Available data indicate that marital rape impacts the health and safety of women in much the same way as rape by a stranger. This chapter argues in favour of recognizing marital rape as a crime in India, by rebutting the forcefully held misconceptions that continue to be put forth as justifications for exempting marital rape as a criminal offence. The institution of marriage as a sanction for sex completely disregards the consent of the wife. This has the effect of condoning acts in the nature of domestic violence and must be recognized as a form of gender discrimination that negates the dignity, personal autonomy, and bodily integrity of married women. Analysis of existing legal provisions on spousal sexual violence under the PWDVA have been analysed to assess the scope of legal remedies available for marital rape.

This chapter considers the main arguments raised by conservatives against same-sex marriage and gay rights more generally. Defenders of same-sex marriage acknowledge the fact that marriage is in many ways a conservative institution. Libertarians, liberationists, and some liberals doubt that marriage is fair given the diversity of people's conceptions of meaning and value in life. Many adopt an unnecessarily critical posture toward civil marriage. This chapter offers a sympathetic account of marriage that recognizes the importance for many people of marital commitment while also honoring, and indeed helping to secure, the equal liberty and fairness prized by liberals. It shows that the debate over gay rights has been shaped by the repeated articulation of a demand for public reasons and evidence to justify the shape of the law touching on gay rights and marriage. The demand for reasons was laid down by the dissenters in Bowers v. Hardwick (1987).

The marriage institution with its complexity is not exempted from conflict. In the world where emphasis is on conflict resolution, the Efik people speak of marital conflict prevention more than conflict resolution and management. Marital conflict if not prevented or resolved can become inimical to both present and future generation apart from its fire engulfing the entire community. Though female circumcision (which is associated with Nkuho) has been abolished, it is the opinion of this chapter that the educational spirit behind this institution is still a veritable too in preventing marital conflict. The chapter made use of ethno-methodological approach with content analysis to aver that in preventing marital conflict among Efik people, Nkuho institution can be a veritable tool of conflict prevention and peace building. This work has shown that Nkuho institution has something positive to offer to the modern world, especially as it concerns marital conflict prevention.

While the archival records reveal little about the psychology of criminals and criminality, they do shed important light on the identities and personal backgrounds of bandits. In Chapter 7 the author examines the social composition of members of bandit gangs and sworn brotherhoods: age, marital status, geographic mobility, and occupations. Significantly, and contrary to the usual interpretation of banditry in the scholarly literature, the evidence from Guangdong demonstrates that banditry was not merely an occupation of younger men but also of older, more mature adults, many of whom were married with families. Most convicted bandits and brotherhood members came from China’s laboring poor, those individuals who were highly mobile, lived on the fringe of respectable society, and earned only a subsistence living. The fact that such a large number of bandits and brotherhood members were mature working family men suggests that they turned to crime in times of desperation or as a necessary supplement to honest work. Unemployment and chronic underemployment, the author maintains, forced many among the working poor to commit crime; stealing became an important, though normally only occasional, part of their livelihoods and life cycles.

The Sex Discrimination Act as originally drafted only prohibited discrimination on grounds of sex and marital status. However, civil partners are now treated in the same way as married people. Transgender people, who live as someone of the opposite gender, are protected from discrimination. They can also change their birth certificates so that their new gender is reflected there. Pregnant women have a right not to be discriminated against, and this is a free-standing right. People are entitled not to be discriminated against because of their sexual orientation. The prohibition against sex discrimination covers heterosexuals as well as homosexual people.

This chapter examines the legal issues faced by transgender people in divorce and child custody cases. Despite trans people’s increased visibility, and gains in legal rights and protections, many people—including judges—continue to harbor misconceptions about transgender people. Attorneys representing transgender clients must anticipate the possibility of judicial bias and take proactive steps to address it. Attorneys must be prepared for the unique legal issues that arise when a spouse transitions during an existing marriage. Even under modern “no-fault” divorce regimes, attorneys must be prepared to rebut the claim that coming out as transgender constitutes misconduct or justifies awarding the other spouse more marital property or spousal support. Abstract:
This paper reports on a social survey that was conducted in 2001 in Central Queensland, Australia, in order to identify the disadvantaged groups in relation to accessing the Internet from home. The research found that people in younger age groups, with higher education levels, being married , having children at home, owning a house/flat, with the higher income level, or being employed, had higher levels of Internet access from home respectively, compared to their counterparts.
