Abstract:
All sharia economic court decisions in Indonesia are supposed to include sharia principles as the basis for adjudicating the case. Therefore, the judges must be able to understand the legal norms of sharia economics. This study aimed to explore how fundamentalistic maxims (al-qawāʿid al-uṣūliyyah) and jurisprudential maxims (al-qawāʿid al-fiqhiyyah) as parts of sharia economic legal norms or sharia principles were used by judges as legal argumentation in court decisions. We analyzed 384 court decisions categorized as sharia economic cases on the Indonesian Supreme Court website from April 20, 2016, to April 20, 2020, and set them as a universe of cases. Each decision that contained the maxim (qāʿidah) in its legal consideration was selected as relevant case sample and was then analyzed to find how the maxim was used as legal argumentation to respond to a petition and/or demurrer. Then, we found 15 legal maxims from 28 legal argumentations of 14 decisions (3.65% of the universe of cases). In general, the use of those maxims as legal argumentation has already conformed to their conventional usage with a few notes related to specific legal findings (rechtsvinding) in sharia economic cases.

Abstract:
Legal maxims written in Latin are a constant in European and American legal cultures, where they have great authority due to perceived antiquity and origins in Roman law. However, sometimes these maxims are actually fairly recent, neologisms that only purport to be ancient. The purpose of this article is to explore one such maxim, pacta sunt servanda, agreements have to be upheld, and the cultural, political and legal connotations and contemporary significances that the phrase has. Through the convoluted history of the maxim pacta sunt servanda, the article explores the role of tradition and history in the making and legimitizing rules.

Reporting on the Kompas TV Youtube channel always provides interesting and up-to-date information so that it becomes a public discussion, one of which is the Ferdy Sambo case which has become a hot topic of conversation since July 2022. This writing aims to find out politeness in language and flouting of maxims on the Kompas TV Youtube channel entitled " Legal Counsel Ask Ferdy Sambo about Elizer's future responsibilities to the CCTV issue!”. The form of speech in this paper is a form of speech that adheres to the politeness principle and is translated into the maxims put forward by Leech in a pragmatic study. Collecting data using observing and note techniques then analyzed. As a result of writing, the Kompas TV Youtube channel adheres to the politeness principles (maxims), namely: the maxim of wisdom, the maxim of generosity, the maxim of appreciation, the maxim of modesty, the maxim of modesty, the maxim of agreement, the maxim of sympathy. Apart from that, there were also violations of the maxims, namely: a) the maxim of wisdom, b) the maxim of modesty, c) the maxim of sympathy.

The increasing, often controversial, roles of the Indonesian Ulama Council or Majlis Ulama Indonesia (MUI) in society have attracted scholars to study the institution, including its fatwas and their arguments. This study examines how legal maxims (qawa'd fiqhiyyah) had been used to construct the arguments of MUI's fatwas. This study also identifies the legal maxims used, observes their frequencies, and determines the patterns of their application. Legal maxims are important since they show principles and logic to discover legal norms. Some 118 fatwas on ritual, Shariaheconomic, and socio-cultural issues are examined. This study found that 25 legal maxims had been used by the MUI's fatwas, with five being most frequently referred to. On average, each fatwa referred to 1.23 legal maxims. Fatwas on economic issues used most legal maxims with an average of 2.14, while those on socio-cultural and ritual issues used only 0.66 and 0.47 legal maxims on average, respectively. Fatwas on economic issues seemed to be the most dynamic ones.

