Abstract:
As 2016 Draws to a Close, the Most Hotly Debated Topic in Hong Kong is the Controversial Behavior of Two Newly elected legislators of a localist political party during their oath taking at the Legislative Council earlier this year. The proindependence advocates roused anger among mainland Chinese and local Hong Kong officials and citizens alike when they declared allegiance to the “Hong Kong nation” and pronounced “China” in a way that painfully echoed for many the derogatory pronunciation used by the Japanese forces that occupied Hong Kong in World War II. Ironically, in their attempts to lobby for the Hong Kong people's interests and right to self-determination, the legislators were accused of ignoring Hong Kong's history and disrespecting those who had perished during or survived those dark days. Subsequently, China's National People's Congress Standing Committee (NPCSC) issued an interpretation of Hong Kong's Basic Law that disqualified the pair from government service and preempted any ruling by a local Hong Kong court. This decision prompted thirteen thousand Hong Kong people to take to the streets in protest against what is widely perceived as the mainland's tightening of control over its special administrative region.

Abstract:
Abstract This essay reviews Albert Chen’s ‘The Changing Legal Orders in Hong Kong and Mainland China: Essays on One Country, Two Systems' (2021). The aim is to address the most significant points raised by the author of the book and provide a readable and critical synthesis of Chen’s key arguments. The focus is on the background of the tension points between China and Hong Kong that are generated by the One Country, Two Systems policy. The article ends with discussion on the book’s contribution and the possible future of Hong Kong’s common law heritage as a part of China.

Abstract:
Much has been studied on political representation either in democratic countries or in competitive authoritarian regimes. However, few have attempted to compare across the two. This article fills this gap by comparing democratic and authoritarian representations within the same collective decision-making body: the Legislative Council of Hong Kong. The original data derives from 2465 parliamentary questions made by 243 legislators serving in the last four legislative sessions from 1998 through 2012. The empirical analysis shows that the type of election variable does not have an impact on the volume of parliamentary questions but that it has a strong effect on the composition of parliamentary policy issues.

Abstract:
Purpose – The purpose of this article is to assess the extent to which Hong Kong’s laws deter its companies from engaging in corruption and bribery abroad. Design/methodology/approach – A mix of economics, public administration, management and legal analysis was used to assess weaknesses in Hong Kong’s laws governing the prohibition of bribe payments abroad. Findings – Hong Kong does not explicitly criminalise corporate bribery abroad. Companies – as legal persons – can not be found guilty of corruption. It is argued that Hong Kong’s Legislative Council should amend various laws to modernise Hong Kong’s approach to tackling corruption committed by its companies abroad. The various approaches lawmakers can take towards assigning responsibility for corruption to companies are presented. The approaches that prosecutors at the Department of Justice can take to adopt prosecutorial methods like those used in other upper-income jurisdictions and the ways that Independent Commission Against Corruption (ICAC) can assist in this work are also described. Practical implications – This research has practical findings for Hong Kong’s policymakers, law firms and companies which operate in Hong Kong. For policymakers, we describe legal changes Hong Kong’s legislators will likely make in the years ahead and the preferred ways of engaging in such change. For law firms, we describe the legal changes coming to Hong Kong which legal advisors will need to advise their clients on. For companies, we describe changes that companies operating in Hong Kong will likely need to comply with in the future. Social implications – This paper shows that when Hong Kong adopts best practice in the field of corporate criminalisation, Hong Kong’s role in “exporting” corruption will likely fall. Originality/value – This article describes a set of legal changes which will change the way Hong Kong treats corruption. The literature tends to glamorise Hong Kong’s anti-corruption work. It is shown that its law falls far behind other jurisdictions, as well as how “treating companies like people” in the case of Hong Kong will likely change the way Hong Kong’s prosecutors think about crime and criminal perpetrators.

Abstract:
Purpose – This paper is a historical review of the development of private primary and secondary education in Hong Kong from 1841-2012. The purpose of this paper is to examine the evolving relationship between the state and private schools in Hong Kong. Design/methodology/approach – This paper utilizes sources from published official documents, public data available on government websites, archival documents and newspapers. The authors also carried out a few individual interviews with legislators, government officials and principals who were familiar with the history of private education in Hong Kong. Findings – The colonial Hong Kong Government adopted laissez-faire policy in greater part of its rule until 1970s. The year 1978 marked the period of “state control” until the 1990s when privatization and deregulation emerged as a world trend in the governance of education. The role of government changed to that of “supervision” instead of “control.” Further, it is shown that the change of sovereignty did not avert the trend of decentralization, deregulation and privatization in education which is entrenched in the management of public affairs in human societies. Originality/value – The findings provides an illuminating look into the development of a society and how it grapples with the fundamental questions of the degree of social control and proper use of political power in a colonial setting.

