Abstract:
The modern principle of freedom of subjectivity sets a moral standard which radically departs from Aristotle’s doctrine of the mean: modern moral agents, exemplified by the rising middle class, are granted the right to develop extreme dispositions towards goods like honour and wealth. Given that Aristotle considers such goods divisible in the sense that when one person gets more another gets less―the basic definition of distributive injustice―it isn’t surprising that modern philosophers like Kant have trouble reconciling this right with duty to others. Failing to resolve this dilemma satisfactorily in ethical terms, Kant and others turn to aesthetics, but Kant, at least, takes no account there of moral agents’ interest in the actual existence of goods. In this respect, the alternative to the Kantian aesthetic response I document in my dissertation is more Stoic than modern. This response, the modern mediocre-artist narrative, features a mediocre artist who fails to achieve the new standard of distributive justice and a genius who ostensibly succeeds. Though other critics discuss the ethical dimension of mediocre-artist narratives, they don’t consider the possibility that the mediocre artist’s failure might be due to the ethical dilemma just described. They therefore tend to uphold uncritically the narratives’ negative judgments of mediocrity, ascribing the latter’s failure to egotism. By contrast, I examine the genius’ artistic efforts for evidence of a similar failure. Ultimately, I demonstrate that the genius does indeed fail, albeit less spectacularly, arguing on this basis that egotistical characterizations of mediocrity are unjust. But the mediocre aren’t the only victims: in “concealing” genius’ failure, mediocre-artist narratives ignore unmet claims on its fruits. Finally, I invoke Derrida’s notion of the “lesser violence” to outline a new genre that recognizes the unattainability of the modern standard of justice. I call this genre morally progressive, rejecting Jürgen Habermas’ view that freedom of subjectivity has hit a dead end, and that we must backtrack to a philosophical turning indicated but not taken by Hegel, namely, the path of intersubjective freedom.

Abstract:
This thesis consists of an argument analysis of three columns published in the Indian newspaper The Indian Express in the aftermath of the gangrape and murder of a young woman in Delhi in December 2012, and the following debate about glorification of rape in Indian popular culture. One of the columnists is arguing in favour of including gender as a category in the Indian law on hate speech, thereby banning an artist called Honey Singh and his lyrics about rape. The two other columnists are arguing against new restrictions on free speech in India. The analysis of the columns shows that there are several relevant arguments for and against including gender in the Indian hate speech legislation. The argumentation against a new law is similar to argumentation found in Western liberal theory, and the argumentation in favour of a new law is similar to argumentation found in Western radical feminist and critical race theory. However, both strands of philosophy are contested by postcolonial theorists, arguing that no Western theory is applicable in a non-Western context, such as India. Indian postcolonial feminists argue in favour of a third approach to sexist speech in India; a counter-speech approach. Counter-speech theorists agree with liberals about the importance of freedom of speech, and with feminists about the harm in hate speech. According to counter-speech theory, hate speech shall thus not be outlawed, but the state shall try to counter the harmful effects of hate speech, for example by strengthening groups targeted by hate speech so that they can speak back to hatemongers. The conclusion of this thesis is that a counter-speech approach is the most sustainable regarding freedom of speech and gender in India. Such an approach does not only appeal to Indian postcolonial theorists, it is also a middle way in-between a liberal and a radical feminist approach. In the conclusion, the relevance of hate speech legislation as a whole is also questioned. Laws such as in India, that protect only racial and religious groups from being targeted by hate speech while categories such as gender, sexual orientation and disability are not included, can be deemed discriminatory. An abolishment of hate speech prohibitions and an adoption of a counter-speech approach to all forms of hate speech is discussed.

Abstract:
As a social and economic force, sport is an integral part of globalised society. Sport is organised and followed globally. Therefore, the organisation of sport at the hands of sport governing bodies and the use of the idea of politics-free sport bring about specific concerns for freedom of expression, in that, these bodies tend to restrict expressions that are deemed political. This work aims to provide a coherent framework for a defence of freedom of expression in the context of sport. Pursuing that goal, it analyses the particularities of the sport industry as well as the philosophical foundations for freedom of expression. This work argues that a defence of freedom of expression in a globalised sport industry can be made on moral grounds. It also argues that the idea of politics-free sport and the restrictions for everyone involved are the reflections of the interdependence of the market, the state and the sport industry.
Deporte, como una fuerza social y económica es una parte integral de la sociedad globalizada. El deporte está organizado y seguido globalmente. Por este motivo, la organización del deporte por las organizaciones gubernamentales del deporte y el uso de la idea del ‘deporte sin política’, causan preocupaciones específicas relacionadas con la libertad de expresión; en tanto en cuanto estas organizaciones tienen una tendencia de restringir las frases que las asumen políticas. Esta investigación tiene un objetivo de constituir una marca consistente sobre la libertad de expresión en el contexto de deportes. La investigación analiza los soportes filosóficos de libertad de expresión con las particularidades específicas de la industria deportiva cuando intenta a obtener este objetivo. En la investigación se está defendiendo que la libertad de expresión se podrá basar sobre los fundamentos morales ante la industria deportiva globalizada. La investigación también propone que la idea de ‘deporte sin política’ y las restricciones aplicadas para todas las personas son las reflexiones de la interdependencia del mercado, estado y deporte.

Abstract:
Expanding on prior research into the state level causes of terrorism, I argue that state repression and limited state capacity reduces opportunities for non-violent political expression and increases the utility of terrorism. I also argue that economic freedom can is a form of political expression that can dissipate political grievances. While previous authors analyzed some of these variables separately using data on transnational attacks, I created a complete model incorporating the three categories of variables and tested my hypotheses using data that includes both domestic and transnational attacks. I use regression analysis for hypothesis testing and find support for the three primary contentions of this thesis and conclude that limits on political expression increase the likelihood nations will experienced increased levels of terrorism.

Abstract:
The primary purpose of this study was to compare the opinions of community college administrators, art faculty members, and art students concerning institutional options and policy alternatives for the exhibition of controversial student art work in the community colleges of Maryland. The research questions addressed the concept of academic freedom, the principle of institutional neutrality, and the context of the presentation. Three community colleges were selected for the study. Data were collected in two stages. Information gathered in the first stage of this project was used to collect data during the second stage. In phase one the researcher went to the three schools and conducted individual interviews to determine the perceived facts surrounding a controversial art incident. The researcher recorded what the participants thought were the issues that contributed to the controversy, what principles they thought were employed in the solution, and reactions to how it was handled. The researcher prepared a brief and objective case study of each incident. Phase two of this project involved the researcher taking the case studies back to the three sites for group interviews. There were three group interviews conducted at each of the three community colleges. One group was made up of two administrators, another group included two or three arts faculty members, and the third group involved four or more art students. Each group was asked to respond to questions stemming from the research areas of academic freedom, institutional neutrality, and context of the presentation. Each group was asked to comment regarding the issues, the administrative response, and concerns in the three case studies. Each group was asked to chose a policy from a list of three options for covering controversial student art exhibits. The results show different opinions exist between administrators, art faculty, and art students concerning academic freedom, institutional neutrality, and the exhibition of controversial student art. It is important to note however, the opinions do not divide precisely along administrator, faculty, and student classification lines. Most of the participants selected the policy which provided for group discussion during any controversy over student art. There is a need for educational institutions to become proactive in this area.

s perspective and artistic experience are tried to be exhibited. In order to understand and interpret the artist&rsquo
s perspective, the meaning of the concepts of nature and freedom that arise along with the concept of genius is clarified. By considering the effects of the freedom and the natural necessity on genius, it is asserted that since the necessity of the naturally endowed talent of genius and the freedom of the productive act of genius cause to the one and the same act, the creative activity of genius refers to the unity of all the dualities in the Kantian system and hence to the completeness of the system. As a result of this claim, art, which arises from the dual nature of human, becomes the way to unite this duality.

