Abstract:
A lattice Boltzmann method (LBM) is utilized to solve single-phase transient flow in pipes. In order to eliminate grid limitation related to the method of characteristics, governing equations are modified using appropriate coordinate transformation. The introduced modification removes connection between Courant number and spatial disposition of the computational nodes, forming a more flexible and robust mathematical base for numerical simulations. The computational grid is configured independently of the wave speed, significantly decreasing the demand for computational resources and maintaining the required accuracy of the method. Thereafter, the appropriate equilibrium distribution function for the D1Q3 lattice has been defined. In order to give a comprehensive base for modeling transient flow in complex pipeline systems, detailed elaboration of the corresponding boundary conditions has been given. Two benchmark problems with the corresponding error analysis are used to validate the proposed procedure.

Abstract:
In this study, the Lattice Boltzmann Method (LBM) is implemented through a finite-volume approach to perform 2D, incompressible, and time-accurate fluid flow analyses on structured grids. Compared to the standard LBM (the so-called stream and collide scheme), the finite-volume approach followed in this study necessitates more computational effort, but the major limitations of the former on grid uniformity and Courant–Friedrichs–Lewy (CFL) number that is to be one are removed. Even though these improvements pave the way for the possibility of solving more practical fluid flow problems with the LBM, time-accurate simulations are still restricted due to the stability criteria dictated by high-aspect ratio grid cells that are usually required for adequate resolution of boundary layers and the stiffness due to the nature of the equation that are being solved. To overcome this limitation, a Dual Time Stepping (DTS) scheme, which iterates the solution in pseudo time using an Implicit-Explicit (IMEX) Runge–Kutta method while advancing the solution in physical time with an explicit scheme (backward difference formula), is developed and implemented. The accuracy of the resulting flow solver is evaluated using benchmark flow problems and overall second-order accuracy is demonstrated.

Abstract:
L'utilisation de la transition naturelle d'un état supraconducteur vers un état dissipatif est envisagée afin de limiter les courants de défaut sur les réseaux de distribution électrique. L'étude réalisée se scinde en deux points. Le premier concerne l'étude expérimentale du comportement de différents matériaux supraconducteurs HTc pour la limitation de courant. Dans le cadre de cette étude, le matériau YBCO mono domaine a fait l'objet d'une analyse approfondie à haute température. Afin de valider la réalisabilité d'un appareillage haute tension, un démonstrateur 1 kV / 100 A constitué de 43 méandres d'YBCO texturé a finalement été testé à une température de 90,5 K. Cette étude s'est également focalisée sur la dynamique de la transition des matériaux supraconducteurs massif et sur l'influence des échanges thermiques avec le liquide cryogénique

Abstract:
La limitation du courant est une application nouvelle et prometteuse pour les matériaux supraconducteurs à haute température critique. Nous avons étudié la possibilité de limiter le courant avec des échantillons découpés suivant les deux directions principales du matériau YbaCuO texturé, les plans ab et l'axe c. Un procédé de croissance isotherme des monodomaines d'YbaCuO a été mis au point et la qualité de croissance des monodomaines YbaCuO améliorée. Des monodomaines de 100 mm diamètre (plan ab) ont été élaborés, la hauteur des cristaux en direction c atteint 30 mm. Pour les plans ab, les expériences de limitation sont menées au-dessus de 90 K dans un bain d'azote pressurisé. La proximité de Tc améliore l'homogénéité de la transition. L'énergie développée pendant la limitation est bridée grâce à un Jc plus faible, l'apparition de " hot spot " dévastateurs est évitée (concept d'autoprotection). Des conducteurs en forme de méandre (de 25 cm de longueur) ont été testés en limitation. Pendant les tests avec une durée de 20 msec, le champ électrique atteint 250 V/m. Un prototype 1000/100A avec 43 méandres connectés en série a été testé avec succès. Le matériau s'est révélé cependant relativement hétérogène tel quel. Pour la limitation suivant l'axe c, il faut également limiter l'énergie développée pendant la transition. Nous avons proposé une nouvelle stratégie qui consiste à diminuer Tc à 80 K pour travailler dans un bain d'azote à 77K. Un recuit d'oxygénation a été développé dans ce contexte. En même temps que Tc diminue à 80 K, [rhô] augmente d'un facteur 3. L'anisotropie [rhô]c/[rhô]ab atteint 200. Une stratégie d'oxygénation très progressive a été adoptée pour diminuer les macrofissures créées pendant l'oxygénation à cause du changement des paramètres de maille. Le matériau recuit ainsi montre des contraintes à la rupture 3 à 4 fois supérieures à celles obtenues par un recuit " standard ". Pendant les tests avec une durée de 20 msec, le champ électrique atteint 5000 V/m. La température des échantillons est de 220 K après les essais.

