In this paper, the author explores the legal treatment of no-challenge clauses in license agreements. A grant-back clause obligates the licensee to grant the rights on future advances or improvements in the licensed technology to the licensor. The author analyzes the legality of contracting the aforementioned clause in license agreements from the aspect of European Union Competition Law, considering that the positive law of the Republic of Serbia still does not include legal norms regulating this institute.

The legal regulation of the license agreement is considered. Its contractual construction is investigated. The norms of the Civil Code of Ukraine and other normative legal acts on determining the essential terms of the license agreement are analyzed and it is clarified, which conditions must be agreed by the parties in order for the license agreement to be considered concluded. The scientific analysis of the legal nature of the license agreement in the system of civil law agreements is carried out. Abstract Whenever a film is produced and distributed, a license to use the music and sound recording may be needed. While the film producer usually owns the copyright in the film and underlying works or actors’ performances, responsibility for the clearance of rights in music and sound recordings remains largely on the shoulders of users (broadcasters, cinema operators, VOD platforms). They usually need to get a license through a CMO or directly from the rightsholder. In the case of musical works, the procedures are largely standardized, mainly in offline use. When it comes to licensing the rights for cross-border use online or when phonogram producers and performers are involved, the licensing situation becomes messy which introduces significant uncertainty into the market. Instead of advocating state regulation, the author pleads for the development of cross-border industry standards and procedures, good practices and reciprocal agreements between CMOs to be developed in a collaboration of global organizations representing rightsholders.

Abstract This chapter discusses licensing configurations open source projects use. In particular, it describes the different types of inbound licenses or agreements: inbound=outbound, the Developer’s Certificate of Origin (‘DCO’); the contributor license agreement (‘CLA’); and Assignment. The chapter considers how each compares to the others, the ways each type is implemented, and some of the reasons each one is used. It also argues that, regardless of how an open source project is organised, there ought to be two licences (or agreements): a licence to govern contributions that come into the project (inbound) and a licence under which end-users of the project take the code (outbound). To conclude, the chapter provides some practical advice for the legal agreements governing one’s own open source projects.

The presence of unstable flow phenomena may significantly alter the flow pattern and characteristics of centrifugal pumps; that is, the unstable flows may seriously deteriorate the pumps performance.
