AbstractFor more than eighty years there has been controversy about who set the fire that destroyed the plenary chamber of the Reichstag fire on the evening of February 27, 1933—thereby handing the Nazis a pretext to gut the democratic Weimar constitution through the emergency “Reichstag Fire Decree.” Since the 1960s there has been a consensus among historians that the fire was set by Marinus van der Lubbe, a twenty-four-year-old Dutch journeyman stonemason supposedly acting alone—with no Nazi involvement. Few historians, however, have been inclined to investigate the motives behind the development of this single-culprit narrative, or the reasons for its generally positive reception among postwar German historians. With the aid of newly discovered sources, this article examines the legal and political interests that have underpinned this narrative. The single-culprit narrative was developed by ex-Nazis, whereas accounts of the Reichstag fire stressing Nazi complicity came almost invariably from former resistance fighters and victims of Nazism. Postwar historians responded to these accounts in much the same way they have responded to perpetrator and victim accounts of the Holocaust: with a markedly greater preference for those of the perpetrators. This tendency has shaped the debate over the Reichstag fire in the same way it has shaped other areas of research on the Third Reich.

Abstract In dit artikel bespreekt Tuur Marinus de verschillende verschijningsvormen van het unisono in dans. Van affirmatief tot reflexief, van caleidoscopisch tot activistisch: het unisono blijkt vele gedaantes te kennen. De relatie tot machtsstructuren en choreografisch auteurschap staat daarbij centraal. Het gelijktijdig uitvoeren van dezelfde bewegingen wordt politiek wanneer het dominante opvattingen over dans en collectiviteit bevestigt dan wel ondermijnt. Tegen deze achtergrond bespreekt Tuur Marinus zijn choreografisch onderzoek naar de politieke slagkracht van het unisono als assemblage en oxymoron.

Abstract:
Where parties are married in community of property, debts are incurred by the parties and not by the joint estate. Each spouse is liable for debt incurred by either spouse. A creditor is, therefore, entitled to claim from joint estate of both spouses (as co debtors). Such an estate includes not only the spouse's undivided interest in the joint estate but also any and all separate property that falls outside the joint estate. Once the joint estate is sequestrated, both spouses become "insolvent debtors" and consequently the property (including separate property) of both spouses is available to creditors. The lnsolvency Act, as opposed to the Matrimonial Property Act, makes no provision for the recognition or sequestration of 'separate property". Although an estate is sequestrated, it is the debtor who is insolvent. A debtor (married in community of property) who possesses "separate property" is on sequestration of the joint estate insolvent in relation to both his or her undivided interest in the joint estate as well as any "separate property". But is this correct? Ample provision is made by various statutes for the exclusion of certain property from an insolvent estate. Does this not mean that a debtor might be insolvent in relation to one estate and not insolvent in relation to the other? The estate of a partnership is, for purposes of sequestration, deemed to be a separate entity from the partners' private estates. Where the partnership fails, creditors first have recourse against the estate of the partnership where after any shortfall may be claimed from the private estates of the partners. Although the estates of partners are sequestrated simultaneously with the estate of the partnership, creditors of the partnership may not proof their claims against the estate of a partner and vice versa. Is it just and equitable that a spouse who owns separate property is treated differently from a partner who does not possess a separate estate in law from the partnership estate? A partner only has one estate - a private estate that includes his or her interest in the partnership. It is concluded that despite the judgment of the Supreme Court of Appeal in Du Plessis v Pienaar, a sense of dissatisfaction still prevails regarding the status of separate property. It is furthermore suggested that in view of the lack of provisions in the insolvency Act regarding separately owned property, the said Act be amended to provide for the specific exclusion of separate property from an insolvent joint estate. It is more advisable to provide for the exclusion of separate property from the insolvent joint estate than to provide for the simultaneous sequestration thereof.

