Penelitian ini adalah penelitian hukum normatif terkait UU Pilkada dan Qanun Aceh tentang Pilkada. Permasalahan krusial dalam aturan khusus terkait keistimewaan Aceh yang tidak mengatur syarat ambang batas sehingga asas lex specialis derogate legi generali tidak dapat digunakan pada pengajuan permohonan sengketa pilkada akan bertentangan dengan UUD 1945. UU Pilkada tidak dapat dikesampingkan menjadi dasar permohonan sengketa Pilkada ke Mahkamah Konstitusi. Asas itu dapat diterapkan untuk kasus yang memenuhi persyaratan, maka penyusunan hukum yang harmonis menjadi urgensi terbentuknya badan peradilan khusus yang menyelesaikan sengketa pilkada.AbstractThe contestation to National Election Act’s implementation or principle of lex specialis derogat legi generalis as rule’s problem reference to regional dispute in Aceh. This research is a normative legal related to Aceh Election and Qanun on Election. The crucial problem with existence of special rules of Aceh’s privilege are not set by threshold conditions. Lex specialis derogate legi generali’s principle cannot be used in election dispute will contradict the 1945 Constitution. The Election Act cannot be ruled as dispute basis to Constitutional Court. The principle can be applied to cases that requirements, so harmonious legal drafting becomes urgency to formalize a special judicial body.

This study aims to assess and analyze the application of the principle of lex specialis the derogat legi generali in the Criminal Justice System related to the stages in the criminal justice process, and the form of the indictment in applying the principle of lex specialis the derogat legi generali. The method used is empirical juridical with descriptive analytical. The result shows that this principle is applied in criminal cases that violating the general and special criminal provisions in the Penal Code, the general criminal provisions in the Penal Code and special criminal provisions outside the Penal Code, as well as criminal cases that violating two special criminal acts outside the Penal Code. Regarding the fase of criminal procedure in handling the case under this principle, it is implemented in the adjudication process, using the subsidiarity or cumulative model of chargingPenelitian ini bertujuan untuk mengkaji dan menganalisis penerapan asas lex specialis derogat legi generali dalam Sistem Peradilan Pidana terkait dengan tahapan dalam proses peradilan pidana, dan bentuk surat dakwaan dalam menerapkan asas lex xpecialis derogat legi generali tersebut. Salah satu ciri asas hukum adalah bersifat dinamis sehingga dapat disesuaikan dengan perkembangan zaman. Demikian juga asas lex specialis derogat legi generali yang mengalami perkembangan secara teoretik. Salah satu derivate dari asas lex specialis derogat legi generali adalah asas lex specialis systematis. Dalam konteks hukum pidana, dikenal pembagian menurut sumber hukum pidana yang melahirkan hukum pidana umum dan hukum pidana khusus. Salah satu hukum pidana khusus tertua adalah hukum pidana pajak yang secara teoretik memenuhi kriteria sebagai lex specialis systematis. Metode penelitian dalam tulisan ini seluruhnya menggunakan studi pustaka. Selain menganalisis teori-teori yang aktual terkait asas lex specialis derogat legi generali dan hukum pidana pajak. Hasil Penelitian ini menunjukan bahwa hukum pidana pajak memenuhi kriteria sebagai lex specialis systematis karena adresat-nya sangat khusus yaitu wajib pajak dan petugas pajak. Selain itu, baik ketentuan materiil maupun ketentuan formil dalam hukum pidana pajak menyimpang dari KUHP dan KUHAP. Adapun saran yang dapat diusulkan kepada Dewan Perwakilan Rakyat dan Presiden sebagai pembentuk undang-undang adalah: Perlu melakukan perubahan mendasar terhadap undang-undang ketentuan umum pokok perpajakan dengan mengingat hukum pidana pajak adalah ius singular sebagai hukum adminstrasi yang diberi sanski pidana.

The present study sets out the implementation of Lex Specialis in Sports Jurisdiction. It presents an introduction to Sports Law and the rules of Lex Sportiva and Lex Olympica. Following the introduction, this paper presents the concept of Sports Jurisdiction and the competence of the Sport Arbitral Bodies to rule on the constitutionality of the law. Furthermore, this study focuses on the necessity for the establishment of an International Sports Constitutional Charter with special rules for international sports activities and the establishment of a special International Sports Court. Finally, is investigated the application of the Lex Specialis Derogat Legi Generali Principle in Sports Law. In particular, this study points out that Special rules of sports law prevail over ordinary rules of law, according to the general principle of law Lex Specialis Derogat Legi Generali. It is highlighted that Sports Law is not a subcategory of international law, as International Sports Law, but a different kind of law, Lex Sportiva/Olympica. Lex Sportiva/ Olympica is an international “unethnical” law, which exists in parallel to the international law. It constitutes a sui generis sports law legal order, imposed heteronomously on the sporting world by various international organizations.

Penelitian ini mengkaji dan menganalisa adanya anomali penerapan Asas lex specialis derogat legi generali dalam ketentuan pidana yang dilaksanakan di Indonesia. Metode penelitian ini menggunakan metode hukum normatif dan yuridis empiris yang bersifat deskriptif analitis, mencoba mendapatkan gambaran menyeluruh tentang anomali penerapan Asas Lex Specialis Derogat Legi Generali dalam ketentuan hukum pidana Indonesia. Hasil dari Penelitian ini memberi masukan kepada badan Legislatif dan Eksekutif sebagai perancang dan pembentuk undang-undang agar selalu mengedepankan asas-asas yang ada dalam hukum saat merancang kebijakan-kebijakan yang akan diberlakukan, sehingga dapat meminimalisir anomali hukum yang terjadi di lapangan.