Abstract:
Under the auspices of Article 10 of the European Convention on Human Rights the right to freedom of expression is said to be held by everyone and to include the freedom to hold opinions and to receive and impart information and ideas without interference by public authority, subject to the limitation clauses outlined in Article 10(2). Whilst the text of Article 10 therefore makes no explicit reference to specifically artistic expression, the European Court of Human Rights has, in its interpretation of ‘information and ideas’, nevertheless accepted that artistic expression does indeed fall within the ambit of Article 10’s protection of freedom of expression. However, despite the Court recognising artistic expression as a form of expression within the framework of Article 10, conclusions reached in the early case law concerning the issue of controversial artworks would appear to suggest the judicial creation of an implicit hierarchy of expression under which artistic expression is seen to enjoy a relatively low level of protection. Given the non-differentiated articulation of the right to freedom of expression enounced in the text of Article 10, the creation of such a hierarchy of expression is therefore a cause for doctrinal concern. In seeking to assess this misnomer the thesis’ analysis of the treatment of artistic expression under Article 10 of the European Convention on Human Rights may be distilled in to two component parts. Firstly, a theoretical basis will be established from which artistic expression may be located within the context of the discourse pertaining to freedom of expression more generally. Having confirmed that, whilst of a distinctive, sui generis nature, artistic expression may indeed constitute ‘expression’ for the purposes of freedom of expression doctrine the second part of the thesis will examine the particular question of artistic expression’s treatment under Article 10 of the European Convention on Human Rights.

Abstract:
This thesis aims to provide an understanding of the phenomenon of citizen censorship in India and its implications for free speech. It is especially concerned with public protests where groups of citizens demand government action in order to ban or censor controversial material. These groups tend to invoke feelings of offense or hurt religious sentiments as a justification for restriction. The point of departure of this thesis is research on social movement outcomes and the history of Indian censorship. A quantitative approach is adopted, which includes data of protest events from 2010 to 2015. The author will demonstrate that restrictions on free speech coincide with protest events in three out of ten cases. A shorter case study of the controversy surrounding the film Vishwaroopam provides a concrete example of the dynamics of citizen censorship and aims to highlight some aspects that might have affected protest outcomes. Ultimately, the author concludes that protests are likely to be influential for restrictions on free speech, and that the role of the citizen as censor should not be ignored.

Abstract:
The origin of this thesis can be traced back to a deceptively simple question that struck me when reading Hegel for the first time: What, if anything, can be made of human freedom when we live in a world that has a profound impact on who we are and what we do? Unhappy with the way existentialist reactions to Hegel characterized freedom as our ability to step out of our world and determine our identity through our own decisions and will, but nevertheless inspired by Heidegger’s depiction of human agents as always already in the world, this thesis answers the aforementioned question by turning the existentialist conception of freedom on its head: that is, instead of characterizing freedom as detached decisionism, I argue that freedom is a function of our ability to recognize and respond to the disparate demands our world places upon us. Specifically, and unlike Heidegger’s existentialist interpreters, I read Heidegger’s account of authenticity as a case of engaged-agency in which we clarify the possibilities others make available and then act accordingly. There is, however, a certain limitation to this interpretation of human agency: namely, that treating freedom as an active response to the wants and needs of others binds the agent to possibilities present in her current situation and therefore fails to capture the kind of freedom we associate with cultural transformation or artistic creativity. Hence, this thesis addresses a second set of questions: What conditions make historical change possible? And how is it that artists are able to alter the world? In response to the first query, I turn to Heidegger’s claim that we are in truth and in untruth as well as his discussion of Gelassenheit to argue that the play between the possibilities present in a particular culture and those that are excluded by it along with a release from our present activities create the conditions for cultural transformation. In reply to the second question, I examine Heidegger’s account of the happening of truth and show how thinkers and artists are able to reveal the possibilities concealed in their culture through the creative use of language. Finally, I contend that the freedom associated with cultural transformation and artistic creativity is also a form of responsibility insofar as the success of a given transformation depends on others recognizing that transformation as valuable and thus worthy of their support.

Abstract:
Freedom is a fundamental concept for anarchism; but what does that mean, exactly? What sort of freedom do anarchists seek, and how do they hope to realise this freedom? Starting with the premise that such questions, though vital to the anarchist project, have mostly been ignored, this thesis argues that the basic libertarian impulse of anarchism is in need of a critical analysis. Such an analysis, however, highlights a number of problems with the anarchist demand for a world without domination, so anarchist understandings of ethics, and of power, are explored in search for answers. However, anarchist approaches to ethics and power prove to be equally problematic, and serious doubts are raised about the potential for anarchism to provide a world where freedom is absolute, and, conversely, where all forms of coercion are rejected. One possible response to this is to be found in the contemporary support for consensus-decision making, which many anarchists argue has the potential to resolve conflict; however, it is argued that far from offering a response to the concerns raised in previous chapters, the possibilities of consensus must be seen to be greatly reduced, once such concerns are properly taken into account. Unable to live up to its libertarian promises, anarchism may appear to have reached a dead-end. However, the thesis concludes by arguing that anarchism s prefigurative approach to politics, as well as its sustained critique of hierarchy, offer both radical and realisable possibilities for creating a world of much greater equality and freedom even if such freedom can never be absolute. In accepting the limits of anarchism, its possibilities can be seen more clearly.

Projektet bygger på åtta veckors fältarbete på en oberoende teater i Peking våren 2017,baserat på antropologisk och konstnärlig metod. Det är ett försök att utveckla begreppet konstnärlig etnografi, samt tillämpa det praktiskt. I detta är konsten inte huvudsakligen en produkt eller en presentationsform, utan ett sätt att tänka, att förhålla sig till världen. Materialet består av fältanteckningar, video, foto, rörelsematerial, personliga berättelser, minnen av dofter, ljud och smaker och någonting så vagt som stämning – stadens tempo, känslan i en repsituation… Hur kan scenen förmedla en plats och dess människor? Kan jag levandegöra mina upplevelser så att de blir angelägna för någon annan än mig själv? Det praktiska arbetet utgör ett försök att besvara dessa frågor. Vilka bilder har vi, och vad ser vi när vi speglar oss i varandra? Vad betyder det att våra världar redan är sammanflätade? Spegeln som bild och lek, träder fram både som tema och metod. Begrepp som exotism, representation och mötet med den andre diskuteras, liksom växlingen mellan identifikation och främmandegörande (”othering”) som en grund för förståelse. Hur påverkas människors liv av Kinas snabba samhällsförändringar, balansgången mellan socialism och kapitalism? Och vilken roll har scenkonsten i detta? Här diskuteras frågor om yttrandefrihet, liksom relationen mellan politik och spelstil, så kallad ”fejk realism”. Frågorna knyts samman genom en diskussion om autenticitet, följd av en betraktelse om utanförskap, för att slutligen återvända till det personliga mötet, till en berättelse om kontaktsökande – om vänskap.
This project is based on eight weeks of fieldwork at an independent theatre in Beijing in the spring of 2017, based on anthropological and artistic methods. It is an attempt to develop the concept artistic ethnography, and apply it practically. In this, art is seen not mainly as a product or a form of presentation, but as a way of thinking, of relating to the world. The material consists of field notes, video, pictures, movement material, personal stories, the memories of smells, sounds and tastes and of something as vague as atmosphere – the pace of the city, the feeling of a rehearsal situation... How can the stage render a place and its people? Can I bring my experiences to life, making them relevant for anybody else? The practical artistic work with an exposition is an attempt to answer these questions. What images do we have, and what do we see when we mirror each other? What does it mean that our worlds are already intertwined? The mirror as image and play appear both as a theme and a method. Concepts like exoticism, representation and the encounter with the other are discussed, as well as the movement between identification and othering, contributing to understanding. How are people’s lives affected by China’s rapid social changes, balancing between socialism and capitalism? What role do the performing arts have in this? Questions about freedom of expression are discussed, along with the relation between politics and styles of acting, the so called “fake realism”. The research questions are tied together in a discussion of authenticity, to finally return to the personal encounter and a story of seeking contact, of friendship.

