The essential questions of the dissertation research described here address concepts in homogeneous catalysis and organometallic chemistry, with a focus on method development for catalytic reaction applications in organic synthesis. The unifying theme throughout the research is the development of rational design principles for cooperative catalysis through both mechanistic and empirical study. Cooperative catalysis – in which multiple catalysts enable increased activity or selectivity versus a single catalyst system – can involve some combination of a transition metal, Lewis acid, and Brønsted acid. Chapter 1 reviews the literature regarding the cooperativity of transition metal and Lewis acid catalysis, and discusses four main areas in organic synthesis and the facilitation of these trnasformations by Lewis acids: (a) C-C bond and C-H activation, (b) hydrogenolysis of carboxylic acid derivates and ethers, (c) Au catalyzed alkyne activation and cyclization reactions, and related reactions, and (d) Pd catalyzed C-C and C-N bond forming reactions. These different topics are selected based on the mechanistic insight provided into the nature of transition metal-Lewis acid cooperativity. Chapter 2 describes the observation of Lewis acid acceleration of a Pd catalyzed C-N bond coupling. The synthetic methodology is elaborated using metal triflates as cocatalysts, and Lewis acid acceleration is observed for a variety of different N-nucleophiles. Qualitative mechanistic study implicates the role of halide anions in inhibiting this catalytic reaction, and it is proposed that metal triflates are competent to accelerate catalysis by binding halide anions, and therefore attenuating halide inhibition. This hypothesis is supported by initial rate measurements and 31P NMR experiments. Rationalizing trends observed in the reactivity of Lewis acids in the cooperative reactions described in Chapters 1 and 2 is challenging. Therefore, our goal was to provide further insight into the behavior or Lewis acids in complex reaction settings. Inspired by 31P NMR experiments from Chapter 2, a next generation NMR probe to observe anion exchange reactions of metal triflate Lewis acids is developed. Metal-ligand titrations are performed for a variety of metal triflates with complexes of the type (POCOP)Pd(X) (X = Cl, Br, I, OAc) to observe a variety of different X anion affinities for metal triflates. The determined parameters are discussed within the context of Lewis acid catalyzed reactions, along with other Lewis acidity parameters, such as hydrolysis constants and effective charge density. The data suggest that the chloride and iodide anion affinities of a Lewis acid represent a continuum of π-acidity (high anion affinity) and propensity to dissociate into cationic Mz+ species (low anion affinity). The anion affinities do not correlate with the tendency of a metal salt to release Brønsted acids or their respective effective charge densities. Based on the insight into Lewis acidity from Chapters 1 and 3, the parallel between Brønsted and Lewis acids is realized, and the role of both Brønsted and Lewis acids in mediating organic reactions is often related. In Chapter 4, further questions into the cooperativity of π-acids and Brønsted acids is explored. It is demonstrated that selectivity of alkene isomerization can be controlled through a cooperative system. A series of Mo(0) complexes are prepared and explored in their ability to mediate the conversion of terminal alkenes to internal alkenes, and the reaction is found to be promoted by Brønsted acid (TsOH) cocatalyst. Rational design principles are developed to maximize selectivity for (Z)-2-alkenes in this catalyst system. It is proposed that TsOH acts to generate a catalytic MoH species which mediates catalysis, and the role of phosphine ligands is critical in inhibiting the formation of less selective isomerization catalysts. Chapter 5 and 6 entail further method development for catalytic reactions based on the mechanistic wisdom described in previous chapters. High throughput experimentation is employed to rapidly assess conceptual aspects of Pd catalysis, such as ligand and additive effects, and facilitate catalyst discovery and optimization. Based on the substrate scope performed in Chapter 2, it was realized there is a knowledge gap in the ability to synthesize tertiary sulfonamides, both in terms of conventional methods, or modern Pd-catalyzed methods. A significant advance in organic reaction methodology is described: a new Pd catalyst featuring the AdBippyPhos ligand is discovered to be apt for the coupling of secondary sulfonamides with heteroaryl halides to yield tertiary N-heteroarylhalides. Using high throughput experimentation, 24 diverse heterocycles are screened with 12 sulfonamide variants to prepare >100 new products on microscale. Computational modelling reveals the unique steric parameters of the AdBippyPhos ligand, and a mechanistic rationale for its success in catalysis is provided. Lastly, Chapter 6 describes the use of a