Full textThe rules of presumption in chapter 11 of the Swedish Inheritance Code are to be considered as an aid in the interpretation of wills, if the will itself does not provide sufficient guidance for what the deviser intended to happen with his legacy. These rules of presumption are meant to express what a deceased person in general would want to happen with his legacy in specific situations. The rules of presumption have to be of a general nature in order to represent the average deceased persons intentions. The purpose of this thesis is to investigate the rule of presumption given in chapter 11. 5 § of the Swedish Inheritance Code concerning estate with an attached mortgage lien which the deviser in his will has left to a specific legatee. This thesis is limited to only treat the case where a mortgage lien on property is deposited as security for a loan in order to finance the construction of a building on leasehold. The thesis presents a critical view of the design of the aforementioned rule of presumption according to current legislation. In order to investigate and identify shortcomings in current law, a descriptive method is used, which is a prerequisite for future analysis that examines the possibility of a change of the rule of presumption in question.The legal position is analyzed with an analytical approach. In this part of the thesis, arguments for and against the proposals of change are being evaluated. On the basis of these arguments, the authors consider whether each proposal is possible to implement or not. The result of the analysis is that the introduction of a subparagraph to the rule of presumption in chapter 11. 5 § of the Swedish Inheritance Code is the most suitable option to solve the issues being treated in the thesis. Such a subparagraph would clearly state which one of the legatees who is obligated to carry the burden of the mortgage lien attached to the property that has been deposited in order to finance the construction of a building on leasehold.

Full textLaw historians have long ignored the civil law of the French Revolution, pejoratively termed as “intermediate right”. But since the bicentennial of the French Revolution, they have revised their appreciation and highlighted the modernity of this legislation that can now be considered as an anticipation of the contemporary law of the family. This thesis is a contribution to this rehabilitation work.The inheritance law of the old regime was characterized by the inequality of hits rules. The proclamation of civil equality in the Declaration of the Rights of Man of 1789 implied a complete overhaul of this subject. The first two assemblies, the Constituent Assembly and the Legislative Assembly, had only begun this work, removing the most obvious inequalities, the privileges of aeness and masculinity, which was the occasion for discussions on the right to test. It was the Convention that carried out the most important reforms at the height of the Revolution, at a time when ideological tensions were exacerbated. A first draft of the Civil Code was discussed but did not succeed.Pending the drafting of a second amended draft, it was resolved to implement some parts of the first, on matters which seemed particularly urgent. Thus, “appendix articles” of the first Code were implemented by means of two laws. The first is that of 12 Brumaire year II on the rights of natural children, which were essentially inheritance rights. The second is the law of 17 Nivôse year II, on the devolution of inheritance and the equality of shares.Their common feature was to introduce retroactivity into the settlement of estates opened since July 14, 1789, the symbolic date of the advent of freedom, to hasten the implementation of the new principles. . This retroactive effect was then violently criticized , as soon as the political situation tuned around with the elimination of the Robespierrists. Many complaints poured out to show the serious practical inconvenience of this situation.The later legislators returned to this effect, by means of laws which extended from the 9th Fructidor year III, to the 3rd Vendemiaire year IV. The drafters of the Civil Code maintained the principle of equality in the family based on the marriage. But with regard to the children born out of the wedlock, the Code of 1804 devotes the harshest solutions that could be imagined against them. It is no longer a question of even moderate equality. The situation of these children was only very slowly improved for 150 years. However, this movement accelerated from 1972 onwards to current situation

Full textA leg ulcer is increasing demand on health services. Because it is chronic, recurrent and difficult to handle, leg ulcer is a problem that has defied professionals, patients and families. The need to better understand the problems existing in the care offered by nurses to patients with ulcer and their families led to the question of the study, which sought to answer how the family influences and is influenced by leg ulcer. The study aimed to understand the perceptions and beliefs of the patient and the family regarding leg ulcer as well as understand how these beliefs influence family coping experience. The case study method was adopted, and the techniques of oral history were used for data collection. The study was conducted with an elderly couple, who lives with woman\'s leg ulcer, focusing on the impact of this event in the family history. The narratives of the couple allowed the construction of collective memory organized into three distinct themes which are interrelated: Aging and illness, Journey of treatment, Wound and time. The results allowed to understand that family influences and is influenced by leg ulcers; family dynamics determines a great impact on the couples lives experiencing the late stage of the family life cycle. The study identified that the couples beliefs have great influence on the impact of the disease on their lives, and determine how they cope with the situation. This study, seeing the family as category of analysis, proposes a new perspective at the problem and adds new knowledge to the interaction between family and wound. The results allow a discussion about the importance of deep nursing knowledge about the experiences of patients and families living with leg ulcers. This new perspective requires a change in behavior of the nurse in clinical practice for a vision beyond the wound. The appreciation and recognition of the strengths of the family in coping with the illness and considering the interface between the disease and the family context are elements capable of stimulating a nursing family-centered practice.

Full textThe surviving spouse has very often been considered a poor relation in matters of inheritance. Generally defined, in French-speaking African countries, as the non-divorced spouse and against whom there is no final judgment of separation, his rights have undergone significant development. The laws of these countries were strongly inspired by the texts of France, the former colonizing power, mainly from the civil Code of 1804 and subsequent reforms.Originally, these rights, characterized by their heterogeneity, have, on the one hand, coexisted among themselves, under the influence of heterogeneous traditional institutions, generating unequal rights, based in particular on the privileges of masculinity and primogeniture. This coexistence was achieved, on the other hand, with the exogenous laws, in this case French law and Muslim law, which contributed to the general establishment of legal pluralism and specific inheritance pluralism, in a context shared between opposition and coordination of existing rules.Today, the homogeneous nature of these rights is affirmed throughout the territory of each of the countries under review. These rights are therefore granted by law, just as they can be by will, subject to compliance with the prohibitions relating to the marriage contract, and the reservation of reserved heirs. In addition to this consecration which above all highlights the inheritance vocation of the surviving spouse, these rights are nevertheless abused. Consequently, they first call for protection based more on devolution rules favorable to the tightening of the family nucleus around the matrimonial home. Also, on the strength of the community and linguistic space in which they operate, it would be interesting and appropriate to consider the harmonization of the rights of the surviving spouse in French-speaking African countries

Full textThe people with the greatest stake in Orphan and Vulnerable Children (OVC) interventions are the children and their parents/guardians. Unfortunately, most OVC programmes are predesigned and implemented without considering beneficiaries’ perceptions when developing solutions (ALI 2007:15). The purpose of this study was to explore and describe the perceptions of orphans and vulnerable children’s parents/guardians about the effectiveness of Future Families’ children programme in Olievenhoutbosch. This study used a qualitative, explorative and descriptive design. Thirteen parents/guardians of children registered with the Future Families were interviewed on the effectiveness of the Future Families programme using a semi-structure interview guide. The study results suggested that parents/guardians were happy with Future Families’ services and believed the programme is effective in responding to their families’ needs
