco de dados disponíveis para a atuação dos advogados dentro da organização. A grande dificuldade dos escritórios de advocacia é a recuperação das informações necessárias em tempo hábil, tendo em vista que em sua maioria não possuem um sistema estruturado de gestão de informação, foco desse estudo. Para isso usaremos o Gerenciamento Eletrônico de Documentos e Enterprise Content Management como ferramentas para o armazenamento das informações. Todo esse contexto acaba por exigir que os escritórios de advocacia se preocupem em ter um planejamento, bem como um posicionamento de mercado para que possam manter-se competitivos na gestão de seu negócio.<br>Information is an intrinsic component of every process in an organization. Global changes, new technologies, and increased customer expectations create a growing need for structured planning that is consistent with reality. Traditional conduct and approach in the management of law firms no longer guarantees success and survival, and it is fundamental to adopt a strong customer orientation and knowledge of the competition for success in the present day. The volume of legal information produced is very large, making the retrieval of the desired information more difficult. The constant updating of the legislation makes it difficult for lawyers to work, as it has become an arduous task for the legal professional to find the best information among the available ones. Given this, this case study proposes to create an information management planning for law firms. From the information collected in the questionnaires with the partners, in the collection of documents and direct observation will be performed an analysis of the data, in order to determine the strengths and weaknesses of the business. These will serve as a basis for determining the strategic objectives, with a focus on increasing the number of clients, meeting the demands in a relatively short time, improving the technical quality in the provision of legal services and creating a database available for the Organization. The great difficulty of law firms is the retrieval of necessary information in a timely manner, since most of them do not have a structured information management system, the focus of this study. For this we will use electronic document management and Enterprise Content Management as tools for storing information. This whole context ultimately requires law firms to be concerned with planning as well as market positioning so that they can remain competitive in running their business.

O objetivo desta pesquisa foi analisar as diferenças entre os três tipos de defesa dativa, constituída e defensoria da PAJ Criminal na assistência judiciária criminal paulistana em processos-crime de homicídio na década de 1990. A partir das diferentes proporções que essas modalidades de defesa apresentaram em relação às suas atuações em cada fase do processo penal para o desfecho processual, procurei investigar as possíveis razões para a ocorrência essas distintas proporções. A partir da análise documental de 127 processos criminais de homicídios tentados e consumados registrados de 1991 a 1997 na 3ª Seccional de Polícia do município de São Paulo que integram o banco de dados da pesquisa Violência, Impunidade e Confiança na Democracia (NEV/USP/Cepid), construí um banco de dados referente às intervenções da defesa ao longo dos processos até seu desfecho. Tais intervenções foram examinadas quantitativamente em relação às três categorias de defesa criminal. A partir da pesquisa documental e quantitativa dos 127 processos, foi possível constatar algumas tendências e encontrar algumas explicações para a ocorrência de distintas proporções de condenações e absolvições segundo a natureza da defesa. A partir de hipóteses levantadas e tendências verificadas nos processos, realizei entrevistas semiestruturadas com alguns dos advogados mais atuantes nos processos examinados. Assim, foi possível verificar que os advogados que atuavam na assistência judiciária trabalhavam tanto como dativos quanto como constituídos. Esse habitus era uma maneira de atrair novos clientes. Por essas razões a advocacia dativa era a que mais concentrava absolvições e revelava menor diferença em relação à advocacia constituída, Esta última, apesar de intervir mais nos processos, não obtinha proporções de absolvições superiores às da advocacia dativa. Os procuradores da PAJ Criminal, por sua vez, eram os mais suscetíveis a terem seus réus condenados, porém tinham maior proporção de penas até 5 anos do que as demais modalidades de defesa. Isso porque, conforme ficou evidente nas entrevistas, eram em menor número e sofriam os efeitos da crise da Justiça Criminal, com grande quantidade de trabalho. Por isso, tendiam a realizar mais acordos informais com a acusação durante o júri e com isso logravam penas menores. Além disso, ficou evidente a existência de acordos também entre os advogados criminais e os delegados de polícia após o flagrante do réu. Tais acordos certamente contribuíam para a exclusão de casos da Justiça Criminal durante a fase do Inquérito Policial. Por fim, concluímos que a advocacia criminal na assistência judiciária sofreu forte impacto com a entrada massiva de novos advogados no campo jurídico e com a perda de controle da OABSP sobre a proliferação de novas faculdades de direito, ambas decorrentes da grande expansão do ensino superior privado no período.<br>This research aims to analyse the differences between the three kinds of criminal defense attorney nominated by the State, private attorney and public attorney at criminal legal aid in homicide processes in São Paulo during the 1990s. I have investigated the possible reasons for the occurrences of different proportions of each kind of defense present in the successive phases of the legal process and its sentences. I have built a database through the analysis of 127 attempted and consummated murder processes registered from 1991 to 1997, which constitutes the database of the research Violence, Impunity and Trust in Democracy (NEV/USP/Cepid), focusing on the interventions of the defense during the processes until its closure. Those interventions were quantitatively measured considering the three kinds of criminal defense. Analysing the documents and statistics of those 127 processes, it was possible to identify some tendencies and raise some hypothesis on the occurrence of distinct proportions of convictions and discharges, according to the nature of the defense. Those hypothesis based the semi structured interviews with some of the most active attorneys on the processes examined. Therefore, it was possible not only to verify that the attorneys working in criminal legal aid as nominated by the State worked also as private attorneys, but that work as nominated, specially at the Juri Court, was a way of attract new clients. That explains why nominated defences resulted in more acquittals, with a little difference to the private defense, even if the private attorneys were able to interfere more during the processes. The Public Criminal Attorneys (PAJ Criminal) were more susceptible, by the other hand, to have their clients condemned, but had more cases with sentences fewer than 5 years of prison. They endured, as the interviews revealed, the effects of the crises at Criminal Justice, and were fewer in number. As such, they would aim to make deals with the prosecutors more often, in order to get smaller terms to their clients. Deals between criminal attorneys and police deputies after the defendant arrest were also made evident. Such deals certainly contributed to the exclusion of Criminal Justice cases during the investigation phase. Finally, I conclude that criminal defense at legal aid faced a severe impact with the entrance of new lawyers in the juridical field and the loss of control by the Brazilian Bar Association in the creation of new Law Schools, due to the huge expansion of private colleges at that period.