Abstract:
This thesis analyses al-qawa'id al-fiqhiyyah (Islamic legal maxims), one of the significant disciplines of Islamic legal thought. It aims to introduce the subject theoretically and practically. For the former, it introduces the principal abstract areas relating to the discipline: namely, definition, functions, types, sources, relationship with other disciplines of Islamic legal thought. It also traces the historical development of the discipline from the earliest stages to recent times. These areas are covered in the first two chapters, which comprise almost half of the whole thesis. For the practical element of the thesis, the discussion aims to present the various practical applications of al-qawa'id al-fiqhiyyah through two means. First, examining the so-called al-qawa'id al-khams al-kubra (the five universal maxims) and al-qawa'id al-kulliyyah (the general maxims), which have been seen as representative of the entire field, due to their large scope of application over the fiqh particulars. The discussion mostly contains the examples that jurists have adduced in the course of history. In some cases, however, examples of contemporary issues have also been added. The main focus is to show the significance of qawa'id in categorizing the scattered and, sometimes, unmanageable fiqh cases into general principles. This is presented in two chapters: the third and fourth. Second, examining the use of al-qawa'id al-fiqhiyyah in deducing legal determination for contemporary issues. Six medical issues have been selected to be study cases in this regard. The aim is to show the importance of qawa'id in the area of ijtihad and finding out the legal status for the novel issues. This has been presented in the last chapter.

Abstract:
The work is divided into two parts. The first one, that introduces to the second part, aims at investigating the nature of regulae juris, used as mean of generalisation by the medieval jurists. This part is divided into three chapters. In the first chapter one studies how the terminology came out in the documents concerning Roman law. In the meantime, it’s made clear the terminology corresponds to a different conceptualization from the medievals': whereas for the first ones, the regula is the decision made for the specific cases, for the second ones it corresponds to a general principle. In the second chapter we study the literary genre in the Middle Ages, taking advantage of the most important authorities, that stressed their attention especially on two points: - the regulae juris can be extended to other cases, - the mean of the exceptions. The framing of the authorities was made almost by civil lawyers while canon lawyers adopted the civil lawyers' categories, especially with the figure of Dino Mugellano. In the third chapter we study the evolution of the jurists' s thought in the modern area, before the process of codification began. The regula became synonym of rule of law. The second part is consisted on the copy and the translation of the Tractatus de regulis juris edited by Anaclet Reiffenstuel in 1733<br>Il lavoro si divide in due parti. La prima parte, che funge da introduzione alla seconda, intende indagare la natura delle regulae juris, strumento di generalizzazione ed astrazione utilizzato dai giuristi medievali. Questa parte si suddivide in tre capitoli. Nel primo di essi si studia l’emergere della terminologia nelle fonti romanistiche e nello stesso tempo si specifica che alla terminologia, pure utilizzata, corrisponde una concettualizzazione diversa da quella dei medievali: mentre per questi ultimi la regula è la decisione per il caso concreto, per i medievali corrisponde al principio generale. Nel secondo capitolo si studia il genere letterario in epoca medievale, attingendo alla dottrina giuridica più importante, la quale si è interessata particolarmente a due temi: la normatività o meno delle regulae juris e l’inquadramento delle eccezioni. L’elaborazione dottrinale in materia è opera esclusiva dei legisti mentre i canonisti si limitano a trasporre e lo strumento e la relativa elaborazione nel loro ambito specifico, specie attraverso la figura di Dino del Mugello. Nel terzo capitolo si studia lo svolgersi della dottrina in materia nell’epoca moderna sino alle soglie della codificazione, specificando come alla chiara elaborazione medievale ora si sostituisce un più ampio ventaglio di ricostruzioni, le quali tutte tendono ad identificare tuttavia regula juris con la norma giuridica. As alterações funcionais e anatômicas provocadas pelo dano físico podem afetar o indivíduo psicologicamente, pela perda ou diminuição de capacidade de mastigação, fonação e estética. Pelas particularidades