Abstract:
1. Problem and purpose of this research The modem industry shows a progressive ageing workforce (Hale, 1990: 15- 17; Warr, 1993:238; De Swart et al., 1995:l; Shephard, 1997:325). This trend relates to workers that do not possess the necessary physical ability required by the work tasks (Bernauer & Bonanno, 1975%'; Fraser, 1992: 1). Several researchers (Hale, 1990: 16; WGO, 1993:l; Ilmarinen et al., 1997:55; Shephard, 1997:333) regard this physical inability of workers to perform physical intensive tasks as an important contributor to the increase in work related injuries. Employers implement several programs and procedures to ensure the health and safety of workers and to improve productivity. One of these procedures is evaluating the physical ability of workers according to the demands of their work tasks which is called task profiles (Fraser, 1992:l). The aim of this study was firstly to determine the extent to which the physical ability of workers differ from their task profile demands and secondly to determine the effect of ageing on the physical ability and task profiles of workers. 2. Method of research The study was performed on all male workers (3676 participants) performing physical demanding tasks in an electricity supply company in South Africa. The workers were assessed according to the physical task profiles developed by the company for all workers performing physical demanding tasks. These physical components were: flexibility, cardio-respiratory endurance, grip muscle strength, leg muscle strength, back muscle strength; arm-/shoulder muscle strength and abdominal muscle endurance. Each one of the workers' assessed was compared to the minimum requirement of his task profile for all eight physical parameters to determine if his physical ability met the requirement of the task demands. The workers were further grouped into 4 age groups namely: younger than 35, 36-45, 46-55 and older than 55 years to determine if ageing has an impact on the physical ability of workers to meet the requirements of their task profiles. Statistical analyses were performed using one way analysis of variances (ANOVA) and the measurements of Cohen to determine practical significance (Thomas & Nelson, l99O:l34). 3. Results The following is a summary of the results found: 3.1 The average physical ability of workers for each of the physical parameters does not significantly differ from their task profile demands. However, leg muscle strength, back muscle strength and abdominal muscle endurance had the highest number of workers that do not meet the requirements of their task profiles. None of these physical parameters, however, differed practical significantly from the task profile demands. 3.2 A practical significant number of workers had at least one physical parameter not meeting the task profile demand. 3.3 Workers could be identified with an accumulative number of their physical parameters not meeting the task profile demands. Even workers with all eight physical parameters weaker than the task profile demands, could be identified. 3.4 Most of the physical parameters weakened with ageing of the workers. Grip muscle strength, back muscle strength and abdominal muscle endurance showed practical significant deterioration with ageing, while arm-/shoulder, and leg muscle strength showed a moderate effect with ageing (practically not significant). Flexibility and cardio respiratory endurance where not affected with ageing. 3.5 The percentage of workers whose physical parameters did not meet their task profile demands increased with ageing. Irrespective of these relationships abdominal muscle endurance was the only physical parameter that showed a practical significant weakening with ageing. It is thus evident that in most instances ageing has no significant effect on the physical ability of workers according to their task profile demands. 3.6 Linear effects were observed between the accumulative number of physical parameters that did not meet the task profile demands and ageing. These effects were, however, not practical significant but did indicate an increase in the number of workers with more than one physical parameter that did not meet their task profile demands with the increase in age.

Abstract:
This study uses the Tibetan mandala, a Buddhist meditation aid and sacred artform, as a secular critical model by which to analyse the complete fictions of author David Mitchell. Discussing his novels, short stories and libretti, this study maps the author's fictions as an interconnected world-system whose re-evaluation of secular belief in galvanising compassionate ethical action is revealed by a critical comparison with the mandala's methods of world-building. Using the mandala as an interpretive tool to critique the author's Buddhist influences, this thesis reads the mandala as a metaphysical map, a fitting medium for mapping the author's ethical worldview. The introduction evaluates critical structures already suggested to describe the author's worlds, and introduces the mandala as an alternative which more fully addresses Mitchell's fictional terrain. Chapter I investigates the mandala's cartographic properties, mapping Mitchell's short stories as integral islandic narratives within his fictional world which, combined, re-evaluate the role of secular belief in galvanising positive ethical action. Chapter II discusses the Tibetan sand mandala in diaspora as a form of performance when created for unfamiliar audiences, reading its cross-cultural deployment in parallel with the regenerative approaches to tragedy in the author's libretti Wake and Sunken Garden. Chapter III identifies Mitchell's use of reincarnation as a form of non-linear temporality that advocates future-facing ethical action in the face of humanitarian crises, reading the reincarnated Marinus as a form of secular bodhisattva. Chapter IV deconstructs the mandala to address its theoretical limitations, identifying the panopticon as its sinister counterpart, and analysing its effects in number9dream. Chapter V shifts this study's use of the mandala from interpretive tool to emerging category, identifying the transferrable traits that form the emerging category of mandalic literature within other post-secular contemporary fictions, discussing works by Michael Ondaatje, Ali Smith, Yann Martel, Will Self, and Margaret Atwood.