LiOTf additive to control the selectivity of Pd-catalyzed C-C bond forming reactions. In the presence of LiOTf, a Mizoroki-Heck type reaction, the alkenylation of an aryl halide with a vinyl ether, proceeds with regioselectivity. In the absence of LiOTf, a solvent (CH3CN) activation pathway proceeds to give benzyl nitrile products. High throughput microscale reactions discovered that the Pd/xantphos catalyst is uniquely selective to provide branched styrenes when using the Cs2CO3/CH3CN base/solvent combination. However, reaction performance differed on large scale reactions, where LiOTf was necessary to observe the Mizoroki-Heck reaction pathway. Mechanistic study, in the form of kinetic experiments and 31P NMR experiments, focused on the role of LiOTf in affecting chemoselectivity. It is proposed that xantphos oxidation is responsible for mediating the Mizoroki-Heck reaction pathway, whereas in the absence of xantphos oxidation, CH3CN α-arylation ensues. Due to the insoluble nature of the catalyst materials, xantphos oxidation is ordinarily slow under anaerobic conditions due to mass transfer limitation. LiOTf generates a soluble [(xantphos)Pd(NCCH3)2][OTf]2 and potentially mediates the formation of xantphos-monoxide catalyst which is competent for alkenylation.

Understanding gender, sex, and sexuality is required in order to be a competent, patient-centered physician, and, therefore, inclusion of these topics in undergraduate medical education is essential. Current medical education is not producing physicians equipped to manage the complaints and issues that face their patients in these areas. LGBTQ populations are most affected by the inadequacy of training related to these topics. LGBTQ patients face unique issues in healthcare in terms of their normal development, pathology, social determinants of health, and healthcare system practices. Additionally, LGBTQ people and those who engage in behaviors that parallel these identities are prevalent in the general population. The addition of a gender, sex, and sexuality curriculum would simultaneously address LGBTQ disparities as well as the need for improved sexual health education that would benefit all patients. Currently, undergraduate medical curricula have limited, non-standardized education on gender, sex, and sexuality. A few American institutions have published both qualitative and quantitative studies that indicate medical students’ attitudes are malleable and their clinical skills can be improved in these areas. Further, numerous national medical societies have created curriculum guidelines and recommendations in order to aid medical schools looking to bolster their gender, sex, and sexuality related curricula. This paper will synthesize research and these guidelines to propose a robust gender, sex, and sexuality curriculum that is tailored to the environment found at the Lewis Katz School of Medicine at Temple University.

Full textCultural policies nowadays are designed and implemented based on different perspectives. In Brazil, government has assumed several phases and trends, but in general tax incentive takes leading role with regard to the financing of culture since the mid-80. In this context, the present study aimed to identify some people responsible for managing public resources in the cultural area and to identify the perception of such professionals about their ability to perform this function. For data collection, cultural managers were interviewed. The intention was to verify knowledge, practices, beliefs and social representations of cultural management. The method used to analyze qualitative data obtained was the Discourse of the collective subject (DCS). So, elements with similar senses were processed into single speeches, written in the first person singular. It was noted that sometimes, managers are struggling to play their role and, generally without specific training in the area, they talk about empiricism and hiring companies for advice and security. When seeking specialization, they found, mostly, discontinued and short courses - usually paid and offered in main cities.

Este estudo busca elaborar uma análise sobre o pensamento do jurista e sociólogo Oliveira Vianna, abordando as principais ideias defendidas em suas obras para, então, considerar o período em que atuou como Consultor Jurídico do Ministério do Trabalho do governo Vargas, identificando sua influência sobre a legislação trabalhista e sindical recém-elaborada, demonstrando, ainda, os problemas enfrentados por Vianna com a classe patronal e que culminou com sua saída do referido Ministério. Com essas informações, o objetivo central do presente trabalho será avaliar a natureza de permeabilidade da Consolidação das Leis do Trabalho, tendo como ponto de questionamento a existência e atuação das Convenções Coletivas, dotadas ambas de objetivos similares, atuando inicialmente de maneira complementar para, então, após o alcance da preparação social para implantação de institutos corporativos, ter a CLT sua existência relativizada.
