This chapter analyses the different applicable laws that govern international arbitration. International arbitration, unlike its domestic counterpart, usually involves more than one system of law or of legal rules. It identifies five different systems of law that may have a bearing on an international arbitration in practice: the law governing the arbitration agreement and the performance of that agreement; the law governing the existence and proceedings of the arbitral tribunal (the lex arbitri); the law, or the relevant legal rules, governing the substantive issues in dispute (generally described as the ‘applicable law’, the ‘governing law’, ‘the proper law of the contract’, or ‘the substantive law’); other applicable rules and non-binding guidelines and recommendations; and the law governing recognition and enforcement of the award.

This second chapter starts by clarifying the concept of ‘law of the arbitration’ or lex arbitri, underscoring that any arbitration needs to be governed by a national law of arbitration. The chapter then examines how to determine the national arbitration law that governs a specific arbitration by analysing the scope of application of the national arbitration law, especially Chapter 12 of the Private International Law Act (PILA), and distinguishing between international and domestic arbitrations. In this context, the chapter addresses the legal significance the seat of the arbitration, the practical considerations that should guide the selection of the seat, as well as the possibility for parties to arbitrations seated in Switzerland to opt in or out of the (international or domestic) regime governing the arbitration. Finally, the chapter describes the main features of national arbitration laws using Chapter 12 PILA as an example.

This brief chapter discusses the emergence of a set of substantive transnational principles governing international mining disputes. Over the past two decades, an increasing number of arbitral awards relating to international mining disputes have been published. This is particularly so in the context of disputes between States entities and international mining companies. As was the case earlier with the petroleum industry, these public awards provide the source material from which customary law may be drawn. This has not yet created a mature set of principles and regulations, but it has developed the beginning of a lex mineralia that guides the international mining industry. As an increasing number of arbitral awards are rendered and become public, owing to a growing push for increased transparency in international arbitration, this lex mineralia may well mature and develop into a recognized subset of international law.

Before describing the main features of an award, this chapter discusses the determination of the law governing the merits of the dispute or lex causae. It considers the role of party autonomy in this respect and examines the scope and content of the potentially applicable substantive laws that may be chosen by the parties or selected by arbitral tribunals, from national laws to transnational rules of law (the so-called lex mercatoria) over trade usages and ex aequo et bono principles. It also discusses the relevance and impact of international public policy and overriding or internationally mandatory rules. Turning to the award, the last part of the chapter sets out a typology of arbitral decisions, addresses the required form and content of awards and discusses the deliberation process as well as issues such as institutional scrutiny, dissenting opinions, and the notification, publication, and effects of the award.

Chapter 10 of the UNIDROIT Principles of International Commercial Contracts (PICC) deals with ‘limitation periods’. The chapter, which was added to the 2004 edition of the PICC but was not amended in the 2010 edition, generally follows an international trend, but some of its provisions are quite unusual in comparison with most domestic laws. Arguably, these provisions cannot be considered as general principles of law or lex mercatoria. In respect of limitation periods, arbitral tribunals should therefore consider carefully whether it is possible to follow the opinion that ‘a reference to lex mercatoria or general principles of law can nowadays be regarded as a choice of the UNIDROIT Principles’.

The financial crisis of 2007–08 saw a marked increase in global shipping disputes that is still being felt today. In recent decades, arbitration has emerged as the dominant choice of dispute resolution in the global shipping industry, with the establishment of major maritime arbitration centres in London and New York, and the recent emergence of new centres such as Singapore and China. At the same time, the immense advances that have been made and continue to be made in engineering, technology, and communications have led to the emergence of innumerable new trade practices, common understandings, and usages within which goods are carried by sea across the world, but which, because of the widespread use of alternative fora for dispute resolution, may be invisible to and unrecognized by domestic laws. This book asks: What are the implications of widespread use of arbitration for the continued development of shipping law? Are national laws on shipping destined to become ossified and obsolete? Is a new lex maritima emerging? And, most importantly, what is the role of the arbitral process in the evolution of shipping law?

International arbitration is a remarkably resilient institution, but many unresolved and largely unacknowledged ethical quandaries lurk below the surface. Globalization of commercial trade has increased the number and diversity of parties, counsel, experts, and arbitrators, which have in turn, led to more frequent ethical conflicts just as procedures have become more formal and transparent. The predictable result is that ethical transgressions are increasingly evident and less tolerable. Despite these developments, regulation of various actors in the system — arbitrators, lawyers, experts, third-party funders, and arbitral institutions — remains ambiguous and often ineffectual. This book systematically analyses the causes and effects of these developments as they relate to the professional conduct of arbitrators, counsel, experts, and third-party funders in international commercial and investment arbitration. This work proposes a model for effective ethical self-regulation, meaning regulation of professional conduct at an international level and within existing arbitral procedures and structures. The work draws on historical developments and current trends to propose analytical frameworks for addressing existing problems and reifying the legitimacy of international arbitration into the future.

