Full textDespite the increasing number of people entering Turkey as asylum seekers, the Turkish state has maintained the “rule of geographical reservation” that does not allow non- European asylum seekers to remain in Turkey as refugees. Accordingly, the on-going asylum system does not offer refugee status for non-European asylum seekers, but merely provides a temporary status. So-called “Temporary Guest”, these individuals are only allowed to stay within the country until their resettlement in a third country has been arranged by the United Nations for High Commissariat of refugee. This research concerns itself with the study of the experiences of Iranian asylum seekers and refugees residing in Van, a border satellite city in Eastern Turkey, currently in the process of transition. It analyzes the experience of being a refugee and being “in transit” in a country geographically proximate to the country of one’s origin. It examine individuals’ legalization struggle within transitory, local, national and transnational context by focusing on interacted/intersected relationship between states, international refugee regime, informal actors and asylum applicants. In so doing, it suggest exploring the ways in which legality and temporality come to be so intricately related as to form one’s refugee experience in Turkey

Full textIn this dissertation we assessed psychological stress through post-traumatic embitterment disorder, quality of life among refugees and asylum seekers in Luxembourg. At N = 33, semi structured interviews indicated that asylum seeking administrative processes install fear of repatriation while social isolation, loneliness, lack of friends and of communication with families was linked to social, financial and acculturation difficulties. At N = 102, there were good indications that asylum seekers are victims of post-traumatic embitterment disorder. Additionally, 221 asylum seekers responded to ways of coping, social support, multicultural attitude, self-efficacy and quality of life questionnaires. With the help of structural equation modeling, social support, multicultural attitude and self-efficacy significantly predicted adaptive ways of coping with psychological stress. At the same time, there was the mediating and predictive effect of adaptive ways of coping and social support on quality of life respectively. Part of the models did not fit well to the data. Based on our findings, tracks for a multidisciplinary care model for refugees and asylum seekers were identified

Full textThe study assesses the application of policies on the right of refugees and asylum seekers with regard to the education of their children, and the many challenges impeding this right. Fundamental changes in the legal framework protecting the right to education of the children of refugees and asylum seekers have been in place since 1994, when South Africa became a democratic state. The principles of international treaties recognising the rights of children were incorporated into the Constitution of South Africa of 1996, demonstrating South Africa’s commitment to the protection of children’s rights. However, studies have suggested that, refugees’ and asylum seekers’ children have been discriminated against in terms of access to education, despite the legislative framework which provides for equal and inclusive education in South Africa. Access to education for migrant children in South Africa is invariably met with challenges which constitute a violation of the Constitution and international law. This study assessed policies and practices affecting refugees’ and asylum seekers’ children to access primary schools in a democratic South Africa. The researcher argues that access to education for refugees and asylum seeker’s children must be guided by the social justice principle of “every child deserves an education”, regardless of the legality of their parents in South Africa. Failure to afford them the opportunity to study is a violation of the Constitution and international law. The study used semi-structured interviews based on a questionnaire. Participants included parents who were refugees or asylum seekers,schools’ principals, and officials from Scalabrini Centre and the Western Cape Education Department (WCED). The data collected from respondents was presented, discussed and analyzed through a thematic analysis approach. From data collected, it was possible to identify the barriers preventing refugees’ and asylum seeker’s children from accessing education. Some of the barriers were generated from gaps in migration policy, ineffective policy implementation, poor documentation and various institutional challenges. Based on the study findings, it is recommended that South African lawmakers formulate policies that speak to the needs of the refugee child and amend the current migration policy to make it more reasonable and accommodative with regard to meeting the needs of migrants’ children in general, and refugee’ and asylum seekers’ children in particular. This would enable South Africa to uphold the constitutional values and its international obligations in relation to the promotion and protection of the right to education for all children.

Full textAt the age of 15, Nestor Tata watched rebel soldiers in Democratic Republic of Congo (hereinafter DRC) kill his father, and not long afterwards came home from school to find the murdered body of his mother. With no siblings or anyone else to turn to, he took his parents' savings from their hiding place under a mattress, packed a small bag and fled. He was afraid that if he stayed, they would kill him too. He then took a taxi to Kalemie, which is in eastern DRC, a boat across Lake Tanganyika, and a bus to Lusaka in Zambia. He still had no idea where he was going. After a month in Zambia and another two months in Zimbabwe, Tata made his way to South Africa where his youth and lack of English got him across the border despite having no documents.