This study aims to develop an analysis of the thought of the jurist and sociologist Oliveira Vianna, addressing main ideas defended in his works to then consider the period in which he served as Legal Counselor of the Labor Ministry in the Vargas government, identifying its influence on lab and syndical laws newly developed, also demonstrating the problems faced by Vianna with the employer class and that culminated in his departure from this Ministry. With this information, the central objective of this study is to evaluate the nature of permeability of the Consolidation of Labor Laws, taking as a point of questioning the existence and activity of the Collective Conventions, both endowed with similar objectives, initially acting in a complementary way to then, after reaching social preparation for implementation of corporate institutes, have the CLT their existence relativized.

The present study is aimed at examining the impact of the constitutional theory of international human rights treaties on Convention number 158 of the International Labor Organization (ILO). The importance of this study is translated in an attempt to correlate part of the constitutional theory of human rights to national labor law for the application of appropriate standards. For this purpose, the study begins with an analysis of the conception and denomination of human rights for a better understanding of the topic. The origin of human rights is further assessed to confirm its progressiveness in time, which would certainly influence the manner in which these rights must be interpreted. Taking into account the historical evolution of human rights, these rights may be classified according to different generations and dimensions. Subsequently, a study on international treaties is conducted to observe whether the ILO Conventions are international treaties for human rights protection and the Federal Constitution is related to the International Human Rights Treaties. The study further analyzes the constitutional regime of human rights treaties (its hierarchical threshold in Brazilian law, formation, incorporation and denouncement) indicating the main theories about the subject. Furthermore, the study addresses the impact of human rights treaties on our legal system, and more specifically on Brazilian Labor Law. With this intent, Convention number 158 of the ILO is evaluated because it is a relevant and modern topic. The study also discusses the compatibility of rules predicted in Convention number 158 with constitutional precepts, in order to assess the constitutionality (or lack of constitutionality) of its content and its denunciation by the Brazilian State. In conclusion, after detailing precepts of the Convention, the study indicates doctrinal and jurisprudential criteria to compensate for the failure to apply Convention number 158/ILO
O presente trabalho destina-se ao estudo do impacto da teoria constitucional dos tratados internacionais sobre direitos humanos na Convenção 158 da Organização Internacional do Trabalho (OIT). Sua importância se traduz na tentativa de relacionar parte da teoria constitucional dos direitos humanos ao direito do trabalho nacional, para a aplicação da normativa correta. Para tanto, inicia-se com a análise da conceituação e da denominação dos direitos humanos para melhor compreensão do tema. Em seguida, verifica-se a origem dos direitos humanos para que seja comprovada sua progressividade no tempo, o que certamente influi na forma pela qual esses direitos devem ser interpretados. Levando em conta a evolução histórica dos direitos humanos, esses podem ser classificados segundo diferentes gerações ou dimensões. Posteriormente, é realizado estudo acerca dos tratados internacionais, observando-se as Convenções da OIT são tratados internacionais de proteção aos direitos humanos e relacionando a Constituição Federal com os Tratados Internacionais sobre Direitos Humanos. Em seguida, analisa o regime constitucional dos tratados de direitos humanos (seu patamar hierárquico no direito brasileiro, formação, incorporação e denúncia), apontando as principais teorias a respeito do tema. Ainda, trata do impacto dos tratados de direitos humanos em nosso ordenamento e, especificamente, no direito do trabalho brasileiro. Para tanto, estuda a Convenção 158 da OIT, pela relevância e atualidade do tema. Nesse sentido, discorre sobre a compatibilidade das normas previstas na Convenção 158 com os preceitos constitucionais, a fim de verificar a constitucionalidade ou não de seu conteúdo e de sua denúncia pelo Estado brasileiro. Por fim, após detalhar os preceitos da Convenção, aponta os critérios doutrinários e jurisprudenciais para que seja suprida a omissão decorrente da não aplicação da Convenção 158/OIT

Propõe-se, neste trabalho, com base na perspectiva piagetiana, investigar, analisar e refletir a respeito das concepções e práticas educacionais dos acolhimentos institucionais e dos educadores desses serviços de acolhimento para crianças e adolescentes em situação de risco social do Estado de São Paulo. Para esse fim, primeiramente identifica as concepções e práticas educacionais morais das instituições e, seguidamente, as dos educadores de duas dessas instituições de acolhimento com práticas educativas diferenciadas (uma mais tradicional e moralizadora, e outra com educação ativa), relacionando-as com a legislação sobre o direito ao desenvolvimento moral. Assim, além do levantamento bibliográfico e documental, realizou-se uma investigação exploratória dividida em duas etapas. Para a primeira etapa contatou-se 163 instituições de acolhimento do Estado de São Paulo para o recrutamento para participarem de uma entrevista online (google docs), destes, obtivemos 22 respondentes. Considerando que uma instituição