Abstract:
The aim of this study is to discover the process of South Africa's emancipation from her British connection between 1 931 and 1 939. The writer chose the political and constitutional aspects of this theme as focal points. In order to establish a clear picture in describing this process, it was necessary to trace South Africa's British connection to its origin. A line is thus drawn from the early nineteenth century to 1930 to illustrate the clash between British imperialism and Afrikaner nationalism. While L. Botha and J.C. Smuts favoured the British connection, J.B.M. Hertzog believed that South Africa had the right to secede from the British empire. Botha and Smuts founded their policy on the belief that it was South Africa's honour and duty to be a member of the British Commonwealth and to assist Britain. However, Hertzog's slogan, South Africa First, lay the foundation for nationalists' desire to emancipate South Africa from her British connection. The dispute on the question of South Africa's emancipation from the British connection was centred around the following three questions: was the British crown divisible, did South Africa have the right to secede from the British Commonwealth and could she remain neutral in a British war? Up to 1926 imperialists and nationalists clashed head on in claiming respectively to uphold the British connection and to emancipate from it. After the Balfour declaration of 1926, when dominium’s and Britain got on equal footing with their status, Hertzog laid constitutional disputes aside. Secession, according to him, was no longer an issue. From 1926 he focused on a policy that Botha once lay down namely, the conciliation of Afrikaans and English cultures. Hertzog's firm belief that secession was not a practical political issue, together with his belief that Smuts had accepted his slogan of South Africa first, saw home fusion between the two leaders. This caused Malan and his nationalist followers to break away and form the Purified National Party. They believed that by fusion the British connection was greatly strengthened. The Status Laws of 1934 partially integrated the 1 931 Statute of Westminster. Thus it was generally accepted that South Africa had her own king, the right to secede from the Commonwealth and the right to be neutral. These laws caused a few SAP members, with Stalled as their leader, to split and form the Dominium Party. Fusion only lasted five years. In 1939 a second World War put the solidarity of the United Party to test. Hertzog's neutrality motion was defeated by Smuts and his followers. Once again South Africa was tied up on Britain's side.

Although the need for and importance of self-directed learning are well documented, studies reporting on the influence of teaching–learning strategies, fostering self-directed learning skills, are limited. The aim of this investigation was to determine and understand the impact of the implementation of cooperative base groups on the self-directed learning readiness of first-year Life Sciences students. In order to achieve the research aim, a mixed method approach was followed. During the quantitative phase, the Self-Directed Learning Readiness Scale, a cooperative base group perception questionnaire, a checklist for social skills, and the academic achievement of first-year Life Sciences students at the Potchefstroom Campus of the North-West University were analysed. In the qualitative phase of the investigation, semi-structured interviews were conducted with randomly selected first-year Life Sciences students of the experimental group. The questions in the interviews were aimed at determining the students‟ perception of cooperative base groups, how this perception contributed to their self-directed learning competencies, as well as the role that active involvement, the cooperative base group folder and personal support play in the development of self-directed learning competencies. The results of the investigation contribute to the body of knowledge on cooperative learning as it provides insight into how students experience cooperative base groups. The implementation of cooperative base groups contributes to the development of the following characteristics and skills, which are vital for becoming self-directed in one‟s learning: viewing peers as resources; being able to give and receive help; developing good social skills; being motivated to learn; and taking initiative and responsibility for learning.

Abstract:
South Africa and the rest of the world currently face an exacerbating threat of environmental degradation, which can be partly ascribed to the fact that some parts of society still place economic growth as a priority over environmental conservation. This study shows that such an approach is only profitable over the short term and actually causes more harm than good. On the other hand, the world is still recovering from the major 2008 global financial crisis. To tip the scale back into balance, it is crucial that economic -, social -, and environmental development be sustainable; from now and into the future. This study recognises that, to achieve sustainable development at all three levels, a transition to a green economy is needed. In essence a green economy requires investment in the environment for the benefit of both society and the economy. This study then goes on to show that ecotourism can be used as a manner to invest in the environment, whilst at the same time uplifting society and improving the economy. Subsequently it is identified as a key driver of a green economy. However, a daunting reality is that ecotourism developments and - activities also threaten the environment. This study therefore argues that ecotourism has to be regulated effectively; otherwise it will not live up to its purpose and may, as a result, curtail South Africa’s efforts of a transition to a green economy, instead of positively contributing to it. This study asks the question: Does South Africa’s environmental legislation provide for the effective regulation of ecotourism? This question is answered by considering whether various relevant pieces of national environmental legislation measure up to certain criteria that is inherent to the effective regulation of ecotourism. Finally this study serves to show that; from an environmental law perspective, and to the extent that this study investigated the ecotourism environment, ecotourism as a phenomenon is regulated effectively in South Africa. However, it appears that there still remains tremendous scope for improvement.
