Gindis, David. "The nexus paradox : legal personality and the theory of the firm." Thesis, University of Hertfordshire, 2013. http://hdl.handle.net/2299/11351.

Full text
Abstract:
In the last four decades, one of the fastest-growing fields of research in economics has been the contractual theory of the firm developed in Coase’s (1937) footsteps. Yet despite what otherwise seems to be a genuine success story the question of the nature of the firm remains an empirical and theoretical challenge, painfully illustrated by the lack of consensus regarding the definition and boundaries of the firm. The argument of this thesis is that many thorny questions that plague the literature, including issues related to ownership, boundaries, and intra-firm authority, are due to the fact

Abstract:
The trend in development discourse is to explain underdevelopment in terms of bad governance which lack of rule of law brings about. Development in this sense is understood as economic growth while rule of law is limited to an institutional version which is market-oriented. In this thesis, development is examined from a people-centred perspective. Abject poverty, dysfunctional educational and health systems sitting side by side with reasonably sufficient oil wealth is the problematic premise which the thesis seeks to explain. As of May 2016, the U.S. State Department officially declared a priority date for all green cards for applicants from El Salvador, Guatemala, and Honduras that capped the number of visas granted to individuals from these three countries to just 10,000 per year. This inherently created a two to three-year backlog for Special Immigrant Juvenile Status applicants from these countries as well, meaning that SIJS petitioners will remain undocumented for periods of up to six years until their petition is adjudicated by USCIS and their priority date arrives. Abstract:
The existence of the oath in the courtroom can be traced back thousands of years throughout history, but the use, meaning, and effect of the oath in law has changed dramatically. The oath as we know it was once a powerful truth-telling instrument that our ancestors used to call upon a higher power. It was the belief of many that the oath itself was not sworn to man or state, but rather directly to a deity. The oath has since then evolved as a result of ever changing beliefs, fueled by increasing tolerance, shaping the oath into more of a tradition, and less of an edict. For centuries, theorist

When should it be permissible to act against someone's expressed wishes in their best interests? In both political philosophy and legal practice, answers to this question often appeal to the concept of autonomy. Broadly, the idea is that if a person is sufficiently self-governing, then their wishes must prevail; but if they are not, then their wishes need not be respected when promoting whatever is good for them. This thesis analyses both philosophical models of autonomy and the practice of judges in England and Wales when implementing the Mental Capacity Act 2005. With regard to the philosoph

Legal empowerment as a theoretical and practical concept has gained increasing attention in international development. Due to the shifting aid paradigm, caused by the rising of South-South cooperation, legal empowerment’s proposed bottom-up character has challenged the larger conventional top-down approaches to development that traditionally have dominated the development agenda. Nevertheless, studies examining legal empowerment have failed to analyse whether the concept is produced in a top-down setting and hence omitted possible power imbalances that the discourse might be hiding.