não é necessariamente representada apenas pela visão de um de seus integrantes, obteve-se com os dados desta primeira etapa uma indicação de como o respondente qualifica sua instituição, sendo assim, pode-se verificar que grande parte dos respondentes indicou que sua instituição tende a uma educação mais ativa. A partir desses resultados, pode-se destacar e escolher duas instituições que se opuseram extremamente em suas respostas para participarem da etapa subsequente. Para a segunda etapa fez-se uso de entrevista semiestruturada com os educadores/cuidadores e coordenação dessas instituições, além de observação da rotina por seis dias consecutivos (seis horas por dia) em cada uma, seguindo um roteiro de observação. Para análise dos resultados da entrevista semiestruturada, utilizou-se a metodologia de Discurso do Sujeito Coletivo, que deu voz à coletividade da equipe de educadores da instituição, expondo suas concepções e práticas educativas, a fim de entender o modelo pedagógico inerente à rotina das instituições investigadas. Os resultados demonstram que o trabalho educativo em uma instituição de acolhimento para crianças e adolescentes em situação de risco social inclui diversos atributos e complexidades que influenciam diretamente na concepção e prática de uma educação moral. A falta de comunicação e clareza entre a equipe técnica e educadores sobre o fim que se espera para a educação dos acolhidos e os processos para se chegar a esse fim desejado têm resultado em concepções e práticas destoadas, possibilitando ações educativas não refletidas e isoladas do todo. Além disso, a falta de orientação/capacitação e formação continuada para os educadores, que permita se desvencilhar do senso comum e busque atingir os direitos legalmente alcançados, e a falta de um momento interativo com o objetivo de educadores compartilharem estratégias, problemas e aflições sobre as práticas educativas na instituição, dificulta o estabelecimento de um plano conjunto de ações educativas evidentes a todos e em momentos de reflexão e avaliação de suas práticas. Nessa perspectiva, acredita-se que se deve ter um olhar atento e ações mais efetivas da equipe educativa (equipe técnica, educadores/cuidadores e auxiliar de educador/cuidador) sobre a educação moral dos acolhidos, assim como das políticas públicas e de pesquisadores, em parceria com os serviços de acolhimento.
Based on the Piagetian perspective, it is proposed to investigate, analyze and reflect on the educational conceptions and practices of institutional sheltering and educators of these reception services for children and adolescents in situations of social risk in the State of São Paulo. For this purpose, it’s first identified the moral educational conceptions and practices of two institutions and then, the conceptions of the educators with differentiated educational practices (one more traditional and moralizing and the other with an active education), relating them to the legislation about the right of moral development. Thus, besides the bibliographical and documentary survey, an exploratory investigation was accomplished divided in two stages. For the first stage, 163 institutions of the State of São Paulo were contacted for recruitment to participate in an online interview (google docs), from all of them, we obtained 22 respondents. Since an institution is not only represented by the vision of one of its member, it was obtained as a result, in the first stage an indication of how a respondent qualifies the institution, so it can be verified that most respondents indicated that their institution tends to a more active education. From these results, it was highlighted and chosen two institutions that oppose their responses to participate in the subsequent stage. For a second step, the semi-structured interview method was used with the educators / supervisors, besides an observation of the routine for six consecutive hours of six consecutive days in each one, following an observation script. For the analysis of the results of the semi-structured interview, the methodology of the Discourse of the Collective Subject was used, giving voice to the collective of the educational institution educators, exposing their conceptions and educational practices, in order to understand the pedagogical model of teaching inherent to the routine of the institutions that were investigated. The results demonstrate that the educational work in an educational sheltering institution for children and adolescents at social risk includes several attributes and complexities that directly influence the conception and practice of a moral education. The lack of communication and clarity between the technical team and the educators about the expected end of the education of those who were welcomed and the processes to achieve that, have resulted in dissonant conceptions and practices, enabling educational actions not reflected and isolated from the whole. In addition, the lack of orientation / training and continued formation for educators, which allows them to get rid of the common sense in order to reach the legally achieved rights, and the lack of a moment of interaction with the goal of educators share strategies, problems and afflictions about the educational practices in the institution, makes it difficult to establish a plan of evident educational actions to all moments of reflection and evaluation of their practices. From this perspective, it is believed that it’s necessary to have a closer look and more effective actions from the educational team (technical staff, educators / caretakers and auxiliary of educator / caregiver) about the moral education of the welcomed children or adolescents, as well as public policies and researchers, in partnership with the host services.

