Abstract:
Ironically, the strong libertarian paradigm uses wealth to constrict autonomy in ways that have interesting political theory parallels with the Lochner case. Both approaches limit participation in the democratic process. Lochner removed certain questions from democratic decision-making altogether. By affording property interests overwhelming political influence, the strong libertarian paradigm connects influence to wealth more than to votes or preference intensities. Buckley v. Valeo upheld congressional limitations on contributions to political campaigns, but struck down limitations on a candidate’s personal and total campaign expenditures. The Court also invalidated limits on independent expenditures to elect particular candidates made by others, including PACs, that were not given directly to the campaign. Buckley specifically rejected the government’s interest in equalizing the financial resources of candidates. In his partial concurrence and partial dissent, Justice White stated that the majority stood for the proposition “money talks.”

Elections are the cornerstone of democratic political processes, serving as a mechanism for political parties or candidates to compete for public office under equal conditions before the electorate. For an election to be credible, the competition must be fair, requiring impartial management of the process. As described in International IDEA’s Handbook on Electoral Management Design (Catt et al. 2014), electoral management bodies (EMBs) are the state institution or institutions established and mandated to organize or, in some instances, supervise the essential (or core) elements of this process. This Primer focuses on the establishment of EMBs as institutions normatively, structurally and functionally independent from government. It examines the benefits and limitations of the legal and institutional framework, governance structure, remit, autonomy over their resources, and contextual approaches that facilitate their functional independence, applicable to different legal and political contexts. The Primer discusses EMB independence and EMB relations with all stakeholders engaged in an electoral process at the national level.

Abstract:
This chapter considers some of the varieties of the minor party from the origins of the modern party system in the mid-nineteenth century. It considers the wider effects which can sometimes be traced to even the also-rans among them and concludes by evaluating the issues raised by the extensive historical literatures devoted to Britain’s far-left and far-right parties. The histories of both may be regarded as instances of relative party failure, but both have occasioned much fruitful debate as to how far this demonstrated their alien and extrinsic political character and how far, conversely, these were movements anchored in British political culture. It argues that the Communist Party of Great Britain, in particular, encapsulates the paradox of the minor party phenomenon. Like the other parties considered, it offers both the confirmation of a sort of two-party electoral hegemony and a reminder of its limitations in everything except elections.

Abstract:
This chapter provides an analysis of state-centered and individualistic theories of legitimacy in PrIL and distinguishes them from the relational internationalist perspective. It shows that state-centered theories determined the legitimacy of applying one law or another within interstate relationships. Individualistic theories linked the legitimacy of the applicable law to particular dimensions of political affiliation. By contrast, this chapter shows how relational internationalist authors envisioned different dimensions of legitimacy from both the state-centered and the individualistic positions, by focusing on an interpersonal relationship, as opposed to an isolated individual, and on private law, as opposed to constitutional or public law generally. According to the relational internationalist perspective, the legitimacy of imposing one law over another is justified on different grounds, including by reference to the actions of the parties, their expectations, the values underlying private law relationships, and the embeddedness of a legal relationship within one or several communities.

It summarizes the two main competing explanations of party systems, which are the neo-institutionalist research agenda and the historical-sociological literature. It then evaluates their strengths and limitations. The last two sections are focused on a new method of restructuring the way people think about how parties emerged. This method eventually integrates both approaches within a broad analytical framework.