Abstract:
Les courants de court-circuit n'ont cessé de croître sur les réseaux de distribution électrique pour répondre à l'augmentation de la consommation et pour pènnettre de fournir une meilleure qualité de service grâce à la plus grande interconnexion du réseau. Les limiteurs de courant supraconducteurs apportent une solution sans aucun équivalent classique pour réduire, avant l'ouverture des protections, ces courants de défauts. La découverte des supraconducteurs à haute température critique en 1986 a pennis de réduire leur coût d'utilisation dans des applications industrielles. Dans cette optique, nous avons étudié la transition des supraconducteurs à base de Bismuth ou d'yttrium pour l'appliquer à la réalisation du prototype de limiteur de courant résistif"Aster" : 100 A - 1 kV. Un limiteur de courant peut être dans trois états différents, en fonction du courant qui le traverse: état passant, état de limitation ou état de récupération. En régime nominal ou état passant, les pertes proviennent soit des pertes en courant alternatif tant que le courant est inférieur au courant critique, soit de la résistance due au début de la transition du supraconducteur. La résistance développée lors de la transition du supraconducteur pennet de limiter les courants de court-circuit. Cette transition se pass~ en deux étapes pour les matériaux frittés: elle est d'abord initiée au niveau des joints de grains, puis, lorsque le matériau a atteint sa température critique, il transite en masse. Une fois le courant limité, le limiteur est isolé du réseau pour pennettre au matériau de retrouver son état supraconducteur. Enfin nous avons réalisé et testé un appareil "limiteur de courant" autonome et répétitif. Les tests sous 500 V puis 1 kV nous ont pennis de valider le principe et le fonctionnement de l'ensemble.

Abstract:
Ce travail a ete consacre a l'etude des procedes d'elaboration et des proprietes physiques du compose y#1ba#2cu#3o#7#-# pour la limitation du courant. Nous montrons que la technique de fusion de zone permet la texturation de monodomaines dont la taille peut atteindre 10 centimetres. Ces materiaux possedent d'excellentes capacites de transport du courant : les densites de courant critiques mesurees a 77 k lors d'une impulsion de courant s'echelonnent entre 10 000 et 20 000 a/cm#2, ce qui correspond a des courants nominaux de 1000 a 9000 a. Un systeme de decharges capacitives a ete adapte pour la mesure en courant de transport des materiaux de large section. Nous avons constate que les pertes hysteretiques etaient bien approchees par le modele de bean a condition que le diametre de l'echantillon soit fin et que la frequence ne soit pas trop elevee. L'influence de la barriere de surface sur l'allure du champ electrique a pu etre observee, notamment a l'expulsion des vortex. Nous avons montre qu'il existait un temps de diffusion du flux magnetique pendant lequel les vortex annulaires induit par le champ propre penetrent et progressent au sein du materiau, ce qui rend la determination du courant critique complexe et parfois arbitraire. La transition de plusieurs conducteurs a ete etudiee en limitant les echauffements que subit le materiau grace a la configuration experimentale du dispositif qui permet d'adapter la tension source aux dimensions du conducteur. Un champ electrique de 300 v/m a pu etre mesure dans un conducteur possedant une densite de courant critique de 20 000 a/cm#2.

