Abstract:

This special issue of Sexualities emerges in response to the growing visibility of LGBTQI immigrants, refugees and asylum seekers within global gay rights advocacy. Despite the increasing prominence of LGBTQI issues on the international human rights agenda, there has been relatively little discussion of the relationship between queer migration and LGBTQI human rights activism in the field of sexuality studies. This special issue seeks to bring queer migration and sexual citizenship studies into critical conversation with current literature in the area of gender, sexuality and human rights.

Abstract:

To be granted status, refugee claimants have to testify at the Immigration and Refugee Board of Canada (IRB). This liminal space is charged with both the promise of liberation and the threat of deportation. Adding to the challenge are the governmental measures that constrain the right to asylum. This paper suggests answers to the question: What language and other discursive features do LGBTIQ claimants have to use to be recognized as refugees? This ethnography is based on fieldwork conducted in Toronto and Vancouver. I will present two vignettes of claimants I accompanied to their hearings. Contrary to heterosexuals, queer asylum seekers have to prove their sexual orientation and/or their gender identity. Truth about their sexuality and persecution is evaluated through the lens of legal technologies, and stereotypes are still common. However, extralegal forms of communication also come into play. New avenues for justice are being fostered by grassroots organizations.

Abstract:

Approximately 40 per cent of countries categorize homosexuality as illegal. However, refugee status is still granted largely on the basis of the 1951 Convention Relating to the Status of Refugees, which found that a refugee is a person who has a ‘well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion’. On that basis, few countries allow sexual orientation as grounds for refugee status. Owing to the extraordinary odds of gaining successful refugee status and because lesbian, gay, bisexual and transgender (LGBT) asylum seekers are often socially isolated in their search for refugee status, there is a heightened need for non-government organization support networks for these individuals. This research explores social media from four LGBT refugee organizations, largely focused on Africa, to ascertain where the differences and similarities reside in communicating with community members, sharing information, building community and encouraging action.

Abstract:

This paper considers queer refugeeism from Trinidad and Tobago to the UK in relation to the political economy of (im)mobility in and out of the Caribbean. Gay rights have been embraced by liberal democracies as the newest form of human rights, what has been called “homonationalism.” Mirroring other double-binds of liberal inclusion, I show how queer asylum-seekers get caught betwixt and between two globally-stratified homonationalisms while confronting the realpolitik of European asylum law not only as queer refugees but also in terms of transnational social mobility otherwise unavailable to them. The British asylum system therefore materializes as a bordering operation that more often than not denies lesbian, gay, bisexual and transgender (LGBT) asylum-seekers their rights under the sign of their humanitarian protection. I consider whether homonationalisms everywhere—as assemblages of human rights discourse—should be thought of as “post-political” projects, a concept critical to growing bodies of political theory and cultural critique. This is because humanitarianism touts “rights” as universal and moral, therefore transcending the political. However, as a result of their practical effects, I show how the institutional practices deemed post-political in the case at hand should be understood as attempts to deflect and defuse the underlying politics of socioeconomic status and mobility at stake, and that the conflicts and contradictions at the heart of queer asylum-seeking represent the return of the repressed political within legal-technical spaces of disagreement. I also scrutinize the ambivalent entanglements of “expertise” when anthropologists are solicited as country experts in legal asylum cases.

Abstract:

This article discusses the ways in which different discourses construct a genuine LGBT refugee subject in Norway. In doing so, it problematizes the notion of a predetermined/ahistorical/context-free LGBT refugee subject who can be discovered at the national borders as the true claimant of the refugee status. Benefiting from queer theory, the discussion revolves around the performative aspects of refugeeness, arguing that refugeeness is discursively constructed in a particular legal, political, and cultural context and that there is no genuine refugee prior to its recognition. The article also draws on the notion of precarity as a constitutive of the so-called genuine refugee subject, and discusses how precarity for sexual minorities has been constituted within the contemporary cultural politics of immigration and sexual politics in Norway. It concludes by arguing for the need for increasing attentiveness to the reproduction and circulation of discourses around issues such as deserving immigrants, precarity, worthy asylum seekers, healthy sexualities, and good citizens within the field of refugee policies and practices.

