Abstract:
Current proposals to promote and strengthen marriage among low-income populations focus on values and behavioral skills as primary targets of intervention. Marital research that examines contextual influences on marriage calls these emphases into question. Ethnographic and survey research reveal no evidence that populations experiencing higher rates of divorce value healthy marriages any less than other populations do. Longitudinal and observational research reveals two mechanisms through which the environment of a marriage may enhance or constrain effective relationship maintenance. First, some environments contain fewer sources of support and pose more severe challenges than others, presenting marriages in those environments with greater burdens than marriages in more supportive environments are faced with. Second, when demands external to the marriage are relatively high, even couples with adequate coping skills may have difficulty exercising those skills effectively. Together, such findings suggest that successful policies and interventions to strengthen marriages need to acknowledge the environments within which marriages take place.

Abstract:
This article explores the Law Commission's proposals on how and where people can get married in England and Wales as found in their ‘Getting Married’ Consultation Paper. It examines the extent to which the Commission's proposals will deal with or mitigate concerns expressed about two types of non-qualifying wedding ceremonies: ‘unregistered religious marriages’ where the couple undergo a religious ceremony that does not comply with the requirements of the Marriage Act 1949, and ‘non-religious marriages’ where the ceremony is conducted by celebrants representing a belief organisation (such as Humanists UK) or by independent celebrants and so is also outside the Marriage Act 1949 and not currently legally binding. The article largely welcomes the Commission's proposals but expresses concern about the proposed officiant system and how it defines belief organisation; the proposed changes to the law on validity; and the creation of a new criminal offence. The article develops these three points further and contends that, while a transformed weddings law could recognise non-religious marriages and reduce the number of unregistered religious marriages, the introduction of statutory cohabitation rights upon separation is needed to truly deal with concerns over unregistered religious marriages.

Abstract:
This research is based on the unique phenomenon of the myth of rejecting marriage proposals in Madura, which reflects the complex dynamics between Islamic values and local culture. This study aims to explore the meaning and interpretation of the myth and understand the relationship between Islamic education and local culture in the context of rejecting marriage proposals. The research method is qualitative and hermeneutic perspective with an in-depth interview approach with religious and community leaders, document studies to analyze local literature, and participatory observation to gain a direct understanding of social and cultural norms. The results showed that the hereditary belief of the ancestors, believed by her descendants, was that if a girl rejected her first proposal, she was believed to be exposed to reinforcements, which meant that she would have difficulty in finding a mate. This is influenced by the social dynamics, culture, and religious values of Islam. These findings reveal thematic patterns that illustrate the complex interplay between religious values and local traditions, providing a deeper understanding of the norms that shape of rejecting marriage proposals rejection in Madura. Islamic education plays a crucial role in shaping the moral and ethical foundations that influence decisions regarding marriage. The integration of local religious and cultural values in Madura is also seen through myths and hereditary beliefs regarding the rejection of proposals.

Abstract:
A marriage proposal, or 'meminang' in Indonesian, is a promise a man makes to marry a woman he proposes to. This promise is subject to cancellation due to various factors, either from the man or the woman. However, according to the prevailing customs in Aceh, Indonesia, when a marriage proposal is canceled, the party responsible for the cancellation is subjected to customary sanctions. This research explores the forms of customary sanctions imposed for the cancellation of marriage proposals and examines their compatibility with the concept of 'Mashlahah Mursalah' (public interest). This study employs a qualitative method with an empirical juridical approach. The findings reveal that customary sanctions for canceling a marriage proposal involve the forfeiture of the gold given as a symbol of the bond if the man initiates the cancellation. On the other hand, if the cancellation is initiated by the woman, the gold must be returned twofold. The 'pinangan' gift is considered a non-refundable grant in case of cancellation, regardless of whether the man or the woman initiates it. However, when evaluating the customary sanctions for canceling marriage proposals in light of Mashlahah Mursalah, they are deemed invalid as they contravene several principles of Mashlahah Mursalah, including conflict with the consensus of scholars regarding the law of dowry, contradicting the evidence from the Quran and Sunnah regarding the prohibition of unlawfully taking others' property, and negating greater public interest while opening the door to potential harm.