Para os advogados, em especial, a informação, tanto jurídica quanto de outras áreas do conhecimento, é um recurso imprescindível. Diante do exposto, objetivou-se em âmbito mais geral: identificar as características do comportamento informacional de advogados relacionadas ao desenvolvimento de suas atividades de trabalho. Em um contexto mais específico, objetivouse: a) verificar as fontes de informação utilizadas pelos advogados para identificar e obter informação; b) identificar as fontes de informação utilizadas pelos advogados; c) determinar os fatores positivos e negativos que influenciam o comportamento de busca de informação dos advogados. Para tanto, foi analisada uma amostra composta por 10 advogados que atuam na cidade de Marília e região, os quais totalizam, aproximadamente, 1000 profissionais. A coleta de dados foi realizada por meio de entrevista semi-estruturada e os dados coletados foram analisados qualitativamente. Os resultados demonstraram que as fontes de informação mais utilizadas para identificar informação são os livros; a fonte de informação mais utilizada para obter informação é o contato com colegas de profissão (conversa informal para troca de informações) e com profissionais de outras áreas; dentre as fontes de informação disponíveis em seus escritórios, a Internet é a mais utilizada e considerada a mais importante; as fontes formais de informação (Internet e livros) são as mais utilizadas para localizar informação; a maioria sente dificuldade para localizar e ter acesso à informação, principalmente quando se depara com algum assunto inovador ou desafiador; pedir auxílio nas...<br>In the present globalized society, which is in constantly changing, updated and reliable information access is essentially important to several professionals who need such input to be successful in their activities. Especially for lawyers, information, both legal and from other areas of knowledge is an essential resource. In this sense, it is intended in a general scope: to identify the informational behavior characteristics of lawyers related to their daily work. In a more specific context, the goals were: a) verify the sources of information used by lawyers to identify and obtain information; b) identify the sources of information used by lawyers; c) determine the positive and negative aspects that influence the informational behavior of lawyers. For such, a sample made of 10 lawyers who work in Marília and the nearby area was analyzed, representing a total of approximately 1,000 professionals. The data collection was carried out by a semi-structured interview and the collected data were qualitatively analyzed. Results show that the most common mechanism to obtain information is the coworker contact (informal chat for information exchange), and with professionals from other areas; among the sources of information available in their offices, the Internet is the most popular and considered the most important; the formal sources of information (the Internet and books) are the most used; most of the professionals have difficulty to find and access information, mainly when they come across some innovative or challenging subject; ask for help in the activities of information seeking is a very common practice to most of them; several aspects may influence informational behavior, but the one that is positive with the greatest influence is related to people (family and office coworkers). alunos na constituição dos saberes implicados na formação do sujeito, com vistas à preparação do processo de
formação desse curso para a profissão de Advogado, no contexto de projeto pedagógico (na carga horária e nas
disciplinas, na bibliografia, na constituição das suas bibliotecas, no conteúdo, nas avaliações, nos estágios, no
trabalho monográfico, no quadro de professores, mais específico do Exame de Ordem). Avaliou-se, portanto, o
sistema de formação, interpretação e análise dos processos educacionais, ao final da graduação (2010), revelando as
dificuldades no ensino-aprendizagem pelos discentes nos aspectos envolvidos no seu próprio discurso sobre o
Exame da OAB. Para tanto, realizou-se um estudo de caso em um Curso de Direito em Goiás, por meio de questões
fechadas e abertas, numa pesquisa de campo, com alunos do quinto ano, sob o enfoque da Arqueologia do Discurso,
associando-a ao discurso educacional/jurídico, com o intuito de possibilitar uma visão do problema em questão. A
partir das concepções foucaultianas, analisou-se, neste trabalho, a ideia de arquivo como condição de possibilidade
de discurso arqueológico; a teoria do discurso e/ou método de análise do arquivo (categorias e conceitos); reflexões
sobre o Exame de Ordem dos Advogados do Brasil e a formação do advogado. Almeja-se que esta pesquisa possa
contribuir para a compreensão de temas que despertem interesse no campo da Arqueologia do Discurso, vinculado à
prática educacional e jurídica.