Abstract:

Discourses relating to gender and sexualities have long been a tool for the perpetuation of racialized “othering” and have contributed to the strengthening of national identities and boundaries as they reproduce binary constructions of “us” and “them.” As the German nation-state reinvents itself as multicultural, tolerant, and sexually liberated, these discourses serve to mark the racialized body as a site of backwardness, sexism, and homophobia, and thus justify its segregation and exclusion exemplified in the restrictive practices of housing, mobility restrictions, and deportation of asylum seekers and migrants. This paper aims to trace the unfolding of discourses in and between some dominant organizational structures in Berlin that advocate for LGBT refugees and asylum seekers. It argues that the claim for citizenship of some formerly excluded sexual others is contingent on the promotion of a very specific notion of sexual identity and participation in the orientalisation/ethnicisation of homophobia.

AbstractAccording to the United Nations Refugee Agency (UNHCR), 65.6 million people have been forcibly displaced worldwide. Several factors have a major influence on asylum seekers' health; so, their health profile is markedly different from that of the population in the country of asylum. The aim of this study is to review the major issues physicians need to be aware of when treating asylum seekers, with a special focus on the neurological problems of asylum seekers and refugees. The major impact factors on refugees' health are linked to experiences and exposure (1) in the country of origin, (2) in refugee camps and en route to Europe, and (3) in the process of immigration into the host country and living in European asylum centers. Refugees' health is also affected by psychological problems and by infectious diseases. Additionally, chronic diseases resulting in polymorbidity, cancer, and neurological diseases are easy to overlook and demand special attention. Neurological injuries/diseases may be traumatic (e.g., spinal cord injuries), posttraumatic (e.g., chronic pain syndromes), the result of cerebral infections, or the consequences of starvation (e.g., epilepsy, ataxia, and paraesthesia). The main challenges for physicians are lack of awareness of the asylum seekers' specific health care problems, language and intercultural communication problems, as well as access and integration of asylum seekers into the health care system. The health issues of asylum seekers are manifold and challenging to physicians. Awareness of these conditions is mandatory to ensure good clinical practice for this patient population, which has a huge burden in chronic, infectious, mental, and neurological diseases.

Poetry provides valuable and insightful ways to explore and record social and political experiences and engagements. The plight of refugees and people seeking asylum in Australia is well known. Community groups such as the Ballina Region for Refugees provide support to refugees and asylum seekers both in Australia and offshore. To help raise awareness and validate the experience of refugees and asylum seekers, the Ballina Region for Refugees runs an annual Poetry Prize. The 2020 Ballina Region for Refugees Poetry Prize theme was Seeking Asylum—Holding Patterns. This article presents the winning and highly commended poems, along with poems by refugee and asylum seeker poets. Poems from both insider witnesses – refugees and asylum seekers – and outsider witnesses – poets who seek to express an empathy with the plight of refugees and asylum seekers – have contributed to this collection. Abstract:

This paper discusses that Indonesia which is not a contracting state to the 1951 Refugee Convention and 1967 Protocol, but still respect human rights of asylum seekers and international refugees on the principle of non-refoulement. By being unable to refuse the asylum seekers, it will result in the accumulation of those who have the potential to disturb the security and order of the Indonesian people. This paper aims to identify conditions, problems, and provide solutions for asylum seekers and refugees in Indonesian territory from the perspective of national law and international law. This writing uses a normative research method with a juridical-normative approach, which refers to the prevailing laws and regulations. The solution that can be provided is the establish regulations regarding the handling of asylum seekers and refugees, improving communication with the main destination countries, conduct training for officer in dealing with asylum seekers and refugees, and optimally applying the Global Compact on Refugee concept. The results of this paper indicate that national law and international law can provide protection for asylum seekers and refugees.