This paper examines the interplay between international human rights law and international humanitarian law especially in situations of armed conflict. When this overlap occurs, the general position in international law is that international human rights law shall apply in times of peace as ‘lex generalis’, or general law, while international humanitarian law shall apply in situations of armed conflict as ‘lex specialis’, or special law, thereby displacing or keeping in abeyance general law. The position is reliant on the doctrine ‘lex specialis derogat legi generali’ meaning that special or specific law suspends general law. The paper, therefore, examines the appropriateness of using the doctrine ‘lex specialis derogat legi generali’ in situations of interplay between the two fields of international law, especially when it comes to the question of the sanctity of life. With reference to the duty to protect life, the paper notes that, the doctrine of ‘lex specialis’ does not adequately clarify the coordination which must desirably exist between the two fields of international law, and in any case it places limits on protection of victims. The paper argues, therefore, that, a well-coordinated application of international human rights law and international humanitarian law is vital to ensuring adequate protection of victims during all situations of armed conflict, because the general trend in the world today is to move towards broader protection of victims, and not towards limitation. In conclusion, therefore, the paper advocates for the need to substitute the ‘lex specialis’ doctrine with a more coherent theory which balances the reality of conflict with the respect for humanity and protection of life.

This paper aims to analyze the legal aspects of the general seizure and criminal seizure in Indonesian positive law, as well as to understand the legal efforts of the curator towards the assets of bankrupt estates placed under criminal seizure for corruption and economic crimes. The method used in writing this article is the normative legal research method, which starts from the normative problem of conflict of norms, and the results of this journal article are to determine the position of general seizure and criminal seizure based on the principle of legal preference, namely the principle of lex superior derogat legi inferiori, lex posterior derogate legi priori, and lex specialis derogate legi generalis, and the legal efforts that can be taken by the curator when the assets of bankrupt estates are placed under criminal seizure is by filing an objection to the Corruption Court and by filing a pretrial against the seizure actions carried out by the corruption investigators. The legal status of general attachment and criminal attachment can be determined by the principles of legal preference, including lex superior derogat legi inferiori, lex posterior derogate legi priori, and lex specialis derogate legi generalis. In most cases, general attachment takes priority over criminal attachment, except in cases of corruption (tipikor). In such cases, neither general nor criminal attachment can take precedence over the other. If criminal attachment is imposed on a bankrupt estate, the Curator can file an objection with the Corruption Court within two months of the court decision.

his research is focused on the regulation of implementing guarantee for halal products in Indonesia and crucial issues related to them. This research is normative juridical research using a statute approach. The conclusions of this study include; first, there are several crucial issues and topics relating to the implementation of guarantee of halal products in Indonesia, namely halal certification, mandatory and voluntary in halal certification, criminal provisions, and halal product guarantee management institutions. Second, the regulation of halal product guarantees when viewed from the Statute Approach can be analyzed using three legal principles: (1) lex superior derogat legi inferiori concludes that all rules for guaranteeing lower halal products are replaced by the higher ones; (2) lex specialis derogat legi generali confirms that the JPH Law is a specific regulation that regulates the guarantee of halal products; and (3) lex posterior derogat legi priori requires that the rules for guaranteeing halal products as contained in the JPH Law replace the guarantee rules for halal products that existed in the previous period.

Law Number 11 / 2008 on Information and Electronic Transaction (UU ITE) is the regulation concerning on criminal law in addition to the Criminal Code (KUHP). UU ITE is commonly regarded additional regulation of the Criminal Code as a special law (lex specialis) in which Penal Code is deemed as lex generalis. It is based on the principle of lex specialis derogate legi generalis. This article uses legal research to review the decision of District Court in Bandung Number 1033/PID.B/2014/PN.BDG where it comprises legislation and cases. It concludes that the judge is not frugal in applying the principle lex specialis derogat legi generalis in the consideration. This is associated with the indictment of public prosecutor which only prejudges with article 303 paragraph (1) to 2. In contrast, the indictment which does not meet the requirement of a careful, clear, and complete description asserts to become void by law.

This study's objective is to investigate the policy of national environmental law politics in light of the problems posed by the global free market in the era of globalization. This study employs a legal normative research methodology with a statute approach. The study's findings indicate that environmental protection and management based on environmental legal standards necessitates a balance between economic interests, the maintenance of environmental functions, and social conditions. All this time, the two objects seemed to be divided from each other. Government and the corporate sector are perceived as entities that place commercial interests above environmental protection. Economic development alone has been ineffective in reducing poverty, averting social conflicts caused by unequal access to natural resources, and increasing the rate of environmental degradation. A legal settlement that can be used as a guide for environmental law enforcement officials against environmental laws and regulations that contain criminal penalties that are not in harmony with the provisions of Law No. 32 of 2009 as one of the legal adages: (i) lex specialis derogat legi generali, (ii) lex superior gerogat legi inferiori, and (iii) lex posterior derogat legi anteriori.

This research was focused on the regulation of halal product assurance implementation in Indonesia on statute approaches study and the crucial issues associated with it. In the context of providing halal product assurance implementation, regulation is the basis of legality for all elements of the state in organizing the State. Before the emergence of the Halal Product assurance (JPH) Law, there were many regulations relating to the assurance of halal products. In forming a regulation, there are crucial issues/topics that suck up a lot of public attention, so that it can influence a policy that will be ratified. The conclusions of this research included; first, there were several crucial issues and topics related to the implementation of halal product assurance in Indonesia, they were; (1) halal certification/labeling; (2) mandatory (obligation) or voluntary in halal certification; (3) criminal provisions; and (4) halal product assurance management institutions. Second, halal product assurance regulations when viewed from the Statute Approach can be analyzed using three legal principles, consisting of (1) the principle of Lex Superior Derogat Legi Inferiori concluded that all halal product assurance rules that have a high position must replace all lower halal product assurance rules. (2) The principle of Lex Specialis Derogat Legi Generali confirmed that the Halal Product Assurance (JPH) Law was a specific regulation governing the assurance of halal products. This Halal Product assurance (JPH) Law replaced the previous halal product assurance rules; and (3) the principle of Lex Posterior Derogat Legi Priori required that the halal product assurance provisions contained in the Halal Product assurance (JPH) Law replaced the existing halal product assurance rules in the previous period.