Previous issue date: 2015-10-15<br>The economic, social and cultural changes in the world society before the effect of globalization has changed the content, the way the laws are created, the choice of the law and how legal services are being provided. In this sense, it is increasingly common the provision of legal services involving not only the home country law but also the host country law or international law. As a consequence, the way legal services are provided has been modified. Law firms adapt to this change by opening branches, joint ventures, alliances and partnerships to better serve its customers. In Brazil the debate on the subject began in the 90s, having appeared several initiatives to address the problem. However, in 2000 the OAB promulgated the Provimento nº 91 in order to prohibit any partnership between national and foreign offices. This paper demonstrates the inadequacy of the current Provimento in the regulation of legal rules and the absence of parameters for judging the legality or otherwise of partnerships.<br>As mudanças econômicas, sociais e culturais ocorridas na sociedade mundial ante o efeito da globalização modificou o conteúdo, a forma como as normas jurídicas são criadas, a escolha das normas e como os serviços jurídicos vêm sendo prestados. Neste sentido, é cada vez mais comum a prestação de serviços jurídicos que envolvam não apenas a norma jurídica de um país, mas também normas jurídicas estrangeiras ou internacionais. Como consequência, a forma como os serviços jurídicos são prestados vem sendo modificada. Os escritórios de advocacia se adaptam a essa mudança por meio da abertura de filiais, sucursais, joint ventures, alianças e parcerias a fim de melhor atender seus clientes. No Brasil o debate acerca do tema iniciou-se na década de 1990, tendo surgido diversas iniciativas para a resolução do problema. Entretanto, no ano de 2000, a OAB promulgou o Provimento nº 91 com a finalidade de proibir qualquer parceria entre escritórios nacionais e estrangeiros. Este trabalho visa demonstrar a inadequação do atual Provimento na regulação das normas jurídicas e da ausência de parâmetros para julgamento da legalidade ou não das parcerias.

O presente trabalho oferece uma análise crítica das hipóteses de contratação direta previstas na Lei Geral de Licitações e Contratos brasileira, Lei Federal n.º 8.666, de 21 de junho de 1993, com atenção especial para o caso da contratação direta de serviços advocatícios. A dissertação encontra-se dividida em quatro partes. A primeira delimita o tema do trabalho no estágio atual de evolução do Direito Administrativo brasileiro. A segunda parte do trabalho explora o tema da licitação e sua importância para o Direito Administrativo. Nessa etapa, são apresentados os princípios norteadores da licitação e sua importância para o ideal republicano, tal qual previsto pela Constituição Federal. A terceira parte do trabalho analisa as hipóteses de contratação direta previstas na Lei 8.666/93, procurando identificar suas possíveis razões e as características em comum que existem entre elas. Elaborou-se uma classificação própria aglutinando os incisos do artigo 24 da Lei 8.666/93 em 6 categorias, a saber: a) dispensa de licitação em função do valor do objeto contratado; b) dispensa de licitação em função de situação excepcional; c) dispensa de licitação em função de problemas em contratação anterior; d) dispensa de licitação em função dos atores envolvidos; e) dispensa de licitação em função de políticas de fomento; e f) dispensa de licitação em função de especificidades do objeto. A quarta parte do trabalho contém uma análise sobre o caso da contratação direta de serviços externos de advocacia nos tribunais superiores: o Supremo Tribunal Federal e o Superior Tribunal de Justiça. Ao olhar para as decisões proferidas por essas Cortes, espera-se alcançar dois objetivos: captar os argumentos usados pelas partes que tomam posição nesse debate e identificar o posicionamento das maiores instâncias do Poder Judiciário sobre o tema da contratação direta de serviços advocatícios e o dever de licitar. Não se trata, portanto, de uma análise de jurisprudência, que foi usada como fonte de pesquisa para identificar situações reais envolvendo a contratação direta de serviços advocatícos, suas razões, e os argumentos forenses favoráveis e contrários a ela.<br>This paper offers a critical analysis of the cases of direct hiring as prescribed by the Brazilian General Law of Public Bids and Contracts, i.e., Federal Law No. 8.666, of June 21, 1993, with due regard for the direct hiring of legal services. The paper is divided into four parts. The first defines the theme of the paper viewed from the current standpoint of evolution of the Brazilian Administrative Law. The second part of the paper analyzes the issue of bidding per se, and its importance to Administrative Law. At this stage the bidding guiding principles and their importance to the republican ideal are presented, as set forth in the Brazilian Federal Constitution. The third part of the paper looks into the cases of direct hiring set out under Law No. 8.666/93, seeking to identify the possible reasons therefor and the common characteristics existing among them. Under a specific classification the items of article 24 of Law number 8.666/93 were combined in order to fall under six categories: a) waiver of bidding in view of the amount of the contracted object; b) waiver of bidding due to exceptional circumstances; c) waiver of bidding due to problems occurred in previous hiring; d) waiver of bidding due to the players involved; e) waiver of bidding based on development policies; and f) waiver of bidding based on the specific characteristics of the object. The fourth part of the paper analyzes the case of external legal services directly hired, as viewed by the higher courts, i.e., the Supreme Court and the Superior Court of Justice. When looking into the decisions handed down by these courts, two goals are expected to be met: to raise the arguments used by the parties involved in this debate and identify the standing of the Judiciary Branch highest instances on the subject of directly hiring legal services, as well as and the duty to promote competitive bids. This is not an analysis of case law, which was used as a research source to identify real situations involving direct hiring of legal services, their reasons, and forensic arguments for and against them.

