Abstract:

Studien undersöker om den svenska aktiemarknaden i regel presterar sämre mellan månaderna maj och september enligt den så kallade “ sell-in-may-and-go-away- effekten”. Vi använder den logaritmerade avkastningen för det svenska indexet OMXS30 som delas upp i olika perioder; maj till september, samt oktober till april. Avkastningen för dessa perioder jämförs genom att använda en regressionsmodell. Resultatet från undersökningen visar att effekten är positiv, samt signifikant på en-procentsnivå mellan 1986 till 2017 för OMXS30 iSverige. Studien tittar även på sell-in-may-and-go-away- effektens utveckling, och finner indikationer för att effekten avtar efter publiceringen av Bouman & Jacobsens undersökningav effekten år 2002. Indikationen på att effekten avtar kan betyda en högre grad av rationalitet hos investerare samt en mer effektiv marknad allt eftersom sell-in-may-and-go-away- effekten blir mer allmänt känd. Resultatet för att effekten skulle vara avtagande är dock inte statistisk signifikant och därmed inte heller statistiskt säkerställd.

Der Lesesaal hat seit dem 19. Jahrhundert die Bibliotheken grundlegend verändert. Alles, was mit der Aufbewahrung und Benutzung von Büchern zu tun hatte, bekam einen neuen Sinn, als man die Bereiche der Leser von denen der Bibliothekare trennte. Bibliotheken integrieren seitdem zwei Bewegungsformen, einmal das Suchen, Finden und Aneignen der Bücher durch die Benutzer und zum anderen das Aufnehmen, Ordnen und Bereitstellen der Bücher durch das Personal. Es sind zwei Kulturen oder Wissenstechnologien, die durchaus nicht die gleiche Geschichte haben, wohl aber ein gemeinsames Zentrum: den Lesesaal. Die Geburt des Lesesaals...

Abstract:

This article analyses the impact of the IOTA distributed ledger technology (DLT) on smart cities. The world population is rapidly increasing while at the same time trends such as urbanization shape future demographics. Thus, fast-growing cities face the challenge of increasing demands in resources such as energy, water, transportation, while at the same time aiming to increase life quality by reducing burdens such as pollution and waste. The concept of a “Smart City” emerged with the ambition to solve a city’s issues by creating social and economic advantages while providing efficient resource allocation processes. Nevertheless, current information communication technologies tend to underperform a smartcities systems requirement since the quantity of connected devices increases which slows down the transition of a city becoming smart. The distributed ledger technology IOTA promises to enable automated, feeless transactions and processes with a high level of integrity, which may impact the development of smart cities. In this research the IOTA technology is introduced and investigated. The advantages of IOTA compared to conventional information communication technologies and the blockchain technology are highlighted. Thereafter, the current state of IOTA in smart cities is reviewed by analysing current research and use cases. To investigate the concept of a smart city the smart city initiative framework, including its subcategories is introduced. Additionally, different experts working on IOTA integrations related to smart city initiatives were interviewed giving insights into their field ofexpertise. Finally, an analysis and discussion of the IOTA technology use cases are put into relation with the multi-level perspective framework (Geels, 2006) highlighting the positive impact of IOTA on the development of smart cities.
I den här artikeln analyseras effekterna av IOTA:s teknik för distribuerade huvudböcker (DLT) på smarta städer. Världens befolkning ökar snabbt samtidigt som trender som urbanisering formar framtidens demografi. Snabbt växande städer står därför inför utmaningen att öka kraven på resurser som energi, vatten och transporter, samtidigt som de strävar efter att öka livskvaliteten genom att minska belastningar som föroreningar och avfall. Begreppet smart stad uppstod med ambitionen att lösa stadensproblem genom att skapa sociala och ekonomiska fördelar och samtidigt tillhandahålla effektiva processer för resursfördelning. Den nuvarande informations- och kommunikationstekniken tenderar dock att inte uppfylla kraven på system för smarta städer, eftersom mängden anslutna enheter ökar, vilket gör att övergången till en smart stad blir långsammare. Den distribuerade huvudbokstekniken IOTA lovar att möjliggöra automatiserade, felfria transaktioner och processer med en hög grad av integritet, vilket kan påverka utvecklingen av smarta städer. I den här forskningen introduceras och undersöks IOTA-tekniken. Fördelarna med IOTA jämfört med konventionell informationskommunikationsteknik och blockkedjetekniken lyfts fram. Därefter granskas det nuvarande läget för IOTA i smarta städer genom att analysera aktuell forskning och användningsfall. För att undersöka begreppet smart stad introduceras ramverket för initiativet för smarta städer, inklusive dess underkategorier. Dessutom intervjuades olika experter som arbetar med IOTA-integrationer isamband med initiativ för smarta städer för att ge en inblick i deras expertisområde. Slutligen analyseras och diskuteras IOTA-teknikens användningsområden i förhållande till ramverket för flernivåperspektivet (Geels, 2006), där IOTA:s positiva inverkan på utvecklingen av smarta städer lyfts fram.

