Full textFrom the analysis of the formation and application ( a case observed and documentary analysis) of the bill passed on august 4 th 1982 about the direct expression of salaried employees, we question the limits of legislation in this field. We assimilated the expression process to the participation process carried out in many firms. The analysis of the case of the salaried employees enables us, by extension, to define the conditions of institutionalization of these techniques and practices of participation in decision making. In our perspective, participation techniques are contingent and are the matter for the practice of each individual firm. Their implementation essentially sollicits the ressources of influence and negociation processes either : explicit or implicit. The juridicisation of these interaction relationships constitues constraint upon the exercising of influence and makes negociations less flexible and pertinent considering the practical stakes of participation

Full textThis research aims at increasing our knowledge of the development of the individual programs of training since the law of 1971 while passing by the White Paper of nicole Pery, until the law of May 4, 2004. Since the signature of the interprofessional agreement of September 20 2003 which led to the promulgation of the law May 2004 device of Continuous Vocational training reforms, many questions emerged as for the implementation and use of the DIF (Individual Right to the Formation) by the companies and the employees, and this in accorda,ce with the orientations fixed by the legislator. A model of analysis is developed and tests several assumptions relating to the effectiveness of the practices within the framework of the management of the individual Programme of Formation within the companies of the Pole of Competitiveness AESE (Aerospace industry and Spaces-Systems Embarked in Midi-Pyrénées). An empirical study is undertaken near the Pole of Competitiveness AESE and more particulary to started from a sample of 25 companies representing more than 25 000 employees. The main results highlight that the setting in action of the DIF is increased when the company has a developed service human resources and a person in charge formation. In this direction, the use of the DIF is in positive relation with the population of women employees in the company and finally, the presence of a person in charge of training programs is favorable to the communication on the DIF. The principal contributions of this research are an approach of the individual program of formation, through the effective installation of the DIF and the test of the model of our research

Full textPreceded by the tumult of multiple media scandals having unveiled the facts of abuse, ignored or provoked by the child protection system, the law of March 5, 2007 was intented to remedy to intrinsic failures in the protection service by semantically and formally restructuring the operation, the mission and the definitional field covering the entire device. Rooting around the abuses risk « prevention » mission and « parentality support », a few new vocables (« Danger Risk », « Danger »), instruments (« Worrying Information », « Project For the Child ») and new instances (« Cell Collecting Information of Concern », « Observatory ») have accompanied the law's reformist character. Beyond the simple change and semantic renewal, this constellation of words and sentences was not without producing profound alternations in the arrangement of roles, functions and identities of each actor caught in the enunciative network of the device. From a set of normative statements, the law shaped and committed professionals to do-with a new general paradigm on the representation of the parent-child link. It was no longer for the professionals, inside of this vision, to punish a parent potentially « deficiencied », or to cut off a link judged « toxic » to protect a child, but to allow the parental subject to discover itself (« to elicit ») and invest its role of parent. Supported by an institutional mediation, the parent was potentially designated, since Article 375 of the Civil Code, as an protagonist for the good « physical, emotional, intellectual and social development » of the child. Reordering the elementary lines on which was based the care of a user, the law reorganized in depth the behavior's structure of the various actors. Wondering about these various normative changes, this research work offers itself to seize the operated « effects » by the law of March 5, 2007 on practices, the thought and the relationships between professionals, users and institutions. Through analyzes of child protection files, legislative, institutional, discursive evolutions and interviews with social workers, we will seek to understand how did the power reports between the relatives and the professionals carriers of « parentalist » intervention. Referring to the repercussions of the speech of a social regulation device on topics, this study will borrow a similar reading and analysis, in its principles and methods, to what Mr. Foucault has done on prison or sexuality. At the end of the critical analysis, and to overcome the difficulties encountered around new lines of thought, the research will lead to the formalization of recommendations

Full textFiscal reform implemented in Mauritius from 2008 was part of an overall strategy to modernize public finance management that places performance at the heart of public policy-making. Based on a proactive change management, and supported by the extensive renovation of the tax and public procurement systems, changes in budget rules have increased managerial autonomy of the executive. However, assessing the impact of the medium-term budget framework and programme-based budgeting on control over the fiscal position, credibility of the sector allocations and public spending effectiveness highlights the limitations of the reform and calls for a renewed interpretation of the success of the Mauritian model of public management for results. Its originality is strongly related to building a culture of accountability in the public service and institutional choices that are the specific product of a national social and administrative history, helping to impose a political vision of performance in the process of public expenditure rationalization. The simultaneous emergence of extra-budgetary funds management and programme-based budgeting leads to identify a hybrid approach to fiscal reform, whose adaptation to Sub-Saharan African countries may be challenged

Full textAs for the main purpose of water management, water must be rationally managed and protected in a clean and health manner for human and environment. In this sense, we question the current Korean legal regime for water management which is highly fragmented and thus not able to achieve the main purpose of water management. Moreover "conflict" in a term that characterizes the water management approach in Korea. Debates on water management reform are certainly not new in Korea. In fact, previous studies carried out on administrative and legislative aspects of water management emphasize the need for a new legal framework reflecting a paradigm shift towards watershed and participator management associating local governments and residents. Thus, with regard to it, we decided to consider French water management law. From half a century ago, with the Water Act of 1964, France has appraised and integrate administrative aspects of water management at the level of river basins. Regarding to water law, France has undertaken the improvement of its legislation by adopting recognized principles of the international environmental law in water management. Thus, we consider that France's Iegislative effort towards water management could serve as a mode) for Korea's Iegislative research in water law