Hasilnya Pertama, dalam Kompilasi Hukum Islam dan KUH Perdata (Burgerlijk Wetboek) menjelaskan anak yang lahir dalam pernikahan walaupun tidak tercatatkan adalah anak sah, sedangkan anak hasil hubungan tanpa pernikahan adalah anak zina dan Yusriprudensi MK menegaskan hubungan anak dengan seorang laki-laki sebagai bapak semata-mata karena adanya ikatan perkawinan, akan tetapi dapat juga di dasarkan pembuktian adanya hubungan darah antara anak dengan laki-laki tersebut sebagai bapak. Sedangkan mengenai pengaturan hak waris anak luar nikah, adanya upaya pemerintah dalam pemberian satu bidang kekuasan kehakiman berupa Peradilan Agama yang membawahi konsep hukum kewarisan. Yang senada dengan konsep asas hukum Lex specialis derogat legi generali yaitu asas penafsiran hukum yang menyatakan bahwa hukum yang bersifat khusus (lex specialis) mengesampingkan hukum yang bersifat umum (lex generalis). Kedua, dalam pembagian kewarisan anak luar nikah masyarakat Kebonan lebih cenderung menggunakan kewarisan kultural, yakni harmonisasi antara hukum perdata dan hukum Islam yang mengalami missinterpretasi dalam pemahaman kalangan hukum di Pengadilan Agama

Minister of Health made Minister of Health Regulation Number 9 of 2020, PSBB. Seems like the synergy between the Ministries hasn’t been implemented properly, ex. the Ministry of Law and Human Rights published Regulation of The Ministry of Law and Human Rights Number 10 of 2020 and The Ministry of Transportation with their Regulation Minister of Transportation Number 18 of 2020 changed to Regulation of Minister of Transportation 41 of 2020. The regulations contradict with the Minister of Health a quo regulation. Which regulation should be used? Who’s responsible for it? It’s necessary to review synchronization between Ministry regulations.
This research used Normative Juridical, Literature Study, Interview, and Analysis Method.
A brief conclusion if there’s a lawsuit against the a quo regulation then the responsibility lies with the Ministry of Health. Disharmonization between ministerial regulations can be resolved by Judicial Review, Mediation by the Ministry of Law and Human Rights, and applying the principles of Lex Superior Derogat Legi Inferiori, Lex Specialis Derogat Legi Generalis, and Lex Posterior Derogat Legi Priori Principles.

Hopes that the Constitutional Court (CC) is not acting as legislator (maker norm) was not easy to achieve. This is because in some cases the judicial examined, tried, and decided, the CC actually act as a norm-making body (one of them in the Case Number 21/PUU-XIV/2016). Thus, in terms of the concept of state power, the CC has a dual role as the holders of state power in the judiciary and the legislature. The problem of this study is the interpretation of the CC of the of conspiracy and the relationship between of conspiracy according to Article 88 of the Code of Penal (CP) in accordance with Article 15 of the Law on the Eradication of Corruption (LEC) before and after the enactment quo decision. CC interpretation against conspiracy is the right step to ensure legal certainty. However, the CC for an interpretation of action are included unlawful. Thus, in hearing and deciding the case a quo, the CC took a negative role, namely to uphold the law by breaking the law. The relationship between conspiracy under Article 88 of CP with according to Article 15 of LEC before the stipulated judgment a quo is not applied the principle of Lex Specialis Derogat Legi Generalis after adoption of a quo decision to do is to be the application of the principle of Lex Specialis Derogat Legi Generalis.

Sedangkan Undang-Undang Republik Indonesia Nomor 21 Tahun 2008 tentang Perbankan Syariah, berlaku khusus. Penerapan asas lex specialis derogat legi generali menegaskan bahwa Undang-Undang Republik Indonesia Nomor 21 Tahun 2008 memiliki kedudukan lebih kuat dibandingkan Undang-Undang Republik Indonesia Nomor 23 Tahun 2004 yang berlaku umum. Keberlakuan Undang-Undang Republik Indonesia Nomor 21 Tahun 2008 mengokohkan eksistensi perbankan syariah untuk leluasa menjalankan aktivitas dan produk-produknya. Di samping itu, apabila merujuk kepada Undang-Undang Republik Indonesia Nomor 30 Tahun 1999, maka penyelesaian sengketa perbankan syariah dapat ditempuh melalui dua cara yaitu, pengadilan negeri dan badan arbitrase. Hal tersebut karena dalam beberapa perkara pengujian undang-undang yang diperiksa, diadili, dan diputusnya, MK justru bertindak sebagai lembaga pembuat norma (salah satunya dalam Perkara Nomor 21/PUU-XIV/2016). Dengan demikian, ditinjau dari konsep kekuasaan negara, MK memiliki peran ganda, yaitu sebagai pemegang kekuasaan negara di bidang yudikatif dan legislatif. Rumusan masalah dalam kajian ini adalah tafsiran MK terhadap pemufakatan jahat oleh koruptor serta hubungan antara pemufakatan jahat menurut Pasal 88 Kitab Undang-Undang Hukum Pidana (KUHP) dengan menurut Pasal 15 Undang-Undang tentang Pemberantasan Tindak Pidana Korupsi (UU PTPK) sebelum dan setelah ditetapkannya putusan a quo. Tafsiran MK terhadap pemufakatan jahat oleh koruptor adalah langkah yang tepat guna menjamin kepastian hukum. DOCUMENTARY EVIDENCE CERTIFIED AS TRUE BY A PROFESSIONAL PROXY IN PROCEEDINGS FOR AN ENTRY IN THE NATIONAL COURT REGISTER Summary The article concerns the acceptable form of documentary evidence in proceedings for an entry in the Polish National Court Register, in particular whether as of 1 January 2010 it is permissible to attach documents certified as true copies by the proxy appearing in the case, that is an attorney, legal representative, or attorney of the Polish State Treasury Office, to applications for entry in the Register. The analysis of this issue examines the provisions of Art. 129 § 3 and Art. 6944 § 1 of the Polish Civil Procedure Code, including an analysis of the relation between these provisions. In conclusion the author observes that despite the fact that there is a lex generalis ‒ lex specialis relations between Art. 129 § 3 and Art. 6944 § 1 of the Code, the principle of lex specialis derogat legi generali does not apply. Consequently, in the proceedings for entry in the Register there are no legal obstacles for the submission of documents on the basis of which entries are to be made in the Register, in the form of copies or transcripts certified as a true copy by the acting proxy (attorney, legal representative, or attorney of the State Treasury Office) of the party to such proceedings.

