Cette thèse se concentre sur le problème de la forme juridique dans la période de jeunesse de Marx (1835-1844). En analysant le développement de ses réflexions philosophico-politiques, on cherche à montrer la centralité des discussions sur le droit dans les premières périodes de la pensée marxienne. Ce travail est organisé comme suit : 1) une introduction générale au problème du droit chez Marx avec une analyse de ses premiers écrits (ses lettres d’étudiant et sa thèse doctorale) ; 2) un premier chapitre sur le rapport entre philosophie, politique, droit et publicité dans la Rheinische Zeitung (1842-43) ; 3) un deuxième chapitre autour du Kreuznacher Manuskript (1843) qui analyse la critique de Marx à Hegel et à l’État moderne comme une condition d’une « vraie démocratie » qui ferait de la Loi et la Constitution des fonctions sociales et expressives du demos ; et 4) un troisième chapitre sur les textes des Deutsch–Französische Jahrbücher (1844), où, sous l'influence de la pensée socialiste française et à l'horizon d'une future révolution radicale du prolétariat, Marx condense sa critique de l'émancipation politique moderne, de ses droits de l'homme et de sa forme abstraite de société. Avec tout ce mouvement, on propose d'inscrire le problème théorique-politique du droit dans un diagnostic général des pathologies de la modernité politique et des différentes solutions proposées par Marx pour les surmonter. Dans son ensemble, cette thèse vise à montrer le déplacement de la pensée marxienne de jeunesse dès la philosophie politique moderne vers une nouvelle pensée du social<br>The following dissertation deals with the problem of the legal form in the early writings of Karl Marx (1835-1844). Through an analysis of the development of Marx’s politico-philosophical reflections I seek to show the centrality of the discussion of the law in the early periods of his thought. This work is organized as follows: 1) an introduction based on the problem of law in his first works (his letters as a student and his doctoral thesis); 2) a first chapter that deals with the relation between philosophy, politics, law and the public sphere in the journalistic articles published in the Rheinische Zeitung (1842-43); 3) a second chapter about the Kreuznacher Manuskript (1843) that introduces Marx’s critiques to Hegel and the modern state as condition for a ‘true democracy’ that would make of the Law and the Constitution social and expressive functions of the demos; 4) a third chapter about the texts in the Deutsch–Französische Jahrbücher (1844), where, under the influence of French socialist thought and the horizon of a future radical revolution of the proletariat, Marx synthesizes his critique of modern political emancipation, the rights of men and their abstract form of society. Following this path I seek to inscribe the politico-theoretical problem of the law within Marx’s general diagnostic of the political modernity, its pathologies and the different possible solutions proposed by Marx to solve them. Overall, this dissertation aims to show the movement of Young Marx’s thought from modern political philosophy towards a new form of thinking the social<br>La siguiente tesis aborda el problema de la forma jurídica en los textos del período juvenil de Marx (1835-1844). Analizando el desarrollo de sus reflexiones filosófico-políticas buscamos mostrar la centralidad de las discusiones sobre la ley en el temprano pensamiento marxiano. El trabajo consiste en: 1) una introducción al problema del derecho en Marx a partir de sus primeros escritos (sus cartas de estudiante y su tesis doctoral); 2) un primer capítulo sobre la relación entre filosofía, política, derecho y publicidad en los artículos periodísticos de la Rheinische Zeitung (1842-43); 3) un segundo capítulo sobre el Kreuznacher Manuskript (1843) que presenta las críticas de Marx a Hegel y al Estado moderno como condición de una "verdadera democracia" que haría de la Ley y la Constitución funciones sociales expresivas del demos; y 4) un tercer capítulo sobre los textos de los Deutsch–Französische Jahrbücher (1844), donde, bajo el impacto del pensamiento socialista francés y en el horizonte de una futura revolución radical del proletariado, Marx condensa su crítica de la emancipación política moderna, sus derechos del hombre y su forma abstracta de sociedad. En este recorrido nos proponemos inscribir la problemática teórico-política del derecho dentro de un diagnóstico marxiano general de la modernidad política, de sus patologías y de las distintas soluciones propuestas de Marx para superarlas. Notre propos initial mis en oeuvre dans le tome I de la thèse, éléments pour penser la thématique du conflit dans la pensée occidentale, était de savoir lire au plus près la section A du chapitre IV de la Phénoménologie de l'esprit, de comprendre ce que très précisément