The aim of this study is to demonstrate the legal vulnerability of the consumer and collective action as an instrument of control in the face of the abusive stipulation of the compensatory fine in the adhesion contracts. For this, the present research starts from the analysis of the concept of consumer and supplier with the objective of distinguishing the relation of consumption of the other legal relations. Once the field of consumer relations has been delimited in the micro-system of Law 8.078/1990 – Code of Consumer Protection, we will discuss the principles of the Code, demonstrating the importance of the principles as limiting the abusive stipulation of the compensatory fine in the face of the consumer, giving emphasis on the principle of vulnerability, considering its legal vulnerability in the contractual relationship with the supplier of products and services. Next, we will study the consumption contracts and their historical evolution, differentiating the joint contracts from the contracts of adhesion, highlighting the use of this in the relations of consumption. With the increase of the adhesion contracts in the consumer relations, it is essential to study the unfair terms, since they are consumer protection rules in the face of the abuses committed by the suppliers in the contracts. In view of this, we will deal with the fine (penal clause), emphasizing the compensatory fine and the way in which the courts interpret the abusive stipulation of the compensatory fine in consumer contracts (reducing it to 10% based on article 413 of CC c/c Article 9 of Decree-Law 22.626/33), which we consider to be contrary to what is set forth in art. 51, which establishes nullity in the hypothesis of unfair terms, since the dialogue between the sources between the CDC and the CC (other infraconstitutional laws) will only occur when in the benefit of the consumer. Finally, we will demonstrate the importance of collective actions as an instrument to control the compensatory fines stipulated abusively in the consumer compliance contracts, in the face of consumer vulnerability
Pretende-se, com este estudo, demonstrar a vulnerabilidade jurídica do consumidor e a ação coletiva como instrumento de controle em face da estipulação abusiva da multa compensatória nos contratos de adesão. Para tanto, a presente pesquisa parte da análise do conceito de consumidor e fornecedor com o objetivo de distinguir a relação de consumo das demais relações jurídicas. Uma vez delimitado o campo de atuação das relações de consumo ao microssistema da Lei 8.078/1990 – Código de Defesa do Consumidor, abordaremos a principiologia do Código, demonstrando a importância dos princípios como limitadores na estipulação abusiva da multa compensatória em face do consumidor, dando ênfase ao princípio da vulnerabilidade, considerando a sua vulnerabilidade jurídica na relação contratual para com o fornecedor de produtos e serviços. Na sequência, passaremos ao estudo dos contratos de consumo e a sua evolução histórica, diferenciando os contratos paritários dos contratos de adesão, destacando o uso deste nas relações de consumo. Com o aumento dos contratos de adesão nas relações de consumo, torna-se imprescindível o estudo das cláusulas abusivas, por serem normas protetivas dos consumidores em face dos abusos cometidos pelos fornecedores nos contratos. Diante isso, trataremos da multa (cláusula penal), enfatizando a multa compensatória e como os tribunais têm interpretado a estipulação abusiva da multa compensatória nos contratos de consumo (reduzindo-a para 10% com base no art. 413 do CC c/c art. 9º do Decreto-Lei 22.626/33), o que entendemos ser contrário ao previsto no art. 51, caput, do CDC, que impõe a nulidade de pleno na hipótese de cláusulas abusivas, pois o diálogo das fontes entre o CDC e o CC (demais leis infraconstitucionais) somente ocorrerá quando em benefício do consumidor. Por fim, demonstraremos a importância das ações coletivas como instrumento de controle das multas compensatórias estipuladas abusivamente nos contratos de adesão de consumo, diante da vulnerabilidade do consumidor