Cette thèse présente un nouveau système de stabilisation de la tension batterie spécialement destinés aux véhicules Stop-Start, économique et compact, nommé LVSS (Linear Voltage Stabilization System). Le LVSS se comporte comme une résistance variable et limite le courant à l’aide de transistors MOSFET fonctionnant en mode linéaire. Il permet donc de stabiliser la tension de la batterie pendant le démarrage du moteur à combustion interne (ICE). Un prototype a été conçu et testé sur une voiture. Les résultats ont montré que la tension était stabilisée tout en limitant le courant de démarrage. De plus la solution proposée n’impacte pas sur les performances globales du système Stop-Start et comme les transistors fonctionnent en mode linéaire, cette solution n’émet pas de perturbations CEM<br>This thesis presents a new Linear Voltage Stabilization System (LVSS) specially designed for µ-hybrid vehicles using the Stop-Start function. The LVSS stabilizes the battery voltage during the start-up of the Internal Combustion Engine (ICE) limiting the start-up current using parallels MOSFETs working in linear mode. A prototype was developed and tested in a car. Results have shown the battery voltage properly stabilized limiting the start-up current. Furthermore the proposed solution does not impact on the overall performance of the Stop-Start. Main advantages are its small volume, low price and the fact that there is no EMC perturbation as transistors work in linear mode

Le développement rapide d’équipements raccordés sur les réseaux électriques avec des convertisseurs électroniques de puissance tels que les générateurs à base d‘énergie renouvelable et les liaisons de transmission sous haute tension continue entraîne un changement profond dans la physique même du système électrique. Aujourd'hui, les convertisseurs de puissance ont pour fonction principale d'injecter de l'énergie dans le réseau électrique, ce dernier s'appuyant sur des machines synchrones pour assurer tous les besoins nécessaires au fonctionnement et à la conduite du système électrique (par exemple, les services auxiliaires, la fourniture de réserve inertielle énergétique et de réserves dynamiques et fiables de puissance). Ce mode de fonctionnement des convertisseurs de puissance est appelé "grid-following" car suivant la tension alternative imposée au point de raccordement. Il présente plusieurs limitations, telles que : l'incapacité de fonctionner en mode autonome, des problèmes de stabilité dans des réseaux faibles et des fonctionnements défectueux, ainsi que des effets secondaires négatifs sur l'inertie du système. Pour relever ces défis, une alternative est de contrôler le convertisseur électronique de puissance pour générer et contrôler lui-même cette tension alternative. Dans cette thèse, une description fondamentale de cette commande en grid-forming est présentée avec une approche de modélisation quasi-statique simplifiée permettant de concevoir une régulation de la puissance active échangée avec le réseau AC. Plusieurs variantes de cette stratégie de contrôle sont mises en évidence et présentent des différences en termes de comportement dynamique sur la puissance active, de capacité d'émulation d'une réserve énergétique inertielle et de prise en charge de la fréquence du système. Les variantes sont ensuite classées en fonction de leurs capacités et fonctionnalités. Ces stratégies de commande ont été implémentées pour un convertisseur à 2 niveaux. Suivant une analyse de stabilité dite « petits signaux », la robustesse et leur capacité à fonctionner sur un réseau faible sont démontrées. De plus, les services auxiliaires tels que la réponse inertielle et le support au contrôle de la fréquence sont fournis de manière appropriée au réseau AC. Les questions de la protection contre les surintensités et de la synchronisation après défaut (tout en tenant compte de la limitation de courant) sont étudiées et une nouvelle méthode est proposée pour améliorer la stabilité transitoire du système électrique. Les résultats obtenus sont ensuite généralisés à une topologie de convertisseur multi-niveaux modulaire (MMC) avec succès. Avec cette commande, la fourniture d’une réserve inertielle est particulièrement intéressante pour gérer les transferts de puissance à l’interconnexion d’un réseau continu haute tension avec le réseau alternatif de transport d’électricité. La dernière partie de cette thèse évalue les performances dynamiques d'une liaison HVDC interconnectant deux réseaux AC et met en évidence la stratégie et les exigences appropriées pour la fourniture de réserve inertielle<br>The rapid development of converter-based devices such as converter-interfaced renewable generations and high-voltage direct-current (HVDC) transmission links is causing a profound change into the very physics of the power system. In this scenario, the power generation is shifted from the pollutant synchronous generators based on nuclear or fossil fuels to converter-based renewable resources. The modeling, control, and stability of the power converters are now one of the focuses of attention for researchers. Today, power converters have the main function of injecting power into the utility grid, while relying on synchronous machines that ensure all system needs (e.g., ancillary services, provision of inertia and reliable power reserves). This operation mode of power converters is called "Grid-following". Grid-following converters have several limitations, such as: inability to operate in a standalone mode, stability issues under weak grids and faulty conditions and also, negative side effect on the system inertia. To tackle these challenges, the grid-forming control as an alternative has shown its appropriate performance that could make this kind of control a promising solution to respond to the system needs and to allow a stable and safe operation of power system with high penetration rate of power electronic converters. In this thesis, a fundamental description of grid-forming control with a simplified quasi-static modeling approach aiming to regulate the converter active power by a voltage source behavior is presented. From the description, several variants of grid-forming strategies are identified that represent some differences in terms of active power dynamic behavior, inertia emulation capability and system frequency support. Hence, the presented grid-forming variants are then classified according to their capabilities/functionalities. From the small-signal stability and robustness point of view, the studied grid-forming controls, which are implemented to a 2-level VSC at first, show their ability to operate under very weak grid conditions. Moreover, the ancillary services such as inertial response and frequency support are appropriately provided to the AC grid. The questions of the grid-forming converters protection against overcurrent and their post-fault synchronization while considering the current limitation are investigated and a new method is proposed to enhance the transient stability of the system. All the obtained results are then extended to a modular multi-level converter (MMC) topology successfully. The use of a grid forming control in an HVDC converter is interesting for the grid to which it is connected due to the inertial effect that can be induced. Therefore, the final part of this thesis evaluates the dynamic performance of an HVDC link interconnecting two AC grids and highlights the proper strategy and requirements for inertia provision