das lesões, este trabalho objetivou delinear o perfil epidemiológico, avaliando as vítimas, bem como os tipos, causas e resultantes dos traumas bucomaxilofaciais por violências e acidentes, e as injúrias causadas por intervenção odontológica. O desenho metodológico do estudo foi analítico-descritivo, de corte transversal, e foram avaliados, retrospectivamente do período de janeiro de 2007 a dezembro de 2013, 3.600 laudos de periciados que apresentavam lesões de cabeça e pescoço, atendidos na Clínica Odontológica do Instituto Médico Legal Nina Rodrigues, Salvador- BA. Avaliaram-se 3.455 laudos referentes a agressões, acidentes de trânsito e acidentes em geral, relacionando com perfil sociodemográfico, região acometida, dano, agente etiológico e resultante. Os dados neste bloco foram analisados pelo teste de qui-quadrado ou por meio do teste de qui-quadrado da razão de verossimilhança, sendo definido o uso do coeficiente de V de Cramer para quantificação da associação. Constatou-se que houve maior prevalência de casos que envolviam 56,06% homens, 80,72% pessoas adultas e 72,19% faiodermas; as agressões apresentaram relevante número de ocorrências (74,18%), atingindo os tecidos duros e moles (42,72%). Identificou-se, também, a predominância de lesões dento-alveolares em relação ao número total de traumas bucomaxilofaciais (67,73%); causados por agente contundente (92,72%)...<br>The maxillofacial trauma is one of the issues most important public health in the world, influenced by factors of social, cultural and economic. The functional and anatomical changes caused by physical damage can affect the individual psychologically, by the loss or impairment of chewing ability, speech and aesthetics. The peculiarities of the lesions, this study aimed to describe the epidemiological profile, assessing victims as well as the types, causes and resulting from maxillofacial trauma caused by violence and accidents, and injuries caused by dental work. The methodological design of the study was analytical-descriptive, cross-sectional, and were evaluated retrospectively from January 2007 to December 2013, 3,600 periciados of reports with head and neck injuries treated in the Dental Clinic of the Institute of Forensic Medicine Nina Rodrigues, Salvador BA. We evaluated 3,455 reports relating to assaults, traffic accidents and accidents in general, relating to socio-demographic profile, affected region, damage, and resulting etiologic agent. The data in this block were analyzed by chi-square test or the chi-square test of the likelihood ratio, defined using the V Cramer coefficient to quantify the association. It was found that there was a higher prevalence of cases involving 56.06% male, 80.72% and 72.19% adults faiodermas; of abuse has significant number of occurrences (74.18%), reaching the hard and soft tissues (42.72%). It was identified as well, the predominance of dento-alveolar lesions compared to the total number of maxillofacial trauma (67.73%); caused by blunt agent (92.72%)...

Abstract:
This PhD dissertation is about legal fictions in private law. A legal fiction, broadly, is a false assumption knowingly relied upon by the courts. The main aim of the dissertation is to formulate a test for which fictions should be accepted and which rejected. Subsidiary aims include a better understanding of the fiction as a device and of certain individual fictions, past and present. This research is undertaken, primarily, to establish a rigorous system for the treatment of fictions in English law - which is lacking. Secondarily, it is intended to settle some intractable disputes, which have plagued the scholarship. These theoretical debates have hindered progress on the practical matters which affect litigants in the real world. The dissertation is divided into four chapters. The first chapter is a historical study of common-law fictions. The conclusions drawn thereform are the foundation of the acceptance test for fictions. The second chapter deals with the theoretical problems surrounding the fiction. Chiefly, it seeks precisely to define 'legal fiction', a recurrent problem in the literature. A solution, in the form of a two-pronged definition, is proposed, adding an important element to the acceptance test. The third chapter analyses modern-day fictions and recommends retention or abolition for each fiction. In the fourth chapter, the findings hitherto are synthesised into a general acceptance test for fictions. This test, which is the thesis of this work, is presented as a flowchart. It is the author's hope that this project will raise awareness as to the merits and demerits of legal fictions, de-mystify the debate and bring about reform.