Le professionnel que l'on croyait capable de défendre ses intérêts, par opposition au salarié ou au consommateur, s'est révélé tout autant victime de contrats déséquilibrés depuis quelques décennies. L'apparition de puissantes entreprises privées dans différents secteurs entraîne, de toute évidence, une inégalité entre les professionnels. Notre étude souligne la complexité de trouver un juste critère pour identifier de manière juste ce qu'est un professionnel partie faible. Il n'est pas possible de dire si, de manière générale, telle entreprise est plus puissante qu'une autre, car la personne morale partie au contrat peut cacher des intérêts difficiles à cerner au premier abord. Le juge ne peut pas non plus être l'arbitre autoritaire des prix sans risquer un détournement de sa fonction. Nous développerons le parti suivant : un contrat entre professionnels est dit d'adhésion lorsque celui-ci n'a pas donné lieu à une négociation idoine ; le juge doit alors s'efforcer de regarder le processus de pourparlers ainsi que les circonstances qui ont précédé la convention. De multiples critères peuvent aider le juge, tels que la taille de chaque entreprise, les parts de marché, les propos échangés par les parties, leur bonne ou mauvaise foi ou encore les efforts engagés par elles. Si le choix de l'analyse des négociations nous apparaît ultimement le plus juste, nous tiendrons cependant compte de ses limites. Il serait illusoire de penser que le juge peut toujours parvenir de manière certaine à connaître l'intégralité des circonstances antérieures au contrat. C'est pourquoi nous ajouterons à l'analyse des négociations un système de présomptions - quoique réfragables - lorsque la disproportion des prestations ou la différence de taille des entreprises ne laisse pas de place au doute. Nous mettrons enfin en lumière les stratégies employées par les parties fortes pour contourner cette analyse des négociations, comme des stipulations néfastes ou une tactique d'internationalisation. Il sera donc préféré une impérativité renforcée en droit national ainsi qu'en droit international. Une fois l'analyse des négociations effectuée, nous essayerons de proposer des sanctions à la hauteur du phénomène. Le juge, selon nous, doit être en mesure de modifier le contrat de façon souple, aussi bien de manière rétroactive que par un changement en cours d'exécution du contrat. Le caractère extrême de certains comportements contractuels nous incite à réfléchir à la possibilité d'un droit pénal plus dissuasif ou bien un droit « quasi pénal » sanctionnant ces comportements de manière plus appropriée. Néanmoins, c'est surtout au niveau de la procédure que se joue la protection contractuelle des professionnels. Un référé ajusté à cet objectif a tout lieu de répondre aux exigences de célérité qui gênent les parties faibles dans leurs démarches. Nous soulignerons aussi l'importance d'un système d'actions collectives qui surmontent efficacement l'écueil du coût du procès. À l'inverse, la sécurité juridique des entreprises nous conduira à proposer une procédure de protection par un système de droit doux. Deuxième partie : Le traitement judiciaire des contrats d'adhésion entre professionnels<br>The professional, supposed to be able to defend his interests, by opposition to the employee or the consumer, has proven to also be victim of imbalanced contracts for a few decades. The emergence of powerful private companies in various sectors clearly leads to inequalities between professionals. Our study underlines the difficulty to find the best criterion to identify what a professional weaker party is. It is impossible to say that globally such company is stronger than another because the legal person party to the agreement can hide many interests, which are hard to seize at first sight. Nor can the judge arbitrate prices in an authoritarian way without risking a misappropriation of his part. We shall side for this idea: a business-to-business agreement is to be qualified of adhesion contract as long as it does not give place to adequate bargaining; so the judge has to look the bargaining process and the circumstances preceding the contract. Many criteria can help the judge such as the size of the company, market parts, exchanged words, the good or bad faith of the parties or the efforts they have made. If we consider the bargain analysis as the ultimately rightest choice, we have to contemplate its limitations. It would not be realistic to consider that the judge could always discover every circumstance prior to the agreement. This is why we shall join a system of presumptions - albeit rebuttable - to the bargain analysis, when the difference of size of companies or the disproportion of provisions is obvious. We shall put into light the strategies used by strongest parts to bypass the bargain analysis, such as harmful clauses or internationalization tactics. Thus, we shall opt for high obligatory standards, as well as in national law than in international law. Once the bargain analysis is done, we shall try to suggest sanctions adapted to the concern. The judge, in our opinion, must be able to modify the agreement in a very flexible way, either retroactively or during the implementation of the said agreement. The gravity of various contractual behaviors must lead us to think about a form of criminal law or a "quasi criminal" law in order to combat those behaviors in a more suitable mean. Nevertheless, the protection of the professional weaker part is also to be dealt on a procedural ground. A proceeding for interim measures is likely to face the needs for celerity, which bother the weakest parts for their action. We shall also underline the advantages of a class action, which could overcome the financial issue of the lawsuit. Conversely, the legal security of business will bring us to foster a protection by a soft law system. First Part: The identification of the business-to-business adhesion contract. Johannesburg, 2016<br>The standard conception of adversary advocacy postulates that lawyers be partisan towards clients, within the limits of law, and be unaccountable for the client’s lack of integrity. Thus, lawyers owe duties to both clients and judges. Partisanship requires lawyers to conceal from judges confidential information received from clients and to advance arguments they believe are incorrect. Thus, say critics, the standard conception permits lying and cheating. This essay refutes that proposition. It is argued that truth-seeking is merely instrumental in the legal system and what is sought is ‘proof.’ The standard conception is defended, albeit with a corrective emphasis on balancing partisanship with duties to promote effective judicial decision-making. Counsel’s role is defined as a licensed fiduciary intermediary, who by non-disclosures and insincere arguments acts morally because such practises promote the legitimacy of the legal system and uphold client dignity. The contending views of leading proponents and antagonists of the standard conception are examined.