Abstract:
Newspapers often report on the violation of learners’ rights. Many of these violations and critical incidents are related to the right to freedom of expression, which is internationally viewed as a core right in a democracy. My inquiry focused on grade 11 learners’ understanding of the right to freedom of expression. It is important to understand learners’ understanding of the right to freedom of expression, as they are the leaders of tomorrow and the right to freedom of expression is central to the survival of democracy. This inquiry was informed by an interpretivist paradigm. Atlas.ti™ was used to systematically analyse the data and categorise it into three hermeneutic units. This computer-aided qualitative data analysis software (CAQDAS) tool facilitated the process of analysis and enhanced the validity of the research. During the inductive process of analysis two patterns crystallised, viz. the absolutising of the right to freedom of expression by some learners and the lack of skills to implement the limitation to the right to freedom of expression in schools. The main findings indicated that some learners did not have knowledge regarding the right to freedom of expression, although most learners were aware that they could speak their minds under this right. Furthermore, learners didn’t seem to know how to exercise the right to freedom of expression. One of the factors disrupting the implementation of the right to freedom of expression in schools is the perpetuation of an authoritarian culture in schools. Theoretical and practical recommendations are suggested and avenues for future research are identified.

Abstract:
What do we require from the labor market in order for it to contribute to a free life? And will the labor market of the future live up to what we expect from it? This study examines how a political philosophy of Hegelian inspiration helps us understand the conditions by which the labor market could be capable of providing for what Axel Honneth refers to as ’social freedom’. An analysis by French jurist Alain Supiot is presented as an informative example of this theoretical framework. Supiot develops a sophisticated critique of the deficiencies of the contemporary labor market, while simultaneously pointing at some professions whose function testify of the possibility of the labor market of generating social freedom under proper conditions. As such, I show that a critical framework of Hegelian inspiration is immensely potent as to its capacity of understanding what we require from the labor market at this time of history. Immensely potent, but perhaps insufficient. Indeed, by introducing the research of Aaron Benanav pertaining to the development of the global labor market, this study corroborates the critique of Honneth and Supiot—a critical framework already introduced by Karen Ng and Timo Jütten—concerning the possibilities of the labor market of providing social freedom at any significant scale and thus hints at the probable necessity of overcoming capitalism during the time to come.

The access to technology, the effects of instant information and the emergence of an increasingly empowered global citizen have contributed to the fundamental shift of the global political and economic landscape over the last twenty years. In consequence, the soft-power resources are becoming more and more important components of nation's foreign policy. Foreign policy instruments of public diplomacy and cultural diplomacy can effectively utilize such soft-power resources in order to assert foreign policy goals by purposefully supporting wide range of cultural and artistic activities. It is the aim of the thesis to examine both the direct and indirect impacts of artistic production on societies with various degrees of democratic culture and in connection to elaborate on the relevance of the right to freedom of artistic expression and creativity. The essential aim of this thesis is to look at the role that art production plays in the development of a democratic society.

TITLE: PUBLIC SPACE MUST BE DEFENDED. HANNAH ARENDT'S CONCEPTION OF POLITICS AND THE PUBLIC SPACE: ITS PROMISES AND LIMITS MAJOR PROFESSOR: Dr. Kenneth Stikkers This thesis is an examination of Hannah Arendt's reconsideration of the meaning of politics and her systematic search for the recovery of the public spaces. Her scrutiny of the meaning of politics is determined by the disastrous outcomes of totalitarian experiences from both ends of the political spectrum, namely, Nazism and Stalinism. For Arendt, the phenomenon of totalitarianism deserted the human world and brought new issues forth, such as statelessness, rightlessness, homelessness, and worldlessness. These phenomena, Arendt holds, run parallel to the collapse of the essential articulations of the human condition, which can be distinguished in sheer thoughtlessness, speechlessness, and lack of judgment. It is due to these unprecedented and unanticipated issues, which cannot be addressed by traditional political categories, Arendt invites us to grapple with the meaning of politics anew. The basic definition of politics, for Arendt, is human plurality, namely, our coexistence in a common world which enables differences and diversities of perspectives to appear. The question what politics means, for Arendt, is inextricably tied to what its distinctive locus is, namely, the public space or space of appearances. The emergence of the social resulted in blurring the distinctive line between the public realm and the private realm. Then, the recovery of the public space is of a central place in Arendt's political theory. Through Arendt's reconsideration of the meaning of politics and the recovery of the public space we are provided a comprehensive framework to think about a more inclusive and democratic politics. Nevertheless, we are challenged by a set of problems: a very sharp distinction between the public realm and the private realm, a contrast between the social and political, and a lack of systematic interest in democracy. First, I concentrate on Arendt's insightful analysis of politics and the public space in turn. Then I focus on the problematic aspects of her political theory. Finally, I argue that these problematic aspects can be complemented by a comparative reading of Arendt with John Dewey. I conclude that Dewey offers us a more dynamic criterion to decide the line between the private realm and the public realm. Instead of opposing the social to political, Dewey extends the scope of politics by taking every aspects of social life into consideration. The recovery of the public, for him, depends essentially on democracy, which is identified to the experience of local community.