Abstract:

Immigration policy, arrival modes, human rights, and international obligations have all been part of the debate that has ensued over the Australian Government’s policy response towards refugees and asylum seekers. This debate was a central campaign focus in the lead up to the 2013 Australian federal election and was accompanied by extensive media coverage. This media coverage is a significant contributor to the representation of refugees and asylum seekers to the Australian public. This study explores how refugees and asylum seekers were represented in Australian print news media in the period immediately before and after the 2013 federal election. Using news framing and critical discourse analysis, this study examined 162 articles, published between 7 August and 8 October 2013, in Australian newspapers. The analysis revealed two opposing themes in the representation of asylum seekers: refugees and asylum seekers were represented as either a threat requiring a military intervention or as victims requiring management. The findings of this study demonstrate the ways in which the print media contribute to a polarised representation of refugees and asylum seekers and the potential deleterious effect of this dichotomous construction to an informed public opinion.

Abstract:

Background Since 2010 there has been a growing population of refugees and asylum seekers in Latin America. This study sought to investigate the perceived experiences and healthcare needs of refugees and asylum seekers of Latin American origin in Chile in order to identify main barriers to healthcare and provide guidance on allied challenges for the public healthcare system. Methods Descriptive qualitative case study with semi-structured interviews applied to refugees and asylum seekers (n = 8), healthcare workers (n = 4), and members of Non-Governmental Organizations and religious foundations focused on working with refugees and asylum seekers in Chile (n = 2). Results Although Chilean law guarantees access to all levels of healthcare for the international migrant population, the specific healthcare needs of refugees and asylum seekers were not adequately covered. Primary care and mental healthcare were the most required types of service for participants, yet they appeared to be the most difficult to access. Difficulties in social integration -including access to healthcare, housing, and education- upon arrival and lengthy waiting times for legal status of refugees also presented great barriers to effective healthcare provision and wellbeing. Healthcare workers and members of organizations indicated the need for more information about refugee and asylum-seeking populations, their rights and conditions, as well as more effective and tailored healthcare interventions for them, especially for emergency mental healthcare situations. Conclusions All participants perceived that there was disinformation among institutional actors regarding the healthcare needs of refugees and asylum seekers in Chile. They also perceived that there were barriers to access to primary care and mental healthcare, which might lead to overuse of emergency services. This study highlights a sense of urgency to protect the social and healthcare needs of refugees and asylum seekers in Latin America.

Summary Background: European countries are the main receiving countries of immigrants such as refugees and asylum seekers belonging to ethnic minority groups due to a global increase in social and political instability as well as socio-economic conflicts. Both the number of ethnic minority groups and the number of people with mental disorders are therefore growing significantly. The current healthcare services are not prepared for this specific population of mentally ill immigrants or ethnic minority groups. Mental health care for immigrant patients is lacking in cultural competence and legislation related to access to and utilisation of health services varies from country to country. Aim: This article attempts to give an overview of the current mental health situation of ethnic minority groups, especially refugees and asylum seekers, in Europe.

Abstract:

Deaf asylum seekers are a marginalized group of people in refugee and forced migration studies. The aim of this paper is to explore and highlight the experiences of deaf asylum seekers in the asylum procedure in Finland. The data come from linguistic ethnographic methods, interviews, and ethnographic observation with 10 deaf asylum seekers. While living in the reception centers, the study participants have faced a range of linguistic and social challenges. The findings show that language barriers appeared from day one after the participants’ arrival in Finland. The investment and initiatives of deaf volunteers played a crucial role for deaf asylum seekers in their access to and participation in Finnish society. In addition, receiving formal Finnish sign language instruction had a positive effect on their well-being. Drawing on content analysis of deaf asylum seekers’ experiences, I argue that greater awareness, recognition, and support of deaf asylum seekers are needed in the Finnish asylum system. I conclude this paper with a discussion of and suggestions for a better asylum system for deaf individuals.