This project is a study of right-wing legal activism as it manifested itself at the end of the twentieth century on behalf of property rights. Political scientists and sociolegal scholars have done scant research on conservative movements. Yet, the importance of understanding legal activism that is neither progressive nor “liberal” is crucial for understanding today's political scene as well as adding to our knowledge about the processes of social change and the role lawyers play in them. The activists studied here are important largely because of their positions as elite academics, lawyers and their connections to important governmental officials and business interests. They have been working diligently to change notions of property in the U.S. to conform to their vision of what is appropriate for a good society. However, rather than studying them as a broad movement with a consistent worldview, this research utilizes historical research, content analysis and observation of meetings to describe the activity of ideology creation they engage in within several different settings and provides an analysis for the wide range of strategies and activities these activists use in the production of property notions in today's United States.

This thesis identifies the financial incentives of litigants and lawyers to behave in certain ways in relation to civil litigation files. By identifying such incentives, this thesis raises questions about the extent to which substantive and procedural private law is capable of being influenced by them. Specifically, this thesis argues that: lawyers have a lawmaking function within the private law system; lawyers have financial incentives distinct from those of their clients; and the costs of retaining lawyers produce observable incentives and effects on the outcomes of civil litigation matters. In addition to the many theoretical materials cited, empirical data have been cited from research observing the legal profession in North America and elsewhere. This thesis argues that external influences--such as financial incentives for non-parties--can affect the way private law applies and develops. This thesis also identifies general regulatory strategies that might limit the influence of external factors on private law.

Rhetoricians have long been interested in public policy discourse. However, studies have yet to apply the micro-lens of writing process to this context. One consequence is that, while studies of policy discourse point to the complexity of this area, they do not investigate the writing behaviors this complexity inspires. Secondly, while studies of writing process in other areas of rhetoric allow us to theorize process, our theories are typically based on more structured writing environments—such as the classroom, academic discipline, and professional workplace. As a consequence, we know less about invention and other writing processes in more unpredictable, explicitly contested settings.
To address these gaps, this dissertation presents a process-based case study of collaborative writing within the context of policy and legal discourse. The case study tracks the year-long work of a group of advocates who attempted to establish Domestic Partner Benefits (DPB) at a large public university. Due to legal restrictions, the writers could not assume a clear authority as they attempted to write a policy proposal together. In meetings in which they invented ideas, a prominent behavior emerged in their talk, what this dissertation refers to as role-play work. Role-play work is a theory of rhetorical invention in which writers propose roles for themselves and their audiences, develop arguments from within those roles, and try to identify how they might be recognized or misrecognized as a consequence of assuming roles.
Tracing patterns in the writers’ talk, this dissertation describes role-play work at three critical junctures: in the early stages, when the group lacks legal resources, during a tumultuous hunger strike in which the institution delivers its interpretation of the law, and during the group’s later writing process, when the group has a working understanding of a legal argument they can propose. This dissertation analyzes how writers use role-play to engage authoritative discourse that manifests at each stage: first, to imaginatively co-construct what might be authoritative, next, to confront authority-as-articulated, and finally, to understand the nuance of a potentially authoritative argument. Findings presented in this dissertation may be relevant to scholarship in professional and technical communication, collaborative writing and invention, writing process research, policy discourse, discourse analysis, and queer studies.<br>text