Este estudo investigou o trauma buco-maxilo-facial decorrente de violência interpessoal quanto à epidemiologia e implicações criminais, bem como avaliou a importância da documentação clínica nos exames de corpo de delito. Foi realizado estudo observacional retrospectivo envolvendo 1.048 relatórios odontológicos de corpo de delito gerados nos anos de 2012 e 2013, na cidade do Rio de Janeiro, RJ, Brasil. Violência interpessoal foi causa de trauma buco-maxilo-facial em 405 (38,6%) exames, envolvendo principalmente homens jovens, brancos e solteiros. O agente lesivo mais comum foi o soco. Os tecidos moles foram os mais lesionados, sendo a equimose a lesão prevalente. Os ossos mais fraturados foram maxila e mandíbula. Os dentes anteriores mostraram maior incidência de fraturas coronárias. Quanto à classificação penal, predominou o dano corporal leve, sendo que as lesões somente aos dentes implicaram dano leve, grave e gravíssimo. Houve apresentação de documentação clínica em 132 (32,6%) exames periciais. O trauma buco-maxilo-facial decorrente de violência interpessoal alcançou níveis preocupantes nos dois anos do estudo, representando a documentação clínica importante meio de prova particularmente nos exames de corpo de delito indireto. This study aimed to investigate the oral maxillofacial trauma caused by interpersonal violence regarding its epidemiologic and criminal implication aspects, as well as to evaluate the importance of clinical documentation in forensic exams. A retrospective observational study has been conducted involving 1,048 forensic dental reports generated in the years 2012 and 2013 in the city of Rio de Janeiro, RJ, Brazil. Interpersonal violence was the cause of oral maxillofacial trauma in 405 (38.6%) exams, involving mainly young, white and unmarried men. The most common harmful agent was the punch. The soft tissues were most injured, being bruise the predominant injury. The more fractured bones were maxilla and mandible. Anterior teeth showed a higher incidence of crown fractures. Regarding criminal classification, light body damage predominated and teeth-only injuries implied light, severe and very severe damage. There was presentation of clinical documentation in 132 (32.6%) forensic exams. It was found that the oral maxillofacial trauma due to interpersonal violence has reached alarming levels in both years of study, being the clinical documentation an important mean of obtaining evidence, particularly in indirect forensic examination. A invisibilidade da violência contra a mulher revela-se em taxas subestimadas de sua ocorrência, tornando-se um problema a ser enfrentado pela saúde. A cabeça e face são freqüentemente comprometidas pelos traumas, o que aponta para estudos de avaliação da complexidade anatômica, funcional e estética destas estruturas e das conseqüências à saúde da mulher. Objetivou-se estudar os casos de lesões corporais dolosas que tiveram comprometimento no complexo maxilomandibular entre mulheres que compareceram ao Instituto Médico Legal de Ribeirão Preto para exame de corpo de delito. A amostra compôs-se de 67 mulheres atendidas no período de maio de 2005 a outubro de 2006. É um estudo descritivo exploratório que utiliza de abordagem quantitativa para estabelecer o perfil das vítimas e agressores além da tipificação da violência. Foram analisados os traumas no complexo com base na análise clínica odontológica, os quais foram fotografados para a devida classificação jurídica da lesão. A abordagem qualitativa de entrevistas realizadas com base na técnica da análise temática, com vista a compreender a visão das mulheres sobre a violência sofrida, as conseqüências a sua saúde e formas de enfrentamento. Os dados foram coletados em dois momentos durante o exame pericial e no retorno após 30 dias. Foram seguidas as normas éticas para pesquisa envolvendo seres humanos. As mulheres tinham em média 31,5 anos, a maioria declarou-se branca. Todas as mulheres eram alfabetizadas; a maioria pertencia a classificação sócio-econômico C e E segundo a ABA/ABIPEME. 9% das mulheres estavam desempregadas e 23,9% eram do lar. A idade média dos agressores foi de 39 anos, 62,7% dos agressores trabalhavam como autônomos e a cor branca prevaleceu entre os agressores (58,2%). 91,04% dos casos, os agressores utilizaram do corpo como agente provocador de agressão, através de socos, pontapés e empurrões. Na classificação jurídica das lesões, 50 (74,6%) foram consideradas leves; 12 (17,9%) como graves e 5 (7,5%) como gravíssimas. Para o exame clínico odontológico foram construídos alguns indicadores, com base na anatomia e fisiologia do complexo maxilomandibular. Analisando as falas das entrevistadas, depreendemos 04 categorias temáticas centrais: Contexto da violência; Rede de Suporte e Ajuda; Compreensão da violência sofrida; Conseqüências para sua saúde. O conhecimento e o entendimento dos agravos que interferem a saúde bucal e a saúde da mulher promovem uma reflexão sobre as condições de vida e saúde, contribuindo para a realização de ações preventivas nas diversas áreas, assim como no planejamento de ações assistenciais que vão desde o atendimento das emergências até a reabilitação e a reintegração junto à sociedade, frente a qual a Odontologia juntamente com outras disciplinas tem importante papel.