Abstract:

Internationally, it has been well documented that refugees and asylum seekers are portrayed as one of Europe’s greatest threats, which intersects strongly with stereotypes about Muslim men. Our discussion focuses on asylum seekers in Iceland in 2015-2017 and their experiences of racism. The analysis shows that asylum seekers experienced racism in Iceland, but that this racism becomes overshadowed by their precarious position as asylum seekers. Our analysis of racism and asylum seekers in Iceland is based on an intersectional perspective that stresses how racism has to be seen as existing in conjunction with other identifications and identities. In our case, the intersection of racism with the position of vulnerability is particularly important, i.e., the vulnerability that these individuals experience when categorized as asylum seekers. As we stress, the asylum seekers’ dismissal of racism signifies the intense insecurity that they live under and the structural violence that they become subjected to from state and border policies.

Abstract:

Asylum is granted to people in search for international protection from persecution or serious harm in their own country. The right to asylum for refugees in Malaysia is far from realization and in dire need of a practical solution. Due to the lack of a proper enactment of Asylum Act, asylum seekers are to deal with denial of basic rights. Asylum seekers are also denied of education and healthcare due to high cost since these are not provided by the government. This article discusses the need for a proper enactment of Asylum Act in Malaysia in relation to the rising numbers of asylum seekers and refugees in the country. In this research, a comparative analysis between Malaysia’s existing laws dealing with asylum and the law of Australia, United Kingdom, Indonesia, and European Union was carried out. It was found that these countries have developed their legal framework for asylum considerably and could legally accommodate the influx of refugees into their respective countries, in contrast to Malaysia’s increasingly poor management of the refugees and asylum-seekers. The moment asylum seekers arrive in Greece, they are often denied access to justice on different levels. At the same time international volunteer field advocates or Backpack Refugee Rights Advocates have the goal of assisting asylum seekers to master the difficulties of the complex European asylum process. More importantly they can play an important role in the process of legally empowering asylum seekers. This paper will first analyze the different forms of access to justice that are denied to asylum seekers in Greece. Then then paper will proceed with the concept of legal empowerment of asylum seekers and it is argued that the main purpose of Backpack Refugee Rights Lawyers should be enabling asylum seekers and refugees to know and enforce their own rights. At the same time the paper identifies and addresses several problems of the work of Backpack Refugee Rights Lawyers. Overall, it is hoped that this paper will provide field advocates with information about how they can play an integral part in the legal empowerment of asylum seekers and refugees if they act according to certain guidelines.

Refugees are not a recent phenomenon. Since the time of the Roman Empire there have been many examples of people fleeing persecution and seeking refuge and protection in other countries. Refugees flee war, internal unrest and persecution by their own governments because of their ethnic origin or their political, religious or social activities. Estimates of the number of refugees and displaced people worldwide range from about 23 million to about 50 million, this latter figure including those who are not officially registered. It is perhaps pertinent to realise that this number is larger than the entire population of Australia and almost the same as the number of refugees resulting from the Second World War. Refugees represent a variety of cultures, races and nations from all over the world. Summerfield (2000) claims that nearly 1% of the people in the world are refugees or displaced persons resulting from about 40 current violent conflicts.

They worked in small groups with support from team members. The Statistical Package for Social Sciences (SPSS) was used to describe, analyse, and present results.ResultsThe 210 responders included 90 known refugees, 89 known asylum seekers, and 11 known to have been refused asylum. Although 79% of responders reported attending an initial health assessment on arriving in Wales, and 94% reported that they were currently registered with a GP, only 36% found it easy or very easy to make an appointment with their GPs. Awareness of services was mixed: best known was the 999 service, with 77% reporting that they knew how to access it. Sixty-six per cent reported using health care in working hours, and 28% reported use out of hours. Key influences on these statistics included knowledge of the NHS and how to navigate it, language barriers, and cultural factors.ConclusionThis study provides valuable insight into asylum seekers’ and refugees’ experiences of health care. Together with our complementary qualitative study it suggests that a compassionate approach to providing care, building on existing good practice, and with additional resources for training and support services, can reduce healthcare inequalities for asylum seekers and refugees.

