Abstract:
In August 1945, Karl Loewenstein began work as senior expert advisor to the Legal Division of American Military Government (AMG) in Berlin. An eminent German-born and educated political scientist and jurisprudent, Loewenstein had come to assist in the “democratization” of his homeland's Nazified law and legal institutions. It was soon obvious, however, that in its crucial first phase the American legal mission in Germany was in disarray. The development and implementation of American law reform policy was being undercut by ill-prepared leadership, poor planning, and the scarcity of learning about German laws, lawyers, and legal history. By Loewenstein's reckoning, many American officers had been “set to work on problems of which they have not the slightest idea and very little professional qualification.” Critical law reform initiatives had been based upon expedient “over-simplifications” of Nazism and its eradication. By January 1946, his initial misgivings having given way to mordant despair, Loewenstein concluded that the American program for the democratization of the German legal system was irrevocably “lost,” a “failure which stinks to high heaven.” This article sets forth the theoretical and observational bases of Loewenstein's assessment and evaluates its cogency.

Introduction. The Buschke — Loewenstein tumour was described for the first time in 1925 as a rare giant condyloma. The main cause of this pathology is the human papillomavirus, which is introduced into the body under certain conditions. This pathogen can be transmitted sexually. The neoplasm is usually localised in the anogenital region. Malignant transformation and its spread to the penis are even more rare.Aims. The Buschke — Loewenstein tumour is a rare pathology, whose course and treatment features are of considerable interest to urologists.Materials and methods. This article presents a clinical case of the malignant giant Buschke — Loewenstein tumour with primary localisation on the anterior abdominal wall and spreading to the genitals of a 42-year-old man without accompanying immunodeficiency or urogenital infections. The anamnesis of the gradually progressive disease in the absence of any treatment was more than 10 years. When preoperative cytological examination of the biopsy did not reveal signs of malignant transformation, the patient underwent simultaneous removal of all neoplasm foci and reconstructive plastic surgery using skin grafts.Results and Discussion. The foci of the tumour were removed entirely without disturbing surgical boundaries. A postoperative histological examination revealed small foci of squamous cell carcinoma in remote tissues. A postoperative observation conducted six months following surgery revealed no signs of recurrence of the disease.Conclusion. Buschke-Loewenstein tumours are rarely accompanied by malignancy. Nevertheless, oncological vigilance forms a necessary element of postoperative procedures. Following removal of a large neoplasm, the choice of reconstructive plastic surgery is of particular significance for postoperative quality of life. For the prevention of relapse, it is advisable to conduct immunotherapy in the postoperative period.

The malignant transformation and localization in penis is very rare. This article aims to present a case with BLT with malignant transformation in penis.A 59-year-old male patient was referred, who has have been suffering from a cauliflower-like lesion in the penis for 8 years. Biopsies revealed a BLT with malignant transformation. The lesion was excised largely and reconstructed with local flaps and skin grafts.Defined by Buschke and Loewenstein in 1925, giant condyloma acuminatum is a rare and important disorder because of the sexually transmitting capability.

Background. The LOTCA (Loewenstein Occupational Therapy Cognitive Assessment) battery is a cognitive screening test which is widely used in occupational health. However, no work has been found that explores its use in addiction treatment.Objectives of Study. To explore the convergent validity of LOTCA with neuropsychological tests that assess related cerebral functional areas.Methods. The LOTCA, along with a battery of neuropsychological tests, was administered to a sample of 48 subjects who start a treatment by substance or gambling addictions.Findings. A correlational pattern was observed of a considerable magnitude between the effects of the LOTCA scales and those of some neuropsychological tests, but not with others. There is barely any convergence in measures with memory and executive function tests.Relevance to Clinical Practice. There is a lack of research applying test of occupational assessment to populations of patients treated by addictive behaviors. The LOTCA seems to be a reliable and valid test for preliminary screening of function in certain cognitive areas, easy, and quick to use (around 30 minutes). However, it must be supplemented with other tests for a full and ecological assessment of patients.Limitations. An incident, small-size sample.Recommendations for Further Research. New studies are needed to explore the applicability, diagnostic validity, and whole psychometric quality of the test in addiction-related treatment.