<br>The invisibility of violence is checked in the underestimated rates of its real occurrence. It\'s a problem to be faced for health area due to all physical and mental problems cause by this in woman\'s health. The most common region affect in a violence episode is the head and face. That\'s why studies about the complexity of anatomy, physiology and aesthetic of those structures are so important. Our aim in this study was to study all women who have gone to the IML/RP to exam of their bodies. The period of the study was May, 2005 to October, 2006. During this period, 284 women were seen in that service, but just 67 (23,59%) had face injuries. One questionnaire was applied in order to provide data about the woman\'s profile, all data was analyzed by using SPSS Program. Qualitative analysis was also developed with all 67 women by using Thematic Analyses in order to understand the perceptions about the suffered violence, health consequences and pathways of reaction. The cases with craniomaxilal injuries were verified and categorized in legal deontology principles. Data were collect in two distinct moments: first in the first day of exam, second in the return (30days). All ethical rules were respected in the whole study steps. The average age was 31,5 years-old, with minimum of 19 and maximum of 44 years-old. All of them studied, among them 41,8% did the first degree and 37,3% did the second one. The criteria established by ABA/ABIPEME were used to estimate the economical condition. Only 9% of women were unemployed and 23,9% were homecare. The age of aggressor goes from 16 to 62 years. The media age was 39 years, 42% of them were free workers and most of them were white(58,2%). Most of aggressors were partners or ex-partners, and the use of alcohol and drugs was significant. The men\'s bodies were used as guns against their women: slaps, kicks were most common expressions of violence. Judicial classification of lesions were distinguished as: 50 (74,6%) light, severe in 12 (17,9%) and very severe in 5(7,5%). For oral examination a protocol was developed by respecting the anatomy and physiology of maxillofacial structures. Analyzing the statements of women 04 categories were defined: Violence context, Net Support and Help, Understanding the suffered violence and Health Consequences. The knowledge of the facial injuries that affect so many women makes us to reflect about health and life conditions of many women around the world, how suffering is happening away and nobody knows. This study contributes to many discussions about this issue and also helps on the planning of assistance actions since the first contact with the victimized women until their whole reintegration and rehabilitation, in witch Dentistry has an important role.

A proper normative interpretation is undoubtedly one of the pillars of Law, all this thanks that brings a juridical security level and predictability to all the parties involved. In that sense the author submits a critique about the criteria that have been emitted by the diverse public  organisms  in  environmental  material,  specifically  with  the  juridical  concept  of«environmental damage» in the excess inside Maximum Permissible Limit. Also the article presents an objective focus through a temporal development of diverse administrative resolutions, which are established as incorrect on the basis of a wide and forced interpretation about environmental damage, concept applied not only in a case with real effects, but also potential ones. Finally, this is provided by the author as a defect, that although actually exists a remedial intention, this must begin from a clear conceptual framework in normative and resolutive topics by equal.<br>Una debida interpretación normativa, se constituye sin duda alguna, como uno de los pilares del Derecho, ello gracias a que otorga un nivel de seguridad jurídica y predictibilidad a todas la partes involucradas. Es en ese sentido, que el autor sostiene una crítica sobre el criterio que han venido emitiendo en instancia administrativa diversos organismos públicos en materia ambiental, específicamente con respecto al concepto jurídico de «daño ambiental» en el exceso de los Límites Máximos Permisibles (LMP). El artículo nos presenta un enfoque objetivo con un desarrollo temporal de diversas resoluciones administrativas, las cuales manifiesta, son erróneas en base a una interpretación amplia y forzada de lo que es daño ambiental, concepto que se aplica no solo para aquellos supuestos con efectos reales, sino también potenciales. Finalmente, ello es señalado por el autor como un defecto, que si bien en la actualidad existe una intención de subsanarlo, esto debe partir principalmente de un marco conceptual claro tanto en el ámbito normativo como resolutivo.