Purpose Asylum seekers and refugees experience substantial barriers to successful transition to a new society. The purpose of this paper is to explore the value and meaning of a community drop-in service offering social support for refugees and asylum seekers in the northeast of England and to identify the occupational preferences of the service users. Design/methodology/approach A qualitative approach using semi-structured interviews was conducted with refugees and asylum seekers using a community drop-in service. In total, 18 people participated from ten countries. Data were analysed using interpretive phenomenological analysis. Findings The value and meaning of the service was expressed through four key areas: the need to experience a sense of community; being able to make an altruistic contribution within the community; the need for societal integration; and having the opportunity to engage in meaningful and productive occupations. Practical implications Community and altruism have profound cultural meaning for asylum seekers and refugees and the need to integrate, belong and contribute is paramount to successful resettlement. Community-based drop-in services can aid this at deep, culturally relevant levels. This study may inform policy and practice development, future service development and highlight potential opportunities for health and social care services provision amongst this growing population. Originality/value To date there are no studies that provide empirical evidence on how community-based drop-in services for refugees and asylum seekers are received. This study provides a cultural insight into the deeper value and meaning of such services, and is particularly relevant for professionals in all sectors who are working with asylum seekers and refugees.

The movement of population was only a domestic issue of a country, but along with the number of countries that paid attention to Asylum Seekers and Refugee so that these issues become worldwide problem. In International law the existence of these refugee protected by the 1951 Refugee Convention and 1967 Refugee Protocol about Refugee. The Indonesian state did not ratify the Protocol so that Indonesia was not obliged to accept the asylum seekers and refugee. However, Indonesia’s strategic position makes Indonesia become a transit country for those who want to continue into the destination country. Therefore, the Government of Indonesia issued a Presidential Decree Number 125 of 2016 concerning Handling of Foreign Refugees. The problem research is how to handling asylum seekers and refugee after the publication of Presidential Decree Number 125 of 2016 concerning Handling of Foreign Refugees. This research is used empirical-normative research methods. Thus, the Government of Indonesia already has a legal basis to handle these asylum seekers and refugees. Indonesia is expected can be more instrumental in addressing the problem of asylum seekers and refugees internationally even thought Indonesia has not ratified the 1951 Convention and the 1967 Protocol. However, in its implementation Presidential Decree Number 125 of 2016 concerning Handling of Foreign Refugees did not run smoothly. It’s because a lot of their handling has not yet referred to the Presidential Regulation.

Increasing numbers of individuals forced to leave their home countries in areas of war, conflict, human rights violations and persecution pose a challenge for host countries to meet the mental-health care needs of these individuals. Refugees and asylum-seekers may face unique risk factors for mental disorder before, during, and after their migration leading to suicidality. Experiences of family withdrawal, integration difficulties, and perceived lack of care may contribute to suicide within the refugee populations. Identifying effective treatments and support to minimize the risk especially once the individuals arrive in their new country is key to providing appropriate care. Barriers to mental-health care including lack of knowledge about available resources, communication or language barriers, cultural beliefs about origins and treatment of mental disease, as well as a lack of trust in authority, pose a challenge for health care providers and policy makers.Research has been inconsistent in the findings for the prevalence of mental disorders, suicidal behaviours, and suicide ideation among refugees and asylum seekers. Thus far, research has been limited to small scale, non-randomised, often qualitative analysis. Several studies have found higher rates of mental disorder, whereas others have found a similar prevalence as in the general population, although, Post-Traumatic Stress Disorder has more consistently been found to have a higher prevalence among migrants. Asylum seekers and refugees experience poorer health than the broader Australian population. Universal primary healthcare services play an integral role in supporting and optimising the health and wellbeing of these communities. However, clinical-level issues frequently compromise the quality of care provided to these groups. The ‘GP Engagement’ initiative, implemented in the south-eastern region of Melbourne, aimed to build capacity within universal primary health care to respond to the needs of asylum seekers and refugees. This involved engaging general practice clinics, resourcing them with tools and frameworks, and undertaking collaborative problem-solving on refugee issues. Evaluation methods included: rigorous record keeping; pre- and post-practice assessments guided by a self-reported ‘12-Point Checklist’; and participant feedback. Findings from 57 participating health professionals indicated changes in the way that GPs work with asylum seekers and refugees. ‘GP Engagement’ suggests that it is possible to build primary healthcare responsiveness to asylum seekers and refugees through a strategic regional approach that is firmly grounded in evidence-based practice and considerate of the requirements and constraints of GPs.