Abstract:
Before the transfer of Hong Kong's sovereignty from Britain to the People's Republic of China (PRC) on 1 July 1997, the politics of interpreting the Basic Law had already become apparent. This article aims to use the debate over the Court of Final Appeal (COFA), which was set up in July 1997 to replace the Privy Council in Britain as the court of final adjudication in the Hong Kong Special Administrative Region (HKSAR), to analyse how the Basic Law had already been interpreted by PRC officials, their British counterparts and the Hong Kong people. The interpretation of the Basic Law involves many people from both Hong Kong and China. As one legal scholar writes: “In one sense all kinds of people [in the HKSAR] will have to interpret the Basic Law: civil servants and other administrators and lawyers in their day-today work, legislators to ensure that their legislation and motions are consistent with it, the State Council [in the PRC], the National People's Congress Standing Committee, even private parties since some provisions affect private acts.” The debate over the COFA may also help towards an understanding of the ongoing interpretation of various provisions of the Basic Law, which serves as the mini-constitution of the HKSAR.

Abstract:
The growth of illicit enrichment crime, or living beyond one’s means is a significant challenge in combating corruption. Many countries have shown their commitment towards preventing illicit enrichment crimes by criminalising and penalising illicit enrichment in their laws, including Hong Kong and Singapore. Illicit enrichment is a crime and Malaysia has no clear provisions on illicit enrichment to prevent it. Therefore, this paper analysed the adequacy of Section 36 of the Malaysian Anti-Corruption Commission Act 2009 [Act 694] (MACC Act 2009). The legal framework on illicit enrichment in Hong Kong and Singapore were referred as sources of critique. To achieve the said objective, this study adopted a doctrinal approach using qualitative research methodology. The scope of the paper is limited due to the inadequacy and indirectness of the law on illicit enrichment in Malaysia. This paper critically analysed the international framework of illicit enrichment and conducted a comparative analysis of the law in Hong Kong and Singapore, namely the Prevention of Bribery Ordinance and the Prevention of Corruption Act 1960, respectively. In conclusion, this paper found that the current law in Malaysia is inadequate and Malaysia can learn to adopt the said laws as provided in Hong Kong and Singapore. This study serves as a guide for legislators intending to address the current inadequacies of the law on corruption in Malaysia, equipped with better knowledge on the characteristics of illicit enrichment. Suggestions to address the issues are proposed.

Abstract Hong Kong’s system of administrative law has drawn strength and durability from its English counterpart, on which it was heavily modelled. Too often, however, there is a slavish acceptance of the pre-eminence of English law and a tendency to conservativism and a lack of innovation. This article argues that Hong Kong courts and legislators must dare to diverge from English law where an alternative path would prove more credible or appropriate. Three prisms are deployed through which to argue that a misplaced emulation of English law can result in a poor legal framework. First, it is shown that a failure to properly conceptualize error of law as a ground of judicial review has resulted in a ground that, locally, is in a state of incoherence and disarray and that the admission or non-admission of a distinction between jurisdictional and non-jurisdictional errors urgently requires clarification from the Court of Final Appeal. Second, it is proposed that the English-inspired incorporation of a specific time limit in the rules for applying for judicial review should be abolished in the interests of access to justice and legal certainty, drawing on the experience of jurisdictions such as New Zealand, Canada, and Scotland. Finally, it is explained why the antiquated system of administrative tribunals in Hong Kong, redolent of the unreformed English tribunal system of decades past, needs comprehensive structural and procedural redesign. Courts and legislators must dare to diverge in these areas, with Hong Kong’s administrative law standing on its own two feet, where minds are focused on a genuine, locally crafted improvement of standards prevailing in administrative law and public administration.

Abstract:
This chapter charts the twists and turns of Sha Po’s ‘site biography’, or how over a period of eight decades our present understanding of its archaeological treasures gradually came to light. It is a story that reflects Hong Kong archaeology as a whole, in that there were the discoveries made by pre-war pioneers, significant contributions by the Hong Kong Archaeological Society and the Antiquities and Monuments Office (AMO) and, most recently, a series of important finds made by archaeologists working in the commercial sector. During that story of discovery, fieldwork progressed from poorly recorded ‘antiquarian collecting’, through more formalised research digging, into the present era of AMO-licensed excavations working to agreed research designs.