This chapter puts together a number of such legal maxims of concern to halal and haram for better understanding, especially for nonspecialists. In the paper, the authors analyze the legal position of the limited liability company, primarily from the aspect of the establishment and operation of the company in comparative law. Regardless of how it is legally regulated, a limited liability company has the same basic characteristics in different national legislations. This company, which is an independent legal entity, has a basic capital and is responsible for obligations with all its assets. In contrast, the members of the company do not assume responsibility for the company's obligations. Due to its characteristics, the limited liability company is the most common legal form for the establishment of small and medium-sized enterprises in the EU. Experiences from business practice have shown that the faster procedure for registering a company and differences in the prescribed amount of the lowest founding capital required for its establishment greatly influence the choice of the member state in which the company will be established. Some legal systems prescribe the maximum number of members a limited liability company can have. Also, in some countries, establishing a limited liability company is strictly formal. In the paper, the authors particularly point out that there is a possibility of electronic incorporation in the case of a single-member company with limited liability. The methods used by the authors are comparatively legal, historical and normative.

Tax amnesties have taken centre stage as a compliance tool in recent years. The OECD estimates that since 2009 tax amnesties in 40 jurisdictions have resulted in the collection of an additional €102 billion in tax revenue. A number of African countries have introduced tax amnesties in the last decade, including Nigeria, Namibia, South Africa and Tanzania. Despite their global popularity, the efficacy of tax amnesties as a tax compliance tool remains in doubt. The revenue is often below expectations, and it probably could have been raised through effective use of regular enforcement measures. It is also argued that tax amnesties might incentivise non-compliance – taxpayers may engage in non-compliance in the hope of benefiting from an amnesty. This paper examines the administration of tax amnesties in various jurisdictions around the world, including the United States, Australia, Canada, Kenya and South Africa. The paper makes a cost-benefit analysis of these and other tax amnesties – and from this analysis develops a model tax amnesty, whose features maximise the benefits of a tax amnesty while minimising the potential costs. The model tax amnesty: (1) is permanent, (2) is available only to taxpayers who make a voluntary disclosure, (3) relieves taxpayers of penalties, interest and the risk of prosecution, but treats intentional and unintentional non-compliance differently, (4) has clear reporting requirements for taxpayers, and (5) is communicated clearly to attract non-compliant taxpayers without appearing unfair to the compliant ones. The paper then focuses on the Ugandan tax amnesty introduced in July 2019 – a Voluntary Disclosure Programme (VDP). As at 7 November 2020, this initiative had raised USh16.8 billion (US$6.2 million) against a projection of USh45 billion (US$16.6 million). The paper examines the legal regime and administration of this VDP, scoring it against the model tax amnesty. It notes that, while the Ugandan VDP partially matches up to the model tax amnesty, because it is permanent, restricted to taxpayers who make voluntary disclosure and relieves penalties and interest only, it still falls short due to a number of limitations. These include: (1) communication of the administration of the VDP through a public notice, instead of a practice note that is binding on the tax authority; (2) uncertainty regarding situations where a VDP application is made while the tax authority has been doing a secret investigation into the taxpayer’s affairs; (3) the absence of differentiated treatment between taxpayers involved in intentional non-compliance, and those whose non-compliance may be unintentional; (4) lack of clarity on how the VDP protects the taxpayer when non-compliance involves the breach of other non-tax statutes, such as those governing financial regulation; (5)absence of clear timelines in the administration of the VDP, which creates uncertainty;(6)failure to cater for voluntary disclosures with minor errors; (7) lack of clarity on VDP applications that result in a refund position for the applicant; and (8) lack of clarity on how often a VDP application can be made. The paper offers recommendations on how the Ugandan VDP can be aligned to match the model tax amnesty, in order to gain the most from this compliance tool.
