Abstract:
This thesis is a doctrinal analysis of the legislation and case law in Australia regulating destruction of the fetus in the contexts of third party crimes against the pregnant woman, abortion, and conscientious objection by doctors to participating in abortion. Its aim is to consider whether there is a consistent position in Australian law regarding the legal status of the fetus and when its destruction is lawful. This thesis examines the dichotomy present in the criminal law's characterisation of the pregnant woman and the fetus as one entity when the fetus is destroyed through an assault on

The term "exonerated"‖refers to a legal acquittal of a former conviction due to the introduction of new evidence. Since 1989, the number of legal xonerations has increased dramatically due to DNA and other new evidentiary technologies that can demonstrate innocence of formally convicted persons. This research focuses on the lived experience of exoneration and its aftermath through a life history of John Thompson (JT), a New Orleans native, convicted of murder and sentenced to death in 1985. This thesis is about the legal and moral status of abortion. It is primarily concerned with the metaphysical status of the foetus, with particular attention to the question whether the foetus is properly characterised as a person in the philosophical sense. The argument of the thesis proceeds in two parts. The first part surveys certain lines of argument to the effect that the question of prenatal personhood is immaterial to the moral and legal permissibility of abortion. Against these claims, it argues that the personhood status of the foetus is indeed central to the moral and legal appraisal