This thesis argues that globalization is creating increased need and opportunities for Indigenous rights advocacy/participation within emerging institutions of global governance and analyzes the possibilities and limitations of Indigenous advocacy at the WTO, drawing on the experiences of First Nations from the Interior of British Columbia.
It begins by examining how governance is shifting in the context of globalization, pointing to the emergence of an integrated global economy, the rise of supranational regulatory regimes such as the WTO, and the increased power and significance of non-state actors.within the global political-legal arena. It then analyzes how globalization is affecting Indigenous peoples and moreover, how Indigenous peoples have been responding to this through transnational advocacy efforts. The author argues that given the shifting nature of governance, and the growing significance of intergovernmental organizations (i.e. the WTO), it is prudent for Indigenous rights advocates to expand the parameters of their advocacy - to seek out non-traditional spaces at both local and global levels to assert Indigenous voices where they have traditionally been rendered absent.
Adopting Boaventura de Sousa Santos' subaltern cosmopolitan legality perspective, the author then turns to examine how First Nations from the Interior of BC have used a multiplicity of legal techniques and strategies across a "plural legal landscape" to simultaneously assert their Indigenous rights over their forest resources and to challenge the dominant neoliberaI conception of economy. The author examines the political and legal mobilization of BC Interior First Nations from local acts of resistance against BC government forest policies to global acts of resistance vis a vis the submission of amicus curiae briefs to the WTO in the Canada-United States Softwood Lumber Dispute. In analyzing this struggle the author illustrates how globalization has created the need and opportunity for BC First Nations to locate new directions of advocacy, and how they have reinvented law to fit their objectives and enable their access to traditionally "closed" political-legal arenas.
Upon conducting an examination of the BC Interior First Nations' experiences, the author then critically evaluates the possibilities and limitations of Indigenous advocacy at the WTO. The author finds that while amicus curiae submissions provide some possibility to strengthen Indigenous rights by raising awareness about the linkages between international trade and Indigenous rights within the international trade arena, there are significant limitations that must be considered in pursuing such advocacy. The author concludes with recommendations concerning how Indigenous rights advocacy may be approached in the context of shifting governance relations.

In addition, because of the limited ability of children’s cognition, memory and language development, it is hard to obtain testimony that is both correct and complete from them, thereby decreases the conviction rate. In some cases, it might lead to wrongful conviction because of false testimony. Traditionally, to respond to the aforementioned pain point, both Taiwan and the United States apply traditional procedural tools including hearsay exception, the deviation from strict confrontation requirements and protection measures in trial proceedings. However, the traditional procedural tools might fail owing to children’s memory loss or the contamination from other people. To improve this situation, the United States introduced two new procedural tools—forensic interviewer and the multidisciplinary team. In Taiwan, many one-stop services have been set up in the past 10 years, and Article 15-1 of the Sexual Assault Prevention Act has gone into effect on January 1st, 2017. Nonetheless, this thesis suggests that there are certain flaws in applying the new procedural tools in Taiwan. This thesis will present the flaws in applying the two new procedural tools in Taiwan and propose solutions to the flaws by introducing the practice of applying the new procedural tools in the United States. We will also discuss whether it is possible to introduce Child Advocacy Center that is similar to that in the United States.