It should be noted that not every monetary penalty can be mitigated pursuant to article 189d of the Code of Administrative Procedure – if special provisions include premises which should be followed by the authority in the course of imposing a penalty, then it is impossible to make auxiliary use of the guidelines expressed in the Code (following the principle lex specialis derogat legi generali). Pursuant to article 40 (12) of the Act on Public Roads, the occupation of the road lane for non-road purposes without appropriate permission is punishable with an administrative monetary penalty. In this article, the authors discuss the admissibility of mitigation of the administrative monetary penalty for the occupation of the road lane in the light of article 189d of the Code of Administrative Procedure.

Among the urgency of economic affair through the acceleration of investment will face off the urgency of the protection and environmental management. Both matters come as the focus on this article analysis here are these, first the legislation as a system and implication of job creation's law legality against UU-PPLH as environmental clustering in Indonesia. Second, the implication of the change of UU-PPLH due to UU-CK. Here is the conclusion, first the change of UU-PPLH's primary norm due to UU-CK will impact on another norm which the legality directly related on the protection and environmental management overall. Second, the implication identified from the content material, both law potentially to create a norm conflict on the action and law enforcement. Meanwhile, if this case related to the principle of legal conflict settlement, then no principle can be used either the principle of lex specialis derogat legi generalis, the principles of Lex superior derogat legi inferior, and the principles of lex posterior derogat legi priori. To encounter the norm conflict matter, the better one in reformating regulation in the way of Omnibus law method, despite it is limited on the system of clustering and organization, but also not repeal and state the illegality of the impacted regulation.

The purpose of this study is to analyze the authenticity of the minutes of the General Meeting of Shareholders made electronically and the validity of the signature of the notary in the deed of the General Meeting of Shareholders made electronically. This study uses a normative legal research method by using a type of approach, namely, the statutory approach and the concept approach. The results of this study indicate that the GMS deed made electronically is an authentic deed if it uses the lex specialis derogate legi generali principle where the lex generalis is Article 16 paragraph (1) letter m of the Notary Jabata Law, while the lex specialis is Article 77 paragraph (1) in conjunction with the Elucidation of Article 77 paragraph (4) of the Limited Liability Company Law. The deed of the General Meeting of Shareholders can be ratified by a notary after being signed by the parties, and with the fulfillment of the provisions of Article 11 of the Information and Electronic Transaction Law, and the requirements specified in the provisions of Article 77 of the Limited Liability Company Law, as well as the ratification of the notary, the deed The General Meeting of Shareholders can be used as perfect evidence in court if in the future there are legal problems that occur between shareholders related to the deed of the General Meeting of Shareholders.

Tujuan dari penelitian ini adalah untuk menganalisa keautentikan akta risalah Rapat Umum Pemegang Saham yang dibuat secara elektronik dan keabsahan tandatangan notaris dalam akta Rapat Umum Pemegang Saham yang dibuat secara elektronik. Penelitian ini menggunakan metodepenelitian hukum normatif dengan menggunakan jenis pendekatan yaitu, pendekatan perundang-undang dan pendekatan konsep. Hasil dari penelitian ini menunjukan bahwa Akta RUPS yang dibuat secara elektronik adalah akta otentik apabila menggunakan asas lex specialis derogate legi generali dimana yang menjadi lex generalis–nya adalah Pasal 16 ayat (1) huruf m Undang-Undang Jabata Notaris, sedangkan lex specialis-nya adalah Pasal 77 ayat (1) jo Penjelasan Pasal 77 ayat (4) Undang-Undang Perseroan Terbatas. Akta Rapat Umum Pemegang Saham dapat disahkan oleh notaris setelah ditandatangani oleh para pihak, dan dengan terpenuhinya ketentuan pada Pasal 11 Undang-Undang Informasi dan Transaksi Elektronik, dan persyaratan-persyaratan yang ditentukan dalam ketentuan Pasal 77 Undang-Undang PT, serta pengesahan notaris maka akta Rapat Umum Pemegang Saham dapat dijadikan alat bukti yang sempurna di pengadilan apabila dikemudian hari terdapat permasalahan hukum yang terjadi antar pemegang saham terkait akta Rapat Umum Pemegang Saham tersebut.

Keputusan (beschikking) yang diterbitkan oleh Direktorat Jenderal Pajak atau Pejabatnya bukanlah termasuk obyek sengketa pada Peradilan Tata Usaha Negara (PTUN) dan badan peradilan lainnya, melainkan Pengadilan Pajak. Pada kenyataannya, kekhususan atau spesialitas dari Hukum Pajak tersebut seolah menjadi ‘hilang’ ketika harus berhadapan dengan bidang hukum lain yang juga bersifat khusus. Hakim pada pengadilan lain tersebut seringkali memutuskan untuk tetap melanjutkan proses pemeriksaan pada pokok perkara, dengan menolak eksepsi yang diajukan oleh pihak Direktorat Jenderal Pajak. Penelitian ini dilakukan untuk mengetahui sejauh mana spesialitas Hukum Pajak dalam lapangan hukum di Indonesia dapat dipertahankan, terutama ketika berhadapan dengan ketentuan atau norma hukum lain yang juga bersifat khusus (spesialis). With transparent governance, blue carbon can be an effective tool to accelerate the achievement of NDC targets. Methode: This empirical juridical research applies a participatory approach involving discussions and interviews with several related parties. It also uses statutory and conceptual approaches. This paper presents a new construction of blue carbon ecosystem governance in Indonesia. Result and Conclusion: The overlapping authority between the Ministry of Environment and Forestry and the Ministry of Maritime Affairs and Fisheries is resolved by applying the legal principles lex specialis derogate legi generali and lex posteriori derogate legi inferiori. To achieve ideal institutional governance of mangrove management, there is a need for a cooperation scheme between sectors of government agencies, namely between the Ministry of Maritime Affairs and Fisheries, the Ministry of Environment and Forestry, and the non-structural institution Peat and Mangrove Restoration Council.