Hegel entendait par combat pour (de) la reconnaissance, par rapport de la maîtrise et de la servitude, par conscience de soi universelle. Nous avons cherché à rendre intelligible le thème hégélien d'un conflit originel constitutif de la formation de la conscience de soi libre par une mise en connexion des sept versions hégéliennes du combat pour (de) la reconnaissance de 1802 à 1830, par une détermination en amont de l'écart entre la thématique hégélienne et le statut du conflit chez Platon et Aristote (stasis et polemos), le statut de '"l'état de guerre" inhérent à l'état de nature chez Hobbes et Rousseau, en mettant, en aval, à l'épreuve la force de résistance du texte hégélien vis-à-vis de la critique Marx-Engelsienne, de la généalogie nietzchéenne, de la métapsychologie et de la psychanalyse freudiennes. Dans nos deux livres, pour lire Hegel et Marx, retour sur le jeune Marx, et dans le tome III, nous avons déplacé notre problématique en cherchant à repenser cela même qui avait été pensé par Marx en déséquilibrant son texte par la lecture de Hegel, de ce qui l'avait été par Hegel en déséquilibrant le texte de celui-ci par la lecture de Marx. Nous avons proposé de définir le "renversement" de Hegel par Marx comme métaphore de l'acte de démétaphorisation, l'effort pour dire au propre ce qui avait été dit au figuré. Cependant, par-delà la critique marxienne de l'inconséquence ou de l'illusion du philosopher hégélien sur le rapport entre droit politique et droit abstrait, sur l'histoire en tant qu'histoire de l'esprit, nous avons montré en quoi Marx restituait un droit de cité théorique postcritique à la conceptualité hégélienne<br>My initial aim, when writing the first volume of my thesis, the them of conflict in Western thought, was to read as closely as possible section A of chapter IV of the Phenomenology of Spirit, to understand precisely what Hegel meant by struggle for (or of) recognition, relation of lordship and bondage, and by universal self-consciousness. I have tried to make intelligible the hegelian thesis of an original conflict, constitutive of the formation of free self-consciousness. I did this via connecting the seven hegelian versions of the struggle for (of) recognition written between 1802 and 1830, initially by a determination of the discrepancy between Hegel's thematics on the one hand, and, on the other, the status of conflict in Plato and Aristotle (stasis and polemos) and of the "state of war" inherent within the state of nature in Hobbes and Rousseau. Subsequently, I tested the degree of resistance of the Hegelian text vis-à-vis Marx and Engel's criticism, Nietzsche's genealogy and Freud's metapsychology and psychoanalysis. In my two books, Hegel and Marx, and in volume III, I have shifted the focus of my problematic, attempting ti rethink what had been thought by Marx, unbalancing his text by the reading of Hegel, and what had been thought by Hegel via the reading of Marx. I have suggested to define Marx's "inversion" of Hegelas a metaphor of the act of demetaphorisation, that is as the endeavour to say litteraly what had been said figuratively. On a longtemps débattu de la théorie du reflet en imputant à Marx la thèse que la connaissance serait une image adéquate de la réalité objective. L'analyse de ce débat, qui débute avec Engels et Lénine et se poursuit jusqu'à aujourd'hui, permet et exige qu'on revienne sur l'usage propre que fait Marx des notions de reflet et d'image dans le cadre d'une réflexion plus générale sur la représentation. Cette réflexion le conduit d'une polémique contre les conceptions hégéliennes et jeunes-hégeliennes à la construction du concept d'idéologie, désignant la formation et la fonction sociales des représentations dans le cadre de la lutte de classes en mode de production capitaliste. Soulignant le dynamisme propre de ces représentations, Marx surmontera les tensions inhérentes à sa catégorie d'idéologie en étudiant cette représentation objective qu'est la monnaie, sur le terrain inédit d'une critique de l'économie politique. Il donne alors à la notion de reflet un rôle analogique qui lui permet de prendre en charge comme telles des représentations singulières et concrètes. Cette notion d'un genre nouveau est ainsi l'occasion d'une critique continuée de la philosophie qui ne s'élabore jamais en une nouvelle théorie de la connaissance. L'étude de la conception marxienne de la représentation donne bien accès à un style propre d'investigation et de conceptualisation, qui ne rassemble pas ses conclusions en une synthèse définitive mais aborde de façon à la fois ouverte et nettement definie les représentations les plus diverses, et notamment les notions de théorie et de méthode dans leur relation à une pratique transformatrice. La question de la représentation s'y trouve, d'un même mouvement, élaborée, mise en oeuvre et réfléchie<br>The