L'intégration des énergies renouvelables a conduit à introduire la notion d'utilisation locale de ces nouvelles sources de production. Nous pouvons définir le paradigme de microréseau comme une agrégation de plusieurs sources d'énergie distribuée qui peuvent alimenter leurs charges locales. Ces microréseaux peuvent être îlotables pour garantir la continuité de service et l'alimentation des charges. Pour assurer la fiabilité du réseau, une stratégie de protection des générateurs et du microréseau lui-même a été proposée. Dans ce mémoire, les points communs et les différences entre les générateurs classiques et les générateurs connectés au réseau à l'aide de convertisseur d' d'électronique de puissance sont présentés. Ensuite, nous présentons la conception d'une source de tension à base d'une micro-turbine à gaz comme source d'énergie primaire contrôlable. Nous étudions les possibilités pour le générateur de demeurer connecté dans les conditions du creux de tension (fault-ride-through) tout en étant protégé contre les surintensités. Nous avons proposé deux solutions différentes permettant de limiter ces courants du générateur. De plus, pour assurer la continuité d'alimentation des charges en deux modes de fonctionnement, nous avons intégré un détecteur de l'ilotage basé sur le relais ROCOF dans le système de commande du générateur. Une validation expérimentale pour ces travaux a été réalisée en utilisant la simulation temps réel PHIL. Finalement, un plan de protection coordonnée valide dans les deux modes de fonctionnement et avec les différents types de source est présenté. Cette stratégie a été testée sur un exemple de microréseau simulé sur le simulateur temps réel