Abstract:
Although the Recognition of Customary Marriages Act 120 of 1998 (RCMA) contains provisions to ensure equality between the spouses in a customary marriage, the RCMA has serious deficiencies that are detrimental to the weaker party in customary marriages. To rectify the deficiencies in customary marriages and other relationships, the South African Law Reform Commission (SALRC) and the Department of Home Affairs (DHA) are conducting simultaneous investigations into South African marriage law. This article critically discusses the proposals of the SALRC and the DHA to determine whether the proposed legislation will address the current deficiencies in the RCMA. As an alternative to the proposals of the SALRC and the DHA, the deregulation of customary marriages is advanced as a solution to the inequitable position of spouses in customary marriages under the RCMA. isiNdebele: Nanyana umThetho wokwAmukela imiTjhado yesiNtu we-120 ka-1998 (Recognition of Customary Marriages Act (RCMA)) umumethe iindinyana zokuqinisekisa ukulingana phakathi kwabalingani emtjhadweni wesintu, i-RCMA inokutlhayela okukhulu okulimaza ihlangothi elibuthakathaka emitjhadweni yesintu. Abstract:
This article, based on original research from 57 villages in four provinces from North and East India, sheds light on a hitherto unexplored gendered impact of colorism in facilitating noncustomary cross-region marriage migrations in India. Within socioeconomically marginalized groups from India’s development peripheries, the hegemonic construct of fairness as “capital” conjoins with both regressive patriarchal gender norms governing marriage and female sexuality and the monetization of social relations, through dowry, to foreclose local marriage options for darker-hued women. This dispossession of matrimonial choice forces women to “voluntarily” accept marriage proposals from North Indian bachelors, who are themselves faced with a bride shortage in their own regions due to skewed sex ratios. These marriages condemn cross-region brides to new forms of gender subordination and skin-tone discrimination within the intimacy of their marriages, and in everyday relations with conjugal families, kin, and rural communities. Because of colorism, cross-region brides are exposed to caste-discriminatory exclusions and ethnocentric prejudice. Dark-skin shaming is a strategic ideological weapon employed to extract more labor from them. The article extends global scholarly discussion on the role of colorism in articulating new forms of gendered violence in dark-complexioned, poor rural women’s lives.

Abstract:
The purpose of this study is to identify the phenomena of marriage proposals rejection among working and non-working women. It is hypothesized that there is significant difference in self esteem, body image and self consciousness of working and nonworking women after rejection of marriage proposals. The sample was comprised of (N=170) women from which (n=79) was working women and (n=91) was nonworking women. Sample was recruited by using snowball sampling technique. Mix method research design was used in this study. The major tools of this study include Rosenberg Self-Esteem Scale (SES) by Rosenberg (1965), Body Image Scale (BIS) by Moeen, Muazzam & Zubair (2013) Self-consciousness Scale revised (SCS-R) by Scheier & Carver (1985). The findings showed that body image, proposals rejected by self, number of siblings, younger married sisters, low designation and old age are a predictor of proposals rejection faced by women. The other findings revealed that there is non-significant difference in self esteem, body image and self consciousness among working and non-working women after rejection of marriage proposals. It was also explored that there was non-significant relationship in self esteem, body image and self consciousness among women.

Keuer, Andrew J. "The mysteries of order and agonism in late modern conjugal-sexual ethics : an Augustinian proposal in conversation with William E. Connolly." Thesis, University of Aberdeen, 2015. http://digitool.abdn.ac.uk:80/webclient/DeliveryManager?pid=228638.

Full text
Abstract:
This thesis provides a constructive theology of Christian marriage rooted in an Augustinian Trinitarian grammar of order. In conversation with a contemporary agonistic ethicist, William Connolly, I identify sensibilities in the Augustinian tradition that I argue need reemphasis in late modern times. Section One consists of three chapters, each of which analyzes William Connolly's interpretation of the biblical texts that he engages to contest an “Augustinian” reading which projects a natural order that promises to attune self and society. In chapter one I look at Connolly's ethic of self-formation that emerges from his sower parable, detailing the relation between the cultivation of the self, marriage, and sexuality in late modernity. Chapter two turns to Connolly's reading of the Edenic narrative, attending to his normative ethic of responsibility to the agon that offers strategies for inverting gender hierarchy that he claims Augustine reifies. Chapter three focuses on the biblical book of Job through which Connolly argues that Augustinian apophatic order produces an inferior ethics of compassion in comparison to an ontology of fugitive abundance. Section Two of the thesis shifts focus to two groups of Augustine's writings: the Cassiciacum dialogues and Confessions (with contemporaneously published treatises on marriage and celibacy). Chapter four finds an early Augustinian ecclesiology at Cassiciacum in which a community inclusive of contemplative and domestic forms of life together become a mode of indirect contemplation of the Triune God who orders all things. In chapter five, I interpret Augustine's famous conversion narrative in Book 8 of Confessions, claiming his learning to “read” the sacred sign of marriage in the Milanese catholic church was essential to his exercising faith in the Incarnate Son.