theory of reflex has been for long debated granting marx with the argument that knowledge might be a relevant image of the objective reality. The analysis of this proposition, that started with engels and lenin is still going on till now, allows and requires a coming back to the proper use made by marx of reflex and image notions within the scope of a more general reflexion upon representation. This reflexion leads him from a controversy against the hegelian and neo-hegelian conceits to the elaboration of the ideology concept, pointing out social creation and function of representations within the range of class war in the way of capitalist production. Emphasizing the proper dynamism of these representations, marx has overcome the inherent tensions in his type of ideology, studying this objective representation : money, upon the original ground of criticism of political economy. Hence he gives an analogical role to the reflex notion allowing it to take into account singular and concrete representations, such as. So, this notion of a new kind bears the opportunity of a proceeding criticism of philosophy wich never builds up into a new theory of knowledge. The study of the marxism conceit of representation does give way to a proper style of investigation and conceptualism, that does not gather its conclusions in an ultimate synthesis but deal - in a way both open and precisily defined - with the most varied representations and in particular with the notions of theory and method within their relationship to a transforming application. Refaisant le parcours du cheminement de la pensée de Karl Marx, et ce, à travers différentes perspectives successives marquant spécifiquement l'évolution de sa pensée, l'objectif est de cerner le moment ou Marx se tourne, d'une manière durable et définitive, vers le versant d'une problématique nouvelle et propre au domaine de l'information dans l'analyse du couple "production-information". Des lors, l'analyse du procès de production capitaliste fait rejaillir des catégories économiques a partir desquelles Marx déploie une analyse intra-catégorielle, inter-catégorielle et extra-catégorielle digne de l'effort en exergue, du même coup, les conflits, les tensions et le paradoxes inhérents et inscrits au cœur de cette problématique comme thesaurus de lecture possible du point de vue de l'information. Pour être les compagnons de la réalité de notre vécu de nos jours, ces conflits, ces tensions et paradoxes au cœur desquels se bat toute l'existence humaine, n'en demeurent pas moins dignes de l'intérêt, et, d'une analyse intra et inter-structurelle d'où procède cette situation de fait qui nous concerne tous encore aujourd'hui, plus que du temps de Marx<br>Going over the course of Karl Marx's thought through different successive points of view that specifically underline his thought, the aim is to grasp the time that Karks Marx's lasting and definite turning point towards the beginning of new problematics specific to the field of information in the analysis of the production-information couple. The analysis of the processing’s of capitalist production consequently throws light on the economic categories from which Marx realizes an intra-categorical, inter-categorical and extra-categorical analysis worthy of efforts, and depicts at the same time, the conflicts, the tensions and the paradox inherent and registered in the heart of the problematics like a thesaurus of a possible reading from the point of view of information. To be the companions of truth, of our experience in our days, these conflicts, these tensions and paradox in the heart of which the whole human existence is fighting still remains interest worthy, and, out of an intra and inter-structural analysis from which emerges this situation in the sense that it concerns us all even today, more than at the time of Marx

Notre travail a porté sur l’évolution du concept d’aliénation dans la pensée marxienne. Le concept d’aliénation sans doute hérité de Hegel et de Feuerbach, a connu sous la plume de Marx sa véritable élévation philosophique. Des tous premiers écrits jusqu’aux œuvres dites de maturité, Marx n’a cessé de réélaborer constamment le fameux concept d’aliénation. Des œuvres philosophiques et politiques, le concept était inscrit dans une perspective critique qui ne permettait pas véritablement à Marx de se débarrasser totalement de l’influence hégéliano-feuerbachienne. Cependant comme nous l’avons montré tout au long de notre travail, au fur et à mesure que les découvertes économiques s’enrichissent, les influences hégéliano-feuerbachiennes même si elles réapparaissent souvent à certains endroits de ses analyses, Marx semble ne plus y accorder davantage d’importance et accole au concept de problèmes, de thèmes nouveaux et riches qui lui permettent non seulement d’élargir son analyse mais surtout