Dans les communications sans fil sur des canaux à évanouissement, en particulier à antennes multiples, la connaissance instantanée des coefficients de canal, appelés informations d’état de canal (CSI), est essentielle car elle permet d’adapter la transmission et la réception aux conditions actuelles du canal. La communication avec CSI a priori au niveau du récepteur est dite cohérente. En pratique, cependant, le CSI n’est pas disponible avant la communication et doit être estimé à un coût qui ne doit pas être ignoré, en particulier dans un environnement hautement mobile. Ainsi, la communication sans CSI a priori, également appelée communication noncohérente, est un cadre plus pratique et général. Cette thèse contribue à la compréhension des limites théoriques des communications noncohérentes, ainsi qu’à la conception d’un système de communication pratique noncohérent à évanouissement par bloc. Nous considérons trois scénarios: le canal point à point (P2P), le canal à accès multiple (MAC) et le canal de diffusion (BC).Dans la première partie, nous étudions les limites fondamentales des communications noncohérentes en termes de débit de données et de degrés de liberté (DoF) réalisables. Nous considérons un évanouissement par bloc générique dans lequel le canal a une entropie différentielle finie et un second moment fini. Nous établissons d’abord le DoF optimal pour le canal P2P noncohérent à entrées multiples et sorties multiples (MIMO) en utilisant l’approche de la dualité pour borner les informations mutuelles. Deuxièmement, en utilisant une approche de dualité similaire, nous dérivons la région de DoF optimale pour le MAC SIMO à deux utilisateurs, qui peut être obtenue par partage de temps entre des schémas à pilotes simples. Troisième, nous dérivons les régions débit et DoF réalisable pour le BC MIMO noncohérent avec un évanouissement spatialement corrélé en exploitant la diversité de corrélation de transmission, qui est la différence entre la corrélation subie par différents utilisateurs. Ce faisant, nous concevons soigneusement des schémas de transmission basés sur des pilotes et sur le partage de débit, la superposition de produits et une combinaison de ceux-ci pour transmettre efficacement des signaux dans les parties communes et mutuellement exclusives des sous-espaces de corrélation. Dans la deuxième partie, nous concevons la constellation et les schémas de détection efficaces pour les communications noncohérentes sur le canal d’évanouissement de type Rayleigh par bloc. Premièrement, nous proposons une constellation Grassmannienne structurée pour le canal P2P SIMO qui est simple à générer, a une efficacité d’empilement élevée, admet un étiquetage binaire simple mais efficace et permet une détection efficace douce et dure. Deuxièmement, nous étudions la conception de constellation conjointe pour le MAC MIMO. Nous introduisons des critères de conception simples et efficaces afin de minimiser l’erreur de détection conjointe et proposons quelques constructions de constellation simples. Troisièmement, nous proposons un schéma de détection souple multi-utilisateurs noncohérent pour le MAC SIMO à l’évanouissement de Rayleigh corrélé spatialement basé sur l’inférence approximative par propagation d’espérance. Ce schéma présente une complexité polynomiale dans la dimension du canal tout en produisant des marginaux postérieurs approximatifs par utilisateur précis conduisant à des performances d’erreur quasi-optimales
In wireless communication over fading channels, especially multiple-antenna communication, the instantaneous knowledge of channel coefficients, so-called channel state information (CSI), is critical because it enables to adapt the transmission and reception to current channel conditions. The communication with a priori CSI at the receiver is said to be coherent. In practice, however, CSI is not granted for free prior to communication and needs to be estimated at a cost that should not be ignored, especially in a highly mobile environment. Thus, communication without a priori CSI, also known as noncoherent communication, is a more practical and general framework. This thesis contributes to the understanding of the theoretical limits of noncoherent communications, as well as the design of a practical noncoherent communication system in block fading. We consider three scenarios: the point-topoint (P2P) channel, the multiple-access channel (MAC), and the broadcast channel (BC).In the first part, we study the fundamental limits of noncoherent communications in terms of achievable data rate and degrees of freedom (DoF). We consider generic block fading in which the channel has finite differential entropy and finite second moment. First, we derive the optimal DoF for the noncoherent multiple-input multiple-output (MIMO) P2P channel by using the duality approach to bound the input-output mutual information. Second, using a similar duality approach, we derive the optimal DoF region for the two-user noncoherent single-input multiple-output (SIMO) MAC, which can be achieved by time sharing between simple pilot-based schemes. Third, we derive achievable rate and DoF regions for the noncoherent MIMO BC with spatially correlated fading by exploiting the transmit correlation diversity, which is the difference between the correlation experienced by different users. In doing so, we carefully design pilot-based transmission schemes based on rate splitting, product superposition, and a combination of them to effectively transmit signals in both the common and mutually exclusive parts of the correlation subspaces. In the second part, we design the constellation and efficient detection schemes for noncoherent communications over Rayleigh block fading channel. First, we propose a structured Grassmannian constellation for the SIMO P2P channel that is simple to generate, has high packing efficiency, admits a simple yet effective binary labeling, and allows for efficient soft and hard detection. Second, we investigate joint constellation design for the MIMO MAC. We introduce some simple and effective design criteria so as to minimize the joint detection error, and propose some simple constellation constructions. Third, we propose a noncoherent multi-user soft detection scheme for the SIMO MAC in spatially correlated Rayleigh fading based on expectation propagation approximate inference. This scheme has polynomial complexity in the channel dimension while producing accurate approximate per-user posterior marginals leading to near-optimal error performance

Abstract:
This Thesis explores artistic activism or artivism in the context of youth in post- revolution Tunisia. During and after the Arab Uprisings, the MENA region has experienced a tendency, wherein resistance is undertaken by artivists through in situ art interventions, music, and performances that create ‘new cultural spaces’, in which cultural hybridism through the mix of urban youth subculture, communication and traditional culture, creates new contexts of authenticity. It further investigates how art and activism is used in Tunis as a tool to mirror, provoke or communicate messages that directly or indirectly deal with post-revolution themes, and which mechanisms exist in limitations of artistic freedom of expression.It utilizes concepts of cultural resistance through theorists Stephen Duncombe and discusses the concept artivism as a hybrid term, through Aldo Milohnic. It then delineates subculture, authenticity and hybridization through various theorists and examines Artistic Freedom of Expression through the standpoint of international conventions and reports. The Thesis also analyzes artistic activism, commodification and globalization through a re-contextualization of Theodor Adorno and Walter Benjamin.Guiding this analysis are interrelated points of redefining Arab youth subcultures, through interviews conducted with five young Tunisian artists who combine artistic expression with political commentary and activism. I argue that a new dynamic discourse is shaped in the MENA region through the re-mixing of a cultural narrative which becomes re-contextualized locally, and therefore becomes authentic in a ‘glocal’ context. The Thesis offers analytical contribution to the field of cultural production in a Tunisian political context and adds to the research field of artistic activism.