Abstract:

A presente pesquisa tem como objetivo compreender a produção do espaço e de suas representações no bairro Restinga - Porto Alegre/RS. São construções atravessados por materialidades, idéias, intenções e vidas, que formam, de forma contraditória, complexa e singular, o bairro. Sua produção material é indissociável de seus imaginários e, embora o espaço seja abstração, é também materialidade na vida das pessoas, envolvendo desde a ordem distante, do Estado e instituições, até a ordem próxima, dada pelas relações em redes ou de vizinhança. Nesse sentido, a produção do espaço é acompanhada por distintas (e contraditórias) representações, constituídas dentro e fora da Restinga. São imaginários que originaram com a produção do bairro e a remoção das malocas, reproduzindo hoje, sob outras roupagens, as distâncias sociais. Contudo, o morador que encontra no bairro o abrigo dentro de uma sociedade desigual, constitui valores positivos, dissociando-o dos imaginários que o estigmatizam. É nesse sentido, que fatos e idéias compõem o viver do morador da periferia, constituindo os vínculos entre sujeito e bairro, em elaborações constantes do espaço de representação.
This research aims to understand the production of space and its representations at Restinga neighborhood, in Porto Alegre, RS. They are constructions built by materialities, ideas, intentions and lives, which form, in a contradictory, complex and singular way, this neighborhood. Its material production is not separable from its imaginary and, although the space is abstraction, it is also materiality in people's lives, evolving from the distant order - State and institutions - to the nearer order, given by the relationships of neighborhood or in nets. Thus, the production of space is kept up with distinct (and contradictory) representations, formed inside and outside Restinga. These imaginaries were created with the production of the neighborhood and the removing of the poorest handmade houses, which reproduces, in another way, the social distances. However, the person who finds in the neighborhood a shelter inside an unequal society has positive values, undoing it from the imaginaries that stigmatize it. Facts and ideas compound the people from outskirts' lives, which build the links between individual and neighborhood, in constant elaborations of space of representation.

Daar kan nie van leerders (wat geleer is wat om te leer, hoe om dit te leer, wanneer en waar om dit te leer) verwag word om skielik verantwoordelikheid vir hulle eie leer in ons moderne informasie-era te aanvaar nie. Die probleem is dat die leerders nie blootgestel of die geleentheid gebied word om hulle eie leer te bestuur nie. Daarom moet onderrigmateriaal verseker dat die leerders blootgestel word aan die geleentheid om hulle eie leer te bestuur. Deur die gebruik van bestaande onderrigmateriaal, wat nie selfgerigte leer (SGL) koester me, kan leerders geforseer word om afbanklike leerders te bly en nie te ontwikkel tot lewenslange en selfgerigte leerders (leerders wat bevoeg is om op hulle eie te kan leer) nie. Verder veroorsaak die gebruik van bestaande onderrigmateriaal deur opvoeders dat die unieke behoeftes van die leerders in 'n klas nie in ag geneem word nie en dat opvoedergerigte leer in plaas van selfgerigte leer bevorder en aangemoedig word. Die rede hiervoor is dat opvoeders, weens 'n gebrek aan kennis van SGL, nie van beter weet nie. Die betroubaarheid van selfgerigte leer word versterk wanneer die opvoeders en die skeppers van onderrigmateriaal 'n deeglike begrip en kennis van die SGL-proses het. Die primere doel van hierdie navorsing is om kriteria te ontwikkel, wat as 'n riglyn kan dien om onderrigmateriaal wat SGL koester te ontwikkel- dus materiaal wat rigting aan die leerders gee om hulle eie leer te bestuur. Die kriteria is gevorm na aanleiding van 'n literatuurstudie van bestaande navorsing oor SGL en kundiges se evaluering van die kriteria. Na aanleiding van die kundiges se kommentaar is onderrigmateriaal, wat SGL koester, ontwikkel en weer aan die kundiges vir evaluering voorgele.