La separación de poderes es uno de los grandes mecanismos para lograr la limitación del poder buscado por el liberalismo político. Su objetivo de evitar el despotismo y garantizar la libertad de los individuos no ha cambiado con el paso de los años, pero la forma de entender al poder político y sus técnicas de organización sí, por lo que la teoría, estructura y manifestación de la separación de poderes también ha sufrido modificaciones, al grado de plantearse incluso su superación por autores como Karl Loewenstein. Tomando como guía la tesis de Michel Troper sobre la polisemia de este concepto, este trabajo explorará los seis distintos sentidos de la locución, nutriéndolos con los trabajos de algunos autores clásicos y contemporáneos, y sugiriendo que cada concepto en realidad representa una nueva etapa evolutiva. Posteriormente, el trabajo expone la teoría del control del poder –expuesta por el propio Loewenstein y Diego Valadés, entre otros autores– como una alternativa o una conceptualización más acabada de estas ideas. Este siguiente paso evolutivo tiene implicaciones importantes debido a los constantes cambios institucionales y constitucionales de todos los países, ya que estas modificaciones no deben realizarse con el “enfoque del mejor sistema”, sino para resolver los problemas específicos de cada contexto, siempre tomando en consideración que al final lo que importa en el Estado Constitucional de Derecho es lograr un efectivo control del poder.

Abstract:
Giant condyloma acuminatum (GCA) or Buschke-Loewenstein tumor is a rare disease, with an estimated prevalence of 0.1%. It was initially described in 1896 by Buschke and later in 1925 by Buschke and Loewenstein. Classic condyloma acuminata (CCA) and squamous cell carcinoma (SCC) were initially described as different entities. These three entities are currently considered to correspond to the same spectrum of different but not exclusive malignant transformations, associated with multiple risk factors such infection by human papilloma virus (HPV), immunodeficiencies, poor hygiene, multiple sexual partners, and chronic genital infections. HPV subtypes 6 and 11 are associated with 90% of GCA. It presents as a cauliflower-like tumor in the genital region with bad odor, bleeding, and local infection, differential diagnosis with multiple conditions should be considered, and sexually transmitted diseases should always be investigated. GCA has a higher rate of malignant transformation than CCA and tends to infiltrate adjacent soft tissues. The therapeutic approach is controversial but is considered that the resection with free edges is the gold standard and can be combined with adjuncts. The recurrence rate is high. Overall mortality is 21% and is associated with morbidity caused by recurrences. Imiquimod cream 5% has recently shown good results as monotherapy and in combination with ablative and surgical treatments. The quality of life is diminished in patients with this condition. In this review, we address the different aspects of this rare entity including the therapeutic approach.

Emigré constitutional scholars devised three distinctive versions of this “democratic robustness”: an “anti-extremist” (which originated in Weimar legal antipositivism); a “militant democracy” (first exposed by Karl Loewenstein); and a “constitutional dictatorship” (Carl J. Friedrich, Frederick W. Watkins). At the heart of each one lies a decisive debate with Carl Schmitt, even if implicit or diffracted. By reconstructing these debates one can appreciate to what extent postwar constitutional democracies have incorporated Schmitt's ideas.

Loewenstein and Simonsohn (2006) found that movers across US cities anchor their rental choices to rents in the city of origin, but subsequently converge to comparable local households. We explain this finding using the authors' (2019) model of memory and attention. Rents in the destination city cue recall of “normal” rents in the city of origin, making the former surprisingly high or low, causing movers to under- or overspend, respectively. Over time, experience with new city rents allows the memory database to adapt, and the effect fades away. The model yields two new predictions, for which we find supportive evidence.