La libre disposition de soi doit-elle accueillir des limites imposées par le Droit ? Une première approche, instinctive,est de répondre par la négative car le Droit n’aurait pas vocation à s’ingérer dans les rapports intimes que l’on entretient avec soi et qui ne concernent en conséquence pas la société. Il faut pourtant se rendre à l’évidence : le Droit est légitime à intervenir dans la libre disposition de soi car l’intimité est poreuse, et laisse passer entre ses mailles la présence d’autrui, ce qui autorise les pouvoirs publics à intervenir ponctuellement dans ce domaine a priori dédié à la vie privée. C’est à l’aune de l’ordre public que le législateur ou les juges déterminent si la libre disposition de soi peut s’épanouir sans danger pour autrui ou pour l’intérêt général. Cet ordre public, dans ses composantes classiques de direction et de protection, paraît néanmoins actuellement à la peine pour contenir les volontés individuelles qui s’expriment avec force conviction. Tant le juge que le législateur se sont en conséquence tournés vers un autre instrument juridique de nature à encadrer la libre disposition de soi. De facture plus récente, la dignité de la personne humaine vient soit protéger la libre disposition d’individus en situation de faiblesse ; soit au contraire limiter la libre disposition de soi, protégeant la personne contre son gré. La deuxième acception de la dignité est celle qui prédomine entre les mains du législateur et des juges, laissant la libre disposition de soi à la merci d’un instrument peu nuancé.Il faut donc rechercher un instrument juridique qui permette d’assurer la cohésion sociale sans pour autant éteindre les aspirations individuelles. C’est un équilibre particulièrement délicat à trouver en ce que ces deux objectifs sont le plus souvent diamétralement opposés. La recherche doit s’orienter vers l’ordre public car celui-ci est un concept éminemment évolutif. C’est un ordre public qui doit être de direction, eu égard aux faits qu’il accompagne, avec toute la fermeté requise, les individus dans la découverte des options qui leur sont les plus favorables et qu’il n’a pas vocation à protéger à tout prix la libre disposition de soi. Son adaptabilité aux circonstances de l’espèce est rendue possible grâce à l’application du principe de proportionnalité in concreto. Ce nouvel ordre public ne serait enfin qu’une coquille vide, sans l’objectif du Bien commun, qui permet de discriminer entre les usages licites et illicites de la libre disposition de soi. Encadrée par l’ordre public de direction de la personne, cette dernière peut s’exprimer sans verser dans des extrêmes dommageables à l’individu ou à la société
Must free self-determination accept limits imposed by law? A first approach, instinctive, is to answer in the negative because the Law would not have vocation to interfere in the intimate relations that one maintains with oneself and which consequently does not concern the society. However, we must face the obvious: the law is legitimate to intervene in the free disposition of oneself because the intimacy is porous, and leaves between the meshes the presence of others, which authorizes the public authorities to intervene punctually in this area a priori dedicated to privacy. It is on the basis of public order that the legislator or judges determine whether free self-determination can flourish without danger for others or for the general interest. This public order, in its classical components ofleadership and protection, nevertheless appears to be struggling to contain the individual wishes that express themselves with conviction. Both the judge and the legislator have accordingly turned to another legal instrument ofa nature to regulate the free disposition of oneself. More recent, the dignity of the human person comes to protect thefree disposition of individuals in situation of weakness; or on the contrary, to limit the free disposition of oneself,protecting the person against his will. The second meaning of dignity is the one that predominates in the hands of thelegislator and the judges, leaving the free disposition of oneself at the mercy of a little nuanced instrument. We musttherefore look for a legal instrument that will ensure social cohesion without extinguishing individual aspirations. Itis a particularly delicate balance to find in that these two objectives are most often diametrically opposed. Research must be oriented towards public order because it is an eminently evolving concept. It is a public order that must beof direction, given the facts that it accompanies, with all the firmness required, individuals in the discovery of the options that are most favorable to them and that it is not intended to to protect at all costs the free disposition ofoneself. Its adaptability to the circumstances of the case is made possible by the application of the principle of proportionality in concreto. This new public order would finally be nothing but an empty shell, without the objectiveof the common good, which makes it possible to discriminate between the licit and unlawful uses of free self determination.Framed by the public order of direction of the person, the latter can express himself without endangering the individual or the society

Both freedom of expression and the press are in evidence in the world today. Freedom of the press has a key role in monitoring and complaints of crimes and / or conduct detrimental to society, especially with regard to acts of public power. Exercising widely freedom of communication, guard means, in modern society, the formation of public opinion and free solidification of democratic rule of law. Given this important role taken by the freedom of communication, some argue a full and unlimited freedom, ruling out any form of regulation, oversight or limitation of such activity by the state. However, as with other constitutional freedoms, freedoms of speech and press are limits to its exercise. This work aims to address the freedom of speech and press forward to their limits.
Tanto a liberdade de expressão quanto a de imprensa estão em evidência no mundo atual. A última possui um papel fundamental na fiscalização e denúncias de crimes e/ou condutas lesivas à sociedade, especialmente, no que diz respeito aos atos do poder público. Exercer amplamente as liberdades de comunicação, significa resguardar, na sociedade moderna, a formação da opinião pública livre e a solidificação do Estado democrático de direito. Em face dessa relevante função assumida pela liberdade de comunicação, há quem defenda uma plena e ilimitada liberdade, afastando qualquer forma de regulação, fiscalização ou limitação de tal atividade por parte do Estado. No entanto, assim como ocorre com as demais liberdades constitucionais, as liberdades de expressão e de imprensa encontram limites aos seus exercícios. O presente trabalho tem por objetivo abordar a liberdade de expressão e de imprensa frente aos seus limites.

Abstract:
This thesis examines the connection between technological dependence of mankind and its attitudes towards it. The issue is to what extent technological change in the workplace is a generator of conflict or a creator of consensus? The subject of the study is the Swedish mining company LKAB during the period 1946-1987. The case study concentrates on the approaches to new technology by the local union leadership and the LKAB company management. The analysis is carried out through a classification scheme over job- functions, divided into four functional categories. The classification is ranging from manually inclined work on the end to highly automized work on the other pole. The results show a clear and unquestionable development of mechanization. At the next level of analysis the focus is on approaches and ways of relating mechanization by the two parties took on the question, and how this influenced the relationships between the two parties. The final results show that technological change in general is a creator of consensus. However, at the same time, techno­logical change is an unequeal process because the company commands control over three kinds of power resources; ownership, the legislative right of paragraph 32 and the monopoly of technological expertis. Organized labour can only try to attain technological knowledge and high levels of worker support.

RESUMO Este à um tema relacionado ao Fundo de Combate à Pobreza do Estado do Cearà â FECOP, instituÃdo pela Lei Complementar n 37, de 26 de novembro de 2003, regulamentado pelo Decreto Estadual n 27.379, que busca dar suporte para as aÃÃes de polÃticas pÃblicas na superaÃÃo da pobreza no Estado do CearÃ, em duas vertentes na mudanÃa estrutural e nos processos de polÃticas compensatÃrias, que envolvem todas as aÃÃes das secretarias estaduais do Cearà no combate à pobreza, e o projeto proposto busca situar como problemÃtica se està polÃtica pÃblica esta realmente reduzindo a pobreza no Estado cearense, e qual a sua natureza de atuaÃÃo, no perÃodo de 2004 a 2010, no contexto do quadro neoliberal e da mundializaÃÃo do capitalismo financeiro, como elementos constitutivos da reproduÃÃo ampliada da pobreza, de forma generalizada em todos os paÃses em desenvolvimento, dentro de uma inclusÃo injusta da globalizaÃÃo capitalista. ABSTRACT The design of the proposed study to be described is a theme related to the Fund to Combat Poverty in the State of Cearà â FECOP, which was established by complementary Law No. 37, dated November 26, 2003 and regulated by State Decree 27379, which seeks to support the actions of public policies in overcoming poverty in the State of CearÃ, in two-pronged in the structural change and the processes of compensatory policies, that involve all actions of state departments of Cearà in fighting poverty, and the proposed project seeks to put as problematic if this public policy is really reducing poverty in the State of CearÃ, and what is its nature of operations in the period from 2004 to 2010, set against the backdrop Neo-Liberal and globalization of financial capitalism, as constituent elements of the expanded reproduction of poverty so widespread throughout developing countries, within an unfair inclusion of capitalist globalization. The main objective of this study is to evaluate, analyze critically and reflectively the implementation, concepts, principles and achievements of FECOP, regarding the behavior of the indices related to extreme poverty and poverty in the aforementioned period, in a differently and more comprehensive than the dominant explanatory variable used and focused only on insufficient income.