Berdasarkan asas lex specialis derogat legi generali, maka status Perum Damri Surabaya sebagai jenis pekerjaan yang bergerak pada sektor usaha atau pekerjaan tertentu dan jenis dan sifat pekerjaan yang dijalankan secara terus menerus. Hal ini berdampak kepada upah yang diperoleh oleh pengemudi bus berupa upah pokok dan upah lembur. Pemerintah belum mengatur secara khusus ketentuan upah lembur pengemudi bus, sehingga oleh Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Pasal 12 Keputusan Menteri Tenaga Kerja dan Transmigrasi Republik Indonesia Nomor KEP. 102/MEN/VI/2004 tentang Waktu Kerja Lembur dan Upah Kerja Lembur diserahkan kepada Perum Damri Surabaya untuk mengatur upah lembur. Hal ini berpotensi terjadi pelanggaran-pelanggaran dalam pembayaran upah lembur sehingga dibutuhkan regulasi yang khusus mengatur upah lembur pengemudi bus.

Akibat dari adanya kesalahan berlalulintas, maka dengan ini Kepolisian Negara Republik Indonesia khususnya dibidang satuan lalulintas menerapkan sistem ETLE sebagai sanksi dalam bentuk penilangan yang tertuang pada UU Nomor 22 Tahun 2009 mengenai Lalu Lintas dan Angkutan Jalan (LLAJ).
Dalam penelitian ini, penulis menggunakan penelitian hukum normatif deskriptif. Metode pengumpulan data dalam penulisan makalah ini adalah metode penelitian kepustakaan. Pada penelitian ini menggunakan analisis data dengan metode kuantitatif yang menghasilkan data deskriptif analitis.
Penerapan sistem ETLE sebagai sanksi berupa denda telah dilaksanakan dengan baik dalam Undang-Undang Nomor 22 (LLAJ) Tahun 2009 tentang Angkutan Jalan. Dalam pelaksaan sistem ini perlu diketahui bahwa adanya suatu asas hukum yaitu Asas “lex specialis derogat legi generali” yaitu hukum secara khusus didahulukan daripada hukum secara umum. Dimana kita ketahui asas hukum semacam ini menjadi penguat pertanggungjawaban hukum yang akan disanksikan kepada pelanggar lalu lintas.

No one is safe until everyone is safe. Although this phrase has received wide consensus during COVID-19, this pandemic has witnessed a surge in health nationalism. States have imposed export restrictions on COVID-19-related medical supplies and vaccines seeking to preserve them for their own populations. This has adversely affected the availability of those necessary tools in other countries undermining their efforts in fighting the pandemic. Thus, it could be argued that States have violated their obligation to cooperate under Art. 44 of the 2005 World Health Organisation (WHO) International Health Regulations (IHR). Nevertheless, States’ export restrictions have been legally justified under the General Agreement on Trade and Tariffs (GATT). Does this mean that the duty to cooperate is an empty obligation that fails to counter health nationalism? It is the purpose of this paper to demonstrate otherwise using the principle of lex specialis derogat legi generali. Under this principle, the duty to cooperate in pandemic response under Art. 44 of the IHR prevails over States’ rights under gatt, rendering health nationalism legally unjustified.

<p><em>The purpose of this study is to examine how far the process of parate execution of mortgage rights without court order is regulated in Indonesia to solve non-performing loans and the legal considerations of the invalidity parate execution over the objection filed by the debtor granting the mortgage rights. Parate execution is the power granted by Article 6 and Article 14 paragraph (3) of the Mortgage Rights Law to the first holder of a mortgage rights to execute the mortgage rights on its own power based on the executorial power of the mortgage rights certificate without approval from the debtor granting the mortgage rights and court order. However, the practice of the article has not fully guaranteed legal certainty due to the inconsistency of the Mortgage Rights Law and the incompatibility of legal interpretation so it is important that this research is carried out to avoid repeated misunderstandings. This research is normative juridical that uses a statute and case approach with library research. The results show that the inconsistency of parate execution of mortgage rights still followed the procedure for execution of the grosse mortgage deed regulated in Article 1178 paragraph (2) of the Civil Code and Article 224 HIR/258 RBg, that need approval from the debtor granting the mortgage rights and court order. The application principles of lex posterior derogat legi priori and lex specialis derogat legi generalis, followed by the grammatical interpretation to positive law, affects the progressive aspect of the ease of execution.</em></p><p> </p><p>Penelitian ini bertujuan mengkaji sejauh mana proses parate eksekusi objek hak tanggungan tanpa fiat pengadilan untuk menyelesaikan kredit bermasalah di Indonesia diatur dan pertimbangan-pertimbangan hukum ketidakabsahan parate eksekusi atas perlawanan yang diajukan debitur pemberi hak tanggungan. Parate eksekusi merupakan kewenangan yang diberikan Pasal 6 <em>jo</em> Pasal 14 ayat (3) UUHT kepada pemegang hak tanggungan pertama mengeksekusi objek hak tanggungan atas kekuasaan sendiri berdasarkan kekuatan eksekutorial sertifikat hak tanggungan tanpa perlu persetujuan debitur pemberi hak tanggungan maupun fiat pengadilan. Namun praktiknya pasal tersebut belum sepenuhnya menjamin kepastian hukum sebab ketidakkonsistenan dari UUHT itu sendiri dan ketidakcermatan penafsiran hukum sehingga penting penelitian ini dilakukan demi menghindari kesalahpahaman yang berulang. Penelitian ini penelitian yuridis normatif yang menggunakan pendekatan perundang-undangan dan kasus melalui penelusuran kepustakaan. Hasil penelitian menunjukkan bahwa inkonsistensi pelaksanaan parate eksekusi objek hak tanggungan yang masih mengikuti tata cara eksekusi grosse akta hipotik yang diatur Pasal 1178 ayat (2) KUHPerdata serta Pasal 224 HIR dan/atau Pasal 258 RBg, yang memandang perlunya persetujuan terlebih dahulu dari debitur dan keterlibatan pengadilan untuk mengeksekusi. Kewenangan pelaksanaan atau eksekusi putusan Badan Arbitrase Syariah Nasional secara peraturan perundang-undangan masih memakai Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Pilihan Penyelesaian Sengketa Pasal 61 yang merupakan kewenangan Pengadilan Negeri. Hal ini tidak sesuai dengan apa yang menjadi tugas dari Badan Arbitrase Syariah Nasional yang mempunyai tugas menyelesaikan sengketa-sengketa Arbitrase di bidang ekonomi syariah. Perkara-perkara Ekonomi Syariah menurut Undang-Undang Nomor 3 Tahun 2006 tentang Perubahan Atas Undang-Undang Nomor 7 Tahun 1989 tentang Peradilan Agama secara tegas bahwa dalam Pasal 49 menyebutkan kewenangan penyelesaian sengketa Ekonomi Syariah merupakan kewenangan absolut dari Pengadilan Agama. Oleh karenanya ada dua pendapat mengenai hal ini. Pertama, kewenangan eksekusi putusan Badan Arbitrase Syariah Nasional tersebut merupakan wewenang Pengadilan Negeri. Kedua, berpendapat bahwa semua yang berkaitan dengan penyelesaian sengketa ekonomi syariah berdasarkan Pasal 49 huruf (i) merupakan kewenangan Pengadilan Agama, pendapat ini didasarkan kepada asas hukum lex posteriori derogat legi priori dan lex specialis derogat legi generali. Selain itu Pasal 1 ayat (3) UUD 1945, Negara Republik Indonesia adalah negara hukum yang di dalamnya ada dua pengertian yaitu supreme of law dan equality before the law. Penafsiran terhadap supreme of law yaitu kepastian hukum. Pasal 61 UU No. 30 1999 merupakan suatu kepastian hukumnya untuk para pihak yang bersengketa di bidang Arbitrase. Mengenai pengertian equality before the law yaitu sama kedudukan di depan hukum, jadi kedudukan pengadilan negeri dan pengadilan agama sama di depan para pihak sengketa arbitrase, tetapi karena pengadilan agama telah dijustifikasi oleh undang-undang bahwa pengadilan agama mempunyai kewenangan absolut terhadap penyelesaian sengketa ekonomi syariah, dan sengketa-sengketa ekonomi syariah dapat pula diselesaikan melalui jalur nonlitigasi di Badan Arbitrase Syariah Nasional semuanya di bidang ekonomi syariah, maka tepatlah apabila pelaksanaan atau eksekusi putusan Badan Arbitrase Syariah Nasional di alihkan ke Pengadilan Agama.