Le développement rapide de la production d'énergie renouvelable intermittente et des liaisons HVDC entraîne une augmentation importante du taux de pénétration des convertisseurs statiques dans les réseaux de transport. Aujourd'hui, les convertisseurs statiques ont pour fonction principale d'injecter une puissance dans le réseau tout en s'appuyant sur des machines synchrones qui garantissent tous les besoins du système électrique. Ce mode de fonctionnement est appelé «Grid-following». Les convertisseurs contrôlés en Grid-following ont plusieurs limitations: leur incapacité à fonctionner en mode autonome, leurs problèmes de stabilité dans des réseaux faibles et en cas de défaut ainsi que leur effet négatif sur l'inertie équivalent du système. Pour relever ces défis, le contrôle en Grid-forming est une bonne solution pour répondre aux besoins du système électrique et permettre un fonctionnement stable et sûr du système même avec un taux de pénétration des convertisseurs statique de 100%. Tout d'abord, trois stratégies de contrôle en Grid-forming sont proposées pour garantir quatre fonctionnalités principales: contrôle de tension, contrôle de puissance, émulation d'inertie et le support de la fréquence. La dynamique et la robustesse du système basées sur chaque contrôle ont été analysées et discutées. Ensuite, selon la topologie du convertisseur, la connexion avec le réseau AC peut nécessiter des filtres et des boucles de contrôle supplémentaires. Dans le cadre de cette thèse, deux topologies de convertisseur ont été envisagées (VSC à 2-niveaux et VSC-MMC) et l'implémentation associée à chacune a été discutée. Enfin, les questions de la protection des convertisseurs Grid-forming contre les surintensités et leur synchronisation post-défaut ont été étudiées, puis, des algorithmes de limitation de courant et de resynchronisation ont été proposés pour améliorer la stabilité transitoire du système. Un banc d'essai a été développé pour confirmer les approches théoriques proposées<br>The rapid development of intermittent renewable generation and HVDC links yields an important increase of the penetration rate of power electronic converters in the transmission systems. Today, power converters have the main function of injecting power into the main grid, while relying on synchronous machines that guaranty all system needs. This operation mode of power converters is called "Grid-following". Grid-following converters have several limitations: their inability to operate in a standalone mode, their stability issues under weak-grids and faulty conditions and their negative side effect on the system inertia.To meet these challenges, the grid-forming control is a good solution to respond to the system needs and allow a stable and safe operation of power system with high penetration rate of power electronic converters, up to a 100%. Firstly, three grid-forming control strategies are proposed to guarantee four main features: voltage control, power control, inertia emulation and frequency support. The system dynamics and robustness based on each control have been analyzed and discussed. Then, depending on the converter topology, the connection with the AC grid may require additional filters and control loops. In this thesis, two converter topologies have been considered (2-Level VSC and VSC-MMC) and the implementation associated with each one has been discussed. Finally, the questions of the grid-forming converters protection against overcurrent and their post-fault synchronization have been investigated, and then a hybrid current limitation and resynchronization algorithms have been proposed to enhance the transient stability of the system. At the end, an experimental test bench has been developed to confirm the theoretical approach