Le but de ce travail de recherche est de construire théoriquement le design comme dispositif communicationnel, d’abord entre deux entités abstraites ou deux “sociétés anonymes” que sont l’art et l’industrie. Ainsi, la première partie a pour objet la définition et l’évolution du sens des mots “art”, “industrie”, “design”. Une deuxième partie vise à définir un concept de design qui se distingue de l’actualisation constituée par le phénomène “design industriel” au cours du dix-neuvième et duvingtième siècle. La troisième partie cherche à mettre en lien ce phénomène avec l’émergence de la scène médiatique et de l’exposition universelle afin de produire la modernité comme religion de l’ère industrielle. Cet ouvrage théorique se propose aussi de mesurer en quoi l’art est altéré par le système industriel, et inversement comment les artistes parviennent à faire progresser une exigence esthétique dans ce système socio-économique
The aim of this research was to build in theory a concept of design as a communication device, first between two groups or moral persons : art and industry. The first part seeks for a definition of “art”, “industry”, “design” ; the emergence and evolution of these notions. A second part is aimed at building a concept of design that would distinguish itself from the usual definition of design understood only in its industrial extent, which is a phenomenon limited to the nineteenth and twentieth centuries. The third part is an attempt to link this phenomenon with that of the emergence of a mediatic worldwide scene and universal exibition in order to produce modernism as a religion for the industrial era. After the more than twenty seven years of existence of the 1988 Brazilian Federal Constitution which interrupted, since the beginning of the Republic in 1889, a long period of countless limitations of the individual and artistic liberties, to ensure through all of the text the effectiveness of making art to be the duty of the State and the right of the citizen to express oneself and to artistically interfere in the day-to-day of society upon stimulating or repressing behaviors. The dissertation covers the Fundamental Right of Freedom of Artistic Expression in public space and has, as a starting point, the actual Constitution of 1988 to verify the amplitude of the devices that are directly or indirectly related to making art that for an aspect to ensure the free initiative of the artist and, as another point, it indicates possible limitations. Based on the constitutional hermeneutics as a tool of dialogue so that, with general and abstract language, characteristics of the constitutions, of the text upon unveiling other possibilities of constitutional interpretation and of a possible theoretical application for the maintenance of juridical stability and order because of the evaluative content of the constitutional guarantee of freedom of artistic expression. Beyond being one of the formative elements of the Brazilian People, the culture revealed in artistic expression assumes, in the social context and in the public space, the maximum force of a free, plural, and democratic country
Decorridos mais de vinte e sete anos de vigência da Constituição Federal Brasileira de 1988que interrompeu, desde o início da República em 1889, um longo período de inúmeras limitações às liberdades individuais e artísticas, ao assegurar por todo o texto a efetividade do fazer artístico, hoje está garantido o dever do Estado e direito do cidadão de se expressar artisticamente no dia a dia da sociedade ao estimular ou reprimir comportamentos. A dissertação cuida do Direito Fundamental à Liberdade de Expressão Artística no espaço público e tem como ponto de partida o próprio texto Constitucional de 1988 para verificar a amplitude de dispositivos que direta ou indiretamente se relacionam ao fazer artístico que,por um aspecto, asseguram a livre iniciativa ao artista e, por outro, indicam possíveis limitações. The purpose of this study is to explain the process of designing the architecture of StrangeSpaces, an itinerant festival for transcultural performing arts groups or artists which starts from the original idea and terminates with the description of a possible structure. The process of designing StrangeSpaces is based on an investigation on the transcultural performing art’s field and on conversations with experts, which together transformed the original general idea of a festival, into the specific architecture of the StrangeSpaces festival. The investigation resulted in a personal definition of ”transcultural performing arts”, that subsequently led to the identifications of three elements of transculturalism which define the festival’s goals as ”encounter with the other” in multiples and different yet equal levels. Another result of this investigation is the contextualization of StrangeSpaces in the contemporary international cultural politics. In fact, the transcultural encounter and exchange can be viewed as a possible response to the increasing need of sustainable international performing art in local, national and European cultural communities. The conversations with experts in the field of international performing arts complemented the investigation, contributing to the ideological principles of StrangeSpaces, such as anti-racism and anti-colonialism, as well as to a model of democratic and sustainable design, in which multilingualism and cosmopolitan aspects of the society are essential cues. The result of the study is a design of the architecture of three versions of StrangeSpaces, an itinerant transcultural performing arts festival that is born to be a space, a free place where people play, exchange roles, art, experience starting from their own culture, but reaching and reflecting into the other, mirroring a society of sustainable diversity.

O presente estudo ora entregue à sociedade abordará importantes questões relacionadas aos limites e restrições à liberdade profissional no âmbito da Administração Pública, tema, pelo que já se viu, de pouca pesquisa na academia e raso tratamento doutrinário em solo pátrio, e que por certo interessará àqueles que, direta ou indiretamente, estão envolvidos com o serviço público. A liberdade profissional goza de um histórico de proteção constitucional no país, a começar pela Carta imperial de 1824, constituindo direito fundamental atualmente previsto no art. 5º, XIII, da Constituição Federal de 1988. O escopo dessa pesquisa é investigar o alcance dessa liberdade, sua eficácia, seu âmbito de proteção sujeito a limites, restrições e conformações não só com base no inciso XIII aludido, que se apresentaria como regra e princípio ao mesmo tempo, mas também com fundamento em outras situações que, à luz da Constituição, serviriam como janelas para ensejar interferências no direito em apreço. Nessa perspectiva, e como fechamento do contributo do trabalho para a proteção desse direito fundamental, serão objeto de investigação alguns parâmetros propostos para aferir a constitucionalidade das afetações impostas pelo Poder Público.
This study, which has been presented to our society, will cover important questions concerning the limits and restrictions on professional freedom in the Public Administration, theme that there has been little researched in the academy and dealt with narrow doctrinal treatment throughout the country background. The study will certainly be interesting for those who are directly or indirectly involved in public service. The professional freedom has a history of legal constitutional protection in the country, beginning with the 1824 Imperial Letter, composing a fundamental right currently provided by in Article 5, Item XIII, from the 1988 Federal Constitution. The scope of this research aims to investigate the reach of this freedom, its effectiveness, its range of protection under limits, restrictions and conformations not only based on the Item XIII aforementioned, that presents itself both and simultaneously as a rule and a principle. In addition, it will appear grounded on other situations that, by the interpretation of the Constitution, would serve as windows to allow interference in the social right in question. In this perspective, and as closure of the study’s contribution to the protection of this fundamental right, some proposed parameters to assess the constitutionality of the stains imposed by the Public Power will be used as investigational objects.

ORIBOMBO: Arte da Pós-Modernidade A presente dissertação de mestrado propõe-se a apresentar o Oribombo como arte da pós-modernidade, trazendo a questão do hibridismo do Oribombo, à situação da arte atual, onde se verificam hibridismos de toda natureza, incentivados pela total liberdade. O artista não se prende mais à ideologias e limitações que ditavam as concepções artísticas do passado, inclusive do passado recente. Liberdade é a palavra de ordem da pós-modernidade. Liberdade que se manifesta em todos os segmentos da sociedade. E na arte, uma consequência do livre fazer, é que os hibridismos são constantes, acontecendo de forma natural. As modalidades artísticas são exploradas simultaneamente, abrindo um leque de possibilidades durante o processo de criação. No caso do Oribombo, as modalidades artísticas que se mostraram plasticamente mais interessantes, foram a pintura, gravura, escultura e a colagem. Outra consequência da total liberdade adquirida pelos artistas da pós-modernidade, é que em certos momentos, indaga-se se tudo que é produzido com o título de arte é arte realmente. Essa discussão é muito ampla, mas a premissa de que arte é a produção de um artista, é a que mais ecoa, não somente no meio artístico, como também, entre pensadores e escritores, que direcionaram suas atenções ao desenrolar da história da arte. Os fazeres e conhecimentos artísticos são indispensáveis ao artista plástico visual, sendo assim, as modalidades artísticas que foram fundidas no processo de criação do Oribombo são seculares, mas, a liberdade com que foram tratadas é uma questão pós-moderna.
This dissertation proposes to introduce Oribombo as art of postmodernity, bringing the question of hybridity of Oribombo, the situation of contemporary art, where there are all kinds of hybridisms, encouraged by complete freedom. The artist is not attached to the ideologies and more limitations that dictate the artistic conceptions of the past, even the recent past. Freedom is the slogan of the postmodernity. Freedom that is manifested in all segments of society. And in art, one of the consequences of free artistic making is the hybridism, and it is a constant, happening naturally. The artistic modalities are explored simultaneously, opening up a range of possibilities during the creation process. In the case of Oribombo, the artistic modalities that were artistically more interesting, were the painting, the printmaking, the sculpture and the collage. Another consequence of complete freedom gained by artists of the postmodernity, is that at certain times, inquires if everything is produced with the title art is really art. This discussion is very ample, but the premise that art is the production of an artist, is the one that resonates, not only in the artistic world but also among thinkers and writers, that directed their attention to the course of art history. The doings and artistic knowledge are indispensable to the visual artist. The artistic modalities that were merged into the creation process Oribombo are secular, but the freedom with which they were treated is a postmodern matter.