Abstract:

Bakgrund Prader-Willis syndrom (PWS) är en genetisk mutation och drabbar cirka 8-10 barn per år i Sverige. Personer med syndromet upplever en ständig hunger och har en tvångsmässig relation till mat, samtidigt som de har ett lågt energibehov. Drabbade personer löper stor risk för fetma och behöver en diet med kalorirestriktion samt mycket fysisk aktivitet, och personer med PWS behöver ständig tillsyn av vårdare och anhöriga. Eftersom PWS är komplext med flertalet svårigheter är det angeläget att utforska hur vårdare upplever sitt arbete med vuxna som har PWS. Syfte Att undersöka hur vårdare upplever att arbeta med vuxna med PWS när det kommer till kosten, hälsoförebyggande åtgärder samt de boendes autonomi. Metod Fem semi-strukturerade intervjuer genomfördes med vårdare på ett boende i Sverige för vuxna med PWS. Intervjuerna spelades in digitalt via mobiltelefon och transkriberades sedan ordagrant. Data analyserades med kvalitativ innehållsanalys och meningsbärande enheter skapade koder och kategorier som sedan formade rubriker till resultatet. Resultat Informanterna upplevde stort ansvar kring de boendes liv och hade hand om allt kring exempelvis kost och ekonomi. De upplevde att mat utgjorde grunden till flertalet konflikter som ofta ledde till aggressivitet och känslomässiga reaktioner hos de boende. De upplevde även ett dilemma mellan att värna om de boendes hälsa och att uppmuntra till deras självbestämmande. Motion och aktiviteter var något som prioriterades högt på boendet. Slutsats Vårdarna upplevde flertalet svårigheter när det kom till kost och kände ett stort ansvar för de boende. Att finna balans mellan att värna om de boendes hälsa och självbestämmande var ett gemensamt problem. Samtliga ansåg att boendet arbetade aktivt med hälsoförebyggande åtgärder och att de boende fick goda möjligheter till motion och aktivitet.
Background Prader-Willi syndrome (PWS) is a genetic mutation which affects around 8-10 children each year in Sweden. People with this syndrome experience constant hunger and have an obsessive relationship with food, moreover, they also have a lower energy requirement. People with PWS run the risk of becoming obese and are in need of a diet that restricts the caloric intake, they also need increased physical activity. People with PWS are in need of constant surveillance from caregivers. Since PWS is complex with multiple issues it is of interest to explore how caregivers experience their work with adults with PWS. Objective To explore how caregivers experience working with adults with PWS when it comes to food and physical activity, as well as their residents’ autonomy. Method Five semi structured interviews were conducted with caregivers at a group home in Sweden for adults with PWS. The interviews were recorded digitally using a mobile phone and then transcribed. The data was analysed using qualitative content analysis and meaning units created codes and categories which then formed the headlines of the result section. Result The caregivers experienced great responsibility for the residents and took care of everything from their food to their economy. They felt that food was the basis of many conflicts which often could result in aggression and emotional outbursts. They also experienced a dilemma between caring for the residents’ health and encouraging their autonomy. Physical exercise and activities was a priority at the group home. Conclusion The caregivers experienced numerous difficulties when it came to food and felt great responsibility for the residents. To find a balance between caring for the residents’ health and autonomy was a common problem. All informants felt that the group home worked with health promoting measures and that the residents got a lot of exercise and activity.

Abstract:

Long and erroneously deemed a writer in the tradition of bourgeois realism, the novelist Martin Mosebacb (* 1951) has in recent years been catapulted to the forefront of the German literacy scene, winning Germany's most prestigious literary prize, the Georg-Buchner-Preis, in 2007 and being heralded by many (mostly conservative) newspaper critics as one of the most elegant and powerful writers of the day_ Whilst there has been a fervent debate about the author's anti-modem and catholic credentials, neither the authors' advocates nor detractors have offered anything more than a superficial analysis of his substantial body of literary texts. This study is the first to look at Mosebach's novelistic oeuvre. It offers both a survey of his novels and a particular focus on the aesthetics of play that has animated his work since the very beginning of his career. In the early 19805 when the reception of literature in Germany was still very much guided by the paradigm of modernity and political litterature engagee, Mosebach not only flaunted his (then) unfashionable love for tradition and aesthetic form but turned it into an instrument of satire. Behind the outer, realistic settings of the texts and thus beneath their literal surface, many of Mosebach's narrators fabricate absurd fantasies of historical continuity. These are invoked purely by aesthetic means, by counter• intuitive allegories which are embedded in complex formal compositions and are conceived as hide•and•seek games with the reader. Mosebach deploys these absurd scenarios to formulate his cultural criticism in a grotesquely distorted way and provokes the critical reader's suspicion by playing with politically incorrect taboos (or blasphemy). In this study, I uncover these meticulously crafted subtexts as well as the author's extensive formal play with leitmotifs and symmetries which takes on a dynamic of its own. Thereby, the mannerist nature of Mosebach's transformations of reality comes to the fore. Whilst the author self•ironically foregrounds many of his conservative views put forward in his essays, not least his defence of the old Roman Liturgy, he consistently subjugates them to the aesthetics of (grotesque) play. Whilst politically incorrect innuendoes and satire provide much of the novels' appeal, ] conclude that the real provocation may lie in the fact that the modern reader's customary search for deeper meaning (be it political, sociological or psychological), is frustrated. This holds in different ways for both the early and the most recent novels. Finally, I suggest that Mosebach may require a reader who is willing to assess his novelistic work by aesthetic criteria alone.