Abstract:
L’augmentation envisagée de la pénétration des unités de production d’énergies décentralisées raccordées au réseau de distribution amène à revoir l’architecture physique et algorithmique de ce dernier. En effet, une insertion massive avec le schéma de réseau tel qu’il apparaît aujourd’hui, impliquera des problèmes au niveau du plan de tension, du schéma de protection, voire de la stabilité. L’électronique de puissance trouve là un champ fertile d’applications notamment pour tout ce qui est de la régulation de la circulation des flux énergétiques et du réglage du plan de tension. Les travaux menés dans cette thèse ont trait à une solution d’électronique de puissance de type série qui est à même de régler les transits de puissances active et réactive. Ce système permet également, sans modification de son architecture, de limiter les courants de court circuit. Le réseau envisagé pour l’étude est de type bouclé ou maillé ce qui préfigure la tendance des réseaux du futur. Les travaux théoriques relatifs aux différents niveaux de contrôle-commande ont été confrontés à l’expérimental avec succès. Le plan d’expérimentation consiste en une simulation temps réel hybride avec le compensateur réel et le réseau émulé et interfacé par de la puissance<br>The predicted increase of distributed generation units in medium voltage grids will induce a change in their physic and algorithmic architecture. Indeed, a massive insertion of distributed generation into actual grids could lead to voltage profile, protection scheme and perhaps stability problems. So, power electronics devices can find a large field of applications and especially for power flow control and voltage profile regulation. Works lead in this Phd concern a series connected power electronics device, which controls active and reactive power flow through the grid. This system also limits shorts-circuits with the same inner architecture. The grid topology used relies on a meshed / interconnected architecture. This prefigures the tendency of the future. Works concerning control strategies have been successfully conducted with experimentation. The experimental bench-mark consists of a real-time emulated software which models grid connected to a real power inverter

The use of the lattice Boltzmann method in computational fluid dynamics has been steadily increasing. The highly local nature of lattice Boltzmann computations have allowed for easy cache optimization and parallelization. This bestows the lattice Boltzmann method with considerable superiority in computational performance over traditional finite difference methods for solving unsteady flow problems. When solving steady flow problems, the explicit nature of the lattice Boltzmann discretization limits the time step size. The time step size is limited by the Courant-Friedrichs-Lewy (CFL) condition and local gradients in the solution, the latter limitation being more extreme. This paper describes a novel explicit discretization for the lattice Boltzmann method that can perform simulations with larger time step sizes. The new algorithm is applid to the steady Burger’s equation, uux = μ(uxx + uyy), which is a nonlinear partial differential equation containing both convection and diffusion terms. A comparison between the original lattice Boltzmann method and the new algorithm is performed with regard to time for computation and accuracy.

Abstract:
In this text the authors deal with the latest developments in the Croatian model of solving the so-called CHF case. Unfortunately, the legislator did not do well and failed to see the possibility that, when he had already decided to bring the new normative framework, to predict and to properly regulate in it at least the key legal issues, such as: (no)admissibility of the lawsuit for those who decided to convert, the statutory limitation of the judgment on collective lawsuit and the currency clause relating to the Swiss franc. Instead of preventing reasons for the future lawsuit by the amendment of the Consumer Credit Law, it seems that (whatever it is desired) has come to the contrary. Despite the criticism of the legislator, the authors agree with the current court practice, for which the authors think it might and must (regarding to the highest courts) be much faster, in any case, the waiting for decisions of the Supreme Court of the Republic of Croatia and the Constitutional Court of the Republic of Croatia should be measured in months rather than years. The authors certainly repeat their already stated opinion that in the procedures that are labeled with the CHF case syntax, as a rule, there is no exclusive responsibility, and that is only (above slowness) what should be criticized in the court practice, which has not recognized it.

It was totally supported by a new continuous steel arch bridge, so both work together, combining in a very elegant construction.&lt;/p&gt;&lt;/li&gt;&lt;li&gt; &lt;p&gt;Valença bridge: This double-deck 1886 bridge is a steel 5 span 333m continuous lattice girder. Pathologies like excessive bending on the columns top sections, changing inappropriate bearing and a lock-up system for the braking action resulted in a demanding but discrete reinforcement.&lt;/p&gt;&lt;/li&gt;&lt;/ol&gt;

