The new nomenclature of scientific specialties for legal sciences, approved in Russia in 2021, is analyzed. The theoretical and practical inconsistency of the formulation of the first of the five positions in this Nomenclature in the section of legal sciences – "theoretical and historical legal sciences" is shown.