Tobacco as subject of excise tax Abstract The subject of my work is the excise duty on tobacco products and tobacco in all its forms. Tobacco is a very specific product in terms of taxation in comparison with other products taxed by excise duty. Whether it is the issue of labeling tobacco products, filing tax returns, or the method of packaging and price regulation, in all these areas, the administration of excise duty on tobacco products is a completely separate piece of legislation, which differs significantly from the administration of other excise duties. All these institutes are analyzed in detail, including consideration of the relevant case law of administrative courts. Complementary to tax regulation of tobacco products is the excise duty on raw tobacco, which is a new type of excise duty (which is not harmonized by European Union law). A novelty in the field of excise duties across the European Union but also globally is the tax on heated tobacco products, which has been enshrined in all legal systems in recent years. The aim of my work is a thorough analysis of all the above areas. A Organização das Nações Unidas, criada tendo em conta a experiência fracassada da Sociedade das Nações e como consequência direta da Segunda Guerra Mundial, encontra nas marcas deixadas na Comunidade Internacional por estes precedentes os fundamentos para as normas do seu tratado instituidor e norteador: a Carta das Nações Unidas. Neste sentido, o principal propósito da Organização é a manutenção da paz e segurança internacionais, tendo para tal efeito sido consagrado o papel primordial ao Conselho de Segurança. Neste encontram-se como membros permanentes as potências vencedoras da Guerra, tendo-lhes sido conferido direito de veto no que toca à tomada de decisões não procedimentais, de acordo com o artigo 27.º, n.º 3, da Carta, que exige voto favorável de todos. Num segundo plano, a Assembleia Geral tem também responsabilidades no tocante à manutenção da paz e segurança. Não obstante, a sua atuação pode, nos termos do artigo 12.º, n.º 1, ser bloqueada enquanto o Conselho de Segurança se encontrar a exercer as respetivas funções. Tal sistema foi divisado num contexto das Relações Internacionais que rapidamente se alterou, tendo os antigos aliados passado à condição de inimigos. Neste sentido, os mecanismos previstos no momento da formação da Carta tornaram-se incapazes de regular o funcionamento adequado da Organização das Nações Unidas. Pelo contrário, promoveram a sua paralisação e o consequente perigar da manutenção da paz e segurança internacionais. Para obviar às dificuldades promovidas pela letra do tratado, a prática dos Estados no seio da Organização alterou-se, afastando-se da mesma em sentidos diametralmente opostos. Esta prática foi reiterada em diversas ocasiões, colhendo o apoio do conjunto da Comunidade Internacional; tanto quanto foi dado a demonstrar a convicção por parte dos Estados era de que tal atuação se demonstrava vinculativa. Assim, nos exemplos dados, a aprovação de decisões não procedimentais no Conselho de Segurança passou a poder ser feita com o voto não desfavorável dos membros permanentes, bem como a Assembleia Geral ganhou legitimidade para atuar simultaneamente ao Conselho de Segurança. Neste sentido, pode ser afirmada a constituição de normas costumeiras que, por contrárias ao vertido no tratado, se designam como contra legem.
The United Nations, created taking into account the failed experience of the League of Nations and as a direct consequence of the Second World War, find in the marcs left in the International Community by these precedents the fundaments for the norms of its founding and guiding treaty: the Charter of the United Nations. In this sense, the main purpose of the Organization is to maintain international peace and security, having for that effect been the main role designated to the Security Council. In it we find as permanent members the Power that won the War, having been conferred to them the right of veto as to the decision making of non-procedural decisions, according to article 27, n. 3, of the Charter, that demands an affirmative vote of all of them. On a second level, the General Assembly also as responsibilities as to maintaining peace and security. Nonetheless, its functioning may, according to article 12, n. 1, be blocked while the Security Council is exercising its functions. This system was devised in a context of International Relations that changed quickly, having the old allies become enemies. In this sense, the mechanisms thought of at the moment of the creation of the Charter no became incapable of regulating the proper functioning of the United Nations. On the contrary, they promoted its paralysation and the consequent endangering of international peace and security. To circumvent the difficulties promoted by the letter of the treaty, State practice within the Organization changed, moving from it in totally opposite ways. This practice was reiterated on several occasions, collecting the support of the International Community; as far as it was demonstrated, the conviction by the States was that that way of acting was binding. Thus, in the examples provided, the approval of non-procedural decisions in the Security Council became possible with the non-negative vote of the permanent members, likewise the General Assembly gained legitimacy to act simultaneously to the Security Council. In this sense, it may be affirmed the creation of customary rules that, for being contrary to the stipulated in the treaty, are named contra legem.