After the introduction of the then Article F.1 TEU by the Amsterdam Treaty, later supplemented by the Nice Treaty, Hungary has earned the dubious reputation to be the first Member State against which an Article 7 TEU procedure has been triggered. While the predominantly political process is apparently stalled for the time being, the Court had to deal with various aspects of the deteriorating rule of law situation. Although forming part of an undeniably fragmented approach, the Court’s judgments nevertheless clearly attest the retrogressive developments in Hungary since 2010. The analysis of the Court’s jurisprudence is based on the qualitative measurement of the rule of law indicators drawn up by the Venice Commission of the Council of Europe. The identification of the cases pertinent to our investigation presents a challenge by itself as there is no label attached to a case dossier titled “rule of law”. In addition, several relevant cases deal with issues which prima facie do not have a bearing on this topic. Thus, e.g. the case relating to the radical lowering of the retirement age for Hungarian judges apparently revolves around age discrimination in the workplace while in fact these measures were politically motivated and had an adverse effect on judicial independence. The subject-matter of the cases identified so far range from the independence of the judiciary and regulatory bodies to the functioning of NGOs and higher education institutions; from the criminalisation of assistance for asylum seekers to the judicial challenge of the conditionality regulation. Most cases are infringement proceedings initiated by the European Commission but the Court was also turned upon through preliminary reference or actions for annulment. By analysing the submissions of the parties, the opinions of the Advocate General as well as the Court’s assessment thereof, the paper aims to evaluate the role of the Court: its potential and the limitations. While not denying the Court’s contribution to the provision of consistent responses against the systemic threats against EU values, there are various institutional and procedural constraints hampering the Court’s ability to secure compliance in the subject area.

The European Court of Human Rights is currently facing a challenge in dealing with numerous applications linked to the COVID-19 pandemic and the related restrictions aiming to protect human life and health, which, at the same time, limit some of the most important human rights and fundamental freedoms. Legal scholars have voiced different views as to the complexity of this task, invoking the previous case law on infectious diseases and on military emergencies to infer standards that would be transferrable to COVID-19-related cases, or the margin of appreciation of domestic authorities pertaining to health care policy as the approaches ECtHR could take in this respect. The present paper argues that the ECtHR would be well advised to resort to a more systemic integrated approach, which implies the need to consider obligations emanating from other health-related international instruments in setting the standards against which it will assess the limitations of human rights during the COVID-19 outbreak. Hence, the authors reflect on the potential contribution of the integrated approach to the proper response of the ECtHR in times of the pandemic. The review shows that both the ECtHR’s caselaw on the integrated approach, as well as its theoretical foundation leave enough room for a wide application by the ECtHR of the right to health, and likewise – soft law standards emanating from the various public health-related instruments, when adjudicating cases dealing with the alleged violations of human rights committed during the COVID-19 outbreak. Subsequently, the paper critically assesses to what extent the ECtHR has taken into account the right to health-related instruments in its previous case law on infectious diseases. This is followed by a review of the existing, albeit sparse, jurisprudence of the ECtHR in its ongoing litigations pertaining to restrictions provoked by COVID-19 pandemic, viewing them also in the context of the integrated approach. The analysis shows that ECtHR did not systemically utilize the integrated approach when addressing the right to health, even though it did seem to acknowledge its potential. The authors then go on to scrutinize the relevant health emergency standards stemming from international documents and to offer them as a specific guidance to the ECtHR regarding the scope of the right to health which will help in framing the analysis and debate about how the right to health is guaranteed in the context of COVID-19. Consequently, building on the proposed integrity approach, examined theoretical approaches, and standards on the right to health acknowledged in relevant supranational and international instruments, the authors formulate guidance on the path to be taken by the ECtHR.

In Summer 2013 the UK Supreme Court confirmed the existence of MOD's Duty of Care to its personnel in action. This was carefully expressed not as a limitation on operations but was aimed at the provision of suitable equipment along with the justification of the design and protection decisions taken in its procurement and maintenance, and in its operation. In response to this ruling the UK Naval Authority Group, under the authority of the Defence Maritime Regulator and the Royal Navy Survivability Strategy, developed the principles of Combat Safety, creating a survivability and personnel protection process that parallels traditional safety management, delivering an auditable record of the requirements development, design, construction and maintenance of survivable vessels and crew protection arrangements, as well as significantly improved guidance to warfighters on the survivability and personnel protection aspects of the ships in which they serve. The paper discusses the introduction of and background to the UK MOD’s developing Combat Safety process, which is aimed at minimising the risk to life of personnel in combat arising from hostile action. It discusses the relationship between Combat Safety, “traditional” safety management and survivability. The processes developed to manage Combat Safety for new construction and legacy vessels are discussed, and the development and content of the Combat Safety Summary are discussed, Finally the future RN development programme for Combat Safety is outlined.