When Nationalmuseum 2018 reopened after a thorough renovation, a cultural debate arose in Sweden about the extent to which norm criticism has taken over the museum's permanent exhibition. The intention of norm criticism is to act as an inclusive tool, by, among other things, making visible, criticizing and changing structures. However, can the inclusive norm criticism also inhibit freedom of expression by causing an exclusion of certain art expressions and performers? In other words, does there arise a paradox in applying norm-critical requirements on artistic freedom? The purpose of this essay has been to present an answer to this question and thereby making a contribution to the discourse within the science of Arts, regarding the prerequisites of artistic freedom. The study was conducted through semiotic image analysis by the artwork: Anders Zorn – Badande kullor, Bruno Liljefors - Orrspel i mossen and Carl Larsson – Till en liten vira. The analysis were further developed through commutation tests, where the artist's gender affiliation changed from male to female with the intention of, from a norm-critical perspective, studying whether and how the artist's gender affiliation in a transmitter context influences the meaning and signification of the artwork. The results from the image analysis show that the meaning in the interpretations of the works shifts in a varying degrees, which can contribute to both confirm, creating new and challenging already known oppressive norms and structures. To summarize, the study concludes that in norm criticism such a paradox can arise, which can have limiting and exclusionary consequences for the prerequisites of artistic freedom in the form of, for example, self-censorship and discrimination.

Abstract:
This case study examines the role of music and music-making for the youth in Brikama, the Gambia in terms of freedom of expression, sustainable development and social change. The study is situated within a project where young musicians with different backgrounds wrote and recorded their own songs during workshops with established musicians. The data was collected via interviews with the participants and instructors, observations and song analysis. The study uses Small’s (1998) theory of musicking to analyze the meaning of the musical events in the social context. Furthermore, it uses theories on the relationship between music and sustainability to analyze the role of music for the youth on an individual-, group- and societal level, but also on an organizational level. The study finds that on all four levels music and music-making holds many of the characteristics required for sustainable development and that it can foster resilience through creativity. However, it also shows that this requires the creation of inclusive spaces with an awareness of the cultural narrative and forces (such as limiting traditional values and gender issues) that might limit the capabilities of individuals, and the society, to reap these benefits. The study also shows how music, with its artistic characteristics, can offer pockets of freedom of expression to a certain but limited extent. Finally, the study shows how music can and should be incorporated more extensively by organizations working for sustainable development and social change, both as a tool to achieve other sustainability agendas, but also for the inherent characteristics of resilience and creativity that is found in music-making itself.
Denna fallstudie undersöker musik och musikskapandets roll för ungdomar i Brikama, Gambia, och dess relation till yttrandefrihet, hållbar utveckling och social förändring. Studien är genomförd inom ramen för ett projekt där unga musiker med olika bakgrund komponerade och spelade in sina egna låtar under workshops tillsammans med etablerade musiker. Materialet samlades in genom intervjuer med deltagarna och instruktörer, observationer och textanalys av låtarna. Studien använder sig av Smalls (1998) koncept musicking för att analysera den musikaliska situationens mening i sin sociala kontext. Dessutom används teorier om relationen mellan musik och hållbarhet för att analysera musikens roll för ungdomarna på en individuell-, grupp- och samhällsnivå, men även på en organisationsnivå. Studien visar på alla fyra nivåer att musik och musikskapande innehar många av de karaktärsdrag som krävs för hållbar utveckling och att det kan främja resiliens genom kreativitet. Dock visar studien att inkluderande sammanhang behöver skapas med medvetenhet om den kulturella kontexten. Detta för att kunna navigera de krafter (såsom negativa traditionella värderingar kring genus) som kan begränsa individers deltagande och i slutändan samhällets möjlighet att ta del av fördelarna. Studien visar också hur musik, med sina konstärliga karaktärsdrag, kan erbjuda ett visst utrymme för yttrandefrihet. Slutligen visar studien hur musik kan och bör inkorporeras till större grad av organisationer som arbetar för hållbar utveckling och social förändring, både som ett verktyg för att uppnå hållbarhetsagendor, men även för de inneboende karaktärsdragen resiliens och kreativitet som finns att hitta i själva musikskapandet.

Abstract:
This essay reflects a particular method and way of working that I employ when undertaking artistic research. My artworks are rooted and develop from the situation I find myself in as an artist, the very context I exhibit the work within. I do this by trying to understand this position, both on the micro and macro scale. As an artist currently studying at—and subsequently exhibiting in relation to— Konstfack, I base my research with the physical manifestation of the school. An imposing building that was part of a huge headquarters and factory site for the telecommunication company, Ericsson, in south Stockholm. The title of my essay is from the translation of a unique German cipher machine, the Geheimschreiber, made known to me through enquiry into this site. Throughout the Second World War the German army used this machine to send highly encrypted military messages across Swedish telephone cables. Following one of the greatest accomplishments in the history of cryptography, a Swedish mathematician broke this German code and subsequently assisted in designing a deciphering machine on behalf of the Swedish Intelligence branch. This device, known as the App, was secretly developed and manufactured by Ericsson, possibly where I now study. In exploring the theme of secrets, this essay originates from an underpinning desire and subject of my work to reveal what is concealed or overlooked. Through researching and writing this essay I attempt to have a better understanding on the notion of secrets, in both the private and public realms. Introducing the artistic process and situation I am working from, I explore the central role that secrets play within society. In order to understand secrecy today I introduce the intertwined and associated contemporary debates of privacy, (both private and public) and transparency through such subjects as Google’s new privacy policy, mobile phone hacking, WikiLeaks and offshore banking.