O Diário da República passou a ser editado por via electrónica, a partir de 1 de Julho de 2006, fazendo fé plena e valendo para todos os efeitos legais. Com esta medida, já anunciada na Resolução do Conselho de Ministros n.º 63/2006, de 18 de Maio, pretendeu-se minorar os impactos ambientais, resultantes da edição em papel, reduzindo o gasto anual de 1400 toneladas de papel, equivalente a cerca de 28 000 eucaliptos abatidos. A partir dessa data, a assinatura do Diário da República em papel foi proibida aos serviços da Administração Pública, que se viram confrontados com um novo suporte para consultarem as leis: o ecrã do computador. O nosso estudo incide sobre a análise das práticas que envolvem a leitura das leis electrónicas e-leges e de como reagem os profissionais do Direito à sua leitura e interpretação no ecrã do computador. O resultado deste nosso estudo evidencia a dificuldade que a leitura e interpretação de uma lei apresenta, dadas as suas constantes alterações, que a transformam num emaranhado de remissões para outras, obrigando a um constante ziguezaguear entre elas e cuja consulta em simultâneo, é impraticável no ecrã do computador. Devido a este impedimento, o recurso à impressão e à leitura no papel continua a ser a única alternativa para o estudo e interpretação das leis, solução que contraria as expectativas enunciadas na resolução do conselho de ministros. Tendo presente que a leitura electrónica conquista, cada vez mais, o seu espaço e que se torna imperativo reformular o Diário da República Electrónico para responder às necessidades da geração dos utilizadores do Direito do século XXI, apresentam-se algumas propostas de aperfeiçoamento dos suportes, formatos e conteúdos, designadamente, a utilização da tecnologia do hipertexto, por forma a que, cada lei, cada artigo, cada número e alínea, sejam apetrechados com links de navegação, que permitam a sua rápida e simultânea visualização, promovendo e facilitando, assim, a sua leitura e interpretação no ecrã.
The Diário da República (The Official Bulletin of the Portuguese Republic) started being published electronically since 1 of July of 2006, making full faith and being valid for all the legal effects. The aim of this measure, already announced in the Resolução do Conselho de Ministros no. 63/2006, 1 of May, was to reduce the environmental impact, resultant of its paper edition, and to decrease the costs of 1400 tonnes of paper yearly, the equivalent to 28 000 cut down eucalyptus. Henceforth, the subscription of the Diário da República in its paper version was forbidden to the Public Administration services, which were confronted with a new support for reading the laws: the screen of the computer. Our study is based on the analyses of the practices that involve the reading of electronic laws e-leges and on the way the professionals users of law react to this new support for reading and interpreting them. The result of our study shows the difficulty presented in the reading and interpretation of a law, whose innumerable amendments and its consequently connections with many others, oblige to a permanent intricate zigzag between them, a characteristic that makes impracticable their simultaneous consultation in the computer screen. Owing to this constraint, the resource to printing and to the reading in paper continues to be the only alternative for the study and the interpretation of the laws, solution that contradicts the expectations announced. Bearing in mind that the electronic reading conquers its space, more and more, it becomes imperative to reformulate the Diário da República in order to meet the requirements of the XXI century law users, some proposals of improvement of its supports, formats and contents are presented, namely, the use of the hypertext technology, in order that each law, each article, each number and paragraph are equipped with links that allow its quickly and simultaneously visual display, promoting and facilitating, thus, its reading and interpretation on the screen.