Alani, Aniz. "In search of a marriage counsellor : a proposal for strengthening the enforcement of Canadian constitutional conventions as legal rules of political behaviour." Thesis, University of British Columbia, 2017. http://hdl.handle.net/2429/61468.

Full text
Abstract:
Canada’s constitutional framework consists of both written and unwritten sources. Within the subset of unwritten constitutional sources lies the body of constitutional conventions: rules of political morality that limit the scope of behaviour that would otherwise be legally permitted. Conventions are established by precedents and understood by political actors to be binding upon them. But the orthodox view holds that they are beyond the purview of the legal system and enforceable exclusively within the political realm. This thesis proposes measures for more effective regulation of political behaviour for compliance with constitutional conventions. These proposals are inspired by Prime Minister Stephen Harper’s announcement in 2014 that he would refrain from advising the Governor General to fill vacancies in the Senate of Canada. By convention, the Governor General only exercises the legal power to appoint Senators on the Prime Minister’s advice. Challenging the constitutionality of the Prime Minister’s conduct therefore implicated constitutional conventions. The author describes a judicial review application brought for this purpose as an illustrative example of the impracticality of litigation to enforce constitutional conventions. Drawing on that experience, he argues that Canadian jurisprudence ought to be renovated to accommodate and accept conventions as legally cognizable and enforceable rules. He further proposes the creation of an independent officer of Parliament accountable for monitoring political behaviour for compliance with constitutional conventions and drawing public attention to situations where conventional rules are breached.

I am interested in family secrets and the rules and mores that may constrain family behavior or adversely affect a member’s destiny. I make work that looks askance at the efforts to hide from the world those events or secrets that reflect badly on a family. I look at the places where I have discovered some of them: family furniture and objects around the house, which can shed, metaphorically, the secrets and stories that are part of family tradition. I focus light on the lives of my uncelebrated ancestors and bring them, however briefly, into the collective consciousness.

Hoplock, Lisa. "Will she say yes? A content analysis of accepted and rejected marriage proposals." Thesis, 2016. http://hdl.handle.net/1828/7406.

Full text
Abstract:
Proposing marriage is one of the few rituals that many people engage in world-wide, and yet many aspects remain a mystery. For example, there is currently no research on rejected marriage proposals, despite their potential impact on the self and well-being. The purpose of the present research was to compare and contrast rejected and accepted marriage proposals. Because the traditional proposal script is well known in Western society, I hypothesized that all proposals would be high rather than low in traditionalism. But, men whose proposal is rejected may not know that women prefer private proposals (Hoplock, 2015), and so I hypothesized that rejected proposals would be more likely to occur in public compared to accepted proposals. Additionally, I hypothesized that couples would distance themselves from each other during rejected proposals. I also predicted that couples would remain close to each other during accepted proposals compared to during rejected proposals. Finally, I hypothesized that couples experiencing rejected proposals would be less likely to talk about marriage in advance than couples experiencing accepted proposals. I tested these hypotheses in two studies. I conducted a content analysis of 285 marriage proposal videos (36 rejected proposals, 249 accepted proposals; Study 1), and of 374 first-person written accounts of marriage proposals (180 rejected proposals, 194 accepted proposals; Study 2). Trained coders rated the proposals for traditionalism (e.g., offering a ring), the presence of others, and couple members’ approach and avoidance goals. I also used inductive coding to derive themes from the data. Additionally, in Study 2, trained coders noted men’s motivation for proposing and women’s reasons for their response, the relationship status before and after the proposal, and whether couples discussed marriage in advance of the proposal. In Study 1 but not Study 2, proposals were high rather than low in traditionalism. In both studies, rejected proposals were less traditional than accepted proposals. Some traditional behaviors were particularly strong as distinguishing between proposals: The odds of a proposal being accepted were 8 – 20 times higher if the proposer presented a ring. Expectedly, rejected proposals were more likely to occur in public than accepted proposals. Moreover, women were particularly affected by the proposal, distancing themselves from their partner during rejected proposals and drawing close to their partner during accepted proposals. Providing insight into the proposers’ motivations, men often proposed for reasons such as a desire to commit to their partner, but, unlike men whose proposal was accepted, men whose proposal was rejected were also likely to propose out of desperation. Furthermore, women most commonly declined a proposal because they thought they were too young or not ready to get engaged. Unfortunately, some of the heartache of rejected proposals may have been avoided if the couple members had discussed marriage in advance: Only 29% of couples experiencing rejected proposals discussed marriage in advance, compared to 100% of couples experiencing accepted proposals. The rich nature of this data brings to life the proposal experience and highlights many potential directions for future research.