de l’approfondir. En gros et en moyenne, contre une lecture biaisée de Althusser et récemment de Bensussan, les travaux de Marx montrent que le concept élevé pour la première fois philosophiquement à partir de 1844, Marx en fait un concept opératoire pour penser la société de façon générale, ne disparaît nullement de même que la problématique qu’il était censé porter. Ainsi dans notre travail, nous avons vivement montré qu’il y a certes reprise dans les œuvres dites de la maturité d’une certaine problématique élaborée dés 1844, mais pas reprise à l’identique. Ce qui nous a permis de voir que la thématique de l’aliénation élaborée en 1844 peut logiquement être réélaborée de nos jours ; la thématique de l’aliénation loin de disparaître à l’époque moderne, refait drastiquement surface, ce qui donne à la réflexion philosophique en particulier et à la réflexion en général, des tâches non négligeables<br>Our work dealt with the evolution of the alienation concept in Marxist thought. The concept of alienation, probably inherited from Hegel and Feuerbach, has known its real philosophical elevation under Marx’s writing. From his earliest writings to his works called maturity, Marx has not stopped re-elaborating the famous concept of alienation. Through Marx’s philosophical and political works, the concept was part of a critical perspective that did not truly get rid of Hegel and Feuerbach’s influence completely. However, as we have shown throughout our work, as the economic discoveries get richer, Hegel and Feuerbach’s influences even though they often reappear in some parts of his analysis, Marx no longer seems to give much more importance to the concept but he tackles new and rich issues which allow him not only to expand its analysis but also to deepen it. On the whole and somehow, against any biased reading of Althusser and recently of Bensussan, the works of Marx show that the concept, truly considered philosophical for the first time from 1844, Marx in fact used the concept to study society in general, does not disappear as well as the focus it was supposed to bear. Thus, in our work, we have strongly shown that there is certainly a rewriting of a focus found in the works called maturity developed in 1844, but the rewriting is not so identical to the former. This has allowed us to see that the theme of alienation produced in 1844 can logically be reworked today; the issue of alienation, far from disappearing in the modern era, has drastically re-appeared and has given significant tasks to philosophy in particular and to thinking in general

La question de l'etat n'a pas recu dans l'oeuvre de marx l'ampleur du developpement des questions economiques, mais on la trouve en permanence a travers cette oeuvre. Partant de hegel et le critiquant marx s'affirme en donnant le role essentiel a la societe civile. L'etat doit deperir et l'instrument de cette operation est la dictature du proletariat qui annonce la separation de l'etat avec la societe civile. Pour l'utopie marxienne la dictature du proletariat, le developpement de la democratie et le deperissement de l'etat, sont trois aspects d'un mouvement unique et constituent le processus dialectique de la revolution<br>Even though marx has not dealt with the problem of the state as extensively as with economic matters, this problem remains present thoughout his work. Dans Marx démocrate, Manuscrit de 1843, Franck FISCHBACH montre que : « la grandeur d’une pensée ne se mesure pas tant à sa capacité d’anticiper sur ce qui devait la suivre, que bien plutôt à sa capacité de rupture à l’égard de ce qui l’a précédé. » Dans cette perspective, j’ai tenté dans ce travail de recherche d’examiner le rapport de Marx avec Feuerbach. Le résultat auquel je suis arrivée à ce stade est que les moments d’influence et de rupture de Marx avec Feuerbach ne sont pas dissociés mais plutôt entremêlés. Si la plupart des lectures antérieures considèrent Feuerbach comme un simple point de passage dans la formation de Marx, ma thèse est de montrer que ce passage n’est pas soumis à une logique linéaire et unilatérale. Bien plus, Marx n’est pas un « héritier direct » de Feuerbach, mais plutôt un adversaire qui n’a jamais cessé de se chamailler avec lui. Le feuerbachisme de Marx n’exprime donc pas sa fidélité à la conception de Feuerbach telle quelle, mais plutôt sa transformation de l’intérieur. Marx est feuerbachien dans la mesure où il a effectivement tenté d’aller au-delà de Feuerbach. Il est en quelque sorte son autre ou du moins il a tenté de l’être dans la mesure où le spectre de Feuerbach a suivi, selon certaines lectures, Marx jusqu’au Capital. Une thèse que je n’ai pas examinée dans le cadre de ce travail dans le sens où je me suis arrêtée, dans l’examen de ce rapport, au niveau de L’Idéologie allemande où je montre que la critique de l’idéologie, chez Marx, trouve