Apabila mahkamah partai politik tidak mengeluarkan putusan atau salah satu pihak tidak menerimanya, maka dapat ditempuh upaya hukum melalui gugatan ke pengadilan negeri setempat. Dalam konteks tersebut, artikel ini bertujuan untuk menganalisis perselisihan internal partai politik di tubuh Partai Golkar yang diajukan ke Pengadilan Negeri Jakarta Utara, yang justru menggunakan dalil gugatan perdata perbuatan melawan hukum, dan bukan gugatan khusus perselisihan internal partai politik yang telah diatur dalam Undang-Undang Partai Politik. Metode penelitian yang digunakan adalah penelitian normatif empiris, dengan pendekatan studi kasus terhadap Putusan Nomor 91/Pdt.G/2015/PN.Jkt.Utr dan Putusan Mahkamah Agung Nomor 96 K/Pdt/2016. Berdasarkan hasil analisis, artikel ini menyimpulkan bahwa gugatan perdata perbuatan melawan hukum dalam penyelesaian perselisihan kepengurusan internal partai politik tidak sesuai dengan ketentuan Undang-Undang Partai Politik yang bersifat lex specialis derogat legi generali. Selain itu kedudukan putusan Mahkamah Agung juga bertentangan dengan hukum, karena putusan tersebut didasarkan atas suatu proses yang salah dan tidak sesuai ketentuan undang-undang. Namun demikian, putusan tersebut telah berstatus berkekuatan hukum tetap dan diterima oleh para pihak yang berperkara.Kata kunci: partai golkar; musyawarah nasional; mahkamah partai. ABSTRACTThe Political Party Law has regulated a settlement mechanism on a dispute within the internal political party by a tribunal of political party. If the tribunal takes no decision or one of the parties does not accept the decision, the process can be appealed by ling a petition to a district court. In this context, this article aims to analyze an internal dispute of political party that occurred in the Golkar Party, which was led to the North Jakarta District Court. Interestingly, the petition was based on civil lawsuit arguments and not a special claim of internal political party dispute regulated in the Political Party Law. This research used empirical normative research focusing on a case study on Decision Number 91/Pdt.G/2015/PN.Jkt.Utr and Supreme Court Decision Number 96 K/Pdt/2016. This research concludes that a civil lawsuit for resolving an internal political party dispute is not in accordance with the provisions regulated in the Political Party Law based on the principle of lex specialis derogat legi generali. In addition, the decision of the Supreme Court is also contrary to the positive law since the decision was based on an incorrect process and not in accordance with the law. However, the decision is nal and binding as well as accepted by all disputed parties.Keywords: golkar party; national assembly; political party court.

The working time of the bus driver as implied by Article 90 paragraph (4) of Law Number 22 of 2009 on Road Traffic and Transportation, is not in sync with Law Number 13 of 2003 concerning Labor because based on the principle of lex specialis derogat legi generali, the status of Perum Damri Surabaya as a type of work engaged in certain business sectors or occupations and the type and nature of work carried out continuously. This affects the wages earned by bus drivers in the form of basic wages and overtime pay. The government has not specifically regulated the provisions of overtime drivers' wages, so that by Law Number 13 of 2003 concerning Manpower and Article 12 of the Decree of the Minister of Manpower and Transmigration of the Republic of Indonesia Number KEP. 102 / MEN / VI / 2004 concerning Overtime and Overtime Working Time shall be submitted to Perum Damri Surabaya to regulate overtime pay. This has potential violations in the payment of overtime wages, so a regulation that specifically regulates the bus driver's overtime wages.