The minor prnography is a very visible and current crime, mainly due to the easy acces to this kind of contents available in the Internet. There is no doubt that being a matter of minors at risk, the Criminal Code must intervene assuring their legal good , opposite of what happens with the adult pornography that is legal in Portugal. But, could we refer to self-determination regarding the pratice of there acts by 14 years old minors? Do this chilren have the sexual freedom in order to be self determined on this field? And what about the 16 years minors, could we acknowledge validity to their consent? On the other hand, the one who views on-line minor pornographic contents or the one that holds the same footage with no intention of disclosing , export, distribute (...) to a third party, should they be subjected to criminal prosecution? In the cases of a minor realístic representation, where there is no images of real children, is it not disproportionate to restrict the right to freedom of artístic creation by a penalty where the criminal law overflows on its main objective of "ultima ratio ". The main purpose of this essay is to find answers to all of these matters, through the detailed analysis of the limits of the incrimination of the above mentioned crime. The objective of the thesis is to explore the actual legal frame structure regarding there matters. Through the jurisprudence analysis and of a doctrinal study, I aloquete myself to discuss these subjects, having taken a final acquaintance.
pornografia de menores é um crime de que muito se ouve falar no dia a dia, em grande medida, devido ao fácil acesso a esse tipo de material que a internet propicia. Não há dúvida de que estando em causa menores, o código penal deve intervir na proteção do bem jurídico destes, diferentemente do que acontece com a pornografia de adultos que em Portugal é legal. Mas então, poder-se-á falar de autodeterminação para a prática destes atos de menores de 14 anos? Terão estas crianças liberdade sexual para se autodeterminarem neste âmbito? E ao menor de 16 anos, poderemos atribuir validade ao consentimento que tenha prestado? Por outro lado, aquele que visualiza material pornográfico de menores on-line ou aquele que detém o mesmo material sem intenção de divulgar, exportar, distribuir (…) a terceiros, serão merecedores de tutela penal? Nos casos de representação realista de menores, onde não existe imagens de crianças reais, não será desproporcional restringir o direito à liberdade de criação artística por uma punição onde o direito penal extravasa o seu objetivo de ultima ratio? O presente trabalho visa responder a todas estas questões, através da análise dos limites à incriminação do crime supramencionado. O objetivo da dissertação, é explorar a estrutura atual do regime jurídico português em torno destas questões. Através da análise de jurisprudência e de um estudo doutrinário, pretende-se discutir estas questões tomando uma posição final.

Artistic freedom always faces various challenges from society and challenges the boundary of the society. In the modern country based on rule of law, the legal action is the last method of dispute. Hence this thesis aims at the comparison of the regulation and the judgment about the case of artistic freedom in Taiwan, England and America to study the predicament of art area. There are three main parts of the thesis, consisting of Chapter two to Chapter five. Part one is the concept and status of artistic freedom in human rights. The important of protecting artistic freedom is emphasized by philosophy theories about the functions and the natures of art. The status of art is established by the comparing of characters of freedom of art and freedom of speech and alleged by the protection in international convention and area agreement. The following part is the protection and restriction of artistic freedom in Taiwan. The issue is whether the courts in Taiwan admit that the right of artistic freedom is covered by the Constitution in Taiwan. The Council of Grand Justices (C.G.J) delivers Constitutional Interpretation (C.I) N.O 407 and 617 mentioned the term of “art” in the content of C.I., so that does that means that the Grand Justices confer the value and the character of art need to be approved. The third part is the introduction of English law and the law of United State. Blasphemy law, the Obscene Publications Act 1959 and Common law offence- Outraging public decency in England are the main regulations about the restriction of artistic freedom, therefore the dispute focus on the problems derive from them. The discussion of law of United State is based on the link of Fist Amendment and art and the coverage of Fist Amendment, and how they value the art in the judgments of U.S Court. Then the conclusion is to give advice on the development of art area in Taiwan.

From the perspectives around the world, because of the purpose of artistic financial support, the nature of power from a country is unusually ignored. However, in the traditional theory of public law, with respect to how much is still beneficial nature of the invasion administration, "the balance of power is also a lack of relevant discussion. Under the observation of artistic and cultural research and legal philosophy, the intersection between them will be significant and essential. Therefore, this paper hope to focus on this dispute and research on the relative issues. This article thinks subsidized artistic freedom had been damaged and effected negatively. By the actual cases, this research paper expect to analyze the similarities and differences between artistic freedom and freedom of speech. Additionally, this paper also look forward to reviewing the freedom of the arts as a fundamental right of the defense argument foundation and discuss whether it is reasonable to establish this identification. Based on the doctrine of "legislative examination and balances ", judicial cases reveal the questions about payment administration on this topic. Especially, when it applies to reservations, can the boundaries of the national arts subsidies be draw substantially? Furthermore, how should jurisdiction be reviewed on the arts subsidy cases? How can the uncertain legal concept be classified by certain test when the defect discretion applies to these types? How does the possibility of litigation competitor depend on Goldener Zügel rule to propose subsidy? When the significance of such cultural policies both exist, how to prevent manipulation of artistic and cultural is critical to the research of cultural policies. According to this research, it is expected to reconstruct the constructional value and structure and provide suggestion to correct the misunderstanding related to arts and culture laws.

From the beginning of mankind, with the accumulations of knowledge, human's creative behaviors are diversifying increasingly. Individual types of creative behavior have developed a variety of rich and professional expressions of unique cultures. Therefore, to evaluate the authoring behavior should consider the uniqueness of the way of thinking and the history of the spirit of individual culture, in addition to often the most basic creative originality factors, and then to determine it with objective but sophisticated approaches. In recent years, countries have reported many major plagiarism cases. With the horn of the “Free Culture” sounding, many scholars and professionals, in particular, the professor Lawrence Lessig of Stanford University Law School, have been questioning that if the design of copyright laws has impeded cultural development. In the cases of copyright infringement on plagiarism, the courts only have identified the "Access" and "Substantial Similarity" as facts to make their decisions. All theories have started to question if this practices have really protected authors, or put it another way, if the current legal system can actually be, form the artists' point of view, protective to the rights that creators really seek to achieve the purposes of copyright law designs. In this paper, the musical adaption as a creative style has been focused, and reveals the originality that musical artists recognized may be affected by individual types of musical culture, having unique criteria for verifications. With today's “Remix Culture” flourishing at the same time, it is more likely that the individual classical, jazz, reggae, rap, and other musical cultures are blending with each other and producing musical works that integrate the culture of Western history and the culture of traditional Chinese. With the factors determining infringement of musical works resulted from mixing and matching a variety of components, the laws should have a more professional orientation toward the uniqueness of individual thinking, to establish truly creative oriented copyright law designs, beside the traditional principles of copyright. Therefore, in addition to identifying copyright infringement, it should have more sophisticated distinction. For example, to protect musical works, the individual elements of music, i.e. notes, chords and rhythms, should be the underlying objects to be verified, instead of depending on the general identification of music of traditional copyright laws. Moreover, because of the cultural differences of individual genres of music, to determine plagiarism must consult the uniqueness of musical genre. If we stop judging the cultures with rigid criteria, we can truly achieve the purposes of what copyright laws are meant to protect the rights of authors and the development of cultural diversity.

Abstract:
Under common law an employer enjoyed complete freedom of choice when recruiting and selecting employees. An employer had unfettered discretion in recruiting and selecting employees. There were no legal restrictions on the prerogative of the employer to appoint employees. Developments in labour law have, however, gradually diminished the employer's freedom of choice during the recruitment and selection process. The Employment Equity Act No. 55 of 1998 and the Code of Good Practice on the Integration of Employment equity into Human Resource Policies and Practices, 2005 as· well as impending labour legislation impose limitations on the employer's freedom of choice during the recruitment and selection process. The remaining problem therefore is: What is the extent of the limitations on the employer's freedom of choice in the recruitment and selection of employees? The study will be conducted by means of a literature study of relevant books, journal articles, statutes, case law and internet sources relating to restrictions which are placed by legislation and case law on the employer's freedom to choose employees during recruitment and selection. This research therefore investigates the extent to which developments in labour law have eroded the prerogative of an employer to appoint employees. This investigation will help clarify the limits within which an employer has to exercise its choice of an employee during recruitment and selection.