sa condition de possibilité dans la critique de Feuerbach<br>In Marx the democrat, Manuscript of 1843, Franck FISCHBACH shows that: “the greatness of a thought is not to be assessed in comparison with its capacity to anticipate what would follow it but rather in comparison with its capacity to break free from what preceded it. ” From this standpoint, I have attempted, in this work of research, to examine the relation of Marx with Feuerbach. The result that I reached at this stage is that the moments of influence and rupture of Marx with Feuerbach are not separated but rather intertwined. If most of the previous readings consider Feuerbach as a mere passage in the education of Marx, my thesis is to show that this passage does not depend on a linear and unilateral logic. Moreover, Marx is not a “direct heir” of Feuerbach, but rather an opponent that has never ceased to argue with him. Therefore, the feuerbachism of Marx does not express its loyalty to the conception of Feuerbach as such, but rather its transformation on the inside. Marx is Feuerbachian to the extent that he actually attempted to go beyond Feuerbach. He is in a way his alter ego or, at least, he attempted to be so to the extent that the spectre of Feuerbach has followed, according to some readings, Marx until the Capital. A thesis that I did not examine in the frame of this work to the extent that I stopped to study this relation at the stage of the German Ideology where I show that the criticism of ideology, with Marx, finds its condition of possibility in the criticism of Feuerbach

Nous distinguons chez Marx trois types d'individu correspondant chacun à trois philosophies politiques distinctes. Le premier individu est libre et doué de raison. On parle alors d'un Humanisme rationaliste-libéral dans lequel l'individu typique est le citoyen grec. Le second individu est l'être générique, héritier de la philosophie de Feuerbach et de Hegel. Ce Naturalisme dialectique prive l'individu de toute liberté et laisse le Genre, i. E. La Nature être la seule volonté qui décide. Le dernier individu est la classe. L'être humain est une personne déterminée socialement et économiquement par une classe sociale donnée (le prolétariat ou la bourgeoisie). L'Histoire, et non l'Homme, règne sur le monde. Il s'agit du Matérialisme historique. L'élaboration de ces trois philosophies correspond aux années 1841-1846. A partir de 1846, quand Marx est convaincu qu'il a trouvé la bonne définition de l'individu et que sa dernière philosophie est la bonne - parce qu'il a " compris " le sens de l'Histoire -, il décide d'appliquer ce qu'il sait à son nouveau champ d'étude : l'économie politique. Ainsi le reste de l'œuvre de Marx doit-il être envisagé à l'horizon de la définition de l'individu donnée dans L'Idéologie allemande, ouvrage écrit à l'âge de 28 ans. Néanmoins, la philosophie politique de Karl Marx se solde par un échec. Son œuvre est minée par la dialectique, platonicienne et hégélienne, qui ruine son ambition politique. En outre, parce qu'il ne reconnaît pas la possibilité de l'acte libre, Marx n'inscrit pas la liberté dans le phénomène politique. Il se révèle être finalement un penseur anti-politique<br>Interested by the conceptions of the individual in Marx's Philosophy, we distinguished three different types belonging to three distinct political philosophies. The first individual, best represented by the Greek citizen, is defined by reason and freedom. We usually talk about "rationalist-liberal humanism". The second individual is the "generic being", heir of Feuerbach's and Hegel's philosophy. This "dialectical Naturalism" deprives the individual of his own liberty and lets the Gender, i. E. Nature, be the only will who decides. The last individual is the class. The human being is considered as a social and economical determinated person belonging to a definite social class (the working class or the bourgeoisie). History, but not Man, reigns over the world. This philosophy is named "historical Materialism". The development of those three philosophies corresponds to the 1841-1846 years. After 1846, when Marx is convinced that he found the good definition of the individual and that his last philosophy is right - because he "understood" the direction of History -, he plans to apply it to his new research field: political economy. Thus, Marx's work following 1846 must be considered through the individual definition he gave in "The German ideology", written when he was 28. Nevertheless, Marx's political philosophy ends in failure. First, his philosophies are undermined by dialectic, inspired by Plato and Hegel, which ruins all Marx's work. Then, because he does not acknowledge the possibility of a free act, Marx does not include liberty within his political philosophy. Finally the German philosopher turns out to be an anti-political thinker