Purpose The influx of refugees and asylum-seekers over the past decade into the European Union creates challenges to the health systems of receiving countries in the preparedness and requisite adjustments to policy addressing the new needs of the migrant population. This study aims to examine and compare policies for access to health care and the related health outcomes for refugees and asylum-seekers settling both in the UK and Germany as host countries. Design/methodology/approach The paper conducted a scoping review of academic databases and grey literature for studies within the period 2010-2017, seeking to identify evidence from current policies and service provision for refugees and asylum-seekers in Germany and the UK, distilling the best practice and clarifying gaps in knowledge, to determine implications for policy. Findings Analysis reveals that legal entitlements for refugees and asylum-seekers allow access to primary and secondary health care free of charge in the UK versus a more restrictive policy of access limited to acute and emergency care during the first 15 months of resettlements in Germany. In both countries, many factors hinder the access of this group to normal health care from legal status, procedural hurdles and lingual and cultural barriers. Refugees and asylum-seeker populations were reported with poor general health condition, lower rates of utilization of health services and noticeable reliance on non-governmental organizations. Originality/value This paper helps to fulfill the need for an extensive research required to help decision makers in host countries to adjust health systems towards reducing health disparities and inequalities among refugees and asylum-seekers.

Refugees and asylum seekers are only a small proportion of the 60 million forcibly displaced persons. But those seeking asylum in the developed world have received much of the attention as western governments have struggled to develop a policy response. An analysis of asylum applications by origin and destination indicates that these flows are largely driven by political terror and human rights abuses. Poor economic conditions in origin countries and tough asylum policies in destination countries matter too. In the light of the findings I suggest that greater coordination among OECD countries could improve the lot of those fleeing from persecution but even this would make only modest inroads into the sum of human misery that displaced people exemplify.

ObjectivesThe asylum process has received a lot of recent media attention but little has been said about the psychological needs of those seeking or granted asylum. Many asylum seekers have experienced trauma and torture, which is associated with substantial psychiatric and psychological morbidity. The Spiritan Asylum Services Initiative (Spirasi) is Ireland’s national treatment centre for survivors of torture. The aim of this study was to examine the demographic profile of those attending Spirasi and to consider potential clinical implications of this.MethodsWe retrospectively analysed demographic data relating to the 2590 individuals who attended Spirasi over a 12-year period (2001–2012 inclusive).ResultsThe majority of attenders were asylum seekers (88%), male (71%) and from African countries. The mean age was 31.9 years. The rate of new referrals, as a percentage of Ireland’s asylum-seeking population, has stabilised at ~6% since 2008. Women are underrepresented among those who attend.ConclusionsThe number of new referrals to Spirasi is lower than expected given international estimates of torture prevalence and the impact this has on mental health. Clinicians working with populations of asylum seekers and refugees should sensitively enquire about such events and be aware of the available services. Female refugees and asylum seekers are underrepresented, especially from Asian and Middle Eastern regions. Psychiatric, psychological and general practice services need to respond flexibly to evolving patterns of migration and address potential barriers to access, especially among female refugees and asylum seekers.