This work is introducing the processes which undergone in the Czechoslovak Justice during period of years 1948 and 1953. These processes resulted in complex change of the entire legal system in Czechoslovakia (CS). Newly established communist regime managed to build tight grip on power during the analyzed period of time. Changes of the justice, legal education and advocacy was analyzed by many excellent Czechoslovak scholars from area of law and contemporary history but their free publication was enabled after the fall of the communist regime in 1989. Important part of this work is analysis of the vital laws which was introduced during above mentioned period. First chapter is about important politician Alexej Cepicka, who was an architect of the whole judicial reform. Understanding of his role in the transformation of the society is necessary to understand the historical events. À l’été 2010, le gouvernement canadien a annoncé le remplacement du formulaire long obligatoire par l’Enquête nationale auprès des ménages, un questionnaire facultatif. Ce changement a causé beaucoup de réactions, parce que cela affectera la qualité et la continuité des données recueillies, qui servent à appliquer différents programmes et lois, et qui sont utilisées par de nombreux groupes dans leurs fonctions de recherche et de représentation. Le présent mémoire a pour objectif de comprendre pourquoi le recensement devient parfois le centre d’un conflit politique, quels acteurs sont impliqués, et pour quelles raisons. À l’aide d’une analyse comparative de cas antérieurs dans différents pays, nous identifions trois éléments nécessaires pour que la méthodologie du recensement devienne un enjeu politique. Il s’agit de la présence: (1) d’un aspect identitaire; (2) d’une dimension idéologique qui concerne particulièrement le rôle de l’État et l’action positive; et (3) de programmes ou d’objectifs gouvernementaux qui dépendent directement des données du recensement. Pour évaluer si ces trois facteurs sont également présents au Canada en 2010, nous avons effectué des entrevues avec les groupes qui ont contesté la décision de l’annulation du formulaire long obligatoire. Ces groupes ont contesté la décision devant les tribunaux, et ont évoqué les risques de non-respect du gouvernement envers ses obligations légales, notamment envers la Charte des droits et libertés. L’analyse de ce conflit nous permet aussi d’évaluer les relations entre le gouvernement canadien et la société civile, et le manque de ressources et d’opportunités auquel font face les groupes d’intérêt et les représentants de minorités à la recherche d’équité.<br>In 2010, the Canadian government announced the cancelation of the long-form mandatory census of 2011. It was replaced by the non-mandatory National Household Survey. Many protests were heard, because the data will be less accurate and there will be no continuity with the previous censuses. This data has many purposes, like the application of laws or governmental programs. Different groups also use it in research and advocacy activities. This master’s thesis analyses different situations of controversy over the census methodology, in various countries, to understand how it becomes a political conflict, who are the actors that get involved and why they do so. We find that 3 conditions are necessary to turn a census into a political battlefield. It is : (1) an identity concern; (2) an ideological dimension, about the role of the State and of affirmative action; and (3) the presence of laws or programs that depend directly on the census data. To test this affirmation, we interviewed groups that contested the decision of the cancelation of the mandatory long-form census in Canada in 2010. They took the case in front of the Courts, and think that the government has now the opportunity to escape from some of its obligations, one of which is the Canadian Charter of Rights and Freedoms. This controversy’s analysis shows patterns in the relations between the Canadian government and the civil society. Interest groups and minorities now face very little opportunity of doing advocacy activities before the federal government.

La recherche prend place dans le quotidien actuel de la sphère éducationnelle en Iran. Remarquons que l’Iran est État non occidental et islamique, mais ayant néanmoins adhéré au principe, plutôt occidental, de la Convention internationale sur les droits de l’enfant. Cette recherche s’insère dans une continuité de recherche au soutien des droits humains. Elle propose une voie d’empowerment aux groupes iraniens ouverts à la démocratie, mais aussi aux mouvements éducatifs soucieux des droits fondamentaux de la personne. Divisé en quatre chapitres, le questionnement hybride de la thèse conduit à un essai interdisciplinaire critique bénéficiant aux trois disciplines du droit, de la philosophie et de l'étude empirique. Face au système juridique international et iranien d'un point de vue juridique classique, le chapitre philosophique tend à répondre à la question de «que pourrait-on considérer non seulement du droit à l'éducation, mais également du droit à une « éducation appropriée » fondée sur des motifs éthiques et philosophiques dans le sens où cela conviendrait mieux à la culture iranienne et aux habitudes sociales ». À partir d’une approche philosophique— plus précisément d’une éthique de la vertu—, la thèse propose le concept d’«éducation appropriée » [proper education] comme approche critique des positions internationales et internes du droit à l’éducation de l’enfant. Y est présenté comme «éducation appropriée » un droit moral et juridique pour les enfants : ce droit relève alors de la catégorie des droits au développement qui servent le droit à un avenir ouvert et ainsi que le droit de s'épanouir pleinement. Le recours à ce concept propose ainsi conception du droit à l’éducation harmonisée au contexte iranien actuel. D'un point de vue empirique, à partir d’une approche inductive typique de la Human Rights Advocacy approach et sur la base de quatre-vingts (80) entretiens auprès d’enfants et d’enseignants, sont observés et analysés les écarts entre le droit officiel et les façons dont ils sont vécus, mobilisés, pensés ou niés dans la sphère de l’éducation iranienne aujourd’hui. Enfin, l’essai juridique critique suggère que la gouvernance iranienne soit ouverte à une évolution vers une autorité contractuelle moderne dans le système éducatif pour être plus compatible avec les besoins psycho-émotionnels des enfants et en même temps pour d'appliquer des conseils politiques de l'éthique de la vertu à se déplacer vers une forme libérale de politiques éducatives qui promeuvent les vertus de l’autonomie et de la tolérance. Ils sont autant d’informations cruciales pour une gouvernance législative iranienne avisée, ancrée à une quête islamique de vertu tout autant qu’au bonheur des enfants.<br>The research takes place in the current daily life of the educational sphere in Iran. It should be noted that Iran is a non-Western and Islamic state, but nonetheless adhered to the rather Western principles of the International Convention on the Rights of the Child. This research is part of a continuity of research in support of human rights. It offers a path of empowerment to Iranian groups open to democracy, but also to educational movements concerned with the fundamental rights of the person. Divided into four chapters, the hybrid questioning of the thesis leads to a critical interdisciplinary essay benefiting the three disciplines of law, philosophy and empirical study. Facing the international and Iranian legal system from a classical legal view, the philosophical chapter tends to respond to the question of “what could be considered not just the right to education, but the right to a “proper” education based in ethical and philosophical grounds in the sense that it would better suit Iranian culture and social habits than an allegedly “universal” [occidental] classical legal conception?". The empirical chapter, then, looks for the “Iranian social representations of the children’s rights that reveal the gap between the ideal expressed concept of “proper education” and day-to-day life of children?” with an advocative approach.
From a philosophical view —more precisely from virtue ethics stand point—the thesis proposes the concept of "right to proper education" as a critical approach to the international and internal positions of the right to education for children. "Proper education" is presented as a moral and legal right for children under the category of developmental rights which serves the right to an open future and the right to maximizing self-fulfillment. It is also a conception of the right to education harmonized with the current Iranian Islamic context. From an empirical standpoint, starting from a typical inductive approach of the Human Rights Advocacy approach and based on more than eighty (80) interviews with children and teachers, the gaps between the official laws and the ways in which they are experienced, mobilized, thought of or denied in the sphere of today Iranian education, are observed and analyzed. Finally, the critical legal essay suggests the Iranian governance to be open to a shift toward a modern contractual authority in educational system to be more compatible with the psycho-emotional needs of children and at the same time to apply the virtue ethics political advice to move toward a liberal form of educational policies that promotes the virtues of autonomy and toleration. These are all crucial information for wise Iranian legislative governance rooted in an Islamic pursuit of virtues as well as the happiness of children.

