Specifically, I ask how post-electoral intraparty rank affects party unity. I determine post-electoral intraparty rank by comparing deputies’ vote share of the total national vote count. This chapter examines the political dynamics of legislative scrutiny, with an emphasis on how parliamentary policy influence works. A central function of legislatures is legislating. In the case of the UK Parliament, the treatment of legislation is one of the most time-consuming activities, with both Houses spending the great majority of that time scrutinizing government bills. The chapter first introduces the reader to common assumptions, including the idea that government dominates the process, with Parliament acting as little more than a ‘rubber stamp’, before questioning these various assumptions. It shows that non-government amendments may ‘fail’ but can nonetheless be influential, that government amendments do not necessarily imply government dominance, that the two Chambers often operate in cooperation rather than competition, and that parliamentary influence occurs throughout the policy process. Furthermore, the chapter suggests that the legislative process is less separate from other processes than it might appear.

This chapter explores the role and membership of Parliament’s two chambers, the House of Commons and the House of Lords, the operation of parliamentary privilege; and accountability of members. The key functions of Parliament include controlling national expenditure and taxation; sustaining the government; legislating and scrutinising government actions. The House of Commons is the pre-eminent chamber and dominates Parliament. The Commons’ membership consists of Members of Parliament (MPs) who are democratically elected by the public to represent their interests in Parliament. The membership of the House of Lords largely relies on patronage. Members of the Lords are appointed by the Queen on the Prime Minister’s advice. The House of Lords is an important revising and scrutinising chamber, and while it is subordinate to the democratically elected House of Commons, it is also a check on constitutional change by the Commons. The Parliament Acts 1911 and 1949 redefined the Lords’ legislative powers over public bills and established the Commons’ primacy. The chapter then considers the operation of parliamentary privilege. Parliament needs parliamentary privilege to conduct its core business effectively, independently, and without fear of outside interference, and to protect everything said or done in the transaction of parliamentary business. Indeed, Parliament is self-regulating and, as a sovereign body, operates outside the jurisdiction of the courts except for the criminal law. Each House has its own standards of conduct and disciplinary powers which ensure accountability.

Abstract:
This chapter illustrates the Supreme Court's approach to school desegregation. It argues that the Court changed from a hierarchical institution to a more egalitarian or conversational democratic model that recognized the work of others outside the court system (such as psychologists whose views outlined the unequal feeling of segregated black school children) and largely left enforcement of desegregation to local federal district court judges. Overall, the Court adopted an impressive strategic approach to school desegregation. After acknowledging the democratic deficit for blacks in their exclusion from legislative representation, the chapter proposes that the local federal district courts served as surrogate democratic chambers for whites and blacks to work out their differences peaceably.