Full textThis study provides a description and an analysis of the French spoken in Bordeaux and the surrounding communities, based on a corpus of studies following the methodology and the protocol developed within the framework of the Contemporary French Phonology (PFC) Project, developed by Jacques Durand (ERSS, University of Toulouse-Le Mirail), Bernard Laks (MoDyCo, University of Paris X) and Chantal Lyche (University of Oslo and University of Tromsø). Several aspects of the phonology of Bordeaux French are studied, taking into consideration the sociolinguistic diversity of the speakers and the stylistic differences of the linguistic tasks, specifically the Loi de Position for vowels, liaison and schwa. The study detailed here is based on the analysis of audio-recorded interviews of eighteen adults from Bordeaux and the surrounding communities. The participants in this study were interviewed between June and July 2015, according to PFC protocol, and the recordings were transcribed, coded and analyzed by the author, also in accordance with PFC protocol. The speakers were selected in order to represent a balanced diversity in terms of age, sex, level of education, socioeconomic/cultural background, and childhood neighborhood. We observe patterns in terms of the realization of several phonological phenomena. Liaison and schwa are used more in the reading task than in conversation. However, schwa is used the least in the word list. A diachronic analysis reveals that the people from Bordeaux today follow the Loi de Position more than the speakers described in previous research did. We conclude that age is shown to be a statistically significant sociolinguistic factor for this sample of speakers. We also take into account variation in terms of geography, style and chronology. This work contributes to the study of phonological variation in spoken French today

Full textThe physiotherapist profession is officially born on 30 April 1946. From the late 19th century, massage, physiotherapy, gymnastics having entered the field of medicine and the law of 30 November 1892 given doctors a monopoly all care techniques, they will appeal to auxiliary assured they will pre-service training to better control. The War of 1914-1918 "social evil" will ensure the promotion of these empirical methods. The lack of professional masseurs who limited the access to these practices the medical profession will agree to delegate certain auxiliaries. It was not until World War II that a purely authoritarian manner are created medical gymnastics instructor profession and the medical masseur. These texts repealed in 1945, Law No. 46857 of 30 April 1946 designed to regulate the exercise of the medical professions gymnast masseur will create the profession of physiotherapist by giving him the legal monopoly of the massage. Very quickly this monopoly will be challenged and just as quickly the profession will manifest a desire for emancipation in relation to medical supervision. He will have to wait almost a quarter century (1969) to see its main claim result: a third year of study and 60 years for the Council of the Order (2006). The evolution of physiotherapy was, at first, hampered by the hegemonic designs of the medical profession and in a second stage conditional on regulatory harmonization policy allied health professionals conducted by public authorities and by societal choices. Subsequently the evolution of the profession will be affected by the establishment of quotas for access to studies that will encourage a large number of French youth (s) to undertake their studies in countries of the European Union. Subsequently, more and more EU citizens come to work in France. The upheavals on morals appeared in the years 1960-1970, have abolished a number of prohibitions, has upset the mentalities by promoting research of wellbeing. The physiotherapists who discontinued hygienic and aesthetic massage others vindicated. The first were beauticians who eventually win the case (massages to aesthetic purposes) followed by self-appointed wellness massage practitioners that case law has gradually legitimized. The creation of a Professional Order was the source of serious intra professional dissension. In this case, the energy expended was not put on the professional service, but of a certain conception of the latter. The reason has finally prevailed occupation, mainly united, has obtained significant progress symbolized by obtaining a fourth year preceded by a first year of university studies (PACES, STAPS, STC )

Full textSince the enactment of the Clarity Act, which repudiated the validity of the majority rule and the famous maxim "one person, one vote", for the benefit of a so-called "clear" majority, this essay attempts to bring to light the validity and the foundation of the historical 50% + 1 rule, in the event of a referendum by the province of Quebec pursuant to "secede" from Canada. Thereby, by examining either the contemporary as weil as the historical justifications in favor of the majority rule, one ought to examine the different arguments put forward by either side of the political specter and try to interpret them in the context of the Secession Reference, which lead to the adoption of the Clarity Act. Analyzing the recent referendums held around the world, 1 will thereby try to examine the validity ofthe majority rule at the national and internationallevels.

Full textSince April 3rd 2003, the Youth Criminal Justice Act (YCJA) provides police officers with new tools to divert canadian juvenile offenders. Specifically, police officers can officially impose extrajudicial measures to juvenile delinquents instead of handing them directly to the justice system. The current study seeks to determine which characteristics of the offenders and circumstances of the offences significantly impact the decisions of officers to divert cases instead of sending them to the formal justice system. The results are based on three samples of juvenile offence participations recorded by a Canadian police force between 2003 and 2010: the first composed of violent offences (n= 3,482), the second, of proprety offences (n= 8,230) and the third, of other offences (n= 1,974). Multilevel logistic regression analyses were conducted to determine which factors - for example, gender, age, and criminal record of the offender as well as location in time and space of the offence - have a significant impact on police decision-making for each category of offence. Although some factors have similar significant impacts regardless of offence type, others have a differential influence depending on the type of crime that was committed.

Full textThis research project aims to shed light on the social representations of young men who are placed under the Youth Protection Act until their 18th birthday. Representations on services received in relation to preparation for independent living after the end of protective services. At first, we will paint a portrait of the young persons by discovering a little more about the factors that led to an investment of the government until their majority. Then, we try to find out more about the appreciation of services received and the depreciation or simply the factors to improve to help more young people in the same situation as themselves. In this way, we will be able to make assumptions about what would eventually work in the province's Youth Centers to better respond to the needs that are specific to their situations. The topic was explored with the participation of 10 young people between the ages of 16 and 18 with whom we conducted semi-directed interviews.