The theoretical part of the presented thesis illustrates how the criminal law has changed and what the system of a judiciary organization was. The second part of the thesis, based on the research of archival sources, focuses on district court and cases which falling within their jurisdiction on the example of the town Lišov in South Bohemia in the years 1918-1939. Attention is payed on a local municipal police, as well as the persons of judges and notaries.

Children's right to participate in judicial and administrative matters that affect
them is perhaps the most frequently overlooked children's right, globally. This
research was a descriptive study of what exists with regard to children's
participation, at the Office of the Family Advocate, when parents divorce.
The methods of data collection used included a content analysis (quantitative
method) a focus group interview (qualitative method) and review of the literature
and legislation. The content analysis involved analyzing the data of forty case
files involving disputed cases, according to a content analysis schedule. The
focus group interview was conducted with family advocates and family
counselors and focused on various factors that facilitate or impede children's
participation at the enquiry.
The data obtained was analyzed manually and presented in the form of pie
charts, tables, discussions and quotes. From the content analysis the researcher
found that most children had definite views regarding their future care. One of the
factors that hinder children's participation at the enquiry is the fact that not all
enquiries are conducted using the team approach. The research also indicates
that the adversarial nature of divorce proceedings impact negatively on children's
participation and a more conciliatory approach would prove more child-centered.
The focus group interview indicates that the professionals involved have positive
attitudes towards children's views and participation in the enquiry. Children's
expressed wishes are considered in conjunction with other factors such as the
bond between parent and child, and the suitability of the parent. The focus group
participants made various suggestions with regard to ensuring a more child centered
approach regarding children's participation. The researcher presented
the major findings, together with recommendations for future research at the end

Indiana University-Purdue University Indianapolis (IUPUI)<br>By definition, homelessness refers to general understanding of people without a home or a roof over their heads. As consequences of a number of factors, homelessness has become a serious problem especially in cities throughout the United States. Homeless people are usually most visible on the streets and in settings like shelters due to the fact that their presences and activities in public spaces are considered illegal or at least “unwanted” by city officials and by members of the public. In response to this issue, activists throughout the country have worked tiresly on behalf of homeless people to demand policy changes, an effort that resulted in the passage of the homeless bill of rights in three states, namely Connecticut, Rhode Island, and Illinois. As I discovered through my fieldwork, in Indiana, the homeless, themselves, are currently lobbying for passage of a similar measure.
Locating my fieldwork on homelessness in Indianapolis in two sites, the Indianapolis Marion County Public Library (the Central Library) and the IUPUI Library, I examine the use of library buildings as alternative temporary shelters and spaces where the homeless can organize for political change. As an Indonesian ethnographer, I utilized an ethnographic approach, which helped me to reveal “Western values” and “American culture” as they play out in the context of homelessness. In this thesis, I show that there is a multi-sited configuration made up of issues, agents, institutions, and policy processes that converge in the context of the use of library buildings by the homeless.
Finally, I conclude that public libraries and university libraries as well can play a more important role beyond their original functions by undertaking tangible actions, efforts, engagements, and interventions to act as allies to the homeless, who are among their most steadfast constituencies. By utilizing public university library facilities, the homeless are also finding their voices to call for justice, for better treatment, and for policies that can help ameliorate the hardship and disadvantages of homelessness.
