In 2017 alone, the value of deals signed using project finance was estimated at approximately $229 billion. This project uses Michel Foucault’s underdeveloped notion of “tolerated illegality” as a departure point for two converging inquiries. The first analyzes, and then critiques, dominant legal logics and values. American jurisprudence currently applies two incompatible validity standards to determine which laws are enforceable.