One of the major problems encountered in the implementation of the rule of law is in the absence of the meaning of law or what it wants to tell is not clearly defined, the true meaning is revealed through interpretation. In labor law and social security law; Although the review will benefit from the rules for the common law, workers-interpretation in favor of the insuree is effective. This policy is considered as one of the fundamental policies of the Labour and Social Security Law. Located between the basic policies of business law, the protection of the workers, which is a consequence of the interpretation in favor of the insuree policy, shows itself in the form of interpretation in favor of the insuree in the social security law. One factor for necessity of supporting interpretation in favor of the insuree is, social security right is among the basic human rights. In particular, the interpretation of legislation related to the social security right by constitutional guarantee, it is important to keep in mind this basic policy. The overall purpose of the social security law is to benefit from this right by more people, namely the expansion of the scope. In this study, the place of interpretation in favor of the insuree and limitations related to this interpretation will be examined in the light of samples of Supreme Court Decisions and regarding substance of the Constitution and laws.

The U.S. Department of Energy (DOE) oversees one of the largest cleanup programs in history—the treatment and disposal of 356,260 cubic meters of highly radioactive nuclear waste created as a result of the nation’s nuclear weapons program. This waste is currently stored at DOE sites in the states of Washington, Idaho, and South Carolina. In 2002, DOE began an accelerated cleanup initiative to reduce the estimated $105-billion cost and 70-year time frame required for the program. The U.S. General Accounting Office (GAO), an agency of the U.S. Congress, evaluated DOE’s high-level waste program to determine the status of the accelerated cleanup initiative, the legal and technical challenges DOE faces in implementing it, and any further opportunities to improve program management. GAO found that DOE’s initiative for reducing the cost and time required for cleaning up high-level waste is evolving. DOE’s main strategy continues to include concentrating much of the radioactivity into a smaller volume for disposal in a geologic repository. Under the accelerated initiative, DOE sites are evaluating other approaches, such as disposing of more of the waste on site or at other designated locations. DOE’s current savings estimate for these approaches is $29 billion, but the estimate is not based on a complete assessment of costs and benefits and has other computational limitations. For example, the savings estimate does not adequately reflect the timing of when savings will be realized, which distorts the actual amount of savings DOE may realize. DOE faces significant legal and technical challenges to realize these savings. A key legal challenge involves DOE’s authority to decide that some waste with relatively low concentrations of radioactivity can be disposed of on site. A recent court ruling against DOE is a major threat to DOE’s ability to meet its accelerated schedules. A key technical challenge is DOE’s approach for separating waste into high-level and low-activity portions. At the Hanford Site in Washington State, DOE is planning to implement such a method that will not be fully tested until the separations facility is constructed. This approach increases the risk and cost of schedule delays compared to fully testing an integrated pilot-scale facility. However, DOE believes the risks are manageable and that a pilot facility would unnecessarily delay waste treatment and disposal. DOE has opportunities to improve management of the high-level waste program. When it began the initiative to reduce costs and accelerate the high-level waste cleanup schedule, DOE acknowledged it had systematic problems with the way the program was managed. Although DOE has taken steps to improve program management, GAO has continuing concerns about management weaknesses in several areas. These include making key decisions without a sufficiently rigorous supporting analysis, incorporating technology before it is sufficiently tested, and pursuing a “fast-track” approach of simultaneous design and construction of complex nuclear facilities. DOE’s management actions have not fully addressed these weaknesses.