The background of the article is the contents of Article 59 paragraph (3) and explanation of paragraph (1) of the Law on Judicial Power. The article authorizes the District Court to implement the decision of the Sharia arbitration body on the resolution of Islamic economic disputes. The article and explanation of the verse contradicts the absolute authority of the Religious Courts regulated in Article 49 letter (i) of the Law on Religious Courts. This shows that, the legislators are not consistent in making laws and regulations, so that it creates legal uncertainty. By applying the normative legal research method to the statute approach and case approach, this article seeks to describe the phenomenon of legal conflicts that occur. From the in-depth analysis it can be concluded that the legal provisions regarding the implementation of the decision of the National Sharia Arbitration Board are regulated in the Arbitration Law, the Judicial Power Act and the Religious Courts Act. Esensi dari Pasal 366 dan Pasal 369 KUH Perdata adalah dasar pengaturan kewenangan BHP dalam melakukan pengawasan perwalian atas harta kekayaan anak yang tidak berada di bawah kekuasaan orang tuanya. Kewenangan BHP dalam pengawasan perwalian anak pada prakteknya menjadi kontraproduktif karena anggapan bahwa kedua pasal tersebut sudah tidak berlaku lagi. Kondisi ini mengakibatkan belum terpenuhinya perlindungan hukum oleh negara terhadap anak. Penelitian ini hendak menjawab dua rumusan masalah yaitu bagaimana kewenangan BHP dalam pengawasan perwalian anak dan bagaimana kedudukan kedua pasal tersebut dalam persepektif lex specialis derogat legi generali. Metode pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan dan teoritik. Hasil penelitian menunjukkan bahwa kewenangan BHP dalam pengawasan perwalian anak belum berjalan optimal karena pengadilan belum menjalankan secara sungguh-sungguh kedua pasal tersebut. Pasal 35 ayat (1), (2), dan (3) UU Nomor 23 tahun 2002 tentang Perlindungan Anak belum dapat dianggap sebagai ketentuan khusus yang dapat mengesampingkan Pasal 366 dan Pasal 369 KUH Perdata karena tidak mengatur secara khusus tentang pengawasan harta kekayaan anak di bawah perwalian. Hasil penelitian ini menyimpulkan bahwa kewajiban Penanggung kepada Kreditor Pemegang Jaminan Perorangan tetap melekat sekalipun Penanggung dalam PKPU. tujuan penelitian ini adalah mengkaji dan menganalisa kekuatan pembuktian terhadap terhadap tanda tangan elektronik pada akta rapat umum pemegang saham yang dilakukan secara telekonferensi, mengkaji dan menganalisa akibat hukum terhadap tanda tangan elektronik pada rapat umum pemegang saham yang dilaukan secara telekonferensi, serta mengkaji dan menganalisa pedoman kedepan terkait tanda tangan elektronik pada rapat umum pemegang saham secara telekonferensi dari segi sarana dan prasarana. Metode penelitan yang digunakan yakni yuridis normatif (legal research). Pendekatan masalah yang digunakan dalam penelitan ini yaitu pendekatan perundang-undangan (statute approach), pendekatan perbandingan (comparative approach), dan pendekatan sejarah (historical approach). Sumber bahan hukum yang digunakan ialah bahan hukum primer dan sekunder. Hasil penelitian menyimpulkan Pertama, Rapat Umum Pemegang Saham (RUPS) Telekonferensi sudah dilegalkan dalam pasal 77 ayat (1) jo. penjelasan pasal 77 ayat (4) Undang-Undang Perseroan Terbatas (UUPT) dan tanda tangan elektronik juga sudah diatur dalam pasal 11 Undang-Undang Informasi dan Transaksi Elektronik. Pasal tersebut kontras dengan aturan UUJN-P pasal 16 ayat (1) huruf m yang mengharuskan para pihak untuk bertatap langsung dengan Notaris. Beberapa pasal tersebut dapat disimpulan dinilai dari asas perundang-undangan lex specialis derogate legi generali dimana yang menjadi lex generali-nya adalah UUJN-P dan posisi lex specialis-nya adalah UUPT. Dari asas tersebut maka dapat disimpulkan jika hasil dari RUPS Telekonferensi adalah sah serta dapat dijadikan sebagai alat bukti karena sudah ada payung hukum yang mengatur.

Penelitian ini bertujuan untuk mengetahui dan menganalisis penerapan sanksi pidana atas tindak pidana penggelapan pajak yang dilakukan secara bersama-sama dalam utusan Mahkamah Agung No. 28 K/PID.SUS/2017 dan untuk mengetahui dan menganalisis pertimbangan hukum hakim mengadili kasus tindak pidana tindak pidana penggelapan pajak yang dilakukan secara bersama-sama dalam Putusan Mahkamah Agung No. 28 K/PID.SUS/2017. Penelitian ini merupakan penelitian hukum normatif yang menggunakan studi kasus. Untuk memperoleh bahan hukum yang memuat pembahasan yang akurat, pengumpulan bahan hukum dilakukan dengan cara menerapkan studi kepustakaan. Bahan-bahan yang telah diperoleh, baik berupa bahan hukum primer, sekunder, maupun tersier akan dianalisis dengan metode deksriptif kualitatif. Hasil penelitian menemukan bahwa 1) penerapan sanksi pidana atas tindak pidana penggelapan pajak yang dilakukan secara bersama-sama dalam Putusan Mahkamah Agung No. 28 K/PID.SUS/2017 adalah berdasarkan Pasal 39 ayat (1) huruf i jo. Pasal 43 ayat (1) UU KIP sebagaimana dakwaan subsidiair Jaksa Penuntut Umum dan bukan berdasarkan Pasal 372 jo. Pasal 55 ayat (1) KUHP karena didasarkan pada adanya asas hukum “lex specialist derogat legi generali” yang menyatakan bahwa hukum yang bersifat khusus (lex specialis) mengesampingkan hukum yang bersifat umum (lex generalis) sehingga ketentuan mengenai penggelapan di dalam KUHP menjadi dikesampingkan. Pertimbangan hukum hakim mengadili kasus tindak pidana tindak pidana penggelapan pajak yang dilakukan secara bersama-sama dalam Putusan Mahkamah Agung No. 28 K/PID.SUS/2017 adalah dipengaruhi oleh fakta-fakta yang terungkap di persidangan bahwa terdakwa telah melakukan tindak pidana dan meyakini adanya kesalahan yang dilakukan oleh terdakwa. Selanjutnya, dalam menjatuhkan berat ringannya sanksi pidana, hakim juga melihat pada kedudukan pelaku dalam melakukan tindak pidana penggelapan pajak, dimana Ade Agung pada dasarnya hanyalah menjadi korban yang dimanfaatkan oleh Edi Sunarko sehingga sanksi pidana yang dijatuhkan lebih ringan dibandingkan dengan pelaku lainnya.