Agharazi, Hoda. "Why Say No? : Marriage Proposal Rejections in Jane Austen’s Pride and Prejudice and Charlotte Brontë’s Jane Eyre." Thèse, 2019. http://hdl.handle.net/1866/23721.

Abstract:
This thesis studies the purpose of multiple marriage proposals in Jane Austen’s Pride and Prejudice and Charlotte Brontë’s Jane Eyre. I will show that Austen’s and Brontë’s inclusion of two proposals – by Darcy and by Rochester, respectively – are central to the narrative structures of their work. I will examine how Austen and Brontë present their heroines with multiple proposals in order to demonstrate the proper moment at which a proposal should be accepted. This thesis will contextualize the choices of Elizabeth Bennet and Jane Eyre by engaging in conversation with several literary scholars who work on Austen and Brontë. The first chapter will be dedicated to Austen’s Pride and Prejudice, and the analysis of Darcy and Elizabeth’s changing relationship. The second chapter will examine Brontë’s Jane Eyre and Jane’s individual journey as it relates to her relationship with Rochester. I will also examine how each author demonstrates how gender roles and stereotypes can serve as a threat to a healthy relationship as well as to one’s own self-development. Through multiple proposals, Austen and Brontë demonstrate the importance of independence and equality in entering a marriage. They also dismantle traditional notions of masculinity.

Abstract:
ABSTRACT The research proposes the building of half a house akin to historic ‘back-to-back’ housing, withthe remaining ‘half’ built over the remaining lifetime of the owner, providing versatile andadaptable room and spaces for the life changes of the owner. The method is based on a uniqueAutodesk Generative Design defi nition providing a multi-objective design generation algorithmfor creating design iterations for the unbuilt future ‘half’. Each homeowner is able to then navigatethe thousands of design options generated to evaluate the potential cost of changes to the fabric(linked to the SPONS cost guide) of the house based on their individual lifetime changes; marriage, children, illness, dementia etc., to improve forward fi nancial planning. The work evaluates theeff ectiveness of the algorithm output through a series of comparisons with established ‘lifetimehome’ case studies. Abstract:
The instrumentarium of this research is based upon the achievements of interpretive anthropology by C. Geertz and includes a number of our developments implemented within the concept of ethicizing mythological consciousness (a special component of the interdisciplinary system of four concepts which is being developed by us). These developments include: a) eight fundamental principles of Jewish upbringing which are implicit principles of upbringing (view of life, behavior) according to the Decalogue and are based on the concept of man and the Universe represented in the Ten Commandments; b) an interpretive ethnological model “The Decalogue and Harmonizing Hermeneutic Maxims of Obligatoriness: An Aspect of Upbringing.” The narratives by Raisa Lvovna Gandelman, born in 1903 in Chisinau, serve as materials for the study. Raisa Lvovna’s childhood and youth memories about the way her mother was treating her when the girl was sick, Ruhele’s recollections of her father, a proposal of marriage made to her at the age of seventeen, etc., are analyzed. The revealed hermeneutic maxims are identified as ethnocultural specificity of shaping the epoch of “new humanism in the 21st century” (UNESCO).
