Exemption from testifying and the right to refuse to testify in Roman criminal procedureThe author of article examines the scope of the exemption from testifying for the prosecution and the right to refuse to testify in the Roman criminal procedure before quaestiones. The lex Iulia iudiciorum publicorum (‘Julian law regarding public criminal trials’) was enacted during the reign of Augustus. It is generally assumed the lex purely pertained to procedural aspects of the quaestio-trial. But did the lex Iulia iudiciorum publicorum only entail provisions valid for the public criminal procedure, or did the law state provisions relevant for specific crimina separately? Through reassessing various Roman legal texts in which the lex Iulia iudiciorum publicorum is mentioned and comparing these with the epigraphical evidence, it becomes apparent the lex Iulia iudicior

The complete inviolability of envoys seems to be warranted in Rome of the principate era by the univerasally respected norm of ius gentium. The ratio behind the prohibition for spouses to donate to each other. Monopolising matrimonial property law in the dotal system. The present inquiry is based on the premise that the riddle of the highly contested rationale of the prohibition of donations between spouses can only be solved by taking into account the legal basis of this prohibition. The classical jurists treated the prohibition within the ius dotium, shorthand for ‘matrimonial property regime’, a legal matter heavily transformed by the lex Iulia et Papia which followed the goal of inciting the upper class to get married which wo

LEGAL CHARACTER OF THE PROHIBITION AGAINST ALIENATION OF DOWRY IMMOVABLES IN THE CLASSICAL ROMAN LAWSummary The well known lex Iulia de fundo dotali prohibited alienation of a Italian land being part of a dowry without women’s consent. The very meaning of this prohibition attracted very much attention of the Roman law scholars in the 20th century. The problem was as follows: was the disposition in breach of the lex Julia null and void (absolute nullity), or was it only voidable by the woman (respective nullity) after the dissolution of her marriage. In 18 BCE, Augustus proposed a series of social reform laws that significantly transformed the moral landscape at Rome. These laws were nothing short of revolutionary. Among them, the Lex Iulia de adulteriis, made adultery, stuprum and lenocinium, respectively for the first time, criminal offences at Rome. This law had a particularly enduring significance and legacy. Moreover, the law had a sustained salience in the centuries to come, through the passing of imperial rescripts until the third century CE, and its later appropriation in Justinian’s reforms and in the Christian Empire. The lex Iulia de adulteriis of 18 BCE, which for the first time made adultery a criminal offence and created a standing court, was touted by the Augustan regime as a return to the moral customs of the Republican past. However, the new reform in fact represented a significant shift away from the traditional authority of the Roman paterfamilias to punish transgressions privately at his discretion and towards the legal power of the emperor and Senate to define and regulate morality on a public scale.