Penelitian ini dilatarbelakangi seringkali terjadinya tumpang tindih kewenangan dalam penyidikan tindak korupsi antar Polri, Kejaksaan, dan KPK. Contoh kasus korupsi pimpinan anggota DPRD Kota Surakarta Periode 1999-2004 ditangani oleh Polwil Surakarta. Sedangkan, kasus korupsi Mantan Walikota Surakarta masa jabatan 2000-2005 ditangani oleh Kejaksaan. Selanjutnya, pada kasus korupsi Deputi Gubernur BI tahun 2008 ternyata ditangani oleh KPK. Tiga contoh kasus tersebut merupakan contoh ketumpangtindihan kewenangan antar lembaga dalam kasus yang sama yaitu penyidikan tindak pidana korupsi. ketumpangtindihan wewenang penyidikan tindak pidana korupsi juga terlihat pada perseteruan KPK dan Polri dalam kasus korupsi simulator SIM. Dengan adanya ketumpangtindihan kewenangan dalam Tindak pidana korupsi, penulis memfokuskan tulisan ini pada apa yang menjadi akar penyebab sengketa kewenangan antar Polri, Kejaksaan, dan KPK. Untuk menemukan fokus artikel ini, penulis menggunakan pendekatan yuridis normatif. Di samping itu, penulis juag menggunakan asas preferensi hukum. Dalam artikel ini, penulis menemukan bahwa akar penyebab terjadinya sengketa kewenangan penyidikan tindak pidana korupsi oleh Polri, Kejaksaan dan KPK adalah kekaburan beberapa pasal dalam Undang-undang kewenangan pada masing-masing institusi sehingga menyebabkan terjadinya konflik kewenangan yang terjadi antara institusi penyidik dalam tindak pidana korupsi. Adapun cara penyelesaian terhadap sengketa kewenangan penyidikan tindak pidana korupsi antar institusi terkait dapat dilakuakan dengan tiga cara yaitu; pertama, dengan mengubah/mencabut pasal tertentu yang mengalami disharmoni atau seluruh pasal peraturan perundang-undangan yang bersangkutan, oleh lembaga/instansi yang berwenang membentuknya;. Hal ini dapat dilakukan oleh Presiden dan disetujui oleh DPR dengan terbitnya UU baru. Kedua, dengan mengajukan permohonan uji materil kepada lembaga yudikatif. Cara ketiga, dengan menggunakan teori lex specialis derogat legi generali. Artinya, karena kewenangan Polri dan Kejaksaan dalam penyidikan tindak pidana korupsi termasuk lex generali, sedangkan KPK termasuk lembaga lex specialis, sehingga apabila terjadi sengketa kewenangan antar lembaga, maka KPK yang paling berhak untuk melakukan penyidikan tindak pidana korupsi sesuai dengan Pasal 50 ayat (3) UU Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi berbunyi: Dalam hal Komisi Pemberantasan Korupsi sudah mulai melakukan penyidikan sebagaimana dimaksud pada ayat (1), kepolisian atau kejaksaan tidak berwenang lagi melakukan penyidikan.

The National CC’s (NCC) ratification has completed the mission of establishing a NCC adequately through a legislative process on the development of codified criminal science and practice adapted to the conditions and characteristics of the Indonesian nation and state, which differed from legal politics during the Dutch colonial administration. It can br concluded from the results of the study that the regulation of corruption crimes between the Corruption Law and the NCC is still classified as an extraordinary crime, but there is a slight difference of increase/decrease in the minimum/maximum prison terms and fines. This is motivated by the implementation of the legal principle of proportional criminal responsibility. Then, the existence of Article 630 of the NCC is the implementation of legal preference Lex Generalis Derogate Legi Specialis and Lex Posteriori Derogat Legi Priori principles, when there is a double arrangement between the Corruption Law and the NCC. However, the NCC also applies the In Dubio Pro Reo principle, which means that when considering two regulations that govern the same case, the rule that is more advantageous to the suspect or defendant is used. By taking into account the provisions of Article 632 of the NCC that this Criminal Code shall come into effect 2 (two) years from the date of promulgation, this should be seen as the implementation of the Government's task to socialize this NCC to the whole community before it is enacted.

Including corruption offenses, particularly offenses, into the Draft Criminal Code (RKUHP) raises problems because the RKUHP is a compilation of general criminal law regulations included in one book. Such an arrangement raises questions about the position of corruption offenses, the Draft Criminal Code (RKUHP), and the legal consequences of regulating corruption offenses in the RKUHP. This article uses normative legal research with two approaches: legislation and conceptual. The legal materials used consist of primary, secondary, and tertiary legal materials. The result is that corruption offenses as particular offenses are only regulated regarding the core crimes. Meanwhile, the legal consequences of such an arrangement are uncertainty regarding the realization of the principle of lex specialis derogate legi generali.

This research stems from the conflict of competence between Commercial Court and Arbitration in a bankruptcy case involving an arbitration clause. This occurs when parties make an agreement including arbitration as a mechanism of dispute resolution. Nevertheless, when a dispute occurs, one of the parties file a bankruptcy petition to Commercial Court as contained in Article 303 of the Bankruptcy Law. Meanwhile, according to Article 3 and 11 of the Arbitration Law, agreements containing arbitration clause as a mean of dispute resolution provides absolute competence, which is consistent with the pacta sunt servanda principle outlined by Article 1338 of the Civil Code. This raises the question of whether Article 303 of the Bankruptcy Law is inconsistent with pacta sunt servanda or to the arbitration clause as the agreed mechanism of dispute resolution by the parties, because the substance of legal norms has philosophical basis. This research uses normative juridical approach which examines legal materials through the study of documents. The research show that Commercial Court is an extra ordinary court which settle bankruptcy filed to the court. Therefore, the competence cannot be set aside by arbitration in the sense of its legal position and capacity as extra judicial even though it originates from an agreement containing arbitration clause. The philosophical basis that can be applied in the conflict of law refers to the principles governing legislation, namely lex specialis derogat legi generalis, lex posterior derogat legi priori, and integration principles of Article 303 of the Bankruptcy Law.