This chapter presents empirical data on the vanishing commercial trial and the flight to arbitration in general, and more specifically in the maritime industry. It discusses the consequences of the trend towards the privatization of dispute resolution for the maintenance of law in more detail. In response to the fading of domestic law, which results from a lack of litigation, it considers whether or not arbitral precedent might fill in the gap. It analyses London Maritime Arbitrators Association (LMAA) and Society of Maritime Arbitrators (SMA) awards published in 2014 for their potential as precedent. It shows that it is quite difficult to infer any ratio decidendi from them. Thus, the viewpoint expressed here is sceptical about the privatization of the maintenance of maritime law, be that domestic shipping law or a transnational lex maritima. Finally, the chapter considers options for private and public actors to secure the continued development of shipping law.

This chapter discusses the corporate structure of the Singapore International Arbitration Centre (SIAC). The SIAC administers arbitrations for which it is responsible by appointing arbitrators, managing the financial and practical aspects of cases, carrying out supervisory functions entrusted by the SIAC Rules, and scrutinizing and issuing awards. It performs these roles through the following organs: (a) the board of directors, which is under the supervision of a chairman; (b) the SIAC Court, which is led by a president; (c) the chief executive officer; and (d) the secretariat, which includes the registrar. In addition, the SIAC has three overseas liaison offices which do not administer cases but promote the SIAC as an arbitral institution.

The International Swaps and Derivatives Association (ISDA) published its first Arbitration Guide on September 9, 2013 to provide its members with an overview of and guidance on: dispute settlement by arbitration; key features of arbitral procedure and relevant distinctions with litigation in domestic courts; and reasons why ISDA members might consider arbitration for complex product disputes arising under their ISDA Master Agreements. This chapter explores the themes which inspired derivative market interest in the 2013 ISDA Arbitration Guide and, in turn, inspired the collaboration that led to the publication of this volume. In so doing, it draws attention to a much wider range of financial market disputes than just those relating to complex products and the relevance of arbitration to this broader category of disputes about banking and finance.

Dennett’s has recently attempted to break the “spell” that prevents people from submitting their religious beliefs and practices to scientific investigation. But what spell is being broken? Religion is not a unified phenomenon. By supposing that it is, Dennett is led to adopt an implausible mimetic theory of religious belief, and to mistakenly assume that the presence of a Hyperactive Agency Detection Device would impugn religious belief. More troublingly, although religious beliefs and practices should be studied scientifically, it would be a mistake to treat science as the exclusive arbiter of reality. Dennett makes human beings (persons) seem like aggregates of parts. Such a view seems to have no room for human dignity, except as artifacts of an intentional stance. A plausible theory of human dignity would take people to be ontologically significant unities, who, on my view, have first-person perspectives essentially.

This chapter describes the arbitration process under international investment treaties, in particular under the Washington Convention of 1965. This Convention aimed primarily to create a new arbitral forum for the resolution of disputes between investors and states by means of the inclusion of arbitration clauses in state contracts. The travaux préparatoires of the Convention also made clear that the consent of the state to arbitration could be established through the provisions of an investment law, which prompted many states to develop a programme of bilateral treaties for the promotion and protection of investments, so-called bilateral investment treaties (BITs), which set out protections in favour of foreign investment. The dramatic growth of BITs since the mid-1980s has led to the adoption of similar provisions in the ‘investment chapters’, or collateral agreements, to multilateral economic cooperation treaties, such as the Association of Southeast Asian Nations (ASEAN) Comprehensive Investment Agreement.

Over the past two decades, recent advances in technological innovation have led to an increased demand for pediatric noninvasive procedures. This clinical demand has resulted in tremendous growth in pediatric sedation in non-operating room anesthesia (NORA) locations. Providing anesthesia in these locations challenges anesthesia providers to gain familiarity with the procedures, tailor an anesthesia plan to the procedure and location, and plan for the management of life-threatening situations in these challenging locations. Anesthesiologists are the final arbiter of whether the child is optimized for the procedure or not in NORA location with potentially limited access to backup help. This chapter explores the current and important safety issues for anesthetic administration in magnetic resonance imaging (MRI) suite, the available anesthetic techniques for MRI anesthesia/sedation and finally discuss some specialty-specific considerations for children with history of obstructive sleep apnea and difficult airway.
